Executive Summary & Key Takeaways

**Executive Summary:** This notification from the Ministry of Road Transport and Highways concerns the levying of fees on the Jammu-Udhampur section of the erstwhile National Highway 1A (New NH44) in Jammu and Kashmir. It specifies the toll rates for different vehicle types, the locations of toll plazas, and the rules for fee collection, discounts, and revisions, effective March 1, 2014. It also addresses monthly passes, local commercial vehicle fees, overloaded vehicle penalties, and capital cost recovery. **Key Points / Main Content:** * **Fee Levy and Scope:** * Toll will be levied on the Jammu-Udhampur section of the former National Highway 1A (New NH44). * Applies to the stretch from km 15.000 on Jammu Bypass to km 67.000 of NH1A, including specific bypasses. * Covers a net road section length of 58.973 km and structures with a combined equivalent length of 56.06 km. * **Toll Rates:** * Fees are based on vehicle type, with a base rate for the year 2007-08. * Specified rates for cars/jeeps/vans, light commercial vehicles, buses/trucks, three-axle vehicles, heavy construction machinery, and oversized vehicles. * **Toll Plaza Locations:** * Toll is payable at the designated toll plaza at Km 22.600 design chainage (existing chainage Km. 20.000). * Additional fees apply for structures longer than 60m, calculated by converting their length into an equivalent highway length. * **Discounts and Passes:** * Monthly passes available for non-commercial vehicles registered to persons residing within 20 km of the toll plaza at a rate of Rs. 215.00 for 2013-14, subject to annual revision. * Discounts are applicable for multiple journeys. * Commercial vehicles registered in the district where the toll plaza falls, except those under a National permit, get a 50% discount if no service road is available. * **Overloaded Vehicles:** * Vehicles exceeding permissible load are charged ten times the fee for their category. * Such vehicles cannot use the highway until the excess load is removed. * **Definitions and Display:** * Definitions of vehicle categories, permissible loads, exempted vehicles, and roads are as per specified rules. * Fee rates must be displayed for user information. * **Fee Revision and Capital Cost Recovery:** * Actual fees and discounts are calculated by the Authority based on the project's completed length and revised annually. * The revised rates will be published in English and the local language. * After recovery of the capital cost, the fee leviable shall be reduced to 40% of the rates and shall be revised annually in accordance with the said rules. * Estimated project capital cost is Rs. 1941.45 crores, subject to change, with the final cost to be notified separately. **Impact Analysis:** * **Vehicle Owners/Users:** * *Impact:* Will incur toll charges for using the specified sections of the highway. Different rates apply based on vehicle type, usage (single vs. multiple journeys), and residential proximity to the toll plaza. * *Action Required:* Need to be aware of the applicable toll rates, discount eligibility, and payment procedures. Overloaded vehicles must reduce their load to avoid penalties. * **National Highways Authority of India (NHAI):** * *Impact:* Entrusted with the responsibility of collecting and managing toll revenue on the specified highway section. * *Action Required:* Implement toll collection mechanisms, ensure proper display of rates, manage discounts and passes, and maintain records of capital cost recovery. * **Residents Near Toll Plaza:** * *Impact:* Those owning non-commercial vehicles and residing within 20 km of the toll plaza are eligible for discounted monthly passes. * *Action Required:* Apply for monthly passes to avail of the discounted rates. * **Commercial Vehicle Operators:** * *Impact:* Subject to toll charges, with potential discounts for locally registered vehicles without access to service roads. * *Action Required:* Understand toll rates and discount eligibility.
