मसौिा जनयम
1. िीर्गक एव ंप्रारंभ - (1) इन जनयमों को केन्द्रीय मोटर यान (... ...संिोधन) जनयम, 2021 कहा िाएगा।

(2) बिते, इन जनयमों में यथाजनजहत के अलावा, य े जनयम सरकारी रािपत्र में उनके अंजतम प्रकािन की जतजथ से लाग ू

2. केंद्रीय मोटर यान जनयमावली, 1989 (इसके बाि उक त जनयमों के रूप म ेंउजल्ल जखत) म,ें
(क) जनयम 126ग के पश् चात जनम्नजलजखत जनयम को अंत:स्ट्थ ाजपत दकया िाएगा,
“126घ. आजधकाररक रािपत्र में अजधसूचना के प्रकािन की तारीख से अठारह महीने तक जनयम 126 में जवजन्िष्टग
परीक्षण एिेंजसयां समय-समय पर यथासंिोजधत एआईएस-017-भाग 6: 2019 म ें जन्िष्टग ानासार, इसमें जनधागररत
प्रदियाओं के अनारूप जनमागता के संयंत्र (त्रों) या आयातक के पररसर (रों) से प्राप् त करन े की तारीख पर या इसके पश् चात
जनर्मगत या आयात दकए गए वाहनों की समरूपता के जलए दक क्य ा ये वाहन उन जनयमों के अनारूप ह,ैं जिसके टाइप के
जलए उन् ह ें जनयम 126 के तहत अनामोदित दकया गया ह,ै के उ पािन का संपूण ग वाहन सारक्षा समरूपता
(डब्ल् यवू ीएससीीपी) परीक्षण करेंगी।
बिते दक जनयम 126 या उपािन आवश्यकताओं की अनरूा पता के अनासार केंद्र सरकार द्वारा टाइप अनामोिन की
आवश् यकता से छूट प्राप्त वाहनों के जलए इस जनयम में काछ भी लाग ूनहीं होगा।”
(ख) जनयम 126क म,ें अक्षर "परीक्षण भी करते ह"ैं , के स्ट् थान पर अक्षरों "टेलपाइप उ सिगन परीक्षण भी दकए िाते" को
प्रजतस्ट्थाजपत दकया िाएगा।

NOTIFICATION
New Delhi, the 2nd March, 2021
G.S.R. 144(E).—The following draft of certain rules further to amend the Central Motor Vehicles Rules,
1989, which the Central Government proposes to make in exercise of the powers conferred by section 110 of the
Motor Vehicles Act, 1988 (59 of 1988), is hereby published as required by sub-section (1) of section 212 of the said
Act for information of all persons likely to be affected thereby; and notice is hereby given that the said draft rules shall
be taken into consideration after the expiry of thirty days from the date on which the copies of this notification, as
published in the Official Gazette, are made available to the public;
Objections and suggestions to these draft rules, if any, may be sent to the Joint Secretary (MVL, Transport &
Toll), Ministry of Road Transport and Highways, Transport Bhawan, Parliament Street, New Delhi-110 001 or on the
email: comments-morth@gov.in;
The objections or suggestions which may be received from any person in respect of the said draft rules before
the expiry of the aforesaid period will be considered by the Central Government.
DRAFT RULES
1. Short title and commencement— (1) These rules may be called as the Central Motor Vehicles
(………….Amendment) Rules, 2021.
(2) Save as otherwise provided in these rules, they shall come into force on the date of their final publication in the
Official Gazette.
2. In the Central Motor Vehicles Rules, 1989 (herein after referred as the said rules),
a) After the rule 126C, the following rule shall be inserted,[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3
“126D. Eighteen months from the date of publication of the notification in the official Gazette, the testing
agencies referred to in Rule 126 shall conduct Whole Vehicle Safety Conformity of Production (WVSCoP) tests
as specified in AIS-017-Part 6:2019, as amended from time to time, in accordance with the procedures laid
down therein, on vehicles, manufactured or imported on and after this date drawn from the manufacturer’s
plant(s) or the importer’s premise(s), to verify whether these vehicles conform to the rules to which they have
been type approved under Rule 126.
Provided that nothing in this rule shall be applicable to vehicles exempted by the Central Government from
Type Approval requirements as per Rule 126 or Conformity of Production requirements.”
b) in rule 126A, the words “also conduct tests”, shall be substituted by the words “also conduct tailpipe
emission tests”.
