L.-33004/99 सी.जी.-डी.एल.-अ.-04012023-241669 xxxGIDHxxx CG-DL-E-04012023-241669 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 31] नई दिल्ली, बुधिार, िनिरी 4, 2023/पौष 14, 1944 No. 31] NEW DELHI, WEDNESDAY, JANUARY 4, 2023/PAUSHA 14, 1944 मजिला और बाल जिकास मत्रं ालय अजधसचू ना नई दिल्ली, 4 िनिरी, 2023 का.आ. 34(अ).— सेिाओं या फायिों या सिायदियों के पररिान के जलए पिचान िस्ट्तािेि के रूप म ें आधार का प्रयोग सरकारी पररिान प्रदियाओं को सरल बनाता ि,ै पारिर्ििता और िक्षता लाता ि,ै और फायिाग्राजियों को सुजिधािनक और जनबािध रीजत से उनकी िकिाररयों को प्राप् तकरने म ें सक्षम बनाता ि ै और आधार दकसी की पिचान साजबत करने के जलए कई िस्ट्तािेि प्रस्ट्तुत दकए िान े की आिश्यकता को समाप्त करता ि;ै और, भारत सरकार का मजिला और बाल जिकास मंत्रालय(जिसे इसम ें इसके पश् चात मंत्रालय किा गया ि ै "जमिन िजि" की केंद्रीय सरकार से प्रायोजित अम्ब्रले ा स्ट्कीम के अधीन"सम्ब्बल" और"सामर्थयि" नामक िो उप-स्ट्कीमों का संचालन कर रिा ि।ै "सम्ब्बल" उप-स्ट्कीम संरक्षा, सुरक्षा के जलए ि ै िबदक"सामर्थयि" मजिला सिजिकरण के जलए ि।ै जमिन िजि का उद्देश्य संस्ट्थागत और अजभसरण तंत्र के माध्यम स े जमिन मोड म ें मजिलाओं की सरं क्षा, सुरक्षा और सिजिकरण की पिलों को सुिढ़ृ करना ि।ै जमिन िजि के अधीन"सम्ब्बल" और"सामर्थयि" उप-स्ट्कीमों का उद्देश्य िीिन-चि जनरंतरता िजृ िकोण पर मजिलाओं को प्रभाजित करन े िाल े मुद्दों का समाधान करके'मजिला-प्रेररत जिकास' के प्रजत सरकार के िजृिकोण को साकार करना ि।ै यि स्ट्कीम राज्य/संघ िाजसत क्षेत्र की सरकारों(जिसे इसमें इसके पश्च ात कायाि‍ ियन अजभकरणकिा गया ि ै के माध्यम से कायािज‍ित की िा रिी ि;ै और, इस स्ट्कीम के अधीन, संबंजधत मजिलाओं(जिसे इसमें इसके पश् चात फायिाग्रािी किा गया ि ै को स्ट्कीम के मौिूिा मागििििक जसद्ांतों के अनुसार जनम्नजलजखत फायिे दिए िाने ि:ैं 55 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] i. पिले और िसू रे बच्च,े यदि लड़की िो, के जलए स्ट्िास्ट्र्थय अनुकूल व्यििार को प्रेररत करन े के जलए गभाििस्ट्था और बच्चे के ि‍म के कारण मििरू ी के नुकसान की भरपाई करना; ii. सियोग और िानकारी की इच्छुक मजिलाओं कोचौबीस घंटे टोल-फ्री िरू संचार सेिा प्रिान करना; iii. जनिी और सािििजनक िोनों स्ट्थानों पर हिसं ा और संकट स े प्रभाजित मजिलाओं को एक िी स्ट्थान पर एकीकृत सियोग और सिायता प्रिान करना और मजिलाओं के जखलाफ दकसी भी प्रकार की हिसं ा का मुकाबला करने के जलए जचदकत्सा, कानूनी, अस्ट्थायी आश्रय, पुजलस सिायता, मनोिैज्ञाजनक और परामि ि सियोग सजित कई सेिाओं के जलए तत्काल, आपातकालीन और गरै -आपातकालीन पहचं को सुजिधािनक बनाना; iv. िव्यु ािपार की पीजड़त मजिलाओं और करिन पररजस्ट्थजतयों िाली मजिलाओं के जलए एकीकृत राित और पुनिािस गृि। जनिाजसयों को बकैं खातों के माध्यम स े कुछ नकि प्रोत्सािन सजित आश्रय, भोिन, कपड़े, प्राथजमक स्ट्िास्ट्र्थय सुजिधाएं और िैजनक िरूरत की अ‍य आिश्यक िस्ट्तुएं प्रिान की िाएगं ी; v. कामकािी मजिलाओं के जलए डे केयर सुजिधाओं सजित सुरजक्षत और सुजिधािनक रूप स े जस्ट्थत आिास प्रिान करना; vi. मजिला श्रम बल की भागीिारी को बढ़ाने के जलए उत्प्रेरक के रूप म ें जििगु ृि के माध्यम से कामकािी मजिलाओं के बच्चों के जलए सुरजक्षत स्ट्थान प्रिान करना; vii. मजिलाओं द्वारा सरकारी स्ट्कीमों की पहचं और उपयोग म ें सुधार करते हए सामाजिक बिलाि के जलए अनुकूल िातािरण जनर्मित करके मजिलाओं के समग्र सिजिकरण को बढ़ािा िने े के जलए मजिलाओं के जलए स्ट्कीमों और कायििमों के अंतर-क्षेत्रीय अजभसरण को सगु म बनाने िते ु केंद्र स्ट्तरीय, राज्य/ संघ िाजसत क्षेत्रस्ट्तरीयऔर जिला स्ट्तरीयप्रदियाओं को सुिढ़ृ करना; viii. जमिन िजि के अधीन"सम्ब्बल" और"सामर्थयि" उप-स्ट्कीमों के अधीन आने िाले दकसी भी अ‍य फायिों का उपयोग करना। और, पूिोि स्ट्कीमों म ेंभारत की संजचत जनजध से दकए गए आिती व्यय अंतचिजलत ि;ैं अत:, अब,आधार(जित्तीय और अ‍य सिायदियों, फायिों और सेिाओं का लजक्षत पररिान अजधजनयम, 2016 (2016 का18) (जिसे इसमें इसके पश् चात उ‍त अजधजनयम किा गया ि ै की धारा 7 के अनुसरण म,ें केंद्रीय सरकार जनम्न प्रकार से अजधसूजचत करती ि,ै अथाित:्- 1. (क दकसी भी स्ट्कीम के अधीनफायिे प्राप्त करने के इच्छुक प्रत्येक फायिाग्रािी को आधार नबं र का प्रमाण प्रस्ट्तुत करना या लाग ूिोने की जस्ट्थजत में आधार प्रमाणीकरणकराना िोगा। (ख स्ट्कीमों के अधीन फायिा प्राप्त करने के इच्छुक दकसी पात्र फायिाग्रािी, जिसके पास आधार नंबर निीं ि,ै को आधार नामांकन के जलए आिेिन करना िोगा और आधार नामांकन पिचान पत्र प्रिान करना िोगा, परंतु िि उि अजधजनयम की धारा 3 के अनसु ार आधार प्राप्त करन े का िकिार िो और ऐसे व्यजि आधार िते ु नामांकन करान े के जलए दकसी भी आधार नामांकन केंद्र [सूची भारतीय जिजिि पिचान प्राजधकरण की िेबसाइट www.uidai.gov.in पर उपलब्ध] में व् यजिगत रूप से िा सकत े ि।ैं (ग आधार (नामांकन और अद्यतन जिजनयम, 2016 के जिजनयम12 के अनुसार, स्ट्कीम का कायाि‍ियन करन े के जलए उत्तरिायी राज्य सरकार या संघ िाजसत क्षेत्रप्रिासन के जिभाग को उन फायिाग्राजियों के जलए नामांकन सुजिधाएं प्रिान करना अपेजक्षत ि ै जि‍िोंने अब तक आधार के जलए नामांकन निीं कराया ि ै और यदि संबंजधत ब्लॉक या तालुका या तिसील म ें कोई आधार नामांकन केंद्र जस्ट्थत निीं ि,ै तो स्ट्कीम का कायाि‍ियन करने के जलए जिम्ब्मेिार राज्य सरकार या संघ िाजसत क्षेत्रप्रिासन का जिभाग भारतीय जिजिि पिचान प्राजधकरण के जिद्यमान रजिस्ट्रारों के सम‍िय से[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 सुजिधािनक स्ट्थानों पर नामांकन सुजिधाएं प्रिान करेगाया भारतीय जिजिि पिचान प्राजधकरण रजिस्ट्रार बनकर आधार नामांकन सुजिधाएं प्रिान कर सकता ि:ै परंतु दकसी फायिाग्रािी को आधार आबंरटत दकए िान े तक, ऐसे फायिाग्राजियों को जनम्नजलजखत पिचान िस्ट्तािेि प्रस्ट्तुत करन े पर स्ट्कीम के अधीन फायिा दिया िाएगा, अथाति ्:- (क) अगर उसन े नामांकन कराया ि,ै तो उसकी आधार नामांकन पिचान पची, और (ख) जनम्नजलजखत िस्ट्तािेिों म ेंसे कोई एक, अथाित:् i. फोटोयु‍ त बैंक या डाकघर पासबुक, या ii. पैन काड,ि या iii. पासपोट,ि या iv. रािन काड,ि या v. मतिाता पिचान पत्र, या vi. मनरेगा काडि, या vii. दकसान फोटो पासबुक, या viii. मोटर यान अजधजनयम, 1988 (1988 का59) के अधीन लाइसेंहसंग प्राजधकरण द्वारा िारी ड्राइहिंग लाइसेंस, या ix. दकसी रािपजत्रत अजधकारी या तिसीलिार द्वारा आजधकाररक लेटर िडे पर िारी दकए गए ऐसे व्यजि की फोटोयु‍ त पिचान का प्रमाणपत्र, या x. जिभाग द्वारा जनर्िष्ि ट कोई अ‍य िस्ट्तािेि: परंतु उपरोि िस्ट्तािेिों की िांच राज्य सरकार या संघ िाजसत क्षेत्र प्रिासन द्वारा इस प्रयोिन के जलए नाजमत अजधकारी द्वारा की िाएगी। 2. फायिाग्राजियों को सुजिधािनक और परेिानी-मुि फायिा प्रिान करने के जलए, स्ट्कीम का कायाि‍ियन करने के जलए जिम्ब्मेिार राज्य सरकार या सघं िाजसत क्षेत्र प्रिासन का जिभाग, यि सुजनजित करने के जलए सभी आिश्यक व्यिस्ट्था करेगा दक फायिाग्राजियों को स्ट्कीमों के अधीन आधार की िरूरत के बारे म ें िागरूक करन े के जलए मीजडया के माध्यम स े व्यापक प्रचार दकया िाए। 3. सभी मामलों म,ें ििां फायिाग्राजियों के खराब बायोमेरर‍स के कारण या दकसी अ‍य कारण स े आधार प्रमाणीकरण जिफल िो िाता ि,ै जनम्नजलजखत उपचारात्मक तंत्र को अपनाया िाएगा, अथाित:् - क. फफंगरहप्रंट की खराब गुणित्ता के मामले में, प्रमाणीकरण के जलए आईररस स्ट्कैन या फेस ऑथेंरटकेिन सुजिधा अपनाई िाएगी, और जिभाग अपन े कायाि‍ियन अजभकरण के माध्यम स े आईररस स्ट्कैनर या फ ंगर ऑथेंरटकेिन के साथ फ ंगरहप्रंट प्रमाणीकरण से जनबािध रीजत से फायिे का पररिान की व्यिस्ट्था करेगा; ख. फफंगरहप्रंट या आईररस स्ट्कैन या फेस ऑथेंरटकेिन के माध्यम से बायोमेररक प्रमाणीकरण सफल निीं िोन े पर, ििां भी संभि और स्ट्िीकायि िो आधार िन टाइम पासिडि या टाइम-बेस्ट्ड िन टाइम पासिडि द्वारा सीजमत समय जिजधमा‍ यता के साथ मा‍य प्रमाणीकरण, िैसी भी जस्ट्थजत िो, की व्यिस्ट्था की िाएगी; ग. उन सभी अ‍य मामलों में ििां बायोमेररक या आधार िन टाइम पासिडि या टाइम-आधाररत िन टाइम पासिडि प्रमाणीकरण संभि निीं ि,ै स्ट्कीमके अधीन फायिा िास्ट् तजिक आधार पत्र के आधार पर दिया िा सकता ि ै जिसकी प्रामाजणकता आधार पत्र पर मुदद्रत त्िररत प्रजतदिया(‍यआू र कोड द्वारा सत्याजपत की िा सकती ि ै और जिभाग द्वारा अपन े कायाि‍ियन अजभकरण द्वारा सुजिधािनक स्ट्थानों पर ‍यूआर कोड रीडर की आिश्यक व्यिस्ट्था उपलब्ध कराई िाएगी।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 4. यि सुजनजित करने के जलए दक स्ट्कीम के अधीन कोई भी िास्ट्तजिक फायिाग्रािी उ‍ि ें िये फायिों से िंजचत निीं िै, जिभाग अपन े कायाि‍ियन अजभकरण के माध्यम से प्रत्यक्ष फायिा िस्ट्तांतरण जमिन, मंजत्रमंडलसजचिालय, भारत सरकार के कायािलय ज्ञापन सं. डी-26011/04/2017-डीबीटी, दिनांक 19 दिसंबर2017 म ें जनर्ििि अपिाि प्रबधं न तंत्र का पालन करेगा। 5. यि अजधसूचना सभी राज्यों और संघ िाजसत क्षेत्रमें इसके प्रकािन की तारीख से प्रभािी िोगी। [फा. सं. पीएम-13/3/2022-पीएमएमिीिाई] पल्लिी अग्रिाल, संय‍ु त सजचि MINISTRY OF WOMEN AND CHILD DEVELOPMENT NOTIFICATION New Delhi, the 4th January, 2023 S.O. 34(E).—Whereas, the use of Aadhaar as identity document for delivery of services or benefits or subsidies simplifies the Government delivery processes, brings in transparency and efficiency, and enables beneficiaries to get their entitlements to them in a convenient and seamless manner and Aadhaar obviates the need for producing multiple documents to prove one’s identity; And, whereas, the Ministry of Women and Child Development (hereinafter referred to as the Ministry) in the Government of India is administering two sub-schemes namely "Sambhal" and "Samarthya" under the Centrally Sponsored Umbrella Scheme of “Mission Shakti”. "Sambhal" sub-scheme is for the safety, security where as "Samarthya" is for empowerment of women. Mission Shakti aims at strengthening interventions for safety, security and empowerment of women in a mission mode through institutional and convergence mechanism. "Sambhal" and Samarthaya sub-Schemes under Mission Shakti seek to realise the Government’s vision for ‘women-led development’ by addressing issues affecting women on the life-cycle continuum approach and the scheme is being implemented through State and Union Territory Governments (hereinafter referred to as the implementing agency); And whereas, under the Scheme, following benefits to be given (hereinafter referred to as the benefits) to the concerned women (hereinafter referred to as the beneficiaries), as per extant Scheme guidelines, namely: - i. for compensating loss of wages due to pregnancy and childbirth inducing health seeking behaviour for first and second child if girl, ii. to provide toll-free twenty-four hours telecom service to women seeking support and information, iii. to provide integrated support and assistance to women affected by violence and in distress, both in private and public space under one roof and facilitate immediate, emergency and non-emergency access to range of services including medical, legal, temporary shelter, police assistance, psychological and counselling support to fight against any form of violence against women, iv. integrated Relief and Rehabilitation Homes for women victims of trafficking and women in difficult circumstances. The residents shall be provided with shelter, food, clothing, primary health facilities and other essential daily need items including some cash incentives through bank accounts, v. to provide safe and conventionally located accommodation for working women with day care facilities, vi. to provide safe and secure place for children of working women through crèche so as to act as a catalyst for enhancing Female Labour Force Participation, vii. to facilitate inter-sectoral convergence of schemes and programmes meant for women at Centre, State and Union Territories and District level through strengthening the processes that promote holistic empowerment of women by creating an environment conducive to social change by improving access and utilization of government schemes by women; and viii. to avail any other benefits covered under "Sambhal" and "Samarthya" sub-schemes under Mission Shakti.[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 And, whereas, the aforesaid Schemes involves recurring expenditure incurred from the Consolidated Fund of India; Now, therefore, in pursuance of section 7 of the Aadhaar (Targeted Delivery of Financial and other Subsidies, Benefits and Services) Act, 2016 (18 of 2016) (hereinafter referred to as the said Act), the Central Government hereby notifies the following, namely :-(a) Every beneficiary desirous of availing the benefits under any of the Schemes is hereby required to furnish proof possession of a number or undergo Aadhaar authentication in case where mentioned applicable. (b) Any eligible beneficiary desirous of availing the benefits under the Schemes, who does not possess the Aadhaar number, shall have to make application for Aadhaar enrolment and provide aadhaar enrolment Identity Document, provided she is entitled to obtain Aadhar as per sections 3 of the said Act and such individual may visit any Aadhar enrolment Centre [list available at Unique Identification Authority of India website www.uidai.gov.in] to get enrolled for Aadhar. (c) As per regulation 12 of the Aadhar (Enrolment and Update) Regulations, 2016, the Department of the State Government or Union Territory Administrations responsible for implementing the Scheme is required to offer enrolment facilities for the beneficiary who are not yet enrolled for Aadhar and in case there is no Aadhar enrolment centre located in the respective Block or Taluka or Tehsil, the Department of the State Government or Union Territory Administration responsible for implementing the Scheme shall provide enrolment facilities at convenient locations in coordination with the existing Registrars of Unique Identification Authority of India or may provide Aadhar enrolment facilities by becoming Unique Identification Authority of India Registrar : Provided that till the time Aadhar is assigned to either beneficiary, benefits under the Scheme shall be given to such beneficiary to the production of the following identification documents, namely: ---- a. if he has enrolled, his Aadhar Enrolment identification slip, and b. any one of the following documents, namely: - i. Bank or Post Office Passbook with photo; or ii. PAN Card; or iii. Passport; or iv. Ration Card; or v. Voter ID card; or vi. MGMNREGA card; or vii. Kisan Photo passbook; or viii. Driving licence issued by the Licensing Authority under the Motor Vehicles Act, 1988 (59 of 1988); or ix. Certificate of Identity having photo of such person issued by a Gazetted Officer or Tehsildar on an official letter head; or x. Any other document specified by the Department: Provided further that the above documents shall be checked by an officer designated by the State Government or Union Territory Administration for that purpose. 2. In order to provide convenient and hassle-free benefits to the beneficiaries, the Department of the State Government or Union Territory Administration responsible for implementing the Scheme, shall make all the required arrangements to ensure that wide publicity through media shall be given to the beneficiaries to make them aware of the requirement of Aadhar under the Schemes. 3. In all cases, where Aadhar authentication fails due to poor biometrics of the beneficiaries or due to any other reason, the following remedial mechanisms shall be adopted, namely: - (a) in case of poor fingerprint quality, iris scan or face authentication facility shall be adopted for authentication, and the Department through its Implementing Agency shall make provisions for iris scanners or face authentication along with fingerprint authentication for delivery of benefits in seamless manner; (b) in case biometric authentication through fingerprint or iris scan or face authentication is not successful, wherever feasible and admissible authentication by Aadhar One Time Password or Time-based One Time Password with limited time validity, as the case may be, shall be offered;6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (c) in all other cases where biometric or Aadhar One Time Password or Time-based One Time Password authentication is not possible, benefits under the scheme may be given on the basis of physical Aadhar letter whose authenticity can be verified through Quick Response code printed on the Aadhar letter and the necessary arrangement of QR code reader shall be provided at convenient locations by the Department through its Implementing Agency. 4. In order to ensure that no bonafide beneficiary under the Scheme is deprived of their due benefits, the Department through its Implementing Agency shall follow the exception handling mechanism as specified in the Office Memorandum of Direct Benefit Transfer Mission, Cabinet Secretariat, Government of India No. D-26011/04/2017-DBT, dated the 19th December 2017. 5.
