S.O. 346(E).—Whereas by notification of the Government of India in the Ministry of Road Transport and
Highways number S.O. 239(E), dated the 24th March, 1998 and S.O. 78(E), dated the 4th February, 1999, issued under
Section 11 of the National Highways Authority of India Act, 1988 (68 of 1988), the Central Government has entrusted
the stretch from kilometer 164.750 to kilometer 180.820 ( Nellore Bypass section] and 52.800 to kilometer 164.750
(Tamil Nadu/Andhra Pradesh Border to Vijayawada section) of National Highway No. 5 in the State of Andhra Pradesh
respectively to the National Highways Authority of India (hereinafter referred to as the “Authority”);
And whereas, the Central Government, in exercise of the powers conferred by section 7 of the National
Highways Act, 1956 (48 of 1956) read with Rule 3 of the National Highways Fee (Determination of Rates and
Collection) Rules, 2008, the Central Government by notification No. S.O. 2661(E), dated 02.09.2013 exempted the
stretch of Nellore Bypass (length 17.166 km) section from km 178.200 to km 161.034 (New chainage km 1366.547 to
km 1383.713) on the National Highway No. 5 in the State of Andhra Pradesh from tolling;
Now, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read
with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 vide G.S.R. 838(E),
dated 5th December, 2008 and amended vide G.S.R. 950(E), dated 3rd December, 2010, G.S.R. 15(E), dated 12th
January, 2011, G.S.R. 1756(E), dated 12th October, 2011, G.S.R. 778(E), dated 16th December, 2013, G.S.R. 26(E),
dated 16.01.2014 and G.S.R. 831(E), dated 21st November, 2014 (hereinafter referred to as the “said Rules”) and in
supersession of the notification number S.O. No. 2661(E), dated 02.09.2013 except as respect things done or omitted to
be done before such supersession, the Central Government, hereby, notifies that there shall be levied and collected fees
on mechanical vehicles for the use of Nellore Bypass section from km 178.200 to km 161.034 (New chainage km
1366.547 to km 1383.713) on the National Highway No. 5 in the State of Andhra Pradesh, on the Type of Vehicles
specified in column (1) at the rate specified in columns (2) of Table 1 below (hereinafter referred to as “base rate”) for
net road length of 16.320 km and equivalent road length of 8.460 km [for 0.846 km of structure (having more than 60
m length)] and authorizes the Authority to collect, either through its officials or through a contractor, the said fee,

3. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes
and resides within a distance of twenty kilometres from the toll plaza is Rs. 225.00 (Rupees Two Hundred Twenty Five
only) for the year 2014-15 and is subject to revision every year as per the provisions of the National Highways Fee
(Determination of Rates and Collection) Rules, 2008.
4. For multiple journey on the highway section, passes shall be issued at the following rates, namely:

6. Mechanical vehicle which is loaded in excess of permissible load specified for its category under the Rules,
shall not be permitted to use the National Highways for crossing the toll plaza unless the excess load has been removed
from such mechanical vehicle. The driver or owner or a person in-charge of such overloaded mechanical vehicle shall be
liable to pay fee, for entering the overloaded vehicle on the National Highway to the toll collecting agency, equal to ten
times of the fee applicable to such category of mechanical vehicle under the Rules.
7. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles,
service road, alternative road etc. shall be as per definitions specified in the rules.
8. The fee rates shall be displayed for information of the users in accordance with rules 12 of the said rules.
9. Based on the Base rate of fee per km for the base year 2007-08 as mentioned in Table-1 above, the actual
amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the
basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the
same shall be published in at least one newspaper, each in English and vernacular language accordingly.
10. The Capital cost of the project is Rupees 88.235 Crore. The Authority shall maintain a record of the recovery of
capital cost through user fee realized and after recovery of the capital cost, the fee leviable shall be reduced to 40% of
the rates and shall be revised annually in accordance with the said rules.
