L.-33004/99 xxxGIDHxxx सी.जी.-डी.एxलxx.-GअID.-E1x3x0x 92021-229573 CG-DL-E-13092021-229573 असाधारण EXTRAORDINARY भाग I—खण्ड 1 PART I—Section 1 प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 262] नई ददल्ली, सोमवार, जसतम्ब र 13, 2021/भाद्र 22, 1943 No. 262] NEW DELHI, MONDAY, SEPTEMBER 13, 2021/BHADRA 22, 1943 वाजणज्य और उद्योग मत्रं ालय (वाजणज्य जवभाग) (व्य ापारार उपाररार महाजनदिे ालय) अजधसरू ना नई ददल् ली, 13 जसतम्ब र, 2021 िारं समाजि जवषय : जवयतनाम स े “6 जम.मी. और उसस े अजधक की मोटाई वाल े प्ल ने मीजडयम डेनजसटी फाइबर बोड’ड’ के आयातों स े सबं जं धत जनणायड क समीक्षा िारं की समाजि । फा. स.ं 7/2/2021-डीिीटीआर.—क. प्रस्ट्त ावना 1. समय-समय पारर यथासंिोजधत सीमा िुल् क टैररफ अजधजनयम, 1975 (जिसे इसके पारश् रात ‘‘अजधजनयम’’ के रुपार म ें भी कहा गया ह)ै और समय-समय पारर यथा-संिोजधत तत्संबंधी सीमा िुल् क टैररफ (पारारटत वस्ट् तुओं पारर पाराटनरोधी िुल् क की पारहरान, आकलन और संकलन तथा क्षजत का जनधाडरण) जनयमावली, 1995 (जिसे इसके पारश् रात ‘‘जनयमावली’’ के रुपार में भी कहा गया ह)ै को ध्यान म ें रखते हुए, ग्रीनप्लाई इंडस्ट्रीि जलजमटेड/ ग्रीनपारनै ल इंडस्ट्रीि जलजमटेड, और रूजसल डेकोर जलजमटेड (जिसे इसके पारश् रात ‘‘आवेदक’’ के रुपार म ें भी कहा गया ह)ै ने जनर्ददष् ट प्राजधकारी (जिन् ह ें आगे "प्राजधकारी" के रुपार म ें भी कहा गया ह)ै के समक्ष जवयतनाम (जिसे आग े संबद्ध दिे के रुपार म ें भी कहा गया ह)ै के मलू के अथवा वहा ं स े जनयाडजतत ‘‘6 जम.मी. और उसस े अजधक की मोटाई वाल े प्ल ेन मीजडयम डेनजसटी फाइबर बोड’ड’ (जिसे आगे "जवराराधीन उत् पाराद" या "संबद्ध वस्ट् तओंु " के रुपार म ें भी कहा गया ह)ै के आयातों स ेसंबंजधत जनणाडयक समीक्षा िांर िुरु करने के जलए एक आवेदन पारत्र दायर दकया था। 5084 GI/2021 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC.1] 2. प्राजधकारी ने आवेदकों द्वारा प्रस्ट्तुत दकए गए प्रथम दष्ृ या साक्ष्य के आधार पारर, संबद्ध दिे के मूल की अथवा वहा ं स े जनयाडजतत संबद्ध वस्ट्तुओं के संबंध म ें लगाए गए िुल्कों को िारी रखन े की िरुरत की समीक्षा करन े के जलए और यह िांर करने के जलए दक क्या यह िुल्क समाि दकए िाने स े घरेल ू उद्योग को पाराटन और क्षजत के िारी रहन े अथवा उसकी पारुनरावृजि होने की संभावना ह,ै जनयमावली के जनयम 23 (1ख) के साथ पाररित अजधजनयम की धारा 9क(5) के अनुसार संबद्ध िांर िुरु करन े के जलए ददनांक 7 िून, 2021 की अजधसूरना स.ं 7/2/2021- डीिीटीआर के तहत एक सावडिजनक सूरना िारी की, जिसे भारत के रािपारत्र म ेंप्रकाजित दकया गया। ख. प्रदिया 3. प्राजधकारी न े जनयमावली के जनयम 23 (1ख) के अनुसार िांर की िरुु आत करन े स े पारूवड वतडमान पाराटनरोधी आवेदन की प्राजि के बारे म ें भारत म ेंसंबद्ध दिे के दतू ावास को अजधसूजरत दकया। 4. प्राजधकारी ने संबद्ध वस्ट्तुओं के आयातों के संबंध में जनणाडयक समीक्षा िांर िुरु करने के जलए भारत के रािपारत्र, असाधारण म ेंप्रकाजित करके ददनांक 7 िून, 2021 की एक सावडिजनक सूरना िारी की । 5. प्राजधकारी ने भारत में संबद्ध देि के दतू ावास, संबद्ध देि से ज्ञात उत्पारादकों/ जनयाडतकों, ज्ञात आयातकों/ उपारयोक्ताओं और घरेल ू उद्योग के साथ-साथ अन्य घरेल ू उत्पारादकों को, आवेदकों द्वारा उपारलब्ध कराए गए पारतों के अनुसार, ददनांक 7 िून, 2021 की िांर िरुु आत करन े संबंधी अजधसूरना की एक प्रजत भेिी और उन्ह ें जनधाडररत समय-सीमा के जलजखत म ेंअपारन े जवरारों से अवगत कराने का अनुरोध दकया । 6. प्राजधकारी ने जनयमावली के जनयम 6 (3) के अनुसार ज्ञात उत्पारादकों/ जनयाडतकों और भारत में संबद्ध देि से दतू ावास को आवेदन के अगोपारनीय पाराि की एक प्रजत प्रदान की। 7. भारत में संबद्ध दिे ों के दतू ावासों को भी अपारने दिे से जनयाडतकों/ उत्पारादकों को यह पाररामिड देने का अनुरोध दकया गया था दक वे जनधाडररत समय-सीमा के भीतर प्रश्नावली का उिर भेिें। जनयाडतकों/ उत्पारादकों को भेिी गयी प्रश्नावली और पारत्र की एक प्रजत संबद्ध देिों से ज्ञात जनयाडतकों/ उत्पारादकों को उनके नाम और पारतों के साथ उन्ह ेभी भेिी गयी थी। 8. िांर िुरुआत करने की अजधसूरना और सूरना के उिर में, संबद्ध देि से जनयाडतकों/ उत्पारादकों ने जनयाडतक प्रश्नावली उिर दाजखल करके प्राजधकारी को उिर ददया । ग. घरेल ूउद्योग स ेप्राि अनरु ोध 9. प्राजधकारी को घरेल ू उद्योग की ओर स े भारतीय पारैनल बोड ड जनमाडता संघ से ददनांक 1 जसतम्बर, 2021 का पारत्र प्राि हुआ जिसमें उन्होंन े अपारनी याजरका वापारस लेन े का अनरु ोध दकया और तदनुसार जनयमों के तहत वतडमान िांर को समाि करन े का अनरु ाध दकया। घ. प्राजधकारी द्वारा िारं 10. घरेलू उद्योग द्वारा ददनांक 1 जसतम्बर, 2021 के पारत्र के तहत दकए गए अनुरोध की िांर की गई। प्राजधकारी यह नोट करत े ह ैंदक जनयमावली के जनयम 14 (क) का पाराि इस प्रकार ह ै: "जनर्ददष् ट प्राजधकारी सावडिजनक सूरना िारी करके कोई िांर तत्काल समाि करेंग,े यदद - (क) उसे घरेल ूउद्योग, जिसके आवेदन पारर िांर िुरू की गई थी, स ेया उसकी ओर से ऐसा करन ेके जलए जलजखत म ेंआवेदन प्राि हो;” 11. यह नोट दकया िाता ह ै दक जनयमावली के जनयम 14(क) के तहत यह प्रावधान ह ै दक प्राजधकारी एक सावडिजनक सूरना िारी करके िांर को समाि करेंग,े यदद उन्ह ें ऐसे प्रभाजवत घरेल ू उद्योग स े या उसकी ओर से ऐसा करन े के जलए जलजखत म ेंआवेदन प्राि होता ह,ै जिसके अनुरोध पारर िांर िुरु की गई थी। 12. वतडमान िांर घरेलू उद्योग के रुपार म ें ग्रीनप्लाई इंडस्ट्रीि जलजमटेड/ ग्रीनपारैनल इंडस्ट्रीि जलजमटेड, और रूजसल डेकोर जलजमटेड द्वारा दायर दकए गए एक आवेदन के आधार पारर िरूु की गई थी। घरेलू उद्योग ने आवेदन को वापारस जलया गया मानने के जलए जलजखत म ेंअनुरोध दकया ह।ै[भाग I—खण् ड 1] भारत का रािपारत्र : असाधारण 3 ड. जनष्क ष ड 13. घरेलू उद्योग द्वारा दकए गए उपाररोक्त अनुरोध को देखते हुए प्राजधकारी एतद्द्वारा जनयमावली के जनयम 14 (क) के अनुसार जवयतनाम के मूल के अथवा वहा ं स े जनयाडजतत ‘‘6 जम.मी. और उससे अजधक की मोटाई वाले प् लेन मीजडयम डेनजसटी फाइबर बोड’ड’ के आयातों के जखलाफ ददनांक 7 िून, 2021 की अजधसूरना स.ं 7/2/2021- डीिीटीआर के तहत िरुु की गयी िांर को समाि करत ेह ैं। अनंत स्ट्वरुपार, जनर्ददष् ट प्राजधकारी MINISTRY OF COMMERCE AND INDUSTRY (Department of Commerce) (DIRECTORATE GENERAL OF TRADE REMEDIES) NOTIFICATION New Delhi, the 13th September, 2021 TERMINATION Subject : Termination of sunset review anti-dumping investigation concerning imports of “Plain Medium Density Fibreboard having thickness 6mm and above” from Vietnam F. No. 7/2/2021-DGTR.—A. Introduction 1. Having regard to the Customs Tariff Act, 1975 as amended from time to time (hereinafter also referred as the “Act”) and the Customs Tariff (Identification, Assessment and Collection of Anti- dumping Duty on Dumped Articles and Determination of Injury) Rules, 1995 (hereinafter also referred as the “Rules”), thereof, Greenply Industries Limited/Greenpanel Industries Limited and Rushil Décor Limited (hereinafter also referred to as the “Applicants”) filed an application before the Designated Authority (hereinafter also referred to as the “Authority”) for initiation of sunset review investigation and extension of anti-dumping duty on imports of “Plain Medium Density Fibreboard having thickness 6mm and above” (hereinafter referred to as the “product under consideration” or the “subject goods”) originating in or exported from Vietnam (hereinafter referred to as the “subject country”). 2. The Authority, based on the prima facie evidence submitted by the applicants, issued a public notice vide Notification No. 7/2/2021-DGTR, dated 7th June, 2021 published in the Gazette of India, initiating the subject investigation in accordance with Section 9A(5) of the Act read with Rule 23(1B) of the Rules to review the need for continued imposition of the duties in force in respect of the subject goods originating in or exported from the subject country and to examine whether the expiry of such duty is likely to lead to continuation or recurrence of dumping and injury to the domestic industry. B. Procedure 3. The Authority notified the Embassy of the subject country in India about the receipt of the present anti-dumping application before proceeding to initiate the investigation in accordance with Rule 23(1B) of the Rules. 4. The Authority issued a public notice dated 7th June, 2021 published in the Gazette of India Extraordinary, initiating the sunset review investigation concerning imports of the subject goods. 5. The Authority sent a copy of the initiation notification dated 7th June, 2021 to the Embassy of the subject country, known producers / exporters form the subject country, known importers / users and the domestic industry as well as other domestic producers as per the addresses made available by the Applicants and requested them to make their views known in writing within the prescribed time limit. 6. The Authority provided a copy of the non-confidential version of the application to the known producer / exporters and to the Embassy of the subject country in India in accordance with Rule 6(3) of the Rules.4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC.1] 7. The Embassy of the subject country in India was also requested to advise the exporters / producers from their country to respond to the questionnaire with the prescribed time limit. A copy of the letter and questionnaire sent to the producers / exporters was also sent to them along with the names and addresses of the known producers / exporters from the subject country. 8. In response to the initiation notification, the producers / exporters from the subject country responded to the Authority by filing questionnaire response. C. Request received from the domestic industry 9. The Authority has received a letter dated 1st September, 2021 from the Association of Indian Panel Board Manufacturer on behalf of domestic industry, with a request for withdrawal of their petition and has accordingly requested termination of the present investigation as per Rules. D. Examination by the Authority 10. The request made by the domestic industry, vide letter dated 1st September, 2021 has been examined. The Authority notes that Rule 14 (a) of the Rules reads as under: “The designated authority shall, by issue of a public notice, terminate an investigation immediately if – (a) it receives a request in writing for doing so from or on behalf of the domestic industry affected, at whose instance the investigation was initiated;” 11. It is noted that Rule 14(a) of the Rules provides that the Authority shall, by issue of a public notice, terminate an investigation if it receives a request in writing for doing so from or on behalf of the domestic industry affected, at whose instance the investigation was initiated. 12. The present investigation was initiated based on an application filed by Greenply Industries Limited/Greenpanel Industries Limited and Rushil Décor Limited constituting domestic industry. The domestic industry has made a written request to treat the application as withdrawn. E. Conclusion 13. In view of the aforesaid request made by the domestic industry, the Authority hereby terminates the investigation initiated vide Notification No. 7/2/2021-DGTR, dated 7th June, 2021 against the imports of “Plain Medium Density Fibreboard having thickness 6mm and above” from Vietnam in terms of Rule 14(a) of the Rules.
