और सवं र्नध णवभाग) अणर्सचू ना नई दिल् ली, 13 अक् िूबर, 2017 सा.का.णन. 1271(अ).—अमोणनयम नाइट्रेट णनयम, 2012 का संशोर्न करने के णलए णनम्नणलणिि प्रारूप णनयम णिसे केन्‍द रीय सरकार, णवस्फ ोटक अणर्णनयम, 1884 (1884 का 4) की र्ारा 5 और र्ारा 7 द्वारा प्रित्त शणियों का प्रयोग करिे हुए बनाने का प्रस् िाव करिी है, णिसे ऐसे सभी व्यणियों की िानकारी के णलए, णिनके उससे प्रभाणवि होने की संभावना है, उक् ि अणर्णनयम की र्ारा 18 की उपर्ारा (1) की अपेक्षानुसार, प्रकाणशि दकया िािा है और इसके द्वारा यह सूचना िी िािी है दक उक् ि प्रारूप णनयम उस िारीि से णिसको, रािपत्र में अंिर्वधष्ट इस अणर्सूचना की प्रणियााँ िनिा को उपलब् र् करा िी िािी ह,ैं पैंिालीस दिन की अवणर् के अवमान के पश् चाि णवचार दकया िाएगा इन प्रारूप णनयमों म,ें ऐसे आक्षेपों या सुझावों पर, यदि कोई हो िो, अणिररि सणचव, औद्योणगक नीणि और संवर्धन णवभाग, वाणिज्य और उद्योग मंत्रालय, कमरा नं. 259, उद्योग भवन, नई दिल् ली- 110107 ईमेलः singh.shailen@nic.in को भेिे िा सकेंगे दकसी व् यणि से प्रा्‍ि ऐसे आक्षेपों या सुझावों पर, िो उक् ि प्रारूप णनयमों के संबंर् में दकसी व् यणि से इस प्रकार णवणन्ि्‍ध ट उि अवणर् के भीिर प्रा्‍ि होिा ह,ै केन्‍द रीय सरकार द्वारा णवचार दकया िाएगा प्रारूप णनयम 1. संणक्ष्‍ि नाम और प्रारंभ (1) इन णनयमों का संणक्ष्‍ि नाम अमोणनयम नाइट्रेट (संशोर्न) णनयम, 2017 ह ै (2) ये रािपत्र में इनके प्रकाशन की िारीि को प्रवृत् ि होंगे 2. अमोणनयम नाइट्रेट णनयम, 2012 में (णिसे इसमे इसके पश्चाि मूल णनयम कहा गया ह)ै णनयम 2 में,- (अ) िण् ड (र्) के स्थान पर णनम्नणलणिि िण् ड रिा िाएगा, अथाधिः- 6232 GI/2017 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] ‘(र्) "नौभाररक के अंिगधि कोई व् यणि या अणभकरि या फमध भी होगा िो पोि से अमोणनयम नाइट्रेट की चढ़ाई और उिराई, अनुज्ञ्‍ ि भण् डार ग हृ िक उसके पररवहन का कायध करिा ह ै” (आ) िण् ड (न) में ““नौभरि, पररवहन, भंडारि और उपयोग” शब्ि ों के स्थान पर "पररविधक और नौभाररक" शब् ि रिे िाएंगे 3. मूल णनयम के णनयम 5 में, परंिुक में, “परन्‍द िु सभी” णवद्यमान” शब्ि ों के पश् चाि “अमोणनयम नाइट्रेट के” शब् ि अंिःस्थाणपि दकए िाएंग े 4. मूल णनयम के, णनयम 6 में,- (अ) उप-णनयम 2 के िण् ड (क) का लोप दकया िाएगा (आ) उप-णनयम (4) के िण् ड ( ) के पश् चाि णनम्नणलणिि िण् ड अंिःस्थाणपि दकए िाएंग,े अथाधिः- “(ङ) आयािक द्वारा अमोणनयम नाइट्रेट का आयाि केवल स्वयं के वास् िणवक उपयोग के णलए दकया िाएगा और णवक्रय के णलए नहीं (च) अमोणनयम नाइट्रेट का णनयाधि उसके णवणनमाधिाओं द्वारा दकया िाएगा”; (इ) उप-णनयम 5 के िण् ड (ि) में “वाहक पोि” शब्िों के पश् चाि “या यान” शब्ि अंिःस्थाणपि दकए िाएंगे 5. मूल णनयम के, णनयम 8 में,- (अ) िण् ड (क) के स्थान पर णनम्नणलणिि िण् ड रिा िाएगा, अथाधिः- “(क) वह एक उणचि िलसह थैले में पैक दकया गया हो” (आ) िण् ड (ि) के स्थान पर णनम्नणलणिि िण् ड रिा िाएगा, अथाधिः- “(ि) णडब् बे पर णनयम 9 के अनुसार णचहनांकन दकया गया हो”;” (इ) िण् ड (ग) में “पैकेि” शब् ि के स्थान पर “थैले” शब् ि रिा िाएगा (ई) िण् ड ( ) में “पैकेि” शब् ि के स्थान पर “थैले” शब् ि रिा िाएगा 6. मूल णनयम के णनयम 9 में,- (अ) उप-णनयम (1) में,- (i) “या आर्ान” ‘शब्ि ों का लोप दकया िाएगा (ii) िण् ड (च) में, “पैकेि” शब् ि के स्थान पर “थैले” शब् ि रिा िाएगा (iii) िण् ड (ि) में “नौभरि अणभकिाध” शब्ि ों के स्थान पर “नौभरक” शब् ि रिा िाएगा (आ) उप-णनयम (2) मे “आरएफआईडी” शब्ि के स्थान पर “रेणडयो फ्रीक्वेंसी आइडेंरटदफकेशन णडवाइस” शब्ि रिे िाएंगे 7. मूल णनयम के, णनयम 12 में,- (अ) उप-णनयम (4) के स्थान पर णनम् नणलणिि उप-णनयम रिे िाएंगे, अथाधिः- “(4) अमोणनयम नाइट्रेट भि डारगृह से णनम् नणलणिि सुरक्षा िरूरयां रिी िाएगी अथाधिः- (क) 30 मीट्रीक टन से अनणर्क अमोणनयम नाइट्रेट के भण् डारि के णलए,- (i) 30 मीट्रीक टन से अनणर्क क्षमिा के भण् डारगृह से 4.5 मीटर (ii) अमोणनयम नाइट्रेट मल्े ट टैंक से 4.5 मीटर (iii) चारिीवारी से 4.5 मीटर और (iv) दकसी भी संरणक्षि कायध से 45 मीटर (ि) 30 मीट्रीक टन से अणर्क अमोणनयम नाइट्रेट के भण् डारि के णलए,- (i) अन्‍द य भण् डारगृह से 9 मीटर (ii) अमोणनयम नाइट्रेट मल्े ट टैंक से 9 मीटर (iii) चारिीवारी से 9 मीटर औरII 3(i) 3 (iv) दकसी भी संरणक्षि कायध से 90 मीटर (4अ) भण् डारगृह या अमोणनयम नाइट्रेट मेल् ट टैंक, अमोणनयम नाइट्रेट के णवणनमािध या संपररविधन के पेटीबंिकरि एकक या णवस्फ ोटक णवणनमाधि संयंत्र या नाइट्रस ्क् साइड णवणनमाधि संयंत्र के णनकटविह हो सकिा है, लेदकन उप-णनयम (4) के सभी उपबंर्ों का पालन दकया िाएगा (4आ) सुरक्षा िरू ी की नाप यथाणस्थणि अमोणनयम नाइट्रेट मेल् ट टैंक या भण् डारगृह के दकनारे से ली िाएगी ” (आ) उप-णनयम (8) के, िण् ड (iii) में, “िरू ी रिी िाएगी” शब् िों के पश् चाि “और िो ऐसे अमोणनयम नाइट्रेट मेल् ट टैंक के बीच न्‍द यूनिम एक मीटर की िरू ी बनाई रिी िाएगी” शब्ि अंिःस्थाणपि दकए िाएंगे 8. मूल णनयम के णनयम 14 में, उप-णनयम (1) के स्थान पर णनम् नणलणिि उप-णनयम रिा िाएगा, अथािध ः- “(1) अमोणनयम नाइट्रेट के णवणनमाधि, संपररविधन, नौभरि, णवक्रय या उपयोग हिे ु कब्िा, पररवहन, आयाि या णनयाधि हिे ु, इन णनयमों के अंिगधि िारी अनुज्ञणि के प्रत् येक र्ारक द्वारा अनुसूची 2 के भाग 3 में णवणन्ि्‍ध ट प्रपत्रों में ररकाडध रिा िाएगा िादक अमोणनयम नाइट्रेट की िवाबिहे ी, पहचान और पिा लगाना सुणनणश्चि दकया िा सकें और णनयम 50 में णवणन्ि्‍ध ट प्राणर्कारी द्वारा मांगे िाने पर ऐसे ररकाडध प्रस् िुि दकए िाए (1क) अनुज्ञणि र्ारक अमोणनयम नाइट्रेट के णवणनमाधि, संपररविधन, नौभरि, पेटीबंिकरि, णवक्रय या उपयोग हिे ु कब्िा, भंडारि, पररवहन, आयाि या णनयाधि के संबंर् में णवणशणष्टया,ाँ पेट्रोणलयम िथा णवस्फोटक सुरक्षा संगठन (पेसो) की आणर्काररक वेबसाइट में उपलब्र् ्नलाइन प्रिाली में, प्रणिदिन के आर्ार पर प्रणवणष्ट करेगा ” 9. मूल णनयम में, “अध्य ाय 3” के शीर्धक के स्थान पर, णनम् नणलणिि शीर्धक को रिा िाएगा, अथाधिः- (क) “सुरक्षा और संरक्षा प्रबंर्न योिना के णलए उपबंर्” 10. मूल णनयम में, णनयम 15 के, उप-णनयम (1) के स्थान पर णनम् नणलणिि उप-णनयम को रिा िाएगा, अथाधिः-- “(1) अमोणनयम नाइट्रेट के णवणनमाधि, संपररविधन या नौभरि के णलए इच् छुक व् यणि अनुज्ञापन प्राणर्कारी और णिला प्राणर्कारी को, यथाणस्थणि, पुणलस अर्ीक्षक या पुणलस उप-अर्ीक्षक द्वारा सम् यक रूप से प्रस्ठांदकि संरक्षा पहलुओं के साथ सुरक्षा और संरक्षा प्रबंर्न योिना प्रस् िुि करेगा ” 11. मूल णनयम के णनयम 18 में,- (अ) उप-णनयम (2) में, “नौभरि अणभकिाध” शब्ि ों के स्थान पर “नौभाररक” शब् ि रिा िाएगा (आ) उप-णनयम (3) में, “नौभाररक अणभकिाध” शब्ि ों के स्थान पर “नौभाररक” शब्ि रिा िाएगा (इ) उप-णनयम (4) म,ें “अनुज्ञापन प्राणर्कारी और” शब्ि ों का लोप दकया िाएगा (ई) उप-णनयम (5) के िंड (ि) में “प्ररूप गड-1” शब्ि , अक्षर और अंक के स्थान पर “प्ररूप ग-1” शब्ि , अक्षर और अंक रिे िाएंगे (उ) उप-णनयम (6) के पश् चाि, णनम् नणलणिि उपणनयम अिं ःस्थाणपि दकया िाएगा, अथाधि:- “(7) अमोणनयम नाइट्रेट का आयाि केवल स् वयं के वास् िणवक उपयोग के प्रयोिन के णलए दकया िाएगा और व् यापार प्रयोिन के णलए नहीं ” 12. मूल णनयम में, णनयम 19 के, उप-णनयम (3) के पश् चाि, णनम् नणलणिि उप-णनयम अंिःस्थाणपि दकया िाएगा, अथाधि:- “(4) णनयाधिक, प्रत्येक पारेर्ि के णनयाधि पर, िैसे ही भारिीय समूरी पत् िन या सीमा से उसके प्रेर्ि करिे ही, मुख्य णनयंत्रक को लिान के णबल की प्रणि और प्ररूप ि-12 में णववरिी प्रस्िुि करेगा ” 13. मूल णनयम में, णनयम 21 के, उप-णनयम (6) में “भण् डार गृह” शब्ि के पश् चाि “या अमोणनयम नाइट्रेट मेल् ट टैंक” शब्ि अंिःस्थाणपि दकए िाएंगे 14. मूल णनयम में, णनयम 22 के, उप-णनयम (8) के पश् चाि, णनम् नणलणिि उप-णनयम अंिःस्थाणपि दकया िाएगा, अथाधिः-4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] “(9) अमोणनयम नाइट्रेट के पररवहन में लगे यानों में ग्लोबल पोणिश्नंग णसस्टम की सुणवर्ा उपलब्र् कराए िाएगी और प्ररूप ि-4 में पररवहन अनुज्ञणि र्ारक द्वारा मॉणनटररंग की िाएगी ” 15. मूल णनयम के, णनयम 26 में, “दकसी भण् डार गृह में और उससे” शब्ि ों के स्थान पर “दकसी भण् डार गृह या अमोणनयम नाइट्रेट मेल् ट टैंक से“ शब्ि रिे िाएंगे 16. मूल णनयम में, णनयम 27 के, उप-णनयम (2) के िण् ड (ग), के पश् चाि णनम् नणलणिि िण् ड अंिःस्थाणपि दकया िाएगा, अथाधिः- “( ) अमोणनयम नाइट्रेट का कब् िा और उपयोग के णलए अनुज्ञणि र्ारक द्वारा अनुसूची II के भाग 3 के प्ररूप ि -13 में पास िारी की िाएगी ” 17. मूल णनयम में, अध्य ाय 7 के शीर्धक में, “अंिरि” शब्ि का लोप दकया िाएगा 18. मूल णनयम में, णनयम 29 के उप-णनयम (1) में, - (अ) िण् ड (ि) में, “भण् डार गृह से” शब्ि ों के स्थान पर “अमोणनयम नाइट्रेट के” शब्ि रिे िाएंग े (आ) िण् ड (ग) में, “भण् डार गृह” शब्ि ों के पश्चाि, “या टैंक में णप ला अमोणनयम नाइट्रेट” शब्ि अंिःस्थाणपि दकए िाएंगे (इ) िण् ड ( ) में “भण् डार गृह” शब्ि ों के पश् चाि “या टैंक में णप ला अमोणनयम नाइट्रेट” शब्ि अंिःस्थाणपि दकए िाएंगे 19. मूल णनयम के, णनयम 30 में,- (अ) उप-णनयम (1) के स्थान पर, णनम् नणलणिि उप-णनयम रिा िाएगा, अथाधिः- “(1) अमोणनयम नाइट्रेट के णवणनमाधि, संपररविधन, नौभरि, पेटीबंिकरि, णबक्री हिे ु भण् डारि के णलए कब्िा या अमोणनयम नाइट्रेट के उपयोग हिे ु कब् िा, इन णनयमों के अर्ीन अनुज्ञणि प्रा्‍ि करने हिे ु दकसी व् यणि द्वारा णनयम 33 में उणल्लणिि िस् िावेि प्रस् िुि कर, ऐसी अनुज्ञणि िारी करने के णलए सशि सक्षम प्राणर्कारी से पूवाधनुमोिन प्रा्‍ि करना होगा ” (आ) उप-णनयम (2) म,ें “मणिस्ट्रेट” शब्ि के स्थान पर “प्राणर्कारी” शब्ि रिा िाएगा (इ) उप-णनयम (3) म,ें शब्ि और अंक “णनयम 33” के स्थान पर शब् ि और अंक “णनयम 34” रिा िाएगा 20. मूल णनयम के णनयम 31 में, शब्ि और अंक, “णनयम 32” के स्थान पर शब् ि और अंक, “णनयम 33” रिा िाएगा 21. मूल णनयम में, णनयम 33 के, उप-णनयम (2) के िंड ( ) में, “चाटधररि अणभयंिा” शब्ि ों के स्थान पर “आवेिक” शब्ि रिा िाएगा 22. मूल णनयम के णनयम 34 में,- (अ) उप-णनयम (2) के िण् ड (ि) मे “िान सुरक्षा महाणनिशे क” शब्ि ों के पश् चाि “या िान सुरक्षा उप महाणनिशे क या िान सुरक्षा णनिशे क” शब्ि अंिःस्थाणपि दकए िाएंगे (आ) उप-णनयम (3) के स्थान पर णनम् नणलणिि उप-णनयम रिा िाएगा, अथाधि:- “(3) णिला प्राणर्कारी या िानसुरक्षा महाणनिशे क या िानसुरक्षा उप-महाणनिशे क या िानसुरक्षा णनिशे क द्वारा णवणनमाधि या संपररविधन या भण् डारगृह या टैंक में णप ले अमोणनयम नाइट्रेट के प्रयोिन, के णलए िारी दकए गए अनापणत्त प्रमाि पत्र या णवस्फ ोटक णनयम,2008 के अर्ीन िारी अना पणत्त प्रमाि-पत्र के िायरे में यदि वह स् थान शाणमल ह ै िह ये कायध पहले से णवद्ययमान ह ैिो उसके णलए नए णसरे से अनापण् ा प्रमाि-पत्र अपेणक्षि नही होगा ” 23. मूल णनयम में, णनयम 35 के, उप-णनयम (3) में, “अनुज्ञापन प्राणर्कारी” शब् िों के स्थान पर “णनयंत्रक या णिला प्राणर्कारी” शब् ि रिे िाएंग े 24. मूल णनयम के, णनयम 36 में,- (अ) उप-णनयम (4) के स्थान पर णनम् नणलणिि उप-णनयम रिा िाएगा, अथाधिः-II 3(i) 5 “(4) अनूज्ञणि के नवीकरि के णलए प्रत् येक आवेिन, अनुज्ञणि फीस के साथ ऐसे प्रस् िुि दकया िाएगा दक वह अनुज्ञापन प्राणर्कारी या अनुज्ञणि के नवीकरि के णलए अणर्कृि प्राणर्कारी के पास उस िारीि को या उससे पहले पहुच ं िाए, णिस िारीि को अनुज्ञणि की णवणर्मान्‍द यिा समा्‍ि होिी हःै परन्‍द िु यदि पूरे िस् िावेिों के साथ नवीकरि आवेिन अनुज्ञापन प्राणर्कारी द्वारा अनुज्ञणि की णवणर्मान्‍दय िा समा्‍ि होने के पश् चाि ंकंिु उसकी णवणर्मान्‍द यिा समा्‍ि होने के छह मास के भीिर प्रा्‍ि होिा ह;ै और यदि अनुज्ञापन प्राणर्कारी को यह समार्ान हो िािा ह ैदक णवलंब का कारि अनुज्ञणिर्ारी के णनयंत्रि से बाहर था, िो इस णनणमत्त दकए गए दकसी भी अन्‍दय कारधवाई के प्रणिकूल प्रभाव के णबना, एक वर्ध के अनुज्ञणि फीस के िुल्य णवलंब शुल्क के भुगिान करने पर नवीकरि दकया िा सकिा ह ै ” (आ) उप-णनयम (8) के पश् चाि णनम् नणलणिि उप-णनयम अिं ःस्थाणपि दकए िाएंगे, अथाधिः- “(9) ऐसी कोई भी अनुज्ञणि का नवीकरि नहीं दकया िाएगा यदि अनुज्ञापन या नवीकरि प्राणर्कारी द्वारा नवीकरि का आवेिन, अनुज्ञणि के णवणर्मान्‍द यिा समा्‍ि होने के छह मास के पश् चाि प्रा्‍ि दकया िािा ह ै (10) अनुज्ञणि के णवणर्मान्‍द यिा समा्‍ि होने के छह मास के पश् चाि यदि अनुज्ञणि नवीकरि हिे ु आवेिन प्रा्‍ि होिा ह ै िो उसे नई अनुज्ञणि िारी करने हिे ु आवेिन समझा िाएगा और ऐसे मामले में, नई अनुज्ञणि िारी करने हिे ु णिला प्राणर्कारी द्वारा िारी अनापणत्त प्रमाि-पत्र सणहि सभी आवश् यक िस् िावेि, अनुज्ञापन प्राणर्कारी को प्रस् िुि दकए िाएंगे ” 25. मूल णनयम में, णनयम 51 के उप-णनयम (3) में “की कोई बाि” शब्ि ों के स्थान पर उप-णनयम 2” शब् ि और अंक रिे िाएंगे और “नहीं” शब्ि का लोप दकया िाएगा 26. मूल णनयम के, णनयम 52 म,ें “िहॉ हाणन अमोणनयम नाइट्रेट के रोिमराध के उत् पािन, भण् डारि, पररवहन, या उपयोग के िौरान प्रिीकात् मक रूप से होने वाली हाणन की मात्रा से अणर्क हाणन होिी ह,ै” शब्ि ों का लोप दकया िाएगा 27. मूल णनयम की अनुसूची 1 के सारिी में क्रम संख्य ा 3 के सामने, स् िंभ 2 में,- (अ) मि (क) में “या प्रयोग” शब्ि ों का लोप दकया िाएगा (आ) मि (ि) के स्थान पर णनम् नणलणिि मि रिा िाएगा, अथाधिः- “(ि) दकसी भण् डार गृह या टैंक म ेंणप ल ेअमोणनयम नाइट्रेट स े30 मरैट्रक टन स ेअणर्क अमोणनयम नाइट्रेट के णवक्रय हिे ुकब्ि े में रिने के णलए अनुज्ञणि या”; (इ) मि (ग) के स्थान पर णनम्नणलणिि मि रिा िाएगा, अथाधिः- “(ग) दकसी णवस्फ ोटक णवणनमाधिा या नाइट्रस ्क् साइड णवणनमाधिा इकाई या औद्योणगक इकाई से संबिद्वर् भण् डार गृह या टैंक में णप ले अमोणनयम नाइट्रेट से उपयोग हिे ु आमोणनयम नाइट्रेट कब् िे में रिने के णलए अनुज्ञणि; या”; (ई) मि ( ) में “भण् डार गृह” शब् िों के पश् चाि “3 मैरट्रक टन से अनणर्क” अंक और शब् ि अंिःस्थाणपि दकए िाएंगे 28. मूल णनयम के अनुसूची 2 म,ें (अ) भाग-1 की, सारिी म,ें स् िंभ 2 में, प्ररूप क-3 के सामने,- (क) मि (क) में “या प्रयोग” शब्ि ों का लोप दकया िाएगा (ि) मि (ि) के स्थान पर णनम् नणलणिि मि रिा िाएगा, अथाधिः- “(ि) दकसी भण् डार गृह या टैंक में णप ले अमोणनयम नाइट्रेट से 30 मैरट्रक टन से अणर्क अमोणनयम नाइट्रेट के णवक्रय हिे ु कब् िे में रिने के णलए अनुज्ञणि; या”; (ग) मि (ग) के स्थान पर णनम् नणलणिि मि रिा िाएगा, अथाधिः-6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] “(ग) दकसी णवस्फ ोटक णवणनमाधिा या नाइट्रस ्क् साइड णवणनमाधिा इकाई या औद्योणगक इकाई से संबणन्‍दर्ि भण् डार गृह या टैंक में णप ले अमोणनयम नाइट्रेट से उपयोग हिे ु आमोणनयम नाइट्रेट कब् िे में रिने के णलए अनुज्ञणि; या”; ( ) मि ( ) में “भण् डार गृह से” शब्िों के पश् चाि “3 मैरट्रक टन से अनणर्क” अंक और शब् ि अंिःस्थाणपि दकए िाएंगे (आ) भाग-2 की, सारिी म,ें स् िंभ 2 में, प्ररूप ि-3 के सामने, - (क) मि (क) में “या प्रयोग” शब्ि ों का लोप दकया िाएगा (ि) मि (ि) के स्थान पर णनम् नणलणिि मि रिा िाएगा, अथाधिः- “(ि) दकसी भण् डार गृह से 30 मैरट्रक टन से अणर्क अमोणनयम नाइट्रेट के णवक्रय हिे ु कब् िे में रिने Email: singh.shailen@nic.in, within the period specified above; The objections or suggestions which may be received from any person with respect to the said draft rules within the period above so specified shall be taken into consideration by the Central Government. Draft Rules 1. Short title and commencement,- (1) These rules may be called the Ammonium Nitrate (Amendment) Rules, 2017. (2) They shall come into force on the date of their final publication in the Official Gazette. 2. In the Ammonium Nitrate Rules, 2012 (hereinafter referred to as the principal rules), in rule 2,- (A) for clause (s), the following clause shall be substituted, namely:- '(s) "stevedore" includes any person or agency or firm which undertakes loading and unloading of Ammonium Nitrate from the ship, its transport to the licensed store house;'; (B) in clause (t), for the words “stevedoring, transport, storage and usage”, the words “converter and stevedore” shall be substituted. 3. In the principal rules, in rule 5, in the proviso, after the words "importers and exporters", the words “of Ammonium Nitrate” shall be inserted. 4. In the principal rules, in rule 6,- (A) in sub-rule 2, clause (a) shall be omitted; (B) in sub-rule (4), after clause (d), the following clauses shall be inserted, namely:- “(e) The Ammonium Nitrate shall be imported by the importer only for his own bonafide use and not for sale. (f) The Ammonium Nitrate shall be exported by its manufacturers only.”; (C) in sub-rule (5), in clause (b), after the words “carriage vessel”, the words “or vehicle” shall be inserted. 5. In the principal rules, in rule 8,- (A) in clause (a), the words "or container or is suitably bagged by stevedore or converter” shall be omitted; (B) for clause (b), the following clause shall be substituted, namely:- " (b) the bag is marked in accordance with the provisions of rule 9;"; (C) in clause (c), for the word “packages”, the word “bags” shall be substituted; (D) in clause (d), for the word “packages”, the word “bags” shall be substituted. 6. In the principal rules, in rule 9,- (A) in sub-rule (1),- (I) the words “or container” shall be omitted;II 3(i) 21 (II) in clause (f), for the word "package", the word "bag" shall be substituted; (III) in clause (h), for the words “stevedoring agent”, the word “stevedore" shall be substituted; (B) in sub-rule (2), for the letters “RFID”, the words “Radio Frequency Identification Device” shall be substituted. 7. In the principal rules, in rule 12,- (A) for sub-rule (4), the following sub-rule shall be substituted, namely:- "(4) The Ammonium Nitrate storehouse shall maintain following safety distances, namely:- (a) for storage of Ammonium Nitrate not exceeding 30 MT,- (i) 4.5 meters from other store house of capacity not exceeding 30 MT; (ii) 4.5 meters from Ammonium Nitrate melt tank; (iii) 4.5 meters from compound wall; and (iv) 45 meters from any protected works; (b) for storage of Ammonium Nitrate exceeding 30 MT,- (i) 9 meters from other store house; (ii) 9 meters from Ammonium Nitrate melt tank; (iii) 9 meters from compound wall; and (iv) 90 meters from any protected works. (4A) The store house or Ammonium Nitrate melt tank may be adjacent to the bagging unit of the manufacturing or conversion of Ammonium Nitrate or xplosives manufacturing plant or nitrous oxide manufacturing plant, but shall observe all the provisions of sub-rule (4). (4B) The safety distance shall be measured from the edge of the store house or Ammonium Nitrate melt tank as the case may be. "; (B) in sub-rule (8), in clause (iii), after the words "protected works", the words “and the distance of minimum one metre shall be maintained between two such Ammonium Nitrate melt tanks” shall be inserted. 8. In the principal rules, in rule 14, for sub-rule (1), the following sub-rules shall be substituted, namely:- "(1) Every person holding a licence granted under these rules for manufacture, conversion, stevedore, possession for sale or use, transport, import or export of the Ammonium Nitrate shall maintain records in the forms specified in Part 3 of Schedule II to ensure accountability, identification and traceability of Ammonium Nitrate and shall produce such records on demand to an authority specified in rule 50. (1A) The licence holder shall enter the particulars on manufacture, conversion, stevedore, bagging, possession for sale or use, transport, import or export of Ammonium Nitrate in the online system made available in the official website of Petroleum and Explosives Safety Organisation on day to day basis.". 9. In the principal rules, in “CHAPTER III", for the heading, the following heading shall be substituted, namely:- “PROVISIONS FOR SAFETY AND SECURITY MANAGEMENT PLAN”. 10. In the principal rules, in rule 15, for sub-rule (1), the following sub-rule shall be substituted, namely:- "(1) A person intending to manufacture, convert or stevedore Ammonium Nitrate shall submit Safety and Security Management Plan to the licensing authority and to the District Authority with the security aspect duly endorsed by the Superintendent of Police or Deputy Superintendent of Police, as the case may be.". 11. In the principal rules, in rule 18,- (A) in sub-rule (2), for the words “stevedoring agent”, the word “stevedore” shall be substituted;22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (B) in sub-rule (3), for the words “stevedoring agent”, the word “stevedore” shall be substituted; (C) in sub-rule (4), the words “the Licensing Authority and”, shall be omitted; (D) in sub-rule (5), in clause (b), for the word, letters and figure “Form CE-1”, the word, letter and figure “Form C-1” shall be substituted; (E) after sub-rule (6), the following sub-rule shall be inserted, namely:- “(7) The Ammonium Nitrate shall be imported only for the purpose of own bonafide use and not for trading purpose.”. 12. In the principal rules, in rule 19, after sub-rule (3), the following sub-rule shall be inserted, namely:- “(4) The exporter shall submit copy of bill of lading and return in Form R-12 to the Chief Controller, on export of each consignment as soon as it is dispatched from Indian sea port or border.". 13. In the principal rules, in rule 21, in sub-rule (6), for the word "storehouse", the words “store house or Ammonium Nitrate melt tank” shall be substituted. 14. In the principal rules, in rule 22, after sub-rule (8), the following sub-rule shall be inserted, namely:- “(9) The vehicles engaged in transport of Ammonium Nitrate shall be fitted with Global Positioning System and monitored by the transport licence holder in Form P-4.”. 15. In the principal rules, in rule 26, for the words "in and from a storehouse", the words "from a store house or Ammonium Nitrate melt tank" shall be substituted. 16. In the principal rules, in rule 27, in sub-rule (2), after clause (c), the following clause shall be inserted, namely:- "(d) a person holding a licence for possession and use of Ammonium Nitrate shall issue pass in Form R-13 of Part 3 of Schedule II.". 17. In the principal rules, in CHAPTER VII, in the heading, the word “TRANSFER” shall be omitted. 18. In the principal rules, in rule 29, in sub-rule (1),- (A) in clause (b), for the words “from a store house”, the words “of Ammonium Nitrate” shall be substituted; (B) in clause (c), after the word "store house", the words “or Ammonium Nitrate melt in tank” shall be inserted; (C) in clause (d), after the word "store house", the words “or Ammonium Nitrate melt in tank” shall be inserted. 19. In the principal rules, in rule 30,- (A) for sub-rule (1), the following sub-rule shall be substituted, namely:- "(1) A person desiring to obtain a licence for manufacture, conversion, stevedore, bag, store for possession for sale or possession for use of Ammonium Nitrate, under these rules, shall obtain prior approval from the authority empowered to grant such licence, by submitting documents mentioned in rule 33."; (B) in sub-rule (2), for the word “Magistrate”, the word “Authority” shall be substituted; (C) in sub-rule (3), for the word and figures “rule 33”, the word and figures “rule 34”, shall be substituted.II 3(i) 23 20. In the principal rules, in rule 31, for the word and figures “rule 32”, the word and figures “rule 33” shall be substituted. 21. In the principal rules, in rule 33, in sub-rule (2), in clause (d), for the words “Chartered Engineer”, the words “the applicant” shall be substituted. 22. In the principal rules, in rule 34,- (A) in sub-rule 2, in clause (b), after the words "Mines Safety", the words "or Deputy Director General of Mines Safety or Director of Mines Safety" shall be inserted; (B) for sub-rule (3), the following sub-rule shall be substituted, namely:- "(3) Fresh No Objection Certificate is not required for manufacturer or converter or store house or Ammonium Nitrate melt in tank, which is already existing at the site covered under No Objection certificate issued for the purpose by the District Authority or Director General of Mines Safety or Deputy Director General of Mines Safety or Director of Mines Safety or No Objection Certificate issued under the Explosives Rules, 2008.". 23. In the principal rules, in rule 35, in sub-rule (3), for the words "licensing authority", the words "Controller or District Authority as the case may be" shall be substituted. 24. In the principal rules, in rule 36,- (A) for sub-rule (4), the following sub-rule shall be substituted, namely:- "(4) Every application for the renewal of a licence shall be made so as to reach the licensing authority or the authority empowered to renew the licence on or before the date on which the licence expires: Provided that if the renewal application together with complete documents is received by the licensing authority after the date of expiry of the licence but not later than six months from the date of its expiry; and if the licensing authority is satisfied that the reason for the delay was beyond the control of the licence holder, the licence may, without prejudice to any other action that may be taken in this behalf, be renewed on payment of the late fee equivalent to one year's licence fee."; (B) after sub-rule (8), the following sub-rules shall be inserted, namely:- "(9) No licence shall be renewed if the application for renewal is received by the licensing or renewing authority after six months of the date of its expiry. (10) An application for renewal received after six months of the expiry of the licence shall be considered as an application for a new licence and in such case, all the documents required for grant of new licence including No Objection Certificate issued by District Authority shall be submitted to the licensing authority for grant of new licence.". 25. In the principal rules, in rule 51, in sub-rule (3), for the words “this rule”, the words and figure “sub-rule (2)” shall be substituted. 26. In the principal rules, in rule 52, the words “where the loss exceeds the permitted limit of loss that typically occurs during routine productions, storage, transportation, or use of Ammonium Nitrate” shall be omitted. 27. In the principal rules, in SCHEDULE I, in the table, against serial no 3, in column 2,- (A) in item (a), the word "or use" shall be omitted; (B) for item (b), the following item shall be substituted, namely:- "(b) Licence to possess for sale of Ammonium Nitrate from a store house exceeding 30 MT or Ammonium Nitrate melt in tank; or”;24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (C) for item (c), the following item shall be substituted, namely:- "(c) Licence to possess for use of Ammonium Nitrate from a store house or Ammonium Nitrate melt in tank attached to explosives manufacturing or Nitrous Oxide manufacturing unit or industrial applications; or". (D) in item (d), after the word "storehouse", the words and figure "not exceeding 3 MT." shall be inserted. 28. In the principal rules, in SCHEDULE II, (A) in PART-1, in the table, against Form No A-3, in column 2,- (a) in item (a), the words "or use" shall be omitted; (b) for item (b), following item shall be substituted, namely:- "(b) Licence to possess for sale of Ammonium Nitrate from a store house exceeding 30 MT or Ammonium Nitrate melt in tank; or”; (c) for item (c), the following item shall be substituted, namely:- "(c) Licence to possess for use of Ammonium Nitrate from a store house or Ammonium Nitrate melt in tank attached to explosives manufacturing or Nitrous Oxide manufacturing unit or industrial applications; or"; (d) in item (d), after the word "storehouse", the words and figure "not exceeding 3 MT." shall be inserted; (B) in PART-2, in the table, against Form No P-3, in column 2,- (a) in item (a), the words "or use", shall be omitted; (b) for item (b), following item shall be substituted, namely:- "(b) Licence to possess for sale of Ammonium Nitrate from a store house exceeding 30 MT or Ammonium Nitrate melt in tank; or”; (c) for item (c), the following item shall be substituted, namely:- "(c) Licence to possess for use of Ammonium Nitrate from a store house or Ammonium Nitrate melt in tank attached to explosives manufacturing or Nitrous Oxide manufacturing unit or industrial applications; or".
