The Central Govt. hereby exempts pharmaceutical manufacturing companies holding drug manufacturing licenses under the Drugs and Cosmetics Act, 1940 (23 of 1940) from the operation of provisions of the notification number G.S.R. 59(E), dated the 21st January, 2004.
This notification, G.S.R. 363(E), issued by the Department of Industrial Policy and Promotion under the Ministry of Commerce and Industry, and dated May 6, 2015, exempts pharmaceutical manufacturing companies holding drug manufacturing licenses under the Drugs and Cosmetics Act, 1940 from certain provisions related to nitroglycerine. Specifically, the exemption applies to the possession, sale, and use of nitroglycerine diluted up to 10%, as initially prohibited by notification G.S.R. 59(E) dated January 21, 2004. The exemption also covers the manufacturing of nitroglycerine not exceeding a batch size of one kilogram without isolating bulk nitroglycerine at any stage. This exemption is granted under the powers conferred by subsection 2 of section 14 of the Explosives Act, 1884, and also exempts these companies from relevant provisions of the Explosives Rules, 2008, effective from the date of publication of this notification. NOTIFICATION
New Delhi, the 6th May, 2015
G.S.R. 363(E).—Whereas the Central Government had prohibited the possession, sale and use of the nitro-
glycerine or such other substance whether a single chemical compound or a mixture of such explosives (explosive of
Class 3, Division 1) vide number G.S.R. 59 (E), dated the 21st January, 2004 and the time limit specified in the said
notification was extended to dispose of the existing stock of said explosives till the 1st day of December, 2004 vide
number G.S.R. 530 (E), dated the 20th August, 2004;
And whereas, the Indian Pharmaceutical Companies are manufacturing nitro-glycerine and diluting or
phelgmatizing nitro-glycerine upto 10% in alcohols and supplying those diluted products to other pharmaceutical
manufacturing companies as active pharmaceutical ingredients.
Now, therefore, in exercise of the powers conferred by sub-section (2) of section 14 of the Explosives Act,1884
(4 of 1884), the Central Government hereby exempts pharmaceutical manufacturing companies holding drug
manufacturing licenses under the Drugs and Cosmetics Act, 1940 (23 of 1940) from the operation of provisions of the
notification number G.S.R. 59(E), dated the 21st January, 2004 in respect of possession, sale and use of nitro-glycerine
diluted upto 10%. Such pharmaceutical manufacturing companies are also exempted in respect of manufacturing of
nitro-glycerine not exceeding batch size of one kilogram without isolating bulk nitro-glycerine at any stage and
possession, sale and use of nitro-glycerine diluted upto 10% from the relevant provisions of the Explosives Rules,
2008 from the date of publication of this notification.
