अिधसूचना सं. का.आ. 339(अ), तारीख 10 मई, 2007 और उन बात& के िसवाय अिध,ांत करते ’ए िज(cid:11)ह (cid:29) ऐसे अिध,मण
से पहल े (cid:4)कया गया ह ै या (cid:4)कए जाने से लोप (cid:4)कया गया ह,ै (cid:13)व ापक औषिध और मन:(cid:16)भावी पदाथ4, िनयंि5त पदाथ4 अथवा
वाहन क प6रसंकटमय (cid:16)कृित, उनक चोरी के िलए भे8ता, (cid:16)ित(cid:13)थ ापन और समुिचत भंडारण (cid:13)थ ान के (cid:16)ितबंध को ;य ान म (cid:29)
रखते ’ए, (cid:13) वापक औषिधय& और मन:(cid:16)भावी पदाथ4, िनयंि5त पदाथ4 अथवा वाहन को, िजनका उनके अिभ>हण (cid:4)कए जाने
के यथाशी? प(cid:30) चात ् उनका A ययन (cid:4)कया जा सकता ह,ै वे अिधकारी जो उनका इस (cid:16)कार Aय यन कर सकत े ह B और वह नीित
िजसम(cid:29) उनका A ययन (cid:4)कया जा सकता ह,ै िविनCदDट करती ह।ै

A ययन उपयु(cid:20)%त अिधिनयम क धारा 52क के अ(cid:11)त गत(cid:20) (cid:4)कया जाएगा।
3. अअअअििििधधधधककककााााररररीीीी जजजजोोोो (cid:19)(cid:19)(cid:19)(cid:19)यय यय ययययनननन कककक(cid:24)(cid:24)(cid:24)(cid:24) ककककाााारररर(cid:25)(cid:25)(cid:25)(cid:25)ववववााााईईईई शशशश(cid:29)(cid:29)(cid:29)(cid:29)ुुुु ककककरररर(cid:16)(cid:16)(cid:16)(cid:16)गगगग————ेेेे (cid:4)कसी थाने का (cid:16)भारी कोई अिधकारी या अिधिनयम क धारा 53 के
अधीन अिधकार (cid:16)ाF त कोई अिधकारी, उ% त अिधिनयम क धारा 52क के अधीन (cid:13)व ापक औषिधय&, मन:(cid:16)भावी पदाथ4,
िनयंि5त पदाथ4 अथवा वाहन& का A ययन कर सकता ह।ै
4. (cid:19)(cid:19)(cid:19)(cid:19)यय यय ययययनननन कककक(cid:24)(cid:24)(cid:24)(cid:24) ररररीीीीिििितततत———— (1) जहा ं (cid:4)कसी (cid:13) वापक औषिध और मन:(cid:16)भावी पदाथ,(cid:20) िनयंि5त पदाथ4 अथवा वाहन को जGत (cid:4)कया
गया ह ै और िनकटतम थाने के (cid:16)भारी अिधकारी को या अिधिनयम क धारा 53 के अधीन अिधकार (cid:16)ाFत अिधकारी को भजे ा
गया ह ै या इसे (cid:4)कसी ऐसे अिधकारी ने (cid:13) वयं जG त (cid:4)कया ह ै तो वह इस अिधसूचना के उपबंध-1 के अनुसार ऐसे (cid:13)व ापक औषिध
और मन:(cid:16)भावी पदाथ4 िनयंि5त पदाथ4 अथवा वाहन& क सूची तैयार करेगा और इस अिधसूचना के
उपबंध-2 के अनुसार उ%त अिधिनयम क धारा 52क क उप-धारा (2) के अधीन जGत क गई (cid:13)व ापक औषिध, मन:(cid:16)भावी

(2) धारा 52क क उप-धारा (3) के अधीन मिज(cid:13)I ेट Jारा आवेदन को अनLु ात करने के प(cid:30)च ात ऊपर खडं (i) म (cid:29) वMणत
अिधकारी स" यािपत सूची, मिज(cid:13) Iेट क उपि(cid:13) थित म(cid:29) िलए गए फोटो>ाफ और नमनू & को मामले के (cid:16)ाथिमक साOय के िलए
संभाल कर रखगे ा तथा औषिध (cid:16)ेषण& के G यौरे, औषिध Aय यन सिमित के अ;य Q को Aय यन के संबंध म(cid:29) सिमित Jारा
िविन(cid:30) चय के िलए (cid:16)(cid:13) ततु करेगा और उ% त अिधकारी, गोदाम के (cid:16)भारी अिधकारी को जGत क गई औषिध सिहत Gय ौर& क
एक (cid:16)ित भेजगे ा।
5. औऔऔऔषषषषििििधधधध (cid:19)(cid:19)(cid:19)(cid:19)यय यय ययययनननन ससससििििममममिििितततत————के(cid:11) (cid:12)ीय और राR य औषिध िविध (cid:16)वत(cid:20)न अिधकरण के (cid:16)"य ेक िवभाग का िवभागा;य Q एक या
अिधक औषिध A ययन सिमितय& का गठन करेगा िजसम(cid:29) (cid:16)"य ेक म(cid:29) तीन सद(cid:13)य ह&गे। ऐसी (cid:16)"य ेक सिमित का अ;य Q, पुिलस
अधीQक के रBक के अिधकारी, के(cid:11) (cid:12)ीय सीमाशु(cid:6) क और उ"प ाद शु(cid:6)क के संयु%त आयु%त , राज(cid:13)व आसूचना िनदेशालय के संयु%त
िनदेशक या समतु(cid:6) य रBक कम रBक का नहT होगा अथवा इनके समतु(cid:6)य रBक का होगा और (cid:16)"य ेक ऐसी सिमित (cid:16)"य Q Uप स े
िवभागा; यQ के (cid:16)ित उ" तरदायी होगी।
6. ककककृृृृ(cid:3)(cid:3)(cid:3)(cid:3)यय यय ————औषिध A ययन सिमित के कृ" य िनWन िलिखत ह&ग:े—
(क) जहां तक यथासंभव और आव(cid:30)य क ह&, बैठक(cid:29) करना;
(ख) जG त मद& के लिW बत िनपटान का िव(cid:13)त ृत पनु Mवलोकन करना;
(ग) जG त मद& के A ययन का आदेश देना; और
(घ) शी? A ययन के िलए (cid:4)कए जाने वाले उपाय& के संबंध म (cid:29) संबंिधत अ(cid:11)व ेषण अिधका6रय&/पय(cid:20)वेQण
अिधका6रय& को सलाह दने ा।

और संबX A ययन सिमित के अ; यQ को उसे (cid:16)(cid:13) ततु करेगा।
(2) उप-पैरा (1) म (cid:29) संदMभत सचू ी क जांच-पड़ताल करन े के प(cid:30)च ात और इस बात से संतुDट होत े ’ए (cid:4)क उस अिधिनयम क
धारा 52क क अपेQाए ं पूरी कर ली गई हa,ै संबंिधत औषिध Aय यन सिमित के सद(cid:13)य इस आशय का आव(cid:30)य क (cid:16)माण-प5
पृD ठां(cid:4)कत कर(cid:29)ग े और सिमित तत प् (cid:30) चात जG त (cid:4)कए जान े क 6रपोट,(cid:20) रासायिनक िव(cid:30)ल ेषण क 6रपोट (cid:20) और अ(cid:11)य द(cid:13)त ावेज& के
संदभ(cid:20) म(cid:29) जGत क गई (cid:16)" येक मद का भार और अ(cid:11)य वा(cid:13)त िवक परीQा और स"य ापन करेगी और (cid:16)"य ेक मामल े म(cid:29) अपने

अपनी िसफा6रशेa िवभागा; यQ को भेजेगी जो इस (cid:16)योजन के िलए िवशेष Uप से ग6ठत (cid:4)कसी उ\च (cid:13)त रीय औषिध Aय यन
सिमित Jारा उनके A ययन के िलए आदेश कर सकेगा।
9. औऔऔऔषषषषििििधधधधयययय&&&& ककककेेेे (cid:19)(cid:19)(cid:19)(cid:19)यय यय ययययनननन कककक(cid:24)(cid:24)(cid:24)(cid:24) ररररीीीीिििितततत————(1) अफ म, माCफन, कोडीन और िथबनीन का Aय यन, कारखाना िनयं5क के अधीन
काय(cid:20)रत सरकारी अफ म और अ(cid:6) कलाइड संकम(cid:20) को अंत6रत करके (cid:4)कया जाएगा।
(2) उप-पैरा (1) म(cid:29) वMणत औषिधय& से िभ(cid:11)न औषिधय& क दशा म,(cid:29) म]ु य कारखाना िनयं5क को Aय यन के िलए, तैयार
जG त मद& के G यौरे उपलG ध " व6रत संसूचना साधन& Jारा सूिचत (cid:4)कए जाएंगे।
(3) मु] य कारखाना िनयं5क उप-पैरा (2) म (cid:29) संदMभत अनुसार, संसूचना (cid:16)ािFत क तारीख से प(cid:11)(cid:12) ह (cid:4)दन के भीतर
(cid:13) वापक औषिधय& और मन:(cid:16)भावी पदाथ4 क मा5ा, य(cid:4)द कोई हो, जो उसके Jारा (cid:13)व ापक औषिध और मन:(cid:16)भावी
पदाथ(cid:20) िनयमावली, 1985 के िनयम 67ख के अधीन नमनू े के Uप म (cid:29) (cid:16)दाय के िलए अपेिQत हो, उपदMशत करेगा।
(4) (cid:13) वापक औषिधय& और मन:(cid:16)भावी पदाथ4 क ऐसी मा5ा य(cid:4)द कोई हो, जो उप-पैरा (3) के अधीन मु]य आरखाना
िनयं5क Jारा अपेिQत हो, उस े अतं 6रत क जाएगी और (cid:13)व ापक औषिधय& और मन: (cid:16)भावी पदाथ4 क शषे मा5ा का
A ययन, उप परै ा (5), (6) और (7) के (cid:16)ावधान& के अनुसार (cid:4)कया जाएगा।
(5) (cid:13) वापक औषिधयां, मन:(cid:16)भावी पदाथ (cid:20) और िनयंि5त पदाथ(cid:20) और वाहन िजनका काननू ी, िच(cid:4)कि"स क अथवा
औ8ोिगक (cid:16)योग ह,ै का A ययन िनW निलिखत तरीके से (cid:4)कया जाएगा:-
(क) (cid:13) वापक औषिधयां, मन:(cid:16)भावी पदाथ(cid:20) और िनयंि5त पदाथ(cid:20) जो (cid:4)क सू5ण (फाWय लू(cid:20) शे न) के Uप म(cid:29) ह ै तथा िजन
पर औषिध और (cid:16)साधन अिधिनयम, 1940 (1940 का 23) के (cid:16)ावधान& और इसके अ(cid:11)त गत(cid:20) बनाए गए िनयम& के
अनुसार लेबल लगाया गया ह,ै उनक िब, , लेबल म(cid:29) उि(cid:6)ल िखत लाइस(cid:29)स (cid:16)ाFत िनमा(cid:20)ता से संघटन (काWप िजशन)
और सू5ण (फाW यलू(cid:20) ेशन) क पिु D ट (cid:4)कए जाने के प(cid:30)च ात औषिध Aय यन सिमित Jारा यथा िनधा(cid:20)6रत संिवदा अथवा
बोली अथवा (cid:4)कसी अ(cid:11) य तरीके से, ऐसे Aय ि%त को क जाए जो औषिध और (cid:16)साधन अिधिनयम, 1940 (1940 का
23) और (cid:13) वापक औषिध और मन:(cid:16)भावी पदाथ (cid:20) अिधिनयम, 1985 (1985 का 61) और इसके अ(cid:11)त गत(cid:20) बनाए
िनयम& और आदेश& क अपेQाएं पूरी करता हो, बशत_ (cid:4)क ऐसी िब, के समय जGत (cid:4)कए गए सू5ण (फाWय लू(cid:20) ेशन) के
उपयोग क (cid:11) यनू तम 60 (cid:16)ितशत अविध शेष हो।
(ख) िबना समुिचत लेबल क (cid:13) वापक औषिध, मन:(cid:16)भावी पदाथ(cid:20) तथा फाWय ू(cid:20)लशे न के Uप म(cid:29) जGत (cid:4)कए गए
िनयंि5त पदाथ4 को नD ट कर (cid:4)दया जाएगा।
(ग) थोक के जG त (cid:4)कए गए (cid:13) वापक औषिध मन:(cid:16)भावी पदाथ(cid:20) तथा िनयंि5त पदाथ4 को जो औषिध तथा
(cid:16)साधन अिधिनयम, 1940 (1940 का 23) तथा (cid:13)व ापक औषिध तथा मन (cid:16)भावी पदाथ(cid:20) अिधिनयम, 1985
(1985 का 61) तथा उनके अ(cid:11)त ग(cid:20)त बनाए गए िनयम& तथा आदेश& के अ(cid:11)त ग(cid:20)त औषिध तथा (cid:16)साधन अिधिनयम,
1940 (1940 का 23) के अ(cid:11) तग(cid:20)त तथा उसके अ(cid:11)त ग(cid:20)त बनाए गए िनयम& के अ(cid:11)त ग(cid:20)त आन े वाली अपेQाZ को परू ा
करने पर उपयु% त (cid:16)ािधकारी Jारा जGत पदाथ4 के िच(cid:4)क"स ीय उ‘े(cid:30)य हते ु उनके मानक Uप क संपुिDट के प(cid:30)च ात
(cid:4)कसी ऐसे A यि% त को संिवदा अथवा नीलामी अथवा (cid:4)कसी ऐसे िविध से बेचे जा सकते ह B िज(cid:11)ह (cid:29) औषिध िनपटान
सिमित Jारा िनधा(cid:20)6रत (cid:4)कया गया हो;
(घ) ऐसे िनयंि5त पदाथ (cid:20) िजनका िविध संवत औ8ोिगक उपयोग ह,ै को औषिध िनपटान सिमित Jारा िनधा(cid:20)6रत (cid:4)कए
अनुसार (cid:4)कसी ऐसे A यि% त को जो (cid:13) वापक औषिध तथा मन:(cid:16)भावी पदाथ (cid:20) अिधिनयम, 1985 (1985 का 61) तथा
उसके अ(cid:11) तग(cid:20)त बनाए गए िनयम& तथा आदेश& क अपQे ाZ को पूरा करता हो संिवदा अथवा नीलामी अथवा अ(cid:11)य
(cid:4)कसी िविध के Jारा बेचे जा सकते ह;B
(ड.) जG त (cid:4)कए गए वाहन& को औषिध िनपटान सिमित Jारा िनधा(cid:20)6रत (cid:4)किए अनुसार संिवदा अथवा नीलामी के
मा; यम से बेचा जा सकता ह।ै
(6) ऐसी (cid:13) वापक औषिधय& मन:(cid:16)भावी पदाथ4 तथा िनयंि5त पदाथ4 िजनका कोई िविध संवत िच(cid:4)क"स ीय अथवा
औ8ोिगक उपयोग नहT हो अथवा जG त मद& क ऐसी मा5ा जो उपयु्र%त (cid:16)योग हते ु समुिचत नहT हो अथवा िजस े बेचा

(7) उप-पैरा (ख) म (cid:29) संदMभत नD टकरण भ(cid:13) मीकरण के मा;य म से ऐसे भ(cid:13)म ीकरण उपकरण के Jारा (cid:4)कया जाए केवल उन
(cid:13) थान& िजनम(cid:29) उपयु(cid:20)% त वायु (cid:16)दषू ण िनयं5क उपकरण लग े ह& और जहां पया(cid:20)Fत सुिवधा तथा सुरQा िव8मान हो और राRय
(cid:16)दषू ण िनयं5ण बोड (cid:20) Jारा अनमु ो(cid:4)दत हो। यह सुिनि(cid:30)च त करने के िलए ऐसा भ(cid:13)म ीकरण (cid:13)व ा(cid:13)a य प6रसंकटमी या (cid:16)दषू क न
हो, यथाि(cid:13) थित राR य (cid:16)दषू ण िनयं5ण बोड(cid:20) या (cid:16)दषू ण िनयं5ण सिमित क सहमित अिभ(cid:16)ापत क जानी चािहए। औषिध
A ययन सिमित के सद(cid:13) य& क उपि(cid:13) थित म (cid:29) नD टकरण (cid:4)कया जाएगा।

11. नननन0000टट टट ककककररररणणणण ककककाााा ,,,,ममममााााणणणणपपपप(cid:8)(cid:8)(cid:8)(cid:8)————सभी संसंगत आंकड़(cid:29) जसै े गोदाम, (cid:16)िविDट सं]य ाकं , अिभ>हण क गई औषिधय& क सकल
और शुX भार आ(cid:4)द अ(cid:11)त MवD ट करते ’ए नD टकरण का एक (cid:16)माणप5 (तीन (cid:16)ितय& म)(cid:29) तैयार (cid:4)कया जाएगा और उपबंध 3
पर Uपिवधान के अनुसार औषिध A ययन सिमित के अ;य Q और सद(cid:13)य & Jारा ह(cid:13)त ाQ6रत (cid:4)कया जाएगा। मलू (cid:16)ित इस
आशय क आव(cid:30) यक (cid:16)िविD टयां करने के प(cid:30) चात् गोदाम रिज(cid:13)ट र म(cid:29) िचपकाई जाएगी, दसू री (cid:16)ित अिभ>हण मामला फाइल म (cid:29)
रखी जाएगी और तीसरी (cid:16)ित औषिध A ययन सिमित Jारा रखी जाएगी।

NOTIFICATION
New Delhi, the 16th January, 2015
G.S.R. 38(E).—In exercise of the powers conferred by section 52A of the Narcotic Drugs and
Psychotropic Substances Act, 1985, (61 of 1985), hereinafter referred to as the said Act, and in supersession
of notification number G.S.R. 339(E), dated 10th May, 2007, except as respects things done or omitted to be
done before such supersession, the Central Government, having regard to the hazardous nature, vulnerability
to theft, substitution, and constraints of proper storage space, in respect of any narcotic drugs, psychotropic
substances, controlled substances or conveyances, hereby specifies the narcotic drugs, psychotropic
substances, controlled substances and conveyances which shall, as soon as may be after their seizure, be
disposed of, the officers who shall dispose them of and the manner of their disposal.
2. Items to be disposed of.–All narcotic drugs, psychotropic substances, controlled substances and
conveyances shall be disposed of under section 52A of the said Act.
3. Officers who shall initiate action for disposal.ÑAny officer in-charge of a police station or any officer
empowered under section 53 of the said Act shall initiate action for disposal of narcotic drugs, psychotropic
substances, controlled substances or conveyances under section 52A of that Act.¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 7
4. Manner of disposal.Ñ(1) Where any narcotic drug, psychotropic substance, controlled substance or
conveyance has been seized and forwarded to the officer-in-charge of the nearest police station or to the
officer empowered under section 53 of the said Act or if it is seized by such an officer himself, he shall
prepare an inventory of such narcotic drugs, psychotropic substances, controlled substances or conveyances
as per Annexure 1 to this notification and apply to any Magistrate under sub-section (2) of section 52A of the
said Act as per Annexure 2 to this notification within thirty days from the date of receipt of chemical analysis
report of seized narcotic drugs, psychotropic substances or controlled substances.
(2) After the Magistrate allows the application under sub-section (3) of section 52A of the said Act, the
officer mentioned in sub-paragraph (1) shall preserve the certified inventory, photographs and samples
drawn in the presence of the Magistrate as primary evidence for the case and submit details of the seized
items to the Chairman of the Drug Disposal Committee for a decision by the Committee on the disposal,
and the aforesaid officer shall send a copy of the details along with the items seized to the officer-in-charge
of the godown.
5. Drug Disposal Committee.ÑThe Head of the Department of each Central and State drug law enforcement
agency shall constitute one or more Drug Disposal Committees comprising three Members each which shall
be headed by an officer not below the rank of Superintendent of Police, Joint Commissioner of Customs and
Central Excise, Joint Director of Directorate of Revenue Intelligence or officers of equivalent rank and every
such Committee shall be directly responsible to the Head of the Department.
6. Functions.ÑThe functions of the Drug Disposal Committee shall be to-
(a) meet as frequently as possible and necessary;
(b) conduct a detailed review of seized items pending disposal;
(c) order disposal of seized items; and
(d) advise the respective investigation officers or supervisory officers on the steps to be
initiated for expeditious disposal.
7. Procedure to be followed by the Drug Disposal Committee with regard to disposal of seized items.Ñ
(1) The officer-in-charge of godown shall prepare a list of all the seized items that have been certified
under section 52A of the said Act and submit it to the Chairman of the concerned Drug Disposal
Committee.
(2) After examining the list referred to in sub-paragraph (1) and satisfying that the requirements of
section 52A of the said Act have been fully complied with, the members of the concerned Drug Disposal
Committee shall endorse necessary certificates to this effect an thereafter that Committee shall physically
examine and verify the weight and other details of each of the seized items with reference to the seizure
report, report of chemical analysis and any other documents, and record its findings in each case.
8. Power of Drug Disposal Committee for disposal of seized items.ÑThe Drug Disposal Committee can
order disposal of seized items up to the quantity or value indicated in the Table below, namely:Ñ

Provided that if the consignments are larger in quantity or of higher value than those indicated in the
Table, the Drug Disposal Committee shall send its recommendations to the Head of the Department who shall
order their disposal by a high level Drug Disposal Committee specially constituted for this purpose.
9. Mode of disposal of drugs.ÑÑÑÑ(1) Opium, morphine, codeine and thebaine shall be disposed of by
transferring to the Government Opium and Alkaloid Works under the Chief Controller of Factories.
(2) In case of narcotic drugs and psychotropic substances other than those mentioned in sub-paragraph
(1), the Chief Controller of Factories shall be intimated by the fastest means of communication available, the
details of the seized items that are ready for disposal.
(3) The Chief Controller of Factories shall indicate within fifteen days of the date of receipt of the
communication referred to in sub-paragraph (2), the quantities of narcotic drugs and psychotropic substances,
if any, that are required by him to supply as samples under rule 67B of the Narcotic Drugs and Psychotropic
Substances Rules, 1985.
(4) Such quantities of narcotic drugs and psychotropic substances, if any, as required by the Chief
Controller of Factories under sub-paragraph (3) shall be transferred to him and the remaining quantities
of narcotic drugs and psychotropic substances shall be disposed of in accordance with the provisions of
sub-paragraphs (5), (6) and (7).
(5) Narcotic drugs, psychotropic substances and controlled substances having legitimate medical or
industrial use, and conveyances shall be disposed of in the following manner:-
(a) narcotic drugs, psychotropic substances and controlled substances which are in the form of
formulations and labeled in accordance with the provisions of the Drugs and Cosmetics Act, 1940 (23
of 1940) and rules made thereunder may be sold, by way of tender or auction or in any other manner
as may be determined by the Drug Disposal Committee, after confirming the composition and
formulation from the licensed manufacturer mentioned in the label, to a person fulfilling the
requirements of the Drugs and Cosmetics Act, 1940 (23 of 1940) and the Narcotic Drugs and
Psychotropic Substances Act, 1985 (61 of 1985) and the rules and orders made thereunder, provided
that a minimum of 60% of the shelf life of the seized formulation remains at the time of such sale;
(b) narcotic drugs, psychotropic substance and controlled substances seized in the form of
formulations and without proper labeling shall be destroyed;
(c) narcotic drugs, psychotropic substances and controlled substances seized in bulk form may
be sold by way of tender or auction or in any other manner as may be determined by the Drug
Disposal Committee, to a person fulfilling the requirements of the Drugs and Cosmetics Act, 1940
(23 of 1940) and the Narcotic Drugs and Psychotropic Substances Act, 1985 (61 of 1985), and the
rules and orders made thereunder, after confirming the standards and fitness of the seized substances
for medical purposes from the appropriate authority under the Drugs and Cosmetics Act, 1940 (23 of
1940) and the rules made thereunder;
(d) controlled substances having legitimate industrial use may be sold, by way of tender or
auction or in any other manner as may be determined by the Drug Disposal Committee, to a person
fulfilling the requirements of the Narcotic Drugs and Psychotropic Substances Act, 1985 (61 of 1985)
and the rules and orders made thereunder;
(e) seized conveyances shall be sold off by way of tender or auction as determined by the Drug
Disposal Committee.
(6) Narcotic drugs, psychotropic substances and controlled substances which have no legitimate medical
or industrial use or such quantity of seized items which is not found fit for such use or could not be sold shall

(7) Destruction referred to in sub-paragraph (b) shall be by incineration in incinerators fitted with
appropriate air pollution control devices, which comply with emission standards and such incineration may
only be done in places approved by the State Pollution Control Board or where adequate facilities and
security arrangements exist and in the latter case, in order to ensure that such incineration may not be a
health hazard or polluting, consent of the State Pollution Control Board or Pollution Control Committee, as
the case may be, shall be obtained, and the destruction shall be carried out in the presence of the Members of
the Drug Disposal Committee.
10. Intimation to Head of Department on destruction.ÑÑÑÑThe Drug Disposal Committee shall intimate
the Head of the Department regarding the programme of destruction at least fifteen days in advance so that, in
case he deems fit, he may either himself conduct surprise checks or depute an officer for conducting such
surprise checks and after every destruction operation, the Drug Disposal Committee shall submit to the Head
of the Department a report giving details of destruction.
11. Certificate of destruction.ÑÑÑÑA certificate of destruction (in triplicate) containing all the relevant data
like godown entry number, gross and net weight of the items seized, etc., shall be prepared and signed by
the Chairman and Members of the Drug Disposal Committee as per format at Annexure 3 and the original
copy shall be pasted in the godown register after making necessary entries to this effect, the duplicate to be
retained in the seizure case file and the triplicate copy shall be kept by the Drug Disposal Committee.
12. Details of sale to be entered in godown register.ÑAs and when the seized narcotic drug, psychotropic
substance, controlled substance or conveyance is sold by way of tender or auction or in any other manner
determined by the Drug Disposal Committee, appropriate entry indicating details of such sale shall be made
in the godown register.
13. Communication to Narcotics Control Bureau.ÑDetails of disposal of narcotic drugs, psychotropic
substances, controlled substances and conveyances shall be reported to the Narcotics Control Bureau in the
Monthly Master Reports.

requires any Magistrate to whom an application is made to allow the application as soon as may be,
I, having been satisfied that the above inventory is as per the seizure documents and the consignments
of seized goods related to the case presented before me, certify the correctness of the above inventory.

1. All narcotic drugs, psychotropic substances, controlled substances and conveyances have been identified
by the Central Government under section 52A of the Narcotic Drugs and Psychotropic Substances Act,
1985 as vulnerable to theft and substitution vide Notification No.……….dated…………
2. As required under sub-section (2) of section 52 A of the Narcotic Drugs and Psychotropic Substances Act,
1985, I submit the enclosed inventory of seized narcotic drugs, psychotropic substances, controlled
substances, and/or conveyances and request you to-
(a) certify the correctness of the inventory;
(b) permit taking, in your presence, photographs of the seized items in the inventory and certify
such photographs as true; and
(c) allow drawing of representative samples in your presence and certify the correctness of the
list of samples so drawn.
3. I request you to allow this application under sub-section (3) of Section 52 A of the Narcotic Drugs and
Psychotropic Substances Act,1985 so that the seized narcotic drugs, psychotropic substances, controlled
substances, and/or conveyances can thereafter be disposed of as per sub-section (1) of section 52A of the
said Act retaining the certificate, photographs and samples as primary evidence as per sub-section (4) of
section 52A (4).
