## Policy Analysis Report: Land Acquisition for National Highway 91 Expansion in Uttar Pradesh **1. Executive Summary:** This report analyzes a notification from the Ministry of Road Transport and Highways, Government of India, concerning land acquisition for the building, widening/four/six laning, maintenance, management, and operation of National Highway 91 (NH91) in Uttar Pradesh. The notification declares the intention to acquire land between Km. 140.200 and Km. 165.600 of the Aligarh-Kanpur section in the Aligarh district. It outlines the process for landowners to object to the acquisition and provides a schedule of the land to be acquired. The key finding is the government's intention to expand and improve NH91 by acquiring specific land parcels. **2. Introduction:** The purpose of this report is to provide a detailed analysis of the Ministry of Road Transport and Highways' notification regarding the land acquisition process for NH91 in Uttar Pradesh, based solely on the information contained within the provided policy text. This report aims to inform potentially affected landowners and stakeholders about their rights and the procedures involved. **3. Policy Overview:** * **Core Objective(s):** Based on the text, the primary objective is to facilitate the building, widening/four/six laning, maintenance, management, and operation of NH91. This necessitates acquiring land within the specified stretch (Km. 140.200 to Km. 165.600). **4. Background and Rationale:** * **Likely Problem/Issue Addressed:** The notification suggests the existing highway infrastructure (NH91, Aligarh-Kanpur section) requires improvement. This could be due to increased traffic volume, the need for better connectivity, safety concerns, or general infrastructure upgrades. The explicit mention of "widening/four/six laning" suggests the current highway capacity is insufficient. **5. Key Provisions / Changes:** * **Main Components and Actions Mandated:** * **Declaration of Intent:** The Central Government declares its intention to acquire land for NH91 expansion. * **Land Identification:** Specific plots of land within the stretch of Km. 140.200 to Km. 165.600 in the Aligarh district are identified for acquisition (detailed in the schedule). * **Objection Process:** Individuals with an interest in the land have 21 days from the notification's publication date to object to the acquisition. * **Competent Authority:** The Special Land Acquisition Officer, Aligarh, is designated as the "Competent Authority" to receive and adjudicate objections. * **Hearing and Enquiry:** The Competent Authority must provide objectors an opportunity to be heard (in person or by a legal practitioner), conduct further enquiry if necessary, and then either allow or disallow the objections. * **Finality of Order:** The Competent Authority's order regarding objections is final. * **Land Plan Availability:** Land plans and other details are available for inspection at the Competent Authority's office. * **Land Survey Numbers and Area:** specifies the land survey numbers, and their areas in hectare. **6. Target Audience and Stakeholders:** The primary target audience is landowners and individuals with interests in the land identified in the schedule for acquisition within the specified stretch of NH91 in the Aligarh district of Uttar Pradesh. Other stakeholders include: * Residents of Akarabad and Nanau Villages. * The Ministry of Road Transport and Highways. * The Special Land Acquisition Officer, Aligarh. * Construction companies involved in the highway project. * General public using NH91. **7. Implementation Aspects (Inferred):** * **Responsible Agency/Bodies:** The Ministry of Road Transport and Highways is ultimately responsible for the project. The Special Land Acquisition Officer, Aligarh, is responsible for the land acquisition process, including handling objections. * **Timelines/Procedures:** Landowners have 21 days from the date of the notification's publication to file objections. The Competent Authority must then conduct hearings and make a decision. No other specific timelines are provided. The notification refers to the National Highways Act, 1956, which likely outlines further procedural details. **8. Expected Outcomes / Impact of Changes:** The intended outcome is the successful acquisition of land required for the building, widening/four/six laning, maintenance, management, and operation of NH91. This will likely lead to: * Improved highway infrastructure. * Increased traffic capacity. * Potentially reduced travel times. * Potential economic benefits related to improved transportation. * Displacement and resettlement for some landowners. **9. Conclusion:** The Ministry of Road Transport and Highways' notification signals a significant infrastructure project involving the expansion of NH91 in Uttar Pradesh. The notification initiates the land acquisition process, offering landowners an opportunity to voice their concerns. Successful implementation of this policy is expected to improve transportation infrastructure and contribute to regional connectivity, but it will also require careful management of the land acquisition process to minimize disruption and ensure fair compensation for affected parties.
