During the year 2013-2014, the Executive Committee met 6 times i.e. 122nd Meeting on 13th April, 2013, 123rd meeting on 13th May, 2013, 124th Meeting on 26th June, 2013, 125th meeting on 26th August, 2013, 126th Meeting on 15th January, 2014 and 127th Meeting on 23rd February, 2014. The various decisions and actions taken by the Council during the year under report are summarized as under: 1.0 RESTORATION OF NAMES REMOVED FROM THE REGISTER OF ARCHITECTS MAINTAINED BY THE COUNCIL UNDER THE ARCHITECTS ACT, 1972: The Council at its 60th Meeting restored names of 942 Defaulting Architects, whose names were restored to the Register of Architects on receipt of requisite fees, during the period 01.01.2013 to 31.07.2013. Dandekar, CA/2002/29046, Thane 3.0 MEETINGS OF THE DISCIPLINARY COMMITTEE : The constitution of Disciplinary Committee was notified by the Ministry of Human Resource Development, Govt. of India on 10th July, 2013, vide their gazette notification dated 03.07.2013. However, one of the members of the Disciplinary Committee expressed his inability to be part of the Committee. Thereafter, the constitution of Disciplinary Committee was re-notified in the gazette of India 5th March, 2014 vide notification dated 26th February, 2014 and the same was communicated to the Council on 27th March, 2014. The constitution of Disciplinary Committee is as under: i) Mrs. Sipra Mitra, Architect, Chairperson; ii) Shri R. Radhakrishnan, Architect, Member; and iii) Prof. Rajiv Mishra, Architect, Member. Thus, during the year-under report no meeting of the Disciplinary Committee of the Council could be held. 4.0 REGISTRATION OF ARCHITECTS : The Council registers a person as an architect under Section 25 of the Act, who resides or carries on the profession of architecture in India and holds, a recognized architectural qualification. During the year (1st April, 2013 to 31st March, 2014), the Council has registered 3700 persons as architects and with this as on 31st March, 2014, a total of 62970 persons have been registered as architects with Council of Architecture. On 31st March, 2014, 48810 persons hold valid registration as an Architect with the Council of Architecture. 5.0 REVISION OF VARIOUS FEES PRESCRIBED UNDER THE ARCHITECTS ACT AND RULES FRAMED THEREUNDER BY THE CENTRAL GOVERNMENT. The Council at its 60th meeting held on 27.08.2013, approved the revised fees structure as under : i) Registration Fee : Rs. 5000/- ii) Renewal Fee : Rs. 1,000/- with an option for onetime payment of Renewal Fee of Rs. 20,000/- iii) Restoration Fee : Rs. 10,000/- iv) Duplicate Certificate of Registration Fee : Rs. 2,000/- v) Additional Qualification Entry Fee : Rs. 500/- The Council further decided that the amount of Rs. 2/- as mentioned in Rule 28 of the Council of Architecture Rules, 1973, regarding Fee of list of Registered Architects be deleted. The Ministry of Human Resource Development, Govt. of India, has been requested to amend the Council of Architecture Rules, 1973 in the matter.¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 19 6.0 PRESCRIPTION OF QUALIFICATIONS AND COMPETENCE OF ARCHITECTS IN THE REVISED NATIONAL BUILDING CODE 2005 PRESCRIBED BY BUREAU OF INDIAN STANDARDS: The Council filed a writ petition challenging the provisions of the National Building Code before Hon’ble Delhi High Court. The writ petition was withdrawn by the Council in the light of the admission in the counter affidavit of the Bureau of Indian Standards that the said National Building Code, 2005 is without any statutory basis with liberty to challenge the same as an when any cause of action arises. 7.0 COMPLAINTS FOR PROFESSIONAL MISCONDUCT AGAINST ARCHITECTS: Each and every architect is required to observe and abide by the provisions of the Architects (Professional Conduct) Regulations, 1989, as amended in 2003. The Act provides for taking action against an architect who is found guilty of professional misconduct upon investigation and after providing opportunity of being heard to the Architect. The Council at its 60th Meeting considered 10 complaints of alleged professional misconduct against Architects 5 complaints were referred to the Disciplinary Committee for detailed investigation and 4 complaints were dismissed and 1 complaint was kept in abeyance since the matter was sub-judice. The Council at its 61st meeting considered two complaints of alleged professional misconduct against architects. One complaint was referred to Disciplinary Committee and another complaint was dismissed. 8.0 CONDUCT OF COMPETENCY TEST FOR CANDIDATES HAVING IIA MEMBERSHIP : In terms of the decision of the Council taken at its 60th Meeting held on 27.08.2013, a Competency Test was held on 7th and 8th February, 2014, at New Delhi for Candidates who have passed the Associate Membership of IIA by Examination. Out of 104 total candidates 56 candidates appeared in the Examination. The results of these candidates could not be declared as some of the candidates who did not appear in the examination have filed a writ petitions against the Council before Hon’ble Delhi High Court, Andhra Pradesh High Court and Calcutta High Court challenging the conduct of Competency test by Council in order to Considered such persons eligible for registration as an Architect. The Hon’ble Delhi High Court has allowed the Council to conduct the test however, directed not to declare the results. 9.0 CONDUCT OF B.ARCH. FIRST STAGE EXAMINATION BY THE COUNCIL FOR STUDENTS OF B.ARCH. COURSE ADMITTED BY THE ARCHITECTURAL INSTITUTIONS WITHOUT VALID APPROVAL OF COUNCIL. In terms of the decision of the Executive Committee of the Council, B.Arch. first stage examination was held on 15th & 16th February, 2014 at Jaipur, Lucknow & Kanpur for students who were admitted by the institutions without valid sanctioned intake or prior approval of the Council, for imparting B. Arch. course. Degree course were granted approval. 7 existing institutions were granted approval for M.Arch. Degree course. With this, the total number of institutions imparting recognized courses in architecture with the approval of Council has risen to 337 in 2013-2014. The annual intake of students (approx.) Undergraduate (UG) level is 20589, Postgraduate (PG) level is 1760 and at Ph.D is 30. 11.0 EXTENSION OF APPROVAL FOR THE ACADEMIC SESSION 2013-2014 ONWARDS: The Council granted extension of approval or otherwise for B.Arch. & M.Arch. Courses to 69 institutions for the academic session 2013-2014 as under: i) Institutions granted extension of approval for B.Arch. Course for 2013-2014 onwards with existing or higher intake: 69 ii) Institutions granted extension of approval for M.Arch. Course for 2013-2014 onwards with existing or higher intake: 5 iii) Institutions put on ‘No Admission’ for 2013-2014: NIL iv) Institutions put on ‘Withdrawal of approval’ for 2013-2014: 3 The Council has also initiated the process of inspection for the academic session 2013-2014 of institutions, which are due for inspections. 12.0 RECOGNITION OF FOREIGN QUALIFICATIONS UNDER THE ARCHITECTS ACT, 1972, BY THE CENTRAL GOVERNMENT: The Council has received references from the Central Government for recognition of Architectural Degree awarded by foreign Universities. A Sub-Committee consisting of Prof. Milind Kollegal, Convenor, Prof. Jitendra Singh, Member, Shri A. D. Shirode, Member, and Prof. D.V. Solomon, Member, for considering requests of Recognition of Foreign Qualifications has been constituted by the Council to examine and consider all cases relating to recognition of foreign qualifications. The Committee held its meeting on 13.06.2014 and 26.08.2014 and made its recommendations in respect of following qualifications that they be not considered for recognition under the Architects Act, 1972: i. M.S. Degree in Urban Design awarded by Edinburgh College of Art, Scotland; ii. Master of Architecture Degree awarded by Southern California Institute of Architecture (SClarc) Los Angeles, California, USA. 13.0 COMPREHENSIVE AMENDMENTS TO THE ARCHITECTS ACT, 1972 The Council submitted a proposal for comprehensive amendments in the Architects Act, 1972 to the Ministry of Human Resource Development, Govt. of India. The Ministry has constituted a Committee under the Chairmanship of Shri J. R. The Council also wrote to several public authorities to appoint architects as per Architectural Competition Guidelines and not to appoint through tender or bid process on payment of lowest fee. The guidelines and¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 25 inputs required by the promoters and competitors from the Council in the conduct of the competitions were also made available as and when requests were received. 18.0 ENFORCEMENT OF THE ARCHITECTS ACT, 1972 AND REGULATIONS FRAMED THEREUNDER : Sections 36 and 37 of the Architects Act, 1972, impose prohibition on misrepresentation as an architect as well as misuse of title and style of architect and violation of the prohibition is a punishable offence. Upon receipt of the complaints of misuse of title and style of architect, the Council files complaints u/s 39 before the First Class Magistrate for taking cognizance of the offences. The Council is vigorously pursuing such criminal complaints filed before the Metropolitan Magistrate in New Delhi, against persons who have violated the provisions of the Architects Act, 1972 and misrepresented or misused the title and style of architect. Presently about 28 complaints are pending for adjudication before the Court. Further, a total of about 114 cases are pending in different courts relating to enforcement of the provisions of the Architects Act, 1972 and other related matters where Council is one of the parties. 19.0 PUBLICATIONS The Council has printed and published its Directory of Architects and Handbook of Professional Documents 2013. The Handbook has been sent free of cost to all Architects holding valid registration and Architectural Institutions. The Council is also printing and publishing a monthly magazine Architecture Time Space and People. This magazine is printing and published with assistance of M/s. Lifestyle Media, New Delhi. The following books have been published and distributed to the architecture institutions in the country for promotion of architectural education and research: • The Courtyard Wada of Maharashtra, by Dr. Rupa Raje-Gupta. • Design Dialog – Dialectics of Design in Architecture, by Prof. Shireesh Deshpande. 500 copies of the each book titled “Concept of Space in Traditional Indian Architecture”, “Elements of Spacemaking” by Mr. Yatin Pandya were purchased for distribution to colleges of architecture and distributed. 400 copies of the book titled “Green is Red” by Mr. Anil Laul were purchased for distribution to colleges of architecture. The following books are in the process of designing and are expected to be printed and published shortly: a. Archiving Architectural Thesis 2011. b. Archiving Architectural Thesis 2012. c. Archiving Architectural Thesis 2013. d. Predesign, by Mr. Naresh Shah 20.0 ACKNOWLEDGEMENTS The Council is functioning with skeleton staff strength and carrying out its statutory functions efficiently on all India level out of its own resources.
