पाटनरोधी िल्ु क का आकलन और संग्रहण तथा क्षजत जनधाारण) जनयमावली, 1995 (जिसे आगे ‘’जनयमावली’’ अथवा
‘’पाटनरोधी जनयमावली’’ भी कहा गया ह)ै को ध् यान मर रखते एए फ्युचरू ा सेरेजमक् स प्राइवेट जलजमटेड (जिसे यहां आग े
‘आवेदक’ भी कहा गया ह)ै ने चीन िन.गण., (जिसे आगे संबद्ध देि भी कहा गया है) के मलू के अथवा वहां से जनयााजतत
‘’सेराजमक रोलस’ा’ जिसे यहां आग े (‘’जवचाराधीन उत् पाद’’ अथवा ‘’पीयूसी’’ भी कहा गया ह)ै के आयातों पर पाटनरोधी
िुल् क क जनणाायक समीक्षा िांच के जलए जनर्ददष् ट प्राजधकारी (जिन् ह र आगे प्राजधकारी भी कहा गया है) के समक्ष एक आवेदन
प्रस्ट् तुत दकया था ।

2. अजधजनयम क धारा 9क (5) के अनुसार, लागू पाटनरोधी िल्ु क को यदद पहले नह हटाया िाता ह ै तो उसे लाग ू
करने क तारीख से पांच वषा समाप् त होने पर जनष्प्र भावी हो िाएगा और प्राजधकारी के जलए यह समीक्षा करना
अपेजक्षत ह ै दक क्य ा िल्ु क समाप् त होन े से पाटन और क्षजत के िारी रहन े या पुनरावृजत होन े क संभावना
ह ै । इसके अनुसार, प्राजधकारी के जलए घरेलू उद्योग द्वारा या उसक ओर स े दकए गए जवजधवतरूप से साक्षय ांदकत
आवेदन के आधार पर इस बात क समीक्षा करना अपेजक्षत ह ै दक क्य ा िुल् क क समाजि से पाटन और क्षजत के
िारी रहन ेया उसक पुनरावृजत होने क संभावना ह ै।
3. तद्नुसार, प्राजधकारी ने भारत के रािपत्र, असाधारण म र प्रकाजित ददनांक 30 जसतंबर, 2022 को एक सावािजनक
सूचना िारी क जिसके द्वारा चीन िन.गण. के मूल के अथवा वहां से जनयााजतत अध् याय 69 के तहत वगीकृत
‘’सेराजमक रोलस’ा’ के आयातों से संबंजधत जनणाायक समीक्षा िांच क िुरूआत क गई थी ।
ख. पष्ृ ठ भजू म
4. जनर्ददष् ट प्राजधकारी ने अंजतम िांच पररणाम अजधसूचना सं. 14/47/2016-डीिीएडी ददनांक 26 माच,ा 2018 के
माध् यम से चीन िन गण के मलू के अथवा वहां से जनयााजतत संबद्ध वस्ट् तु के आयातों के संबंध मर िांच क थी और
पाटनरोधी िल्ु क लगान े क जसफाररि क थी । तत्प श् चात केन्र सरकार न े अजधसूचना सं. 27/2018-सीमािुल् क
(एडीडी) ददनांक 17 मई, 2018 के माध् यम से पाटनरोधी िल्ु क लगाया था । यह िल्ु क 16 मई, 2023 को समाप् त
होना जनधााररत ह ै।
ग. प्रदिया
5. प्राजधकारी न े िांच िुरूआत के बाद िांच िुरूआत संबंधी अजधसूचना क प्रजतयां भारत म र संबद्ध देि के दतू ावास,
संबद्ध देि के ज्ञात उत् पादकों/जनयाातकों, ज्ञात आयातकों/प्रयोक्त ाओं और घरेल ू उद्योग को आवेदक द्वारा उपल ध
कराए गए ई-मेल पतों के अनुसार भेिी थी और उनसे ए डी जनयमावली के जनयम 6(2) के अनुसार िांच िरूु आत
अजधसूचना के 30 ददनों के भीतर जलजखत मर अपने जवचारों से अवगत कराने का अनुरोध
दकया था ।
6. प्राजधकारी ने 10 नवंबर, 2022 तक प्रश्न ावली का उत् तर देन े के जलए पहली बार समय ब़ााया और आगे उत् तर
प्रस्ट् तुत करन े के जलए 20 नवंबर, 2022 तक समय ब़ााया गया, जिसे डी िी टी आर क वबै साइट के माध् यम स े
सावािजनक डोमेन मर रखा गया था ।
7. प्राजधकारी ने जनयमावली के जनयम 6(3) के अनुसार ज्ञात उत् पादकों/जनयाातकों तथा भारत म र संबद्ध देि के
दतू ावास को आवेदन के अगोपनीय अंि क एक प्रजत उपल ध कराई थी ।
8. भारत म र संबद्ध दिे के दतू ावास से जवजहत समय सीमा के भीतर प्रश् नावली का उत् तर देन े के जलए अपन े देि के
जनयाातकों/उत् पादकों को सलाह देने का अनरु ोध भी दकया गया था । उत् पादकों/जनयाातकों को भेिे गए पत्र और
प्रश् नावली क एक प्रजत संबद्ध देि स े ज्ञात उत् पादकों/जनयाातकों के नाम और पतों के साथ दतू ावास को भी भेिी
गई थी ।
9. िांच िुरूआत अजधसूचना और सूचना के उत् तर म र संबद्ध दिे से जनयाातकों/उत् पादकों और आयातकों/प्रयोक्त ाओं
ने जनयाातक प्रश् नावली के उत् तर और कानूनी अनरु ोध प्रस्ट् तुत करके प्राजधकारी को उत् तर ददया था ।
घ. घरेल ूउद्योग स ेप्राप्त अनरु ोध
10. ददनाकं 14 नवंबर, 2022 के ई-मेल के माध् यम स े आवेदक ने सजू चत दकया दक कंपनी के समक्ष आन े वाली कजतपय
करठनाइयों के कारण कंपनी जनणाायक समीक्षा िांच पर आग ेकारावाई नह चाहती ह ै।
11. जनर्ददष् ट प्राजधकारी ने ददनांक 1 ददसंबर, 2022 को घरेलू उद्योग को व् यजगगत सुनवाई का अवसर ददया था ।
तथाजप, आवेदक ने ददनांक 29 नवंबर, 2022 के ई-मेल द्वारा सूजचत दकया दक वह यह बताते एए बैठक म र
उपजस्ट्थत होन े मर असमथा ह ैंदक, ‘’कंपनी ने इस बात पर जवचार करत ेएए उत् पादन बंद करन ेका जनणाय जलया ह ैदक
उसे चीन से पाटन का समाधान करन ेके जलए पयााप् त संरक्षण जमलने क संभावना नह ह ै। अत: कंपनी प्रस्ट् ताजवत
बैठक मर उपजस्ट्थत होन ेमर असमथा होगी ।’’[भाग I— खण् ड 1] भारत का रािपत्र : असाधारण 3
ड. प्राजधकारी द्वारा िाचं
12. घरेलू उद्योग, फ्युचुरा सेराजमक्स प्राइवेट जलजमटेड द्वारा 14 नवंबर, 2022 और 29 नवंबर, 2022 के ई-मेल के
माध् यम से दकए गए अनुरोध क िांच क गई ह ै।
13. वतामान िांच घरेल ू उद्योग के रूप म र फ्युचुरा सेराजमक् स प्राइवेट जलजमटेड द्वारा दायर आवेदन के आधार पर िरूु
क गई थी । आवेदक भारत म रसंबद्ध वस्ट् तु का एकमात्र उत् पादक ह ै।
14. प्राजधकारी नोट करत े ह ैंदक जनयमावली का जनयम 14(क) जनम्न ानुसार उल्ल ेख करता ह ै:
‘’14. िांच क समाजि – जनर्ददष्ट प्राजधकारी एक सावािजनक सूचना िारी करके दकसी िांच को तत्क ाल समाप् त
कर दगरे यदद- (क) उन् ह रपीजऺडत घरेलू उद्योग जिसके अनरुोध पर िांच क िरूु आत क गई थी, से या उसक ओर
स ेजलजखत म रऐसा करन ेका अनरुोध प्राप् त होता ह ै।’’
15. यह नोट दकया गया ह ै दक पाटनरोधी जनयमावली का जनयम 14 कजतपय जस्ट्थजतयों मर िांच क समाजि का
प्रावधान करता ह ै जिनमर ऐसी जस्ट्थजत िाजमल ह,ै िहां कंपनी द्वारा आवेदन वापस ल े जलया िाता ह ै ।
जनयमावली का जनयम 14(क) मर यह प्रावधान ह ै दक प्राजधकारी एक सावािजनक सूचना िारी करके िांच तत्क ाल
समाप् त कर दगर े यदद उन् ह र उस पीजऺडत घरेलू उद्योग, जिसके कहने पर िांच िुरू क गई थी, से या उसक ओर स े
जलजखत मर ऐसा करन े का अनरु ोध प्राप् त होता ह ै।

16. घरेल ू उद्योग, फ्युचरु ा सरे ाजमक् स प्राइवेट जलजमटेड द्वारा दकए गए पूववोकक्त अनुरोध के म्ेनिर और जनयमावली के

TERMINATION NOTIFICATION

Subject: Termination of sunset review investigation of anti-dumping duty on the imports of “Ceramic Rollers”
originating in or exported from China PR.
A. Introduction
F. No. 07/18/2022-DGTR.—Having regard to the Customs Tariff Act, 1975 as amended from time to time
(hereinafter also referred to as the “Act”) and the Customs Tariff (Identification, Assessment and Collection of Anti-
dumping Duty on Dumped Articles and for Determination of Injury) Rules, 1995, as amended from time to time
(hereinafter also referred to as the “Rules” or the “Anti-Dumping Rules”), thereof, Futura Ceramics Private Limited
(hereinafter also referred to as the “applicant”) filed an application before the Designated Authority (hereinafter also
referred to as the “Authority”) for sunset review investigation of anti-dumping duty on the imports of “Ceramic
Rollers” (hereinafter referred to as the “product under consideration” or the “PUC”) originating in or exported from
China PR (hereinafter referred to as the “subject country”).
2. In terms of Section 9A (5) of the Act, the anti-dumping duty imposed under this section shall, unless revoked
earlier, cease to have effect on expiry of five years from the date of such imposition and the Authority is required to
review whether the expiry of duty is likely to lead to continuation or recurrence of dumping and injury. In accordance
with the same, the Authority is required to review, on the basis of a duly substantiated request made by or on behalf of
the domestic industry as to whether the expiry of duty is likely to lead to continuation or recurrence of dumping and
injury.
3. The Authority accordingly issued a public notice dated 30th September 2022 published in the Gazette of India-
Extraordinary, initiating the sunset review investigation concerning imports of “Ceramic Rollers”, classified
under chapter 69 of the Customs Tariff Act, 1975 originating in or exported from China PR.4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC.1]
B. Background
4. The Designated Authority conducted investigation and recommended imposition of anti-dumping duty on
imports of the subject goods originating in or exported from China PR, vide final finding Notification No.
14/47/2016 -DGAD dated 26th March 2018. The Central Government thereafter vide Notification No.
27/2018-Cus (ADD), dated 17th May 2018 imposed anti-dumping duties. The duties are set to expire on
16th May 2023.
C. Procedure
5. The Authority post-initiation sent copies of the initiation notification to the Embassy of the subject country in
India, known producers/ exporters from the subject country, known importers/ users and the domestic
industry as per the e-mail addresses made available by the applicant and requested them to make their views
known in writing within 30 days of the initiation notification as per Rule 6(2) of the Rules.
6. The Authority, granted first extension, to file questionnaire response by 10th November 2022 and further
extension to file the response by 20th November 2022, which was placed in the public domain through
DGTR’s website.
7. The Authority provided a copy of the non-confidential version of the application to the known
producers/exporters and to the embassy of the subject country in India in accordance with Rule 6(3) of the
Rules.
8. The embassy of the subject country in India was also requested to advise the exporters/ producers from its
country to respond to the questionnaire within the prescribed time limit. A copy of the letter and
questionnaire sent to the producers/ exporters was also sent to them along with the names and addresses of
the known producers/ exporters from the subject country.
9. In response to the initiation notification and intimation, exporters/ producers from the subject country and
importers/ users responded to the Authority by filing the questionnaire response and filing legal submissions.
D. Request received from the domestic industry
10. The applicant, vide email dated 14th November 2022 informed that the company does not want to proceed
further with the sunset review application due to certain hardships faced by the company.
11. The Designated Authority gave an opportunity to the domestic industry for personal hearing on 1st December,
2022. However, the applicant vide email dated 29th November 2022 informed that he is not able to attend the
meeting stating that, “The company has decided to close down production, considering that it is unlikely to
get protection adequate enough to address the Chinese dumping. The company would therefore not be able
to attend the proposed meeting.”
E. Examination by the Authority
12. The request made by the domestic industry, Futura Ceramics Private Limited, vide its e-mail dated
14th November 2022 and 29th November 2022, has been examined.
13. The present investigation was initiated based on an application filed by Futura Ceramics Private Limited
constituting the domestic industry. The applicant is the sole producer of the subject goods in India.
14. The Authority notes that Rule 14 (a) of the Rules reads as under:
“14. Termination of investigation. – The designated authority shall, by issue of a public notice, terminate an
investigation immediately if - (a) it receives a request in writing for doing so from or on behalf of the
domestic industry affected, at whose instance the investigation was initiated;”
15. It is noted that Rule 14 of Anti-Dumping Rules, 1995 provides for termination of investigations in certain
situations which includes a situation where the application is withdrawn by affected domestic industry. Rule
14(a) of the Rules provides that the Authority shall, by issue of a public notice, terminate an investigation
immediately if it receives a request in writing for doing so from or on behalf of the domestic industry
affected, at whose instance the investigation was initiated.
F. Conclusion
16. In view of the aforesaid request made by the domestic industry, the Authority hereby terminates the
investigation initiated vide notification no. 7/18/2022- DGTR dated 30th September, 2022 against the imports
of “Ceramic Rollers” originating in or exported from China PR in terms of Rule 14(a) of the Rules.
