तारीख स,े िजसको अिधसूचना वाले राजप+ क(cid:19) (cid:26)ितयाँ जनसाधारण को उपल.ध कराई गई थी, प0तालीस (cid:4)दन क(cid:19) अविध क(cid:19) समाि1
से पूव(cid:28) आ(cid:24)ेप और सुझाव आमंि+त करने के िलए भारत के राजप+, असाधारण, भाग-II, ख8ड 3, उपख8ड (i) म(cid:12) भारत सरकार,,,,
वािण:य और उ;ोग मं+ालय, (औ;ोिगक नीित और संव<न(cid:28) िवभाग) क(cid:19) अिधसूचना सं=यांक सा.का.िन. 286 (अ), तारीख 6 मई,
2013 >ारा (cid:26)कािशत (cid:4)कए गए थे;
और उ(cid:31) अिधसूचना वाले राजप+ क(cid:19) (cid:26)ितयाँ तारीख 12 जून, 2013 को जनसाधारण को उपल.ध करा दी गई थी;
और उ(cid:31) (cid:26)ा(cid:27)प िनयम के संबंध म(cid:12) जनसाधारण से (cid:26)ा1 आ(cid:24)ेप और सुझाव पर केABीय सरकार >ारा िवचार (cid:4)कया गया है;
अत: अब, केABीय सरकार, पेट(cid:12)ट अिधिनयम, 1970 (1970 का 39) क(cid:19) धारा 159 >ारा (cid:26)दC शि(cid:31)य का (cid:26)योग करते Dए,
पेट(cid:12)ट िनयम, 2003 का और संशोधन करने के िलए िनEन िलिखत िनयम बनाती ह,ै अथा(cid:28)त-्
1. (1) इन िनयम का संि(cid:24)1 नाम पेट(cid:12)ट (संशोधन) िनयम, 2014 ह ै ।
(2) ये राजप+ म(cid:12) उनके (cid:26)काशन क(cid:19) तारीख को (cid:26)वृC gksaxs ।
2. पेट(cid:12)ट िनयम, 2003 (िजसे इसम (cid:12)इसके पHात ्मूल िनयम कहा गया ह)ै के िनयम 2 म(cid:12) ---
(i) खंड (घ) के पHात् िनE निलिखत खंड अंतःJथािपत (cid:4)कया जाएगा, अथा(cid:28)त:्

(ii) खंड (च) के पHात् िनE निलिखत खंड अंतःJथािपत (cid:4)कया जाएगा, अथा(cid:28)त:्
Ô(चक) “लघु अिJतLव” से िनEन अिभ(cid:26)ेत ह-ै (i) वJतुN का िविनमाण(cid:28) या उLपादन लगे Dए (cid:4)कसी उ;म के मामल े
म,(cid:12) एक उ;म जहाँ संयं+ और मशीनरी म(cid:12) (cid:4)कया गया िनवेश “सOू म, लघु और मPयम उ;म िवकास अिधिनयम, 2006
(2006 का 27)” क(cid:19) धारा 7 क(cid:19) उप–धारा (1) के खंड (क) के अधीन मPयम उ;म के िलए िनQदR सीमा से अिधक न हो; और
(ii) सेवा (cid:26)दान या उपल.ध कराने वाले (cid:4)कसी उ;म के मामले म(cid:12), एक उ;म जहाँ उपJकर म(cid:12) (cid:4)कया गया िनवेश “सूOम, लघु
और मPयम उ;म िवकास अिधिनयम, 2006” क(cid:19) धारा 7 क(cid:19) उप–धारा (1) के खंड (ख) के अधीन मPयम उ;म के िलए
िनQदR सीमा से अिधक न हो ।
(cid:18)(cid:18)(cid:18)(cid:18)पपपप(cid:20)(cid:20)(cid:20)(cid:20)ीीीीककककररररणणणण :::: 1111.- इस खंड के (cid:26)योजन के िलए, “उ;म” से ऐसा कोई औ;ोिगक उपSम या कोई (cid:30)ावसाियक समुLथान या कोई
अAय Jथापन अिभ(cid:26)ेत ह,ै चाहे वह (cid:4)कसी भी नाम से Tात हो, जो उ;ोग (िवकास और िविनयमन) अिधिनयम, 1951
(1951 का 65) क(cid:19) पहली अनुसूची म(cid:12) िविनQदR (cid:4)कसी उ;ोग से संबंिधत वJतुN के िविनमा(cid:28)ण या उLपादन म,(cid:12) (cid:4)कसी रीित से
लगा Dआ ह ैया (cid:4)कसी ऐसे उ;ोग म(cid:12) कोई सेवा या सेवाN को उपल.ध कराने या उAह (cid:12)(cid:26)दान कराने म(cid:12) लगा Dआ ह ै।
(cid:18)(cid:18)(cid:18)(cid:18)पपपप(cid:20)(cid:20)(cid:20)(cid:20)ीीीीककककररररणणणण:::: 2.- संयं+ और मशीनरी म(cid:12) (cid:4)कए गए िनवेश क(cid:19) संगणना म(cid:12) (cid:26)दषू ण िनयं+ण, शोध और िवकास, औ;ोिगक सुर(cid:24)ा
उपकरण तथा सूOम, लघु और मPयम उ;म िवकास अिधिनयम, 2006 (2006 का 27) के तहत अिधसूचना >ारा यथा
िविनQदR ऐसी अAय वJतुN को सिEमिलत नहW (cid:4)कया जाएगा।
(cid:18)(cid:18)(cid:18)(cid:18)पपपप(cid:20)(cid:20)(cid:20)(cid:20)ीीीीककककररररणणणण:::: 3.- भारतीय Yरजव(cid:28) ब0क क(cid:19) िवदशे ी मुBा क(cid:19) िनदशZ दर अिभभावी होगी।Õ
3. मूल िनयम के िनयम 7 म(cid:12) - उप-िनयम (3) के पHात ्िन[िलिखत उप-िनयम अंतःJथािपत (cid:4)कया जाएगा, अथा(cid:28)त:्
(i) उप-िनयम (1) के पHात् िन[िलिखत उपबंध को अंतःJथािपत (cid:4)कया जाएगा, अथा(cid:28)त:्
“परAतु यह (cid:4)क जब कोई पेट(cid:12)ट के िलए आवेदन या अAय कोई दJतावेज़ भौितक (cid:27)प म(cid:12) अथा(cid:28)त ्मु(cid:4)Bत (cid:26)ित के
(cid:27)प िवधान म(cid:12) फाइल (cid:4)कया जाता ह,ै तो दस (cid:26)ितशत अितYर(cid:31) फ(cid:19)स संदये होगा ।
परAतु यह और (cid:4)क (cid:4)कसी लघु अिJतLव के सदं भ(cid:28) म(cid:12) (cid:26)Lयेक दJतावेज़, िजसके िलए कोई फ(cid:19)स िविहत है, (cid:26)(cid:27)प-28 के साथ संल_
होगा।"
(ii) “(3क) (cid:4)कसी लघु अिJतLव >ारा (cid:26)(cid:4)Sयागत आवेदन को पूणत(cid:28) : या अंशत: (cid:4)कसी (cid:26)कृत (cid:30)ि(cid:31) के अितYर(cid:31) (cid:4)कसी अAय
(cid:30)ि(cid:31) (लघु अिJतLव के िसवाय) को हJतांतYरत करने क(cid:19) िJथित म(cid:12) उसी मामले म(cid:12) (cid:4)कसी लघु अिJतLव से (cid:26)भाYरत फ(cid:19)स
(फ(cid:19)स ) और (cid:4)कसी (cid:26)कृत (cid:30)ि(cid:31) के अितYर(cid:31) (cid:4)कसी अAय (cid:30)ि(cid:31) (लघु अिJतLव के िसवाय) से (cid:26)भाय(cid:28) फ(cid:19)स (फ(cid:19)स ) के पYरमाण

NOTIFICATION
New Delhi, the 28th February , 2014
G.S.R. 125(E).— Whereas certain draft rules, namely the Patents (Amendment) Rules, 2013 were published
as required under sub-section (3) of Section 159 of the Patents Act, 1970 (39 of 1970), vide notification of the
Government of India in the Ministry of Commerce and Industry (Department of Industrial Policy and Promotion),
number G.S.R. 286(E), dated the 6th May, 2013, in the Gazette of India, Extraordinary, Part II, Section 3,
sub-section (i), dated the 6th May, 2013, for inviting objections and suggestions from all persons likely to be affected
thereby before the expiry of a period of forty-five days from the date on which copies of the Gazette containing the
notification were made available to the public;
And whereas, the copies of the Gazette containing the said notification were made available to the public on
the 12th June, 2013;
And whereas, the objections and the suggestions received from the public on the said draft rules have been
considered by the Central Government;
Now, therefore, in exercise of the powers conferred by Section 159 of the Patents Act, 1970 (39 of 1970), the
Central Government hereby makes the following rules further to amend the Patents Rules, 2003, namely:—
1. (1) These rules may be called the Patents (Amendment) Rules, 2014.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In rule 2 of the Patents Rules, 2003 (hereinafter referred to as the principal rules),—
(i) after clause (d), the following clause shall be inserted, namely:—
‘(da) “ person other than a natural person” shall include a “small entity” ’ ;
(ii) after clause (f), the following clause shall be inserted, namely:—
(i) in case of an enterprise engaged in the manufacture or production of goods, an enterprise where the
investment in plant and machinery does not exceed the limit specified for a medium enterprise under clause (a)
of sub-section (1) of section 7 of the Micro, Small and Medium Enterprises Development Act, 2006 (27 of
2006); and¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 13
(ii) in case of an enterprise engaged in providing or rendering of services, an enterprise where the investment
in equipment is not more than the limit specified for medium enterprises under clause (b) of sub-section (1) of
Section 7 of the Micro, Small and Medium Enterprises Development Act, 2006.
Explanation 1. – For the purpose of this clause, "enterprise" means an industrial undertaking or a business
concern or any other establishment, by whatever name called, engaged in the manufacture or production of
goods, in any manner, pertaining to any industry specified in the First Schedule to the Industries
(Development and Regulation) Act, 1951 (65 of 1951) or engaged in providing or rendering of any service or
services in such an industry.
Explanation 2. - In calculating the investment in plant and machinery, the cost of pollution control, research
and development, industrial safety devices and such other things as may be specified by notification under the
Micro, Small and Medium Enterprises Development Act, 2006 (27 of 2006), shall be excluded.
Explanation 3. - The reference rates of foreign currency of the Reserve Bank of India shall prevail.’.
3. In rule 7 of the principal rules, -
(i) after sub rule (1), the following provisos shall be inserted, namely:-
“ Provided that ten per cent additional fee shall be payable when the applications for patent and other
documents are filed through physical mode, namely, in hard copy format:
Provided further that in the case of a small entity, every document, for which a fee has been specified,
shall be accompanied by Form-28.”.
(ii) after sub-rule (3), the following sub-rule shall be inserted, namely:---
“(3A) In case an application processed by a small entity is fully or partly transferred to a person other
than a natural person ( except a small entity), the difference, if any, in the scale of fee(s) between the fee(s)
charged from a small entity and the fee(s) chargeable from the person other than a natural person ( except a
small entity) in the same matter shall be paid by the new applicant with the request for transfer.” ;
4. In sub- rule (1) of rule 55 of the principal rules, after the words “shall be filed”, the words, figure, brackets and
letter “ in Form 7 (A)” shall be inserted.
5. For the First Schedule to the principle rules, the following Schedule shall be substituted, namely :---
