जलए, भारत के रािपत्र, असाधारण म ें प्रकाजित की गई ददनांक 27 मई, 2021 की अजधसूचना सं. 6/5/2021- डीिीटीआर के तहत एक सावािजनक सूचना िारी की। ख. प्रदिया 3. प्राजधकारी न े जनयमावली के जनयम 6 (2) के तहत िांच िूसु करन े के जलए आगे कायावाही िुूस करने स े पूव,ा वतामान पाटनरोधी आवेदन प्राप्त होने के बारे म ेंभारत में संबद्ध देिों के दतू ावासों को अजधसजू चत दकया। 4. प्राजधकारी ने संबद्ध वस्ट् तुओं प के आयातों के संबंध में पाटनरोधी िांच िुूस करने के जलए भारत के रािपत्र, असाधारण म ें प्रकाजित की गई ददनांक 27 मई, 2021 की अजधसूचना सं. 6/5/2021- डीिीटीआर के तहत एक सावािजनक सूचना िारी की। 5. प्राजधकारी ने भारत म ेंसंबद्ध देिों के दतू ावासों, ज्ञात उत् पादकों/ जनयाातकों, ज्ञात आयातकों/ प्रयोक्त ाओं प और घरेल ू उद्योग के साथ-साथ घरेल ू उत् पादकों को, आवेदकों द्वारा उपलब्‍ ध कराए गए पतों के अनुसार, िांच िुूस करने की अजधसूचना की एक प्रजत भेिी और उ‍ ह ें जनधााररत की गई समय सीमा के भीतर जलजखत में अपने जवचारों स े अवगत करान े का अनुरोध दकया। 6. प्राजधकारी ने पाटनरोधी जनयमावली के जनयम 6 (3) के अनुसार ज्ञात उत्पादकों/ जनयाता कों और भारत म ें संबद्ध देि से दतू ावास को आवेदन के अगोपनीय पाठ की एक प्रजत प्रदान की। 7. भारत में संबद्ध देिों के दतू ावासों को भी जनधााररत की गई समय-सीमा के भीतर प्रश्नावली का उत्तर देने के जलए उनके देि से जनयाातकों/ उत्पादकों को परामिा देन े का अनुरोध दकया गया था। उत् पादकों/ जनयाातकों को भेिे गए पत्र तथा प्रश् नावली की एक प्रजत भी उ‍ ह ें संबद्ध दिे स े ज्ञात उत्पादकों/ जनयाातकों के नामों और पतों के साथ भेिी गई थी । 8. प्राजधकारी ने जनयमावली के जनयम 6 (6) के अनुसार, जहतबद्ध पक्षकारों को मौजखक रुप स े संबद्ध सूचना प्रस्ट्ततु करने के जलए एक अवसर प्रदान करन े हते ु ददनांक 13 जसतंबर, 2021 को मौजखक सुनावाई आयोजित की । ग. घरेल ूउद्योग स ेप्राि अनरु ोध 9. आवेदकों न े अपन े ददनांक 31 ददसम्बर, 2021 के ईमेल के माध्यम स े जनम्नजलजखत कारणों का उल्लेख करत े हुए िांच को समाि करन ेका अनुरोध करते हुए अपनी याजचका को वापस ली : क. क्षजत मार्जिन के जनधाारण के जलए मालभाडा प्रभारों पर जवचार दकए जबना कोई प्रयोिन हल नहीं होगा। ख. लागत संबंधी कीमत और मांग के संबंध म ें वतामान बािार संरचना पूरी तरह स े अजस्ट्थर और अजनजित ह,ै जिसम ेंइस जस्ट्थजत की अवजध के संबंध में कोई स्ट्पष्टता नहीं ह।ै ग. संयुक्त अरब अमीरात (यूएई) म ें कोई जनमााण सुजवधा नहीं ह ै और आयात दकए िा रह े उत्पाद ईरान के मूल के ह ैं तथा यह समझा िाता ह ै दक पक्षकार अ‍य दिे ों के माध्यम से ईरानी मूल की सामग्री का आयात करने के जलए तैयार ह।ैं घ. प्राजधकारी द्वारा िाचं 10. घरेलू उद्योग द्वारा दकए गए उक्त अनुरोध की िांच की गई ह।ै प्राजधकारी यह नोट करत े ह ैं दक जनयम 14 (क) का पाठ इस प्रकार से ह ै:- जनर्ददष् ट प्राजधकारी सावािजनक सूचना िारी करके कोई िांच तत् काल समाप् त करेंग,े यदद – (क) उसे प्रभाजवत घरेलू उद्योग, जिसके आवेदन पर िांच िुूस की गई थी, से या उसकी ओर से ऐसा करने के जलए जलजखत में आवेदन प्राप् त हो । 11. घरेल ू उद्योग द्वारा िांच वापसी के जलए दकए गए उपरोक्त अनुरोध को देखत े हुए, प्राजधकारी अनेक जहतबद्ध पक्षकारों द्वारा उठाए गए जवजभन्न मुद्दों के समाधान के जलए इस े उजचत नहीं मानते और एतद्द्वारा इस िांच को समाि करत े ह।ैं[भाग I—खण् ड 1] भारत का रािपत्र : असाधारण 3 ङ जनष्क ष ा TERMINATION Subject : Termination of Anti-Dumping Original Investigation concerning imports of “Soda Ash” from United Arab Emirates (UAE) and Russia. F. No. 06/05/2021-DGTR.—A. Introduction 1. As per the Custom Tariff Act,1975 as amended from time to time (hereinafter also referred as the “Act”) and the Custom Tariff (Identification, Assessment and Collection of Anti- dumping Duty on Dumped Articles and for Determination of Injury) Rules,1995 (hereinafter also referred as the “Rules” ),thereof, M/s RSPL, M/s GHCL, and M/s DCW Limited (hereinafter referred to as the „applicants‟ or „applicant companies‟) have filed an application before the Designated Authority (hereinafter referred to as the “Authority”) on behalf of the domestic industry for initiation of antidumping investigation and imposition of anti-dumping duty on imports of “Soda Ash” (hereinafter also referred as the “Product Under Consideration” or “Subject Goods”) originating in or exported from United Arab Emirates (UAE) and Russia. 2. The Authority, based on prima facie evidence submitted by the Applicants, issued a Public Notice vide Notification no. 6/5/2021-DGTR dated 27th May 2021 published in the Gazette of India Extraordinary, initiating the subject investigation in accordance with Rule 5 to determine the existence, degree and effect of any alleged dumping only upon receipt of a written application by or on behalf of the domestic industry. B. Procedure 3. The Authority notified the Embassies of the subject countries in India about the receipt of the present anti-dumping application before proceeding to initiate the investigation as per Rule 6(2) of the Rules. th 4. The Authority issued a public notice vide notification no 6/5/2021-DGTR dated 27 May 2021 published in the Gazette of India Extraordinary, initiating anti-dumping investigation concerning imports of the subject goods. 5. The Authority sent a copy of the initiation notification to the Embassies of the subject countries in India, known producers/exporters, known importers/users and the domestic industry as well as domestic producers as per the address made available by the Applicants and requested them to make their views known in writing within the prescribed time-limit. 6. The Authority provided a copy of the non-confidential version of the application to the known producers/exporters and to the embassy of subject countries in India in accordance with Rule 6 (3).4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC.1] 7. The Embassies of subject countries in India were also requested to advice the exporters/ producers from their country to respond to the questionnaire within the prescribed time limit. A copy of the letter and questionnaire sent to the producer/exporters was also sent to them along with the names and address of the known producers/exporters from the subject country. th 8. The Authority held oral hearing on dated 13 September, 2021 to provide an opportunity to the interested parties to present relevant information orally in accordance with the Rule 6 (6). C. Request Received from Domestic Industry st 9. The Applicants through an email dated 31 December 2021, citing the following reasons withdrew their petition, requesting termination of the investigation: a. Without considering freight charges for determination of injury margin no purpose will be served. b. The current market structure is quite fluid and uncertain as regards the cost price and demand with no clarity of duration of this situation. c. There is no manufacturing facility in UAE and products being imported are of Iranian origin and it is understood that parties are prepared to import Iranian origin material through other countries. D. Examination by Authority 10. The said request made by the domestic industry, has been examined. The Authority notes that Rule 14(a) reads as under The Designated Authority shall, by issue of a public notice, terminate an investigation immediately if- (a) it receives a request in writing for doing so from or on behalf of the domestic industry affected, at whose instance the investigation was initiated. 11. Keeping in view of the request of withdrawal by the domestic industry, the Authority does not consider it appropriate to deal with the various issues raised by several interested parties and hereby, terminates this investigation. E. Conclusion 12. In view of the aforesaid withdrawal made by the domestic industry i.e. M/s RSPL, M/s GHCL, and M/s DCW Limited read with the provisions of Rule 14 (a) of the Rules, the Authority hereby terminates the investigation initiated vide notification no 6/5/2021- DGTR dated 27th May 2021 against the import of “Soda Ash” from United Arab Emirates (UAE) and Russia.
