असाधारण म ें प्रकाजित की गई ददिांक 30 जसतंबर 2024 की अजधसूचिा फा. सं. 6/35/2024-डीिीटीआर के माध्यम से एक सावािजिक सूचिा िारी की, जिसमें जियमावली के जियम 5 के साथ परित अजधजियम की धारा 9क के अिुसार संबद्ध िांच िुरू की गई, तादक संबद्ध देिों के मूल के अथवा वहां से जियााजतत जवचाराधीि उत्पाद के संबंध म ें दकसी कजथत पाटि के अजस्ट्तत्व, मात्रा और प्रभाव का जिधारा ण दकया िा सके और पाटिरोधी िल्ु क की ऐसी राजि की जसफाररि की िा सके, जिसे यदद लगाया िाता ह ैतो वह घरेलू उद्योग को हुई क्षजत को दरू करिे के जलए पयााि होगी। ख. प्रदक्रया 3. प्राजधकारी िे जियमावली के जियम 5(5) के अिुसार िांच िुरू करिे से पूवा वतामाि पाटिरोधी आवेदि की प्राजि के संबंध में भारत म ेंयूरोपीय सघं के प्रजतजिजधमंडल को सूजचत दकया। 4. प्राजधकारी ि े संबद्ध वस्ट्तओंु के आयातों के संबंध म ें पाटिरोधी िांच िुरु करत े हुए ददिांक 30 जसतंबर 2024 की अजधसूचिा फा. सं. 6/35/2024-डीिीटीआर के माध्यम स े एक सावािजिक सूचिा िारी की, जिसे भारत के रािपत्र - असाधारण म ेंप्रकाजित दकया गया । 5. प्राजधकारी िे िांच िुरु करि े के उपरांत भारत म ें यूरोपीय संघ के प्रजतजिजधमडं ल, ज्ञात उत्पादकों/ जियाातकों, ज्ञात आयातकों/ उपयोगकताओंा , आवेदक कंपिी के साथ-साथ भारत म ें संबद्ध वस्ट्तओंु के घरेल ू उत्पादकों को, आवेदक द्वारा उपलब्ध कराए गए पत े के अिुसार िांच िरुु आत अजधसूचिा की एक प्रजत भेिी तथा उिसे अिरु ोध दकया दक व े जियमावली के जियम 6(2) के अिुसार जिधााररत समय सीमा के भीतर अपि े जवचारों स े जलजखत रूप में अवगत कराएं। 6. प्राजधकारी िे जियमावली के जियम 6(3) के अिुसार ज्ञात उत्पादकों/ जियाातकों तथा भारत म ें संबद्ध देिों के दतू ावासों को आवेदि के अगोपिीय पाि की एक प्रजत उपलब्ध कराई। 7. भारत म ें यूरोपीय संघ के प्रजतजिजधमंडल स े अिुरोध दकया गया था दक वे अपि े देि के जियाातकों/ उत्पादकों को जिधााररत समय सीमा के भीतर प्रश्नावली का उत्तर देि े का परामिा दें। उत्पादकों/ जियाातकों को भेिे गए पत्र और प्रश्नावली की एक प्रजत के साथ ही उन्ह ेंसंबद्ध देिों के ज्ञात उत्पादकों/ जियाातकों के िाम और पते भी भेि ेगए। 8. िांच िुरुआत अजधसूचिा और सूचिा के प्रत्युत्तर में, संबद्ध देिों के जियाातकों/ उत्पादकों और आयातकों/ उपयोगकतााओं िे जियाातक प्रश्नावली उत्तर और जवजधक प्रस्ट्तुजतकरण को भरकर प्राजधकारी को उत्तर ददया। 9. सभी जहतबद्ध पक्षकारों की एक सूची डीिीटीआर की वेबसाइट पर अपलोड की गई और साथ ही उि सभी स े अिुरोध दकया गया दक वे अपि े प्रस्ट्तुजतकरणों का अगोपिीय पाि अन्य सभी जहतबद्ध पक्षकारों को ईमेल करें। ग. आवदे क कंपिी स ेप्राि अिरु ोध 10. आवेदक ि े ददिांक 11 ििवरी 2025 को भेिे गए एक ईमले के माध्यम स े अपिी याजचका वापस ल े ली ह ै और िांच को समाि करि े का अिरु ोध करत े हुए कहा ह ैदक: "याजचकाकताा से प्राि जिदेिों के अिुसार, हम एतद्द्वारा सीमा िुल्क टैररफ (पारटत वस्ट्तओंु पर पाटिरोधी िुल्क की पहचाि, आकलि और संग्रहण तथा क्षजत का जिधाारण) जियमावली, 1995 के जियम 14 के तहत वतामाि आवेदि वापस लेते ह।ैं याजचकाकताा का आपसे अिुरोध ह ैदक कृपया आवेदि को वापस जलया हुआ मािा िाए और वतामाि िांच को समाि करें।"[भाग I—खण् ड 1] भारत का रािपत्र : असाधारण 3 घ. प्राजधकारी द्वारा िाचं 11. आवेदक कंपिी द्वारा दकए गए उक्त अिरु ोध की िांच की गई ह।ै प्राजधकारी यह िोट करत े ह ैं दक जियमावली के जियम 14(क) में यह प्रावधाि ह ै दक जिर्दाष्ट प्राजधकारी द्वारा सावािजिक सूचिा िारी करके िांच को तत्काल समाि कर ददया िाएगा, यदद "उसे प्रभाजवत घरेल ूउद्योग स ेअथवा उसकी ओर से, जिसके कहिे पर िांच िरूु की गई थी, ऐसा करि ेके जलए जलजखत में कोई अिरुोध प्राि होता ह।ै" 12. आवेदक कंपिी द्वारा याजचका को वापस लेि े और िांच को समाि करि े के जलए उसके अिुरोध को देखत े हुए, प्राजधकारी कई जहतबद्ध पक्षकारों द्वारा उिाए गए जवजभन्न मद्दु ों पर जवचार करिा उजचत िहीं समझते हैं और एतद्द्वारा इस िांच को समाि करते ह।ैं ङ जिष्कष ा 13. आवेदक कंपिी अथाात दीपक िाइराइट जलजमटेड द्वारा उपरोक्तािुसार याजचका को वापस लेिे और पाटिरोधी जियमावली, 1995 के जियम 14 (क) को देखते हुए, प्राजधकारी एतद्द्वारा यरू ोपीय संघ के मूल के अथवा वहां स े जियााजतत "परै ा िाइरोटोलुईि (पीएिटी)" के आयातों के संबधं म ें ददिांक 30 जसतंबर 2024 की अजधसूचिा फा. स.ं 6/35/2024-डीिीटीआर के तहत िुरू की गई पाटिरोधी िांच को समाि करत े ह।ैं दपणा ििै , जिर्दष्टा प्राजधकारी MINISTRY OF COMMERCE AND INDUSTRY (Directorate General of Trade Remedies) TERMINATION NOTIFICATION New Delhi,the 23rd January,2025 (CASE No. ADD (Ol) – 33/2024) Subject: Termination of anti-dumping investigation concerning imports of Para Nitrotoluene (PNT) originating in or exported from the European Union. F. No. 6/35/2024-DGTR.–– A. INTRODUCTION 1. Having regard to the Customs Tariff Act, 1975 as amended from time to time (hereinafter referred as the ' Act’) and the Customs Tariff (Identification, Assessment, and Collection of Anti- Dumping Duty on Dumped Articles and for Determination of Injury) Rules, 1995, as amended from time to time (hereinafter referred to as the 'Rules’), Deepak Nitrite Limited (hereinafter referred to as the 'applicant’) has filed an application before the Designated Authority (hereinafter referred to as the ' Authority’), for initiation of an anti-dumping investigation concerning imports of Para Nitrotoluene (PNT) (hereinafter referred to as the 'product under consideration’ or 'subject goods’), originating in or exported from the European Union (hereinafter referred to as the 'subject country’) .4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC.1] 2. The Authority, based on prima facie evidence submitted by the applicant, issued a public notice vide Notification F. No. 6/35/2024-DGTR dated 30th September 2024, published in the Gazette of India - Extraordinary, initiating the subject investigation in accordance with Section 9A of the Act read with Rule 5 of the Rules, to determine the existence, degree and effect of any alleged dumping in respect of the product under consideration originating in or exported from the subject countries and to recommend the amount of anti-dumping duty, which if levied, would be adequate to remove the injury to the domestic industry. B. PROCEDURE 3. The Authority notified the Delegation of the European Union to India about the receipt of the present anti-dumping application before proceeding to initiate the investigation in accordance with Rule 5(5) of the Rules. 4. The Authority issued a public notice vide Notification F. No. 6/35/2024-DGTR dated 30th September 2024, published in the Gazette of India - Extraordinary, initiating the anti dumping investigation concerning imports of the subject goods. 5. The Authority post-initiation sent a copy of the initiation notification to the Delegation of the European Union to India, the known producers/ exporters, the known importers/users, the applicant company as well as the domestic producers of the subject goods in India as per the address made available by the applicant and requested them to make their views known in writing within the prescribed time limit as per Rule 6(2) of the Rules. 6. The Authority provided a copy of the non-confidential version of the application to the known producers/ exporters and to the embassies of the subject countries in India in accordance with Rule 6(3) of the Rules. 7. The Delegation of the European Union to India were requested to advise the exporters/ producers from their country to respond to the questionnaire within the prescribed time limit. A copy of the letter and questionnaire sent to the producers/ exporters was also sent to them along with the names and addresses of the known producers/ exporters from the subject countries. 8. In response to the initiation notification and intimation, exporters / producers from the subject countries and importers/users responded to the Authority by filling the exporter questionnaire responses and the legal submission. 9. A list of all the interested parties was uploaded on the DGTR's website along with the request therein to all of them to email the non-confidential version of their submissions to all other interested parties. C. REQUEST RECEIVED FROM THE APPLICANT COMPANY 10. The applicant, through an email dated 11th Jan. 2025, has withdrawn its petition and has requested for termination of the investigation citing that: “Under instructions from the petitioner, we hereby withdraw the present application under Rule 14 of the Customs Tariff (Identification, Assessment and Collection of Anti- Dumping Duty on Dumped Articles and for Determination of Injury) 1995 Rules. The petitioner requests you to please treat the application withdrawn and terminate the present investigations.”[भाग I—खण् ड 1] भारत का रािपत्र : असाधारण 5 D. EXAMINATION BY THE AUTHORITY 11. The said request made by the applicant company, has been examined. The Authority notes that Rule 14(a) of the Rules provides that the Designated Authority shall, by issue of a public notice, terminate an investigation immediately if "it receives a request in writing for doing so from or on behalf of the domestic industry affected, at whose instance the investigation was initiated." 12. In view of the withdrawal of the petition by the applicant company and its request for termination of the investigation, the Authority does not consider it appropriate to deal with the various issues raised by several interested parties, and hereby terminates this investigation. E. CONCLUSION 13. In view of the aforesaid withdrawal of the petition made by the applicant company, i.e., Deepak Nitrite Limited and Rule 14(a) of the Anti-dumping Rules, 1995 the Authority hereby terminates the anti-dumping investigation initiated vide Notification F. No. 6/35/2024-DGTR dated 30th September 2024 concerning the imports of “Para Nitrotoluene (PNT)” originating in or exported from the European Union.
