S.O. 3317(E).—Whereas, by notification of the Government of India in the erstwhile Ministry of Road
Transport and Highways number S.O. 275 (E) dated 14th February, 2012 issued under Section 5 of the National
Highways Act, 1956 (48 of 1956), the Central Government has entrusted National Highway No. 7 in the State of Madhya
Pradesh to the State Government of Madhya Pradesh.
And whereas, a Memorandum of Understanding was entered between Central Government and the State
Government of Madhya Pradesh on September 30, 2009 for the development of National Highway No. 7 from Rewa to
MP/UP Border situated in the State of Madhya Pradesh.
And whereas, the State Government of Madhya Pradesh authorized Madhya Pradesh Road Development
Corporation Limited, Bhopal (hereinafter referred to as the “Authority”) to act as implementing authority on behalf of the

State Government of Madhya Pradesh vide order No. 5593/6502/19/ ./2011 dated 18.10.2011.
And whereas, the Authority has entered into an Agreement on 25.01.2012 (hereinafter referred to as said
“Agreement”) with M/s. Vindhyachal Expressway Private Limited, having its Registered Office at A-104, Shapath-4,
Opp. Karnavati Club, S.G. Road, Ahmedabad 380 051, Gujarat (hereinafter referred to as “Concessionaire”), for the bid
submitted on 02.09.2011 for the development & operation of Rewa-MP/UP Border Section of NH-7 from km 229/100 to
km 140/600 [Design length 89.23 km] (hereinafter referred to as the “said section”) in the State of Madhya Pradesh on
Design, Build, Finance, Operate and Transfer (DBFOT) basis;
Now, therefore, in exercise of the powers conferred by Section 8A of the National Highways Act, 1956 (48 of
1956), read with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 and amended
upto the date of receipt of bid, (herein referred to as the “Rules”), the Central Government, having regard to the
expenditure involved in building, maintenance, management and operation of the said section, interest on the capital
invested, reasonable return, the volume of traffic and the period of the Agreement entered into between the Authority and
the Concessionaire, hereby notifies that there shall be levied and collected fees on mechanical vehicles for the use of the
said section at the rate specified in column (2) of the Table 1 for net road section of 61.33 km length for use of the four
and more lane sections (hereinafter referred to as “base rate”) and at one and half times of the base rate for six number of
bypasses having total design length of 27.90 km on the Types of Vehicles specified in column (1) of the Table 1 below,
and authorizes the said Concessionaire to collect and retain the fees on and from the date of commercial operation dated
(COD) declared by the Authority and on getting the completion certificate or the provisional completion certificate as the
case may be from the Authority or publication of this notification in the Official Gazette, whichever is later, till the
termination date as specified in the Agreement;

3. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes
and resides within a distance of twenty kilometers from the toll plaza is Rs 225.00 (Rupees Two Hundred Twenty Five
only) for the year 2014-15 and is subject to revision every year as per the provisions of the National Highway fee
(determination of Rates and collection) Rules, 2008.
4. For multiple journeys on the highway section, passes shall be issued at the following rates namely:

5. Fee for commercial vehicles (excluding vehicles plying under National Permit) registered in the district where
the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative
road is available for use of such commercial vehicles.
6. The driver or owner or a person in charge of a Mechanical vehicle which is loaded in excess of permissible load
specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the
toll collecting agency, equal to ten times of the fee applicable to such category of mechanical vehicle and shall not be
entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle.
7. All definitions, category of mechanical vehicles, its permissible load, category of exempted vehicles, service
road, alternative road etc. shall be as per definitions specified in the said Rule.6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
8. The fee rates shall be displayed for information of the users in accordance with rules 12 of the said Rules.
9. Based on the base rate of fee per km for the base year 2007-08 as mentioned in Table-1, the actual amount of fee
to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of the
completed portion of the length of the project Highway. The same shall be got published by the Authority in at least one
newspaper, each in English and vernacular language through the concessionaire and thereafter revised annually in
accordance with the rule 5 of the said rules and provision of Concession Agreement and got published, provided that no
revision shall be effected with in a period of six months from the date of the preceding revision of fee.
