And whereas, the Central Government, in exercise of the powers conferred by section 9 of the National Highways Act, 1956 (48 of 1956) has framed the National Highways Fee (Determination of Rates and Collection) Rules, 2008, vide G.S.R. 838 (E) dated the 5th Dec, 2008, and amended vide G.S.R 950(E) dated 3rd December, 2010,G.S.R 15(E) dated 12th January, 2011, G.S.R 756(E) dated 12th October,2011 and G.S.R 778 (E) dated 16th December,2013 and G.S.R 26(E) dated 16th January,2014 for collection of fee for use of sections of national highways, permanent bridges, bypasses and tunnels;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 and amended from time to time (hereinafter referred to as the “said Rules”), the Central Government hereby levies the fee at the base rate specified in columns (2) of the Table 1 for net road section length of 36.287 km. {including 36.182 km. road and 105 m. of structure (having length more than 60 m.) with equivalent length of 1.05 km. } (hereinafter referred to as “base rate”) for use of the four and more lane sections and at one and one half times the base rate for bypass length of 7.600 km. costing Rupees Ten crore or more on the Type of Vehicles specified in column (1) of Table 1 below, under the project of Four Laning of Reengus to Sikar section from km. 298.075 Near Madhopura Junction to km. 341.047 (after Sikar Town) of NH-11 (Proposed Chainage from kilometre 298.075 to kilometre 341.962) on BOT(Annuity) basis on DBFOT basis in the State of Rajasthan and authorizes the Authority to collect, either through its officials or through a contractor, the said fee, namely:- Table 1 Type of vehicle Base rate of fee per km. for the base year 2007-08 (in Rupees) (1) (2) Car, Jeep, Van or Light Motor Vehicle 0.65 Light Commercial Vehicle, Light Goods Vehicle or Mini Bus 1.05 Bus or Truck (Two Axles) 2.20 Three-axle commercial vehicles 2.40 Heavy Construction Machinery (HCM) or Earth Moving Equipment (EME) or 3.45 Multi Axle Vehicle (MAV) (four to six axles) Oversized Vehicles (seven or more axles) 4.20 1. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometres from the toll plaza is Rs. 225.00 (Rupees Two Hundred Twenty Five only) for the year 2014-15 and is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules, 2008. 5. For multiple journey on the highway section, passes shall be issued at the following rates, namely: Amount Payable Maximum number of Period of validity one way journeys allowed One and half times of the fee for one way Two Twenty four hours from the time of journey payment Two-third of amount of the fee payable for Fifty One month from date of payment fifty single journeys 6. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles. 7. Mechanical vehicle which is loaded in excess of permissible load specified for its category under the Rules, shall not be permitted to use the National Highway for crossing the Toll Plaza until the excess load has been removed from such mechanical vehicle. The driver or owner or a person in charge of such overloaded mechanical vehicle shall be liable to pay fee, for entering the overloaded vehicle on the National Highway to the Toll Collecting agency, equal to 10 times of the fee applicable to such category of mechanical vehicles under the rules. 8. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the rules. 9. The fee rates shall be displayed for information of the users in accordance with rules 12 of the said rules. 10. Based on the Base rate of fee per km. for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper, each in English and vernacular language accordingly. 11. The estimated capital cost of the project is Rupees 366.50 crores. The capital cost is subject to variation as the activities of land acquisition, utility shifting, tree cutting etc. are yet to be completed. The final capital cost will be notified separately. The Authority shall maintain a record of the recovery of capital cost through user fee realized and after recovery of the capital cost, the fee leviable shall be reduced to 40% of the rates and shall be revised annually in accordance with the said rules.
