परमानेंट मैग्नेट (“स्ट्कीम”) के जिजनमाडण सिं धडन स्ट्कीम को मंजरू ी ि े िी ह।ै 1. पष्ठृ भजू म : 1.1 रेयर अर्ड परमानेंट मग्नै ेट्स (आरईपीएम) सिाडजधक िजििाली िाजणजययक रूप से उपलब्ध मैग्नेट्स म ें स े एक ह,ैं िो रेयर अर् ड एजलमेंट्स, मख्ु यतः जनयोजडजमयम (Nd), प्रेिोजडजमयम (Pr) और सैमेररयम (Sm) िाल े एलॉय स े बन े होत े ह।ैं 1.2 आरईपीएम म,ें ससंटड ड जनयोजडजमयम-आयरन-बोरॉन (NdFeB) आरईपीएम सबस े मजबूत और सिाडजधक इस्ट्तेमाल होने िाले मग्नै ेट्स म ें स े एक ह,ैं िो रेयर अर्ड ऑक्साइड (आरईओ) यानी NdPr ऑक्साइड स े बनाए िात े ह।ैं य े आरईपीएम ज़्यािा मग्नै ेरटक ताकत, बेहतरीन परफॉमेंस-टू-िेट रेश्यो और डीमैग्नेटाइिेिन के जलए अच्छा रेजिस्ट्टेंस िेत े ह।ैं 1.3 रेयर अर् ड ओस ड स े ससंटर दकए गए NdFeB आरईपीएम बनाने म ें कई चरण होत े ह,ैं िो रेयर अर् ड (आरई) ओसड की माइसनंग स े िुड़े अपस्ट्रीम प्रोसेस स े िुरू होकर उन्ह ें हाई-प्योररटी रेयर अर्ड ऑक्साइड (आरईओ) म ें ररफाइन करन े 8418 GI/2025 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] तक होते ह।ैं इसके बाि जमडस्ट्रीम प्रोसेस होते ह ैं जिनम ें आरईओ को मेटल्स म,ें मेटल्स को एलॉय म ें और एलॉय को मैग्नेट म ें बिलना िाजमल ह।ै 1.4 इन ससंटर दकए गए NdFeB आरईपीएम का इस्ट्तेमाल कई जरूरी डाउनस्ट्रीम सेक्टसड िैसे इलेजक्रक व्हीकल, ररन्यूएबल एनिी, इलेक्रॉजनक्स, जडफेंस और एयरोस्ट्पेस आदि म ें दकया िाता ह।ै ससंटर दकए गए NdFeB आरईपीएम के उत्पािन में िाजमल प्रदिया का जचत्र िाला ररप्रिे ेंटेिन नीच ेजचत्र 1 म ें दिया गया ह।ै जचत्र 1: रेयर अर्ड ओसड से जसन्टडड दकए गए NdFeB आरईपीएम के उत्पािन में िाजमल प्रदिया 1.5 भारत के पास िजु नया के सबस े बड़े रेयर अर्ड ररजव्सड म ें स े एक ह,ै िो ज़्यािातर तटीय इलाकों म ें ह।ै आईआरईएल (इंजडया) जलजमटेड, िो परमाण ु ऊिा ड जिभाग (डीएई) के तहत एक सीपीएसई ह,ै भारत की एकमात्र कंपनी ह ै िो रेयर अर्ड ओसड की माइसनंग और उन्ह ें आरईओ म ें ररफाइन करने का काम करती ह।ै अभी, इसकी NdPr ऑक्साइड प्रोडक्िन कैपेजसटी 400 एमटीपीए ह ै िो लगभग 1,200 एमटीपीए ससंटडड NdFeB आरईपीएम के उत्पािन को सहयोग कर सकती ह।ै इसके अलािा, आईआरईएल के पास लगभग 500 मीररक टन का NdPr ऑक्साइड का स्ट्टॉक ह।ै इस तरह, आईआरईएल, अभी लगभग 1,500 एमटीपीए आरईपीएम के जिजनमाडण का सहयोग करने की जस्ट्र्जत में ह।ै 1.6 हालांदक भारत के पास माइसनंग, सेपरेिन और ऑक्साइड ररफाइसनंग म ें अपस्ट्रीम क्षमताएं ह,ैं लेदकन ऑक्साइड-टू- मेटल, मेटल-टू-अलॉय और अलॉय-टू-मैग्नेट कन्ििडन के जलए जरूरी इंडजस्ट्रयल-स्ट्केल जमडस्ट्रीम क्षमताओं म ें एक बड़ा अंतर ह।ै इस ििह स,े भारत अभी डाउनस्ट्रीम एप्लीकेिन के जलए अपनी सभी ससंटड ड NdFeB आरईपीएम जडमाडं इम्पोटड करता ह।ै 1.7 इसजलए, रेयर अर् ड ऑक्साइड को ससंटर दकए गए NdFeB आरईपीएम म ें बिलने के जलए एक पूरी घरेल ू आरईपीएम िैल्य ू चेन बनाना भारत की स्ट्रेटेजिक और इंडजस्ट्रयल तरक्की के जलए जरूरी ह।ै इस स्ट्कीम के जररए, भारत सरकार ििे म ें 6,000 एमटीपीए इंटीग्रेटेड आरईओ स े ससंटर दकए गए NdFeB आरईपीएम की जिजनमाडण सुजिधा को बढ़ािा िेना चाहती ह।ै 2. स्ट्कीम की खास बात:ें 2.1 NdPr ऑक्साइड स े ििे म ें बन े ससंटर दकए गए NdFeB आरईपीएम, इस स्ट्कीम के तहत जबिी-संबद्ध प्रोत्साहन और कैजपटल सजब्सडी के जलए पात्र होंगे। 2.2 यह स्ट्कीम ग्लोबल टेंडर इंक्वायरी (िीटीई) यानी एक रांसपेरेंट जबसडंग प्रोसेस के जररए, अनरु ोध प्रस्ट्ताि (आरएफ़पी) िारी करके, पााँच (5) आिेिकों (जिन्ह ें आगे “लाभार्ी” कहा िाएगा) को 6,000 एमटीपीए तक की इंटीग्रेटेड ससंटड ड NdFeB मैग्नेट मैन्युफैक्चररंग कैपेजसटी िेगी। एक लाभार्ी को न्यूनतम एलोकेिन 600 एमटीपीए होगा, िो 100 एमटीपीए के गणु ि म ें1,200 एमटीपीए तक होगा । 2.3 लाभार्ी को (क) ससंटड ड NdFeB आरईपीएम की जबिी पर जबिी-संबद्ध प्रोत्साहन जमलेगा; और (ख) िी गई जिजनमाडण क्षमता स्ट्र्ाजपत करन े के जलए पूंिीगत सजब्सडी जमलगे ी। 2.4 इसके अलािा, न्यूनतम बोली लगान े िाल े तीन चयजनत लाभार्र्डयों को आईआरईएल (इंजडया) जलजमटेड, िो परमाणु ऊिाड जिभाग (डीएई) के तहत एक सीपीएसई ह,ै से NdPr ऑक्साइड की सीजमत आपर्ू तड जनजित होगी।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 2.5 स्ट्कीम का कुल समय 7 िषड होगा, जिसम ें जिजनमाडण सुजिधा स्ट्र्ाजपत करने के जलए 2 िषड का िेस्ट्टेिन पीररयड और ससंटडड दकए गए NdFeB आरईपीएम की जबिी पर इंसेंरटि िेन े के जलए 5 िष ड िाजमल ह।ैं 2.6 इसके अलािा, अगर ससंटडड दकए गए NdFeB आरईपीएम की पहली जबिी िेस्ट्टेिन पीररयड परू ा होने स े पहले िरूु होती ह,ै तो यह अजतररि अिजध 5 िष ड के समय के अलािा जबिी-संबद्ध प्रोत्साहन के जलए पात्र होगा। 3. लाभार्र्यड ों का चयन 3.1 पात्रता: i. स्ट्कीम के जलए आिेिक एक कंपनी, इंटरनिे नल एंरटटी, या कंपजनयों का समूह और/या इंटरनेिनल एंरटटी (“कंसोर्टडयम”) होना चाजहए। कंसोर्टडयम के मामले म,ें सिस्ट्यों म ें स े एक को “लीड पाटडनर” के तौर पर पहचाना िाना चाजहए। लीड पाटडनर की लाभार्ी म ें कम स े कम 51% िेयरधाररता होनी चाजहए। ii. चुने गए आिेिकों को “लाभार्ी” के तौर पर डेजजग्नेट दकया िाएगा। अगर कंसोर्टडयम और/या जििेिी एंरटटी को स्ट्कीम के तहत क्षमता िी िाती ह,ै तो उन्ह ें कंपनीज एक्ट, 2013 के तहत एक एसपीिी बनाना होगा, जिसे भी “लाभार्ी” के तौर पर डेजजग्नेट दकया िाएगा। iii. नटे िर् ड की जरूरत : एजप्लकेंट/लीड पाटडनर के पास कम स े कम नेट िर्ड इस तरह होनी चाजहए: बोली क्षमता (एमटीपीए) न्यनू तम जनिल मल्ू य (करोड़ रुपए) 600 180 700/ 800 245 900/1,000 310 1,100/ 1,200 375 ताजलका 1 – न्यनूतम नटे िर्ड की जरूरत iv. जडटेल्ड एजलजिजबजलटी िाइटेररया आररफ़पी म ेंबताए िाएंगे। 3.2 लाभार्र्डयों को क्षमता और प्रोत्साहन का आिंटन एक पारििी न्यूनतम लागत प्रणाली (एलसीएस) के माध्यम स े दकया िाएगा जिसम ें एक "टू एिनलप" प्रणाली, यानी तकनीकी बोली और जित्तीय बोली िाजमल होगी। 3.3 टेदिकल जबड म,ें आिेिक 600 एमटीपीए स े लेकर ज़्यािा स े ज़्यािा 1,200 एमटीपीए तक की कैपेजसटी के जलए, 100 एमटीपीए के मल्टीपल म ें ("प्रोिेक्ट") जबड कर सकते ह ैं । इसके अनुसार, आिेिक एक जडटेल्ड प्रोिेक्ट ररपोट ड (डीपीआर) िमा करेगा जिसम ें उनकी कजमटेड कैपेजसटी और प्रोिेक्ट िुरू करने की क्षमता िाजमल होगी। डीपीआर का कंटेंट आरएफ़पी म ें बताया िाएगा। एक तकनीकी सजमजत (टीसी) आिेिक की टेदिकल जबड को इिल्ै यूएट करेगी। 3.4 जसफ़ड टेदिकली क्वाजलफाइड एजप्लकेंट्स की फाइनेंजियल जबड खोली िाएगी। फाइनेंजियल जबड म,ें आिेिक मांगे गए इंसेंरटि की रकम (जबिी दकए गए ससंटडड NdFeB मैग्नेट के जलए प्रजत दकग्रा रुपए) बताएगा, जिसकी जलजमट 2,150 रुपए प्रजत दकलोग्राम ह।ै यह इंसेंरटि NdPr ऑक्साइड के स्रोत पर जनभरड नहीं करेगा, यानी यह इंसेंरटि रकम आईआरईएल स े या अपनी व्यिस्ट्र्ा के तहत जलए गए NdPr ऑक्साइड स े बन े ससंटडड NdFeB मैग्नेट्स पर लाग ू होगी । 3.5 सबस े कम इंसेंरटि मांगन े िाली पांच टेदिकली क्वाजलफाइड जबड्स को चनु ा िाएगा (एल1, एल2, एल3, एल4, और एल5)। जबसडगं प्रोसेस खत्म होने के बाि, चुन े गए आिेिकों को लेटर ऑफ़ इंटेंट (एलओआई) िारी दकया िाएगा। 3.6 परफॉमेंस बैंक गारंटी िमा करना: चनु े गए आिेिक/लाभार्ी को स्ट्कीम के तहत अपने जसलेक्िन को कन्फमड करन े के जलए नीच ेिी गई िरों पर परफॉमेंस बैंक गारंटी (पीबीिी) िमा करनी होगी: आिरं टत क्षमता (एमटीपीए) प्रििनड बकैं गारंटी (करोड़ रुपए) 600 20 700/ 800/ 900 30 1,000/ 1,100/ 1,200 40 ताजलका 2 – आिरंटत क्षमता के अनसु ार आिश्यक परफॉमसें बकैं गारंटी जरूरी है4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 3.7 लेटर ऑफ़ अिाड ड (एलओए) िारी करना: आिय-पत्र म ें बताई गई फॉमैजलटीज पूरी होने, पीबीिी िमा करन,े एसपीिी बनाने (अगर जरूरी हो), आदि के बाि, लाभार्ी को लेटर ऑफ़ अिाड ड (एलओए) िारी दकया िाएगा। 4. लाभार्र्यड ों को प्रोत्साहन 4.1 इस स्ट्कीम म ें िो तरह की सहायता की बात कही गई ह,ै यानी जबिी-संबद्ध प्रोत्साहन और कैजपटल सजब्सडी, जिनका जििरण इस तरह ह:ैं 4.2 जबिी सबं द्ध प्रोत्साहन: i. लाभार्ी, पहले सेल्स इनिॉइस की तारीख स े लेकर स्ट्कीम की आजखरी तारीख तक ससंटर दकए गए NdFeB आरईपीएम की जबिी पर जबिी-संबद्ध प्रोत्साहन पान े के जलए पात्र होंगे। लाभार्ी को इंसेंरटि हर अद्ध ड िार्षडक/िार्षडक दिया िाएगा। ii. हर लाभार्ी को जमलने िाल े जबिी-संबद्ध प्रोत्साहन की रकम इस तरह कैलकुलेट की िाएगी: इंसरेंटि की रकम (जबिी-सबंद्ध प्रोत्साहन) = इस समय के िौरान बचे ेगए ससटंर दकए गए NdFeB आरईपीएम की मात्रा (दकग्रा म)ें × बताए गए इंसरेंटि (रुपए प्रजत दकग्रा) स े(गणु ा करके)। iii. लाभार्ी को दिया िान े िाला जबिी-संबद्ध प्रोत्साहन ससंटर दकए गए NdFeB आरईपीएम के नेट सेल्स टनडओिर (िीएसटी के बाि) के 40% तक सीजमत होगा। iv. लाभार्ी आिंरटत क्षमता के िरूु होन े के बाि ही जबिी-संबद्ध प्रोत्साहन पाने के जलए पात्र होगा। v. लाभार्ी को कुल जबिी-संबद्ध प्रोत्साहन नीच े िी गई रकम स ेज़्यािा नहीं होगा: आिरं टत क्षमता (एमटीपीए) जबिी स ेिड़ु े प्रोत्साहन की सीमा (करोड़ रुपए) 600 645 700 753 800 860 900 968 1,000 1,075 1,100 1,183 1,200 1,290 ताजलका 3 – स्ट्कीम के समय के िौरान सल्े स स े िड़ु े प्रोत्साहन पर कैसपगं 4.3 पिूं ी सजब्सडी i. 1 अप्रलै 2025 के बाि दकए गए योग्य जनिेि पर 15% की कैजपटल सजब्सडी, परू ी अलॉटेड कैपेजसटी के चाल ू होने पर लाभार्र्डयों को रीइंबसडमेंट के तौर पर िी िाएगी। 5. लाभार्ी को जमलन े िाली टोटल कैजपटल सजब्सडी इस तरह स ेतय होगी: आिरं टत क्षमता (एमटीपीए) पिूं ी सजब्सडी की सीमा (करोड़ रुपए) 600 75 700 या 800 100 900 या 1,000 120 1,100 या 1,200 150 ताजलका 4 – स्ट्कीम के अतंगतड प्रजत लाभार्ी पिूं ी सजब्सडी की सीमा ii. इस उिेश्य के जलए योग्य जनिेि म ें इन पर दकया गया खचड िाजमल होगा: क. प्लांट, मिीनरी, इदक्वपमेंट और उससे िुड़ी यूरटजलटीज: इसम ें प्लांट, मिीनरी, इदक्वपमेंट और उससे िुड़ी यूरटजलटीज के सार्-सार् टूल्स, डाई, मोल्ड , जिग्स, दफक्स्ट्चर (जिनम ें उनके पाट्सड, एक्सेसरीज, कंपोनेंट और स्ट्पेयर िाजमल ह)ैं पर होने िाला खचड िाजमल होगा, जिनका इस्ट्तेमाल इंिीजनयररंग ररसचड एडं डेिलपमेंट (ईआरएडं डी) और प्रोडक्ट[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 जडजाइन और डेिलपमेंट, मैन्युफैक्चररंग, असेंबली, टेसस्ट्टंग, पैकेसिंग या स्ट्कीम के तहत योग्य प्रोडक्ट (जसन्टड ड NdFeB आरईपीएम) की प्रोसेससंग म ें होता ह।ै इसम ें पैकेसिंग, फ्रेट/रांसपोटड, इंश्योरेंस, और प्लांट, मिीनरी, इदक्वपमेंट और उससे िुड़ी यूरटजलटीज को लगाने और चालू करने पर होने िाला खच ड भी िाजमल होगा। उससे िुड़ी यूरटजलटीज म ें कैजप्टि पािर और एफ्लुएंट रीटमेंट प्लांट, ऑपरेिन एररया म ें जरूरी इदक्वपमटें िैसे क्लीन रूम, एयर कटेन, टेम्परेचर और एयर क्वाजलटी कंरोल जसस्ट्टम, कम्प्रेस्ट्ड एयर, पानी और पािर सप्लाई, और कंरोल जसस्ट्टम िाजमल होंगे। उससे िुड़ी यूरटजलटीज म ें जिजनमाडण से िुड़ा आईटी और आईटीईएस इंफ्रास्ट्रक्चर भी िाजमल होगा, जिसम ें सिडर, सॉफ्टिेयर और ईआरपी सॉल्यूिन िाजमल ह।ैं सभी नॉन-िेजडटेबल टैक्स और ड्यूटी भी ऐसे खचड म ें िाजमल होंगे। ख. अनुसंधान और जिकास (आरएंडडी) पर दकया गया व्यय:: इसम ें जसन्टरड ड NdFeB आरईपीएम स े िड़ु े आरएंडडी और प्रोडक्ट डेिलपमेंट पर कैजपटल खचड िाजमल होगा । "संबंजधत" िब्ि का मतलब जसन्टरडड NdFeB आरईपीएम की जिजनमाडण की पूरी िैल्यू चेन के सभी स्ट्टेि स े होगा। ऐसे खचड में इन-हाउस और कैजप्टि आरएडं डी पर होने िाला खच ड िाजमल होगा, जिसम ें जसन्टरडड NdFeB आरईपीएम की जिजनमाडण की पूरी िल्ै य ू चेन के सभी स्ट्टेि िाजमल होंगे। ऐस े खचड म ें टेस्ट्ट और मेिररंग इंस्ट्ूमेंट्स, टेसस्ट्टंग के जलए इस्ट्तमे ाल होने िाले प्रोटोटाइप, जडजाइन टूल्स की खरीि, सॉफ्टिेयर कॉस्ट्ट (सीधे आरएंडडी के जलए इस्ट्तेमाल होने िाल)े और लाइसेंस फीस, टेिोलॉिी पर खचड, आईपीआर, आरएडं डी के जलए पेटेंट और कॉपीराइट िाजमल होंगे। सभी नॉन-िेजडटेबल टैक्स और ड्यूटी ऐसे खचड म ें िाजमल होंगे। ग. प्रौद्योजगकी हस्ट्तांतरण (टीओटी) समझौतों से संबंजधत व्यय: इसम ें ससंटर दकए गए NdFeB आरईपीएम की जिजनमाडण स े िुड़ी टेिोलॉिी की लागत और िुरुआती टेिोलॉिी खरीि िाजमल होगी । सभी नॉन-िेजडटेबल टैक्स और ड्यूटी ऐसे खचड म ें िाजमल होंगे। इस स्ट्कीम के तहत सेकंड-हडैं /इस्ट्तेमाल दकए गए/ररफर्बडश्ड प्लांट, मिीनरी, उपकरण, यूरटजलटीज या अनुसंधान एि ं जिकास उपकरण या पररसंपजत्तयों की अनुमजत नहीं होगी। इसके अलािा, स्ट्लपं सले के जररए खरीिे गए या लीज पर जलए गए उपयिुड बताए गए पररसंपजत्तयों को भी इस स्ट्कीम के तहत अनुमजत नहीं िी िाएगी। 5.1 कच्च े माल की आपर्ू त ड i. आईआरईएल (इंजडया) जलजमटेड एल1, एल2, और एल3 लाभार्ी को कुल 500 एमटीपीए NdPr ऑक्साइड िेगा। यह एलोकेिन इस तरह होगा: एल1 को 200 एमटीपीए, एल2 को 167 एमटीपीए, और एल3 लाभार्ी को 133 एमटीपीए – िो लगभग 1,500 एमटीपीए ससंटर दकए गए NdFeB मग्नै ेट प्रोडक्िन के जलए काफी होगा। ii. बाकी ससंटर NdFeB आरईपीएम प्रोडक्िन कैपेजसटी के जलए, लाभार्ी अपने खुि के इंतजाम के तहत NdPr ऑक्साइड का इंतजाम करेंगे। उिाहरण के जलए, अगर एल1 लाभार्ी को ससंटर NdFeB आरईपीएम की 1,200 एमटीपीए की कैपेजसटी िी िाती ह,ै तो आईआरईएल को दिया गया NdPr ऑक्साइड (200 एमटीपीए) लगभग ससंटर NdFeB आरईपीएम के 600 एमटीपीए प्रोडक्िन म ें सहायता करेगा। NdPr ऑक्साइड की बाकी 200 एमटीपीए की जरूरत एल1 लाभार्ी अपन े सोसड स े पूरी करेगा। इसके अलािा, एल4 और एल5 लाभार्ी को NdPr ऑक्साइड की पूरी जरूरत अपने सोसड से परू ी करनी होगी । 6. सजं ितरण तत्रं 6.1 जबिी-संबद्ध प्रोत्साहन : सेल्स सलंक्ड इंसेंरटि पाने के जलए, लाभार्ी को हर छह महीन/े सालाना आधार पर ससटं र दकए गए NdFeB मैग्नेट्स की जबिी के स्ट्टैच्युटरी ऑजडटर सर्टडदफकेट, मैनेिमेंट सर्टडदफकेट, ऑजडटेड सेल्स इनिॉइस, ई-िे जबल, िीएसटी ररकंजसजलएिन आदि िमा करना होगा। लाभार्ी को जमलने िाले इंसेंरटि को कैलकुलेट करने के जलए इसी का इस्ट्तेमाल दकया िाएगा। 6.2 कैजपटल सजब्सडी : कैजपटल सजब्सडी पाने के जलए, लाभार्ी को ये िमा करना होगा- i. संबंजधत इंडस्ट्रीज जडपाटडमेंट और चाटडड ड इंिीजनयर, िोनों स े एक सर्टडदफकेट िो NdPr ऑक्साइड स े ससंटड ड NdFeB मैग्नेट्स की पूरी तय कैपेजसटी के चालू होने को सर्टडफ़ाई करता हो , जिसम ें सभी बीच के प्रोसेस िाजमल हों। ii. स्ट्टैच्युटरी ऑजडटर स े कोऑर्डडनिे न और टेदिकल ब्रीफ तैयार करने िैसे प्रिासजनक कामों म ें एसएमसी और टीसी की सहायता करना। iv. स्ट्कीम को आसानी स े लाग ू करना, आिेिकों के सामन े आने िाली मुजश्कलों को िरू करना और संसाधनों का उपयुि इस्ट्तेमाल सुजनजित करना। v. जबिी-संबद्ध प्रोत्साहन और कैजपटल सजब्सडी के संजितरण के िािों की िांच करना। vi. जबड डॉक्यूमेंट्स को अंजतम रूप िेन े और लेटर ऑफ़ अिाड ड िारी होने तक सहयोग िेन े के जलए NOTIFICATION New Delhi, the 15th December, 2025 SCHEME TO PROMOTE MANUFACTURING OF SINTERED RARE EARTH PERMANENT MAGNET S.O. 5800(E).—The Government has approved the Scheme to Promote Manufacturing of Sintered Rare Earth Permanent Magnet (“the Scheme”) with a budgetary outlay of ₹7,280 crore. 1. Background: 1.1 Rare Earth Permanent Magnets (REPMs) are one of the most powerful commercially available magnets made from alloys that include rare earth elements, primarily Neodymium (Nd), Praseodymium (Pr) and Samarium (Sm). 1.2 Within REPMs, sintered Neodymium-Iron-Boron (NdFeB) REPMs are one of the strongest and most widely used magnets which are manufactured from rare earth oxides (REOs) viz. NdPr oxide. These REPMs offer high magnetic strength, excellent performance-to-weight ratio and good resistance to demagnetization. 1.3 The production of sintered NdFeB REPMs from Rare Earth Ores involves a large number of steps, starting with upstream processes involving mining of rare earth (RE) ores to refining them into high-purity rare earth oxides (REOs). This is followed by midstream processes involving conversion of REOs to metals, metals to alloys, and alloys to magnet. 1.4 These sintered NdFeB REPMs are used in several essential downstream sectors such as electric vehicles, renewable energy, electronics, defence & aerospace, etc. Pictorial representation of process involved in production of sintered NdFeB REPM is provided in Figure 1 below.10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Figure 2: Process involved in production of sintered NdFeB REPM from Rare Earth Ores 1.5 India has one of the world’s largest rare earth reserves mostly located in coastal regions. IREL (India) Ltd., a CPSE under the Department of Atomic Energy (DAE) is the only company in India that is engaged in the mining of rare earth ores and refining these into REOs. At present, its NdPr Oxide production capacity is 400 MTPA which can support the production of approximately 1,200 MTPA of sintered NdFeB REPM. Further, IREL has a stock of NdPr Oxide of ~500 MT. Thus, IREL, at present, is in a position to support manufacturing of around 1,500 MTPA of REPM. 1.6 While India possesses upstream capabilities in mining, separation and oxide refining, there is a notable gap in the industrial-scale midstream capabilities needed for oxide-to-metal, metal-to-alloy and alloy-to-magnet conversion. Due to this, India currently imports all its sintered NdFeB REPM demand for downstream applications. 1.7 Therefore, building a complete domestic REPM value chain of converting rare earth oxide into sintered NdFeB REPM is essential for India’s strategic and industrial advancement. Through this Scheme, the Government of India intends to incentivize setting up of 6,000 MTPA of integrated REO to sintered NdFeB REPM’s manufacturing facilities in the country. 2. Salient features of the Scheme: 2.1 Indigenously produced sintered NdFeB REPMs from NdPr oxide shall be eligible for sales-linked incentives and capital subsidy under the Scheme. 2.2 The Scheme will allocate up to 6,000 MTPA of integrated sintered NdFeB magnet manufacturing capacity to five (5) applicants (hereinafter called the “Beneficiary(ies)”) through a transparent bidding process viz. Global Tender Enquiry (GTE), by issuing a Request for Proposal (RFP). Minimum allocation to a Beneficiary will be 600 MTPA going up to a maximum allocation of 1,200 MTPA, in multiples of 100 MTPA. 2.3 The Beneficiaries will receive (a) sales-linked incentive on sale of sintered NdFeB REPM; and (b) capital subsidy for setting up the allocated manufacturing capacity. 2.4 Further, three selected Beneficiaries with the lowest bids would receive an assured limited supply of NdPr oxide from IREL (India) Ltd., a CPSE under the Department of Atomic Energy (DAE). 2.5 The total duration of the Scheme will be 7 years, which includes 2 years of gestation period for setting up the manufacturing facilities and 5 years for incentive disbursement on sale of sintered NdFeB REPM. 2.6 Further, in case the first sale of sintered NdFeB REPM commences prior to the completion of the gestation period, then this additional period will also be eligible for sales-linked incentive over and above the 5 year duration. 3. Selection of Beneficiaries 3.1 Eligibility: i. An Applicant for the purpose of the Scheme should be a company, international entity, or a group of companies and/or international entities (“Consortium”). In case of a consortium, one of the members must be identified as a “Lead Partner”. The Lead Partner shall have a shareholding of not less than 51% in the Beneficiary.[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 11 ii. The selected applicants will be designated as the “Beneficiary”. In case the consortium and/or foreign entity(ies) are allocated capacity under the Scheme, they would be required to form an SPV under the Companies Act, 2013 which will also be designated as the “Beneficiary”. iii. Detailed eligibility criteria will be specified in the RFP. 3.2 The allocation of capacity and incentive to Beneficiaries shall be carried out through a transparent Least Cost System (LCS) which shall comprise a “two-envelope” system, i.e., technical bid and financial bid. 3.3 In the technical bid, the Applicants may bid for capacity from 600 MTPA up to a maximum of 1,200 MTPA, in multiples of 100 MTPA (the “Project”). Accordingly, the applicant shall submit a Detailed Project Report (DPR) which will include their committed capacity and capability to undertake the Project. Contents of the DPR will be specified in the RFP. A Technical Committee (TC) will evaluate the technical bid of the Applicants. 3.4 The financial bid of only the technically qualified Applicants shall be opened. In the financial bid, Applicant will quote the amount of incentive sought (₹ per kg of sintered NdFeB magnet sold), capped at ₹ 2,150 per kilogram. This incentive sought shall be agnostic to the source of NdPr oxide i.e. this incentive amount will be applicable to sintered NdFeB magnets produced from NdPr oxide sourced from IREL or under own arrangement. 3.5 Five responsive technically qualified bids with the lowest incentive sought will be selected (L1, L2, L3, L4, and L5). After conclusion of the bidding process, a Letter of Intent (LoI) will be issued to the selected applicants. 3.6 Submission of Performance Bank Guarantee: The selected applicants/ Beneficiaries shall submit a Performance Bank Guarantee (PBG) at the following rates to confirm their selection under the Scheme: Allocated capacity (MTPA) Performance Bank Guarantee (₹ crore) 600 20 700/ 800/ 900 30 1,000/ 1,100/ 1,200 40 Table 2 – Performance Bank Guarantee required as per allocated capacity 3.7 Issuance of Letter of Award (LoA): Post completion of formalities spelt out in the LoI, submission of PBG, formation of SPV (if required), etc., a Letter of Award (LoA) will be issued to the Beneficiary. 4. Incentive to the Beneficiaries 4.1 The Scheme envisages two kinds of support viz. sales-linked incentive and capital subsidy, whose details are as follows: 4.2 Sales-linked incentive: i. The Beneficiaries shall be eligible to receive sales-linked incentive on sale of sintered NdFeB REPM from the date of first sales invoice till the terminal date of the Scheme. Incentives shall be disbursed to the Beneficiaries on a half-yearly/annual basis. ii. The amount of sales-linked incentive payable to each Beneficiary would be calculated as follows: Amount of incentive (sales-linked incentive) = Quantity of sintered NdFeB REPM sold (in kg) during the period × (multiplied by) quoted incentive (₹/kg) iii. The sales-linked incentive disbursed to the Beneficiary shall be capped at 40% of the net sales turnover (net of GST) of the sintered NdFeB REPM.12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] iv. The Beneficiary shall be eligible to receive sales-linked incentive only after commissioning of the allocated capacity. v. A capital subsidy of 15% on eligible investment made after 1st April 2025 shall be provided to the Beneficiaries as reimbursement upon the commissioning of the entire allocated capacity. ii. Eligible investment for this purpose shall include expenditure incurred on: a. Plant, Machinery, Equipment and Associated Utilities: This shall include expenditure on plant, machinery, equipment and associated utilities as well as tools, dies, moulds, jigs, fixtures (including parts, accessories, components and spares thereof) of the same, used in the engineering research & development (ER&D) and product design and development, manufacturing, assembly, testing, packaging or processing of the eligible product under the Scheme (sintered NdFeB REPM). It shall also include expenditure on packaging, freight/transport, insurance, and erection and commissioning of the plant, machinery, equipment, and associated utilities. Associated utilities would include captive power and effluent treatment plants, essential equipment required in operations area such as clean rooms, air curtains, temperature and air quality control systems, compressed air, water and power supply, and control systems. Associated utilities would also include IT and ITES infrastructure related to manufacturing including servers, software, and ERP solutions. All non- creditable taxes and duties would also be included in such expenditure. b. Expenditure incurred on Research and Development (R&D): This shall include capital expenditure on R&D and product development related to sintered NdFeB REPM. The term “related” shall refer to all stages in the entire value chain for manufacturing of sintered NdFeB REPM. Such expenditure shall include expenditure on in-house and captive R&D, including all stages in the entire value chain of manufacturing of sintered NdFeB REPM. Such expenditure shall include test and measuring instruments, prototypes used for testing, purchase of design tools, software cost (directly used for R&D) and license fee, expenditure on technology, IPR, Patents and Copyrights for R&D. All non- creditable taxes and duties would be included in such expenditure.[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 13 c. Expenditure related to Transfer of Technology (ToT) Agreements: This shall include cost of technology and initial technology purchase related to manufacturing of sintered NdFeB REPM. All non-creditable taxes and duties would be included in such expenditure. Second-hand/ used/ refurbished plant, machinery, equipment, utilities or Research & Development equipment or assets shall not be allowed under the Scheme. Further, above mentioned assets acquired through slump sale or leased assets shall also not be permitted under the Scheme. 4.4 Raw material supply i. IREL (India) Ltd. will allocate a total of 500 MTPA of NdPr oxide to the L1, L2, and L3 Beneficiaries. The allocation will be as follows: 200 MTPA to L1, 167 MTPA to L2, and 133 MTPA to L3 Beneficiaries – which will be sufficient for around 1,500 MTPA of sintered NdFeB magnet production. ii. For the remaining sintered NdFeB REPM production capacity, the Beneficiaries will arrange for NdPr oxide under their own arrangement(s). For example, if the L1 Beneficiary is awarded a capacity of 1,200 MTPA of sintered NdFeB REPM, then IREL allocated NdPr oxide (200 MTPA) will support production of around 600 MTPA of sintered NdFeB REPM. The balance requirement of 200 MTPA of NdPr oxide shall be arranged by the L1 Beneficiary through its own sources. Further, the L4 and L5 Beneficiaries shall have to arrange for the entire NdPr oxide requirement from their own sources. 5. Disbursement Mechanism 5.1 Sales-linked Incentive: To avail sales linked incentive, the Beneficiaries shall submit statutory auditor certificate, management certificate, audited sales invoices, e-way bills, GST reconciliation, etc. for sale of sintered NdFeB magnets on a half yearly/annual basis. The same shall be used to calculate the incentive payable to the Beneficiary. 5.2 Capital Subsidy: In order to avail capital subsidy, the Beneficiaries shall submit- i. A certificate both from concerned Department of Industries and Chartered Engineer certifying the commissioning of entire allocated capacity of sintered NdFeB magnets from NdPr oxide, including all intermediate processes therein. ii. A certificate from Statutory Auditor certifying the commencement of sale and capitalization of the assets in books. 5.3 MHI may seek additional data, clarification, or documents, as deemed appropriate, for examining and processing of incentive/ subsidy claim. Further, MHI may appoint an Independent Engineer (IE) to verify claims made by Beneficiaries. 6. Scheme milestones 6.1 The Beneficiary must achieve the following milestones under the Scheme: i. Milestone 1: Achieve eligible investment of ₹150 crore within one year from the date of issuance of LoA. ii. Scheme outlay 7.1 The total financial outlay of the Scheme will be ₹7,280 crore. Scheme Monitoring Committee (SMC) 8.1 An inter-ministerial Scheme Monitoring Committee chaired by Secretary, MHI will be constituted for overall monitoring and implementation of the Scheme as well as to remove any obstacles/ difficulties that may arise in the implementation stage. The SMC will conduct a periodic review of the performance of the Scheme. The composition of the SMC is provided at Annexure-A. 9. Technical Committee (TC) 9.1 A Technical Committee (TC) will be constituted to provide inputs on preparation of bidding documents and evaluation of the bids. The TC will also conduct a quarterly review of the performance of the Scheme. The composition of the TC is provided at Annexure-B. 10. Project Management Agency (PMA) 10.1 The Scheme shall be implemented through a PMA, which shall be responsible for providing secretarial, managerial and implementation support and carrying out other responsibilities, as assigned by MHI from time to time. PMA would inter-alia be responsible for: i. Development & maintenance of online portal for the Scheme. ii. Preparation and issuance of standard operating procedure (SOP) for processing of incentive claims. iii. Assisting the SMC and TC in administrative tasks such as documentation, meeting coordination and preparation of technical briefs. iv. Ensuring smooth execution of the Scheme, addressing challenges faced by applicants and ensuring proper utilization of resources. v. Examining the claims for disbursement of sales-linked incentives and capital subsidy. vi. Hiring of techno-financial and legal consultants for finalizing the bid documents and providing support till the issuance of Letter of Award. vii. Hiring of Independent Engineer (IE). viii. Conducting a detailed analysis of each project's status in terms of technical, financial, and operational aspects. ix. Preparing and submitting reports summarizing the overall progress of the Scheme to MHI. x. Provide recommendations to strengthen forward and backward linkages for Beneficiaries during Scheme implementation. xi. Prepare quarterly review reports (QRRs) which will include progress reports from Beneficiaries on the following KPIs, including but not limited to:[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 15 a) Project Phases and Milestones b) Infrastructure Development c) Technology Integration d) Human Resources e) Risk Management 11. Misrepresentation/ Breach of commitments 11.1 In case of any misrepresentation or failure to meet milestones or any other obligations as specified in the RFP by the Beneficiary, suitable penalty provisions including, but not limited to, encashment of the Performance Bank Guarantee (PBG), revocation of the Letter of Award, and the forfeiture of the entire incentive package will be applicable. 11.2 If MHI is satisfied that eligibility under the Scheme and/ or benefits availed under the Scheme have been obtained by misrepresentation of facts or falsification of information, MHI will ask the Beneficiary to refund any benefit obtained under the Scheme along with interest calculated at 3 years‘ SBI Marginal cost of funds- based lending rate (MCLR) prevailing on the dates of availing benefits, compounded annually, after giving an opportunity to the Beneficiary of being heard. This will be in addition to MHI’s right to take any other action as deemed fit. 12. Resolution of Disputes Any dispute under this Scheme shall be resolved by mutual discussion and reconciliation. In case of difference of opinion, decision of Additional Secretary/ Joint Secretary, MHI shall be final. The jurisdiction in respect of any disputes that may arise under this Scheme shall lie at the Courts/Tribunals in New Delhi, India only. 13. Power to modify the Scheme The Empowered Group of Secretaries (EGoS) chaired by Cabinet Secretary shall be fully empowered to make any changes/ modifications/ amendments required in the Scheme parameters for its smooth implementation, within the overall Scheme outlay of ₹ 7,280 crore.
