And whereas, in exercise of powers conferred by section 7 of National Highways Act, 1956 (48 of 1956) read with Rule (3) of National Highway Fee (Determination of Rules and Collection) Rules, 2008, the Central Government by notification of Government of India authorized Authority for levying and collecting fee on mechanical vehicles for the use of following four-laned stretches:¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5 Stretch Section S.O. No. Dated Km 0.000 to km 32.270 Gorakhpur Bypass in the state of S.O. 2624 (E) 30.10.2012 (existing chainage km 252.860 Uttar Pradesh to km 279.800) of NH-28 Km 279.800 to km 320.800 of Gorakhpur-Kasya in the state of S.O. 39 (E) 03.01.2013 NH-28 Uttar Pradesh Km 320.800 to km 366.800 of Kasya-Uttar Pradesh/ Bihar Border in S.O. 1154 (E) 22.05.2012 NH-28 the state of Uttar Pradesh And whereas, pursuant to the provisions of section 14 of the National Highways Authority of India Act, 1988 (68 of 1988), the Authority has entered into an agreement (hereinafter referred to as the “said agreement”) on 22.05.2015 with M/s Gorakhpur Kasia Tollways Private Limited, having its registered office at 306-7, Chandni Apartment, 2/2 New Palasia, Indore-450 001, MP (hereinafter referred to as the “Concessionaire”), for the bid received on 16.02.2015, for the Operation and Maintenance of the Gorakhpur Bypass–Kasia–UP/Bihar Border section from Km 279.800 to Km 360.915 (New km 285.002 to km 366.117) of NH-28 on Operate, Maintain and Transfer (OMT) basis and toll revenue collection of Toll Plaza at km 255.200 (New Km 256.500) for BOT Annuity section from km 251.700 to km 279.800 (New Chainage 252.860 to km 285.215) of NH-28 in the state of Uttar Pradesh (hereinafter referred to as the “said section”); Now, therefore, in exercise of the powers conferred by section 8A of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 published vide G.S.R 838(E) dated 5th December, 2008 and amended vide G.S.R 950(E) dated 3rd December, 2010, G.S.R 15(E) dated 12th January, 2011, G.S.R 756(E) dated 12th October, 2011, G.S.R 778(E) dated 16th December, 2013, G.S.R. 26(E) dated 16th January, 2014 and G.S.R. 831(E) dated 21st November, 2014 (hereinafter referred to as the “said Rules”) and in supersession of the notification number S.O. No. 2624(E) dated 30.10.2012, S.O. No. 39(E) dated 03.01.2013 & S.O. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometers from the toll plaza is Rs. 230.00 (Rupees Two Hundred and Thirty only) for the year 2015-16, which is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules, 2008. 5. For multiple journeys on the highway section, passes shall be issued at the following rates, namely: Amount Payable Maximum number of one way Period of validity journeys allowed One and half times of the fee for one way Two Twenty four hours from the time journey of payment Two-third of amount of the fee payable for 50 (Fifty) or more One month from date of payment fifty or more single journeys 6. Fee for commercial vehicle (excluding vehicles plying under national permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles. 7. A mechanical vehicle which is loaded in excess of permissible load specified for its category under sub-rule (2) of rule 4, shall not be permitted to use the National Highway or crossing the toll plaza until the excess load has been removed from such mechanical vehicle. The driver or owner or a person in charge of a mechanical vehicle shall be liable to pay fee, for entering the overloaded vehicle on the National Highway to the toll collecting agency, equal to ten times of the fee applicable to such category of mechanical vehicle under sub-rule (2) of Rule 4. 8. All definitions, category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the Rules. 9. The fee rates shall be displayed for information of the users in accordance with Rule 12 of the said Rules. 10. Based on the base rate of fee per km for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority. The same shall be got published by the Authority in at least one newspaper, each in English and vernacular language through the Concessionaire and thereafter revised annually in accordance with the rule 5 of the said Rules and provisions of the Concession Agreement and will be published; provided, however, that such revision shall not be effected until a period of 6 (six) months from the date of preceding revision of fee. 11. The Capital Cost of the project (as on 30.06.2015) to be recovered from the (probable) date of COD (01.07.2015) is Rs. 1439.97 Crore (Rupees One Thousand Four Hundred Thirty Nine Crore and Ninety Seven lakh). From the Commercial Operation Date (COD) toll shall be collected by the Concessionaire at the applicable rates provided under the National Highways Fee (Determination of Rates and Collection) Rules, 2008 published vide G.S.R. 838(E) dated 5th December, 2008 and further amendments till bid due date. After the day on which the Capital Cost is recovered, the user fee chargeable shall be reduced to 40% of the rates being charged. In case, due to any reason, COD is advanced/ postponed upto 90 days, the Capital cost to be recovered shall be reworked and intimated to the Concessionaire within 30 days after actual COD, by the Engineer/ Independent Engineers.
