L.-33004/99 सी.जी.-डी.एल.-अ.-01122022-240705 xxxGIDHxxx CG-DL-E-01122022-240705 xxxGIDExxx असाधारण EXTRAORDINARY भाग III—खण् ड 4 PART III—Section 4 प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 623] नई ददल्ली, बृहस्ट्पजतवार, ददसम्बर 1, 2022/अग्रहायण 10, 1944 No. 623] NEW DELHI, THURSDAY, DECEMBER 1, 2022/AGRAHAYANA 10, 1944 भारतीय खाद्य सरु क्षा और मानक प्राजधकरण अजधसचू ना नई ददल्ली, 30 नवम्बर, 2022 फा. स.ं स्ट्ट ैंड्स/ एसपी-08/ए-1-2020/एन-01.— खाद्य सुरक्षा और मानक (लेबललग और प्रदिन ) जवजनयम, 2020 में और आगे संिोधन, जो भारतीय खाद्य सुरक्षा और मानक प्राजधकरण, केंद्र सरकार के पूवा नुमोदन से, खाद्य सुरक्षा और मानक अजधजनयम, 2006 (2006 का संख यांक 34) का धारा 23 के साथ पठित धारा 92 का उप-धारा (2) के खंड (ट) द्वारा प्रदत् त िजतियय का प्रयोग करते ुएए करना चाहती ह,ै करने के जलए इनके जवजनयम का प्रारूप इससे प्रभाजवत हो सकने वाले सभी व् यजतियय का सूचना के जलए उतिय उप-धारा (1) का अपक्षे ा के अनुसार एतदद्वारा प्रकाजित करती ह ै और एतदद्वारा नोठटस ददया जाता ह ै दक उक्त प्रारूप जवजनयम पर उस जतजथ से साि ददन का अवजध समाप् त होने के बाद जवचार दकया जाएगा, जजस जतजथ को इस अजधसूचना को प्रकाजित करने वाल ेराजपत्र का प्रजतयााँ जनता को उपलब् ध कराई जाएाँगी। यदद कोई आपजि या सुझाव हो तो उसे मखु य काय कारी अजधकारी, भारतीय खाद्य सरु क्षा और मानक प्राजधकरण, एफडीए भवन, कोटला रोड, नई ददल् ली-110002 को अथवा regulation@fssai.gov.in पर ई-मेल स े भेजा जा सकता ह।ै उक्त प्रारूप जवजनयम के संबधं म ें दकसी व् यजतिय स े इस प्रकार जनधा ठरत जतजथ तक प्राप् त आपजिय और सुझाव पर भारतीय खाद्य सुरक्षा और मानक प्राजधकरण द्वारा जवचार दकया जाएगा। 7976 GI/2022 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] प्रारूप जवजनयम 1. इन जवजनयम को ‘खाद्य सुरक्षा और मानक (लेबललग और प्रदि न) संिोधन जवजनयम, 2022 कहा जा सकता ह।ै 2. खाद्य सुरक्षा और मानक (लबे ललग और प्रदि न) जवजनयम, 2020 (जजन् ह ें एतशपच चात् उक्त जवजनयम कहा जाएगा), के,- (1) जवजनयम 5 के उप-जवजनयम (3) म,ें- (क) खंड (ख) म ें ‘परंत ु यह दक’ िब् द स े आरंभ होने वाल े और ‘लेबल पर पोषक तत्व ’ िब् द से समाप् त होने वाले परंतुक के बाद जनम्न जलजखत को अतं : स्ट्थाजपत दकया जाएगा, अथा त,् - ‘’परंत ु यह भी दक आरडीए को प्रजत परोसे प्रजतित (%) अिं दान तथा प्रजत पैक परोस का संख या जििु पोषण उत् पाद पर न दी जाए, जैसा दक खाद्य सुरक्षा और मानक (जििु पोषण के जलए खाद्य) जवजनयम, 2020 म ेंपठरभाजषत दकया गया ह ैl” (ख) खंड (ग) के,- (i) मद (i) को जनम्न जलजखत के साथ प्रजतस्ट्थाजपत दकया जाएगा, अथा त,् - “(i) न् यनू तम प्रसंस्ट् कृत क‍ चे कृजष उत् पाद यथा गेँ,ाँ चावल, धान्य , दाल,ें फल और सजब्जयााँ और/अथवा एकल संघटक वाले उत् पाद। स्ट्प ष्ट ीकरण : न् यनू तम प्रसस्ट्ं कृत खाद्य वह खाद्य होते हैं, जजन् ह ें पठररक्षण के मुखय प्रयोजन के जलए थोडा सा बदला जाता ह,ै परंत ु जजससे खाद्य के पोषण अंि म ें साथ क पठरवत न नहीं होता। इसम ें सफाई तथा अखाद्य अथवा अवांछनीय जहस्ट्स को अलग करना, पीसना, िंडा करना, पाच ‍ युरीकरण करना, दकजण्वत करना, प्रिीजतत करना, और जनवा त्-पैककग करना िाजमल हो सकता ह ैl” (ii) मद (ii) को जवलोजपत दकया जाएगा l (iii) मद (xiii) को जनम्न जलजखत के साथ प्रजतस्ट्थाजपत दकया जाएगा अथा त्,- “(xiii) ऊजा के स्रोत का महत् व न होन े पर, सूक्ष्म पोषक तत्व के संबंध म,ें टेबलेट और कैप् सूल कें रूप म,ें स्ट् वास्ट् ् य अनपु ूरक, न् यरु ास्ट् यठु टकलस तथा जविेष आहार उपयोग के जलए खाद्य (एफएसडीय)ू l” (ग) खंड (घ) का जगह जनम्न जलजखत खंड प्रजतस्ट्थाजपत दकया जाएगा, अथा त,् - ‘’(घ) लेबल पर घोजषत पोषक तत्व का मात्रा के अनुपालन के संबधं म ें उस पोषक तत्व के मान पर ±20 प्रजत ित छूट दी जाएगी, जजसे लेबल पर उत् पाद के घोजषत भंडारण काल के अंदर दकसी भी समय घोजषत दकया जाए l” (2) जवजनयम 8 के,- (क) खंड (1)(क) के बाद जनम्न जलजखत खंड अतं : स्ट्थाजपत दकया जाएगा, अथा त,् - “(1)(ख) खाद्य सुरक्षा और मानक जवजनयम के तहत अजधसजू चत लोगो उस जस्ट्थजत म ें नहीं ददया जा सकता ह ै जब पैकेज का सतही क्षेत्र 100 वग सेंटीमटर से अजधक न हो, परंत ु यह सूचना बुए-इकाई पैकेज पर दी जाएगी l”[भाग III—खण् ड 4] भारत का राजपत्र : असाधारण 3 (3) अध् याय-4 के, जवजनयम 10 का जगह जनम् नजलजखत जवजनयम प्रजतस्ट्थाजपत दकया जाएगा, अथा त्,- “10. गरै -खदु रा पात्र का लबे ललग अपक्षे ाएाँ (1) गैर-खुदरा जबक्रा के जलए अपेजक्षत प्रत् येक पैकेजबंद खाद्य के संबंध मपर जनम्न जलजखत अजनवाय सूचना या तो उसके पात्र पर दी जाए अथवा उसके साथ लगे लबे ल पर दी जाए: (क) खाद्य का नाम; (ख) एफ.एस.एस.ए.आई लोगो और लाइसेंस संख या; (ग) उत् पाद का सुरक्षा और अखंडता के जलए आवि् यक होने पर, जतजथ का मार्ककग और भंडारण जनदेि; (घ) राजि संख या/खेप संख या/कोड संख या, और (ङ) उत् पादक अथवा पैकर का नाम और पता (आयाजतत पैकेज के मामल े म ें मलू देि के नाम सजहत)। परंतु यह दक कई दकस्ट् म के खाद्य वाले गैर-खुदरा पात्र का जस्ट्थजत में अजनवाय सूचना उसमें जनजहत प्रत् येक प्रकार के खाद्य के जलए दी जाएगी। परंतु यह दक जजस गरै -खुदरा पात्र में उप-जवजनयम 10(1) में अपेजक्षत संपूण सूचना गैर-खुदरा पात्र के अंदर पूव पकै ेजबंद खाद्य के लेबल पर दचृ य और सुपा्य रूप में ह,ै उस जस्ट्थजत म ेंउप-जवजनयम 10(1) म ेंजनधा ठरत सूचना देने का आवच यकता नहीं ह।ै (2) जनम्न जलजखत सूचना लेबल पर न होने तो उसके संल्‍ नी प्रलेख में दी जाए: (क) संघटक का सूची; (ख) िाकाहार अथवा मांसाहार संबधं ी घोषणा, और (ग) जनवल मात्रा। परंत ु यह दक उप-जवजनयम 10(2) म ें अपेजक्षत सूचना गैर-खुदरा पात्र के खाद्य तक खोजी जा सके। परंतु यह दक उप-जवजनयम 10(2) द्वारा अपेजक्षत सभी सूचना लेबल पर द े ददए जाने पर उप- जवजनयम 10(2) लागू नहीं होगा। खाद्य पठरवहन यूजनट के रूप म ें प्रयुक् त ऐस े गैर-खुदरा पात्र का जस्ट्थजत म,ें जजस पर लेबल न लगाया जा सके, उप-जवजनयम 10(1) और 10(2) के तहत अपेजक्षत सभी सूचना सलं ्‍ नी प्रलखे म ें दी जाए अथवा दकसी अन् य उपयुक् त माध् यम स े दी जाए (यथा खाद्य कारोबार के बीच इलेक्र ॉजनक रूप म)ें तथा उस े ऐसे पात्र के खाद्य के संबंध म ेंआसानी स े खोजा जा सके। (3) जनम्न जलजखत लेबललग अपेक्षाए ाँ बारकोड/्‍ल ोबल रेड आइडेंठटदफकेिन नंबर (जीटीआईन) म ें दी ुएई होने पर, जनम्न जलजखत पर छूट होगी:- (क) ब्ांड के माजलक का पता, चाह े वह स्ट् वय ं उतपादक, जवपणक, पैकर अथवा बोटलर, हो या न हो, जैसी भी जस्ट्थजत हो, तथा (ख) लाइसेंस संख या, यदद ब्ांड का माजलक उत् पादक अथवा जवपणक अथवा पैकर अथवा बोटलर, न हो, जैसी भी जस्ट्थजत हो, ।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (4) गैर-खुदरा जबक्रा के प्रत् येक पकै ेज का आसानी स े पहचान का जा सके। यदद वह इस रूप म ें आसानी से न पहचाना जा सकने वाला हो, तो : (क) उसके साथ इस आिय का जववरण हो दक उसका खाद्य उपभोक्त ा का सीधे बेचे जाने के जलए आिजयत नहीं ह ै अथवा उसे गैर-खुदरा पात्र के रूप में आसानी से पहचाना जा सकने वाला बनाया जाए। ऐसे जववरण के कुछ उदाहरण ह:ैं ‘’गैर-खुदरा पात्र’’ अथवा ‘’गुर-खुदरा पात्र – उपभोक्त ा को सीधे जबक्रा के जलए नहीं’’ (ख) उस पर कोई ऐसा अन् य जच्न अंदकत हो जजससे यह संकेजतत हो दक उसका सामग्री सीधे उपभोक्त ा को बेचे जान े के जलए नहीं ह।ै (5) सामान् य सूचना: (क) इस मानक अथवा दकसी अन् य मानक के तहत लेबल पर अपेजक्षत सूचना और जववरण साफ, दचृ यमान तथा सुपा्य हो और ऐसी रीजत स े दी जाए दक उससे छेड-छाड का पता लग जाए। (ख) लेबल पर उप-जवजनयम 10(1) के अंतगत अपेजक्षत अजनवाय सूचना गैर-खुदरा पात्र के प्रमुख स्ट् थान पर हो तथा उसे प्रहस्ट्त न एवं प्रयोग का आम जस्ट्थजतय में आसानी से देखा जा सके l” (4) अनुसूची-1 के पैराग्राफ (1) का जगह जनम्न जलजखत प्रजतस्ट्थाजपत दकया जाएगा , अथा त,् - “(1) खाद्य सुरक्षा और मानक (दढृ ीकृत खाद्य) जवजनयम, 2018 के अनुसार पौजिकाकृत खाद्य के प्रत् येक पैकेज के लेबल पर “……………… (पोषक तत्व का नाम) से पौजिकाकृत’’ िब् द तथा जनम्न -जनर्ददष् ट लोगो ददया जाए। लोगो के नीचे “संपूण पोषण स्ट् वस्ट् थ जीवन” संदेि लाइन भी हो सकती ह।ै “ (5) अनुसूची 2 के,- (क) पैराग्राफ 1 के उप-पैराग्राफ (3) का सारणी म,ें- (i) क्रम संख या 1 के जलए, ‘’घोषणा’’ वाल े कॉलम के नीच,े जनम्न जलजखत अंत: स्ट्थाजपत दकया जाएगा, अथा त,् - ‘’ठटप् पणी: चेतावनी का यह जववरण पान मसाला स े संबंजधत जवज्ञापन म ें सुपा्य /सुश्रव् य हो’’। (ii) ‘’घोषणा’’ वाले कॉलम के नीचे क्रम संख या 3 के लबद ु (iv) का जगह जनम्न जलजखत प्रजतस्ट्थाजपत दकया जाएगा, अथा त,् - ‘’(iv) दफनॉयलकेटोन् यठु रक्स; No. STD/SP-08/A1.2022/N-01.— The following draft of certain regulations to further amend the Food Safety and Standards (Labelling & Display) Regulations, 2020, which the Food Safety and Standards Authority of India proposes to make with previous approval of the Central Government, in exercise of the powers conferred by clause (k) of sub-section (2) of section 92 read with section 23 of the Food Safety and Standards Act, 2006 (34 of 2006) is hereby published as required by sub-section (1) of section 92 of the said Act, for the information of all persons likely to be affected thereby, and notice is hereby given that the said draft regulations shall be taken into consideration after the expiry of the period of sixty days from the date on which copies of the Gazette in which this notification is published are made available to the public; Objections or suggestions, if any, may be addressed to the Chief Executive Officer, Food Safety and Standards Authority of India, FDA Bhawan, Kotla Road, New Delhi- 110002 or may be sent by e-mail at regulation@fssai.gov.in; Objections or suggestions which may be received with respect to the said draft regulations within the period specified above shall be considered by the Food Safety and Standards Authority of India.6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] Draft Regulations 1. These regulations may be called the Food Safety and Standards (Labelling & Display) Amendment Regulations, 2022. 2. In the Food Safety and Standards (Labelling & Display) Regulations, 2020 (herein after refer as said regulations),- (1) in sub-regulation (3) of regulation 5, (a) in clause (b), after the proviso starting with „provided that‟ and ending with “nutrients on the label” the following shall be inserted namely, - “Provided further that per serve percentage (%) contribution to RDA and number of servings per pack may not be given for Infant Nutrition products as defined under Food Safety and Standards (Foods for Infant Nutrition) Regulations, 2020.” (b) in clause (c), (i) item (i) shall be substituted with the following, namely, - “(i) Raw agricultural minimally processed products such as wheat, rice, cereals, pulses, fruits and vegetables and/or products that comprise a single ingredient. Explanation: Minimally processed foods are the ones that are slightly altered for the main purpose of preservation but which do not substantially change the nutritional content of the food. This may involve cleaning and removing inedible or unwanted parts, grinding, refrigeration, pasteurization, fermentation, freezing, and vacuum-packaging.” (ii) item (ii) shall be omitted. (iii) item (xiii) shall be substituted with the following, namely, - “(xiii) Health supplements, Nutraceuticals and Foods for Special Dietary Uses (FSDU) in tablet and capsule format, with respect to macronutrients, when sources of energy are insignificant.” (c) Clause (d) shall be substituted with following, namely, - “(d) The compliance to quantity of declared nutrients on the label shall have the tolerance of ± 20 percent of the value for that nutrient declared on the label at any point in time within declared shelf life of the product.” (2) In regulation 8, (a) after clause (1)(a) the following shall be inserted, namely, - “(1)(b) The logos notified under Food Safety & Standards Regulations may not be given where the surface area of the package is not more than 100 square centimetres, but this information shall be given on the multi-unit packages.” (3) In Chapter-4, regulation 10, shall be substituted with the following namely, - „„10. Labelling Requirements of non-retail container (1) Every packaged food meant for non-retail sale shall provide the following mandatory information either on the container or pasted on the label thereto: (a) Name of the food; (b) FSSAI Logo and License number; (c) Date marking and storage instructions, when required for the safety or integrity of the product; (d) Lot No. /Batch No. /Code No and (e) Name and address of the manufacturer or packer (including country of origin for imported packages). provided that in case of Non-retail container containing multiple types of food, the mandatory information shall be provided for all the types of foods contained therein. provided that non-retail container, which provides access to all the information required by sub-regulation 10(1) on the label of pre-packaged foods within the non-retail container, the information stipulated in sub-regulation 10(1) is not required.[भाग III—खण् ड 4] भारत का राजपत्र : असाधारण 7 (2) The following information if not provided on the label shall be provided in the accompanying documents: (a) List of ingredient; (b) Declaration regarding Veg or Non-Veg and (c) Net Quantity. provided that the information required under sub-regulation 10(2) shall be traceable to the food in non-retail container. provided that if all information required under sub-regulation 10(2) is made available on the label of non-retail container or pre-packaged foods within the non-retail container, sub-regulation 10(2) does not apply. In the case of a non-retail container used as a food transportation unit that is not amenable to possess a label, all the information required under sub-regulation 10(1) & 10(2) shall be provided in the accompanying documents or through appropriate other means (e.g. electronically between food businesses) and shall be effectively traceable to the food in such containers. (3) The following labelling requirements are exempted if they are provided in a Barcode/Global Trade Identification Number (GTIN); - (a) Address of the brand owner whether or not, he himself is the manufacturer, marketer, packer or bottler, as the case may be and (b) the license number of the manufacturer or marketer or packer or bottler, as the case may be, if different from the brand owner. (4) Every package meant for non- retail sale shall be clearly identifiable as such. If the container is not clearly identifiable as a non-retail container, the container shall: (a) bear a statement to indicate that the food is not intended to be sold directly to the consumer or to clearly identify it as a non-retail container. Some examples of such statements are: “NON-RETAIL CONTAINER” “NON-RETAIL CONTAINER - NOT FOR DIRECT SALE TO CONSUMER” OR, (b) carry any other mark that indicates that the container is not intended to be sold directly to the consumer. (5) General Information: (a) Information and the statements required to appear on the label by virtue of this Standard or any other Standards shall be clear, prominent, readily legible and applied in such a manner that any tampering with it will be evident. (b) The mandatory information required on the label under sub-regulation 10 (1) shall appear in a prominent position on the non-retail container and shall be readily accessible under normal handling and use of the container.‟‟ (4) in Schedule I, for the paragraph (1) following shall be substituted namely, - “(1) Every package of food fortified as per FSS (Fortification of Foods) Regulations, 2018, shall carry the words “fortified with ………… (name of the fortificant)” and the logo, as specified below, on the label. It may also carry a tag line “Sampoorna Poshan Swasth Jeevan” under the logo.” (5) in Schedule II, (a) in paragraph 1, in sub paragraph (3), in the table, (i) for S. No. 1, the following shall be inserted, under column “Declarations”, namely, - “Note: This warning statement should be clearly legible/audible in advertisements related to Pan Masala”. (ii) for S. No. 3, under column “Declarations, point (iv) following shall be substituted namely, - “(iv) Not recommended for phenylketonurics; for children; pregnant or lactating women (in case of Aspartame- Acesulfame salt or admixture/combination of Aspartame & Acesulfame Potassium)” (b) in paragraph 1, in sub paragraph (4), in table, (i) for S. No. 1, under column “Declarations”, point (iv) the following shall be substituted namely, - “(iv) Not recommended for phenylketonurics; for children; pregnant or lactating women (in case of Aspartame- Acesulfame salt or admixture/combination of Aspartame & Acesulfame Potassium).” (ii) for S. No. 2, under column “Declarations”, after the proviso starting with „provided that‟ and ending with “in the mixture”, the following proviso shall be inserted, namely, -8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] “Provided further that the repetition of information may not be required for combination of sweeteners.” (c) The words “pregnant and lactating mothers”, wherever it appears, shall be substituted with the following namely, - “pregnant or lactating women”.
