और, उि प्रारूप जनयमों पर िनता से प्राि आिेपों और सुझावों पर केंद्रीय सरकार द्वारा जवचार दकया गया ह;ै अब, अतः केंद्रीय सरकार सरोगेसी (जवजनयमन) अजधजनयम, 2021 (2021 का 47) की धारा 50 द्वारा प्रित्त िजियों का प्रयोग करत े हुए सरेगेसी (जवजनयमन) जनयम, 2022 म ें और संिोधन करन े के जलए जनम्नजलजखत जनयम बनाती ह,ै अथाित: - 4438 GI/2026 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

1. (1) इन जनयम का संजिि नाम सरोगेसी (जवजनयमन) संिोधन जनयम, 2026 ह ै।

(2) य ेरािपत्र म ें उनके प्रकािन की तारीख को प्रवृत्त होंगे। सरोगेसी (जवजनयमन) जनयम, 2022 म,ें (क) जनयम 10 के पश्चात,् जनम्नजलजखत जनयम अंत:स्ट्थाजपत दकया िाएगा, अथाित ्:- "10क. रजिस्ट्री िल्ु क के संिाय और इसके उपयोग का ढगं - सरोगेसी जललजनक के रजिस्ट्रीकरण के जलए िल्ु क संबंजधत उपयुि प्राजधकारी के आजधकाररक पिनाम के नाम पर खोल े गए बैंक खाते म ें िमा दकया िाएगा और उपयुि प्राजधकारी द्वारा अजधजनयम और तद्धीन बनाए गए जनयमों के उपबंधों के कायािन्वयन से संबंजधत कायिकलापों के संबंध में उपयोग दकया िाएगा। (ख) जनयम 11 के पश्चात,् जनम्नजलजखत जनयम अंतस्ट्थाजपत दकया िाएगा, अथाित ् :- "11क. धारा 12 की उपधारा (3) के अधीन जललजनक के रजिस्ट्री प्रमाण पत्र के नवीकरण की रीजत और रजिस्ट्री के नवीकरण के जलए िल्ु क - (1) रजिस्ट्री प्रमाणपत्र के नवीकरण के जलए आवेिन सरोगेसी जललजनकों द्वारा प्ररूप 3 म ें राष्ट्रीय रजिस्ट्री पोर्िल के माध्यम से उपयुि प्राजधकारी को ऐसे रजिस्ट्री प्रमाणपत्र की समाजि की तारीख से कम से कम साठ दिन पहल े दकया िाएगा।

(2) उपजनयम (1) के अधीन रजिस्ट्री के नवीकरण के जलए प्रत्यके आवेिन के साथ सरोगेसी ललीजनक के जलए एक लाख रुपय े की अप्रजतिेय िुल्क होगी ।

(3) िहा ं दकसी भी सरोगेसी जललजनक के नवीकरण के जलए आवेिन उसके रजिस्ट्री प्रमाण पत्र की समाजि की तारीख स े पहले साठ दिन की अवजध के भीतर प्राि नहीं होता है, प्रारंजभक रजिस्ट्री की ििा म ें यथा लाग ू िो लाख रुपय े की आवेिन िुल्क संित्त करना अपेजित होगा:

परंतु दक सरकार द्वारा संचाजलत संस्ट्थानों म ें स्ट्थापनों के रजिस्ट्री प्रमाण पत्र के नवीकरण के जलए कोई िल्ु क िेन े की आवश्यकता नहीं ह।ै

(4) राष्ट्रीय रजिस्ट्री पोर्िल पर रजिस्ट्री प्रमाण पत्र के नवीकरण के जलए ऑनलाइन आवेिन प्रस्ट्तुत करने के पश्चात्, जललजनक की ओर स ेप्राजधकृत हस्ट्तािरकताि द्वारा सम्यक रूप स ेहस्ट्तािररत भरे हुए आवेिन पत्र का एक पीडीएफ प्प्रंर्आउर् संबंजधत राज्य सरकार या सघं राज्य ित्रे प्रिासन के उपयिु प्राजधकारी को प्रस्ट्तुत दकया िाएगा और नवीकरण के जलए आवेिन पर तभी जवचार दकया िाएगा, जिस तारीख को जवजहत िुल्क के साथ आवेिन की पीडीएफ प्रजत, उपयिु प्राजधकारी को प्राि हो िाएगी।

(5) रजिस्ट्री प्रमाण पत्र के नवीकरण के जलए िल्ु क संबंजधत उपयुि प्राजधकारी के आजधकाररक पिनाम के नाम पर खोल े गए बैंक खाते में िमा की िाएगी और अजधजनयम और तद्धीन बनाए गए जनयमों के उपबंधों के कायािन्वयन से िुडे कायिकलापों के संबंध में उपयिु प्राजधकारी द्वारा उपयोग दकया िाएगा।

(6) रजिस्ट्री प्रमाण पत्र के नवीकरण के जलए आवेिन प्राि होने पर, उपयुि प्राजधकारी साठ दिन की अवजध के भीतर, - (क) जनरीिण करने और स्ट्वयं का समाधान करने के पश्चात् की आवेिक ने अजधजनयम और तद्धीन बनाए गए जनयमों के अधीन जवजहत सभी अपेिाओं का अनपु ालन दकया है, अजधजनयम और तद्धीन बनाए गए जनयमों और जवजनयमों के उपबधं ों के अध्यधीन रहते हुए, प्ररूप 4 म ें यथाजवजनर्ििष्ट जललजनक के रजिस्ट्री के प्रमाण पत्र का नवीकरण करें; या (ख) अजभजलजखत कारणों के जलए ऐसे आवेिन को अस्ट्वीकार करें, यदि वह आवेिन अजधजनयम और तद्धीन बनाए गए जनयमों या जवजनयमों के उपबंधों के अनरूु प नहीं ह:ै[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 परंतु दक रजिस्ट्री के नवीकरण के जलए कोई भी आवेिन, आवेिक को सुनवाई का अवसर दिए जबना अस्ट्वीकार नहीं दकया िाएगा।

(7) यदि दकसी सरोगेसी जललजनक के रजिस्ट्री के नवीकरण के जलए कोई आवेिन उपयुि प्राजधकारी द्वारा अस्ट्वीकार कर दिया िाता ह,ै तो आवेिक द्वारा उसी जललजनक के जलए नवीकरण आवेिन को पुन: प्रस्ट्तुत करने पर कोई िल्ु क संित्त करना अपेजित नहीं होगा, यदि यह यथाजस्ट्थजत अजधजनयम या तद्धीन बनाए गए जनयमों या जवजनयमों, के उपबंधों का अनुपालन करता ह ै

(8) रजिस्ट्री प्रमाण पत्र के नवीकरण या ऐसे नवीकरण के जलए आवेिन की अस्ट्वीकृजत के संबंध में सूचना राज्य बोडि को िी िाएगी।

(9) रजिस्ट्री का नवीकृत प्रमाण पत्र सरोगेसी जललजनक द्वारा अपने कारबार के स्ट्थान पर सहििश्ृ य स्ट्थान पर प्रिर्िित दकया िाएगा।

(10) रजिस्ट्री प्रमाण पत्र का नवीकरण पूवि म ेंदिए गए रजिस्ट्री प्रमाण पत्र की समाजि की तारीख से तीन वर्ि की अवजध के जलए जवजधमान्य होगा। [फा.स. य.ू 11019/15/2022-एचआर(पार्ि)] ऋचा खोडा, संयुि सजचव रर्प्पण: सरोगेसी (जवजनयमन) जनयम, 2022 भारत के रािपत्र, असाधारण, भाग 2, खंड 3, उपखडं (i) संखयांक सा. का. जन. 460 (अ), तारीख 21 िून, 2022 द्वारा प्रकाजित दकए गए थे और तत्पश्चात् संखयांक सा.का.जन. 772 (अ), तारीख 10 अिूबर, 2022, सा. का. जन. 179 (अ), तारीख 14 माच,ि 2023, सा. का. जन. 415 (अ), तारीख 8 िनू , 2023, सा.का.जन. 494 (अ), तारीख 11 िुलाई, 2023 और सा.का.जन. 119 (अ), तारीख 21 फरवरी, 2024 द्वारा संिोजधत दकए गए थे । MINISTRY OF HEALTH AND FAMILY WELFARE (Department of Health Research)

NOTIFICATION New Delhi, the 17th June, 2026 G.S.R.492(E).— Whereas a draft of certain rules further to amend the Surrogacy (Regulation) Rules, 2022 were published in the Gazette of India, Extraordinary, Part II, section 3, sub-section (i) vide number G.S.R. 872(E), dated the 27th November, 2025 as required by sub-section (1) of section 50 of the Surrogacy

(Regulation) Act, 2021 (47 of 2021), inviting objections and suggestions from all person likely to be affected thereby before the expiry of a period of thirty days from the date on which the copies of the Official Gazette containing the said notification was published were made available to public,

And whereas, copies of the said Official Gazette were made available to the public on the 27th November, 2025;

And whereas, objections and suggestions received from the public on the said draft rules have been considered by the Central Government;

Now, therefore, in exercise of the powers conferred by section 50 of the Surrogacy (Regulation) Act, 2021 (47 of 2021), the Central Government, hereby makes the following rules further to amend the Surrogacy

(Regulation) Rules, 2022, namely: -

1. (1) These rules may be called the Surrogacy (Regulation) Amendment Rules, 2026.

(2) They shall come into force on the date of their publication in the Official Gazette.4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

2. In the Surrogacy (Regulation) Rules, 2022,-

(a) After rule 10, the following rule shall be inserted, namely: “10A. Mode of payment of registration fee and its utilisation.-The fee for registration of surrogacy clinic shall be deposited in a bank account opened in the name of the official designation of the appropriate authority concerned and shall be utilised by the appropriate authority in connection with the activities connected with implementation of the provisions of the Act and rules made thereunder.”;

(b) after rule 11, the following rule shall be inserted, namely:- “11A. Manner of renewal of certificate of registration and fee for renewal of registration of clinic under sub-

section (3) of section 12.-(1) An application for renewal of a certificate of registration shall be made by surrogacy clinics in Form 3 to the appropriate authority through the National Registry portal, at least sixty days before the date of expiry of such certificate of registration.

(2) Every application for renewal of registration under sub-rule (1) shall be accompanied with a non- refundable fee of one lakh rupees for surrogacy clinics.

(3) Where an application for renewal of any surrogacy clinic is not received within a period of sixty days before the date of expiry of its certificate of registration, application fee of two lakh rupees as applicable in

case of initial registration shall be required to be paid:

Provided that establishments in the Government-run institutes need not pay any fee for the renewal of certificate of registration.

(4) After submission of the online application for renewal of certificate of registration on the National Registry portal, a PDF printout of the filled-in application form, duly signed by the authorised signatory on behalf of the clinic, shall be submitted to the appropriate authority of the respective State Government or Union territory Administration and the application for renewal shall be considered only from the date the prescribed fee, along with the PDF copy of the application, is received by the appropriate authority.

(5) The fee for renewal of certificate of registration shall be deposited in a bank account opened in the name of the official designation of the appropriate authority concerned and shall be utilised by the appropriate authority in connection with the activities connected with implementation of the provisions of the Act and rules made thereunder.

(6) On receipt of the application for renewal of certificate of registration, the appropriate authority shall within a period of sixty days,-

(a) after inspection and satisfying itself that the applicant has complied with all the requirements prescribed under the Act and rules made thereunder, renew the certificate of registration of the clinic as specified in Form 4, subject to the provisions of the Act and the rules and regulations made thereunder; or

(b) reject such application for reasons to be recorded in writing, if that application does not conform to the

provisions of the Act or the rules or regulations made thereunder:

Provided that no application for renewal of registration shall be rejected without giving an opportunity of being heard to the applicant.

(7) If an application for renewal of registration of any Surrogacy clinic is rejected by the appropriate authority, no fee shall be required to be paid for re-submission of the renewal application by the applicant for the same clinic, if it complies with the provisions of the Act, or the rules or regulations made thereunder, as the case may be.

(8) The intimation with regard to renewal of certificate of registration or rejection of application for such renewal shall be made to the State Board.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5

(9) The renewed certificate of registration shall be displayed by the surrogacy clinic at a conspicuous place at its place of business.

(10) The renewal of certificate of registration shall be valid for a further period of three years from the date of expiry of the certificate of registration earlier granted.”. [F.No. U. 11019/15/2022-HR(Pt.)] RICHA KHODA, Jt. Secy.
