COUNCIL OF ARCHITECTURE (A statutory authority of Govt. of India) NOTIFICATION New Delhi, the 1st January, 2020 ANNUAL REPORT 2018-2019 F. No. CA/55B/iii/2019/A.R.—The Council of Architecture, set up under the Architects Act, 1972, deems it a pleasure to present the Annual Report and Audited Statement of Accounts for the financial year ending on 31st March, 2019. The Council is functioning under the Ministry of Human Resource Development, Department of higher Education, Government of India and is regulatory body for architectural education and profession in the country. Organizational Structure: The President, Council of Architecture, is the Head of the Organization under those overall charge the Council functions. Shri Vijay Garg is presently Acting President of the Council. The Registrar, Council of Architecture is the Chief Executive Officer of the Council. Statutory and Other Committee: The order to carry out the objectives of the Act, the Central Government has framed Rules and the Council has framed Regulations and constituted various Committees to carry on the duties and functions of the Council. The Executive Committee functions as an Executive Authority of the Council. The Disciplinary Committee investigated the complaints and holds enquiries related to allegations of professional misconduct against architects. The Advisory Committee (Appeals) hears the appeals of the applications whose applications for registration are rejected. Apart from these several other Committees are constituted from time to time for particular/special purposes. The Council constituted a Sub-Committee to examine the reference received to scrutinize the proposals/applications received from new institutions for imparting Bachelor’s Degree in Architecture and Master’s Degree in Architecture. The details of the various activities and the actions taken by the Council from 01.04.2018 to 31.03.2019 are enumerated below: 1. MEETINGS: Council Meetings: During the year under report the Council had its two meetings i.e. 69th Meeting on 14th April, 2018 at New Delhi and 70th Meeting on 22nd November, 2018 at New Delhi. REGISTRATION OF ARCHITECTS: The Council registers a person, as an Architect under Section 25 of the Act, who resides or carries on the profession of Architecture in India and holds a recognized architectural qualification. The application for registration and fees an accepted online. During the year, the Council has registered 14202 qualified persons as Architects. With this as on 31st March, 2019, a total of 106694 Architects have been registered as architects. INTRODUCTION OF “ARCHITECTURE” AS AN ELECTIVE SUBJECT AT 10+2 LEVEL ALL OVER INDIA: The Council prepared the model syllabus for introduction of “Architecture:” course at 10+2 level with a view to enable the students in enhancing their technical skill and adaptability to Architecture course when they opt for pursing such course at the later stage. The same was submitted to MHRD, NCERT and CBSE for issuing appropriate directions in the matter to the concerned Education Boards. Further, progress in the matter is yet to be informed by these bodies to Council. 4. AMENDMENTS IN ELIGIBILITY CRITERIA FOR ADMISSION TO B.ARCH. COURSE: Consequent upon amendment of eligibility criteria in May 2017 for admission to B.Arch. Course, the Council as well as the MHRD, Govt. of India, received several representations from the Diploma for considering them eligible for admission to B.Arch. Course. Accordingly, the eligibility for admission to B.Arch. Course was further amended and notified in the gazette of India on 13.02.2019 under : “No candidate shall be admitted to the Architecture Course unless she/he has passed an examination at the end of 10+2 scheme of examination with at least 50% aggregate marks in Physics, Chemistry & Mathematics and also at least 50% marks in aggregate of 10+2 level examination or passed 10+3 Diploma with Mathematics as compulsory subject with atleast 50% marks in aggregate.” 5. COMPLAINTS FOR PROFESSIONAL MISCONDUCT AGAINST ARCHITECTS: Each and every Architect is required to observe and abide by the provisions of the Architects (Professional Conduct) Regulations, 1989. The Act provides for taking action against an architect who is found guilty of professional misconduct upon investigation and after providing opportunity of being heard to the Architect. During the year under the report, the Council has received 24 complaints against Architects. 6. DISCIPLINARY COMMITTEE: In terms of Council of Architecture Rules, 1973, the Disciplinary Committee is constituted by the Central Government, from time to time by gazette notification, to investigate the complaints received against Architects for alleged professional misconduct. The during year under report the Disciplinary Committee met thrice and investigated 12 Complaints against architects.20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] 7. COMMITTEE ON RECOGNITION OF FOREIGN QUALIFICATIONS: In terms of Section 15 of the Architects Act, 1972, the Central Government is empowered to recognize foreign architectural qualifications, upon consultation with the Council of Architecture, for the purposes of the Architects Act, 1972. The Council has constituted a Committee to consider the references received from the Central Government and make its report. During the year under report the Committee met thrice on 12th April, 2018, 1st and 2nd August, 2019 and 21st November, 2018 and considered the respective cases and made its report to Full Council. The Committee has also prepared a format for receiving applications from applicants possessing foreign qualifications. 8. SUPPLY OF INFORMATION UNDER RTI ACT, 2005: Shri Deepak Kumar, Administrative Officer, is Central Public Information Officer in the Council and Shri Raj Kumar Oberoi, Registrar, is Appellate Authority in the Council in terms of provisions of the RTI Act, 2005. During the period under report, the Council provided information to in respect of 71 RTI Applications and dealt with 1 First Appeal as per the RTI Act. 9. APPROVAL OF COUNCIL OF ARCHITECTURE MINIMUM STANDARDS OF ARCHITECTURAL EDUCATION REGULATIONS, 2017. In terms of the provisions of Section 21 of the Architects Act, 1972, the Council is vested with the power to prescribe minimum standards of architectural education for imparting recognized qualifications by architectural institutions. The Council earlier framed Regulations on Minimum Standards of Architecture Education with the approval of the Central Government in the year 1983. The Council after having wider consultations with all stakeholders framed Council of Architecture (Minimum Standards of Architectural Education) Regulations, 2017 to repeal the existing Regulations framed in the year 1983. These Regulations have been sent to Ministry of Human Resource Development, Govt. of India, for approval and the approval of the Ministry is still awaited. 10. APPROVAL OF NEW INSTITUTIONS IN THE ACADEMIC SESSION 2018-2019: During the year under the report 20 new institutions were granted approval to impart Bachelor of Architecture Courses and 7 existing institutions were granted approval for imparting PG courses. A total of 477 institutions imparted recognized architectural qualifications during the academic session 2018-2019 with the approval of Council. EXTENSION OF APPROVAL FOR THE ACADEMIC SESSION 2018-2019 ONWARDS: The Council granted extension of approval or otherwise for UG and PG Courses for the academic session 2018–2019 as under: i) Institutions granted extension of approval for B.Arch. Course: 412 ii) Institutions granted extension of approval for M.Arch. course: 65 iii) Institutions put on ‘No Admission’: 6 iv) Institution put on ‘withdrawal of approval’: 0 The Council also initiated the process of inspection for the academic session 2019-2020 which were due for inspections. 12. ISSUANCE OF ENROLMENT NUMBERS TO STUDENTS ADMITTED BY ARCHITECTURAL INSTITUTIONS IN B.ARCH. COURSE: The Council is issuing enrolment numbers to students admitted by the Institutions to ensure that only eligible students are admitted as per the sanction intake of the Council. The Council is issuing enrolment numbers online based on information furnished by the institutions. Year wise details of enrolment numbers issued by the Council for students of B.Arch. National Awards for Excellence in Architectural Thesis (cid:1) Undergraduate: The Council of Architecture through Training & Research Centre conducted the 13th National Awards for Excellence in Architectural Thesis Program for undergraduate thesis projects to encourage the young talent. Students' Awards for Excellence in Documentation of Architectural Heritage : The Council conducted the 1st Students' Awards for “Excellence in Documentation of Architectural Heritage” for the undergraduate documentation projects with an objective to encourage interest and talent of students for understanding, documentation of heritage buildings and to develop & promote sensitivity and awareness towards India's architectural heritage amongst students of architecture across the country. Training Programme on ECBC In terms of MOU signed between the Council and BEE, the Council organized 6 training programme (from 01.04.2018 to 31.03.2019) on ECBC for students, faculty members and practicing architects. 16. SIGNING OF MEMORANDUM OF UNDERSTANDING WITH GRIHA COUNCIL: The Council of Architecture and GRIHA Council entered into a Memorandum of Understanding (MOU) 11.02.2019, to work together to create awareness about Sustainable Development through programme & events across India and to develop the pool of evaluators and certified professionals for construction of green and efficient buildings with optimum use of resources.[भाग III—ख(cid:2) ड 4] भारत का राजप(cid:12) : असाधारण 27 17. SIGNING OF MEMORANDUM OF UNDERSTANDING WITH MANIT, BHOPAL: The Council has signed an MOU with MNIT Bhopal with an object to carry out joint academic activities such as short course, seminars, workshops, or conferences based on mutual interests and available expertise in both the institutions. It is also agreed to organize Continuing Education Program (similar to TTPs but targeted towards practicing professionals in the field to focus on new theories and practices, legalities, technical updating, etc.) and promoting better appreciation of architectural design concerns through public events, etc. 18. SELECTION OF ARCHITECTS BY GOVT. DEPARTMENT/UNDERTAKINGS: The Council wrote to several public authorities to appoint architects as per Finance, Competition Guidelines and on payment of fees as prescribed by the Council. The President, COA, met Secretary, Department of Revenue, Ministry of Finance, Government of India, for considering adoption of the scale of charges prescribed by the Council by the Government and also amending the Government of India Manual on Procedure for appointment of Consultants. 19. ENFORCEMENT OF THE ARCHITECTS ACT, 1972: Sections 36 and 37 of the Architects Act, 1972 impose prohibition on misrepresentation as an Architect and use of title and style of Architects by any person other than a registered Architect. The violation of Act is a punishable offence. On receipt of the complaints of misuse of title and style of Architect, the Council filed complaint under Section 39 of the Act before the first class Magistrate for taking cognizance of the offences. The Council is pursuing such criminal complaints before the Metropolitan Magistrate in New Delhi, against persons who have violated the Architects Act, 1972. Presently about 2 complaints are pending before the MM, Saket Court. The Council will be filing an Appeal in Delhi High Court against dismissal of some complaints on the ground of jurisdiction. 20.
