धारा (3) के साथ प(ठत उपधारा (1) के अधीन %द* शि,य- का %योग करते 0ए, भारत के त2कालीन् पया(cid:9)वरण और वन मं5ालय क’
सं6यांक का. आ. 1690 (अ) (cid:1)दनाकं 4 जुलाई, 2014 क’ अिधसूचना Aारा उन सभी Bि,य- क’ जानकारी के िलए %कािशत क’ गई थी
िजनके उससे %भािवत होने क’ संभावना ह ैऔर उसके Aारा उस तारीख स ेसाठ (cid:1)दन क’ अविध के भीतर आ(cid:17)ेप और सुझाव मांगे गए थे
िजस तारीख को उ, अिधसूचना को अंतGवH करने वाले राजप5 क’ %ितयां जनता को उपलIध कराई गई थी ;
और उJत राजप5 क’ %ितयां तारीख 4 जुलाई, 2014 को जनसाधारण को उपलI ध करा दी गई थी ;
और कKLीय सरकार Aारा %Mत ािवत %ाNप अिधसूचना के संबंध मK कोई आ(cid:17)ेप और सुझाव %ाP त नहQ 0ए ह R;

उ, पा(रिMथितक’य संवेदी जोन मK उ^ोग- के %चालन या %संMकरण या उ^ोग- के वग_ का %चालन और %संMकरण करने को %ितिषa
करना आवVयक ह ै;
अतः, अब, केSLीय सरकार, पया(cid:9)वरण (संर(cid:17)ण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ प(ठत पया(cid:9)वरण (संर(cid:17)ण)
अिधिनयम, 1986 (1986 का 29) क’ धारा 3 क’ उप-धारा (2) के खंड (v) और खंड (xiv) के साथ प(ठत उप-धारा (1) Aारा %द*
शि,य- का %योग करते 0ए, ओिडशा राWय मK किपलाश वS यजीव अभयारT य क’ सीमा के चार- ओर 13.15 (cid:1)कलोमीटर तक के
िवMत ा(रत (cid:17)े5 को ओिडशा राWय के किपलाश वS यजीव अभयारT य पा(रिM थितक’य संवेदी जोन (िजसे इसमK इसके पV चात् पा(रिM थितक
संवेदी जोन कहा गया ह)ै के &प मK अिधसूिचत करती ह,ै िजसका िववरण िनdानुसार ह,ै अथा(cid:9)त् :--

अभयारTय क’ सीमा से 500 मीटर से 13.15 (cid:1)कलोमीटर तक ह ैऔर इसका (cid:17)े5 393.87 वग(cid:9) (cid:1)कलोमीटर मK फैला 0आ ह ै।
(2) पा(रिMथ ितक संवेदी जोन पूव (cid:9) क’ ओर 200 43' 55.818'' उ. अ(cid:17)ांश और 850 55' 30.586'' पू. दशे ांतर (उपाबंध I के
मानिच5 का gबद ु िपल सं. 200); पिVच म क’ ओर 200 38' 50.930'' उ. अ(cid:17)ांश और 850 41' 11.524'' पू. दशे ांतर (उपाबंध I के
मानिच5 का gबद ुिपल सं. 1) ; उ*र क’ ओर 200 41' 44.559'' उ. अ(cid:17)ांश और 850 48' 42.827'' पू. दशे ांतर ( उपाबंध I के मानिच5

(3) पा(रिMथितक संवेदी जोन का मानिच5 इनके अ(cid:17)ांश और देशांतर के साथ उउउउपपपपबबबबंधंधंधंध I के &प मK उपाबa हR ।
(4) पा(रिMथितक संवेदी जोन के अंतग(cid:9)त आने वाले iाम- क’ सूची %मुख िबS द ुपर इनके देशांतर और अ(cid:17)ांश के साथ उउउउपपपपााााबबबबधधंंधधंं II के
&प मK उपाबa ह ै।

इस अिधसूचना के %काशन क’ तारीख से एक वष(cid:9) क’ अविध के भीतर, Mथानीय Bि,य- के परामश(cid:9) से, इस अिधसूचना मK संलj न अनुबंध-
के सामंजMय से आंचिलक महायोजना तैयार करेगी ।
(2) उJत आंचिलक महायोजना राWय सरकार मK स(cid:17)म %ािधकारी Aारा अनुमो(cid:1)दत होगी ।
(3) पा(रिMथ ितक संवेदी जोन के िलए आंचिलक महायोजना, राW य सरकार Aारा इस अिधसूचना मK िविन]द\ ट &प मK ऐसी रीित मK
तथा सुसंगत कKLीय और राWय िविधय- के सामंजM य मK भी तथा कKLीय सरकार Aारा जारी माग(cid:9)िनदशl , य(cid:1)द कोई ह-, Aारा तैयार होगी ।
(4) आंचिलक महायोजना सभी संबिधत राW य के िवभाग- के परामश(cid:9) से पया(cid:9)वरणीय और पा(रिM थितक’ िवचार- को समाकिलत
करने के िलए तैयार क’ जाएगी, अथा(cid:9)त्:--
(i) पया(cid:9)वरण ;
(ii) वन ;
(iii) नगर िवकास ;
(iv) पय(cid:9)टन ;
(v) नगरपािलका ;
(vi) राजM व ;
(vii) कृिष ; और
(viii) ओडीशा राWय %दषू ण िनयं5ण बोड (cid:9);
(5) आंचिलक महायोजना अनुमो(cid:1)दत िव^मान भू-उपयोग, अवसंरचना और (cid:1)nयाकलाप- पर कोई िनबoधन अिधरोिपत नहQ करेगी
जब तक (cid:1)क इस अिधसूचना मK और आंचिलक महायोजना मK सभी अवसंरचना के सुधार के िलए और अिधक %भावी और पा(रिM थितक’य
अनुकूल (cid:1)nयाकलाप कारक इस %कार िविन]द\ट न हो ।
(6) आंचिलक महायोजना मK अनाpछा(cid:1)दत (cid:17)े5- के जीणraार, िव^मान जल िनकाय- के संर(cid:17)ण, आवाह (cid:17)े5- के %बंधन, जल-
संभर- के %बंधन, भूतल जल के %बंधन, मृदा और नमी संर(cid:17)ण, Mथानीय समुदाय- क’ आवVयकताs तथा पा(रिMथितक’ और पया(cid:9)वरण से
संबंिधत ऐसे अSय पहलुs, िजन पर tयान दने ा आवVयक ह,ै के िलए उपबंध ह-गे ।
(7) आंचिलक महायोजना सभी िव^मान पूजा M थल-, iाम- और नगरीय बंदोबMत-, वन- के %कार और (cid:1)कM म-, कृिष (cid:17)े5-,
ऊपजाऊ भूिम, ह(रत (cid:17)े5 जैसे उ^ान और उसी %कार के M थान, उ^ान कृिष (cid:17)े5, आ]कड-, झील- और अSय जल िनकाय- का अvयकंन

(8) आंचिलक महायोजना पा(रिMथ ितक संवेदी जोन मK िवकास के पा(रिM थितक अनुकूल िवकास और M थानीय समुदाय- क’ आजीिवका
को सुिनिV चत करते 0ए िविनयिमत होगी ।
3. रररराााा(cid:22)(cid:22)(cid:22)(cid:22)यययय ससससररररककककाााारररर (cid:23)(cid:23)(cid:23)(cid:23)ाााारररराााा (cid:24)(cid:24)(cid:24)(cid:24)ककककएएएए जजजजाााानननन ेे ेेववववााााललललेे ेे उउउउपपपपाााायययय-------- राWय सरकार इस अिधसूचना के उपबंध- को %भावी करने के िलए िनdिलिखत उपाय
करेगी, अथा(cid:9)त् :--
(1) भभभभ--ूू--ूूउउउउपपपपययययोोोोगगगग ---- पा(रिMथ ितक संवेदी जोन मK आमोद-%मोद के %योजन के िलए िचिSहत (cid:1)कए गए वन-, उ^ान-कृिष (cid:17)े5-, कृिष (cid:17)े5-,
पाक_ और खुले Mथान- का वािणिWयक और औ^ोिगक संबa िवकास (cid:1)nयाकलाप- के िलए उपयोग या संप(रवत(cid:9)न नहQ होगा :
परंतु पा(रिMथितक संवेदी जोन के भीतर कृिष भूिम का संप(रवत(cid:9)न, मानीटरी सिमित क’ िसफा(रश पर और राWय सरकार के
पूव(cid:9) अनुमोदन से, Mथानीय िनवािसय- क’ आवासीय ज&रत- को पूरा करने के िलए और पैरा 4 क’ सारणी के Mतंभ (2) के अधीन nम सं.
20, 26, 29 और 34 के सामने सूचीबa (cid:1)nयाकलाप- को पूरा करने के िलए अनुwात ह-गे, अथा(cid:9)त् :-
(i) %दषू ण का(रत न करने वाले लघु उ^ोग ;
(ii) पा(रिMथ ितक’य अनुकूल पय(cid:9)टन (cid:1)nयाकलाप- के िलए पय(cid:9)टक- के अM थायी आवासन के िलए पा(रिM थितक’य अनुकूल
आरामगाह जैसे टटK , लकड़ी के मकान आ(cid:1)द ;
(iii) वषा(cid:9) जल संचयन, और
(iv) कुटीर उ^ोग, िजसके अंतग(cid:9)त iामीण उ^ोग, सुिवधा भंडार और M थानीय सुख-सुिवधाएं ह R:
परंतु यह और (cid:1)क राWय सरकार के पूव(cid:9) अनुमोदन और संिवधान के अनुp छेद 244 या त2समय %वृ* िविध के उपबंध- के
अनुपालन के िबना, िजसके अंतग(cid:9)त अनुसूिचत जनजाित और अSय परंपरागत वन िनवासी (वन अिधकार- क’ माSयता) अिधिनयम, 2006
(2007 का 2) भी ह,ै वािणिWयक या उ^ोग िवकास (cid:1)nयाकलाप- के िलए जनजातीय भूिम का उपयोग अनुwात नहQ होगा :
परंतु यह और भी (cid:1)क पा(रिMथ ितक संवेदी जोन के भीतर भू-अिभलेख- मK पाई जाने वाली कोई 5ु(ट मानीटरी सिमित के िवचार
%ाy करने के पzात् राWय सरकार Aारा %2येक मामले मK केवल एक बार संशोिधत होगी और उ, 5ु(ट के संशोधन क’ भारत सरकार के
पया(cid:9)वरण, वन और जलवायु प(रवत(cid:9)न मं5ालय को सूचना दने ी होगी :
परंतु यह और भी (cid:1)क उपयु(cid:9), 5ु(ट के संशोधन मK इस उप पैरा के अधीन यथा उपबंिधत के िसवाय (cid:1)कसी भी दशा मK भू-उपयोग
का प(रवत(cid:9)न सि{मिलत नहQ होगा :
परंतु यह और भी (cid:1)क ह(रत (cid:17)े5 जैसे वन (cid:17)े5, कृिष (cid:17)े5 मK कोई पा(रणािमक कटौती नहQ होगी और अ%युJ त या अनु2 पादक
कृिष (cid:17)े5- मK पुन: वनीकरण करने के %यास (cid:1)कए जाएंगे ।
(2) (cid:26)(cid:26)(cid:26)(cid:26)ााााककककृृृृििििततततकककक जजजजलललल (cid:30)(cid:30)(cid:30)(cid:30)ोोोोतततत -- आचंिलक महायोजना मK सभी %ाकृितक जल }ोत- क’ पहचान क’ जाएगी और उनके संर(cid:17)ण और पुनन(cid:9)वीकरण
के िलए योजना को सि{म िलत (cid:1)कया जाएगा और राW य सरकार Aारा ऐसी रीित से माग(cid:9)दश(cid:9)क िसaांत बनाए जाएंगे िजससे (cid:1)क उन (cid:17)े5- मK
या इसके समीप िवकास (cid:1)nयाकलाप को रोका जा सके जो ऐसे (cid:17)े5 के िलए हािनकारक हR ।
(3) पपपपयययय(cid:4)ट(cid:4)ट(cid:4)ट(cid:4)टनननन –––– (क) पा(रिMथितक संवेदी जोन के भीतर पय(cid:9)टन संबंधी (cid:1)nयाकलाप, पय(cid:9)टन महायोजना के अनुसार ह-गे, जो आंचिलक
महायोजना का भाग &प ह-गे ।
(ख) पय(cid:9)टन महायोजना ओिडशा सरकार के पय(cid:9)टन िवभाग Aारा राजM व और वन िवभाग के परामश(cid:9) से तयै ार होगी ।
(ग) पय(cid:9)टन संबंधी (cid:1)nयाकलाप िन{ निलिखत के अधीन िविनयिमत ह-गे, अथा(cid:9)त् :-
(i) पा(रिMथितक संवेदी जोन के भीतर सभी नए पय(cid:9)टन (cid:1)nयाकलाप- या िव^मान पय(cid:9)टन (cid:1)nयाकलाप- का िवMतार रा\ ~ीय
(cid:127)य ा(cid:128) संर(cid:17)ण %ािधकरण, पया(cid:9)वरण, वन और जलवायु प(रवत(cid:9)न मं5ालय Aारा जारी (समय-समय पर यथा संशोिधत)
पा(रिMथितक पय(cid:9)टन के अनुसरण मK माग(cid:9)िनदशे - के अनुसार होगा िजसमK पा(रिMथितक पय(cid:9)टन, पा(रिMथितक िश(cid:17)ा और
पा(रिMथितक िवकास को मह2व (cid:1)दया जाएगा और पा(रिMथितक संवेदी जोन क’ वहन (cid:17)मता के अtययन पर आधा(रत होगा ;
(ii) पा(रिMथ ितक अनुकूल पय(cid:9)टन (cid:1)nयाकलाप- के संबंध मK पय(cid:9)टक- के िलए अM थायी वास-सुिवधा के िसवाय किपलाश वS यजीव
अvय ारTय क’ सीमा के एक (cid:1)कलोमीटर के भीतर होटल- और (रसाट_ के नए संिनमा(cid:9)ण अनुwात नहQ ह-गे ;
परंतु यह (cid:1)क संरि(cid:17)त (cid:17)े5- क’ सीमा से एक (cid:1)कलोमीटर क’ दरू ी के परे पा(रिM थितक संवेदी जोन के िवM तार तक नए
भवन- और (रसाट_ के Mथ ापन को केवल पूव(cid:9) प(रभािषत, पदािविहत (cid:17)े5- मK पय(cid:9)टन महायोजना के अनुसार पा(रिM थितक’य
पय(cid:9)टन सुिवधाs के िलए अनुwात (cid:1)कया जाएगा ।
(iii) आंचिलक महायोजना का अनुमोदन (cid:1)कए जाने तक, पय(cid:9)टन के िलए िवकास और िव^मान पय(cid:9)टन (cid:1)nयाकलाप- के िवMतार
को वाMतिवक Mथल िविन]दH संवी(cid:17)ा तथा मानीटरी सिमित क’ िसफा(रश पर आधा(रत संबंिधत िविनयामक %ािधका(रय-

(4) ननननैसैसैसैस""""गगगगकककक ििििववववररररााााससससतततत -------- पा(रिMथितक संवेदी जोन मK मह2वपूण(cid:9) नैसGगक िवरासत के सभी Mथल- जैसे सभी जीन कोश आरि(cid:17)त (cid:17)े5, शैल
िवरचनाएं, जल %पात-, झरन-, घाटी माग_, उपवन-, गुफाs, Mथल-, (cid:129)मण, अ(cid:130)रोहण, %पातो आ(cid:1)द क’ पहचान क’ जाएगी और उSह K
प(ररि(cid:17)त (cid:1)कया जाएगा तथा उनक’ सुर(cid:17)ा और संर(cid:17)ा के िलए इस अिधसूचना के %काशन क’ तारीख से छह मास के भीतर, उपयु,
योजना बनाई जाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगी ।

मह2व के (cid:17)े5- और अहात- क’ पहचान क’ जाएगी और इस अिधसूचना के %काशन क’ तारीख से छह मास के भीतर उनके संर(cid:17)ण क’
योजनाए ंतैयार क’ जाएंगी तथा आंचिलक महायोजना मK सि{मिलत क’ जाएंगी ।
(6) $$$$वव वव ििििनननन (cid:26)(cid:26)(cid:26)(cid:26)ददददषषषषूूूू णणणण -- पा(रिMथितक संवेदी जोन मK t विन %दषू ण के िनयं5ण के िलए राW य सरकार का पया(cid:9)वरण िवभाग वायु (%दषू ण
िनवारण और िनयं5ण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयम- के उपबंध- के अनुसरण मK माग(cid:9)दश(cid:9)क
िसaांत और िविनयम तैयार करेगा ।

MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE
NOTIFICATION
New Delhi, the 17th June, 2015
S.O.1659(E).—Whereas, a draft notification under sub-section (1), clause (v) and clause (xiv) of sub-section
(2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) was published, as required
under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, vide notification of the Government of India in
the Ministry of Environment Forest and Climate Change number S.O. 1690 (E), dated the 4th July, 2014, inviting
objections and suggestions from all persons likely to be affected thereby, within a period of sixty days from the date on
which copies of the Gazette containing the said notification were made available to the public;
And, Whereas, copies of the said Gazette were made available to the public on 4th July, 2014;
And, Whereas, no objection and suggestion received in respect of the proposed draft notification by the Central
Government;
Whereas, the Kapilash Wildlife Sanctuary (hereinafter referred to as the Sanctuary) lies in the Dhenkanal
District of Odisha State within the Kapilash Reserve Forest covering an area of 125.5 square kilometers without any
human settlement;
And, Whereas, the forest of this Sanctuary intercept rainfall and help recharge ground water aquifer, protect
rivers and streams against siltation by minimising soil erosion and has well-knit network of perennial or semi-perennial¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 11
and seasonal streams, nalas or rivers which feed minor irrigation projects and water harvesting structures and are
tributaries to the river Brahmani;
And, Whereas, the sanctuary is an excellent habitat for Asian Elephants and some of the most endangered
species like Elephant (Elephas maximus), Hyena (Hgaena hyaena), Spotted Deer (Axix axis), Sambar (Ceruus unicolor),
Wolf (Canis lupus), Bears (Melursus ursinusl), Sloth Bears, Common Longoors, Jackal (Canis aureus), Fox (Vulpes
bengalensis), Hares (Lepus nigricottis), Wild Boar (Sus scrofa), porcupines (Hystrix indica), Peacocks (Pavo cristatus),
varieties of Birds, Snakes, Lizards etc;
And, Whereas, the sanctuary is an excellent habitat for flora with Sal i.e. Shorea robusta as the dominant
species along with the associates like Kasi (Brdelia retusa), Simul (Bombax ceiba), Kangara (Xylia xylocarpa), Sidha
(Albizia lebbek), Phasi (Anogeissus accuminata), Kendu (Diospgrous melanoxylon), Jamu (Syzygium anminfi), Amla
(Emblica officinalis), Mango (Mangifera indica), Asan (Terminalia alata), Bija (Pterocarpus marsupium), Kurum
(Adina cordifulia), Teak (Tectona grandis), Dhaura (Anogeisus latifolia), Kadamba (Anthocephalus kadamba), Karanja
(Pongamia pinnata), Kusum (Schleichera oleosa), Mundi (Sphaeranthus indica), Mahul (Madhuca indica), Bela (Aegle
marmelos), Gmabhari (Gmelina arborea), Kanchan (Bauhinia acuminata), etc;
And Whereas, it is necessary to conserve and protect the area to the extent and boundaries of which are
specified in paragraph 1 of this notification, around the protected area of the Kapilash Wildlife Sanctuary as Eco-
sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their
operations and processes in the said Eco-sensitive Zone;
Now, Therefore, in exercise of the powers conferred by sub-section (1) read with clause (v) and clause (xiv) of
sub-section (2) of Section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of
the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent upto 13.15
kilometers from the boundary of the Kapilash Wildlife Sanctuary in the State of Odisha as the Kapilash Wildlife
Sanctuary Eco-sensitive Zone, details of which are as under, namely:-
1. Extent and Boundaries of Eco-sensitive Zone.-(1) The extent of Eco-sensitive Zone varies from 500 meters
to 13.15 kilometers from the boundary of the Kapilash Wildlife Sanctuary covering geographical area of 393.87 square
kilometers.
(2) The Eco-sensitive Zone is bounded by 20º 43’ 55.818"N latitude and 85º55’ 30.586"E longitude towards East
(point pill No.200 of Annexure I map); 20º 38’ 50.930"N latitude and 85º 41’ 11.524"E longitude towards west (point
pill No.1 of Annexure I map); 20º 41’ 44.559"N latitude and 85º 48’ 42.827"E longitude towards north (point pill
No.100 of Annexure I map) and 20º 38’ 20.393"N latitude and 85º 44’ 55.087"E longitude towards south (point pill
No.300 of Annexure I map).
(3) The map of Eco-sensitive Zone boundary along with latitudes and longitudes is appended as Annexure I.
(4) The list of villages falling within the Eco-sensitive Zone along with their longitudes and latitudes at prominent
point are appended as Annexure II.
2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco-
sensitive Zone prepare a Zonal Master Plan, within a period of one year from the date of publication of this notification
in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification.
(2) The Zonal Master Plan shall be approved by the Competent Authority in the State Government.
(3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such a manner
as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines
issued by the Central Government, if any.
(4) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:-
(i) Environment;
(ii) Forest;
(iii) Urban Development;
(iv) Tourism;
(v) Municipal;
(vi) Revenue;
(vii) Agriculture; and
(ix) Odisha State Pollution Control Board,
for integrating environmental and ecological considerations into it.
(5) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and
activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all
infrastructure and activities to be more efficient and eco-friendly.
(6) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies,
management of catchment areas, watershed management, ground water management, soil and moisture conservation,
needs of local community and such other aspects of the ecology and environment that need attention.12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(7) The Zonal Master Plan shall demarcate all the existing places of worship, village and urban settlements, types
and kinds of forests, agricultural areas, fertile lands, green area, such as parks and like places, horticultural areas,
orchards, lakes and other water bodies.
(8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure Eco-friendly
development and livelihood security of local communities.
3. Measures to be taken by State Government.-The State Governments shall take the following measures for
giving effect to the provisions of this notification, namely:-
(1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes
in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development
activities:
Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the
recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the
residential needs of local residents, and for the activities listed against serial numbers 20, 26, 29 and 34 in column (2) of
the Table in paragraph 4, namely:-
(i) Small scale industries not causing pollution;
(ii) Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, for Eco-friendly
tourism activities;
(iii) Rainwater harvesting; and
(iv) Cottage industries including village artisans, convenience stores and local amenities:
Provided further that no use of tribal land shall be permitted for commercial and industrial development
activities without the prior approval of the State Government and without compliance to the provisions of article 244 of
the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest
Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by
the State Government, after obtaining the views of the Monitoring Committee, in each case and the correction of said
error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as
provided under this sub-paragraph:
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural
area and efforts shall be made to afforest the unused or unproductive agricultural areas.
(2) Natural springs.-The catchment areas of all natural springs shall be identified and plans for their conservation and
rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State
Government in such a manner so as to prohibit development activities at or near these areas which are detrimental to
such areas.
(3) Tourism.-(a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan,
which shall form part of the Zonal Master Plan.
(b) The Tourism Master Plan shall be prepared by the Department of Tourism, Government of Odisha in consultation
with the Departments of Revenue and Forests.
(c) The activity of tourism shall be regulated as under, namely:-
(i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in
accordance with the eco-tourism guidelines issued by the National Tiger Conservation Authority, Ministry of
Environment, Forest and Climate Change (as amended from time to time) with emphasis on eco-tourism, eco-education
and eco-development;
(ii) Construction of new hotels and resorts shall not be permitted within one kilometre from the boundary of the
Kapilash Wildlife Sanctuary except accommodation for temporary occupation of tourists related to Eco-friendly tourism
activities:
Provided that beyond the distance of one kilometre from the boundary of the Protected Areas till the extent of
the Eco-sensitive Zone, the establishment of new hotels and resorts shall be permitted only in pre-defined and designated
areas for Eco-tourism facilities as per the Tourism Master Plan;
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities
shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation
of the Monitoring Committee.
(4) Natural heritage. - All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve
areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 13
preserved and plan shall be drawn up for their protection and conservation, within six months from the date of
publication of this notification and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural,
aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and plans for their conservation shall be
prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.
(6) Noise pollution.- The Environment Department of the State Government shall draw up guidelines and regulations
for the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and
Control of Pollution) Act, 1981(14 of 1981)and the rules made thereunder.
(7) Air pollution.- The Environment Department of the State Government shall draw up guidelines and regulations for
the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and
Control of Pollution) Act, 1981 (14 of 1981)and the rules made thereunder.
(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the
provisions of the Water (Prevention and Control of Pollution) Act, 1974(6 of 1974) and the rules made thereunder.
(9) Solid wastes. - Disposal of solid wastes shall be as under. –
(a) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Municipal Solid Waste
(Management and Handling) Rules, 2000 published by the Government of India in the erstwhile Ministry of
Environment and Forests vide notification number S.O. 908 (E), dated the 25th September, 2000 as amended from time
to time;
(b) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable
components;
(c) the biodegradable material shall be recycled preferably through composting or vermiculture;
(d) the inorganic material shall be disposed of in an environmentally acceptable manner at sites identified outside the
Eco-sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical waste.-The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the
provisions of the Bio-Medical Waste (Management and Handling) Rules, 1998 published by the Government of India in
the erstwhile Ministry of Environment and Forests vide Notification number S.O. 630(E), dated the 20th July, 1998 as
amended from time to time.
(11) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific
provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master plan is
prepared and approved by the Competent Authority in the State Government. The Monitoring Committee shall monitor
compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.-All activities in the Eco-
sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules
made thereunder and shall be regulated in the manner specified in the Table below, namely:-

No.202 of 1995 and dated 21.04.2014 in the matter of
Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012.
2. Setting up of saw mills. No new and expansion of existing saw mills shall be

3. Setting up of industries causing water or air or No new or expansion of existing polluting industries
soil or noise pollution. shall be permitted within the Eco-sensitive Zone.
4. Commercial use of firewood. Prohibited (except as otherwise provided) as per
applicable laws.
5. Establishment of new major hydroelectric Prohibited (except as otherwise provided) as per
projects. applicable laws.
6. Use of plastic carry bags. Prohibited (except as otherwise provided) as per
applicable laws.
7. Use or production of any hazardous substances. Prohibited (except as otherwise provided) as per
applicable laws.
8. Undertaking activities related to tourism like Prohibited (except as otherwise provided) as per
over-flying the sanctuary area by hot-air applicable laws.

B. Regulated Activities:
10. Felling of trees. (a) There shall be no felling of trees in the forest land or
Government or revenue or private lands without prior
permission of the competent authority in the State
Government.
(b) The felling of trees shall be regulated in accordance
with the provisions of the concerned Central or State
Act and the rules made there under.
11. Commercial establishment of hotels and resorts. No new commercial hotels and resorts shall be
permitted within one kilometer of the boundary of the
Protected Area except accommodation for temporary
occupation of tourists related to Eco-friendly tourism
activities. However, beyond one kilometer and upto the
extent of the Eco-sensitive Zone all new tourism
activities or expansion of existing activities would be in
conformity with the Tourism Master Plan and
guidelines of the National Tiger Conservation
Authority.
12. Commercial water resources including ground (a)The extraction of surface water and ground water
water harvesting. shall be permitted only for bona fide agricultural use
and domestic consumption of the occupier of the land.
(b) The extraction of surface water and ground water for
industrial or commercial use including the amount that
can be extracted shall require prior written permission
from the concerned Regulatory Authority.
(c) No sale of surface water or ground water shall be
permitted.
(d) Steps shall be taken to prevent contamination or
pollution of water from any source including
agriculture.
13. Erection of electrical cables and Promote underground cabling.

20. Small scale industries not causing pollution. Non-polluting, non-hazardous, small-scale and service

goods from the Eco-sensitive Zone which do not cause
any adverse impact on environment shall be permitted.

27. Construction activities. (a) No new commercial construction of any kind shall
be permitted within one kilometer from the boundary of

undertake construction in their land for their residential

paragraph 3:
Provided further that the construction activity related to
small scale industries not causing pollution shall be
regulated and kept at the minimum, with the prior
permission from the Competent Authority as per
applicable rules and regulations, if any.
(b) beyond one kilometer upto the extent of Eco
sensitive Zone construction for bona fide local needs
shall be permitted and other construction activities shall
be regulated as per Zonal Master Plan.
(c) construction activity in the ESZ shall be as per Zonal
Master Plan.
C. Permitted Activities:
28. Ongoing agriculture and horticulture practices Permitted under applicable laws.

Monitoring Committee.- (1) The Central Government hereby constitutes a Monitoring Committee, for effective
monitoring of the Eco-sensitive Zone, which shall comprise of the following, namely:-
(i) The District Collector, Dhenkanal District, Government of Odisha - Chairman;
(ii) Concerned Superintendent of Police - Member;
(iii) Concerned representative of Collector cuttack - Member;
(iv) Representative of the Ministry of Environment, Forests and Climate Change – Member;
(v) Regional Officer, Odisha State Pollution Control Board-Member;
(vi) Expert in the field of Environment Wildlife and Ecology to be nominated by the Government of
Odisha for a period of one year in each case - Member;
(vii) One representative of Non-governmental Organizations working in the field of environment to be
nominated by the Government of Odisha for a period of one year in each case– Member;
(viii) Concerned Divisional Forests Officers - Member; and
(ix) Divisional Forests Officer, Dhenkanal Forest Division– Member Secretary.
Terms of Reference:
(2) The Monitoring Committee shall monitor the compliance of the provisions of this Notification.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile
Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006, and are falling in
the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof,
shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to
the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental
clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the
erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006 and are
falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph
4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and
referred to the concerned Regulatory Authorities.
(5) The Member Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be
competent to file complaints under section 19 of the Environment (Protection) Act, 1986 (29 of 1986) against
any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments,
representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending
on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of
every year by 30th June of that year to the Chief Wild Life Warden of the State as per pro-forma appended at
Annexure III.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such
directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
6. The Central Government and State Government may specify additional measures, if any, for giving effect to the
provisions of this notification.
7. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble
Supreme Court of India or the High Court or National Green Tribunal.
