## Report on the Gas Cylinders Fourth Amendment Rules, 2021 **1. Executive Summary:** This report analyzes the Gas Cylinders Fourth Amendment Rules, 2021, based on the official notification published by the Ministry of Commerce and Industry, Department of Industrial Policy and Promotion. This amendment to the Gas Cylinders Rules, 2016, mandates the use of permanent and tamperproof QR code markings on high-pressure cylinders and cryogenic containers used for filling non-toxic, non-flammable gases and liquids. This is likely to improve tracking and safety. **2. Introduction:** This report provides an overview of the Gas Cylinders Fourth Amendment Rules, 2021, based solely on the provided government notification. The purpose is to inform affected industries about the key changes and their potential implications. **3. Policy Overview:** * This report pertains to an amendment of the Gas Cylinders Rules, 2016. * The core objective of this amendment, as inferred from the text, is to enhance the tracking and identification of gas cylinders and cryogenic containers, potentially improving safety and regulatory compliance within the industry handling non-toxic, non-flammable gases and liquids. **4. Background and Rationale:** The amendment likely aims to improve the existing gas cylinder regulatory framework. The specific reason for this amendment appears to be a need for more robust and readily accessible identification methods for high-pressure cylinders and cryogenic containers. The use of QR codes suggests a move towards digital tracking and inventory management, potentially addressing issues of counterfeit cylinders or difficulty in tracing cylinder origins and contents. The focus on non-toxic, non-flammable gases and liquids might reflect a specific concern or incident history related to those substances. **5. Key Provisions / Changes:** This is an amendment, so this section focuses on the changes introduced. * **Specific Part of Original Policy Changed:** Rule 6 of the Gas Cylinders Rules, 2016. Specifically, a new sub-rule (c) is inserted after sub-rule (2b). * **New Rule/Provision:** "All the high pressure cylinders and Cryogenic containers used for filling NonToxic, NonFlammable Gases and Liquids shall have permanent and tamperproof marking in form of QR code at conspicuous place on cylinders." * **Difference/Effect of the Change:** The amendment introduces a mandatory requirement for QR code markings on specific types of gas cylinders and cryogenic containers. This represents a shift from potentially less standardized or less easily accessible identification methods to a digital, readily scannable system. This is expected to result in readily accessible traceability of gas cylinders. **6. Target Audience and Stakeholders:** Based on the provided text, the primary target audience includes: * Manufacturers of high-pressure cylinders and cryogenic containers. * Businesses involved in filling high-pressure cylinders and cryogenic containers with non-toxic, non-flammable gases and liquids. * Businesses that use high-pressure cylinders and cryogenic containers with non-toxic, non-flammable gases and liquids. * Regulatory bodies overseeing the gas cylinder industry. **7. Implementation Aspects (Inferred):** * **Responsible Agency/Bodies:** The Department of Industrial Policy and Promotion (Ministry of Commerce and Industry) is responsible for this amendment. * **Timelines/Procedures:** The amendment comes into force on the date of its final publication in the Official Gazette. The notification states that objections or suggestions were to be received within 30 days of the notification's publication. This implies a final publication date will follow that period. * **Specific to Changes:** The amendment necessitates that affected businesses implement systems for applying permanent and tamperproof QR codes to their cylinders and containers. This will likely require investment in appropriate marking equipment and data management infrastructure. **8. Expected Outcomes / Impact of Changes:** The likely intended outcomes of this amendment are: * Improved traceability and accountability for high-pressure cylinders and cryogenic containers used for non-toxic, non-flammable gases and liquids. * Enhanced safety through better identification and tracking of cylinders. * More efficient regulatory oversight of the gas cylinder industry. * Reduced risk of counterfeit cylinders entering the market. **9. Conclusion:** The Gas Cylinders Fourth Amendment Rules, 2021, represent a significant update to the gas cylinder regulatory framework. The mandatory use of QR codes for specific types of gas cylinders and containers is expected to bring greater transparency, safety, and efficiency to the industry. Businesses must adapt to this new requirement by implementing QR code marking systems and ensuring compliance with the amended rules.
