NOTIFICATION
New Delhi, the 13th November, 2014
S.O. 2909(E).— Whereas, in exercise of the powers conferred by Section 8A of the National
Highways Act, 1956 (48 of 1956), read with the National Highways Fee (collection of fees by any
person for user of Section of National Highways/Permanent Bridge/Temporary bridge on National
Highways) Rules, 1997, Central Government, vide notification S.O. 1422 (E) dated 20.06.2011
authorized M/s. Lucknow Sitapur Expressway Limited to collect and retain the fee for the
development, operation and maintenance of the stretch from km. 488.270 to km 413.200
(Lucknow - Sitapur section) of NH-24 in the state of Uttar Pradesh to four lane divided carriageway
on Build, Operate and Transfer (BOT) basis.
Now, in exercise of the powers conferred by Section 8A of the National Highways Act, 1956
(48 of 1956), read with the National Highways Fee (Determination of Rates and Collection) Rules
2008 and its Amendment Rules, 2013 published vide G.S.R. 778 (E) dated 16.12.2013 and
Ministry of Road Transport and Highways Office Memorandum bearing File No. H-39011/12/2014-
Toll dated 13.03.2014, the Central Government hereby makes the following amendments in the
notification published vide S.O. 1422 (E) dated 20.06.2011.
1. WPI-B in note 2 of Para-2 the Notification shall be substituted as follows:
“WPI-B = is the Average Wholesale Price Index for the year ending March
31st preceding the fee revision date”
2. A mechanical vehicle which is loaded in excess of permissible load specified for its
category under sub-rule (2) of rule 4, shall not be permitted to use the National Highway or
crossing the toll plaza until the excess load has been removed from such mechanical
vehicle. The driver or owner or a person in charge of a mechanical vehicle shall be liable to
pay fee, for entering the overloaded vehicle on the National Highway to the toll collecting
agency, equal to ten times of the fee applicable to such category of mechanical vehicle under
sub-rule (2) of Rule 4.
