अजभप्रेत ह ै: (iii) "अपील प्राजधकारी" से जनयम 8 के उप-जनयम (1) में जनर्िाष्ट अजधकारी अजभप्रेत ह ै ; और (iv) "धारा" से अजधजनयम की कोई धारा अजभप्रेत ह ै । (2) उन िब्िों और पिों के, िो इनमें प्रयुि है रािपत्र में प्रकाजित एक आिेि द्वारा, इतनी संख्या में केंद्रीय सरकार के अजधकाररयों की जनयुजि कर सकती है, िो अवर सजचव के पि से नीचे का न हो, को अजधजनयम के उपबंधों के अधीन िुमााने के न्यायजनणायन के जलए प्राजधकृत अजधकारी के रूप में जनयुि दकया गया है। (2) राज्य सरकार, रािपत्र में प्रकाजित आिेि द्वारा, राज्य सरकार के इतने अजधकारी, िो अपर जिला मजिस्ट्रेट या अपर कलेक्टर या जिला के अपर उपायुि या राज्य सरकार में अवर सजचव के पि से नीचे के नहीं हों, अजधजनयम के उपबंधों के अधीन िुमााना तय करने के जलए प्राजधकृत अजधकारी के रूप में की जनयुजि कर सकती है। 4. प्राजधकृत अजधकारी की िजियाँ-—प्राजधकृत अजधकारी जनम्नजलजखत काया करेगा अर्ाात् :— (i) प्रििानी स्ट्र्ल में प्रवेि करना या दकसी अजधकारी को प्रििानी स्ट्र्ल में प्रवेि करने के जलए अजधकृत करना और उल्लंघन, यदि कोई हो, की ररपोटा करना: (ii) जलजखत में कारण ििा करते हुए तथ्यों से पररजचत दकसी भी व्यजि को बुलाना और मामले की पररजस्ट्र्जतयों के पश्चात उसकी उपजस्ट्र्जत सुजनजश्चत करना; और (iii) साक्ष्य के जलए आिेि िेना, जिसमें वीजडयो जनगरानी फुटेि, रटकट स्ट्केन या कोई िस्ट्तावेि तैयार करना िाजमल है, िो प्राजधकृत अजधकारी की राय में सुसंगत हो सकता ह ै । 5. िुमााने के न्यायजनणायन के जलए जवचार दकए िाने वाले कारक—िुमााने की मात्रा का न्यायजनणायन करते समय, प्राजधकृत अजधकारी को जनम्नजलजखत कारकों का उजचत ध्यान रखना होगा, अर्ाात् (i) उल्लंघन की प्रकृजत, (ii) अनुपातहीन लाभ या अनुजचत लाभ की राजि, िहां उल्लंघन का पररणाम है ; और (iii) उल्लंघन की पुनरावृजत्त, (iv) करठनाइयों का संतुलन । 6. िुमााना लगाने की प्रदक्रया— (1) िुमााने का न्यायजनणायन करने से पहले, प्राजधकृत अजधकारी उस व्यजि को, िो व्यजतक्रम करता ह,ै ऐसी अवजध के भीतर कारण बताने के जलए नोरटस (पंद्रह दिन से कम नहीं और उस पर सेवा की तारीख से तीस दिन से अनजधक), िारी करेगा जिसके जलए उस पर िुमााना नही लगाया िाना चाजहए। (2) उप-जनयम (1) के अधीन िारी प्रत्येक नोरटस,- (i) अजधकजर्त उल्लंघन की प्रकृजत को स्ट्पष्ट रूप से इंजगत करें, िो अजधजनयम के अधीन व्यजि द्वारा काररत दकया गया हो या दकया गया हो ; और (ii) अजधजनयम के सुसंगत िुमााने के उपबंध पर ध्यान आकर्षात करें । (3) कारण बताओ नोरटस का उत्तर उस अवजध के भीतर फाइल दकया िाएगा, जिसे प्राजधकृत अजधकारी द्वारा जलजखत कारणों से, पंद्रह दिन की अनजधक अवजध के जलए बढाया िा सकता है, यदि व्यजि प्राजधकृत अजधकारी का यह समाधान करता ह ै दक ऐसे व्यजि के पास जनधााररत अवजध के भीतर नोरटस का प्रत्युत्तर न िेने के जलए पयााप्त कारण है या यदि प्राजधकृत अजधकारी के पास यह जवश्वास करने का कारण ह ै दक व्यजि ने कम समय में नोरटस को प्राप्त दकया ह ैऔर प्रत्युत्तर िेने के जलए उजचत समय नहीं ह ै । (4) प्राजधकृत अजधकारी द्वारा प्रिान दकए गए कारण बताओ नोरटस के उत्तर पर जवचार करने के पश्चात् यह प्राजधकृत अजधकारी की राय ह ै दक वास्ट्तजवक उपजस्ट्र्जत अपेजित है, प्राजधकृत अजधकारी उत्तर की प्राजप्त की तारीख से िस दिन के भीतर एक नोरटस िारी करेगा, व्यजि की उपजस्ट्र्जत की तारीख को या तो व्यजिगत रूप से या प्राजधकृत प्रजतजनजधत्व के माध्यम से जनयत करेगा । (5) यदि कोई व्यजि, जिसको उपधारा (1) के अधीन नोरटस िारी दकया गया है, व्यजिगत रूप से या अपने प्राजधकृत प्रजतजनजधत्व के माध्यम से मौजखक प्रजतजनजधत्व करता ह ै और कारण बताओ नोरटस के उत्तर में इसे इंजगत दकया गया ह,ै प्राजधकृत अजधकारी ऐसे व्यजि को उपजस्ट्र्त होने की तारीख जनयत करने के पश्चात् ऐसा प्रजतजनजधत्व करने के जलए प्राजधकृत दकया गया है ।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 (6) सुनवाई के जलए जनयत तारीख पर व्यजि को सुनवाई का उजचत अवसर िेने के पश्चात् प्राजधकृत अजधकारी जलजखत में कारणों के अध्यधीन, जलजखत में एक आिेि पाररत करेगा, जिसमें स्ट्र्गन आिेि भी िाजमल ह ै । (7) सुनवाई के पश्चात्, प्राजधकृत अजधकारी संबंजधत व्यजि से उल्लंघन की अवधारणा के सुसंगत दकन्हीं अन्य मुद्दों पर जलजखत उत्तर की मांग कर सकता ह ै । (8) यदि कोई व्यजि उपधारा (1) या उपधारा (4) के अधीन िारी कारण बताओ नोरटस का उत्तर िेने में जवफल रहता है या उपधारा (5) के अधीन अपेिानुसार उपजस्ट्र्त होने से मना कर िेता है, प्राजधकृत अजधकारी ऐसा करने के कारणों को ििा करने के पश्चात् ऐसा न होने पर िुमााना लगाने का आिेि पाररत कर सकता ह ै । 7. िुमााने के आिेि का पाररत होना एवं प्रकटीकरण--(1) प्राजधकृत अजधकारी जनयम 6 के उपजनयम (1) के अधीन नोरटस िारी होने की तारीख से नब्बे दिनों के भीतर िुमााना तय करके आिेि पाररत करेगा । (2) यदि उप-जनयम (1) के अधीन यर्ाजनर्िाष्ट नब्बे दिनों की अवजध की समाजप्त के पश्चात कोई आिेि पाररत दकया िाता ह,ै तो जलजखत में प्राजधकृत अजधकारी द्वारा िेरी के कारण बताए िाएंगे । (3) प्राजधकृत अजधकारी द्वारा पाररत कोई भी आिेि केवल प्राजधकृत अजधकारी द्वारा आिेि पाररत करने में िेरी के कारण अमान्य नहीं होगा। (4) प्राजधकृत अजधकारी का प्रत्येक आिेि जवजधवत दिनांदकत और प्राजधकृत अजधकारी द्वारा हस्ट्तािररत होगा और जनयम 6 के उपजनयम (4) के अधीन वास्ट्तजवक उपजस्ट्र्जत की आवश्यकता के कारण न्यायजनणायन के आधार सजहत सुसंगत तथ्यों को स्ट्पष्ट रूप से बताएगा। (5) प्राजधकृत अजधकारी उपजनयम (1) के अधीन पाररत आिेि की एक प्रजत जबना दकसी जवलंब के जनम्नजलजखत पिकारों को भेिेगा, अर्ाात् :- (क) ऐसा संबंजधत व्यजि, िो उल्लंघन कर रहा ह ै या उल्लंघन करने वाला कोई अन्य व्यजि ; (ख) अजधजनयम की धारा 11 के अधीन अनुज्ञजप्त प्राजधकारी ; और (ग) केंद्रीय दफल्म प्रमाणन बोडा का अध्यि । (6) उपजनयम (1) के अधीन पाररत दकसी आिेि की एक प्रजत केंद्रीय दफल्म प्रमाणन बोडा की वेबसाइट पर भी अपलोड की िाएगी । 8. अपील अजधकारी (1) जनयम 7 के उपजनयम (1) के अधीन पाररत दकसी प्राजधकृत अजधकारी के आिेि के जवरुद्ध की गई कोई अपील केंद्रीय सरकार (िहां प्राजधकृत अजधकारी अवर सजचव है) के उप सजचव या जनिेिक या संबंजधत जिले के जिला मजिस्ट्रेट (िहां प्राजधकृत अजधकारी अपर जिला मजिस्ट्रेट है) के समि जलजखत रूप में फाइल की िाएगी । (2) उपजनयम (1) के अधीन फाइल की गई कोई अपील के सार् आवेिन उस आिेि की प्रमाजणत प्रजत की मांग की िाएगी, जिसके जवरुद्ध अपील की मांग की गई ह ै । (3) उपजनयम (1) के अधीन की गई कोई अपील उस तारीख से तीस दिनों के भीतर फाइल की िानी चाजहए, जिसको जनयम 7 के उपजनयम (1) के अधीन प्राजधकृत अजधकारी द्वारा दकए गए िुमााने के आिेि की एक प्रजत संबंजधत व्यजि को प्राप्त होती है और, िहां उजचत हो, अपीलीय प्राजधकारी द्वारा जलजखत रूप में कारणों के सार् तीस दिन तक की िेरी को माफ दकया िा सकता है । (4) उपजनयम (1) के अधीन कोई भी अपील इन जनयमों से उपाबद्ध प्ररूप में, िो ऐसी फीस के सार् फाइल की िाएगी, िो केंद्रीय सरकार द्वारा जनर्िाष्ट की िा सकती है । (5) िहां पीज़ित व्यजि का प्रजतजनजधत्व एक प्राजधकृत प्रजतजनजध द्वारा दकया िाता है, प्रजतजनजध के पि में प्राजधकरण पत्र के रूप में ऐसे प्राजधकरण की एक प्रजत और ऐसे प्राजधकृत प्रजतजनजध की जलजखत सहमजत, अपील के सार् संलग्न की िाएगी । (6) इस जनयम के उपजनयम (1) के अधीन फाइल की गई दकसी अपील में एक से अजधक आिेि के जवरुद्ध अनुतोष की मांग नहीं की िाएगी िब तक दक अपील के अधीन मांगा गया अनुतोष पररणामी न हो ।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 9. अपील के जलए प्रदक्रया— (1) अपीलीय प्राजधकारी, प्राजधकृत अजधकारी जिसके आिेि के जवरुद्ध अपील की गई है, अपील की एक प्रजत के सार् एक नोरटस भेिेगा, ऐसे प्राजधकृत अजधकारी को नोरटस प्राजप्त की तारीख से इक्कीस दिन की अनजधक अवजध के भीतर उत्तर िाजखल करने की अपेिा की िाती ह ै । (2) िहां कोई अपील िोषपूणा पाई िाती है, अपीलीय प्राजधकारी अपीलकताा को िोषों को सुधारने के जलए िोषों की प्रकृजत के बारे में अपीलीय प्राजधकारी से सूचना प्राप्त होने की तारीख के पश्चात कम से कम चौिह दिनों की अनुमजत िे सकता ह ै । (3) यदि अपीलकताा िोषों को सुधारने में जवफल रहता है, तो अपीलीय प्राजधकारी आिेि द्वारा और कारणों को जलजखत रूप में ििा करने से ऐसी अपील को रजिस्ट्रीकृत करने से इनकार कर सकता ह ै और उप-जनयम (2) के अधीन जनर्िाष्ट समय की समाजप्त की तारीख से सात दिनों की अवजध के भीतर अपीलकताा को इस तरह के इनकार के बारे में सूजचत कर सकता ह ै । (4) अपीलीय प्राजधकारी, जलजखत रूप में ििा दकए िाने वाले कारणों से, उपजनयम (1) में जनर्िाष्ट अवजध को इक्कीस दिनों की और अवजध तक बढा सकता है, यदि प्राजधकृत अजधकारी अपीलीय प्राजधकारी को संतुष्ट करता ह ै दक जवलंब के जलए पयााप्त कारण र्ा अपील का उत्तर फाइल करने में जवलंब के जलए पयााप्त कारण हो । (5) अपीलीय प्राजधकारी के समि प्राजधकृत अजधकारी द्वारा फाइल दकए गए प्रत्येक उत्तर, आवेिन या जलजखत अभ्यावेिन की एक प्रजत प्राजधकृत अजधकारी द्वारा अपीलकताा को एक सार् िी िाएगी । (6) प्राजधकृत अजधकारी, अपील की सुनवाई की तारीख से कम से कम पंद्रह दिन पूवा अपीलकताा और प्राजधकृत अजधकारी को अपील की सुनवाई का नोरटस िारी करेगा । (7) अपील प्राजधकारी, अपील की सुनवाई के समय, अपील के दकसी भी आधार को िो़िने की अनुमजत िे सकता है, िो उस जनयम से उपाबद्ध अपील के रूप में जनर्िाष्ट नहीं ह ै यदि वह संतुष्ट है दक उस आधार का लोप िानबूझकर या अनुजचत नहीं र्ा । (8) अपीलीय प्राजधकारी सुनवाई के जलए एक तारीख जनयत कर सकता ह ै और ऐसी िांच करने के पश्चात, िो आवश्यक हो और अजभजलजखत करने के कारणों के अध्यधीन कोई आिेि पाररत कर सकता है, िो वह ठीक समझे । (9) यदि अपीलकताा या प्राजधकृत अजधकारी जनयत तारीख पर उपजस्ट्र्त होने में जवफल रहता है, अपील प्राजधकारी ऐसे आिेि पाररत करने के कारणों को अजभजलजखत करते हुए, ऐसे व्यजि की अनुपजस्ट्र्जत में एक आिेि पाररत कर सकता ह ै । (10) अपील प्राजधकारी, िहां ऐसा करना संभव हो, अपील की प्राजप्त की तारीख से छह मास की अवजध के भीतर अपील की सुनवाई और जवजनश्चय करेगा । (11) िहां आिेि िारी करने पर न्यायालय के आिेि द्वारा रोक लगा िी िाती है, अपील पर जवजनश्चय लेने के जलए छह मास की अवजध की गणना में उस अवजध को बाहर रखा िाएगा । (12) इस जनयम के अधीन पाररत प्रत्येक आिेि पर तारीख और हस्ट्तािर दकए िाएंगे । (13) अपील प्राजधकारी द्वारा पाररत प्रत्येक आिेि की एक प्रमाजणत प्रजत को जबना जवलंब के प्राजधकृत अजधकारी, अपीलकताा और अध्यि, दफल्म प्रमाणन बोडा को सूजचत दकया िाएगा । 10. िुमााने का भुगतान करने की पद्धजत— िुमााने का भुगतान केवल ई-जसनेमाप्रमाण पोटाल के माध्यम से दकया िाएगा । 11. भारत की समेदकत जनजध— अजधजनयम के अधीन िुमााने के माध्यम से प्राप्त सभी रकम भारत की समेदकत जनजध को संिाय की िाएगी । *******[भाग II—खण् ड 3(i)] Act, 1952 (37 of 1952), the Central Government hereby makes the following rules, namely :— 1. Short title and commencement. (1)—These rules shall be called the Cinematograph (Adjudication of Penalty) Rules, 2024. (1) They shall come into force on the date of their publication in the Official Gazette. 2. Definitions. (1)— In these rules, unless the context otherwise requires- (i) “Act” means the Cinematograph Act, 1952; (ii) “authorised officer” means an officer appointed by either the Central Government or the relevant State Government under sub-rule (1) of rule 3; (iii) “appellate authority” means an officer referred to in sub-rule (1) of rule 8; and (iv) “section” means any section of the Act. (2) Words and expressions used in these rules but not defined, and defined in the Act shall have the meanings respectively assigned to them in the Act. 3. Appointment of the authorised officer. (1) The Central Government may, by an order published in the Official Gazette, appoint such number of officers of the Central Government, not below the rank of Under Secretary, as authorised officers for adjudging penalty under the provisions of the Act. (2) The State Government may, by an order published in the Official Gazette, appoint such number of officers of the State Government, not below the rank of an Additional District Magistrate or Additional Collector or Additional Deputy Commissioner of a District or Under Secretary in the State Government, as authorised officers for adjudging penalty under the provisions of the Act. 4. Powers of the authorised officer. The authorised officer shall exercise the following powers, namely:- (i) to enter the place of exhibition or authorise any officer to enter the place of exhibition and to report the violation, if any; (ii) to summon and enforce the attendance of any person acquainted with the facts and circumstances of the case after recording reasons in writing; and (iii) to order for evidence, including video surveillance footage, ticket scans or to produce any document, which in the opinion of the authorised officer may be relevant to the subject matter. 5. Factors to be considered for adjudication of penalty. While adjudicating the quantum of penalty, the Authorised Officer shall have due regard to the following factors, namely:- (i) nature of the violation; (ii) the amount of disproportionate gain or unfair advantage, wherever quantifiable, made as a result of the violation. (iii) repetition of the violation; and (iv) balance of hardships. 6. Procedure for levying penalties. – (1) Before adjudging the penalty, the authorised officer shall issue a show cause notice to the person who is in default, to show cause within such period as may be specified in the notice (not being less than fifteen days and not more than thirty days from the date of service thereon), providing the reasons for which the penalty should not be imposed upon. (2) Every notice issued under sub-rule (1) shall, - (i) clearly indicate the nature of violation alleged to have been committed or made by the person under the Act; and (ii) draw attention to the relevant penalty provisions of the Act. (3) The reply to show cause notice shall be filed within the period specified in the notice which may be extended by the authorised officer, for reasons to be recorded in writing, by a further period not exceeding fifteen days, if the person satisfies the authorised officer that[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 7 such person has sufficient cause for not responding to the notice within stipulated period or if the authorised officer has reason to believe that the person has received a shorter notice and did not have reasonable time to respond. (4) After considering the reply to show cause notice provided by the person, if the authorised officer is of the opinion that physical appearance is required, the authorised officer shall issue a notice, within ten working days from the date of receipt of the reply, fixing a date for appearance of the person, either personally, or through authorised representative. (5) If any person, to whom a notice is issued under sub-rule (1), desires to make an oral representation, whether personally or through their authorised representative and has indicated the same in the reply to show cause notice, the authorised officer shall allow such person to make such representation after fixing a date of appearance. (6) After giving a reasonable opportunity of being heard to the person concerned on the date fixed for hearing, the authorised officer may, subject to reasons to be recorded in writing, pass any order in writing, including an order for adjournment. (7) After the hearing, the authorised officer may require the concerned person to submit a written reply on any other issues relevant to the determination of the violation. (8) If any person fails to reply to the show cause notice issued under sub-rule (1) or sub-rule (4) or refuses to appear as required under sub-rule (5), the authorised officer may pass an order imposing the penalty in the absence of such a person after recording the reasons for doing so. 7. Passing and disclosure of the order of penalty. (1) The authorised officer shall pass an order deciding penalty, within ninety days from the date of issue of notice under sub-rule (1) of rule 6. (2) If an order is passed after the expiry of the period of ninety days as specified under sub- rule (1), the reasons for the delay shall be recorded by the authorised officer in writing. (3) No order passed by the authorised officer shall be invalid merely for the reason of delay in passing of order by the authorised officer. (4) Every order of the authorised officer shall be duly dated and signed by the authorised officer and shall clearly state the relevant facts, basis of the decision including the reasons for requiring the physical appearance under sub-rule (4) of rule 6. (5) The authorised officer shall send a copy of the order passed under sub-rule (1), without delay, to the following parties, namely: - (a) the concerned person who is in violation or any other person concerning the violation; (b) the licensing authority under section 11 of the Act; and (c) the Chairman of the Central Board of Film Certification. (6) A copy of the order passed under sub-rule (1) shall also be uploaded on the website of Central Board of Film Certification. 8. Appellate authority. (1) An appeal against the order of the authorised officer passed under sub-rule (1) of rule 7 shall be filed in writing before the deputy secretary or director to the Central Government (where the authorised officer is the under secretary) or the district magistrate of the relevant district (where the authorised officer is the additional district magistrate). (2) Any appeal filed under sub-rule (1) shall be accompanied by a certified copy of the order against which the appeal is sought. (3) An appeal under sub-rule (1) must be filed within thirty days from the date on which a copy of the order of penalty made by the authorised officer under sub-rule (1) of rule 7 is received by the concerned person and, where justified, delay may be condoned by the appellate authority up to thirty days more, with reasons to be recorded in writing. (4) Any appeal under sub-rule (1) shall be filed in the form annexed to these rules accompanied by such fees as may be specified by the Central Government. (5) Where the aggrieved person is represented by an authorised representative, a copy of such authorisation in favour of the representative, in the form of an authorization letter, and the written consent of such authorised representative, shall be appended to the appeal.8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (6) An appeal filed under sub-rule (1) of this rule shall not seek relief against more than one order unless the reliefs prayed for under the appeal are consequential. 9. Procedure for appeal. (1) The Appellate Authority shall serve a notice along with a copy of the appeal, to the authorised officer against whose order the appeal has been preferred, requiring such authorised officer to file a reply within a period not exceeding twenty one days from the date of receipt of the notice. (2) Where an appeal is found to be defective, the appellate authority may allow the appellant not less than fourteen days following the date of receipt of intimation by the appellant from the appellate authority about the nature of the defects, to rectify the defects. (3) If the appellant fails to rectify the defects, the appellate authority may by order and for reasons to be recorded in writing, decline to register such appeal and communicate such refusal to the appellant within a period of seven days from the date of expiry of the time specified under sub-rule (2). (4) The appellate authority may, for reasons to be recorded in writing, extend the period referred to in sub-rule (1), by a further period of twenty one days, if the authorised officer satisfies the appellate authority that there was sufficient cause for delay in filing reply to the appeal. (5) A copy of every reply, application or written representation filed by the authorised officer before the appellate authority shall be simultaneously served on the appellant, by the authorised officer. (6) The appellate authority shall issue notice of hearing of appeal to the appellant and the authorised officer, at least fifteen days before the date of hearing of the appeal. (7) The appellate authority may, at the time of hearing of an appeal, allow an appellant to add any ground of appeal not specified in the form of appeal annexed to the rules, if it is satisfied that the omission of that ground from the grounds of appeal was not wilful or unreasonable. (8) The appellate authority may fix a date for hearing and after making such further inquiry as may be necessary and subject to the reasons to be recorded in writing, pass any order as it thinks fit. (9) If the appellant or the authorised officer fails to appear on the date fixed for hearing, the appellate authority may pass an order in the absence of such person, after recording the reasons for passing such order. (10) The appellate authority shall, where it is possible to do so, hear and decide every appeal within a period of six months from the date of receipt of the appeal. (11) Where the issuance of order is stayed by an order of a court, the period of such stay shall be excluded in computing the period of six months for deciding the appeal. (12) Every order passed under this rule shall be dated and signed by the appellate authority. (13) A certified copy of every order passed by the appellate authority shall without delay be communicated to the authorised officer, the appellant, and the Chairman, Central Board of Film Certification. 10. Method of making payment of penalty. The penalty shall be paid through the e-cinemapramaan portal only. 11. Consolidated Fund of India.
