प्रजतस्ट्पधा ाको प्रोत्साजित करन ेके जलए दििाजनििे सं. 15/1/2017-पारेषण.—जिद्युत अजधजनयम, 2003 में पारेषण में प्रजतस्ट्पधाा की पररकल्पना की गई ि ै और इसमें केंद्रीय जिद्युत जिजनयामक आयोग (सीईआरसी) के साथ-साथ राज्य जिद्युत जिजनयामक आयोग (एसईआरसी) द्वारा पारेषण लाइसेंस प्रिान करने का प्रािधान ि।ै 2. 12 फरिरी, 2005 को अजधसूजित राष्ट्रीय जिद्युत नीजत में अन्य बातों के साथ-साथ किा गया ि ै दक िि- "5.3.1 पारेषण प्रणाली को ििे के जलए एक मिबूत और एकीकृत जिद्युत प्रणाली जिकजसत करने के जलए पयााप्त और समय पर जनिेि तथा िक्ष और समजन्ित कारािाई की आिश्यकता ि।ै 5.3.2 उत्पािन में जनयोजित भारी िृजि और जिद्युत बािार के जिकास को ध्यान में रखते हुए, पारेषण क्षमता को पयााप्त रूप से बढाने की आिश्यकता ि।ै 5.3.10 पारेषण क्षेत्र में जनिी जनिेि को प्रोत्साजित करने के जलए जििेष तंत्र बनाए िाएंगे तादक 2012 तक मांग को पूरी तरि से पूरा करने के उद्देश्य को प्राप्त करने के जलए पयााप्त जनिेि दकया िा सके। 5.8.1 आिश्यक क्षेत्र के जिस्ट्तार के पररमाण को ध्यान में रखते हुए, जनिेि का एक बडा जिस्ट्सा भी जनिी क्षेत्र से लाने की आिश्यकता िोगी। अजधजनयम सािािजनक क्षेत्र और जनिी क्षेत्र िोनों के जलए उद्योग के सभी क्षेत्रों में जनिेि के जलए एक अनुकूल िातािरण का सृिन करता ि ै तथा जिजभन्न क्षेत्रों में प्रिेि की बाधा को िरू करता ि।ै अजधजनयम की धारा 63 में 4437 GI/2021 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC.1] जिजभन्न खंडों में प्रजतस्ट्पधी आधार पर आपूर्ताकतााओं की भागीिारी का प्रािधान ि ै िो जनिी क्षेत्र के जनिेि को और प्रोत्साजित करेगा। 3. 28 िनिरी, 2016 को अजधसूजित टैररफ नीजत में अन्य बातों के साथ-साथ किा गया ि ैदक – “5.3 केंद्र सरकार के स्ट्िाजमत्ि िाली या जनयंजत्रत कंपनी की सभी नई उत्प ािन और पारेषण पररयोिनाओं का टैररफ 6 िनिरी, 2006 को अजधसूजित टैररफ नीजत के अनुसार प्रजतस्ट्पधी बोली के आधार पर जनधााररत दकया िाना िारी रिगे ा, िब तक दक मामला-िर-मामला आधार पर केंद्र सरकार द्वारा अन्यथा जिजनर्िष्टा निीं दकया िाता ि।ै इसके अलािा, राज्य सरकार द्वारा एक सीमा से अजधक लागत िाली पररयोिनाओं के जलए प्रजतस्ट्पधी बोली प्रदिया के माध्यम से अंतर-राज्यीय पारेषण पररयोिनाओं का जिकास दकया िाएगा, जिसका जनणाय एसईआरसी द्वारा दकया िाएगा।’’ 4. राष्ट्रीय जिद्युत नीजत में उजल्लजखत ििे में पारेषण क्षमता के सुिारू और तीव्र जिकास को सुगम बनाने के जलए, केंद्र सरकार द्वारा छूट प्राप्त पररयोिनाओं के अलािा, अंतरराज्यीय/ अंतर-राज्यीय पारेषण पररयोिनाओं को टैररफ आधाररत प्रजतस्ट्पधी बोली के माध्यम से कायााजन्ित दकया िाएगा। 5. इन दििाजनििे ों की समय-समय पर सभी पारेषण पररयोिनाओं को िक्ष और दकफायती तरीके से जिकजसत करने के मुख् य उद्देश्य के साथ समीक्षा की िाएगी। पररप्रक्ष्े य, अल्पािजध और नटे िका योिनाएं 6. केंद्रीय पारेषण यूरटजलटी (सीटीयू) को जिद्युत अजधजनयम 2003 की धारा 38(2)(ख) के अनुसार अंतरराज्यीय पारेषण प्रणाली से संबंजधत योिना और समन्िय के सभी कायों का जनिािन करना िोता ि।ै अजधजनयम की धारा 38 (2) (ग) के अनुसार, सीटीयू को उत्पािन स्ट्टेिनों से लोड केंद्रों तक जिद्युत के सुिारू प्रिाि के जलए अंतरराज्यीय पारेषण लाइनों की एक िक्ष, समजन्ित और दकफायती प्रणाली का जिकास सुजनजित करना ि।ै 7. अजधजनयम की धारा 73 (क) के अनुसार, केंद्रीय जिद्युत प्राजधकरण (सीईए) को "राष्ट्रीय जिद्युत नीजत से संबंजधत मामलों पर केंद्र सरकार को सलाि िने ा िै, जिद्युत व्यिस्ट्था के जिकास के जलए अल्पकाजलक और पररप्रेक्ष्य योिना तैयार करना ि ै और राष्ट्रीय अथाव्यिस्ट्था के जितों को पूरा करने और सभी उपभोक्ताओं के जलए जिश्वसनीय और सस्ट्ती जिद्युत प्रिान करने के जलए संसाधनों के अनुकूलन उपयोग के जलए योिना एिेंजसयों की गजतजिजधयों का समन्िय करना ि।ै 8. जिद्युत अजधजनयम की धारा 3 की उपधारा 4 के अनुसार, केजिप्रा को राष्ट्रीय जिद्युत नीजत के अनुसार राष्ट्रीय जिद्युत योिना तैयार करनी िोती ि।ै 9. राष्ट्रीय जिद्युत नीजत के पैरा 3.2 में प्रािधान िै " केजिप्रा अल्पकाजलक और पररप्रेक्ष्य योिना तैयार करेगा"। 10. राष्ट्रीय जिद्युत नीजत के अनुसार "केंद्रीय पारेषण यूरटजलटी (सीटीयू) और स्ट्टेट पारेषण यूरटजलटी (एसटीयू) के पास अजधजनयम में िी की गई सभी संबंजधत एिेंजसयों के समन्िय में राष्ट्रीय जिद्युत योिना के आधार पर नेटिका योिना और जिकास की प्रमुख जिम्मेिारी ि।ै " जिद्युत अजधजनयम की धारा 38(2) में अन्य बातों के साथ, जनम्नजलजखत करती करती ि:ै "केंद्रीय पारेषण यूरटजलटी के काया जनम्नानुसार िोंगे - क. अंतर-राज्यीय पारेषण प्रणाली के माध्यम से जिद्युत का पारेषण करना; ख. अंतर-राज्यीय पारेषण प्रणाली से संबंजधत योिना और समन्िय के सभी कायों का जनिािन करने के जलए - (i) राज्य पारेषण यूरटजलरटयां; (ii) केंद्र सरकार; (iii) राज्य सरकारें; (iv) उत्पािन कंपजनयां; (v) क्षेत्रीय जिद्युत सजमजतयां; (vi) प्राजधकरण; (vii) लाइसेंसी;[भाग I—खण् ड 1] भारत का रािपत्र : असाधारण 3 (viii) इस संबंध में केंद्र सरकार द्वारा अजधसूजित कोई अन्य व्यजक्त" जिद्युत अजधजनयम और राष्ट्रीय जिद्युत नीजत के उपरोक्त प्रािधानों के अनुसार नेटिका योिना तैयार की िाएगी। 11. उपरोक्त को ध्यान में रखते हुए जनम्नजलजखत योिनाएँ तैयार की िाएँगी: • केजिप्रा द्वारा पन्द्रि िषा की अिजध के जलए पररप्रेक्ष्य योिना तैयार की िाएगी। • केजिप्रा द्वारा पांि साल की अिजध के जलए अल्पािजध योिना तैयार की िाएगी। ये िोनों योिनाएं राष्ट्रीय जिद्युत योिना का भाग ि।ैं • राष्ट्रीय जिद्युत योिना के आधार पर सीटीयू द्वारा नेटिका योिना तैयार की िाएगी। नेटिका योिना, अल्प अिजध योिना और पररप्रेक्ष् य योिना को संबंजधत संगननों की िेबसाइटों पर िोस्ट्ट दकया िाएगा, जिन्ि ेंइन योिनाओं को तैयार करने का काया सौंपा गया ि।ै 12. नेटिका योिना की समीक्षा की िाएगी और आिश्यकता पडने पर अद्यतन दकया िाएगा लेदकन िषा में एक बार से अजधक निीं। नेटिका योिना में नई लाइनों और सबस्ट्टेिनों, मौिूिा लाइनों के सुिढृ ीकरण और उन्नयन और अंतरक्षेत्रीय पारेषण लाइनों के जलए पररयोिनाएं िाजमल िोंगी। नेटिका योिना स्ट्पष्ट रूप से पररयोिना के िायरे, िोल्टेि स्ट्तर, लाइन कॉजऩ्िगरेिन अथाात् एस/सी या डी/सी, कंडक्टर के कायाात्मक जिजनििे ों आदि, पारेषण लाइन की लंबाई और सबस्ट्टेिन के संभाजित स्ट्थान अथिा एििीडीसी पारेषण लाइनों का कनिटार स्ट्टेिन सजित जडिाइन जिजनििे ों िैसे व्यापक मानकों की स्ट्पष्ट रूप से पििान करेगी। पारेषण सबं ंधी सजमजतयां 13. जिद्युत मंत्रालय, भारत सरकार के कायाालय आििे संख्या 15/3/2017-रांस दिनांक 4 निंबर, 2019 और बाि में संिोजधत संख्या 15/3/2018-रांस-पीटी(5) दिनांक 20 मई 2021 के तित पारेषण पर एक राष्ट्रीय सजमजत का गनन दकया गया ि।ै सजमजत की संरिना इस प्रकार ि:ै 1. अध्यक्ष, केंद्रीय जिद्युत प्राजधकरण (केजिप्रा) अध्यक्ष 2. सिस्ट्य (पािर जसस्ट्टम), केजिप्रा सिस्ट्य 3. सिस्ट्य (आर्थाक और िाजणजज्यक), केजिप्रा सिस्ट्य 4. निीन एिं निीकरणीय ऊिाा मंत्रालय, भारत सरकार@ में पारेषण सिस्ट्य का काया िखे रि ेसंयुक्त सजिि स्ट्तर के अजधकारी। 5. सीएमडी, पोसोको सिस्ट्य 6. जनििे क (रांस), जिद्युत मंत्रालय, भारत सरकार सिस्ट्य 7. मुख्य प्रिालन अजधकारी, केंद्रीय पारेषण यूरटजलटी (पािरजिड) सिस्ट्य 8. सलािकार, नीजत आयोग# सिस्ट्य 9. जिद्युत क्षेत्र के िो जििेषज्ञ * सिस्ट्य 10. मुख्य अजभयंता (पािर जसस्ट्टम विंग से), केजिप्रा # सिस्ट्य सजिि @ सजिि (एमएनआरई) द्वारा नाजमत दकया िाएगा # नीजत आयोग/केजिप्रा द्वारा नाजमत दकया िाएगा * जिद्युत मंत्रालय, भारत सरकार द्वारा समय-समय पर उनके नामांकन की तारीख से अजधकतम िो िषा की अिजध के जलए पर नाजमत दकया िाना।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC.1] 14. इसके अलािा, जिद्युत मंत्रालय, भारत सरकार के कायाालय आििे संख्या 15/3/2017-रांस दिनांक 4 निंबर, 2019 के तित पांि (5) क्षेत्रीय जिद्युत सजमजतयों (पारेषण योिना) का भी गनन दकया गया ि।ै सजमजतयों की संरिना और संिभा की ितों (टीओआर) सजित आििे अनुलग्नक-1 में संलग्न ि।ै सजमजतयों की संरिना और संिभा की ितें उसी प्रकार से िोगी िैसा दक जिद्युत मंत्रालय, भारत सरकार द्वारा समय-समय पर अजधसूजित की िायेगी। पररयोिना जनमाणा 15. एक बार पररप्रेक्ष् य योिना, अल्पािजध योिना, नेटिका योिना तैयार िो िाने के बाि केंद्र सरकार द्वारा छूट प्राप्त पररयोिनाओं के अलािा अन्य पररयोिनाओं को प्रजतस्ट्पधी बोली के जलए इस योिना के तित किर दकया िाएगा। पारेषण क्षेत्र में जनिी जनिेि को आकर्षात करने के जलए, नई पररयोिनाओं और उनकी तकनीकी और अन्य जिजनििे ों के बारे में सभी िानकारी जितधारकों को उपलब्ध कराने में समथा िोना बहुत मित्िपूणा ि।ै इसके बाि इन पररयोिनाओं को पयााप्त जििरण के साथ जनमााण करने की आिश्यकता िोगी तादक प्रजतस्ट्पधी बोली लगाई िा सके। इन पररयोिनाओं के जलए पररयोिना प्रोफाइल (पीपी) सीईए के परामिा से सीटीयू द्वारा तैयार दकया िाएगा। बोली िस्ट्तािेिों में पररयोिना प्रोफाइल और सिेक्षण ररपोटा भी िाजमल िोगी। पररयोिना प्रोफाइल (पीपी) में लाइन के संबंध में सुसंगत डेटा अथाात िोल्टेि स्ट्तर, लाइन कॉजऩ्िगरेिन, अथाात् एस/सी या डी/सी, कंडक्टर आदि के कायाात्मक जिजनििे और सबस्ट्टेिन या कनिटार स्ट्टेिनों के कायाात्मक जिजनििे (एििीडीसी लाइन के मामले में) िोना िाजिए। इसके अजतररक्त, इन पररयोिनाओं के जलए सिेक्षण ररपोटा में मागा की अनुमाजनत लंबाई, इलाके के प्रकार, अजधकतम ऊंिाई , बफीले क्षेत्र , पिन क्षेत्र, िन/िन्यिीि उल्लंघन, लुप्तप्राय प्रिाजतयों के पयाािास का उल्लंघन, आसपास के नागररक और सेना ििाई अड्ड,े मागा में आने िाली प्रमुख निी/समुद्री िॉवसंग और कोयला/खजनि खनन क्षेत्रों और सबस्ट्टेिन या कनिटार स्ट्टेिनों के स्ट्थान सजित एक सुझाया गया मागा िोगा तैयार दकया िाएगा। सिेक्षण ररपोटा तैयार करने का काया राष्ट्रीय पारेषण सजमजत (एनसीटी) द्वारा सीटीयू और बीपीसी नाम की एिेंजसयों के बीि रोस्ट्टर बनाकर आिंरटत दकया िाएगा। दकसी भी पारेषण पररयोिना के जनष्पािन के तरीके के संबंध में िास्ट्तजिक जनणाय के बाि, संबंजधत सिेक्षण ररपोटा, खिा की प्रजतपूर्ता पर सिेक्षण के जलए एनसीटी द्वारा नाजमत एिेंसी से पारेषण पररयोिना की बोली लगाने िाली एिेंसी द्वारा प्राप्त की िाएगी। 16. बीपीसी उन्ि ें आिंरटत पररयोिनाओं के जलए सिेक्षण ररपोटा सजित पररयोिनाओं की प्रारंजभक गजतजिजधयों के जलए व्यय ििन करेगा। बीपीसी इस राजि को उस एिेंसी से िसूल करेगी िो अंततः पररयोिना का कायाान्ियन करती ि।ै जिकासकता ा का ियन 17. जिद्युत अजधजनयम, 2003 की धारा 63 के तित जिद्युत मंत्रालय द्वारा िारी दििा-जनििे ों के अनुसार अजभजनधााररत पररयोिनाओं के जलए जिकासकताा का ियन पारेषण सेिाओं के जलए ई-ररिसा बोली के माध्यम से टैररफ आधाररत प्रजतस्ट्पधी बोली द्वारा िोगा। पररयोिनाओं को जबल्ड, ओन, ऑपरेट और रांसफर मोड पर प्रिान दकया िाएगा। अंतर- राज्यीय पारेषण पररयोिनाओं के जलए, 35 िषों की अनुबंध अिजध की पररसमाजप्त के बाि, पररयोिना की संपजि के साथ सबस्ट्टेिन भूजम अजधकार, मागााजधकार और मंिूरी के साथ अजनिाया रूप से सीटीयू या उसके उिराजधकाररयों या केंद्र सरकार द्वारा पररयोिना के सीओडी से िून्य लागत पर और दकसी भी भार और िाजयत्ि से मुक्त िोने के 35 िषों के बाि तय की गई एिेंसी को िस्ट्तांतररत की िाएगी। िस्ट्तांतरण 35 िषा की अनुबंध अिजध की समाजप्त के 90 दिनों के भीतर पूरा दकया िाएगा, जिसमें जिफल रिने पर सीटीयू पररयोिना की संपजि को स्ट्ि च्े छा से लेने का िकिार िोगा। केजिप्रा और सीटीयू (िोनों योिना एिेंजसयां) पररयोिना के सीओडी के बिीसिें िषा (32िें) में उस समय के प्रौद्योजगक जिकल्पों और प्रणाजलयों के अध्ययन के आधार पर मौिूिा प्रणाली के उन्नयन या निीनीकरण और आधुजनकीकरण की आिश्यकता की िांि करेंगे। पररयोिना को पररयोिना के सीओडी से 35 िषों के बाि यदि आिश् यकता हुई तो निीनीकरण तथा आधुजनकीकरण और प्रिालन तथा रखरखाि के जलए प्रजतस्ट्पधी बोली प्रदिया के माध्यम से ियजनत उिराजधकारी बोलीिाता को दिया िा सकता ि।ै यदि सीटीयू द्वारा मौिूिा प्रणाली के उन्नयन या निीनीकरण और आधुजनकीकरण तथा पररसंपजियों के िस्ट्तांतरण की आिश्यकता की िांि करने के जलए कोई लागत खिा की िाती िै, तो उसे ियजनत उिराजधकारी बोलीिाता से िसूल दकया िाएगा। अंतरा-राज्यीय पारेषण पररयोिनाओं के जलए, पररयोिना की पररसंपजि के साथ सबस्ट्टेिन भूजम अजधकार, मागााजधकार और मंिूरी के साथ, पररयोिना की अनुबंध अिजध की समाजप्त के बाि राज्य सरकार द्वारा तय की गई एिेंसी को िून्य लागत पर और जबना दकसी ऋणभार और िाजयत्ि के अजनिाया रूप से िस्ट्तांतररत की िाएगी। राज्यान्त ररक अंतरा-राज्यीय पारेषण पररयोिनाओं के जलए अनुबंध की अिजध उपयुक्त आयोग के प्रासंजगक जनयमों के अनुसार एलटीटीसी या बीपीसी द्वारा जनधााररत 35 िषा या कोई भी अिजध िो सकती ि।ै एसटीयू (योिना एिेंसी िोने के नाते), िषा में िो पररयोिना की समाजप्त से तीन (3) िषा पिले िै, प्रौद्योजगक जिकल्पों और उस समय के अध् ययनों के आधार पर प्रणाली के उन्नयन या मौिूिा प्रणाली के निीनीकरण और आधुजनकीकरण की आिश्यकता की िांि करेगा। पररयोिना को पररयोिना की[भाग I—खण् ड 1] भारत का रािपत्र : असाधारण 5 अनुबंध अिजध के बाि यदि आिश् यकता हुई तो निीनीकरण तथा आधुजनकीकरण और प्रिालन तथा रखरखाि के जलए प्रजतस्ट्पधी बोली प्रदिया के माध्यम से ियजनत उिराजधकारी बोलीिाता को दिया िा सकता ि।ै यदि एसटीयू द्वारा मौिूिा प्रणाली के उन्नयन या निीनीकरण और आधुजनकीकरण और पररसंपजियों के िस्ट्तांतरण की आिश्यकता की िांि करने के जलए कोई लागत खिा की िाती िै, तो इसे उिराजधकारी ियजनत बोलीिाता से िसूल दकया िा सकता ि।ै पारेषण के जलए लाइससें 18. बोली मूल्यांकन सजमजत द्वारा ियन की जसफाररि के साथ, एसपीिी, ियजनत जिकासकताा द्वारा अजधिजित दकए िाने के बाि पारेषण लाइसेंस प्रिान करने और पारेषण प्रभारों को अपनाने के जलए उक्त एसपीिी के संपूणा इदिटी के अजधििण की तारीख से पांि (5) काया दििसों की अिजध के भीतर उपयुक्त आयोग से संपका करेगा। यदि यि जनधााररत समय सीमा के भीतर लाइसेंस के जलए आिेिन करने में जिफल रिता िै, तो यि इसके ियन को रद्द करने के जलए उिरिायी िोगा। ऊपरजलजखत अनुसार ियन को रद्द करने का काया सरकार द्वारा बी.पी.सी. की अनुिंसा पर दकया िाएगा। तथाजप, इसकी अनुिंसा करने से पिले, बीपीसी ियजनत बोलीिाता/टीएसपी को अपना िजृ ष्टकोण प्रस्ट्तुत करने का अिसर िगे ा। पररयोिना का जिकास, प्रिालन और रखरखाि और अतं रराज्यीय पारेषण प्रणाली के जलए पारेषण िल्ु क का भुगतान 19. अंतरराज्यीय पारेषण पररयोिनाओं िते ु पररयोिना के जिकास और प्रिालन के जलए नोडल एिेंसी और टीएसपी के बीि एक अलग पारेषण सेिा करार (टीएसए) पर िस्ट्ताक्षर दकए िाएंगे। इसके अलािा, टीएसपी समय-समय पर संिोजधत केंद्रीय जिद्युत जिजनयामक आयोग (अंतर-राज्यीय पारेषण प्रभारों और िाजनयों की जिस्ट्सेिारी) जिजनयमों के तित आिश्यक करार (करारों), यदि कोई िो, को भी जनष्पादित करेगा, िो आयोग से पारेषण लाइसेंस प्रिान करने की तारीख से पंद्रि (15) दिनों के भीतर िोगा। 20. यदि दकसी डीआईसी द्वारा पारेषण प्रभारों के भुगतान में कोई िूक िोती िै, तो उसे समय-समय पर यथा संिोजधत केंद्रीय जिद्युत जिजनयामक आयोग (अंतर-राज्यीय पारेषण प्रभारों और िाजनयों की जिस्ट्सेिारी) जिजनयमों के प्रािधानों के अनुसार जिजनयजमत दकया िाएगा। राज्य पारेषण पररयोिनाएं 21. ििां तक अंतर-राज्यीय पररयोिनाओं का संबंध िै, राज्य सरकारें इन दििाजनििे ों को अपना सकती ि ैं और राज्य के भीतर पारेषण पररयोिनाओं की सुजिधा के जलए समान सजमजतयों का गनन कर सकती ि।ैं राज्यों के पास सािािजनक जनिी भागीिारी (पीपीपी) मोड के तित अपने राज्यों में पारेषण प्रणाली के जिकास के जलए तत्कालीन योिना आयोग के व्यििायाता अंतराल जनधीयन (िीिीएफ) आधाररत मॉडल पारेषण एिीमेंट (एमटीए) िस्ट्तािेि का उपयोग करने का जिकल्प भी ि।ै 22. टीएसपी पररयोिना के जिकास, प्रिालन, रखरखाि और िस्ट्तांतरण के जलए लाभार्थायों के साथ एक पारेषण सेिा करार करना ि।ै सीटीयू को जिद्युत के जनबााध प्रिाि के जलए एक कुिल, समजन्ित और जमतव्ययी अंतर-राज्य पारेषण प्रणाली के जिकास को सुजनजित करने के जलए िर जतमािी में राष्ट्रीय सजमजत के समक्ष एक[भाग I—खण् ड 1] भारत का रािपत्र : असाधारण 7 व्यापक प्रस्ट्तुतीकरण भी िने ा िोगा। सीटीयू , इस प्रदिया में , पारेषण प्रणाली में बाधाओं और संकुलनता की पििान के जलए बािारों से िानकारी भी ले सकता िै iv. सीटीयू और क्षेत्रीय सजमजतयों की जसफाररिों पर जििार करने के बाि, एनसीटी जिजभन्न क्षेत्रों में मांग और उत्पािन में िृजि की प्रिृजि का आकलन करेगा; अंतर-राज्यीय, अंतर-क्षेत्रीय अंतरण प्रणाली में बाधाओं, यदि कोई िों, की पििान करेगा और आिश्यकताओं को पूरा करने के जलए पारेषण लाइनों, जिड स्ट्टेिनों और अन्य बुजनयािी ढांिे के जनमााण का प्रस्ट्ताि करेगा, जिनकी जनकट अिजध / मध्यम अिजध में उभरने की संभािना िै, तादक पारेषण िृजि को बाजधत न करे। एनसीटी 10 से 15 िषों के समय को ध्यान में रखते हुए पररप्रेक्ष्य योिना भी तैयार करेगा। 3. अपनी जसफाररिें प्रस्ट्तुत करते समय, एनसीटी टैररफ नीजत के दििाजनििे ों को ध्यान में रखेगी। 4. िूंदक एनसीटी राष्ट्रीय पारेषण प्रणाली अथाात् संपूणा क्षेत्रों और राज्यों में पारेषण को िखे ेगी, इसजलए क्षेत्रीय जिद्युत सजमजतयों (पारेषण आयोिना) (आरपीसीटीपी) की पूिा सिमजत प्रासंजगक निीं िोगी। क्षेत्र के भीतर पारेषण मुद्दों के जलए आरपीसीटीपी के जििार प्रासंजगक िोंगे; लेदकन पूरे क्षेत्र में पारेषण के मुद्दों के जलए, आरपीसीटीपी के जििार अपयााप्त िोंगे क्योंदक उनके पास राष्ट्रीय पररप्रेक्ष्य निीं िोगा। करना; और अंतर-क्षेत्रीय पारेषण प्रणाली को सुिढृ करने के जलए प्रस्ट्ताि तैयार करना। पारेषण आयोिना को उन क्षेत्रों को ध्यान में रखना आिश्यक िोगा ििां उत्पािन बढने की संभािना ि ै और उन क्षेत्रों में ििां लोड की मांग बढेगी तादक दकसी भी समय में पारेषण प्रणाली ििे के िर कोने में मांग को पूरा कर पाएगी और जिड के सुिारू संिालन को सुजनजित करने के जलए उत्पािन से पिले पारेषण प्रणाली जिकजसत करने की टैररफ नीजत के तित अजधििे का पालन करने के जलए सक्षम िो पाएगी। (ii) जनकट, मध्यम और िीघाािजध में पारेषण प्रणाली की आिश्यकताओं का आकलन करना और इन आिश्यकताओं को पूरा करने के जलए पारेषण योिनाएँ तैयार करना। ऐसा करते समय अगले 15-20 िषों के जलए एक पररप्रेक्ष्य योिना को भी ध्यान में रखा िा सकता ि ै और तिनुसार योिना प्रदिया के िौरान प्रणाली में अपेजक्षत भिा/मार्िान को िाजमल दकया िा सकता ि।ै (iii) कनेजक्टजिटी और एक्सेस के जलए आिेिनों की िांि करना और सुजनजित करना दक इन्ि ें िीघ्रता से प्रिान दकया िाता ि,ै बिते दक अपेजक्षत िुल्क/प्रभार का भुगतान दकया गया िो। (iv) पारेषण योिनाओं से िुडे अपस्ट्रीम और डाउनस्ट्रीम नेटिका की समीक्षा करना। (v) अंतरा-राज्यीय पारेषण प्रस्ट्तािों की िांि और मूल्यांकन करना। (vi) अंतर-क्षेत्रीय जिड सुिढृ ीकरण योिनाओं के जनमााण की समीक्षा और सुजिधा प्रिान करना । 3. आरपीसीटीपी यि New Delhi, the 10th August, 2021 Guidelines for Encouraging Competition in Development of Transmission Projects No. 15/1/2017-Trans.—The Electricity Act, 2003 envisages competition in transmission and has provisions for grant of transmission licenses by the Central Electricity Regulatory Commission (CERC) as well as State Electricity Regulatory Commissions (SERCs). 2. The National Electricity Policy notified on 12th February, 2005 interalia states that– “5.3.1 The Transmission System requires adequate and timely investments and also efficient and coordinated action to develop a robust and integrated power system for the country. 5.3.2 Keeping in view the massive increase planned in generation and also for development of power market, there is need for adequately augmenting transmission capacity. 5.3.10 Special mechanisms would be created to encourage private investment in transmission sector so that sufficient investments are made for achieving the objective of demand to be fully met by 2012. 5.8.1 Considering the magnitude of the expansion of the sector required, a sizeable part of the investments will also need to be brought in from the private sector. The Act creates a conducive environment for investments in all segments of the industry, both for public sector and private sector, by removing barrier to entry in different segments. Section 63 of the Act provides for participation of suppliers on competitive basis in different segments which will further encourage private sector investment.” 3. The Tariff Policy notified on 28th January, 2016 interalia states that – “5.3 The tariff of all new generation and transmission projects of company owned or controlled by the Central Government shall continue to be determined on the basis of competitive bidding as per the Tariff Policy notified on 6thJanuary, 2006 unless otherwise specified by the Central Government on case to case basis. Further, intra-state transmission projects shall be developed by State Government through competitive bidding process for projects costing above a threshold limit which shall be decided by the SERCs.” 4. In order to facilitate the smooth and rapid development of transmission capacity in the country as envisaged in the National Electricity Policy, inter State /intra State transmission projects, other than those exempted by the Central Government, shall be implemented through tariff based competitive bidding. 5. These guidelines will be reviewed from time to time with the ultimate aim of developing all transmission projects in an efficient and economical manner. PERSPECTIVE, SHORT TERM AND NETWORK PLANS 6. Central Transmission Utility (CTU) has to discharge all functions of planning and coordination relating to inter State transmission system according to section 38(2) (b) of the Electricity Act 2003. According to section 38(2) (c) of the Act, the CTU has to ensure the development of an e- fficient, coordinated and economical system of inter State transmission lines for smooth flow of electricity from generating stations to load centers. 7. According to Section 73(a) of the Act, the Central Electricity Authority (CEA) has to “advise the Central Government on the matters relating to the National Electricity Policy, formulate short-term and perspective plans for development of the electricity system and co-ordinate the activities of the planning agencies for the optimal utilization of resources to subserve the interests of the national economy and to provide reliable and affordable electricity for all consumers.”14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC.1] 8. According to Section 3 subsection 4 of the Electricity Act, the CEA has to prepare the National Electricity Plan in accordance with the National Electricity Policy. 9. Para 3.2 of the National Electricity Policy provides “the CEA shall prepare short term and perspective plan”. 10. According to the National Electricity Policy “the Central Transmission Utility (CTU) and State Transmission Utility (STU) have the key responsibility of network planning and development based on the National Electricity Plan in coordination with all concerned agencies as provided in the Act.” Section 38(2) of the Electricity Act, inter alia, provides the following: “The functions of the Central Transmission Utility shall be – a. To undertake transmission of electricity through inter-State transmission system; b. To discharge all functions of planning and co-ordination relating to inter-State transmission system with – (i) State Transmission Utilities; (ii) Central Government; (iii) State Governments; (iv) Generating companies; (v) Regional Power Committees; (vi) Authority; (vii) Licensees; (viii) Any other person notified by the Central Government in this behalf” The Network Plan will be prepared as per the above provisions of the Electricity Act and the National Electricity Policy. 11. In view of the above the following plans will be prepared:  Perspective Plan for fifteen years period will be prepared by CEA.  Short Term Plan for five years period will be prepared by CEA. Both these plans form part of the National Electricity Plan.  Network Plan will be prepared by the CTU based upon the National Electricity Plan. The Network Plan, Short Term Plan and the Perspective Plan will be hosted on the websites of the respective organizations, entrusted with the task of formulation of these plans. 12. The Network plan will be reviewed and updated as and when required but not later than once a year. The Network Plan would include the projects for new lines and substations, strengthening and up gradation of the existing lines and interregional transmission lines. The Network Plan will clearly identify the scope of the project, broad parameters such as design specifications including Voltage level, line configuration i.e S/C or D/C, functional specifications of conductor etc., length of transmission line and probable location of substation or converter station of HVDC transmission lines. COMMITTEES ON TRANSMISSION 13. A National Committee on Transmission has been constituted by Ministry of Power, Government of India vide office order no 15/3/2017-Trans dated 4th November, 2019 and subsequent amendment no. 15/3/2018-Trans-Pt(5) dated 20th May 2021. Further, five (5) number of Regional Power Committee (Transmission Planning) have also been constituted by the Ministry of Power, Government of India vide office order no 15/3/2017-Trans dated 4th November, 2019. The order containing therein the composition & Terms of Reference (ToR) of the committees is enclosed at Annex-1. The composition & Terms of Reference of the committees shall be as notified by Ministry of Power, Govt. of India from time to time. PROJECT FORMULATION 15. Once the Perspective plan, the Short Term Plan and the Network Plan have been prepared; projects other than those exempted by the Central Government, will be covered under this Scheme for competitive bidding. In order to attract private investment in the transmission sector, it is very important to be able to make available all the information to the stakeholders, regarding new projects and their technical and other specifications. These projects would then need to be formulated with adequate details to enable competitive bidding to take place. Project Profile (PP) for these projects shall be prepared by CTU in consultation with CEA. The Project Profile (PP) must contain relevant data regarding the line i.e. voltage level, line configuration i.e. S/C or D/C, functional specifications of conductor etc. and functional specifications of the substations or converter stations (in case of HVDC line). In addition, a survey report containing one suggested route with approximate route length, type of terrain, max. altitude, snow zones, Wind zones, forest / wildlife infringement, infringement of endangered species habitat, vicinity to civil and defence Airports, major river/sea crossings & coal/ mineral mine areas likely to be encountered and location of substations or converter stations shall be prepared for these projects. The task of preparing survey report shall be allocated by National Committee on Transmission (NCT) by maintaining a roster amongst agencies namely CTU & BPCs. After actual decision regarding the mode of execution of any transmission project, the relevant survey report shall be procured by the agency bidding out the transmission project from the agency nominated by NCT for survey upon reimbursement of the cost incurred. 16. BPC will incur the expenditure for the preparatory activities of the projects including survey report for the projects allocated to them. BPC will recover this amount from the agency that finally undertakes the implementation of the project.16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC.1] SELECTION OF DEVELOPER 17. The selection of developer for identified projects would be through tariff based competitive bidding through e-reverse bidding for transmission services according to the guidelines issued by the Ministry of Power under section 63 of the Electricity Act, 2003. The projects shall be awarded on Build, Own, Operate and Transfer mode. For inter-state transmission projects, after expiry of the contract period of 35 years the project assets along with substation land with rights, right of way and clearances shall compulsorily be transferred to CTU or its successors or an agency as decided by the Central Government after 35 years from COD of project at zero cost and free from any encumbrance and liability. The transfer shall be completed within 90 days of expiry of the contract period of 35 years failing which CTU shall be entitled to take over the project assets Suo moto. The CEA and the CTU (both being the planning agencies) in the thirty second year (32th) of COD of project will examine the need of upgradation of the system or renovation and modernization of the existing system depending on technological options and system studies at that time. The project may then be awarded to successor bidder selected through a competitive bidding process for renovation and modernization, if required, and operation and maintenance after 35 years from COD of project. In case, any cost is incurred by CTU towards examining the need of upgradation or renovation and modernization of the existing system and transfer of assets, the same shall be recovered from successor selected bidder. For intra-state transmission projects, the project assets along with substation land with rights, right of way and clearances shall compulsorily be transferred to an agency as decided by the State Government after expiry of contract period of project, at zero cost and free from any encumbrance and liability. The contract period for the intra state transmission projects may be 35 years or any period as fixed by the LTTCs or BPC as per the relevant regulations of the Appropriate Commission. The STU (being the planning agency), in the year which is three (3) years prior to the expiry of the project, will examine the need of upgradation of the system or renovation and modernization of the existing system depending on technological options and system studies at that time. The project may then be awarded to successor bidder selected through a competitive bidding process for renovation and modernization, if required, and operation and maintenance after contract period of project. In case, any cost is incurred by STU towards examining the need of upgradation or renovation and modernization of the existing system and transfer of assets, the same may be recovered from successor selected bidder. LICENSE FOR TRANSMISSION 18. Along with the recommendation of selection by the Bid Evaluation Committee, the SPV, after being acquired by the selected developer shall, approach the Appropriate Commission, within a period of five (5) working days from the date of the acquisition of entire equity of the said SPV, for grant of transmission license and adoption of transmission charges. If it fails to apply for license within this time limit, then it will be liable for cancellation of its selection. Cancellation of selection as provided above will be done by the Government on the recommendation of BPC. However, before recommending so, BPC will give an opportunity to the Selected Bidder / TSP to present their view point. DEVELOPMENT, OPERATION AND MAINTENANCEOF THE PROJECT AND PAYMENT OF TRANSMISSION CHARGES FOR INTER STATE TRANSMISSION SYSTEM 19. For inter State transmission projects, a separate Transmission Service Agreement (TSA) will be signed between the Nodal Agency and the TSP for the development and operation of the project. Further, TSP shall also execute agreement(s) required, if any, under Central Electricity Regulatory Commission (Sharing of Inter-State Transmission Charges and Losses) Regulations as amended from time to time within fifteen (15) days from the date of grant of Transmission License from the Commission. 20. In case there is any default in payment of transmission charges by any DIC, the same shall be regulated as per the provisions of the Central Electricity Regulatory Commission (Sharing of Inter- State Transmission Charges and Losses) Regulations as amended from time to time.[भाग I—खण् ड 1] भारत का रािपत्र : असाधारण 17 STATE TRANSMISSION PROJECTS 21. As far as intra State projects are concerned the State Governments may adopt these guidelines and may constitute similar committees for facilitation of transmission projects within the State. The States also have the option to use Viability Gap Funding (VGF) based Model Transmission Agreement (MTA) document of erstwhile Planning Commission for development of transmission system in their States under Public Private Partnership (PPP) mode. 22. The TSP will enter into a Transmission Service Agreement (TSA) with the beneficiaries for development, operation, maintenance and transfer of the project. MONITORING OF THE PROJECTS 23. For monitoring of the project as well as for performing roles & responsibilities as identified in the Transmission Service Agreement, Nodal Agency shall appoint independent engineer during construction phase, as per framework provided in these Guidelines at Annex-2. 24. The TSP shall provide to the CEA, Nodal Agency and independent engineer, on a monthly basis, progress reports along with likely completion date of each Element with regard to the Project and its execution. CEA shall monitor the development of the Project for its timely completion for improving and augmenting the electricity system as a part of its statutory responsibility. REPEAL AND SAVING 25. The “Guidelines for Encouraging Competition in Development of Transmission Projects” issued on 13th April, 2006 as amended from time to time, are hereby repealed. 26. Provided, however, that any agreement signed or action taken prior to the date hereof shall not be affected by such repeal of the said Guidelines of 2006 and shall continue to be governed by the Guidelines repealed hereunder. उपभोक्ता जितों की रक्षा करना;  मानकीकरण को बढाना और अस्ट्पष्टता को कम करना, और फलस्ट् िरूप पररयोिनाओं के पूणा िोने में लगने िाले समय में कमी लाना, ;  पारेषण सेिा प्रिाताओं को प्रिालन में लिीलेपन की जनमााण, स्ट्िाजमत्ि, जनर्िष्टा पारेषण प्रणाली घटकों को संिाजलत और स्ट्थानांतररत करेगा, के जलए लागू िोंगे । अंतर-राज्यीय पारेषण पररयोिनाओं के जलए मानक बोली िस्ट्तािेि केंद्रीय जिद्युत जिजनयामक आयोग (अंतर-राज्यीय पारेषण प्रभारों और िाजनयों की जिस्ट् सेिारी) जिजनयम, 2020 के आधार पर जिकजसत दकए िाते िैं, िबदक अंतरा-राज्यीय पारेषण पररयोिनाओं के जलए मानक बोली िस्ट्तािेि टैररफ गणना की डाक रटकट पिजत के आधार पर जिकजसत दकए िाते ि।ैं यदि कोई राज्य केंद्रीय जिद्युत जिजनयामक आयोग (अंतर-राज्यीय पारेषण प्रभारों और िाजनयों की जिस्ट्सेिारी) जिजनयम, 2020 के तित जनर्िष्टा जिस्ट् सिे ारी तंत्र को अपनाता ि,ै तो िे उजित संिोधन एिं उपयुक्त सरकार के अनुमोिन से अंतरा-राज्यीय पारेषण पररयोिनाओं के अिाडा के जलए अंतर-राज्यीय पारेषण पररयोिनाओं के जलए मानक बोली िस्ट्तािेिों का अनुसरण कर सकते ि।ैं अंतर-राज्यीय पारेषण पररयोिनाओं के जलए, सीटीयू या उसके उिराजधकाररयों या केंद्र सरकार द्वारा तय की गई एिेंसी को पररयोिना के सीओडी से 35 साल बाि, अथाात् करार के समाप्त िोने की अिजध के बाि पररयोिना की पररसंपजि के साथ सबस्ट्टेिन के भूजम अजधकारों, मागााजधकार और मंिूरी के साथ िून्य लागत पर और दकसी भी भार और िाजयत्ि से मुक्त अजनिाया रूप से िस्ट्तांतररत की िाएगी। यि िस्ट्तांतरण करार की अिजध समाप्त िोने के 90 दिनों के भीतर पूरा दकया िाएगा, ऐसा न करने पर सीटीयू को स्ट् ित: पररयोिना पररसंपजि का अजधििण करने का अजधकार िोगा। सीईए और सीटीयू (िोनों आयोिना एिेंजसयां िोने के नाते) पररयोिना के सीओडी के बिीसिें िषा (32िें) में तत् समय उपलब् ध प्रौद्योजगक जिकल्पों और प्रणाली अध्ययन के आधार पर प्रणाली के उन्नयन या मौिूिा प्रणाली के निीनीकरण और आधुजनकीकरण, की आिश्यकता की िांि करेंगे। पररयोिना के सीओडी से 35 िषों के बाि पररयोिना को प्रजतस्ट्पधी बोली प्रदिया के माध्यम से ियजनत उिराजधकारी बोलीिाता को निीनीकरण और आधुजनकीकरण यदि कोई िो, और प्रिालन और रखरखाि के जलए दिया िा सकता ि।ै यदि सीटीयू द्वारा मौिूिा प्रणाली के उन्नयन या निीनीकरण और आधुजनकीकरण और पररसंपजियों के िस्ट्तांतरण की आिश्यकता की िांि करने के जलए कोई लागत आती ि,ै तो उसे उिराजधकारी ियजनत बोलीिाता से िसूल दकया िाएगा। 2.3. अंतर-राज्यीय पारेषण पररयोिनाओं के जलए, पररयोिना की करार अिजध की समाजप्त के बाि राज्य सरकार द्वारा तय की गई एिेंसी को पररयोिना की पररसंपजि के साथ सबस्ट्टेिन भूजम अजधकार, मागााजधकार और मंिूरी के साथ, िून्य लागत पर और दकसी भार और िाजयत्िसे मुक्त अजनिाया रूप से िस्ट्तांतररत की िाएगी । अंतरा-राज्य ीय पारेषण पररयोिनाओं के जलए करार की अिजध उपयुक्त आयोग के सुसंगत जिजनयमों के अनुसार एलटीटीसी या बीपीसी द्वारा जनयत 35 िषा या कोई भी अिजध िो सकती ि ै। राज्य पारेषण यूरटजलटी (एसटीयू) (आयोिना एिेंसी िोने के नाते), पररयोिना की समाजप्त से तीन (3) िषा पिले िाले िषा में, उस समय के प्रौद्योजगक जिकल्पों और प्रणाली अध्ययन के आधार पर प्रणाली के उन्नयन या मौिूिा प्रणाली के निीनीकरण और आधुजनकीकरण की आिश्यकता की िांि करेगी। इसके बाि आिश् यकतानुसार, पररयोिना की करार अिजध के बाि निीनीकरण और आधुजनकीकरण, और प्रिालन और रखरखाि के जलए प्रजतस्ट्पधी बोली प्रदिया के माध्यम से ियजनत उिराजधकारी बोलीिाता को पररयोिना प्रिान की िा सकती ि।ै यदि एसटीयू द्वारा मौिूिा प्रणाली के उन्नयन या निीनीकरण और आधुजनकीकरण और पररसंपजियों के िस्ट्तांतरण की आिश्यकता की िांि करने के जलए कोई लागत आती ि,ै तो इसे उिराजधकारी ियजनत बोलीिाता से िसूल दकया िा सकता ि।ै 2.4. पारेषण सेिाएं प्रिान करने के अंतगात, सिेक्षण, जिस्ट्तृत पररयोिना ररपोटा तैयार करना, जिि की व्यिस्ट्था, पररयोिना प्रबंधन, पारेषण लाइसेंस प्राप्त करना, मागााजधकार प्राप्त करना, िन मंिूरी, पयाािरण मंिूरी, सांजिजधक और अन्य आिश्यक मंिूरी, साइट पििान, भूजम अजधििण और मुआििे का भुगतान, जडिाइन, इंिीजनयररंग, गुणििा जनयंत्रण, उपकरण की खरीि, सामिी, जनमााण, जनमााण, परीक्षण और कमीिवनंग, पारेषण लाइनों और/या सबस्ट्टेिन और/या जस्ट्िविंग स्ट्टेिनों और/या एििीडीसी वलंक के प्रिालन और टर्मानल स्ट्टेिनों और एििीडीसी पारेषण लाइन सजित सभी संबंजधत गजतजिजधयां िाजमल िोंगी। यि इस प्रकार से िोगा दक पररयोिना के जनष्पािन से लेकर पूरा िोने और िालू िोने तक और उसके बाि के रखरखाि और प्रिालन तक बोली िस्ट्तािेि में जनर्िष्टा आिश्यक पारेषण सेिाएं प्रिान की िाती ि,ैं तादक ई-ररिसा बोली के िौरान ियजनत बोलीिाता द्वारा उद्धृत और उपयुक्त आयोग द्वारा अपनाए गए पूणा पारेषण िुल्क की िसूली के जलए लक्ष्य के अनुसार सुजिधाएं उपलब्ध िों। लक्ष्य से कम[भाग I—खण् ड 1] भारत का रािपत्र : असाधारण 27 पारेषण प्रणाली की उपलब्धता के जलए, नीिे पैरा 2.5 के अध् यधीन, टीएसपी को िये पारेषण िुल्क, पारेषण सेिा करार (टीएसए) के उपबंधों के अनुसार िोगा। 2.5. यदि लगातार छि मिीनों के जलए पारेषण प्रणाली की उपलब्धता पारेषण सेिा करार (टीएसए) में जनधााररत मानिडं ों से कम ि,ै तो नोडल एिेंसी टीएसए को समाप्त कर सकती ि।ै यदि पारेषण सेिा या नोडल एिेंसी के खरीिार की राय ि ै दक पारेषण प्रणाली अत् यंत मित्िपूणा ि,ै तो िि टीएसपी के िोजखम और लागत पर समय अंतराल व्यिस्ट्था के रूप में पारेषण प्रणाली के प्रिालन और रखरखाि िारी रख सकती ि ै या करिा सकती ि ै और जिद्युत अजधजनयम 2003 के तित जनधााररत प्रदिया के अनुसार उपयुक्त कारािाई के जलए उपयुक्त आयोग से संपका कर सकती ि।ै 3. बोली प्रदिया समन्ियक (बीपीसी) 3.1. एक बोली प्रदिया समन्ियक, जिसे इसके बाि बीपीसी किा गया ि,ै इन दििाजनििे ों के अनुसार टैररफ आधाररत प्रजतस्ट्पधी बोली के तित कायााजन्ित की िाने िाली प्रत्येक अंतर-राज्यीय पारेषण पररयोिना के जलए आिश्यक पारेषण सेिाओं की खरीि के जलए बोली प्रदिया के संिालन के जलए जिम्मेिार िोगा । 3.2. दकसी भी अंतर-राज्यीय पारेषण पररयोिना के जलए आिश्यक पारेषण सेिाओं की खरीि के जलए , केंद्र सरकार सीटीयू या दकसी केंद्र सरकार के संगनन/केंद्रीय सािािजनक क्षेत्र के उपिम या इसकी पूणा स्ट्िाजमत्ि िाली सिायक कंपनी (जििेष प्रयोिनीय िािन) को बीपीसी के रूप में अजधसूजित करेगी । जिद्युत मंत्रालय दकसी भी समय बीपीसी के नामांकन की समीक्षा करने के जलए स्ट्ि तंत्र िोगा । 3.3. अंतरा-राज्यीय पारेषण के जलए आिश्यक पारेषण सेिाओं की खरीि के जलए, उपयुक्त राज्य सरकार एसटीयू या दकसी संगनन/राज्य सािािजनक क्षेत्र के उपिम को बोली प्रदिया समन्ियक के रूप में अजधसूजित कर सकती ि ै या केंद्र सरकार द्वारा अजधसूजित बीपीसी की सेिाओं को जनयुक् त कर सकती ि।ै 3.4. प्रत्येक पारेषण पररयोिना के जलए आिश्यक पारेषण सेिाओं की खरीि के जलए बोली प्रदिया संिाजलत करने के जलए, बीपीसी पररयोिना की अनुमाजनत लागत के 1% की िर से व्य ािसाजयक िुल् क िसूल करेगा, िो प्रजत पररयोिना न्यूनतम 5 करोड रु. और अजधकतम 15 करोड रु .िोगा। 3.5. साथ िी, इन दििाजनििे ों के उपबंधों के अनुसार जिकासकताा के ियन की प्रदिया में बीपीसी द्वारा दकए गए सभी व्यय की िसूली उस जिकासकताा से की िाएगी जिसे अंजतम रूप से जिजननत दकया गया ि,ै और उस पररयोिना को जिकजसत करने का काया सौंपा गया ि ै । िसूल की िाने िाली राजि को आरएफपी िस्ट्तािेि में ििााया िाएगा तादक बोलीिाता उस राजि को उनके द्वारा उद्धृत दकए िाने िाले टैररफ में ध्यान में रख सकें। इसके अलािा, ियजनत बोलीिाता द्वारा बोली प्रदिया के अंत में आरएफपी िस्ट्तािेि में ििााई गई राजि और अंजतम भुगतान की िान े िाली राजि में 5% से अजधक का अंतर निीं िोना िाजिए। साथ िी, यदि दकसी पारेषण योिना के जलए बोली प्रदिया को रद्द/डीनोरटफाई दकया िाता ि,ै तो उस योिना पर बीपीसी द्वारा दकए गए व्यय को योिना की पुन: बोली लगाने पर िसूल दकया िा सकता ि।ै यदि योिना अब आिश्यक निीं ि ै या जिजनयजमत टैररफ तंत्र पर िी गई िै, तो उस योिना पर बीपीसी द्वारा दकए गए व्यय को जिद्युत मंत्रालय की अनुमजत से आगामी योिनाओं के जलए आिंरटत दकया िा सकता ि।ै 4. बोजलया ं आमंजत्रत करन ेकी तयै ारी 4.1. बीपीसी इन दििाजनििे ों के अनुसार बोली िस्ट्तािेि तैयार करेगा और उपयुक्त सरकार का अनुमोिन प्राप्त करेगा। िैकजल्पक रूप से, बीपीसी जिद्युत मंत्रालय द्वारा अजधसूजित मानक बोली िस्ट्तािेिों का उपयोग कर सकता ि ै। मानक बोली िस्ट्तािेिों से कोई भी मित्िपूणा जििलन उपयुक्त सरकार के पूिा अनुमोिन से िी दकया िाएगा। दकसी बोली िस्ट्तािेि को मानक बोली िस्ट्तािेिों से मित्िपूणा जििलन किा िाएगा, यदि िि मानक बोली िस्ट्तािेिों की तुलना में जनम्नजलजखत में से एक या अजधक पिलुओं में पयााप्त अंतर के साथ पारेषण सेिा प्राप्त करने का प्रस्ट्ताि करता ि:ै i. पारेषण सेिा का जिस्ट् तार, गुणििा या जनष् पािन मानक; ii. टीएसपी और नोडल एिेंसी के अजधकार, भूजमकाएं और िाजयत्ि iii. अिता ा आिश्यकता iv. बोली बंधपत्र की कीमतें, करार जनष् पािन गारंटी और क्षजतपूर्ता नुकसानी28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC.1] 4.2. बीपीसी द्वारा बोली प्रदिया िुरू करने के बारे में उपयुक्त आयोग को सूिना भेिी िाएगी । 4.3. बोली िस्ट्तािेिों में पररयोिना प्रोफाइल और सिेक्षण ररपोटा भी िाजमल िोगी। पररयोिना प्रोफाइल (पीपी) में लाइन के संबंध में सुसंगत डेटा अथाात िोल्टेि स्ट्तर, लाइन कॉजऩ्िगरेिन, अथाात् एस/सी या डी/सी, कंडक्टर आदि के कायाात्मक जिजनििे और सबस्ट्टेिन या कनिटार स्ट्टेिनों के कायाात्मक जिजनििे (एििीडीसी लाइन के मामले में).िोना िाजिए।सिेक्षण ररपोटा में मागा की अनुमाजनत लंबाई, इलाके के प्रकार, अजधकतम ऊंिाई , बफीले क्षेत्र , पिन क्षेत्र, िन/िन्यिीि उल्लंघन, लुप्तप्राय प्रिाजतयों के पयाािास का उल्लंघन, आसपास के नागररक और सेना ििाई अड्ड,े मागा में आने िाली प्रमुख निी/समुद्री िॉवसंग और कोयला/खजनि खनन क्षेत्रों और सबस्ट्टेिन या कनिटार स्ट्टेिनों के स्ट्थान सजित एक सुझाया गया मागा िोगा। 4.4. स्ट्थान जिजिष्ट सबस्ट्टेिनों, जस्ट्िविंग स्ट्टेिनों या एििीडीसी टर्मानल या इन्िटार स्ट्टेिनों के जलए बीपीसी को भूजम अजधििण की प्रदिया िुरू करनी िाजिए। बीपीसी िरूरत पडने पर िन मंिूरी लेने की प्रदिया भी िुरू करेगा। 5. पारेषण सिे ा प्रिाता (टीएसपी) 5.1. बीपीसी द्वारा जनगजमत जििेष प्रयोिनीय िािन (एसपीिी), जिसे आगे टीएसपी किा गया िै, को करार जनष् पािन गारंटी िमा करने और सफल बोलीिाता द्वारा एसपीिी प्राप्त करने के बाि, पारेषण सेिा प्रिाता (टीएसपी) के रूप में नाजमत दकया िाएगा । टीएसपी उपयुक्त आयोग से पारेषण लाइसेंस का अनुरोध करेगा। 5.2. टीएसपी पारेषण पररयोिना के जनष्पािन को आरंभ करेगा तादक टीएसए में जनर्िष्टा अनुसूिी के अनुसार पारेषण प्रणाली की कमीिवनंग और प्रिालनात्मकता को पूरा दकया िा सके। 6. पारेषण प्रभारों की िसूली 6.1. इन दििाजनििे ों के अनुसार ई-ररिस ा बोली प्रदिया के माध्यम से ियजनत टीएसपीयों द्वारा प्रिान दकए गए पारेषण प्रणाली के जलए टीएसपी को िये कुल िुल्क, इन दििाजनििे ों के पैरा 7.1, 7.2, 7.3, 7.4 और 7.5 में जनर्िष्टा अनुसार जनधााररत दकया िाएगा। 6.2. राज्य आपूर्ता यूरटजलरटयों, जितरण कंपजनयों, उत्पािन कंपजनयों, व्यापाररयों, थोक उपभोक्ताओं, आदि िैसे डीआईसी/एलटीटीसी से पारेषण िुल्क की िसूली इन दििाजनििे ों और समय-समय पर अजधसूजित उपयुक्त आयोग के सुसंगत जनयमों के अनुसार की िाएगी। 7. पारेषण प्रभार संरिना 7.1. इन दििाजनििे ों के तित पारेषण सिे ाओं की खरीि िते :ु प्रत्येक भुगतान अिजध के जलए पारेषण िुल्क का भुगतान और जनपटारा उपयुक्त आयोग के जिजनयमों के अनुसार दकया िाएगा। प्रथम िषा के जलए िार्षाक पारेषण प्रभार, िो पररयोिना के सीओडी से 35 िषा की अिजध के जलए जनयत रिगे ा, बोली और मूल्यांकन का आधार बनेगा। 7.2. बीपीसी, पारेषण सेिा के जलए आिश्यक पारेषण प्रणाली के जलए िाजणजज्यक प्रिालन के जनधााररत मिीने को जनर्िष्टा करेगा । 7.3. िये माजसक टैररफ, िार्षाक टैररफ में उस मिीने में दिनों की संख्या का गुणा कर तथा पररणाम में िषा में दिनों की संख्या से जिभाजित कर जनकाला िाएगा। 7.4. टैररफ केिल भारतीय रुपए में जनर्िष्टा दकया िाएगा। जिििे ी मुद्रा िोजखम, यदि कोई िो, टीएसपी द्वारा ििन दकया िाएगा। 7.5. ई-ररिसा बोली प्रदिया के उपरांत पाए गए न्यूनतम िार्षाक पारेषण िुल्क िाले बोलीिाता को अिाडा के जलए जििार दकया िाएगा। यदि उद्धृत िरें प्रिजलत कीमतों के अनुरूप निीं िैं, तो मूल्यांकन सजमजत को सभी कीमत बोजलयों को अस्ट्िीकार करने का अजधकार िोगा। 8. भुगतान सरु क्षा तंत्र 8.1. अंतर-राज्यीय पारेषण पररयोिनाओं के जलए भुगतान सुरक्षा समय-समय पर संिोजधत केंद्रीय जिद्युत जिजनयामक आयोग (अंतर-राज्यीय पारेषण प्रभारों और िाजनयों की जिस्ट् सेिारी) जिजनयमों के अनुसार िोगी और डीआईसी द्वारा सीटीयू को उपलब्ध कराई िाएगी। 8.2. अंतरा-राज्य ीय पररयोिनाओं के जलए, टीएसपी द्वारा प्रिान की िा रिी पारेषण सेिाओं के उपयोगकताा द्वारा टीएसपी को भुगतान सुरक्षा उपलब्ध कराई िाएगी। भुगतान सुरक्षा में जनम्न जलजखत िाजमल िो सकते ि:ैं[भाग I—खण् ड 1] भारत का रािपत्र : असाधारण 29 i. अपररितानीय साख पत्र (एलसी) ii. पारेषण सेिाओं के िूककताा उपयोगकताा (उपयोगकतााओं) की जिद्युत के जिजनयमन सजित अन्य उपाय। 9. बोली प्रदिया 9.1. इन दििाजनििे ों के तित पारेषण सेिाओं की खरीि के जलए बीपीसी, प्रस्ट्ताि (आरएफपी) का अनुरोध करने के जलए, िो जलफाफे िाली एकल िरण जनजििा प्रदिया अपनाएगा। बोली के जलए िस्ट्तािेि इन दििाजनििे ों के पैरा 4.1 के अनुसार तैयार दकए िाएंगे। पूरी बोली प्रदिया ई-ररिसा बोली फ्रेमिका के तित इलेक्रॉजनक माध्यम से ऑनलाइन आयोजित की िाएगी। 9.2. आरएफपी नोरटस कम से कम िो राष्ट्रीय समािार पत्रों, बीपीसी की िेबसाइट और जििेष रूप से व्यापार पजत्रकाओं में भी प्रकाजित दकया िाना िाजिए, तादक इसके व्यापक प्रिार िो सके। बोली अजनिाया रूप से अंततराष्ट्रीय प्रजतस्ट्पधी बोली (आईसीबी) के माध्यम से िोगी। आरएफपी िारी करने के जलए, बोलीिाता द्वारा पूरी की िाने िाली न्यूनतम ितों को आरएफपी में जनर्िष्टा दकया िाएगा। 9.3. बीपीसी दकसी भी बोली लगाने िाले/प्रजतभागी को जनजििा िस्ट्तािेि की केिल जलजखत व्याख्या प्रिान करेगा, उसी के जलए किगे ा, और उसे िी अन्य सभी बोलीिाताओं को उपलब्ध कराया िाएगा। सभी पक्षकर केिल बीपीसी की जलजखत सूिना और स्ट्िीकृजतयों पर जनभार रिगें ।े 9.4. आरएफपी में प्रिान दकए िाने िाले मानक िस्ट्तािेिों में जनम्न जलजखत िाजमल िोंगे: 9.4.1. आिश्यकताओं की पररभाषा, जिनमें िाजमल ि:ैं  पररयोिना का संजक्षप्त जििरण;  बोलीिाताओं द्वारा प्राप्त दकए िाने िाले कमीिवनंग माइलस्ट्टोन;  बोली िस्ट्तािेिों में उल् लखे के अनुसार, आिश्यक प्रमाण के साथ न्यूनतम जनिल मूल्य (नेटिथा), आदि सजित बोलीिाताओं द्वारा पूरी की िाने िाली अिता ा आिश्यकताएं। 9.4.2. कमीिवनंग और िाजणजज्यक प्रिालन के जलए जनर्िष्टा लक्ष्य जतजथयां/माि। जनमााण समय कम से कम 18 मिीने के अध् यधीन, इलाके, पररयोिना की िरटलता और लाइन की लंबाई आदि के आधार पर पारेषण संबंधी राष्ट्रीय सजमजत द्वारा अनुिंजसत िोगा। 9.4.3. मानक पारेषण सेिा करार (टीएसए)। टीएसपी, बीपीसी से एसपीिी के अजधििण की तारीख को नोडल एिेंसी (अंतरराज्यीय पररयोिनाओं के मामले में)/संबंजधत यूरटजलरटयों (अंतरा-राज्यीय पररयोिनाओं के मामले में) के साथ एक पारेषण सेिा करार (टीएसए) करेगा। जिद्युत अजधजनयम की धारा 38(2) के अनुसार, अंतरराज्यीय पारेषण पररयोिनाओं के जलए, सीटीयू पारेषण सेिा करार और आिश्यकतानुसार, अंतरराज्यीय पारेषण सेिाएं प्रिान करने के जलए समय-समय पर यथासंिोजधत केंद्रीय जिद्युत जिजनयामक आयोग (अंतर-राज्यीय पारेषण प्रभार और िाजनयों की जिस्ट् सेिारी) के तित, दकसी भी अन्य करार, जिसमें इस संबंध में केंद्रीय आयोग द्वारा बनाए गए जनयमों के अनुसार डीआईसी के बीि पारेषण प्रभारों और िाजनयों की जिस्ट्स ेिारी, डीआईसी से पारेषण प्रभार एकत्र करना और संबंजधत पारेषण सेिा प्रिाताओं को संजितररत करना िाजमल ि,ै को जनष्पादित करने के जलए नोडल एिेंसी के रूप में काया करेगा। नोडल एिेंसी अपनी भूजमकाओं को पूरा करने और टीएसए के तित समाजप्त भुगतान, क्षजतपूर्ता सजित दकसी भी अन्य िािों और/या िये ता (ओं) को पूरा करने के जलए डीआईसी से अपने खिों की िसूली करने की िकिार िोगी। नोडल एिेंसी के ऐसे खिों की िसूली के जलए एक उपयुक्त जिजनयम तैयार दकया िाएगा। नोडल एिेंसी द्वारा टीएसपी से प्राप्त दकसी भी भुगतान या नुकसान को सीईआरसी जिस्ट्स ेिारी जिजनयमों के अनुसार िेय मुआििे की कटौती के बाि, पररयोिना की कमीिवनंग में िरे ी के जलए सीईआरसी जिस्ट्स ेिारी जिजनयमों के अनुसार डीआईसी द्वारा भुगतान दकए िाने िाले पारेषण िुल्क को समायोजित करने के जलए उपयोग दकया िाएगा। इसके अलािा,30 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC.1] सभी नाजमत अंतर-राज्यीय िािक (डीआईसी) सीटीयू को अपनी जिम्मेिाररयों के जनिािन में सुजिधा प्रिान करने के जलए जनम्नजलजखत िाजयत् ि जनभाएंगे: क) पररयोिना को िोडने के जलए टीएसपी को सक्षम करने के जलए अंतसंयोिन सुजिधाओं की उपलब्धता का समन्िय करना; तथा ख) नोडल एिेंसी को अपने कताव्यों और िाजयत्ि ों के जनष्पािन के जलए आिश्यक सभी सिायता प्रिान करना। 9.4.4. समय-समय पर यथासंिोजधत केंद्रीय जिद्युत जिजनयामक आयोग (अंतर-राज्यीय पारेषण प्रभारों और िाजनयों की जिस्ट् सेिारी) जिजनयम के तित करार। अंतर-राज्य ीय पररयोिनाओं के मामले में, टीएसपी समय-समय पर यथासंिोजधत केंद्रीय जिद्युत जिजनयामक आयोग (अंतर-राज्यीय पारेषण प्रभारों और िाजनयों की जिस्ट्स ेिारी) जिजनयम के तित आयोग से पारेषण लाइसेंस प्रिान करने की जतजथ से पन्द्रि (15) दिनों के भीतर आिश्यक करार करेगा। 9.4.5. बोलीिाता के प्रस्ट्ताि की िैधता की आिश्यक अिजध; 9.4.6. एसपीिी के साथ दकया िान े िाला प्रस्ट्ताजित टीएसए। आरएफपी िरण में प्रस्ट्ताजित टीएसए को बोली-पूिा सम्म ेलन के िौरान बोलीिाताओं से प्राप्त पररयोिना से संबंजधत िानकारी के आधार पर संिोजधत दकया िा सकता ि ै और इसे सभी आरएफपी बोलीिाताओं को उपलब्ध कराया िाएगा। टीएसए में आगे कोई और संिोधन निीं दकया िाएगा; 9.4.7. बीपीसी द्वारा अपनाई िान े िाली बोली मल्ू याकं न कायाप्रणाली। आरएफपी के साथ ऑनलाइन िमा दकए गए प्रारंजभक मूल्य प्रस्ट्ताि का मूल्यांकन बोलीिाता द्वारा उद्धृत पैकेि के तित िाजमल सभी घटकों के जलए िार्षाक पारेषण िुल्क के आधार पर दकया िाएगा। प्रारंजभक प्रस्ट्ताि के पारेषण िुल्क को अिता ा प्राप्त बोलीिाताओं के जनधाारण के जलए आरोिी िम के आधार पर िमबि दकया िाएगा। आरएफपी िरण में रैंककंग के पिले 50% (दकसी भी अंि को अगले पूणांक में पूणांदकत) या 4 (िार) बोलीिाताओं में से िो भी अजधक िो, ई-ररिसा बोली में भाग लेने के जलए पात्र िोंगे। यदि आरएफपी िरण में अनुदियािील बोलीिाताओं की संख्या 2 (िो) से 4 (िार) के बीि ि,ै तो सभी ई-ररिसा बोली में भाग लेने के जलए पात्र िोंगे। यदि अनुदियािीलता िांि के बाि केिल एक बोलीिाता िेष रिता ि,ै तो ऐसे बोलीिाता का प्रारंजभक प्रस्ट्ताि निीं खोला िाएगा और मामला सरकार को भेिा िाएगा। एक या एक से अजधक बोलीिाताओं द्वारा प्रस्ट्तुत दकए गए प्रारंजभक प्रस्ट्ताि से समान पारेषण िुल्क पाए िाने की जस्ट्थजत में, पात्र बोलीिाताओं के जनधाारण के उद्देश्य से ऐसे सभी बोलीिाताओं को समान रैंक िी िाएगी। ऐसे मामलों में, सभी बोलीिाता िो ऊपर जनधााररत रैंक के 50% तक समान रैंक साझा करते िैं, ई-ररिसा बोली में भाग लेने के जलए अिता ा प्राप्त करेंगे। यदि 50% रैंक (दकसी भी अंि को अगल े पूणांक में पूणांदकत दकया गया ि)ै में 4 (िार) से कम बोलीिाता ि ैं और िौथे बोली लगाने िाले की रैंक 1 (एक) से अजधक बोलीिाता द्वारा साझा की िाती ि,ै तो ऐसे सभी बोलीिाता िो िौथे बोलीिाता के रैंक को साझा करने िाले ई-ररिसा बोली में भाग लेने के जलए अिता ा प्राप्त करेंगे। िुरुआती प्रस्ट् ताि से प्राप्त िोने िाला सबसे कम पारेषण प्रभार अगले िरण, अथाात् ई-ररिसा बोली प्रदिया िरण के जलए उच्चतम कीमत िोगी। ई-ररिसा बोली प्रदिया िरण के िौरान, आरएफपी िरण में अिता ा प्राप्त बोलीिाताओं को अपनी बोली मौिूिा न्यूनतम बोली से कम से कम 0.25% कम रखनी िोगी, िब तक दक िे ररिसा नीलामी में िारी रखना िािते ि।ैं ई-ररिसा बोली के संिालन की प्रारंजभक अिजध 2 घंटे िोनी िाजिए, जिसे अंजतम प्राप्त बोली के समय से 30 जमनट तक बढाया िाएगा, यदि बोली जनधााररत या जिस्ट्ताररत बोली के समय के अंजतम 30 जमनट के िौरान प्राप्त िोती ि।ै इसके बाि, इसे निीनतम प्राप्त बोली के समय से 30 जमनट के जलए दफर से बढाया िाएगा। िष्ृट ातंः (i) यदि बोलीिाता 10 ि,ैं जिनके रैंक L1, L2, L3, L4, L5, L6, L7, L8, L9, L10 के ि,ैं तो ऐसे मामले में 50% रैंक अथाात् 5 ि,ैं बोलीिाता 5 ि।ैं तिनुसार, कुल 5 बोलीिाता अथाात एल1, एल2, एल3, एल4, एल5 ररिसा नीलामी में भाग लेने के जलए पात्र िोंगे। (ii) यदि बोलीिाता 8 ि ैंजिनके रैंक L1, L1, L2, L2, L2, L3, L4, L5 ि,ैं तो ऐसी जस्ट्थजत में 50% रैंक (अगले उच्च पूणांक तक के जलए) अथाात् 3 ि ैजिसमें 6 बोलीिाता ि।ैं तिनुसार, अब कुल 6 बोलीिाता अथाात एल1, एल1, एल2, एल2, एल2, एल3 ररिसा नीलामी में भाग लेने के जलए पात्र िोंगे। (iii) यदि बोलीिाता 8 ि ैंिो L1, L2, L3, L4, L4, L5, L5, L6 के रूप में रैंक रखते ि,ैं तो ऐसे मामले में 50% रैंक अथाात् 3 में केिल 3 बोलीिाता ि ैंऔर िौथे बोलीिाता द्वारा 2 बोलीिाताओं के बीि रैंक साझा दकया िाता ि।ै[भाग I—खण् ड 1] भारत का रािपत्र : असाधारण 31 तिनुसार, अब कुल 5 बोलीिाता अथाात एल1, एल2, एल3, एल4, एल4 ररिसा नीलामी में भाग लेने के जलए पात्र िोंगे। 9.4.8. आरएफपी बोली बंधपत्र के साथ-साथ करार काया जनष्पािन गारंटी को भी जनर्िष्टा करेगा िो बोलीिाताओं को प्रस्ट्तुत करना िोगा। 9.4.9. टीएसए में टीएसपी और नोडल एिेंसी (अंतर-राज्यीय पररयोिनाओं के मामले में)/टीएसपी और यूरटजलरटयों (अंतरा-राज्यीय पररयोिनाओं के मामले में) के बीि प्रस्ट्ताजित क्षजतपूर्ता व्यिस्ट्था भी प्रिान की िाएगी। यि क्षजतपूर्ता टीएसए की प्रभािी जतजथ से टीएसपी और नोडल एिेंसी/यूरटजलरटयों िोनों पर लागू िोगी। 9.4.10. टीएसए, पारेषण सेिाओं को प्रिान करने में िरे ी की जस्ट्थजत में लागू िोने िाले पररसमापन नुकसानों को भी जनर्िष्टा करेगा। 9.4.11. टीएसए, बोलीिाता/टीएसपी द्वारा पूरा दकए िाने िाले तकनीकी, प्रिालनात्मक और सुरक्षा मानिडं ों को भी जनर्िष्टा करेगा। 9.4.12. टीएसपी को सुसंगत जिजनयमों के अनुसार उपयुक्त आयोग से पारेषण लाइसेंस प्राप्त करना िोगा। 9.5. बीपीसी उन सभी संभाजित बोलीिाताओं के साथ बोली-पूिा सम्मेलन बुला सकता ि,ै जिन्िोंने आरएफपी िरण के जलए िस्ट्तािेि मांगे ि।ैं यदि बोलीिाता कोई पररयोिना जिजिष्ट जििलन िािते ि ैं और बीपीसी को लगता ि ै दक िे जििलन उजित ि,ैं तो बीपीसी ऐसे जििलन को स्ट्िीकार करने के तका के साथ ऐसे जििलन के जलए सिमत िो सकता ि।ै स्ट्पष्टीकरण/ संिोजधत-जनजििा िस्ट्तािेि उन सभी को दिया िाएगा जिन्िोंने जििलनों और स्ट्पष्टीकरणों के बारे में सूजित करते हुए आरएफपी िस्ट्तािेि मांगा था। ििां भी संिोजधत बोली िस्ट्तािेि िारी दकए िाते िैं, बीपीसी ऐसे िस्ट्तािेि िारी करने के बाि बोलीिाताओं को बोजलयां प्रस्ट्तुत करने के जलए न्य ूनतम पंद्रि (15) दिनों का समय उपलब्ध कराएगा। 9.6. बोली प्रस्ट्ततु करना और मल्ू याकं न प्रजतस्ट्पधाा सुजनजित करने के जलए, अिता ा प्राप्त/योग्य बोलीिाताओं की न्यूनतम संख्या िो िोगी। 9.7. बोली खोलने िाली सजमजत: 9.7.1. अंतर-राज्य ीय पारेषण प्रणाजलयों के जलए बोजलयां केजिप्रा के कायाालय में खोली िाएंगी जिसमें केजिप्रा से कम से कम एक सिस्ट्य और बीपीसी का एक सिस्ट्य िाजमल िोगा। केजिप्रा और बीपीसी बोली खुलने के दिन िोनों संगननों से एक- एक सिस्ट्य की उपलब्धता सुजनजित करने के जलए अपने संबंजधत संगनन से एक-एक िैकजल्पक सिस्ट्य को भी नाजमत कर सकते ि।ैं 9.7.2. अंतरा-राज्य ीय पारेषण प्रणाली के जलए, एसटीयू/राज्य सरकार अंतर-राज् यीय पारेषण प्रणाली िैसी संरिना के साथ या िैसा उजित िो, बोजलयों को खोलने के जलए एक सजमजत का गनन करेगी। 9.8. बोली मूल्यांकन सजमजत: 9.8.1. अंतर-राज्यीय पारेषण प्रणाजलयों के जलए, केजिप्रा बोजलयों के मूल्यांकन के जलए एक सजमजत का गनन करेगा जिसमें केजिप्रा के कम से कम एक प्रजतजनजध और संबंजधत क्षेत्रीय जिद्युत सजमजतयों के कम से कम िो प्रजतजनजध और एक स्ट्ितंत्र सिस्ट्य िोगा। इसके अलािा, यदि पररयोिना अंतर-क्षेत्रीय ि,ै तो प्रत्येक संबंजधत आरपीसी से कम से कम एक प्रजतजनजध िोना िाजिए। स्ट्ितंत्र सिस्ट्य को जििीय मामले/बोली मूल्यांकन में जििेषज्ञता प्राप्त िोनी िाजिए। 9.8.2. अंतरा-राज्य ीय पारेषण प्रणाली के जलए, एसटीयू/राज्य सरकार अंतर-राज् यीय पारेषण प्रणाली िैसी संरिना के साथ, या िो उजित िो, बोजलयों के मूल्यांकन के जलए एक सजमजत का गनन करेगी। 9.9. यि सुजनजित करने के जलए तकनीकी बोजलयों की िांि की िाएगी दक प्रस्ट्तुत की गई बोजलयां सभी तकनीकी मूल्यांकन मानकों पर बोली िस्ट्तािेिों में जनधााररत न्यूनतम पात्रता मानिडं ों को पूरा करती ि।ैं बोली िस्ट्तािेिों में जनधााररत न्यूनतम तकनीकी मानिडं ों के सभी घटकों को पूरा करने िाली बोजलयों पर िी पारेषण िुल्क बोजलयों पर आगे के मूल्यांकन के जलए जििार दकया िाएगा।32 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC.1] 9.10. ऑनलाइन प्रारंजभक कीमत बोजलयां, बोली मूल्यांकन सजमजत की उपजस्ट्थजत में बोली खोलने िाली सजमजत द्वारा इलेक्रॉजनक रूप से खोली िाएंगी। ई-ररिसा बोली प्रदिया में भाग लेने के जलए सभी अिता ा प्राप्त बोलीिाताओं को केिल न्यनू तम प्रारंजभक प्रस्ट्ताि के बारे में सूजित दकया िाएगा। ई-ररिसा बोली प्रदिया के िौरान इलेक्रॉजनक प्लेटफॉमा पर सभी अिता ा प्राप्त बोलीिाताओं को केिल सबसे न्य ूनतम िल रिी बोली दिखाई िने ी िाजिए। 9.11. पारेषण प्रभार बोली को अस्ट्िीकार कर दिया िाएगा यदि इसमें प्रस्ट्तुत करने में बोली िस्ट्तािेिों से कोई जििलन िोता ि।ै 9.12. ई-ररिसा बोली प्रदिया के िौरान उद्धृत िार्षाक पारेषण प्रभारों में से प्राप्त न्यूनतम पारेषण प्रभारों पर अिाडा िते ु जििार दकया िाएगा। यदि ई-ररिसा बोली िरण के िौरान कोई बोली प्राप्त निीं िोती ि ै तो न्यूनतम प्रारंजभक प्रस्ट्ताि को अंजतम प्रस्ट्ताि माना िाएगा। 10. मध्यस्ट्थता करना 10.1. टीएसए या टैररफ के संबंध में दकसी भी जििाि के मामले में, िि जिद्युत अजधजनयम, 2003 के उपबंधों के तित उपयुक्त आयोग के अजधकार क्षेत्र के अधीन िोगा। 11. बोली प्रदिया के जलए समय सारणी 11.1 एकल िरण बोली प्रदिया के जलए सुझाई गई समय-सारणी नीिे िी गई ि।ै खरीिार मौिूिा पररजस्ट्थजतयों के आधार पर यिां ििााई गई जिस्ट्ताररत समय-सीमा ि े सकता ि ै और ऐसे पररितानों को इन दििाजनििे ों से जििलन निीं माना िाएगा। घटनािम िून्य तारीख से बीता हुआ समय बीपीसी के जलए रािपत्र अजधसूिना का प्रकािन िून्य तारीख आरएफपी का प्रकािन 2 दिन बोली स्ट्पष्टीकरण, सम्मेलन आदि और आरएफपी का संिोधन 40 दिन तकनीकी और प्रारंजभक प्रस्ट्ताि प्रस्ट् ततु करना 65 दिन प्रारंजभक प्रस्ट्ताि के खुलने के बाि ई-ररिसा बोली 75 दिन बोलीिाताओं की छंटनी और एलओआई िारी करना ई-ररिसा बोली प्रदिया की समाजप्त के 8 दिन बाि करार पर िस्ट्ताक्षर एलओआई िारी िोने के 10 दिन बाि 12. संजििा प्रिान करना और जनष्कष ा 12.1. ियन और बीपीसी से आिय पत्र (लेटर ऑफ इंटेंट) (एलओआई) िारी िो िाने के बाि, बोली िस्ट्तािेि में जिजित जनबंधन एिं ितों के अनुसार टीएसपी बनने के जलए ियजनत बोलीिाता पररयोिना के जलए तैयार दकए गए एसपीिी के अजधििण के जलए िेयर खरीि करार को जनष्पादित करेगा और टीएसए जनष्प ादित करेगा। इसके अलािा, अंतरराज्यीय पररयोिनाओं के मामले में, टीएसपी आयोग द्वारा पारेषण लाइसेंस प्रिान करने की तारीख से 15 दिन के भीतर, समय- समय पर यथासंिोजधत केंद्रीय जिद्युत जिजनयामक आयोग (अंतर-राज्यीय पारेषण िुल्क और िाजनयों की जिस्ट् सेिारी) जिजनयम के तित आिश्यक करार यदि कोई िो, को भी जनष्पादित करेगा। 12.2. टीएसपी, एसपीिी के अजधििण के जलए िेयर खरीि करार के जनष्पािन की तारीख से पांि (5) काया दििसों के भीतर उपयुक्त आयोग को पारेषण लाइसेंस प्रिान करने के जलए एक आिेिन करेगा।[भाग I—खण् ड 1] भारत का रािपत्र : असाधारण 33 12.3. बीपीसी सभी बोजलयों के मूल्यांकन के अंजतम पररणाम को सािािजनक करेगा। 12.4. बोली मूल्यांकन सजमजत के प्रमाण पत्र सजित अंजतम टीएसए, अजधजनयम की धारा 63 के अनुसार ई-ररिसा बोली प्रदिया के िौरान उद्धृत िार्षाक पारेषण िुल्क से प्राप्त टैररफ को अपनाने के जलए उपयुक्त आयोग को अिेजषत दकया िाएगा। 13. पारेषण सेिा करार का समापन 13.1. पारेषण सेिा करार में जनर्िष्ा ट दकसी भी घटना के घरटत िोने पर नोडल एिेंसी द्वारा पारेषण सेिा करार को समाप्त दकया िा सकता ि।ै 13.2. पारेषण सेिा करार के समाप्त िोने पर, नोडल एिेंसी पररयोिना की पुन: बोली लगाने के जलए उपाय कर सकती ि।ै 14. जनरसन और व्य ािृजत 14.1. समय-समय पर यथासंिोजधत 13 अप्रैल, 2006 को िारी "पारेषण सेिा के जलए टैररफ आधाररत प्रजतस्ट्पधी-बोली दििाजनििे " एतद्द्वारा जनरस्ट्त दकया िाता ि।ै 14.2. बिते, तथाजप, इस तारीख से पिले िस्ट् ताक्षररत कोई भी करार या की गई कारािाई 2006 के उक्त दििाजनििे ों के ऐसे जनरसन से प्रभाजित निीं िोगी और इसके तित जनरस्ट्त दििाजनििे ों द्वारा िाजसत िोती रिगे ी। मृत्युंिय कुमार नारायण, संयुक्त सजिि RESOLUTION New Delhi, the 10th August 2021 Tariff based Competitive-bidding Guidelines for Transmission Service 1. Preamble No. 15/1/2017-Trans.— Promotion of competition in the electricity industry in India is one of the key objectives of the Electricity Act, 2003 (the Act). Development of a transmission system is essential both for encouraging competition and for creating electricity markets. These guidelines are aimed at facilitating competition in this sector through wider participation in providing transmission services and tariff determination through a process of tariff based bidding. Section 61 & 62 of the Act provide for tariff regulation and determination of tariff of generation, transmission, wheeling and retail sale of electricity by the Appropriate Commission. Section 63 of the Act states that – “Notwithstanding anything contained in section 62, the Appropriate Commission shall adopt the tariff if such tariff has been determined through transparent process of bidding in accordance with the guidelines issued by the Central Government.” Tariff based Competitive Bidding Guidelines for Transmission Service and Guidelines for encouraging competition in development of Transmission Projects have been framed under the above provisions of section 63 of the Act. The specific objectives of these guidelines are as follows:  Promote competitive procurement of transmission services.  Encourage private investment in transmission system.  Facilitate transparency and fairness in procurement processes;  Facilitate reduction of information asymmetries for various bidders;34 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC.1]  Protect consumer interests by facilitating competitive conditions in procurement of transmission services of electricity;  Enhance standardization and reduce ambiguity and hence time for materialization of projects;  Ensure compliance with standards, norms and codes for transmission systems while allowing flexibility in operation to the transmission service providers. 2. Scope of the Guidelines 2.1. These guidelines are being issued under the provisions of Section 63of the Electricity Act, 2003 for procurement of transmission services for transmission of electricity. 2.2. The guidelines shall apply for procurement of transmission services for transmission of electricity through tariff based competitive bidding, through the mechanisms described in this notification and to select the bidder who will acquire SPV for a new interstate / intra state transmission system and to build, own, operate and transfer the specified transmission system elements. Standard Bidding Documents for inter-state transmission projects are developed based on Central Electricity Regulatory Commission (Sharing of Inter-State Transmission Charges and Losses) Regulations; 2020 whereas Standard Bidding Documents for intra-state transmission projects are developed on the basis of the postage stamp method of tariff computation. In case any state adopts the sharing mechanism as specified under Central Electricity Regulatory Commission (Sharing of Inter-State Transmission Charges and Losses) Regulations, 2020, they may follow the Standard Bidding Documents for inter-state transmission projects with suitable modifications and approval from the Appropriate Government, for award of intra-state transmission projects. For inter-state transmission projects, the project assets along with substation land with rights, right of way and clearances shall compulsorily be transferred to CTU or its successors or an agency as decided by the Central Government after 35 years from COD of project, i.e expiry of contract period, at zero cost and free from any encumbrance and liability. The transfer shall be completed within 90 days of expiry of the contract period failing which CTU shall be entitled to take over the project assets Suo moto. The CEA and the CTU (both being the planning agencies) in the thirty second year (32th) of COD of project will examine the need of upgradation of the system or renovation and modernization of the existing system depending on technological options and system studies at that time. The project may then be awarded to successor bidder selected through a competitive bidding process for renovation and modernization, if required, and operation and maintenance after 35 years from COD of the project. In case, any cost is incurred by CTU towards examining the need of upgradation or renovation and modernization of the existing system and transfer of assets, the same shall be recovered from successor selected bidder. 2.3. For intra-state transmission projects, the project assets along with substation land with rights, right of way and clearances shall compulsorily be transferred to an agency as decided by the State Government after expiry of contract period of project, at zero cost and free from any encumbrance and liability. The contract period for the intra state transmission projects may be 35 years or any period as fixed by the LTTCs or BPC as per the relevant regulations of the Appropriate Commission. The State Transmission Utility (STU)(being the planning agency), in the year which is three (3) years prior to the expiry of the project, will examine the need of upgradation of the system or renovation and modernization of the existing system depending on technological options and system studies at that time. The project may then be awarded to successor bidder selected through a competitive bidding process for renovation and modernization, if required, and operation and maintenance after contract period of the project. In case, any cost is incurred by STU towards examining the need of upgradation or renovation and modernization of the existing system and transfer of assets, the same may be recovered from successor selected bidder. 2.4. Providing transmission services would include all activities related to survey, detailed project report formulation, arranging finance, project management, obtaining transmission license, obtaining right of way, forest clearance, environment clearance, statutory and other necessary clearances, site identification, land acquisition and payment of compensation, design, engineering, quality control, procurement of equipment, material, construction, erection, testing and[भाग I—खण् ड 1] भारत का रािपत्र : असाधारण 35 commissioning, maintenance and operation of transmission lines and/or substations and/or switching stations and/or HVDC links including terminal stations and HVDC transmission line. It will be in such a manner that the required transmission services as specified in the bid document are provided from execution of the project up to completion and commissioning and its subsequent maintenance and operation so that the facilities are available as per the target for recovery of full transmission charges as quoted by the selected bidder during the e-reverse bidding and adopted by the Appropriate Commission. For availability of transmission system below the target, subject to para 2.5 below, transmission tariff payable to the TSP will be in accordance with the provisions of Transmission Service Agreement (TSA). 2.5. If the availability of the transmission system is below the norms prescribed in the Transmission Service Agreement (TSA), for six consecutive months, the Nodal Agency may terminate the TSA. If the procurer of transmission service or Nodal Agency is of the opinion that the transmission system is of critical importance, it may carry out or cause to carry the operation and maintenance of transmission system at the risk and cost of TSP as a time gap arrangement and approach the Appropriate Commission for suitable action as per the procedure laid down under the Electricity Act 2003. 3. Bid Process Coordinator (BPC) 3.1. A Bid Process Coordinator, herein after referred to as BPC, would be responsible for conducting the bid process for procurement of required transmission services for each inter-state transmission project to be implemented under tariff-based competitive bidding in accordance with these guidelines. 3.2. For procurement of transmission services, required for any inter-state Transmission Project, the Central Government shall notify the CTU or any Central Government Organization/ Central Public Sector Undertaking or its wholly owned subsidiary (Special Purpose Vehicle) to be the BPC. It will be open for Ministry of Power to review the nomination of BPC at any time. 3.3. For procurement of transmission services required for intra-state transmission, the appropriate State Government may notify the STU or any Organization/State Public Sector Undertaking as the Bid Process Coordinator or may engage the services of the BPC notified by the Central Government. 3.4. For conducting the bid process for procurement of required transmission services for each transmission project, BPC shall charge a professional fee @ 1% of the estimated cost of the project subject to minimum of Rs. 5 Crore and a maximum of Rs. 15 Crore for each project. 3.5. Also, all the expenditure incurred by the BPC in the process of selection of the developer in accordance with the provisions of these guidelines shall be recovered from the developer who is finally identified and assigned the task of developing that project. The amount to be recovered shall be indicated in the RFP document so that bidders can take that amount into consideration in the tariff to be quoted by them. Further, there should not be a variation of more than 5% in the amount indicated in the RFP document and amount to be finally paid at the end of bidding process by selected bidder. Also, in case the bidding process for a transmission scheme is cancelled/ de- notified, the expenditure incurred by BPC on that scheme may be recovered when the scheme is re- bid. In case the scheme is no longer required or given on regulated tariff mechanism, the expenditure incurred by BPC on that scheme may be allocated to upcoming schemes with the permission of Ministry of Power. 4. Preparation for inviting bids 4.1. The BPC shall prepare the bid documents in accordance with these guidelines and obtain approval of the Appropriate Government. Alternatively, the BPC can use the Standard Bidding Documents notified by Ministry of Power. Any material deviation from the Standard Bidding Documents shall be made only with the prior approval of the Appropriate Government. A Bid Document will be said to have material deviation from Standard Bidding Documents, if it proposes36 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC.1] to procure transmission service with substantial difference in one or more of the following aspects as compared to Standard Bid Documents: i. Scope, quality, or performance standards of the transmission service; ii. Rights, roles and obligations of the TSP and Nodal Agency iii. Qualification Requirement iv. Values of Bid Bond, Contract Performance Guarantee & Liquidated Damages 4.2. Intimation shall be sent by the BPC to the Appropriate Commission about initiation of the bidding process. 4.3. The bid documents shall also include Project Profile and survey report. The Project Profile (PP) must contain relevant data regarding the line i.e. voltage level, line configuration i.e S/C or D/C, functional specifications of conductor etc. and functional specifications of the substations or converter stations (in case of HVDC line).The survey report shall have one suggested route with approximate route length, type of terrain, max. altitude, snow zones, Wind zones, forest / wildlife infringement, infringement of endangered species habitat, vicinity to civil and defence Airports, major river/sea crossings & coal/ mineral mine areas likely to be encountered and location of substations or converter stations. 4.4. For location specific substations, switching stations or HVDC terminal or inverter stations the BPC should initiate the process of acquisition of land. The BPC will also initiate the process of seeking forest clearance, if required. 5. Transmission Service Provider (TSP) 5.1. The Special Purpose Vehicle (SPV) incorporated by BPC shall be designated as the Transmission Service Provider (TSP), hereinafter referred to as the TSP, after submitting a contract performance guarantee and acquiring the SPV by the successful bidder. The TSP shall seek transmission license from the Appropriate Commission. 5.2. The TSP would take-up execution of the Transmission Project so as to complete commissioning and operationalization of the transmission system as per the specified schedule in the TSA. 6. Recovery of Transmission Charges 6.1. Total charges for the transmission system provided by the TSP(s) selected through the e- reverse bidding process as per these guidelines, payable to the TSP, shall be determined as specified in paras 7.1, 7.2, 7.3, 7.4 and 7.5 of these guidelines. 6.2. Recovery of transmission charges from the DICs/LTTCs such as State supply utilities, distribution companies, generation companies, traders, bulk consumers, etc., shall be done as provided in these guidelines and relevant regulations of the Appropriate Commission as notified from time to time. 7. Transmission Charge Structure 7.1. For procurement of transmission services under these guidelines: Transmission charges shall be paid and settled for each payment period as per regulations of the Appropriate Commission. Annual transmission charges for the first year, which shall remain fixed for the period of 35 years from COD of project, shall form the basis for bidding and evaluation. 7.2. The BPC shall specify scheduled month of commercial operation for the transmission system required for the transmission service. 7.3. The monthly tariff payable shall be annual tariff multiplied by no. of days in that month and divided by no. of days in the year. 7.4. Tariff shall be designated in Indian Rupees only. Foreign exchange risks, if any, shall be borne by the TSP.[भाग I—खण् ड 1] भारत का रािपत्र : असाधारण 37 7.5. The bidder with the lowest annual transmission charges discovered after the e-reverse bidding procedure will be considered for the award. The Evaluation Committee shall have the right to reject all price bids if the rates quoted are not aligned to the prevailing prices. 8. Payment Security Mechanism 8.1. The payment security for inter state transmission projects shall be as per Central Electricity Regulatory Commission (Sharing of Inter-State Transmission Charges and Losses) Regulations as amended from time to time and shall be made available to the CTU by the DICs. 8.2. For intra State projects, payment security shall be made available to the TSP by the user of transmission services being provided by the TSP. The payment security may include: i. Irrevocable revolving Letter of Credit (LC) ii. other measures, including regulation of power of the defaulting user(s) of the transmission services. 9. Bidding Process 9.1. For the procurement of transmission services under these guidelines, BPC shall adopt a single stage two envelope tender process featuring Request for Proposal (RFP). The bid documents shall be prepared in accordance with para 4.1of these guidelines. The entire bidding process shall be conducted online through electronic medium under e-reverse bidding framework. 9.2. RFP notice should be published in at least two national newspapers, website of the BPC and preferably in trade magazines also, so as to accord it wide publicity. The bidding shall necessarily be by way of International Competitive Bidding (ICB). For the purpose of issue of RFP, minimum conditions to be met by the bidder shall be specified in the RFP. 9.3. BPC shall provide only written interpretation of the tender document to any bidder / participant, asking for the same, and the same shall be made available to all other bidders. All parties shall rely solely on written communication and acceptances from the BPC. 9.4. Standard documentation to be provided in the RFP shall include, 9.4.1. Definition of requirements, including:  Brief description of the Project;  Commissioning milestones to be achieved by the bidders;  Qualification requirements to be met by bidders including, minimumnet-worth, etc with necessary proof of thesame, as outlined in the bid documents; 9.4.2. Specified target dates/months for commissioning and commercial operations. Construction time shall be as recommended by National Committee on Transmission depending on terrain, complexity of the project and line length etc., subject to a minimum of 18 months. 9.4.3. Standard Transmission Service Agreement (TSA). The TSP on the date of acquisition of SPV from the BPC will enter into a Transmission Service Agreement (TSA) with the Nodal Agency (in case of inter state projects) / the concerned utilities (in case of intra State projects). In terms of Section 38(2) of the Electricity Act, for inter state transmission projects, CTU shall act as Nodal Agency to execute the Transmission Service Agreement and any other agreement(s), if required, under Central Electricity Regulatory Commission (Sharing of Inter-State Transmission Charges and Losses) Regulations as amended from time to time for providing the inter State transmission services, including sharing of transmission charges and losses amongst the DICs, collecting the transmission charges from the DICs and disbursing it to the respective Transmission Service Providers, as per the regulations framed by the Central Commission in this regard from time to time. The Nodal Agency shall be entitled to recover its expenses from the DICs towards fulfilment of its roles and any other claims and/ or liability(ies) including that for termination payment,38 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC.1] indemnification under TSA. A suitable regulation shall be framed for recovery of such expenses of Nodal Agency. Any payment or damages received by the Nodal Agency from the TSP, after deducting compensation payable as per CERC Sharing Regulations, for delay in achieving commissioning of Project shall be utilised to adjust the transmission charges to be paid by DICs as per the CERC Sharing Regulations. Further, all Designated Inter-State Customers (DICs) shall undertake following responsibilities to facilitate CTU in discharging its responsibilities: a) to coordinate the availability of the interconnection facilities to enable the TSP to connect the project; and b) for providing all assistance to the Nodal Agency as they may require for the performance of their duties and responsibilities.” 9.4.4. Agreement(s) under Central Electricity Regulatory Commission (Sharing of Inter- State Transmission Charges and Losses) Regulations as amended from time to time. In case of inter state projects, the TSP shall enter into agreement(s) required, if any, under Central Electricity Regulatory Commission (Sharing of Inter-State Transmission Charges and Losses) Regulations as amended from time to time within fifteen (15) days from the date of grant of Transmission License from the Commission. 9.4.5. Required Period of validity of offer of bidder; 9.4.6. The TSA proposed to be entered with the SPV. The TSA proposed at the RFP stage may be amended based on the project specific inputs received from bidders during the pre bid conference and it will be made available to all RFP bidders. No further amendments shall be carried out in the TSA; 9.4.7. Bid evaluation methodology to be adopted by the BPC. The initial price offer submitted online with the RFP shall be evaluated based on annual transmission charges for all components covered under the package as quoted by the bidder. The transmission charges of initial offer shall be ranked on the basis of ascending order for determination of the qualified bidders. Bidders in the first 50% of the ranking (with any fraction rounded off to higher integer) in RFP stage or 4 (four) bidders, whichever is more shall qualify to participate in the e-reverse bidding. In case the number of responsive bidders in RFP stage is between 2 (two) to 4 (four), all will qualify to participate in the e-reverse bidding. In case only one Bidder remains after the responsiveness check, the initial offer of such Bidder shall not be opened and the matter shall be referred to the Government. In the event of identical transmission charges discovered from the initial offer having been submitted by one or more bidders, all such bidders shall be assigned the same rank for the purpose of determination of qualified bidders. In such cases, all the bidders who share the same rank till 50% of the ranks determined above, shall qualify to participate in the e-reverse bidding. In case, 50% of the ranks (with any fraction rounded off to higher integer) is having less than 4 (four) bidders and the rank of the fourth bidder is shared by more than 1 (one) bidder, then all such bidders who share the rank of the fourth bidder shall qualify to participate in the e-reverse bidding. The lowest transmission charges discovered from the initial offers will be the ceiling price for the next round i.e e-reverse bidding stage. During the e-reverse bidding stage, the qualified bidders in the RFP stage would be required to place their bids at least 0.25% lower than the prevailing lowest bid, as long as they wish to continue in the reverse auction. The initial period for conducting the e- reverse bidding should be 2 hours which will be extended by 30 minutes from the last received bid time, if the bid is received during the last 30 minutes of the scheduled or extended bid time. Subsequently, it will be extended again by 30 minutes from the latest received bid time. Illustration (i) If there are 10 bidders who are holding ranks as L1, L2, L3, L4, L5, L6, L7, L8, L9, L10 in such a case the 50% of the ranks i.e. 5 is having 5 bidders. Accordingly, total 5 bidders i.e L1, L2, L3, L4, L5 will be qualified to participate in reverse auction.[भाग I—खण् ड 1] भारत का रािपत्र : असाधारण 39 (ii) If there are 8 bidders who are holding ranks as L1, L1, L2, L2, L2, L3, L4, L5, in such a case the 50% of the ranks (rounded of to next higher integer) i.e. 3 is having 6 bidders. Accordingly, now total 6 bidders i.e. L1, L1, L2, L2, L2, L3 will be qualified to participate in reverse auction. (iii) If there are 8 bidders who are holding ranks as L1, L2, L3, L4, L4, L5, L5, L6, in such a case the 50% of the ranks i.e. 3 is having only 3 bidders and the rank of the fourth bidder is shared between 2 bidders. Accordingly, now total 5 bidders i.e. L1, L2, L3, L4, L4 will be qualified to participate in reverse auction. 9.4.8. The RFP will also specify the bid bond as well as the Contract Performance Guarantee that the bidders will have to furnish. 9.4.9. The proposed indemnification arrangement between the TSP and the Nodal Agency (in case of inter state projects) / the TSP and the utilities (in case of intra state projects) will also be provided in the TSA. This indemnification will be applicable to both the TSP and the Nodal Agency/utilities from the effective date of the TSA. 9.4.10. The TSA shall also specify the liquidated damages that shall apply in event of delay in start of providing the transmission services. 9.4.11. The TSA shall also specify the technical, operational and safety criteria to be met by bidder/TSP. 9.4.12. The TSP will have to obtain Transmission License from Appropriate Commission in accordance with relevant regulations. 9.5. BPC may call a pre bid conference with all prospective bidders, who have sought documents for RFP stage. In case the bidders seek any project specific deviations and BPC finds that those deviations are reasonable, the BPC may agree to such deviations, with reasoning for acceptance of such deviations. The clarification/revised-bidding document shall be given to all who had sought the RFP document informing about the deviations and clarifications. Wherever revised bidding documents are issued, the BPC shall provide bidders at least fifteen (15) days after issue of such documents for submission of bids. 9.6. Bid submission and evaluation To ensure competitiveness, the minimum number of qualified bidders will be two. 9.7. Bid opening committee: 9.7.1. For inter state transmission systems, the bids shall be opened in the office of CEA by a committee comprising of at least one member from CEA and one member from BPC.CEA and BPC can also nominate alternate member from their respective organization so as to ensure availability of one member each from both the organizations on the day of bid opening. 9.7.2. For intra state transmission systems, the STU/ State Government shall constitute a committee for opening of bids with similar composition as for inter state transmission systems or as deemed fit. 9.8. Bid evaluation committee: 9.8.1. For inter state transmission systems, CEA shall constitute a committee for evaluation of the bids with at least one representative from CEA and not less than two representatives from the concerned Regional Power Committees and one independent member. Further, in case project is inter-regional, there shall be at least one representative from every concerned RPC. The independent member shall have expertise in financial matter/bid evaluation. 9.8.2. For intra state transmission systems, the STU/ State Government shall constitute a committee for evaluation of the bids with similar composition as for inter state transmission systems or as deemed fit.40 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC.1] 9.9. The technical bids shall be examined to ensure that the bids submitted meet minimum eligibility criteria set out in the bid documents on all technical evaluation parameters. Only the bids that meet all elements of the minimum technical criteria set out in the bid documents shall be considered for further evaluation on the transmission charges bids. 9.10. The online initial price bids shall be electronically opened by the bid opening committee in presence of the bid evaluation committee. Only the lowest initial offer (s) shall be communicated to all the Qualified Bidders to participate in the e-reverse bidding process. During the e-reverse bidding process only the lowest prevailing bid should be visible to all the qualified bidders on the electronic platform. 9.11. The transmission charge bid shall be rejected if it contains any deviation from the bid documents for submission of the same. 9.12. The lowest transmission charges discovered from the quoted annual transmission charges during the e-reverse bidding process will be considered for the award. In case, no bid is received during the e-reverse bidding stage then the lowest initial offer shall be deemed to be the final offer. 10. Arbitration 10.1. In case of any dispute regarding TSA or tariff, the same will be subject to jurisdiction of the Appropriate Commission under the provisions of the Electricity Act, 2003. 11. Time Table for Bid Process 11.1 A suggested time-table for the Single stage bid process is indicated below. The procurer may give extended time-frame indicated herein based on the prevailing circumstances and such alterations shall not be construed to be deviation from these guidelines. Contract award and conclusion 12.1. After selection and issue of the Letter of Intent (LOI) from the BPC, the selected bidder shall execute the share purchase agreement to acquire the SPV created for the Project to become TSP in accordance with the terms and conditions as finalized in the bid document and execute the TSA. In addition, in case of interstate projects, the TSP shall also execute the agreement(s) required, if any, under Central Electricity Regulatory Commission (Sharing of Inter- State Transmission Charges and Losses) Regulations as amended from time to time within fifteen (15) days from the date of grant of Transmission License from the Commission. 12.2. The TSP shall make an application for grant of transmission license to the Appropriate Commission within five (5) working days from the date of execution of share purchase agreement for acquisition of SPV. 12.3. The BPC shall make the final result of evaluation of all bids public.[भाग I—खण् ड 1] भारत का रािपत्र : असाधारण 41 12.4. The final TSA, along with the certification by the bid evaluation committee, shall be forwarded to the Appropriate Commission, for adoption of tariff discovered from the quoted annual transmission charges during the e-reverse bidding process in terms of Section 63 of the Act. 13. Termination of Transmission Service Agreement 13.1. The Transmission Service Agreement may be terminated by Nodal Agency upon occurrence of any event, as detailed in Transmission Service Agreement. 13.2. Upon termination of Transmission Service Agreement, the Nodal Agency may take steps to bid out the Project again. 14. Repeal and Saving 14.1. The “Tariff based Competitive-bidding Guidelines for Transmission Service” issued on 13th April, 2006 as amended from time to time, are hereby repealed. 14.2. Provided, however, that any agreement signed or action taken prior to the date hereof shall not be affected by such repeal of the said Guidelines of 2006 and shall continue to be governed by the Guidelines repealed hereunder.
