Rules, 2008, the Central Government by following notifications of the Government of India authorized
Authority for levying and collecting fee on mechanical vehicles for use of following four-laned sections:

And whereas, pursuant to the provision of Section 14 of the National Highways Authority of India
Act, 1988 (68 of 1988), the Authority has entered into an agreement (hereinafter referred to as said
agreement) on 28.10.2014 with M/s Agra-Gwalior Pathways Private Limited having its registered office at
76, Mall Road, Mhow-453441, Madhya Pradesh, India (hereinafter referred to as the “Concessionaire”), for
the bids received on 11.04.2014, for the Operation and Maintenance of Agra-Gwalior section from km 8.000
to km 103.000 of NH-3 & Operation of toll plaza at km 32.607 for Gwalior Bypass section from km 0.000
(existing km 103.000 of NH-3) to km 42.033 (existing km 16 of NH-75) in the States of Uttar Pradesh,
Rajasthan & Madhya Pradesh (hereinafter referred to as the “said section”) on Operation, Maintenance &
Transfer (OMT) basis;¹Hkkx IIµ[k.M 3 (ii)º Hkkjr dk jkti=k % vlk/kj.k 7
Now, therefore, in exercise of the powers conferred by section 8A of the National Highways Act,
1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection)
Rules, 2008 published vide G.S.R 838(E) dated 5th December, 2008 and amended vide G.S.R 950(E) dated
3rd December, 2010, G.S.R 15(E) dated 12th January, 2011, G.S.R 1756(E) dated 12th October, 2011, G.S.R
778(E) dated 16th December, 2013 and G.S.R. 26(E) dated 16.01.2014 (hereinafter referred to as the “said
Rules”) and in supersession of the notification number S.O. 2842(E) dated 06.12.2012, S.O. No. 2843(E)
dated 06.12.2012 & S.O. No. 544(E) dated 06.03.2013 except as respect things done or omitted to be done
before such supersession, the Central Government, having regard to the expenditure involved in maintenance,
management and operation of the said section, interest on the capital invested, reasonable return, the volume
of traffic and the period of the agreement entered into between the authority and the concessionaire, hereby
notifies that there shall be levied and collected fees on mechanical vehicles for the use of four-laned said
section and authorizes the said Concessionaire to collect and retain the fee for the use of the said section on
and from the date of commercial operation declared by the Authority or publication of this notification in the
Official Gazette, whichever is later, till the termination date as specified in the said agreement;

3. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial
purposes and resides within a distance of twenty kilometers from the toll plaza is Rs. 225.00 (Rupees Two
Hundred and twenty five only) for the year 2014-15, which is subject to revision every year as per the
provisions of the National Highways Fee (Determination of Rates and Collection) Rules, 2008.
4. For multiple journeys on the highway section, passes shall be issued at the following rates, namely:

5. Fee for commercial vehicle (excluding vehicles plying under national permit) registered in the district
where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service
road or alternative road is available for use of such commercial vehicles.
6. A mechanical vehicle which is loaded in excess of permissible load specified for its category under
sub-rule (2) of rule 4, shall not be permitted to use the National Highway or crossing the toll plaza until the
excess load has been removed from such mechanical vehicle. The driver or owner or a person in charge of a
mechanical vehicle shall be liable to pay fee, for entering the overloaded vehicle on the National Highway to
the toll collecting agency, equal to ten times of the fee applicable to such category of mechanical vehicle
under sub-rule (2) of Rule 4.
7. All definitions, category of mechanical vehicles, its permissible load, category of exempted vehicles,
service road, alternative road etc. shall be as per definitions specified in the Rules.
8. The fee rates shall be displayed for information of the users in accordance with Rule 12 of the said
Rules.
9. Based on the base rate of fee per km. for the base year 2007-08 as mentioned in Table-1 & 2 above,
the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by
the Authority. The same shall be got published by the Authority in at least one newspaper, each in English
and vernacular language through the Concessionaire and thereafter revised annually in accordance with the10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
rule 5 of the said Rules and provisions of the Concession Agreement and will be published; provided,
however, that such revision shall not be effected until a period of 6 (six) months from the date of preceding
revision of fee.
10. The Capital Cost of the Project yet to be recovered from date of COD is Rs. 1019.86 Crore (Rupees
One Thousand Nineteen Crores & Eighty Six Lakh only). From the Commercial Operations Date (COD) toll
shall be collected by the Concessionaire at the applicable rates provided under National Highways Fee
(Determination of Rates and Collection) Rules, 2008 published vide G.S.R 838(E) dated 5th December, 2008
and further amended till bid due date. After the day on which the capital cost is recovered, the user fee
chargeable shall be reduced to 40 % of the rate being charged. In case, due to any reason, COD is
advanced/postponed up to 90 days, the Capital Cost to be recovered shall be reworked and intimated to the
Concessionaire within 30 days after actual COD, by the Engineer/Independent Engineers.
