L.-33004/99 सी.जी.-डी.एल.-अ.-13052023-245867 xxxGIDHxxx CG-DL-E-13052023-245867 xxxGIDExxx ऄसाधारण EXTRAORDINARY भाग III—खण् ड 4 PART III—Section 4 प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 319] नइ ददल्ली, िुक्रिार, मइ 12, 2023/ििै ाख 22, 1945 No. 319] NEW DELHI, FRIDAY, MAY 12, 2023/ VAISAKHA 22, 1945 भारतीय खाद्य सरु क्षा और मानक प्राजधकरण ऄजधसचू ना नइ ददल्ली, 11 मइ, 2023 फा.स.ंमानक/एसपी-21/टी(ऄल्कोहल-6).—खाद्य सुरक्षा और मानक (ऄल्कोहाजलक पेय) जिजनयम, 2018 में अग े संिोधन,जो भारतीय खाद्य सरु क्षा और मानक प्राजधकरण, केन्‍द रीय सरकार के पूि ु ऄनुमोदन से, खाद्य सुरक्षा और मानक ऄजधजनयम, 2006 (2006 का संखयांक 34) की धारा 92 की ईप-धारा (2) के खंड (फ) द्वारा प्रदत् त िजियों का प्रयोग करते हुए करना चाहती ह,ै करने के जलए आन जिजनयमों का प्रारूप आससे प्रभाजित हो सकने िाले सभी व्यजियों की सूचना के जलए ईि ऄजधजनयम की धारा 92 की ईप-धारा (1) की ऄपेक्षानुसार एतदद्वारा प्रकाजित की जाती ह ै और एतदद्वारा यह नोटटस ददया जाता ह ैदक ईि प्रारूप जिजनयमों पर ईस जतजथ से साठ ददनों की ऄिजध समाप्त होने के बाद जिचार दकया जाएगा, जजस जतजथ को आस ऄजधसूचना को प्रकाजित करन े िाले राजपत्र की प्रजतयााँ जनता को ईपलब्ध कराइ जाएाँगी यदद कोइ अपजि या सुझाि हो तो ईसे मखु य कायुकारी ऄजधकारी, भारतीय खाद्य सरु क्षा और मानक प्राजधकरण, एफडीए भिन, कोटला रोड, नइ ददल्ली – 110002 को ऄथिाregulation@fssai.gov.in पर इ-मेल के माध्यम से भेजे जा सकते ह ैं ईि प्रारूप जिजनयमों के संबंध में दकसी व्यजि से आस प्रकार जनधाुटरत जतजथ तक प्राप्त अपजियों और सुझािों पर भारतीय खाद्य सुरक्षा और मानक प्राजधकरण द्वारा जिचार दकया जायेगा प्रारूप जिजनयम 1. आन जिजनयमों को खाद्य सुरक्षा और मानक (ऄल्कोहाजलक पेय) संिोधन जिजनयम, 2023 कहा जाएगा 3106 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] 2. खाद्य सुरक्षा और मानक (ऄल्कोहाजलक पेय) जिजनयम, 2018 के, - (1) भाग-1 में, (क) 'पटरभाषाए'ाँ से संबंजधत जिजनयम 1.2 म,ें ईप-जिजनयम 1.2.12 के बाद जनम्नजलजखत ऄंतःस्ट्थाजपत दकया जाएगा, ऄथाुत,् - "1.2.12क. "रेडी-टू-ड्रिंक/कम ऄल्कोहाजलक पेय पदाथ ु कम ऄल्कोहल िाले सुिासीकृत पेय पदाथों को कहा जाएगा, जजनमें ऄल्कोहलकी 0.5 से 8.0% अयतन मात्रा हो और जजन्‍दह ें जस्ट्पटरट या जस्ट्पटरट के जमश्रण या बेस के रूप म ें िाआन और जबयर के ऄलािा दकसी भी ऐल्कोहोजलक पेय पदाथ ु से, ईसमें खाद्य सुरक्षा और मानक (एफपीएस एंड एफए) जिजनयम 2011 के ऄधीन ऄनुमत प्राकृजतक/ प्राकृजतक जैसा/कृजत्रम सुिासकारक और/ या खाद्य सहयोज्य जमलाकर; और/या फल/सब्जी का रस चीनी/नमक के साथ या ईसके जबना जमलाकर और काबोनेिन करके या जबना दकए बनाया गया हो काबोनेटेड रेडी-टू-ड्रिंक (अरटीडी)/ कम ऄल्कोहाजलक पेय पदाथों के मामले म,ें ईन्‍दह ें काबुन डाआऑक्साआड के साथ काबोनेट दकया जाएगा हालांदक, काबोनेटेड अरटीडी/कम ऄल्कोहाजलक पेय पदाथों म ें काबुन डाआऑक्साआड न्‍दयनू तम एक अयतन होनी चाजहए ये पेय पदाथ ु सारणी-4 की ऄपेक्षाओं के ऄनरूु प होंगे]" (ख) जिजनयम 1.3 म,ें ईप-जिजनयम 1.3.9 म,ें "जजस ऄल्कोहाजलक पेय पदाथु म ें" से िरूु होने िाले और "सारणी- 4 की ऄपक्षे ाएाँ" के साथ समाप्त होने िाले परंतुक के स्ट्थान पर जनम्नजलजखत प्रजतस्ट्थाजपत दकया जाएगा, ऄथाुत,् - "जजस ऄल्कोहाजलक पेय पदाथ ु में ऄल्कोहल की अयतन मात्रा 0.5 प्रजतित से ऄजधक हो ककतु 8.0 प्रजतित से ऄजधक नहीं हो, ईन्‍दह ें रेडी-टू-ड्रिंक/कम ऄल्कोहाजलक पेय कहा जाएगा य े पेय पदाथ ु जिजनयम 1.2 के ऄधीन दी गइ पटरभाषा और सारणी-4 की ऄपेक्षाओं के ऄनरूु प होंगे ऐसे ईत्पादों के संबंध में ईत्पाद का नाम/संघटक/कच्ची सामग्री की जानकारी आन जिजनयमों के ऄनुबंध-1 में दी गइ ह,ै जो पटरपूण ु नहीं ह ै " (2) भाग 2 म,ें देिी िराब से संबंजधत जिजनयम 2.2 के स्ट्थान पर जनम्नजलजखत प्रजतस्ट्थाजपत दकया जाएगा, ऄथाुत,् - "2.2 देिी िराब/भारतीय िराब: देिी िराब/भारतीय िराब या जस्ट्पटरट कृजष मूल के दकण्िन काबोहाआिंेट के असुत से प्राप्त िराब ह ै देिी िराब / भारतीय िराब जनम्न प्रकार की भी हो सकती ह:ैं 2.2.1 सादा देिी िराब / सादा भारतीय िराब: सादा देिी िराब / सादा भारतीय िराब दकजण्ित गुड़, गुड़, ऄनाज, अल,ू कसािा, फल, नाटरयल और खजूर के पड़े के रस या ऄकु, महुअ के फूल या कृजष मूल के कोइ ऄन्‍दय काबोहाआिंेट से प्राप्त ऐल्कोहोजलक असि से बनाया जाएगा 2.2.2 जमजश्रत देिी िराब / जमजश्रत भारतीय िराब: जमजश्रत देिी िराब / जमजश्रत भारतीय िराब ऐल्कोहोजलक असि, पटरिोजधत जस्ट्पटरट या न्‍दयूरल जस्ट्पटरट के जमश्रण को कहा जाएगा देिी िराब / भारतीय िराब, भाग 1 में जिजनर्ददष्ट सामान्‍दय ऄपेक्षा और सारणी - 1 में जिजनर्ददष्ट ऄपेक्षाओं के ऄनुरूप भी होगी ऐसे ईत्पादों के संबंध म ें ईत्पाद का नाम / सघं टक/ कच्ची सामग्री की जानकारी आन जिजनयमों के ऄनुबंध -1 में दी गइ ह,ै जो पटरपूणु नहीं ह ै ” (3) भाग-3 में, जिजनयम 3.1 म,ें (क) "एक मौसम की िाआन की ईपज" से िुरू होने िाले और "ड्रिटेज िाआन" के साथ समाप्त होने िाले परंतुक के बाद जनम्नजलजखत ऄतं ःस्ट्थाजपत दकया जाएगा, ऄथाुत,् - "ऐसे ईत्पादों के संबंध में ईत्पाद का नाम/संघटक/कच्ची सामग्री की जानकारी आन जिजनयमों के ऄनुबंध-1 में दी गइ ह,ै जो पटरपूण ु नहीं ह ै " (ख) ईप-जिजनयम 3.1.4 म,ें िीषुक "ऄंगरू के ऄलािा ऄन्‍दय फलों से प्राप्त िाआन" के स्ट्थान पर जनम्नजलजखत प्रजतस्ट्थाजपत दकया जाएगा, ऄथाुत,् - "िहद स ेजनर्ममत िाआन सजहत फल से बनी िाआन (ऄगं ूर से जनर्ममत िाआन के ऄलािा)" (ग) ईप-जिजनयम 3.1.4 म,ें खंड 3.1.4.3 के बाद, जनम्नजलजखत ऄतं ःस्ट्थाजपत दकयाजाएगा, ऄथाुत,् - "3.1.4.4 िहद स े बनी िाआन/मीड: िहद से बनी िाआन/मीड दकसी ऄन्‍दय काबोहाआिंेट स्रोत को जमलाए जबना खमीर द्वारा िहद के जलीय घोल के दकण्िन से ईत्पाददत िाआन होती ह ै यह िाआन सारणी-2 में दी गइ ऄपेक्षाओं के ऄनरूु प होगी "[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 3 (घ) ईप-जिजनयम 3.1.5 के स्ट्थान पर जनम्नजलजखत प्रजतस्ट्थाजपत दकया जाएगा, ऄथाुत,् - "ऄन्‍दय कृजष और पौध े संबंधी स्रोतों से प्राप्त िाआन (डब्ल्यूएपीएस) ऄन्‍दय कृजष और पौध े संबंधी स्रोतों स े प्राप्त िाआन, चीनी या गड़ु जमलाकर या जबना जमलाए रस या ऄकु या साबुत ऄनाज या ऄन्‍दय कृजष और पौध े संबंधी स्रोतों के सामान्‍दय ऐल्कोहोजलक दकण्िन द्वारा ईत्पाददत की जाएगी आसम ें जनम्नजलजखत िाजमल हो सकते ह:ैं" (ङ) िाआन अधाटरत पेय से सबं ंजधत ईप-जिजनयम 3.1.6 म,ें "या कोइ ऄन्‍दय ऄनुमोददत पदाथु" िब्दों के साथ समाप्त होने पर जनम्नजलजखत ऄतं ःस्ट्थाजपत दकया जाएगा, ऄथाुत्, - "िाआन अधाटरत पेय काबोनेटेड हो भी सकत े ह ैंऔर नहीं भी " (5) भाग 4 म,ें िंॉट जबयर से संबंजधत जिजनयम 4.2 म,ें क्राफ्ट जबयरसे संबंजधत ईप-जिजनयम 4.2 (1) के बाद, जनम्नजलजखत ऄंतःस्ट्थाजपत दकया जाएगा, ऄथाुत,् - "4.2 (1) (i) नाआरो क्राफ्ट जबयर- नाआरो क्राफ्ट जबयर CO और N गैस के जमश्रण से बनी क्राफ्ट जबयर को 2 2 कहते ह ैं " (6) सारणी संखया 2 में, (क) स्ट्तंभ संखया 7, िीषुक में, "ऄगं ूर िाइन के ऄलािा फलों की िाइन " िब्दों के बाद जनम्नजलजखत ऄंतःस्ट्थाजपत दकया जाएगा, ऄथाुत,् - "िहद से जनर्ममत िाआन सजहत" (ख)स्ट्तंभ संखया 5, िीषुक “ देिी िराब या सादा देिी िराब” को जनम्नानुसार संिोजधत दकया जाएगा: देिी िराब / भारतीय िराब या सादा देिी िराब / सादा भारतीय िराब (ग) स्ट्तंभ संखया 6, पंजि संखया 1 म,ें “जमजश्रत देिी िराब” में जनम्नानुसार संिोधन दकया जाएगा: जमजश्रत देिी िराब/जमजश्रत भारतीय िराब (7) सारणी 2 म,ें "िाआन अधाटरत पेय पदाथ"ु िब्दों से िरूु होन े िाले और "आथाइल ऐल्कोहल कंटेंट" के साथ समाप्त होने िाले फुट नोट के स्ट्थान पर जनम्नजलजखत प्रजतस्ट्थाजपत दकया जाएगा, - "िाआन अधाटरत पेय पदाथ ुजिजिष्ट आथाइल ऐल्कोहल कंटेंट को छोड़कर, टेबल िाआन के मानकों के ऄनरूु प होंगे " (8) सारणी 3 म,ें (क) कॉलम संखया 7 के बाद क्राफ्ट जबयर श्रेणी के ऄतं गतु जनम्नजलजखत ऄतं ःस्ट्थाजपत दकया जाएगा: स्ट्रांग No. STD/SP-21/T(Alcohol-6).—The following draft of certain regulations, further to amend the Food Safety and Standards (Alcoholic Beverages) Regulations, 2018, which the Food Safety and Standards Authority of India proposes to make with previous approval of the Central Government, in exercise of the powers conferred by clause (v) of sub-section (2) of section 92 of the Food Safety and Standards Act, 2006 (34 of 2006) is hereby published as required by the said sub-section (1) of section 92 of the said Act, for the information of all persons likely to be affected thereby and notice is hereby given that the said draft regulations shall be taken into consideration after the expiry of the period of sixty days from the date on which copies of the Official Gazette in which this notification is published are made available to the public; Objections and suggestions, if any, may be addressed to the Chief Executive Officer, Food Safety and Standards Authority of India, FDA Bhawan, Kotla Road, New Delhi- 110002, or may be sent through email at regulation@fssai.gov.in. Objections and suggestions, which may be received from any person with respect to the said draft regulations, before the expiry of period so specified above, shall be considered by the Food Authority. Draft regulations 1. These regulations may be called the Food Safety and Standards (Alcoholic Beverages) Amendment Regulations, 2023. 2. In the Food Safety and Standards (Alcoholic Beverages) Regulations, 2018,– (1) inPart-1, (a) in regulation 1.2 relating to „Definitions‟, after sub-regulation1.2.12, following shall be inserted, namely, - “1.2.12a. “Ready-to–drink/ Low alcoholic beverages, shall be low alcoholic, flavored beverages having more than 0.5 to 8.0% of alcohol ABV, made from spirit or the mixture of spirit or any alcoholic beverage other than wine and beer as base by adding natural/nature identical/artificial flavors and/or food additives permitted under the FSS (FPS&FA) Regulations 2011; and/or fruit/vegetable juice with or without added sugar/salt and with or without carbonation. In case of carbonated ready-to-drink (RTD) /low alcoholic beverages, they shall be carbonated with carbon dioxide. However,the carbonated RTD /low alcoholic beverages shall have a minimum of one volume of carbon dioxide. It shall conform to the requirements of Table-4]”.8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (b) in regulation 1.3, in sub-regulation 1.3.9, the proviso starting with “Alcoholic beverage containing” and ending with “the requirements of Table-4”, shall be substituted with the following, namely, - “Alcoholic beverage containing more than 0.5 per cent abv but not more than 8.0 per cent abv may be called as Ready-to–drink/ low alcoholic beverage. It shall conform to the definition provided under regulation 1.2 and the requirements of Table-4. Product name/Ingredients/Raw materials for such products are placed at Annexure-1 of these regulations, which are not exhaustive.” (2) in Part2, regulation 2.2 related to Country Liquors shall be substituted with the following namely, - “2.2 Country liquors/Indian Liquors: Country liquors/Indian Liquors or spirits are alcoholic beverages obtained from distillation of fermentable carbohydrates of agricultural origin. Country liquors/Indian Made Liquors may also be of the following types: 2.2.1 Plain country liquors/Plain Indian liquors: Plain country liquors/Plain Indian liquors shall be made from alcoholic distillate obtained from fermented molasses, jiggery (Gur), mash of cereals, potato, cassava, fruits, juice or sap of coconut and palm trees, mahua flowers or any other carbohydrates of agricultural origin. 2.2.2 Blended country liquors / Blended Indian liquors: Blended country liquors /Blended Indian liquors is a blend of an alcoholic distillate, rectified spirit or neutral spirit. Country liquors/Indian liquors shall also conform to the general requirements pecified in Part 1 and requirements specified in Table – 1. Product name/Ingredients/Raw materials for such products are placed at Annexure-1 of these regulations, which arenot exhaustive.” (3) in Part-3, in regulation 3.1, (a) after the proviso starting with “A season‟s yield of wine” and ending with “vintage wine”, the following shall be inserted, namely, - “Product name/Ingredients/Raw materials for such products are placed at Annexure-1 of these regulations, which are not exhaustive.” (b) in sub-regulation 3.1.4, the heading “Wine from fruits other than grapes” shall be substituted with the following, namely, - “Fruit Wine (other than grape wine) along with Honey wine”. (c) in sub-regulation 3.1.4, after clause 3.1.4.3,following shall be inserted, namely, - “3.1.4.4 Honey wine/ Mead: Honey wine / Mead is a wine produced from the fermentation of an aqueous solution of honey by yeasts without addition of any other carbohydrate source. It shall conform to the requirements provided under Table-2.” (d) sub-regulation 3.1.5, shall be substituted with the following, namely, - “Wine from other agricultural and plant sources (WAPS) Wine from other agricultural and plant sources may be produced by the normal alcoholic fermentation of the juice or sap or whole grains or other agricultural and plant sources with or without the addition of sugar or jaggery. It may include the following:” (e) in sub-regulation 3.1.6, related to Wine Based Beverages, ending with words “or any other approved substance”, following shall be inserted, namely, - “Wine Based Beverages may or may not becar bonated.” (5) in Part 4, in regulation 4.2, related to Draught beer, after sub-regulation 4.2 (1) related to Craftbeer, following shallbe inserted, namely, - “4.2 (1) (i) Nitro Craft Beer-NitroCraft Beer is the craft beer having the mixture of CO2 and N2 gas.” (6) in the Table no. 2, (a) Column no. 7, in the heading, after the words “Fruit Wine (other than grape wine)”, the following shall be inserted, namely, -“alongwith Honey wine”. (b) Column 5 in the heading Country Liquor or Plain Country Liquor shall be amended as follows:Country Liquor/Indian Liquor or Plain Country Liquor/ Plain Indian Liquor.
