No. VI(2)/8(e)/2025. An order to provide for specifications, reservation, choice and allotment of symbols at elections to local bodies in the State of Tamil Nadu and for matters connected therewith. WHEREAS, the superintendence, direction and control of all elections to local bodies in the State of Tamil Nadu are vested in the Tamil Nadu State Election Commission (hereinafter referred to as ‘the State Election Commission’) by the Constitution of India, the Tamil Nadu Panchayats Act, 1994 (Tamil Nadu Act 21 of 1994) and the Tamil Nadu Urban Local Bodies Act, 1998 (Tamil Nadu Act 9 of 1999) (hereinafter referred to as ‘the Acts’); AND WHEREAS, it is necessary and expedient to provide in the interest of purity of elections to the local bodies in the State of Tamil Nadu and in the interest of the conduct of such elections in a fair and efficient manner, for the specification, reservation, choice and allotment of symbols and for matters connected therewith: NOW, THEREFORE, in exercise of the powers conferred by Articles 243-K and 243-ZA of the Constitution of India read with relevant sections of the Acts and rules 33, 34 and 35 of the Tamil Nadu Panchayats (Elections) Rules, 1995, rules 37, 38 and 39 of the Tamil Nadu Urban Local Bodies Rules, 2023 and in supersession of the State Election Commission's S.O.No.2/2022/TNSEC/PE-1, dated 6th January 2022 published at pages 1 to 19 of Part VI—Section 2, Notification No.VI(2)/4(a)/2022 of the Tamil Nadu Government Gazette, Extraordinary No. 24, dated 07th January 2022, and as amended, from time to time, the State Election Commission hereby makes the following Order:- 1. Short title, application and commencement.-(1) This Order may be called the Tamil Nadu Local Bodies Election Symbols (Reservation and Allotment) Order, 2025 (2) It shall apply to all elections held under the Acts. (3) It shall come into force at once. [ 1 ] VI-2 Ex. (225)2 TAMIL NADU GOVERNMENT GAZETTE EXTRAORDINARY 2. Definition and Interpretation.-(1) In this Order, unless the context otherwise requires, - (a) “Contested election” means an election where a poll is taken; (b) “Election” means an election held under the Acts; (c) "Form" means a form appended to this Order; (d) “Free symbol” means a symbol other than a reserved symbol; (e) "Government" means the Government of Tamil Nadu; (f) "Local bodies" means and includes all the Village Panchayats, Panchayat Unions, District Panchayats, Town Panchayats, Municipal Councils and Municipal Corporations; (g) ”Ordinary election” / "General election" means an election held to fill up a vacancy occurring in “Rural Local Bodies” / “Urban Local Bodies” respectively by efflux of time; (h) "Political party" means an association or a body of individual citizens of India registered with the Election Commission of India as a political party under Section 29A of the Representation of the People Act, 1951; (Act No.43 of 1951) (i) “Reserved symbol” means a symbol which is reserved by the Election Commission of India for exclusive allotment to a contesting candidate set up by a recognised political party; (j) “Recognised political parties” means and includes every political party which has been recognised by the Election Commission of India as a National Party or as a State Party in the State of Tamil Nadu under the Election Symbols (Reservation and Allotment) Order, 1968; and (k) “Registered - Unrecognised political party” means and includes (i) every political party which had previously been recognised by the Election Commission of India as a National Party under the Election Symbols (Reservation and Allotment) Order, 1968 and subsequently lost its status as National Party; (ii) every political party which has been recognised by the Election Commission of India as a State Party in any State other than Tamil Nadu under the Election Symbols (Reservation and Allotment) Order, 1968; (iii) every political party having its head office in the State of Tamil Nadu which is registered with the Election Commission of India but not recognised either as a National Party or as a State Party in Tamil Nadu by the Election Commission of India under the Election Symbols (Reservation and Allotment) Order, 1968; and (iv) political parties registered with the Election Commission of India and having their head office in other States and have not been recognized either as a National Party or as a State Party by the Election Commission of India under the Election Symbols (Reservation and Allotment) Order, 1968; provided such parties should make an application to the State Election Commission with its office address in Tamil Nadu, bye-laws, office bearers, etc. (2) Words and expressions used but not defined in this Order but defined in the Tamil Nadu Panchayats Act, 1994 (Tamil Nadu Act 21 of 1994) or the rules made there under or in the Tamil Nadu Urban Local Bodies Act, 1998 (Tamil Nadu Act 9 of 1999) or rules made there under shall have the meaning respectively assigned to them in those Acts and rules. (3) In the absence of such definitions, the Tamil Nadu General Clauses Act, 1891 (Tamil Nadu Act 1 of 1891) shall, as far as may be, apply in relation to the interpretation of this Order as it applies in relation to the interpretation of a Tamil Nadu Act. 3. Notification by the State Election Commission of elections to be held on party-basis.- For the purposes of this Order, the State Election Commission shall, in consultation with the Government, notify from time to time the election or elections which shall be held on party-basis and the election or elections which shall not be held on party-basis. 4. Notification by the State Election Commission of the list of recognised political parties and their symbols, the list of registered - unrecognised political parties and the list(s) of free symbols.- The State Election Commission shall notify from time to time a list of recognised political parties, the symbols respectively reserved for them and a list of registered - unrecognised political parties and the list or lists of free symbols. 5. Allotment of Symbols.- In every contested election, a symbol shall be allotted to a contesting candidate in accordance with the provisions of this Order and different symbols shall be allotted to different contesting candidates. 6. Allotment of Symbols in Elections not held on party-basis.- (1) In every contested election not held on party- basis, symbols shall be allotted to the candidates in the sequence of the symbols in the list of free symbols meant for that election by drawing lots.TAMIL NADU GOVERNMENT GAZETTE EXTRAORDINARY 3 Example.-If election of member of a ward of a Village Panchayat is not held on party-basis and if there are five candidates and if the first five symbols in the list are, say, (1) “Key”, (2)“ Comb”, (3) “Cot”, (4) “Car” and (5) “Conch”, then these five symbols should be taken for allotment and assigned to the five candidates by drawing lots. The candidate whose name is drawn first shall get the symbol “Key” and the candidate whose name is drawn next shall get the symbol “Comb” and so on. If there had been only three candidates in the above example, only “Key”, “Comb” and “Cot” could be allotted in that Order. (2) In such election, the allotment of symbol shall be done only by drawing lots even if the contesting candidates agree among themselves upon their symbols. 7. Allotment of Symbols in Elections held on party basis.- (1) Allotment of symbols to National Parties and Recognised Parties of Tamil Nadu In an election held on party-basis, a candidate set up by a recognised political party shall choose, and shall be allotted, the symbol reserved for that party and no other symbol: Provided that when there are conflicting claims for any such reserved symbol due to defect of substantial character either in the nomination paper or in Form B or Form C filed, none of the claimants shall be allotted that reserved symbol and all the claimants shall be treated as independent candidates and allotted the free symbols left after allotting to all other candidates in that election: Provided further that no reserved symbol shall be sought or allotted in an election, to any candidate other than a candidate set up by a recognised political party to which that symbol has been reserved, even if no candidate has been set up by that recognised political party in that election. (1) A. Concession to candidates set up by a State Party at elections in other States or Union Territories If a Political Party which is recognized as a State Party in some other State or States or Union Territories sets up a candidate at an election in a ward in any Local Body which are held on party basis, then such candidate may, to the exclusions of all other candidates in the said election be allotted the symbol reserved for that party in the State or States in which it is a recognised State Party, notwithstanding that such symbol is not specified in the list of free symbols for such election, on the fulfilment of each of the following conditions, namely:- (a) that an application is made to the State Election Commission by the said party for exclusive allotment of that symbol to the candidate set up by it, not later than the third day after the publication in the Official Gazette of the Notification calling the election or within three days from the date of issue of this Order; (b) that the said candidate has made a declaration in his nomination paper that he has been set up by that party at the election and that the party has also fulfilled the requirements of clauses (b), (c) and (d) of paragraph 8; and (c) that in the opinion of the State Election Commission there is no reasonable ground for refusing the application for such allotment. Provided that nothing contained in the paragraph shall apply to a candidate set up by the said party at an election in any Ward/Local Body where the same symbol is already reserved for some other National or State Party of Tamil Nadu. (1) B. Concession to candidates set up by unrecognised party which was earlier recognised as a National or State party If a Political Party, which is unrecognized at present but was a Recognised National or State Party in the State of Tamil Nadu not earlier than six years from the date of notification of the election sets up a candidate at an election in a ward in any Local body which are held on party basis then such candidate may, to the exclusion of all other candidates in the said election, be allotted the symbol reserved earlier for that party when it was a Recognised National or State party in Tamil Nadu notwithstanding that such symbol is not specified in the list of free symbols for such election, on the fulfilment of each of the following conditions, namely:- (a) that an application is made to the State Election Commission by the said party for the exclusive allotment of that symbol to the candidate set up by it, not later than the third day after the publication in the Official Gazette of the Notification calling the election; (b) that the said candidate has made a declaration in his nomination paper that he has been set up by that party of the election and that the party has also fulfilled the requirements of clauses (b), (c) and (d) of paragraph 8; and (c) that in the opinion of the State Election Commission there is no reasonable ground for refusing the application for such allotment.4 TAMIL NADU GOVERNMENT GAZETTE EXTRAORDINARY Provided that nothing contained in the paragraph shall apply to a candidate set up by the said party at an election in any Ward/Local Body where the same symbol is already reserved for some other National or State Party. (1) C. Concession to candidates set up by registered (unrecognised) political parties and to unrecognized parties which were earlier recognised parties more than 6 years back If a registered unrecognized political party has been allotted with a common symbol in the elections conducted by the Election Commission of India and not cancelled subsequently, the said registered unrecognized political party may request the State Election Commission to continue to allot the same common symbol in the Local Body Elections conducted by the State Election Commission also subject to the following conditions: Provided that if a common symbol allotted by Election Commission of India to one or more registered political parties in different elections prior to Local Body Elections, that common symbol shall be considered for allotment to the party to whom the common symbol were allotted by the Election Commission of India in the recently held Election; Provided further that an application is made to the State Election Commission by the said party for the concession for the allotment of common symbol to the candidates set up by it, not later than the third day after the publication in the Official Gazette of the notification calling the election along with the details of No. of wards / offices in which the said party wishes to get concession for the allotment of common symbol; Provided further that the free symbol allotted as a common symbol shall not be entitled for the candidates set up by the party other than those wards / offices for which the details has been furnished as per para 3 to the State Election Commission under this provision; Provided further that if the party does not set up candidates as furnished, the party shall be liable for such action as the State Election Commission may consider appropriate as per existing laws; Provided further that the free symbol allotted as a common symbol to the candidates of a party under this paragraph shall be available for allotment to candidates set up by the other party or independent candidates in those other wards in which that party has not set up its candidates; and Provided also that notwithstanding anything contained in paragraph 7(1) B, a political party which was earlier a recognized political party and which lost its recognition more than 6 (six) years back will also be eligible under this paragraph to the concession of allotment of the symbol which was earlier reserved for the party as above. (2) Choice of symbol by candidates set by registered - unrecognised political parties and by independent candidates .- Every independent candidate, shall declare in the nomination paper first filed by him or on his behalf, his choice of three free symbols from the list of free symbols for that election indicating the order of his preference. Every candidate who is set up by the registered - unrecognised political party shall declare in the nomination paper first filed by him or on his behalf, his choice of three free symbols collectively from the list of free symbols notified for the party based elections. The symbols shall be allotted in accordance with the procedure laid down below:- (a) The allotment of symbols shall be considered in the order of preference made by the candidates, that is to say, the first preference of the candidates will be considered first, the second preference next and the third preference last: Provided that the allotment of symbols to candidates set up by the registered - unrecognised political parties shall be completed first and only thereafter the allotment of symbol to the independent candidates shall be taken up and allotted from among the remaining free symbols. (b) Where a free symbol has been sought for by only one candidate set up by a registered-unrecognised political party, as his first choice, it shall be allotted to that candidate and to no one else. If any free symbol has been sought for by more than one candidate set up by the registered-unrecognised political parties, the allotment of that symbol shall be decided by drawing a lot among these candidates and the candidate whose name is drawn first shall be allotted that symbol. (c) If any candidate set up by registered - unrecognised political party could not be allotted the symbol sought for in his first preference in the lot, he shall be considered for allotment of the free symbol sought for, as his second preference. Should the second choice of symbol could also not be allotted, due to conflicting claims for that symbol and failure in the lot, he shall be considered for the allotment of the free symbol of his third preference. Even if this could not be allotted, he should be allotted by drawing a lot, any one of the free symbols left after allotting to other candidates set up by the registered - unrecognised political parties in accordance with the procedure set out above. (d) After completing the allotment of free symbols to all the candidates set up by the registered - unrecognised political parties, the remaining free symbols shall be allotted to the independent candidates in accordance with their choice and preference by adopting the procedures for allotment of symbols to candidates set up by the registered - unrecognised political parties. 8. When a candidate shall be deemed to be set up by a political party.- (1) For the purposes of this Order, a candidate shall be deemed to be set up by the political party if, and only if -TAMIL NADU GOVERNMENT GAZETTE EXTRAORDINARY 5 (a) the candidate has enclosed a declaration to that effect in Form C along with the nomination paper; (b) a notice in writing in Form B to that effect has, not later than 3.00 p.m. on the last date for withdrawal of candidature, been delivered to the Returning Officer; (c) the said notice is either signed by the President/Secretary or any other office bearer and who has been authorised by the party in this behalf or any other person who has been authorised by such office bearer, to send the notice; and (d) the communication in Form A with regard to the name and specimen signature of such authorised person are delivered to the Returning Officer not later than 3.00 p.m. on the last date for withdrawal of candidature. (2) (a) The communication in Form A shall be signed by the President/Secretary or any other office bearer and who has been authorised by the party in this behalf to send such communication: Provided where the notice in Form B is signed by any such office bearer authorised by the Party, Form A need not be insisted upon. (b) Form C shall be signed in ink, while printed/cyclostyled/photocopies of Forms A and B with facsimile signature can be presented. 9. When splinter groups or rival groups claim to be that party.- If in an election to the local bodies held on party-basis, rival sections or groups of a recognised political party claim to be that party, the State Election Commission may decide on allotment of symbols to the candidates sponsored by such sections or groups and the State Election Commission's decision shall be final. 10. When two or more recognised political parties amalgamate into a new party.- If in an election to the local bodies held on party-basis, two or more recognised political parties join together to form a new political party but the recognition for it under the Election Symbols (Reservation and Allotment) Order, 1968, is pending before the Election Commission of India, the new party may be allotted by the State Election Commission any of the reserved symbols already allotted to the constituent parties, provided a request in writing for such an allotment is made jointly by the Chief Executive Officers of all the constituent recognised parties. 11. Power of State Election Commission to issue instructions and directions.-The State Election Commission may issue instructions and directions- (a) for the clarification of any of the provisions of this Order; (b) for the removal of any difficulty which may arise in relation to the implementation of any such provision; and (c) in relation to any matter with respect to the reservation and allotment of symbols for which this Order makes no provision or makes insufficient provision, and the provision is, in the opinion of the State Election Commission, necessary for the smooth and orderly conduct of elections. *****6 TAMIL NADU GOVERNMENT GAZETTE EXTRAORDINARY FORM A COMMUNICATION WITH REGARD TO AUTHORISED PERSONS TO INTIMATE NAME OF CANDIDATE SET UP BY THE RECOGNISED POLITICAL PARTY/ REGISTERED – UNRECOGNISED POLITICAL PARTY [See paragraph 8 (1) (d) and 8 (2) (a) of the Tamil Nadu Local Bodies Election Symbols (Reservation and Allotment) Order, 2025] From The President / Secretary / Office bearer, .................................... Secretary, Tamil Nadu State Election Commission.TAMIL NADU GOVERNMENT GAZETTE EXTRAORDINARY 9 தமிழ்நாாடு உள்ளாாட்சி அமைைப்புகளின் தேதர்தலுக்கான சின்னங்கள் (ஒதுக்கீடு ைற்றும் பங்கீடு) ஆமை�, 2025 [S.O.No.10/2025/TNSEC/ME-I, Dated the 6th May 2025.] தமிழ்நாாடு மாாநிலத்தில் உள்ள உள்ளாட்சி அமைமாப்புகளுக்கான தேதர்தல்களுக்கு சின்னங்கள் ஒதுக்கீடு, விருப்தேேற்பு மாற்றும் சின்னங்கமைளப் ேங்கிட்டு அளித்தல் தொதாடர்புமைடய வரன்முமைை ஆமை�. இந்திய அரசியலமைமாப்புச் சட்டத்தின்ேடியும், 1994-ஆம் ஆண்டு தமிழ்நாாடு ஊராட்சிகள் சட்டம் (1994 தமிழ்நாாடு சட்டம் 21) மாற்றும் 1998-ஆம் ஆண்டு தமிழ்நாாடு நாகர்ப்புை உள்ளாட்சிகள் சட்டம் (1999 தமிழ்நாாடு சட்டம் 9) ஆகிய சட்டங்களின்ேடியும் தமிழ்நாாட்டிலுள்ள உள்ளாட்சி அமைமாப்புகளுக்கான அமைனத்து தேதர்தல்களும் "தமிழ்நாாடு மாாநில தேதர்தல் ஆமை�யத்தின் (இனிவரும் இடங்களில் "மாாநில தேதர்தல் ஆமை�யம்" எனக் குறிப்பிடப்ேட்டுள்ளது) தேமாற்ோர்மைவயிலும், இயக்கத்திலும், கட்டுப்ோட்டிலும் நாமைடதொேை தொோறுப்பு அளிக்கப்ேட்டுள்ளதாலும், தமிழ்நாாடு மாாநிலத்திலுள்ள உள்ளாட்சி அமைமாப்புகளுக்கான தேதர்தல்கள் நியாயமாாகவும், தேநார்மைமாயாகவும், திைமைமாயாகவும் நாமைடதொேை அதன் தொதாடர்புமைடய தேதர்தல் சின்னங்கள் குறித்த வரன்முமைைகள், ஒதுக்கீடு, விருப்தேேற்பு மாற்றும் சின்னங்கமைளப் ேங்கிட்டு அளித்தலுக்கு வமைக தொசய்து தொகாடுத்தல் இன்றியமைமாயாதது ஆகும். ஆகதேவ, இந்திய அரசியலமைமாப்பின் பிரிவுக்கூறுகள் 243 K மாற்றும் 243 ZA ேடி, அதனுடன் சம்ேந்தப்ேட்ட சட்டப்பிரிவுகளின்ேடியும் மாற்றும் 1995-ஆம் ஆண்டு தமிழ்நாாடு ஊராட்சிகள் (தேதர்தல்கள்) விதிகளில் விதிகள் 33, 34 மாற்றும் 35-ன்ேடியும், 2023-ஆம் ஆண்டு தமிழ்நாாடு நாகர்ப்புை உள்ளாட்சிகள் விதிகளில், விதிகள் 37, 38 மாற்றும் 39-ன்ேடியும் வழங்கப்ேட்ட அதிகாரத்திற்குட்ேட்டும், மாற்றும் தமிழ்நாாடு மாாநில தேதர்தல் ஆமை�யத்தின் சட்டப்பூர்வ ஆமை� எண்.2/2022/தநாாமாாதேதஆ/ஊதேத-1, நாாள் 6.1.2022 ததமிமிழ்ழ்நாநாாாடுடு அஅரரசிசிததழ்ழ் சிைப்பு தொவளியீடு எண்.24, நாாள் 07.01.2022-ல் ோகம் VI-ல் பிரிவு 2 அறிவிக்மைக எண். VI(2)/4(a)/2022 ேக்கம் 1-19-ல் தொவளியிடப்ேட்ட அறிவிக்மைகயிமைன அகற்றி அதற்குப்ேதிலாக மாாநில தேதர்தல் ஆமை�யம் கீழ்வரும் தொசயல் ஆமை�மையப் பிைப்பிக்கின்ைது:- 1. சிசிறுறு ததமைமைலலப்ப்புபு,, தொதொசசயயற்ற்ேேடுடுத்த்ததல்ல் மாமாற்ற்றுறும்ம் நாநாமைமைடடமுமுமைமைைைக்க்குகு வவருருததல்ல் ..--(1) இந்த ஆமை�, 2025-ம் ஆண்டு தமிழ்நாாடு உள்ளாட்சி அமைமாப்புகளின் தேதர்தலுக்கான சின்னங்கள் (ஒதுக்கீடு மாற்றும் ேங்கீடு) ஆமை� என்ைமைழக்கப்ேடும். (2) தேமாற்குறிப்பிட்ட சட்டங்களின் கீழ் நாமைடதொேறும் அமைனத்துத் தேதர்தல்களுக்கும் இவ்வாமை� தொோருந்தும். (3) இவ்வாமை� உடனடியாக நாமைடமுமைைக்கு வருகின்ைது. 2. தொதொேோாருருள்ள் வவமைமைரரயயமைமைைையுயும்ம் தொதொேோாருருள்ள் விவிளளக்க்ககமுமும்ம்..-- (1) இவ்வாமை�யில் சந்தர்ப்ேங்களுக்தேகற்ே தேவறு விளக்கம் தேதமைவப்ேட்டாலன்றி, - (அ) "தேோட்டியுள்ள தேதர்தல்" என்ேது வாக்தொகடுப்பு தேதமைவப்ேடும் தேதர்தலாகும். (ஆ) "தேதர்தல்" என்ேது தேமாற்குறிப்பிட்ட சட்டங்களின் கீழ் நாமைடதொேறும் தேதர்தலாகும். (இ) ேடிவம்" என்ேது இவ்வாமை�யில் இமை�க்கப்ேட்டுள்ள ேடிவமாாகும். (ஈ) சுதேயச்மைசச் சின்னம்" எனப்ேடுவது ஒதுக்கீடு தொசய்யப்ேடாத சின்னமாாகும். (உ) "அரசு" என்ேது தமிழ்நாாடு அரசு எனப்ேடும். (ஊ) "உள்ளாட்சி அமைமாப்புகள்" என்ேது தமிழ்நாாட்டிலுள்ள அமைனத்து சிற்றூராட்சிகள்,ஊராட்சி ஒன்றியங்கள், மாாவட்ட ஊராட்சிகள், தேேரூராட்சிகள், நாகராட்சிகள் மாற்றும் மாாநாகராட்சிகள் ஆகியவற்மைை உள்ளடக்கியதும் குறிப்ேதுமாாகும். (எ) "சாதார�த் தேதர்தல்" /"தொோதுத் தேதர்தல்" என்ேது காலக்தொகடுவிற்குப் பின் ஊரக/நாகர்ப்புை உள்ளாட்சிகளில் ஏற்ேட்ட ஒரு காலியிடத்மைத நிரப்ேச் தொசய்ய நாடத்தப்ேடும் தேதர்தலாகும். மாற்றும் (ஏ) "அரசியல் கட்சி” என்ேது 1951ஆம் ஆண்டு மாக்கள் தொேயராண்மைமா நிதித்துவ சட்டப்பிரிவு 29Aன் கீழ் இந்தியத் தேதர்தல் ஆமை�யத்தால் அரசியல் கட்சியாக ேதிவு தொசய்யப்ேட்ட இந்திய குடியுரிமைமாப் தொேற்ைவர்கமைளக் தொகாண்ட ஒரு சங்கம் அல்லது அமைமாப்பு ஆகும். (ஐ) "ஒதுக்கப்ேட்ட சின்னம்" என்ேது அங்கீகரிக்கப்ேட்ட அரசியல் கட்சியின் சார்ோக, தேோட்டியிடும் தேவட்ோளருக்கு என மாட்டும் இந்தியத் தேதர்தல் ஆமை�யத்தால் தனியாக ஒதுக்கீடு தொசய்யப்ேட்டச் சின்னமாாகும். (ஒ) "அங்கீகரிக்கப்ேட்ட அரசியல் கட்சி" என்ேது இந்தியத் தேதர்தல் ஆமை�யத்தால், 1968-ம் ஆண்டு தேதர்தல் சின்னங்கள் (ஒதுக்கீடு மாற்றும் ேங்கீடு) ஆமை�யின்கீழ், தேதசீயக் கட்சியாகவும் அல்லது தமிழ்நாாடு மாாநிலத்தில் மாாநிலக் கட்சியாகவும் அங்கீகரிக்கப்ேட்ட ஒவ்தொவாரு கட்சிமையக் குறிப்ேதும் உள்ளடக்கியதும் ஆகும். (ஓ) "ேதிவு தொசய்யப்ேட்ட அங்கீகரிக்கப்ேடாத அரசியல் கட்சி" என்ேது (i) 1968ம் ஆண்டு தேதர்தல் சின்னங்கள் (ஒதுக்கீடு மாற்றும் ேங்கீடு) ஆமை�யின்கீழ் இந்தியத் தேதர்தல் ஆமை�யத்தால் அங்கீகரிக்கப்ேட்ட, தமிழ்நாாடு மாாநிலம் தவிர்த்த, பிை மாாநிலங்கமைளச் தேசர்ந்த மாாநிலக் கட்சி; (ii) 1968-ம் ஆண்டு தேதர்தல் சின்னங்கள் (ஒதுக்கீடு மாற்றும் ேங்கீடு) ஆமை�யின்கீழ், இந்தியத் தேதர்தல் ஆமை�யத்தால் ேதிவு தொசய்யப்ேட்டு ஆனால் தேதசிய கட்சியாகதேவா, அல்லது தமிழ்நாாட்டில் மாாநில கட்சியாகதேவா அங்கீகரிக்கப்ேடாத. தமிழ்நாாட்மைடத் தமைலமைமாயிடமாாகக் தொகாண்டுள்ள கட்சி;10 TAMIL NADU GOVERNMENT GAZETTE EXTRAORDINARY (iii) 1968-ம் ஆண்டு தேதர்தல் சின்னங்கள் (ஒதுக்கீடு மாற்றும் ேங்கீடு) ஆமை�யின்ேடி, இந்தியத் தேதர்தல் ஆமை�யத்தால் அங்கீகரிக்கப்ேட்டு ஆனால் பிைகு தேதசியக் கட்சி நிமைலயிலிருந்து தனது தகுதிமைய இழந்த கட்சி; (iv) 1968-ம் ஆண்டு தேதர்தல் சின்னங்கள் (ஒதுக்கீடு மாற்றும் ேங்கீடு) ஆமை�யின்கீழ், இந்தியத் தேதர்தல் ஆமை�யத்தால் ேதிவு தொசய்யப்ேட்டு ஆனால் தேதசிய கட்சியாகதேவா, அல்லது மாாநில கட்சியாகதேவா அங்கீகரிக்கப்ேடாத மாற்றும் தமாது தமைலமைமா அலுவலகத்மைத தேவறு மாாநிலங்களில் தொகாண்டுள்ள அரசியல் கட்சிகள்; தமிழ்நாாட்டில் உள்ள தமாது அலுவலக முகவரி, துமை� விதிகள் மாற்றும் அலுவலக தொோறுப்ோளர்கள் தேோன்ை விேரங்களுடன் தமிழ்நாாடு மாாநில தேதர்தல் ஆமை�யத்திற்கு விண்�ப்பிக்க தேவண்டும். (2) இவ்வாமை�யில் உேதேயாகப்ேடுத்தப்ேடும் ஆனால், இவ்வாமை�யில் தொோருள் வமைரயறுக்கப்ேடாத வார்த்மைதகதேளா அல்லது தொசாற்தொைாடதேரா இருப்பின், அவற்றிற்கு, 1994 ஆம் ஆண்டு தமிழ்நாாடு ஊராட்சிகள் சட்டத்திதேலா (1994 தமிழ்நாாடு சட்டம் 21) அல்லது அதன் தொதாடர்புமைடய விதிகளிதேலா அல்லது 1998-ம் ஆண்டு தமிழ்நாாடு நாகர்ப்புை உள்ளாட்சிகள் சட்டத்திதேலா (1999 தமிழ்நாாடு சட்டம் 9) அல்லது அதன் தொதாடர்புமைடய விதிகளிதேலா இவ்வார்த்மைதகளுக்கும் தொசாற்தொைாடர்களுக்கும் தொோருள் வமைரயறுக்கப்ேட்டிருப்பின் அச்சட்டத்திற்கும் விதிகளுக்கும் தொோருந்தக்கூடிய அதன் தொோருமைளதேய குறிக்கும். (3) தேமாற்கண்டவாறு வமைரயறுக்கப்ேடாத வார்த்மைத மாற்றும் தொசாற்தொைாடர் ஏதேதனும் இவ்வாமை�யில் தேமாலும் இருப்பின், அவற்றிற்கு தமிழ்நாாடு சட்டத்திற்கு தொோருந்தக்கூடிய அல்லது விளக்கமாாக எடுத்துக் தொகாள்ளக்கூடிய, 1891ம் ஆண்டு தமிழ்நாாடு தொோது ஷரத்துச் சட்டத்தில் (1891 தமிழ்நாாடு சட்டம் 1) கண்ட விளக்கங்கள் தொோருந்தும். 33.. ககட்ட்சிசி அஅடிடிப்ப்ேேமைமைடடயியில்ல் நாநாமைமைடடதொதொேேைைவுவுள்ள்ளள தேதேததர்ர்ததலுலுக்க்ககாானன மாமாாாநிநிலல தேதேததர்ர்ததல்ல் ஆஆமைமை��யயத்த்திதின்ன் அஅறிறிவிவிக்க்மைமைகக தொதொவவளிளியியிடுடுததல்ல்..-- இவ்வாமை�மையச் தொசயற்ேடுத்தும் வமைகயில், மாாநில அரமைசக் கலந்தாதேலாசித்து, மாாநில தேதர்தல் ஆமை�யம் எந்தொதந்த தேதர்தல் கட்சி சார்புமைடயதாக நாடத்தப்ேடும் அல்லது எமைவ கட்சி சார்பின்றி நாடத்தப்ேடும் என்ேமைதக் குறித்து அவ்வப்தேோது அறிவிக்மைக தொவளியிடும். 44.. மாமாாாநிநிலல தேதேததர்ர்ததல்ல் ஆஆமைமை��யயம்ம் தேதேததர்ர்ததல்ல் சிசின்ன்னனங்ங்ககளிளின்ன் ேேட்ட்டிடியயமைமைலல அஅறிறிவிவித்த்ததல்ல்.. --மாாநில தேதர்தல் ஆமை�யம் அவ்வப்தேோது அங்கீகரிக்கப்ேட்ட அரசியல் கட்சிகள் மாற்றும் அமைவகளுக்கு ஒதுக்கப்ேட்டுள்ள சின்னங்களின் ேட்டியல், ேதிவு தொசய்யப்ேட்ட அங்கீகரிக்கப்ேடாத அரசியல் கட்சிகளின் ேட்டியல், கட்சி அடிப்ேமைடயில் நாமைடதொேைவுள்ள தேதர்தல்/தேதர்தல்களுக்கு ஒதுக்கப்ேட்ட சின்னங்களின் ேட்டியமைலயும், சுதேயச்மைசயான சின்னங்களின் ேட்டியமைலயும் மாற்றும் கட்சி அடிப்ேமைடயில்லாத தேதர்தல்/தேதர்தல்களுக்கு சுதேயச்மைசயான சின்னங்களின் ேட்டியமைலயும்/ேட்டியல்கமைளயும் குறித்து அறிவிக்மைக தொவளியிடும். 55.. சிசின்ன்னனங்ங்ககள்ள் ஒஒதுதுக்க்கிகிடுடுததல்ல்..-- இவ்வாமை�யில் கண்டுள்ள வழிவமைககளின்ேடி தேோட்டியுள்ள ஒவ்தொவாரு தேதர்தலிலும் தேோட்டியிடும் தேவட்ோளர்களுக்கு தொவவ்தேவறு சின்னங்கள் ஒதுக்கீடு தொசய்யப்ேடும். 66.. ககட்ட்சிசி அஅடிடிப்ப்ேேமைமைடடயியில்ல்லலாாதத தேதேததர்ர்ததல்ல்ககளுளுக்க்குகு சிசின்ன்னனங்ங்ககள்ள் ஒஒதுதுக்க்கீகீடுடு தொதொசசய்ய்ததல்ல்.. --(1) கட்சி அடிப்ேமைடயில் நாமைடதொேைாத தேோட்டியுள்ள தேதர்தல்களில் தேவட்ோளர்களுக்கு அத்தேதர்தல்களுக்தொகன அங்கீகரிக்கப்ேட்ட சுதேயச்மைசச் சின்னங்களிலிருந்து வரிமைசக்கிரமாமாாக குலுக்கல் முமைையில் சின்னங்கள் வழங்கப்ேடும். உதார�ம்: கட்சி அடிப்ேமைடயில்லாத ஒரு சிற்றூராட்சியின் ஒரு வார்டு உறுப்பினருக்கான தேதர்தலில் ஐவர் தேோட்டியிடுவதாகக் தொகாள்தேவாம். சுதேயச்மைசச் சின்னங்கள் ஐந்து, முமைைதேய (1) "திைவுதேகால் - (2) சிப்பு (3) "கட்டில்" (4) "கார்" மாற்றும் (5) "சங்கு" என்று இருந்தால், இமைவ தேவட்ோளர்களுக்குக் குலுக்கல் முமைையில் ஒதுக்கப்ேடும். குலுக்கலில் முதலில் எந்த தேவட்ோளர் தொேயர் வருகிைதேதா அவருக்கு "திைவுதேகால்" சின்னமும், இரண்டாவதாக வரும் தேவட்ோளருக்கு "சிப்பு" சின்னமும் என்ைவாறு சின்னங்கள் ஒதுக்கீடு தொசய்யப்ேடும். மூன்தேை மூன்று தேவட்ோளர்கள் இருந்தால் "திைவுதேகால்" அடுத்த நாேருக்கு "சீப்பு" மாற்றும் "கட்டில்" ஆகிய முதல் மூன்று சின்னங்கள் மாட்டுதேமா முமைைதேய ஒதுக்கப்ேடும். (2) இப்ேடிப்ேட்ட தேதர்தலில், தேவட்ோளர்கள் சின்னம் குறித்து தங்களுக்குள் உடன்ோடு தொசய்து தொகாண்டாலும், குலுக்கல் முமைையில் மாட்டுதேமா சின்னம் ஒதுக்கப்ேடும். 77.. ககட்ட்சிசி அஅடிடிப்ப்ேேமைமைடடயியிலலாானன தேதேததர்ர்ததல்ல்ககளுளுக்க்குகு சிசின்ன்னனங்ங்ககள்ள் ஒஒதுதுக்க்கீகீடுடு தொதொசசய்ய்ததல்ல்..-- (1) தேதசிய கட்சிகள் மாற்றும் தமிழ்நாாட்டில் அங்கீகரிக்கப்ேட்ட கட்சிகளுக்கு சின்னங்கள் ஒதுக்கீடு தொசய்தல். கட்சி அடிப்ேமைடயில் நாமைடதொேறும் ஒரு தேதர்தலில், அங்கீகரிக்கப்ேட்ட ஒரு கட்சியின் சார்ோல் நிறுத்தப்ேடும் ஒரு தேவட்ோளர் அக்கட்சிக்கு ஒதுக்கீடு தொசய்யப்ேட்ட சின்னத்மைத மாட்டுதேமா தேதர்ந்தொதடுக்கலாம். அவருக்கு அக்கட்சிக்கு ஒதுக்கீடு தொசய்யப்ேட்ட சின்னம் மாட்டும் ஒதுக்கப்ேடுதேமா தவிர, தேவறு எந்த சின்னமும் ஒதுக்கப்ேடமாாட்டாது. தாக்கல் தொசய்யப்ேட்ட தேவட்பு மானு அல்லது ேடிவம் B அல்லது ேடிவம் C-யில் தொவகுவாக ஏற்ேட்ட குமைைோட்டின் கார�மாாக ஒதுக்கீடு தொசய்யப்ேட்ட சின்னம் குறித்து முரண்ேட்ட தேகாரிக்மைககள் இருந்தால், எந்ததொவாரு தேவட்ோளருக்கும் "ஒதுக்கப்ேட்ட சின்னம்" வழங்கப்ேடமாாட்டாது. அவ்தேவட்ோளர்கள் அமைனவரும் சுதேயட்மைசகளாகக் கருதப்ேடுவதுடன் பிை சுதேயட்மைச தேவட்ோளர்களுக்கு ஒதுக்கப்ேட்ட பின்னர் மீதமிருக்கும் சுதேயட்மைச சின்னங்கள் ஒதுக்கப்ேடும். ஒரு தேதர்தலில் அங்கீகரிக்கப்ேட்ட அரசியல் கட்சி ஒன்றின் சார்பில் எந்ததொவாரு தேவட்ோளரும் நிறுத்தப்ேடாத ேட்சத்திலும், அக்கட்சிக்தொகன ஒதுக்கப்ேட்ட சின்னம் அத்தேதர்தலில் தேவதொைந்த தேவட்ோளராலும் தேகாரப்ேடதேவா அல்லது ஒதுக்கப்ேடதேவா கூடாது.TAMIL NADU GOVERNMENT GAZETTE EXTRAORDINARY 11 ((11)) AA.. பிபிைை மாமாாாநிநிலலங்ங்ககள்ள் அஅல்ல்லலதுது யூயூனினியயன்ன் பிபிரரதேதேததசசங்ங்ககளிளில்ல் அஅங்ங்கீகீககரிரிக்க்ககப்ப்ேேட்ட்டட மாமாாாநிநிலல ககட்ட்சிசியியினனாால்ல் நிநிறுறுத்த்ததப்ப்ேேடுடும்ம் தேதேவவட்ட்ேோாளளர்ர்ககளுளுக்க்குகுச்ச் சசலுலுமைமைகக வவழழங்ங்குகுததல்ல்.. தேவறு சில மாாநிலம் அல்லது மாாநிலங்களில் அல்லது யூனியன் பிரதேதசங்களில் ஒரு மாாநிலக் கட்சியாக அங்கீகரிக்கப்ேட்ட ஒரு அரசியல் கட்சி ஏதேதனும் ஒரு உள்ளாட்சி அமைமாப்பில், கட்சி அடிப்ேமைடயில் நாடத்தப்ேடும் தேதர்தலில் ஒரு வார்டில் ஒரு தேவட்ோளமைர நிறுத்தும்தேோது, தேமாற்கண்ட கட்சி எந்த மாாநிலம் அல்லது மாாநிலங்களில் ஒரு மாாநிலக்கட்சியாக அங்கீகரிக்கப்ேட்டுள்ளதேதா, அக்கட்சிக்கு அங்தேக ஒதுக்கப்ேட்டுள்ள சின்னத்மைத, அச்சின்னம் தேமாற்கண்ட உள்ளாட்சி தேதர்தலில் சுதேயட்மைச சின்னங்களின் ேட்டியலில் குறிப்பிடப்ேடாமாலிருப்பினும் கீதேழ குறிப்பிடப்ேடும் நிேந்தமைனகளுக்குட்ேட்டு அத்தேதர்தலில் தேோட்டியிடும் மாற்ை தேவட்ோளர்கமைளத் தவிர்த்து தேமாற்கண்ட மாாநிலக்கட்சியின் தேவட்ோளருக்கு ஒதுக்கீடு தொசய்யலாம். அ) அரசிதழில், தேதர்தல் தொதாடர்ோன அறிவிப்பு தொவளியிடப்ேட்ட நாாளிலிருந்து மூன்று நாாட்களுக்கு தேமாற்ேடாமால், அல்லது இந்த ஆமை� தொவளியிடப்ேட்ட மூன்று நாாட்களுக்குள் தேமாதேல குறிப்பிடப்ேட்ட அரசியல் கட்சி. தான் நிறுத்தியுள்ள தேவட்ோளருக்காக மாட்டும் அதன் சின்னத்மைத ஒதுக்கீடு தொசய்யுமாாறு தேகட்டு மாாநில தேதர்தல் ஆமை�யத்திற்கு விண்�ப்பிக்க தேவண்டும். ஆ) தேமாலும், தேமாதேல குறிப்பிடப்ேட்ட தேவட்ோளர், அத்தேதர்தலில் தேமாற்கண்ட கட்சியினால் தான் தேவட்ோளராக நிறுத்தப்ேட்டுள்ளதாகத் தனது தேவட்பு மானுவில் உறுதியளிக்க தேவண்டும் ேத்தி எண் 8ல் பிரிவு (ஆ), (இ) மாற்றும் (ஈ) ல் குறிப்பிடப்ேட்டுள்ள நிேந்தமைனகமைளப் பூர்த்தி தொசய்துள்ளதாகவும் உறுதியளிக்க தேவண்டும். இ) சின்னம் ஒதுக்கீடு தொசய்ய தேவண்டி வரப்தொேற்ை வி��ப்ேத்மைத மாறுப்ேதற்கான தகுந்த கார�ங்கள் ஏதுமில்மைல என்று மாாநில தேதர்தல் ஆமை�யம் கருததேவண்டும். ஆயினும், எந்த ஒரு வார்டு / உள்ளாட்சி அமைமாப்பிற்கான தேதர்தலில், தேவறு சில தேதசிய அல்லது தமிழ்நாாட்டிலுள்ள மாாநிலக்கட்சிக்கு அதேத சின்னம் ஒதுக்கப்ேட்டிருந்தால் தேமாதேல குறிப்பிடப்ேட்ட கட்சியினால் அந்த வார்டில் / உள்ளாட்சி அமைமாப்பில் நிறுத்தப்ேட்ட தேவட்ோளருக்கு, தேமாதேல கண்ட ேத்தியில் தொசால்லப்ேட்ட எதுவுதேமா தொோருந்தாது. ((11)) BB.. ஏஏற்ற்ககனனதேதேவவ அஅங்ங்கீகீககரிரிக்க்ககப்ப்ேேட்ட்டட ககட்ட்சிசியயாாகக இஇருருந்ந்துது,, ததற்ற்தேதேேோாதுது அஅங்ங்கீகீககரிரிக்க்ககப்ப்ேேடடாாதத தேதேததசிசியய//மாமாாாநிநிலலக்க்ககட்ட்சிசியயாால்ல் நிநிறுறுத்த்ததப்ப்ேேடுடும்ம் தேதேவவட்ட்ேோாளளர்ர்ககளுளுக்க்குகு சசலுலுமைமைகக வவழழங்ங்குகுவவதுது ஒரு தேதசிய அல்லது தமிழ்நாாட்டில் மாாநிலக்கட்சி, தேதர்தல் அறிவிக்மைக தொவளியிடுவதற்கான தேததியிலிருந்து ஆண்டுகளுக்கு முன்பு வமைர அங்கீகரிக்கப்ேட்ட கட்சியாக இருந்து தற்தேோது அங்கீகரிக்கப்ேடாத கட்சியாக உள்ள ஒரு அரசியல் கட்சி, ஏதேதனும் ஒரு உள்ளாட்சி அமைமாப்பில் கட்சி அடிப்ேமைடயில் நாமைடதொேறும் தேதர்தலில் ஒரு வார்டில் தனது தேவட்ோளமைர நிறுத்தும்தேோது, தேமாற்கண்ட கட்சி அங்கீகரிக்கப்ேட்ட தேதசிய / தமிழ்நாாட்டில் மாாநிலக் கட்சியாக இருந்ததேோது அக்கட்சிக்கு ஒதுக்கீடு தொசய்யப்ேட்ட சின்னத்மைத, அச்சின்னம் தேமாற்கண்ட உள்ளாட்சி தேதர்தல் சுதேயட்மைச சின்னங்களின் ேட்டியலில் குறிப்பிடப்ேடாமாலிருப்பினும் கீதேழ குறிப்பிடப்ேடும் நிேந்தமைனகளுக்குட்ேட்டு, அத்தேதர்தலில் தேோட்டியிடும் தேவட்ோளர்கமைளத் தவிர்த்து, இக்கட்சியின் தேவட்ோளருக்கு ஒதுக்கீடு தொசய்யலாம். அ) தேதர்தல் அறிவிக்மைக அரசிதழில் தொவளியான நாாளிலிருந்து மூன்று நாாட்களுக்குள், தனது கட்சியினால் நிறுத்தப்ேட்ட தேவட்ோளருக்கு மாட்டுதேமா அச்சின்னத்மைத ஒதுக்கீடு தொசய்யக்தேகட்டு, தேமாதேல தொசால்லப்ேட்ட கட்சி மாாநில தேதர்தல் ஆமை�யத்தில் விண்�ப்பித்திருக்க தேவண்டும். ஆ) அந்த தேவட்ோளர், தேமாற்கண்ட கட்சியினால், அத் தேதர்தலுக்கு, தான் தேவட்ோளராக நிறுத்தப்ேட்டிருப்ேதாகவும், ேத்திஎண் 8ல் உட்பிரிவு (ஆ), (இ) மாற்றும் (ஈ)-ல் தொசால்லப்ேட்ட அமைனத்மைதயும் கட்சி பூர்த்தி தொசய்திருப்ேதாகவும் தனது தேவட்பு மானுவில் உறுதிதொமாாழி அளித்திருக்க தேவண்டும். இ) தேமாற்கண்ட ஒதுக்கீட்டிற்கான விண்�ப்ேத்மைத மாறுப்ேதற்கு தகுந்த கார�ங்கள் இல்மைல என்று மாாநில தேதர்தல் ஆமை�யம் கருத தேவண்டும். ஆயினும் எந்த ஒரு வார்டு / உள்ளாட்சி அமைமாப்பிற்கான தேதர்தலில், தேவறு சில தேதசிய அல்லது மாாநிலக் கட்சிக்கு அதேத சின்னம் ஏற்கனதேவ ஒதுக்கீடு தொசய்யப்ேட்டிருந்தால், தேமாதேல குறிப்பிடப்ேட்ட அக்கட்சியினால் அந்த வார்டில் / உள்ளாட்சி அமைமாப்பில் நிறுத்தப்ேட்ட தேவட்ோளருக்கு இப்ேத்தியில் குறிப்பிடப்ேட்ட எதுவும் தொோருந்தாது. ((11)) CC.. ேேதிதிவுவு தொதொசசய்ய்யயப்ப்ேேட்ட்டட ((அஅங்ங்கீகீககரிரிக்க்ககப்ப்ேேடடாாதத)) அஅரரசிசியயல்ல் ககட்ட்சிசிககள்ள் மாமாற்ற்றுறும்ம் ஆஆறுறு வவருருடடங்ங்ககளுளுக்க்குகு முமுன்ன்னனர்ர் அஅங்ங்கீகீககரிரிக்க்ககப்ப்ேேட்ட்டட அஅரரசிசியயல்ல் ககட்ட்சிசிககளளாாகக இஇருருந்ந்தத அஅங்ங்கீகீககரிரிக்க்ககப்ப்ேேடடாாதத அஅரரசிசியயல்ல் ககட்ட்சிசிககளளாால்ல் நிநிறுறுத்த்ததப்ப்ேேடுடும்ம் தேதேவவட்ட்ேோாளளர்ர்ககளுளுக்க்ககாானன சசலுலுமைமைகக.. அங்கீகரிக்கப்ேடாத ேதிவு தொசய்யப்ேட்ட ஒரு அரசியல் கட்சிக்கு இந்திய தேதர்தல் ஆமை�யத்தால் நாடத்தப்ேடும் தேதர்தல்களில் ஒரு தொோது சின்னம் ஒதுக்கீடு தொசய்யப்ேட்டு அடுத்தடுத்து ரத்து தொசய்யப்ேடாமாலிருந்தால், தமிழ்நாாடு மாாநில தேதர்தல் ஆமை�யத்தால் நாடத்தப்ேடும் உள்ளாட்சி தேதர்தலில் அந்த அங்கீகரிக்கப்ேடாத ேதிவு தொசய்யப்ேட்ட அரசியல் கட்சி அதேத தொோது சின்னத்மைத தமிழ்நாாடு மாாநில தேதர்தல் ஆமை�யத்திடம் பின்வரும் நிேந்தமைனகளுக்கு உட்ேட்டு ஒதுக்கீடு தொசய்திட தேகாரலாம்: உள்ளாட்சி தேதர்தலுக்கு முன்னர் இந்திய தேதர்தல் ஆமை�யத்தால் நாடத்தப்ேட்ட தேவறுேட்ட தேதர்தல்களில் ஒன்று அல்லது ஒன்றுக்கு தேமாற்ேட்ட ேதிவு தொசய்யப்ேட்ட அரசியல் கட்சிகளுக்கு ஒதேர தொோது சின்னம் ஒதுக்கீடு தொசய்யப்ேட்டிருப்பின், அதேத தொோது சின்னம் இந்திய தேதர்தல் ஆமை�யத்தால் அண்மைமாயில் நாடத்தப்ேட்ட தேதர்தலின் தேோது வழங்கப்ேட்ட அரசியல் கட்சிக்கு ஒதுக்கீடு தொசய்திட ேரிசீலிக்கப்ேடும்;12 TAMIL NADU GOVERNMENT GAZETTE EXTRAORDINARY அரசிதழில் தேதர்தல் தொதாடர்ோன அறிவிப்பு தொவளியிடப்ேட்ட நாாளிலிருந்து மூன்று நாாட்களுக்கு தேமாற்ேடாமால் தேமாதேல குறிப்பிடப்ேட்ட அரசியல் கட்சி, தான் நிறுத்தியுள்ள தேவட்ோளர்களுக்கு தொோது சின்னம் ஒதுக்கீட்டின் சலுமைக தொேை தேவண்டி தேமாற்ேடி அரசியல் கட்சி தொோதுச்சின்னம் ஒதுக்கீடு சலுமைக தொேை விரும்பும் வார்டுகள் / அலுவலகங்கள் அடங்கிய விவரங்களுடன் தமிழ்நாாடு மாாநில தேதர்தல் ஆமை�யத்திற்கு விண்�ப்ேம் தொசய்திட தேவண்டும்; தொோது சின்னமாாக ஒதுக்கீடு தொசய்யப்ேட்ட சுதேயட்மைச சின்னத்மைத ேத்தி 3-ன்ேடி இவ்வாமை�யத்தில் சமார்ப்பிக்கப்ேட்ட வார்டுகள்/அலுவலகங்கள் தவிர தேவறு வார்டுகள் /அலுவலகங்களுக்கு அக்கட்சியால் நிறுத்தப்ேடும் தேவட்ோளர்களுக்கு இந்த ஷரத்தின் கீழ் உரிமைமா தேகார இயலாது. சமார்ப்பிக்கப்ேட்ட விவரங்களின்ேடி அந்த அரசியல் கட்சி தேவட்ோளமைர நிறுத்தாத நிமைலயில், நாடப்பு சட்ட விதிகளின்ேடி ஆமை�ய ேரிசீலமைனக்கு ஏற்ே தொதாடர்புமைடய கட்சி தகுந்த நாடவடிக்மைகக்கு உட்ேடுத்தப்ேடும்; இந்த ேத்தியின் கீழ் ஒரு கட்சியின் தேவட்ோளர்களுக்கு தொோது சின்னமாாக ஒதுக்கீடு தொசய்யப்ேட்ட சுதேயட்மைச சின்னம் அந்த கட்சியால் தேவறு வார்டுகளில் தேவட்ோளர்கள் நிறுத்தப்ேடாத நிமைலயில், தேவதொைாரு அரசியல் கட்சி அல்லது சுதேயட்மைச தேவட்ோளர்களுக்கு அச்சுதேயட்மைச சின்னம் ஒதுக்கீடு தொசய்திட ேயன்ேடுத்தப்ேடும்; மாற்றும் ேத்தி7 (1) B-யில் உள்ளவாறு குறிப்பிட்டு இருந்தாலும், ஒரு அரசியல் கட்சி முன்னர் அங்கீகரிக்கப்ேட்ட கட்சியாக இருந்து 6 வருடங்களுக்கு தேமால் அதன் அங்கீகரிப்மைே இழந்திருப்பினும் அந்த கட்சிக்காக முன்னர் ஒதுக்கி மைவக்கப்ேட்ட சின்னத்மைத இந்த ேத்தியின் கீழ் ஒதுக்கீட்டின் சலுமைகயாக தொேைவும் தகுதியுமைடயதாகிைது. ((22)) ேேதிதிவுவு தொதொசசய்ய்யயப்ப்ேேட்ட்டட அஅங்ங்கீகீககரிரிக்க்ககப்ப்ேேடடாாதத அஅரரசிசியயல்ல் ககட்ட்சிசிககள்ள் மாமாற்ற்றுறும்ம் சுசுதேதேயயட்ட்மைமைசச தேதேவவட்ட்ேோாளளர்ர் சிசின்ன்னனங்ங்ககள்ள் ஒஒதுதுக்க்கிகிடடல்ல்..-- எந்த ஒரு சுதேயட்மைச தேவட்ோளரும், சம்மாந்தப்ேட்ட தேதர்தலுக்கான சுதேயட்மைச சின்னங்களின் ேட்டியலிலிருந்து மூன்று சின்னங்கமைளத் தேதர்ந்தொதடுத்து தான் விரும்பும் முன்னுரிமைமா வரிமைசப்ேடி குறிப்பிட தேவண்டும். ேதிவு தொசய்யப்ேட்ட அங்கீகரிக்கப்ேடாத அரசியல் கட்சியின் சார்பில் நிறுத்தப்ேடுகின்ை தேவட்ோளர் அல்லது அவர் சார்பில் தேவட்பு மானு தாக்கல் தொசய்யும்தேோது அவர் விரும்புகின்ை சின்னங்கமைள கட்சி அடிப்ேமைடயிலானத் தேதர்தலுக்கான சின்னங்களின் ேட்டியலிலிருந்து ஒருங்கிமை�ந்தவாறு தேதர்ந்தொதடுத்து குறிப்பிடலாம். சின்னங்கள் கீழ்கண்ட முமைைப்ேடி ஒதுக்கீடு தொசய்யப்ேடும். (அ) தேவட்ோளர் தேகாரிய வரிமைசப்ேடி சின்னம் ஒதுக்கீடு தொசய்வது ேற்றி ேரிசீலிக்கப்ேடும். அதாவது தேவட்ோளர் முதலில் தேகாரிய சின்னம் முதலாவதாகவும், இரண்டாவதாகக் தேகாரிய சின்னம் இரண்டாவதாகவும், மூன்ைாவது தேகாரிக்மைக கமைடசி தேகாரிக்மைகயாகவும் ேரிசீலிக்கப்ேடும். ஒரு ேதிவு தொசய்யப்ேட்ட அங்கீகரிக்கப்ேடாத அரசியல் கட்சியின் சார்ோக தேோட்டியிடும் தேவட்ோளருக்கு சின்னம் முதலில் ஒதுக்கப்ேட்ட பின்னதேர சுதேயட்மைச தேவட்ோளருக்கு மீதமுள்ள சுதேயட்மைச சின்னங்கமைளக் தொகாண்டு ஒதுக்கீடு தொசய்யப்ேடும். (ஆ) ஒதேர ஒருவரால் மாட்டுதேமா அவரது முதல் தேதர்வாக ஒரு சுதேயச்மைச சின்னம் தேகாரப்ேட்டால், அந்தச் சின்னம் அவருக்கு மாட்டுதேமாயல்லாது பிைருக்கு ஒதுக்கப்ேடமாாட்டாது. ஒரு சுதேயச்மைசச் சின்னம் ஒன்றுக்கு தேமாற்ேட்ட, தேவட்ோளர்களால் முதல் தேதர்வாகக் தேகாரப்ேட்டால், அந்தச் சின்னம், குலுக்கல் முமைையில், முதலில் யார் தொேயர் தேதர்ந்தொதடுக்கப்ேடுகிைதேதா அவருக்கு ஒதுக்கீடு தொசய்யப்ேடும். (இ) தேவட்ோளர் ஒருவர் தேகாரிய முதல் விருப்ேச் சின்னம், குலுக்கல் முமைை மூலம் அவருக்கு ஒதுக்கீடு தொசய்ய இயலாது தேோனால், அவர் தேகாரிய இரண்டாவது விருப்ே சின்னத்மைத அவருக்கு ஒதுக்கீடு தொசய்ய ேரிசீலிக்கப்ேடும். முரண்ேட்ட தேகாரிக்மைககளினாலும், குலுக்கலில் தேதர்ந்தொதடுக்கப்ேட இயலாத ேட்சத்திலும், இரண்டாவது விருப்ே சின்னமும் அவ்தேவட்ோளருக்கு ஒதுக்கீடு தொசய்ய முடியாமாற்தேோனால், அவரது மூன்ைாவது விருப்ே சின்னத்மைத ஒதுக்கிட ேரிசீலிக்கப்ேடும். அவ்வாறு மூன்ைாவது விருப்ே சின்னத்மைதயும் ஒதுக்கிட இயலாமாற்தேோயின், பிை தேவட்ோளர்களுக்கு ஒதுக்கீடு தொசய்தது தேோக மீதமுள்ள சுதேயச்மைச சின்னங்களில் ஒன்மைை குலுக்கல் முமைையில் தேதர்வு தொசய்யப்ேட்டு அவ்தேவட்ோளருக்கு ஒதுக்கீடு தொசய்யப்ேடும். (ஈ) ேதிவு தொசய்யப்ேட்ட - அங்கீகரிக்கப்ேடாத அரசியல் கட்சியின் சார்ோக தேோட்டியிடும் தேவட்ோளர்களுக்கு சின்னம் ஒதுக்கீட்டில் முதலில் ஒதுக்கீடு தொசய்யப்ேட்ட பிைதேக மீதமுள்ள சுதேயச்மைச சின்னங்கமைள சுதேயச்மைச தேவட்ோளர்களுக்கு அவர்கள் விரும்பும் முன்னுரிமைமா அடிப்ேமைட வழிமுமைையில் ஒதுக்கப்ேடும். 8.. ஒஒருரு தேதேவவட்ட்ேோாளளர்ர் எஎப்ப்தேதேேோாதுது அஅரரசிசியயல்ல் ககட்ட்சிசி சசாார்ர்பிபில்ல் நிநிறுறுத்த்ததப்ப்ேேடுடும்ம் தேதேவவட்ட்ேோாளளர்ர் எஎனனக்க் ககருருததப்ப்ேேடுடுவவாார்ர்-- ((11)) இவ்வாமை�யின் கருத்துக்தொகாப்ே, ஒரு தேவட்ோளர் ஓர் அங்கீகரிக்கப்ேட்ட அரசியல் கட்சியின் சார்பில் நிறுத்தப்ேடும் தேவட்ோளராக கருதப்ேடதேவண்டுதொமான்ைால்; (அ) அவர் தனது தேவட்பு மானுவுடன், கட்சி சார்பில் நிறுத்தப்ேடுவதற்கான ேடிவம் C- யிலான உறுதிதொமாாழிமைய இமை�த்திருக்க தேவண்டும்; (ஆ) தேவட்பு மானுமைவத் திரும்ே தொேறும் நாாளன்று மாாமைல 3.00 மாணிக்குள், தேதர்தல் நாடத்தும் அலுவலரிடம், தான் கட்சி சார்பில் நிறுத்தப்ேடுேவர் என்ேதற்கான எழுத்து மூலமாான அறிவிப்மைே ேடிவம் B-ல் அளிக்க தேவண்டும் ; (இ) தேமாற்ேடி அறிவிப்பு, தொதாடர்புமைடய கட்சியால் அவ்வறிவிப்பிமைனச் தொசய்ய அதிகாரம் தொேற்ை தமைலவர் அல்லது தொசயலாளர் அல்லது பிறிதொதாரு நிர்வாகி அல்லது அத்தமைகய நிர்வாகியினால் அதிகாரமாளிக்கப்ேட்ட மைகதொயாப்ேமிடப்ேட்டிருக்க தேவண்டும்; மாற்றும் (ஈ) ேடிவம் B அளிக்க அதிகாரம்/அத்தாட்சிப் தொேற்ை நாேரின் தொேயர் மாற்றும் மாாதிரி மைகதொயாப்ேம் ஆகிய தகவல்கள் அடங்கிய ேடிவம் A நிரப்ேப்ேட்டு தேவட்பு மானு திரும்ேப்தொேறும் கமைடசிநாாள் மாாமைல 3.00 மாணிக்குள் தேதர்தல் நாடத்தும் அலுவலரிடம் ஒப்ேமைடத்திருத்தல் தேவண்டும்.TAMIL NADU GOVERNMENT GAZETTE EXTRAORDINARY 13 (2) (அ) ேடிவம் A தொதாடர்புமைடய கட்சியால் அவ்வறிவிப்பிமைன தொசய்ய அதிகாரம் தொேற்ை தமைலவர் அல்லது தொசயலாளர் அல்லது பிறிதொதாரு நிர்வாகியினால் மைகதொயாப்ேமிடப்ேட்டிருத்தல் தேவண்டும்; இருப்பினும், தேமாற்ேடி அலுவலர்களால் தேநாரடியாக B மைகதொயாப்ேமிடப்ேட்டு வழங்கப்ேடும் தேநார்வுகளில் ேடிவம் A வழங்கிட வலியுறுத்தப்ேட தேவண்டியதில்மைல.
