And whereas, the Central Government, in exercise of the powers conferred by section 9 of the National Highways Act, 1956 (48 of 1956) has framed the National Highways Fee (Determination of Rates and Collection) Rules, 2008, vide G.S.R. 838 (E) dated the 5th Dec, 2008, and amended vide G.S.R 950(E) dated 3rd December, 2010, G.S.R 15(E) dated 12th January, 2011, G.S.R 756(E) dated 12.10.2011, G.S.R 778(E) dated 16th December, 2013 and G.S.R 26(E) dated 16th January, 2014 for collection of fee for use of sections of national highways, permanent bridges, bypasses and tunnels; Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 and amended from time to time (hereinafter referred to as the “said Rules”), the Central Government hereby levies the fee at the rate specified in column (2) of the Table 1 for net road section length of 130.432 km (excluding 1288.62 m of structures having length more than 60 m) (hereinafter referred to as “base rate”) and at one and half times the base rate for bypasses having an aggregate length of 42.024 km. (excluding 455.440 m of structures having length more than 60 m) costing each Bypass Rupees Ten Crore or more on the Type of Vehicles specified in column (1) of Table 1 below, under the project of Four laning of Nagpur-Saoner-Betul section of NH-69 from km. 3.000 to km. 59.300 in the state of Maharashtra and km. 137.000 to km. 257.400* in the state of Madhya Pradesh (approx. length 174.200 km) on DBFOT(Annuity) basis and authorizes the Authority to collect, either through its officials or through a contractor, the said fee, namely:—¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5 * Authority has confirmed that the old chainage was km. 137.000 to km. 256.400 and that due to some increase in intermediate length, the new End Chainage is km. 257.400. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometers from the toll plaza is Rs. 225.00 (Rupees Two Hundred Twenty Five only) for the year 2014-15 and is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules, 2008. 5. For multiple journey on the highway section, passes shall be issued at the following rates, namely :— Amount Payable Maximum number of Period of validity one way journeys allowed One and half times of the fee for one way Two Twenty four hours from the time of payment journey Two-third of amount of the fee payable for Fifty One month from date of payment fifty single journeys 6. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles. 7. The driver or owner or a person in charge of a Mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the toll collecting agency, equal to ten times of the fee applicable to such category of mechanical vehicle and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle. 8. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the rules. 9. The fee rates shall be displayed for information of the users in accordance with rules 12 of the said rules. 10. Based on the Base Rate of Fee per km. for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of the completed length of the sections and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper, each in English and vernacular language accordingly. 11. The estimated capital cost of the project is Rupees 2777.12 crores. The capital cost is subject to variation as the activities of land acquisition, utility shifting, tree cutting etc. are yet to be completed. The final capital cost will be notified separately. The Authority shall maintain a record of the recovery of capital cost through user fee realized and after recovery of the capital cost, the fee leviable shall be reduced to 40% of the rates and shall be revised annually in accordance with the said rules.
