S.O. 1096 (E) dated 4th August 2005, the central Government has declared Panvel-Mahad-Panji as NH-66 (Erstwhile 17) and entrusted to the Chief Engineer, National Highways (P.W.), Government of Maharashtra (hereinafter referred to as the ”Authority”); And whereas, the Central Government, in exercise of the powers conferred by Section 9 of the National Highways Act, 1956 (48 of 1956) has framed the National Highways Fee (Determination of Rates and Collection) Rules, 2008, vide G.S.R. 838(E) dated the 5th December, 2008, for collection of fee for use of sections of National Highways, Permanent Bridges, bypasses and tunnels; Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 and amended from time to time (hereinafter referred to as the “said Rules”), the Central Government hereby levies the fee at the base rate specified in column (2) of Table 1 for net completed road section length of 21.383 km (hereinafter referred to as “base rate”) for use of the four and more lane sections on the Type of Vehicles specified in column (1) of Table 1 below, for the use of the Zarap-Patradevi section from Km 450.170–Km 475.040 (Design Chainage of Km 0/0 to Km 21/383 of Missing link) on the National Highway No.-66 (Erstwhile NH-17) in the State of Maharashtra and authorizes the Executing Authority to collect, either through its officials or through a contractor, the said fee, namely :— TABLE 1 Base rate of fee per km for the base Type of Vehicle year 2007-2008 (in rupees) (1) (2) Car, Jeep, Van or Light Motor Vehicle 0.65 Light Commercial Vehicle, Light Goods Vehicle or Mini Bus 1.05 Bus or Truck (two axles) 2.20 Three-axle commercial Vehicle 2.40 Heavy Construction Machinery (HCM) or Earth Moving Equipment (EME) or Multi 3.45 Axle Vehicle (MAV) (four to six axles) Oversized Vehicles (seven or more axles) 4.204 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 1. The fee levied and collected hereunder shall be due and payable at the following Toll Plaza for net road length specified for such Toll Plaza : Location of Toll Plaza (chainage) Length (in km) for which Fee is payable At Km. 464/570 (Ch.14.400) (near Insuli village of Taluka Sawantwadi, in Sindhudurga 21.383 District in the state of Maharashtra) 2. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometers from the toll plaza is Rs. 215.00 (Rupees Two Hundred Fifteen only) for the year 2013-14 and is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules, 2008. 3. For multiple journey on the highway section, passes shall be issued at the following rates, namely : Maximum number of one way Amount payable Period of validity journeys allowed One and half times of the fee for one way journey Two Twenty four hours from the time of payment Two-third of amount of the fee payable for fifty Fifty One month from date of payment single journeys 4. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles. 5. Mechanical vehicle which is loaded in excess of permissible load specified for its category under the Rules, shall be liable to pay fee equal to Ten times of the fee applicable to such category of mechanical vehicles and shall not be entitled to make the use of the highway unless the excess load has been removed from such mechanical vehicle. 6. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the rules. 7. The fee rates shall be displayed for information of users in accordance with rules 12 of the said Rules. 8. Based on the Base rate of fee per km for the base year 2007-08 as mentioned in Table-1, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority and published and will further be revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper, each in English and vernacular language accordingly. 9. The estimated capital cost of the project is Rupees 264.05 crores. The Authority shall maintain a record of the recovery of capital cost through user fee realized and after recovery of the capital cost.
