In exercise of the powers conferred by sub-section (2) of section 242 of the Tamil Nadu Panchayats Act, 1994 (Tamil Nadu Act 21 of 1994), the Governor of Tamil Nadu hereby makes the following rules:- 1. Short title:- These rules may be called the Tamil Nadu Panchayats (Nomination of Person with Disability as Member) Rules, 2025. 2. Definitions.— (1) In these rule, unless the context otherwise requires,— (a) “Act” means the Tamil Nadu Panchayats Act, 1994 (Tamil Nadu Act 21 of 1994); (b) “District Collector” means the Collector of the District concerned; (c) “nominated member” means a person nominated under sub-section (1) of section 32-A of the Act; (d) Words and expressions used in these rules but not defined herein, shall have the meanings respectively assigned to them in the Act. 3. Eligibility for nomination as member in Panchayat.— (1) The person with disability to be nominated under of sub-section (1) of section 32-A as a member of the panchayat shall,— (a) be the resident of the panchayat concerned; (b) be a person with disability; (c) possess a valid disability certificate obtained from the certifying authorities designated under rule 10 of the Tamil Nadu Rights of Persons with Disabilities Rules, 2018; (d) complete twenty first year of age on or before the date of nomination as member of panchayat, Ex-III-1(a)—(335) [1]2 TAMIL NADU GOVERNMENT GAZETTE EXTRAORDINARY 4. Disqualifications.— The disqualification of candidates for being elected as member of panchayat and for being a member, provided under sections 37 and 38 of the Act, shall also be applicable to the nominated member. 5. Procedure for nomination of person with disability as member in panchayats.— (1) Application for nomination.— An Officer appointed by the District Collector / Inspector of Panchayats shall call for application in Form 1 along with an affidavit from among the persons with disability in the panchayat concerned, for nomination as member of the panchayat, by publishing in two local daily newspapers atleast one in vernacular language, having wide circulation in the panchayat by giving at least fifteen days of time for making application and shall forward the same to the District Level Committee. (2) Composition of District Level Committee.— There shall be a District Level Committee consisting of the following members, namely:— (a) The Personal Assistant (Development) to the District Collector who shall be the Chairman; (b) The District Differently Abled Welfare Officer (DDAWO); (c) One member from among the three representatives of the registered organisation in the District Level Committee on Disability nominated under clause (iii) of sub-rule (1) of rule 17 of the Tamil Nadu Rights of Persons with Disabilities Rules, 2018, to be nominated by the District Collector; and (d) The Assistant Director (Panchayats) concerned who shall be the Convenor. (3). Scrutiny of nomination.— (a) The District Level Committee shall on receipt of application, scrutinise and analyse the application based on service and qualification of applicants and forward with its recommendation to the District Collector / Inspector of Panchayats. The District Collector / Inspector of Panchayats on receipt of the District Level Committee recommendation, shall verify the same and nominate the eligible candidate as members of the Panchayats concerned in Form 2. 6. Rights of the nominated members.— The nominated member shall have the rights and responsibilities as provided under section 81 of the Act. 7. Honorarium.— Nominated member shall be entitled to get honorarium and allowances as may be fixed by the Government from time to time.
