And whereas, in exercise of the powers conferred by section 8A of the National Highway Act 1956 (48 of 1956) read with the National Highways (Collection of Fees by any person for the Use of Section of National Highways/Permanent Bridge/Temporary Bridge on National Highways) Rules, 1997, the Central Government by notification of the Government of India in the Ministry of Road Transport and Highways) number S.O. 670 (E) dated 31st March, 2011, had authorised M/s Cochin Port Road Company Limited (as SPV of NHAI) for levying and collecting fee on mechanical vehicles for the use of four-laned stretch from km 342.000 to km 358.750 (hereinafter referred to as the “said stretch”) Edapally – Vytilla – Aroor section of National Highway Number 47 in the State of Kerala at the base rates specified in column (3) of the Table-1 below, on the category of vehicles specified in the column (2) of the said Table-1 below: Table-1 S. Truck, Bus 1.40 Multi Axle Vehicle(> 2 axles), Earth Moving Equipment or 4. 2.25 Heavy Construction Machinery And whereas, pursuant to the provision of section 14 of the National Highways Authority of India Act, 1988 (68 of 1988), M/s Cochin Port Road Company Limited (a SPV promoted by the National Highway Authority of India) has entered into an agreement on 3rd day of May, 2013 (hereinafter referred to as said agreement) with M/s Cochi Tollways Private Limited, having its registered office at 8-2-686/B/11/6/1, Plot No. 9, Road No. 12, Banjara Hills, Hyderabad, Andhra Pradesh - 500034 (hereinafter referred to as the “Concessionaire”) for the bid submitted on 11.01.2013, and a Supplementary Agreement (Tripartite Agreement) to the Concession Agreement dated 03.05.2013 was signed between National Highways Authority of India i.e. Authority, The Cochin Port Road Company Limited (CTPL) and M/s Cochi Tollways Private Limited on 28th day of November, 2013 envisaging the consent of CTPL to transfer the Concession Agreement dated 03.05.2013 to Authority along with all rights and obligations and subsequently a fresh agreement was signed directly between the Authority with M/s Cochi Tollways Private Limited on 18.03.2014 incorporating the provisions of agreement dated 03.05.2013 and supplementary agreement dated 28.11.2013, for the Operation & Maintenance of Edapally –Vytilla - Aroor section from kilometre 342.000 to kilometre 358.750 on National Highway No. 66 (formerly as NH-47) in the state of Kerala (hereinafter referred to as the “said section”) on Operation, Maintainance and Transfer (OMT) basis; And whereas, the Central Government, in exercise of the powers conferred by section 9 of the National Highways Act, 1956 (48 of 1956) and in supersession of the National Highways (Temporary Bridges) Rules, 1964, the National Highways (Collection of Fees by any person for the Use of Section of National Highways/Permanent Bridge/Temporary Bridge on National Highways) Rules, 1997. The National Highways (fee for the use of National Highway Section and Permanent Bridge-Public Funded Project) Rules, 1997 and the National Highways (Rate of Fees) Rules, 1997, has framed the National Highways Fee¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5 (Determination of Rates and Collection) Rules, 2008, vide number G.S.R. 838 (E) dated the 5th Dec, 2008, for collection of fee for use of sections of national highways, permanent bridges, bypasses and tunnels; Now, therefore, in exercise of the powers conferred by section 8A of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 and amended vide G.S.R 950(E) dated 3rd December, 2010, G.S.R 15(E) dated 12th January, 2011, G.S.R 756(E) dated 12th October, 2011 (hereinafter referred to as the “said Rules”), and in supersession of the notification of the Government of India, in the Ministry of Road Transport and Highways, No. S.O. 670 (E) dated 31st March, 2011, except as respects things done or omitted to be done before such supersession, the Central Government hereby levies fee at the base rate specified in column (2) of Table-2 for net road section length of 16.750 km (hereinafter referred to as “base rate”), for use of the four lane sections on the type of Vehicles specified in column (1) of Table-2 for the use of the “said stretch” and authorises the Concessionaire to collect and retain the fee on and from the date of commercial operation declared by the Authority or publication of this notification in the Official Gazette, whichever is later, till the termination date as specified in the agreement; Table-2 Type of vehicle Base rate of fee per km for the base year 2007-08 (in Rupees) (1) (2) Car, Jeep, Van or Light Motor Vehicle 0.65 Light Commercial Vehicle, Light Goods Vehicle or Mini Bus 1.05 Bus or Truck (Two Axles) 2.20 Three-axle commercial vehicles 2.40 Heavy Construction Machinery (HCM) or Earth Moving Equipment 3.45 (EME) or Multi Axle Vehicle (MAV) (four to six axles) Oversized Vehicles (seven or more axles) 4.20 1. The rate of monthly pass for a person who owns a mechanical vehicle registered for non- commercial purposes and resides within a distance of twenty kilometre from the toll plaza is Rs. 215.00 (Rupees Two Hundred Fifteen only) for the year 2013-14 and is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules, 2008. 3. For multiple journey on the highway section, passes shall be issued at the following rates, namely: Amount Payable Maximum number of one Period of validity way journeys allowed One and half times of the fee for one way Two Twenty four hours from the journey time of payment Two-third of amount of the fee payable for Fifty or more One month from date of fifty single journeys or more payment 4. Fee for commercial vehicle (excluding vehicles plying under national permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicle. 5. Mechanical vehicle which is loaded in excess of permissible load specified for its category under the Rules, shall be liable to pay fee at ten times of the fee applicable to such category of mechanical vehicle and shall not be permitted to use the National Highway or cross the toll plaza unless the excess load has been removed from such mechanical vehicle.6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 6. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the said Rule. 7. The fee rates shall be displayed for information of the users in accordance with rules 12 of the said Rule. 8. The increase in the actual amount of user fee to be charged from the mechanical vehicles shall in no case be more than 25% of the fee applicable in the immediately preceding year. 9. Based on the base rate of fee per km for the base year 2007-08 as mentioned in Table 2 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority. The same shall be got published by the Authority in at least one newspaper, each in English and vernacular language through the Concessionaire and thereafter revised annually in accordance with the rule 5 of the said Rules and provisions of the Concession Agreement and will be published provided, that no revision shall be effected within a period of 6 (six) months from the date of the preceding revision of fee. 10. The Capital Cost of the Project (as on 01.02.2014) to be recovered from the date of COD is Rs. 268.16 Crore (Rupees Two Hundred Sixty Eight Crore and Sixteen Lakh only). From the Commercial Operations Date (COD) toll shall be collected by the Concessionaire at the applicable rates provided under National Highways Fee (Determination of Rates and Collection) Rules, 2008 published vide G.S.R 838(E) dated 5th December, 2008 and further amended till bid due date. After the day on which the capital cost is recovered, the user fee chargeable shall be reduced to 40 % of the rate being charged. In case, due to any reason, COD is advanced/postponed up to 90 days, the Capital Cost to be recovered shall be reworked and intimated to the Concessionaire within 30 days after actual COD, by the Engineer/Independent Engineers.
