Hkqous'oj esa fLFkr gksxkA XIII. dksbZ ekeyk ftls izkf/dj.k ds {ks=k vkSj vf/dkfjrk ds Hkhrj fofufnZ"V :i ls iQkby ugha fd;k x;k gks] ml ij lacaf/r dkuwuh izkf/dkj.kksa n~~okjk fopkj fd;k tk,xkA [iQk- la- 12&2@2005&vkbZ ,- IIIº fc'okukFk flUgk] la;qDr lfpo MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE ORDER New Delhi, the 1st April, 2015 S.O. 936(E).— In exercise of the powers conferred by sub sections (1) and (3) of section 3 of the Environment (Protection) Act, 1986 ( 29 of 1986) (hereinafter referred to as the said Act), and in supersession of the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O.490 (E), dated the 19th March, 2012 except as respects thinks done or omitted to be done before such supersession, the Central Government hereby reconstitutes the Odisha Coastal Zone Management Authority (hereinafter referred to as the Authority) consisting of the following persons, for a period of three years, with effect from the 19th Day of March, 2015, namely :— 1. Secretary, Forests and Environment Department, Government of Odisha Chairman 2. Shri. Jagannath Bastia, President Beach Protection Council of Odisha, Dolamandap Sahi, Member Puri – 752 001 3. Dr. B.R. Subramanian, Former Director, Integrated Coastal and Marine Area Management, Chennai Member 4. Dr. Rabindra Nath Hota, Professor of Geology, Utkal University, Bhubaneswar Member 5. Head of the Department, Department of Marine Science, Berhampur University, Odisha. Member 6. Secretary, Housing and Urban Development Department, Government of Odisha Member 7. Secretary, Fisheries and Animal Resource Development Department, Government of Odisha Member 8. Principal Chief Conservation of Forest (WL) and Chief Wildlife Warden, Odisha Member 9. Chairman, State Pollution Control Board, Odisha or Member Secretary, State Pollution Control Board, Member Odisha 10. Chief Executive, Chilika Development Authority, Bhubaneswar Member 11. Director, Environment-cum-Special secretary to Government of Forests and Environment Member-Secretary Department, Bhubaneswar II The Authority shall have the power to take the following measures for protecting and improving the quality of the coastal environment and preventing, abating and controlling environmental pollution in areas of State of Odisha, namely :— (i) (a) examination of the proposals in accordance with the approved Coastal Zone Management Plan and in compliance with notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 19 (E) , dated the 6th January, 2011 (hereinafter referred to as the CRZ notification, 2011) and making recommendations within a period of sixty days from date of receipt of complete application to the Ministry of Environment, Forest and Climate Change or State Environmental Impact Assessment Authority or Local Planning Authority as applicable : (b) examination of proposals for changes or modifications in classification of Coastal Regulation Zone areas and in the Coastal Zone Management Plan (CZMP) received from the Odisha State Government and making specific recommendations in accordance with the provisions of the CRZ notification, 2011; (ii) (a) inquire into cases of alleged violation of the provisions of the said Act or the rules made thereunder or any other law which is relatable to the objects of the said Act and, if found necessary in a specific case,4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] issuing directions under section 5 of the said Act, in so far as such directions are not inconsistent with any direction issued in that specific case by the National Coastal Zone Management Authority constituted by the Central Government; (b) review of cases involving violations of the provisions of the said Act and the rules made thereunder or under any other law which is relatable to the objects of the said Act, and if found necessary referring such cases, with comments, for review to the aforesaid National Coastal Zone Management Authority: Provided that the cases under clauses (a) and (b) of this sub paragraph may be taken up by the Authority, suo motu or on the basis of complaint made by an individual or a representative body or an organisation; (iii) filing complaints, under section 19 of the said Act, in cases of non -compliance of the directions issued by it under this paragraph; (iv) to take action under section 10 of the said Act to verify the facts concerning the issues arising from this paragraph. III The Authority shall deal with environmental issues relating to Coastal Regulation Zone which may be referred to it by State of Odisha, the National Coastal Zone Management Authority or the Central Government, as the case may be. VI The Authority shall prepare and submit Coastal Regulation Zone Plans and maps of the coastal areas in the State as per the procedure laid down in the CRZ notification, 2011 and submit to the National Coastal Zone Management Authority and the Central Government in the Ministry of Environment, Forest and Climate Change for approval. V The Authority shall ensure compliance of all specific conditions that are laid down in the approved Coastal Zone Management Plan of Odisha and the CRZ notification, 2011. VI The Authority shall furnish report of its activities at least once in six months to the National Coastal Zone Management Authority and the Central Government in the Ministry of Environment, Forest and Climate Change. VII The quorum of the meeting of the Authority shall be one-third of the total number of the Members of the Authority and in case the quorum is not available, the meeting shall be adjourned for 30 minutes and shall be reconvened. VIII The pay and allowances such as TA, DA, Seating Fees, Field visit fees etc., shall be as per the norms decided by the Ministry of Environment and Forests/ Central Government. IX The State Government shall ensure that sufficient resources, manpower and funds are available to the Authority to discharge its functions effectively as envisaged in this notification and in the Environment (Protection) Act, 1986. X It shall be the responsibility of the Authority to create a dedicated website to maintain transparency in the working of the Coastal Zone Management Authority and post the agenda, minutes, decisions taken, clearance letters, violations, action taken on the violations and cases pending in the courts including the Orders of the Court as also the approved Coastal Zone Management Plans of State of Odisha. XI The foregoing powers and functions of the Authority shall be subject to the supervision and control of the Central Government. XII The Authority shall have its headquarters at Bhubaneswar.
