In exercise of the powers conferred by Article 229 (1) and (2) of the Constitution of India and of all other powers hereunto enabling, the Hon’ble the Chief Justice is pleased to make the following amendments to the Madras High Court Service Rules, 2015:- AMENDMENT-I In Rule 14(h) of the Madras High Court Service Rules, 2015, after the existing entries in the para to second proviso, commencing with the words “The members in Category-3 of Division - II, viz., Interpreter. ... “ and ending with the words “ ... Liaison Officer (Protocol).”, the following paragraph shall be added, as a separate para: “The member in Category 4 of Division - II viz., Private Secretary to the Registrar General, also be considered, if his/her Seniority reach the seniority level of members under consideration for such promotion from Category-2 of Division Il viz., Senior Private Secretary to Hon’ble Judges / Private Secretary to Hon’ble Judges / Personal Assistant to the Hon’ble Judges including Personal Assistant to the Hon’ble the Chief Justice and Private Secretary to the Hon’ble the Chief Justice. In such event of promotion of Private Secretary to the Registrar General, he/she shall be accommodated from out of the ratio of ‘1’ allocated to Category-2 of Division II viz., Senior Private Secretary to Hon’ble Judges / Private Secretary to Hon’ble Judges / Personal Assistant to the Hon’ble Judges including Personal Assistant to the Hon’ble the Chief Justice and Private Secretary to the Hon’ble the Chief Justice.” AMENDMENT-II In the Madras High Court Service Rules, 2015, in the existing para to second proviso of Rule 14(h), commencing with the words “However, on such promotion ...” and ending with the words “ ... and Librarian, in that selection”, the words occurring as “categories 1 to 3 of Division II” shall be substituted as “Categories 1 to 4 of Division - II.” AMENDMENT-III In Rule 14(j) of the Madras High Court Service Rules, 2015, after the existing entries, the following entries shall be added:- “The member in Category 4 of Division - II viz., Private Secretary to the Registrar General, also be considered, if his/her Seniority reach the seniority level of members under consideration for such promotion from Category-2 of Division II viz., Senior Private Secretary to Hon’ble Judges / Private Secretary to Hon’ble Judges / Personal Assistant to the Hon’ble Judges including Personal Assistant to the Hon’ble the Chief Justice and Private Secretary to the Hon’ble the Chief Justice. In such event of promotion of Private Secretary to the Registrar General, he/she shall be accommodated from out of the ratio of’ ‘1’ allocated to Category-2 of Division II viz., Senior Private Secretary to Hon’ble Judges / Private Secretary to Hon’ble Judges / Personal Assistant to the Hon’ble Judges including Personal Assistant to the Hon’ble the Chief Justice and Private Secretary to the Hon’ble the Chief Justice.” AMENDMENT-IV Rule 14(1) of the Madras High Court Service Rules, 2015, shall be substituted as follows:- “Promotion to Category-6B of Division-I viz., Sub Assistant Registrar (Insolvents, Accounts) shall be from Category-1 of Division-Il viz. Court Officer/Section Officer / Appeal Examiner, including Section Officer (Property), Court Fee Examiner, Deputy Sheriff and Liaison Officer (Protocol); Category-2 of Division-II viz. Senior Private Secretary to Hon’ble Judges/Private Secretary to Hon’ble Judges/Personal Assistant to the Hon’ble Judges including Personal Assistant to the Hon’ble the Chief Justice and Private Secretary to the Hon’ble the Chief Justice; Category-3 of Division-II viz. Interpreter and Category-4 of Division - II viz., Private Secretary to the Registrar General. The vacancy shall be filled up in rotation from the above said feeder categories, i.e., continuing from the vacancy filled up during immediate preceding selection. However, the members in Category 3 of Division-II viz., Interpreter and Category-4 of Division-II viz., Private Secretary to the Registrar-General shall be considered, only if their seniority reach the seniority level of the members underFeb. 22, 2017] TAMIL NADU GOVERNMENT GAZETTE 11 consideration for such promotion from Category-2 of Division-Il, viz., Senior Private Secretary to Hon’ble Judges / Private Secretary to Hon’ble Judges / Personal Assistant to the Hon’ble Judges including Personal Assistant to the Hon’ble the Chief Justice and Private Secretary to the Hon’ble the Chief Justice. Explanation: (a) If in a particular selection, the staff member from one of the feeder cadre’s viz., Category-1 of Division - II, viz., Court Officer/Section Officer/Appeal Examiner including Section Officer (Property), Court Fee Examiner, Deputy Sheriff and Liaison Officer (Protocol), has been promoted as Sub Assistant Registrar (Insolvents, Accounts), the subsequent promotion to this post, shall be from the next feeder category, viz., Category - 2 of Division - II, viz., Senior Private Secretary to Hon’ble Judges / Private Secretary to Hon’ble Judges / Personal Assistant to the Hon’ble Judges including Personal Assistant to the Hon’ble the Chief Justice and Private Secretary to the Hon’ble the Chief Justice, thereafter from Category- 3 of Division-II viz., Interpreter and thereafter from Category-4 of Division-II viz., Private Secretary to the Registrar General. (b) However, if the seniority level of staff member in either Category-3 of Division - II viz., Interpreter or that of Category-4 of Division - II, viz., Private Secretary to the Registrar General, does not reach the seniority level of the members under consideration for such promotion from Category-2 of Division-Il, viz., Senior Private Secretary to Hon’ble Judges / Private Secretary to Hon’ble Judges / Personal Assistant to the Hon’ble Judges including Personal Assistant to the Hon’ble the Chief Justice and Private Secretary to the Hon’ble the Chief Justice, their turn in the rotation for promotion shall lapse and the rotation in cycle to continue.” AMENDMENT-V In Rule 14(m) of the Madras High Court Service Rules, 2015, after the existing entries, the following shall be added:- “In case, at a given point of time, if less than three vacancies arise, such arising vacancies shall be filled up in rotation, i.e., continuing from the vacancy filled up during the immediate preceding selection. However, members in Category 3 of Division-II viz., Interpreter and Category-4 of Division-II viz., Private Secretary to the Registrar-General shall be considered, only if their seniority reach the seniority level of the members under consideration for such promotion from Category-2 of Division-II, viz., Senior Private Secretary to Hon’ble Judges / Private Secretary to Hon’ble Judges / Personal Assistant to the Hon’ble Judges including Personal Assistant to the Hon’ble the Chief Justice and Private Secretary to the Hon’ble the Chief Justice. In such event of promotion, Category-3 of Division-II, viz., Interpreter, shall be accommodated from out of the ratio of ‘2’ allocated to the Category-1 of Division-Il viz., Court Officer/Section Officer/Appeal Examiner, including Section Officer (Property), Court Fee Examiner, Deputy Sheriff and Liaison Officer (Protocol), and Category-4 of Division-II, viz., Private Secretary to the Registrar General, shall be accommodated from out of the ratio of ‘1’ allocated to the Category-2 of Division - II viz., Senior Private Secretary to Hon’ble Judges / Private Secretary to Hon’ble Judges / Personal Assistant to the Hon’ble Judges including Personal Assistant to the Hon’ble the Chief Justice and Private Secretary to the Hon’ble the Chief Justice.” The above amendments shall come into force with effect from 03-02-2017.
