Any person interested in making any objections or suggestions on the proposals contained in the draft notification may do so in writing within the period so specified through post to the Secretary, Ministry of Environment, Forest and Climate Change, Indra Paryavaran Bhawan, Jor Bagh Road, New Delhi – 110 003, or electronically at e-mail address: gyanesh.bharti@ias.nic.in or sharath.kr@gov.in4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Draft Notification Whereas, the Central Government has mandated the requirement of prior environmental clearance for the projects and activities mentioned in the notification S.O. No 1533 (E) dated 15th September 2006 and its subsequent amendments. This process of preparation of environment impact assessment report and environment management plan ensures that the adverse environmental impacts of the projects and activities are assessed, studied and mitigation measures are taken in implementation of the project to avoid or minimize the adverse environmental impacts of the project and activities; Whereas, based on the appraisal and recommendations of the Expert Appraisal Committees in the Central Government and State Level Expert Appraisal Committees in the States, District Environment Impact Assessment Authority in the Districts, the authority grants prior environmental clearance with stipulated environmental safeguards in the form of environmental clearance conditions; Whereas, the process obligates the project proponent to file six-monthly compliance status against the environmental clearance conditions, compliance of which is also checked and certified by the Regional Offices of the Ministry; Whereas, to improve the compliance status of the implementation of the environmental clearance conditions of the projects and activities granted environmental clearance by the Ministry of Environment, Forest and Climate Change for the projects of Category A, the State Environment Impact Assessment Authority and for the projects of Category B, the District Environment Impact Assessment Authority, the Central Government proposes to introduce the concept of randomised third party compliance monitoring of the environment clearance conditions through national level reputed and competent government institutions to be empanelled by the Ministry; The following shall be inserted after sub para (iv) of para 10 of the Environment Impact Assessment Notification, 2006 as amended “10(v) notwithstanding the above provisions, the ministry will empanel government institutions of national repute for carrying out compliance monitoring of Environment Clearance conditions of projects and activities. The compliance monitoring will be done inter-alia against the baseline information available in the Environmental Impact Assessment report, Environmental Management Plan appraised by EAC, terms and conditions of the Environmental Clearance as well as other provisions as may be specified by the ministry from time to time.” [No. 22-48/2017-IA.III GYANESH BHARTI, Jt.
