"प्रपत्र" का अजभप्राय इन जनयमों के साथ सलं ग्न अनासूची म ें जवजन्दष्ट कोई भी प्रपत्र; (च) "संपकग अजधकारी" का अजभप्राय पररवहन वाहन का पररचालन पयगवेिण करने और याजत्रयों एव ं सीमा िाल्क तथा आव्रजन अजधकाररयों और याजत्रयों तथा जनधागररत भोजन आउटलेट या रेस्ट्तरां के बीच संपकग रखने के जलए अजधकृत क्रू म ें िाजमल अजधकारी; (छ) "सहायक प्रमाण पत्र" से अजभप्राय एमओय ूपर हस्ट्त ािर करने वाले पिकार द्वारा जारी प्रमाण पत्र ह;ै (ज) "ड्राइववग लाइसेंस" स े सिम प्राजधकारी द्वारा जारी ऐसा दस्ट् तावेज अजभप्रेत ह,ै जजसम ें जवजन्द्‍ ट व् यज‍त को मोटर यान चलाने के जलए अजधकृत दकया जाता ह;ै (झ) "यान" स े भारत और उसके पडोसी दिे (िों) के बीच माल ढालाई और याजत्रयों के आवागमन के जलए मोटर यान अजभप्रेत ह;ै (ञ) "दिटनेस प्रमाण पत्र" से अजभप्राय सिम प्राजधकारी द्वारा जारी प्रमाण पत्र ह,ैजो सड़क पर चलने के जलए यान की यांजत्रक योग् यता प्रमाजणत करता ह;ै[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 3 (ट) "बीमा पॉजलसी" स े अजभप्राय भारतीय ित्रे म ें जवस्ट् तारणीय एक जवजधमान् य वाहन बीमा पॉजलसी अजभप्रेत ह ै जजसम ें तृतीय पिकार जोजखम व् यापक रूप स े सजम् मजलत ह;ै (ठ) "पंजीकरण प्रमाण पत्र" का अजभप्राय, जब एक यान के संबंध म ें प्रयोग दकया जाता ह,ैसिम प्राजधकारी द्वारा जारी पंजीकरण प्रमाण पत्र ह;ै (ड) "पीयूसी प्रमाण पत्र" का अजभप्राय ह ै भारत या भारत के पड़ोसी देिों म ें उपयिा प्राजधकारी द्वारा जारी प्रदर्ू ण जनयंत्रण प्रमाण पत्र; (ढ) "जनधागररत सेवा मागग" का अजभप्राय भारत और अन्य पड़ोसी दिे (िों) के बीच बस सेवा के जवजनयमन के जलए समय साररणी और समझौते के प्रोटोकॉल म ें जवजन्द्‍ ट अन्य पररचालन संबंधी आयाम; (ण) "परजमट" स े सिम प्राजधकारी द्वारा जारी दकया गया दस्ट्त ावेज अजभप्रेत ह,ै जजसके द्वारा यान के प्रचालन को प्राजधकृत दकया जाता ह;ै (त) "जवस्ट् िोटक लाइसेंस" से उद्योग संवधगन और आंतररक व् यापार जवभाग, वाजणज् य और उद्योग मंत्रालय, भारत सरकार के अधीन पेरोजलयम जवस्ट् िोटक सारिा संगठन द्वारा जारी दकया गया लाइसेंस अजभप्रते ह;ै (थ) "राज्य " का अजभप्राय भारत ह।ै 3. परजमट का प्रपत्र, सामग्री और अवजध आदद - (1) पररवहन वाहन के जलए जनयजमत परजमट अनासूची-I म ें जनधागररत प्रपत्र में होगा औरयह गरै -हस्ट्तांतरणीय होगा। (2) पररवहन वाहन के जलए एक जनयजमत परजमट एक वर्ग के जलए मान् यहोगा और वार्षर्क आधार पर अजधकतम पांच वर् ग की अवजध तक नवीकरणीय होगा। 4. दकसी वाहन की योग्य ता की जस्ट्थजत - (1) एक पररवहन वाहन का जनमागण और रख-रखाव ऐसा होना होगा दक यह हर समय इस े चलान े वाल े व्यजि के प्रभावी जनयंत्रण म ेंहोना चाजहए। (2) उप-जनयम (1) म ें जवजन्दष्ट पररवहन यान चालक के पास होना होगा, - (क) संबंजधत दिे के कानून के तहत जारी एक वैध पंजीकरण प्रमाण पत्र; (ख) संबंजधत दिे के कानून के तहत जारी दिटनेस का वधै प्रमाण पत्र; (ग) संबंजधत दिे के कानून के तहत जारी एक वैध बीमा पॉजलसी; (घ) संबंजधत दिे के कानून के तहत जारी एक वैध परजमट; (ड.) याजत्रयों की राष्ट्रीयता के जववरण के साथ एक यात्री सूची; (च) संबंजधत दिे के कानून के तहत एक वैध पीयूसी प्रमाण पत्र; तथा (छ) यदद दकसी भी प्रकार के खतरनाक माल की ढालाई की जा रही ह ै तो इस तरह के वाहन के संबंध म ें वैध जवस्ट्िोटक लाइसेंस दकसी सिम प्राजधकारी द्वारा ऐस े वाहन के जनरीिण के जलए उि सभी दस्ट्तावेज उपलब्ध कराए जाएगं े। 5. ड्राइवर और कंड‍टर के जलए ितें (1) दकसी पररवहन वाहन के चालक के पास इस प्रकार के वाहन को चलाने का सिम प्राजधकारी द्वारा जारी वैध ड्राइववग लाइसेंस और चालक का बैज होना चाजहए।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (2) दकन्हीं कारणों स,े दकसी दिे के उप-जनयम (1) म ें जवजन्दष्ट चालक अन् य दिे म ें अपने कतगव्यों का पालन करने म ें असमथग होता ह,ैतो ऐसे अन्य दिे के सिम प्राजधकारी द्वारा जारी वैध लाइसेंसधारी ड्राइवर वाहन चला या वाहन के कंड‍ट र के रूप म,ें जैसा भी मामला हो,काय ग कर सकता ह।ै 6. पररवहन वाहन पर प्रदर्षित दकए जान े वाल े जवजिष्ट जववरण-समझौते के तहत प्रचालनम ें पररवहन वाहन को सिम प्राजधकारी द्वारा सौंपी गई पंजीकरण संख्या के अलावा जनम्नजलजखत जववरण अंग्रेजी म ें और संबंजधत दिे की आजधकाररक भार्ा म ें [वैध रूप स े पेंट दकए गए एक सादे प्लेट या वाहनों पर लगाए गए प्लेटों पर प्र‍येक अिर अजधकतम दो इंच (पांच सेंटीमीटर) ऊंचा और दो इंच (पांच सेंटीमीटर) चौड़ा], अंदकत दकए जाएंगे,अथागत:् - (i) भारत के पड़ोसी दिे का स्ट्थान -भारत का स्ट्थान - भारत के पड़ोसी दिे का स्ट्थान (इस तरह के पररवहन वाहन के आग े और पीछे की तरि एक जवजिष्ट स्ट्थान पर)। (ii) पररवहन वाहन सेवा के सचं ालक का नाम (ऐसे पररवहन वाहन के दोनों ओर)। 7. बस चालक दल (क्रू) का व्यजिगत प्रभाव —समझौते के तहत प्रचाजलत पररवहन वाहन का बस चालक दल (क्रू)दोनों देिों के सीमा िल्ा क कानूनों म ें जन्दष्ट ितों के अधीन मेजबान दिे म ें अपने प्रवास की अवजध के संबंध म ें ऐस े व्यजिगत प्रभाव अपन े साथ रख सकता ह,ै जैसा दक आवश्यक हो। 8. वाहन का बीमा- कोई पररवहन वाहन, जजसकी ऐसी बीमा पॉजलसी ना हो, जो पररवहन वाहन के प्रयोग स े उ‍ पन् न व्यापक या तीसरे पि के जोजखम को कवर करती ह ै और जो संबंजधत दिे के कानून की आवश्यकताओं का अनापालन ना करता ह,ै इन जनयमों के तहत प्रचाजलत नहीं होगा। 9. इसम ेंिाजमल जवजभन्न जहतधारकों की जजम्मदे ारी- i. पररवहन जवभाग, भारत के दकसी भी राज्य की सरकार (जैसा दक एमओयूमें उल्लेख दकया गया ह)ै की पररवहन सेवा के प्रचालन के जलए जजम्मेदार होगा और वह उन्ह ेंसौंपे गए जवजभन्न अन्य कतगव्यों का पालन करेगा। ii. पररवहन सेवा को सारिा प्रदान करने की जजम् मदे ारी राज्य पाजलस की होगी। डीआईजी रैंक के पाजलस कायागलय को ऐसी जजम्मेदाररयों सौंपी जाएंगी। iii. राज्य का स्ट्वास्ट््य जवभाग जचदक‍सा साजवधाओं / आपात जस्ट्थजतयों के जलए समन्वय करेगा। iv.पररवहन सेवा के साचारू प्रचालन के जलए इंटेजलजेंस संबधं ी माद्दों के समन्वय की जजम्मेदारी के साथ इंटेजलजेंस ब्यरू ो (आईबी) नोडल इंटेजलजेंस एजसें ी होगी। v.राज्य पररवहन जवभाग द्वारा पररवहन सेवा दकतने ददनों तक चलगे ी (जैसा दक एमओय ू म ें उजल्लजखत ह)ै और आवृजत्त की समीिा की जाएगी और उसे मागं के अनासार जवजनयजमत दकया जाएगा। vi. पररवहन सेवा एमओय ू म ें उजल्लजखत जवजन्दष्ट मागों का अनासरण करेगीऔर राज्य पररवहन जवभाग वाहन के रूकने के स्ट् थान(नों) का िैसला करेगा। vii. राज्य पररवहन जवभाग जनधागररत स्ट्थान स े प्रस्ट्थान के पूव ग रटकट, वाहन का दोर् माजगन, वाहन की सड़क पर चालन योग्यता,याजत्रयों और चालक दल की तलािी/ जांच, सामान संभालना आदद जैसी औपचाररकताओं का ध्यान रखेगा। viii. जवजभन्न एजेंजसयां भारत के आईसीपी (इंटीग्रेटेड चेक पोस्ट्ट) पर उन्ह ेंसौंपी गई जजम्मेदाररयां जनभाएंगी।[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 5 अनूसूची-I (जनयम 3 देख)ें भारत (भारत)-भारत के पड़ोसी देिों (माडं ल)े के बीच चलने वाले पररवहन वाहनों को चलाने के जलए परजमट का प्रपत्र *जनयजमत परजमट (जो लागू न हो, काट दें) भारत सरकार / भारत के पड़ोसी दिे की सरकार भारत (भारत) - DRAFT RULES 1. Short title and commencement (1) These rules may be called as the Central Motor Vehicles (Regulation of Bus Service between India and Neighbouring countries of India (Movement of Vehicles Carrying Goods and Passengers) Rules, 2020. (2) These rules shall come into force on the date of their final publication in the Official Gazette. 2. Definitions In these rules, unless the context otherwise requires. a) “MoU” means the Agreement between the Government of the Republic of India and the Neighbouring countries of India for the regulation of Bus Service between India and other Neighbouring countries of India duly signed on any specific date; b) "authorisation fee" means the fee to be paid by the permit holder of one country to the other country for obtaining authorisation; c) "crew" means driver, conductor and the liaison officer; d) "competent authority" means,— in relation to— (i) "permits", an authority competent to issue such a permit authorised under the law of the Neighbouring countries of India; (ii) "driving licence", an authority competent to issue such a driving licence authorized under the law of the Neighbouring countries of India; (iii) "conductor's licence", an authority competent to issue such a conductor's licence authorised under the law of the country concerned; "country" means India or Neighbouring countries of India, as the case may be;[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 7 (iv) “registration certificate”, an authority competent to issue such Registration Certificate under the law of Neighbouring countries of India; e) "Form" means any of the Form specified in the Schedule annexed to these rules; f) "Liaison Officer" means official included in the crew authorised to carry out operational supervision of transport vehicle and to keep liaison between passengers and customs and immigration authorities and between passengers and prescribed food outlets or restaurants; g) “helper’s certificate” means a certificate issued by the party signing the MoU; h) “driving licence” means the document issued by a competent authority, authorising the person specified therein to drive a motor vehicle; i) “vehicle” means motor vehicle, for the carriage of Passengers and Goods between India and Neighbouring countries of India ; j) “certificate of fitness” means a certificate issued by a competent authority, testifying the mechanical fitness of the vehicle to ply on the road; k) “insurance policy” means a valid vehicle insurance policy, extendable in Indian territory, covering comprehensive third party risks; l) “registration certificate” when used with reference to a vehicle, means the certificate of registration issued by the competent authority; m) "PUC certificate" means Pollution Under Control Certificate issued by appropriate authorities in Neighbouring countries of India or India; n) "scheduled service routes" mean the routes along with the time schedule and other related operational aspects specified in the Protocol to the Agreement for the regulation of bus service between India and other Neighboring Countries; o) “permit” means document issued by the competent authority authorising the movement of a vehicle; p) “explosive license” means license issued by Petroleum Explosive Safety Organisation under Department for the Promotion of Industry and Internal Trade, Ministry of Commerce and Industry, Government of India; q) “State” means State of India. 3. Forms, contents and duration, etc., of the permit.—(1) A regular permit for transport vehicle shall be in the Form set out in Schedule I and shall be non-transferable. (2) A regular permit for transport vehicle shall be valid for one year and renewable upto a maximum period of five years on a yearly basis. 4. Eligibility conditions of a vehicle.—(1) A transport vehicle shall be so constructed and maintained as to be at all times under the effective control of the person driving it. (2) Driver of a transport vehicle referred to in sub-rule(1) shall have,— (a) a valid registration certificate issued under the law of the country concerned; (b) a valid certificate of fitness issued under the law of the country concerned; (c) a valid insurance policy issued under the law of the country concerned; (d) a valid permit under the law of the country concerned; (e) a passenger list with details of their nationality; and (f) a valid PUC certificate under the law of the country concerned; (g) a valid Explosive license if any kind of hazardous goods are being transported in respect of such vehicle and shall make all the said documents available for inspection by any authority competent to inspect such vehicle. 5. Conditions for the driver and conductor.—(1) The person driving a transport vehicle shall be in possession of a valid driving licence issued by a competent authority to drive such a vehicle and the driver's badge. (2) The conductor of a transport vehicle shall be in possession of a valid conductor's licence issued by a competent authority.8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (3) For any reason, a driver referred to in sub-rule (1) or a conductor referred to in-sub-rule (2), of a country is unable to perform his duties in the other country, a driver or a conductor in possession of a valid licence issued by the competent authority of such other country, may drive or act as a conductor of the vehicle, as the case may be. 6. Distinguishing particulars to be exhibited on the transport vehicle. In addition to the registration number assigned to a transport vehicle operating under the Agreement by the competent authority, the following particulars shall be painted in English and in official language of the respective country [each letter being not less than two inches (five centimeters) high and two inches (five centimeters) wide, legibly painted on a plain plate or plates affixed to the vehicles], namely:— (i) Place of India - Place of India Neighboring Country - Place of India (on front side and back side of such transport vehicle in a conspicuous place). (ii) Name of the operator of the bus service (on both the sides of such transport vehicle). 7. Personal effects of bus crew.—The bus crew of a transport vehicle operating under the Agreement may carry such personal effects, as may be necessary, having regard to the period of their stay in the host country subject to conditions specified in the customs laws of both countries. 8. Insurance of the vehicle.—No transport vehicle which does not have a policy of insurance which covers comprehensive or third party risks, arising out of the use of transport vehicle and which complies with the requirements of the law of the country concerned shall operate under these rules. 9. Responsibility of various stakeholders involved- i. The Transport Department, Government of any States of India (as mentioned in MoU) will be responsible for the conduct of the bus service and will perform various other duties assigned to them. ii. It will be the duty of State police to provide security to the bus service. A DIG rank police office shall be assigned such responsibilities. iii. Health Department of the State will coordinate for medical facilities/emergencies. iv. Intelligence Bureau (IB) will be the nodal Intelligence Agency with responsibility to coordinate the intelligence related issues for smooth conduct of bus service. v. The bus service will be running for as many days (as mentioned in MoU) and frequency will be reviewed by the State Transport Department and increase as per demand. vi. The bus service shall follow the designated routes as mentioned in MoU and State Transport Department will decide the halting place for the buses vii. State Transport Department will take care of formalities like provisioning of tickets, debugging of bus, roadworthiness of the bus, frisking/checking of passengers , handling of luggage etc. before departure from the designated place. viii. The various agencies shall perform responsibilities assigned to them at ICP (integrated check post) of India.
