पर क(cid:11)(cid:12)ीय सरकार ारा िवचार (cid:1)कया जाएगा। (cid:21)(cid:21)(cid:21)(cid:21)ाााा(cid:22)(cid:22)(cid:22)(cid:22)पपपप ििििननननययययमममम 1. ससससंिंिंिंि(cid:24)(cid:24)(cid:24)(cid:24)(cid:25)(cid:25)(cid:25)(cid:25) शशशशीीीीषषषषकक(cid:16)(cid:16)कक(cid:16)(cid:16) औऔऔऔरररर (cid:21)(cid:21)(cid:21)(cid:21)ााााररररंंंंभभभभ - (1) इन िनयम# को क(cid:11)(cid:12)ीय मोटर यान (संशोधन ………) िनयम, 2019 कहा जा सकता ह।ै (2) ये िनयम सरकारी राजप7 म (cid:11) इनके अंितम (cid:27)काश क(cid:31) तारीख से लाग ू ह#गे। 2. क(cid:11)(cid:12)ीय मोटर यान िनयम, 1989 (इसम(cid:11) इसके प=च ात उ" िनयम# के (cid:29)प म (cid:11)उि(cid:3)ल िखत) म:(cid:11)- ।. _____ िनयम के पIात, िनJिलिखत अKयाय शािमल (cid:1)कया जाएगा। ‘अKयाय ____ राG Lीय सड़क सरु +ा बोड D 6354 GI/2019 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] ििििननननययययमममम ________________ रररराााा(cid:30)(cid:30)(cid:30)(cid:30)(cid:31)(cid:31) (cid:31)(cid:31) ीीीीयययय ससससड़ड़ड़ड़कककक ससससररुुररुु (cid:24)(cid:24)(cid:24)(cid:24)ाााा बबबबोोोोडडडड(cid:16) (cid:16) (cid:16) (cid:16) कककक$$$$ %%%%थथ थथ ाााापपपपननननाााा (1) क(cid:11)(cid:12) सरकार इस अिधिनयम के त हत (cid:27)दNत शि"य# का (cid:27)योग करने के िलए और इसे समनुद िे शत (cid:27)कायO के िनGप ादन के िलए, इस अिधिनयम के (cid:27)ारंभ होने के 6 महीन े के भीतर इस अिधिनयम क(cid:31) धारा 215ख (1) के अनुसार एक बोडD का गठन करेगी, िजसे राG Lीय सड़क सुर+ा बोडD कहा जाएगा। (2) यह बोडD ऊपर उ( त नाम का िनगिमत िनकाय होगा, िजसके पास संिवदा करन े और उ(त नाम से वाद लान े और वाद लाए जाने के िलए इस अिधिनयम के (cid:27)ावधान# के अKय धीन शि"य# के साथ शा=व त उNत रािधकार और सामाUय मुहर होगी। (3) बोडD का मVु य कायाDलय राG Lीय राजधानी +े7 म (cid:11) होगा जैसा(cid:1)क राGL ीय राजधानी +े7 योजना बोड D अिधिनयम 1985 के धारा 2 के खंड (च) म (cid:11) िनFदG ट (cid:1)कया गया ह।ै (4) यह बोडD भारत म(cid:11) अU य &थ ान# पर कायाDलय &थ ािपत कर सकता ह।ै ििििननननययययमममम ________________ बबबबोोोोडडडड(cid:16) (cid:16) (cid:16) (cid:16) कककक$$$$ ससससररंंररंं चचचचननननाााा (1) बोड D िन(cid:8) निलिखत से ग1ठत होगा :- (क) क(cid:11)(cid:12) सरकार ारा उप-धारा, (2) म(cid:11) िविनFदGट मानदंड# को पूरा करने वाल े -य ि"य# म(cid:11) से िनयु(त अKय + एवं तीन से कम नहW परंत ु सात से अनिधक सद&य ; परंत ु यह तब जब(cid:1)क कोई - यि(त जो सरकार क(cid:31) सेवा म (cid:11) ह ै या रहा ह,ै को िन(cid:8)न िलिखत के (cid:29)प म (cid:11) िनयु(त नहW (cid:1)कया जाएगा -- (i) अK य+, जब तक (cid:1)क उU ह#न े भारत सरकार म (cid:11) सिचव अथवा इसके समक+ का पद धा1रत न (cid:1)कया हो; (ii) कोई सद& य, जब तक (cid:1)क उU ह#ने भारत सरकार म (cid:11) अपर सिचव अथवा इसके समक+ का पद या क(cid:11)(cid:12)ीय सरकार या राX य सरकार म (cid:11) कोई समक+ पद धा1रत न (cid:1)कया हो; परंतु यह और (cid:1)क कोई - यि" जो सरकार क(cid:31) सेवा म(cid:11) नही ह ; या नहW रहा ह,ै िन(cid:8)न िलिखत के (cid:29)प म(cid:11) िनयु(त नहW (cid:1)कया जाएगा, (i) अK य+, जब तक (cid:1)क उसने उप-िनयम (2) के अंतगDत उि(cid:3)लिखत (cid:1)कसी +े7 म(cid:11) 20 वषO के Uय नू तम अनुभव के साथ 55 वष D क(cid:31) आय ु (cid:27)ा< त न कर ली हो; (ii) कोई सद& य, जब तक (cid:1)क उसने उप-िनयम (2) के अंतगDत उि(cid:3)लिखत (cid:1)कसी +े7 म(cid:11) 20 वषO के Uय नू तम अनुभव के साथ 45 वष D क(cid:31) आयु (cid:27)ा<त न कर ली हो; (ख) सड़क प1रवहन और राजमाग D मं7ालय म (cid:11) भारत सरकार के सिचव अथवा उनके (cid:27)ितिनिध एक पदेन सद&य ह#गे। (2) बोडD का (cid:27)N येक सद& य सड़क प1रवहन और सुर+ा, शहरी आयोजना, िविध, यातायात (cid:27)बंधन और िविनयमन, & वा& Z य अथवा वकालत, पुिलस (cid:27)वतDन और अUव षे ण, बीमा, ऑटोमोबाइल अिभयांि7क(cid:31), िसिवल अिभयांि7क(cid:31), िवपणन और संचार म (cid:11) स े एक अथवा अिधक +े7 म (cid:11) िवशेष ]ान, या पशे ेवर अनुभव, जो क(cid:11)(cid:12)ीय सरकार क(cid:31) राय म (cid:11) बोडD को इस अिधिनयम के अंतगDत अपने (cid:27)कायO का िनGप ादन करन े और अपन े ल^य # को परू ा करन े के िलए उपयोगी ह,ै रखने वाल े यो_ य, सN यिनG ठ और (cid:27)िति‘त -य ि" होगा। (3) बोडD के अK य+ और अU य सद&य , पूणDकािलक सद&य ह#गे। (4) बोडD के अK य+ और अU य सद&य क(cid:11)(cid:12) सरकार ारा यथा िविहत तरीके से चयिनत ह#ग े और उनक(cid:31) िनयुि(त सरकारी राजप7 म(cid:11) अिधसूिचत क(cid:31) जाएगी। ििििननननययययमममम ____________________ अअअअ))))यय यय (cid:24)(cid:24)(cid:24)(cid:24) औऔऔऔरररर अअअअ****यययय ससससदददद%%%%यय यय ,,,, ककककाााा ककककााााययययकक(cid:16)(cid:16)कक(cid:16)(cid:16) ाााालललल (1) (cid:1)कसी - यि( त को अK य+ अथवा सद& य के (cid:29)प म (cid:11) िनयु(त करने स े पूव D क(cid:11)(cid:12)ीय सरकार &व य ं को संतुGट करेगी (cid:1)क ऐसे - यि( त का ऐसा कोई िवN तीय या अU य िहत नहW ह ै जो ऐसे अKय + या सद&य के (cid:29)प म(cid:11) उसके (cid:27)कायO पर (cid:27)ितकूल (cid:27)भाव डालता हो।¹Hkkx IIµ[k.M 3(i)] Hkkjr dk jkti=k % vlk/kj.k 3 (2) अK य+ अथवा सद& य अपने कायDभार bहण करने क(cid:31) ितिथ से तीन वष D क(cid:31) अविध के िलए पदbहण कर(cid:11)गे और अिधकतम एक और कायDकाल के िलए पुन:िनयुि(त के पा7 ह#गे। परंत ु यह और (cid:1)क, कोई अK य+ अथवा अUय सद&य पद धा1रत नहW करेगा य(cid:1)द उसन े- (क) अK य+ के मामल े म,(cid:11) प;सठ वषD क(cid:31) आयु (cid:27)ा<त कर ली हो; (ख) (cid:1)कसी अU य सद& य के मामल े म,(cid:11) बासठ वषD क(cid:31) आयु (cid:27)ा<त कर ली हो (3) अK य+ का वेतन, भN ता एव ं सेवा क(cid:31) अUय िनबंधन एवं शतc भारत सरकार के सिचव के समतु(cid:3)य ह#गी एवं अUय सद& य# के िलए ये भारत सरकार के अपर सिचव के समत(cid:3)ु य ह#गी। (4) अK य+ और सद& य# के सेवा क(cid:31) िनबंधन एवं शत,c उनक(cid:31) िनयुि(त के प=च ात,् उनके अपिहत म(cid:11) प1रवdतत नहW ह#गी। ििििननननययययमममम ____________________ अअअअ))))यय यय (cid:24)(cid:24)(cid:24)(cid:24) एएएएवववव ंं ंंससससदददद%%%%यययय ,,,, ककककाााा ....यय यय ाााागगगगपपपप(cid:18)(cid:18)(cid:18)(cid:18) (1) बोडD का अK य+ अथवा कोई सद& य, क(cid:11)(cid:12) सरकार को अपने कायDकाल के समा<त होन े स े पूव D कम तीन महीन े पहल े अिbम म (cid:11) िलिखत सूचना (cid:27)दान कर (cid:1)कसी भी समय अपने पद से Nय ागप7 द े सकता ह।ै (2) बोडD का अK य+ अथवा कोई सद& य, उप-धारा (1) के अंतगDत नो1टस देकर खाली %ए पद पर क(cid:11)(cid:12) सरकार ारा (cid:1)कसी - यि( त के िनयु(त (cid:1)कए जान े तक अथवा नो1टस क(cid:31) ितिथ स े तीन माह बीत जान े तक, जो भी पहले हो, पद पर बना रहगे ा। ििििननननययययमममम ____________________ अअअअ))))यय यय (cid:24)(cid:24)(cid:24)(cid:24) औऔऔऔरररर ससससदददद%%%%यय यय ,,,, ककककोोोो हहहहटटटटााााययययाााा जजजजााााननननाााा (1) क(cid:11)(cid:12) सरकार (cid:1)कसी सद& य को पद से हटा सकती ह,ै जो - (क) (cid:1)दवािलया ह,ै या (cid:1)कसी भी समय एक (cid:1)दवािलया घोिषत (cid:1)कया गया ह;ै अथवा (ख) (cid:1)कसी ऐसे अपराध म(cid:11) दोषी ठहराया जाता ह,ै िजसम,(cid:11) क(cid:11)(cid:12) सरकार क(cid:31) राय म (cid:11) नैितक अधमता शािमल ह;ै अथवा (ग) जो अपन े कायD िनG पादन के िलए शारी1रक अथवा मानिसक (cid:29)प से अ+म हो गया ह;ै (घ) िजसने ऐसे िवN तीय अथवा अUय िहत अdजत कर िलया हो िजससे उनके एक सद&य के (cid:29)प म (cid:11) कायD करना अिहतकर हो सकता ह;ै (ङ) िजसने, क(cid:11)(cid:12)ीय सरकार क(cid:31) राय म,(cid:11) अपने पद का इस (cid:27)कार दfु पयोग (cid:1)कया ह,ै िजससे उसके पद पर बने रहना जनिहत के िलए अिहतकर हो; अथवा (च) अपन े कायDकाल के दौरान (cid:1)कसी अU य िनयोजन म (cid:11) कायD करने लगा हो; (छ) अK य+ को सूिचत (cid:1)कए िबना अपन े कायD से सात (cid:1)दन स े अिधक क(cid:31) अविध के िलए िबना (cid:1)कसी औिचNय पूणD कारण से अपन े कायाDलय स े और प= चातवतh कतD-य िनवहनD से अनुपि&थ त रहा हो। (2) (cid:1)कसी अK य+ अथवा सद& य को उप-िनयम (1) के खडं (घ) अथवा खंड (ड़) के तहत उनके काय D से हटाया नहW जाएगा जब तक उU ह (cid:11)उस मामल े म(cid:11) सुनवाई का उिचत अवसर (cid:27)दान नहW (cid:1)कया गया हो। ििििननननययययमममम ____________ बबबबोोोोडडडड(cid:16) (cid:16) (cid:16) (cid:16) ककककेेेे ससससदददद%%%%यय यय ककककेेेे ििििननननययययोोोोजजजजनननन ककककाााा ििििननननषषषषधधेेधधेे (1) बोडD का अK य+ अथवा कोई सद& य, उस ितिथ से िजस ितिथ से वह अपना पदधारण करने स े पदिवरत हो जाता ह,ै एक वष D क(cid:31) अविध तक इस अिधिनयम के अंतगDत बोडD स े संबi कोई िनयोजन &व ीकार नहW करेगा। परंत ु यह तब जब(cid:1)क इस धारा के (cid:27)ावधान वैसे मामले म (cid:11) लागू नहW ह#ग े जहा ं इस संबंध म (cid:11) क(cid:11)(cid:12)ीय सरकार से िलिखत म (cid:11) िविशG ट अिधकार-प7 (cid:27)ा<त कर िलया गया ह।ै & पG टीकरण – शंकाj के िनवारण के िलए, एतkारा यह &प Gट (cid:1)कया जाता ह ै (cid:1)क पदधारण से पदिवरत होन े के बाद एक वष D पूरा होन े स े पूव D (cid:1)कसी एज(cid:11)ट, (cid:27)शासक, अिधकारी, िनदेशक, (cid:27)ितधारक, कायDका1रणी सिमित का सद&य अथवा शेयरधारक अथवा इि(व टी & वामी अथवा लाभकारी &व ामी के (cid:29)प म(cid:11) कायDरत अKय + अथवा (cid:1)कसी सद&य का (cid:27)N य+ या अ(cid:27)N य+ िहत होने का अथ D लगाया जाएगा।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] ििििननननययययमममम ________________ बबबबोोोोडडडड(cid:16) (cid:16) (cid:16) (cid:16) ककककेेेे अअअअििििधधधधककककााााररररीीीी एएएएवववव ंं ंंअअअअ****यय यय ककककममममचच(cid:16)(cid:16)चच(cid:16)(cid:16) ााााररररीीीी (1) बोडD क(cid:11)(cid:12) सरकार के पूव-D अनुमोदन से ऐस े अिधका1रय# और अUय कमDचा1रय# िजसे इस अिधिनयम के अंतगDत इसके कायD के कुशल िनG पादन के िलए आव=य क समझता हो, को क(cid:11)(cid:12) सरकार अथवा राXय सरकार से (cid:27)ितिनयुि" के आधार पर अथवा संिवदा के आधार पर िनयु(त कर सकता ह।ै (2) बोडD के अिधका1रय# और कमDचा1रय# क(cid:31) सेवा के अUय िनबंधन एव ं शत c और संदेय वेतन एव ं भNत े और ऐस े अिधका1रय# और कमDचा1रय# क(cid:31) संV या बोडD के िविनयम# ारा िविनFदGट (cid:1)कए जाएंगे। ििििननननययययमममम ________________ बबबबोोोोडडडड(cid:16) (cid:16) (cid:16) (cid:16) कककक$$$$ शशशशिििि1111तत तत ययययाााा ंं ंंऔऔऔऔरररर (cid:21)(cid:21)(cid:21)(cid:21)ककककाााायययय (cid:16)(cid:16) (cid:16)(cid:16) (1) बोडD सड़क सुर+ा, नवाचार और नई (cid:27)ौlोिगक(cid:31) को अपनान े एवं यातायात और मोटर वाहन िनयमीकरण के िलए िज(cid:8) मदे ार होगा। (2) उप-िनयम (1) के उmे= य# के िलए, बोडD, केU(cid:12) सरकार ारा िवचार के िलए िन(cid:8)न िलिखत सिहत (cid:1)दशा-िनदoश और िविनयम# का िनयमन करेगा: (क) िडजाइन, भार, िनमाDण, िविनमाDण (cid:27)(cid:1)pया, संचालन और रखरखाव, मोटर वाहन# और सुर+ा उपकरण# के (cid:27)Nयाqवान के मानक; (ख) मोटर वाहन# का पंजीकरण और लाइस(cid:11)rसग; (ग) सड़क सुर+ा, सड़क अवसंचना और यातायात के िनयं7ण के िलए मानक# का िनयमन; (घ) देश म(cid:11) पहाड़ी +े7# के िलए सड़क सुर+ा, यातायात (cid:27)बंधन और सड़क िनमाDण के िलए िविशGट मानक# का िविनयमन; (ड.) सड़क सुर+ा और यातायात (cid:27)बंधन के (cid:27)शासन पर केU(cid:12) सरकार, राXय सरकार और &थ ानीय (cid:27)ािधका1रय# को तकनीक(cid:31) सलाह और सहायता (cid:27)दान करना; (च) सुर+ा उपकरण# क(cid:31) लागत# का िनधाDरण; (छ) राX य (cid:27)ािधका1रय# के साथ सलाह करके -य वसाियक सं&थ ान#, सूचना पs# और -य वसाियक संकेतक# के िविनयमन के िलए एक िविनयामक ढांचा िवकिसत करना; (ज) सड़क# और राजमागO पर यातायात संबंधी चोट# से िनपटने के िलए Lॉमा सुिवधाj और परा-िच(cid:1)कN सा सुिवधाj क(cid:31) & थापना और संचालन के िलए (cid:1)दशा-िनदoश िविनFदGट करना; (झ) इस तरह क(cid:31) सहायता को प%चं ाने वाल े क(cid:31) rजदगी को कोई नकु सान प%्चं ाए िबना एक सड़क दघु Dटना के पीिडत# के िलए अिधकतम सहायता सुिनि= चत करने के िलए नेक vि" के िसiांत को (cid:27)ोNस ािहत करना; (ञ) सड़क सुर+ा और यातायात (cid:27)बंधन से िनपटन े वाल े यातायात पुिलस, अ&प ताल (cid:27)ािधका1रय#, राजमाग D (cid:27)ािधका1रय#, शैि+णक और अनुसंधान संगठन# और अUय संगठन# के िलए कौशल िवकास और +मता िनमाDण के िलए (cid:1)दशा-िनदoश िविनFदG ट करना; (ट) सड़क सुर+ा और यातायात (cid:27)बंधन म(cid:11) अwछ ी (cid:27)थाj को बढ़ावा देना और उसका समथDन करना, सड़क सुर+ा और यातायात िश+ा कायDpम# को चलाना और सड़क (cid:27)यो(त ाj के सभी वगO के बीच जाग(cid:29)कता फैलान े के िलए अिभयान चलाना; (ठ) सड़क सुर+ा और यातायात (cid:27)बंधन के +े7 म(cid:11) शेयरधारक# और गैर-सरकारी संगठन# को शािमल करना और कुशल यातायात (cid:27)बंधन और सड़क सुर+ा (cid:27)थाj के (cid:27)ोNस ाहन म(cid:11) उनक(cid:31) सहायता करना; (ड) सड़क सुर+ा और यातायात (cid:27)बंधन स े संबंिधत मामल# म (cid:11) अUय एज(cid:11)िसय# जैसे िश+ा बोडD और सं&थ ान, &व ा&Z य सेवाएं और गैर-सरकारी संगठन# के साथ समUव य रखना; (ढ) सावDजिनक-िनजी भागीदारी प1रयोजनाए;ं (ण) सड़क प1रवहन पा1रि& थितक(cid:31) तं7 के सुरि+त और सतत (cid:27)योग को बढ़ावा देना;¹Hkkx IIµ[k.M 3(i)] Hkkjr dk jkti=k % vlk/kj.k 5 (त) वाdषक (cid:29)प से इसके ारा तय (cid:1)कए गए िनGप ादन ल^य ; (थ) अिधिनयम के खंड 2 (ख) के अनुसार साधारण (cid:29)प से वाहन इंजीिनय{रग, यं7वत वाहन# और यातायात के +े7# म (cid:11) नवाचार, अनुसंधान और िवकास के माK यम स े नई वाहन (cid:27)ौlोिगक(cid:31) को बढ़ावा देना; (द) असुरि+त सड़क (cid:27)यो( ताj क(cid:31) सुर+ा; (ध) मोटर वाहन# और सड़क# के िलए अंतरराGL ीय तकनीक(cid:31) मानक# के िवकास म(cid:11) योगदान देना; (न) मोटर वाहन मानक# के कायO पर अतं रराGL ीय सरकारी सगं ठन# और गैर-सरकारी संगठन# के साथ समUव य को बढ़ावा देना; (प) अंतरराG Lीय तकनीक(cid:31) मानक# और घरेलू तकनीक(cid:31) मानक# के बीच िनरंतरता को बढ़ावा देना और य े सुिनि=च त करना (cid:1)क देश म (cid:11) अपनाए गए सुर+ा के &त र से कोई समझौता न (cid:1)कया गया हो; and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of thirty days from the date on which the copies of this notification as published in the Official Gazette, are made available to the public; Objections and suggestions to these draft rules, if any, may be sent to the Joint Secretary (Transport), email: js-tpt@gov.in, Ministry of Road Transport and Highways, Transport Bhawan, Parliament Street, New Delhi-110 001; The objections or suggestions which may be received from any person in respect of the said draft rules before the expiry of the aforesaid period will be considered by the Central Government, Draft Rules 1. Short Title and commencement. - (1) These rules may be called the Central Motor Vehicles (……Amendment) Rules, 2019. (2) They shall come into force on the date of their final publication in the Official Gazette. 2. In Central Motor Vehicle Rules, 1989 (hereafter referred as the said rules).- I. After Rule __, the following chapter to be included- “Chapter ___ - National Road Safety Board Rule____ –Establishment of the National Road Safety Board (1) The Central Government shall, within 6 months of commencement of this Act, in accordance with Section 215B(1) of theAct, constitute a Board to be called theNational Road Safety Board, to exercise the powers conferred on, and to perform the functions assigned to, it under this Act. (2) The Board shall be a body corporate by the name aforesaid, having perpetual succession and a common seal with power, subject to theprovisions of this Act, to contract and shall, by the said name, sue and be sued. (3) The head office of the Board shall be in the National Capital Region referred to in clause (f) of section 2 of the National Capital Region Planning Board Act, 1985. (4) The Board may establish offices at other places in India.8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] Rule ____ - Composition of the Board (1) The Board shall consist of: (a) the Chairman and not less than three but not exceeding seven members to be appointed by the Central Government from amongst the persons who fulfil the criteria specified in sub-section (2): PROVIDED that a person who is or has been in the service of Government shall not be appointed as –– (i) Chairman, unless he has held the post of Secretary or its equivalent, to the Government of India; (ii) a member, unless he has held the post of Additional Secretary or its equivalent, to the Government of India or any equivalent post in the Central Government or the State Government; PROVIDED further that a person who is not or has not been in the service of the Government shall not be appointed as – (i) Chairman, unless he has attained 55years of age coupled with a minimum experience of 20 years in any of the fields mentioned under sub-rule (2); (ii) A member, unless he has attained 45 years of age coupled with a minimum experience of 20 years in any of the fields mentioned under sub-rule (2); (b) the Secretary to the Government of India in the Ministry of Road Transport and Highways or his representative who shall be an ex-officio member. (2) Every member of the Board shall be a person of ability, integrity and standing, having special knowledge of, or professional experience in, one or more fields of road transport and safety, urban planning, law, traffic management and regulation, health and advocacy, police enforcement and investigation, insurance, automobile engineering, civil engineering, marketing and communications, which, in the opinion of the Central Government, is useful for the Board to render its functions and fulfil its objectives under this Act. (3) The Chairman and other members of the Board shall be whole-time members. (4) The Chairman and other members of the Board shall be selected in such manner as may be prescribed by the Central Government and their appointment shall be notified in the Official Gazette. Rule ___ - Term of office of Chairman and other members (1) Before appointing any person as a Chairman or Member, the Central Government shall satisfy itself that such person has no financial or other interest that may be prejudicial to his functions as such Chairman or Member. (2) The Chairman or a Member shall hold office for a term of three years from the date on which he enters upon his office and shall be eligible for re-appointment for a maximum of one more term: PROVIDED further that no Chairman or other Member shall hold office, as such after he attains– (a) in the case of the Chairman, the age of sixty-five years; (b) in the case of any other Member, the age of sixty-two years (3) The salary, allowances, and other terms and conditions of service of Chairman shall be equivalent to that of Secretary to the Government of India and that of other Members shall be equivalent to that of Additional Secretary to the Government of India. (4) The terms and conditions of service of the Chairman and the Members shall not be varied to their disadvantage after appointment. Rule ___ - Resignation of Chairman and Members (1) The Chairman or a Member of the Board may resign office at any time before the expiry of his term, by giving to the Central Government an advance notice in writing of not less than three months.¹Hkkx IIµ[k.M 3(i)] Hkkjr dk jkti=k % vlk/kj.k 9 (2) The Chairman or a Member of the Board, after giving notice under sub-section (1), shall continue to hold office until the Central Government appoints a person to the office so vacated, or till the expiry of three months from the date of notice, whichever is earlier. Rule ___ - Removal of Chairman and Members (1) The Central Government may remove from office any member, who- (a) is, or at any time has been adjudged an insolvent; or (b) has been convicted of an offence which, in the opinion of the Central Government, involves moral turpitude; or (c) has become physically or mentally incapable of discharging his duties; or (d) has acquired such financial or other interest as is likely to affect prejudicially his functions as amember; or (e) has, in the opinion of the Central Government, so abused his position as to render his continuance in office detrimental to the public interest; or (f) has engaged at any time during his term of office in any other employment; or (g) has remained absent fromhis office and subsequent discharge of duties without any reasonable cause for a period of more than 7 days, without informing the Chairman. (2) No Chairman or member shall be removed from his office under clause (d) or clause (e) of sub- rule(1) unless he has been given a reasonable opportunity of being heard in the matter. Rule ___ - Restrictions of employment of Member of the Board (1) The Chairman or a member of the Board shall not, for a period of one year from the date on which he ceases to hold office as such, accept any employment relating to the Board under this Act. PROVIDED that the provisions of this section shall not apply in cases where specific authorisation in this regard has been obtained in writing from the Central Government. Explanation–– For the removal of doubts, it is hereby clarified that, the Chairman or a member acting as an agent, administrator, officer, director, retainer, member of the executive committee or shareholder or equity owner or beneficial owner before the expiry of one year on ceasing to hold office as such Chairman or a member shall be construed to have direct or indirect interest. Rule ___ - Officers and other employees of Board (1) The Board may, with the prior approval of the Central Government, appoint such officers and other employees as it may consider necessary, for the efficient discharge of its functions under this Act, on deputation from the Central Governmentor State Government or on contract basis. (2) The salaries and allowances payable to and other terms and conditions of service of the officers and employees of the Board and the number of such officers and employees shall be such as may be specified by the Board by regulations. Rule __ - Powers and Functions of the Board (1) The Board shall be responsiblefor promoting road safety, innovation and adoption of new technology and for regulating traffic and motor vehicles. (2) For the purposes of sub-rule (1), the Board shall, for consideration by the Central Government, formulate guidelines and regulations including but not limited to: (a) the standards of design, weight, construction, manufacturing process, operation and maintenance, recall of motor vehicles and of safety equipment; (b) the registration and licensing of motor vehicles; (c) the formulation of standards for road safety, road infrastructure and control of traffic; (d) the formulation of specific standards for road safety, traffic management and road construction for hilly regions in the country;10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (e) provide technical advice and assistance to the Central Government, State Government and local authorities on administration of road safety and traffic management; (f) the determination of costs of safety equipment; (g) develop, in consultation with State Authorities, a regulatory framework for regulation of commercial establishments, billboards and commercial signage; (h) specify guidelines for establishing and operating trauma facilities and para-medical facilities for dealing with traffic related injuries on roads and highways; (i) promote the principle of Good Samaritan so as to ensure maximum aid for victims of a road accident without causing any impediment to the life of those facilitating such aid; (j) specify guidelines for capacity building and development of skills for traffic police, hospital authorities, highway authorities, educational and research organisations and other organisations dealing with road safety and traffic management; (k) promote good practices in road safety and traffic management and advocacy of the same, undertake road safety and traffic education programmes, and conduct campaigns to create awareness amongst all sections of road users; (l) involve stakeholders and non-government organisations working in the area of road safety and traffic management, and assist them in promotion of efficient traffic management and road safety practices; (m) co-ordinate with other agencies such as education boards and institutions, health services and non-government organisations in matters relating to road safety and traffic management; (n) public-private partnership projects and schemes; (o) the facilitation of safe and sustainable utilisation of road transport ecosystem; (p) the performance targets set by it annually; (q) the promotion of new vehicle technology through innovation, research and development in the fields of vehicular engineering, mechanically propelled vehicles and transportation in general as per Section 2B of the Act; (r) the safety of vulnerable road users; (s) contribute to the development of international technical standards for motor vehicles and roads; (t) promote co-ordination with the international governmental organisations and non- governmental organisations on the work of motor vehicle standards; (u) promote consistency between international technical standards and domestic technical standards and ensure that the level of safety adopted in the country is not compromised; (v) conduct research, by way of collecting data and undertake analysis and planning activities to improve road safety, traffic management, crash investigation and such other measures as may be necessary for the purposes of this Act; (w) prepare and implement such plans as may be necessary to improve road safety; (x) establish a network of organisations to facilitate technical co-operation, co-ordination of activities, exchange of information and data collection, the development and implementation of joint projects, exchange of expertise and best practices in the fields which falls within its responsibility; (y) encourage competition, innovation, efficiency and economical use of resources; (z) such other matters as may be referred to it by the Central Government. Rule __ - Powers and Functions of Chairman of Board The Chairman shall have powers of general superintendence and directions in the conduct of affairs of the Board and he shall, in addition to, presiding over the meetings of the Board, exercise and discharge such powers and functions of the Board as may be prescribed by the Central Government, or delegated to him by the Board.¹Hkkx IIµ[k.M 3(i)] Hkkjr dk jkti=k % vlk/kj.k 11 Rule __ - Meetings of the Board (1) The Chairman and the members of the Board shall, meet at least once a month, and at such times and places, and observe such rules of procedure in regard to the transaction of business at its meetings, including quorum for such meetings, as may be prescribed by the Central Government. (2) The Chairman or any member who has any direct or indirect interest in any matter coming up for consideration at a meeting of the Board shall, as soon as it comes to his knowledge, disclose the nature of interest to the Board. (3) A disclosure made by the Chairman or a member under sub-section (3) shall be recorded in the proceedings of the meeting, and the Chairman or such member shall recuse from any deliberation or decision of the Board with respect to that matter or any matter connected therewith: PROVIDED that if the Chairman has to recuse himself from a proceeding of the Board, he shall designate a member of the Board to discharge the functions of the Chairman for that matter. PROVIDED that if a member has to recuse himself from a proceeding of the Board, the Central Government shall authorise a person to attend the meeting. (4) All orders and decisions of the Board shall be authenticated by the member authorised by the Board in this behalf. (5) No act or proceedings of the Board shall be questioned or invalidated merely on the ground of existence of any vacancy or defect in the constitution of the Board. Rule __ - Technical Working Groups (1) The Board shall for the efficient discharge of its functions, constitute as many Technical Working Groups as it may consider necessary, which shall consist of independent technical experts, having the ability to maintain and exercise independent judgment in the discharge of their duties. (2) Each Technical Working Group constituted under sub-section (1) shall be headed by such member of the Board designated by the Chairman, having regard to his special knowledge and experience in the relevant field. (3) The Technical Working Group for undertaking deliberations on the matters entrusted to it shall invite the relevant industry and consumer representatives to participate in its deliberations. (4) The number of technical members and the procedure for constituting the technical working groups under sub-rule (1) above,shall be such as may be specified by regulations by the Board. (5) The Technical Working Group constituted under sub-section (1) may be entrusted with any of the following matters, namely:- (a) transport infrastructure and safety, including road standards; (b) traffic management; (c) crash investigation and forensics; (d) data collection and analytics; (e) motor vehicle standards; (f) driving skill testing; (g) development of technology, its use and testing standards for checking driving of motor vehicles under the influence of alcohol or intoxicating drugs or over speeding; (h) inspection and certification of vehicles already in use; (i) vehicle fuel quality; (j) vehicle noise standards; (k) third party insurance relating to motor vehicles; (l) any other matter that may be entrusted to such technical working group as may be considered necessary by the Board.12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (6) The Board may from time to time re-constitute the Technical Working Groups by increasing or decreasing the number of experts or by changing the subject maters entrusted to such Groups. (7) The Board shall provide the administrative, financial and research support for smooth functioning of the Technical Working Groups. Rule ___ - Power of Board to delegate The Board may, by a general or special order made in writing, delegate to any member, officer of the Board or any other person subject to such conditions, if any, as may be specified in that order, such of its powers and functions under this Act (except the powers to make regulations), as it may deem necessary. Rule ____ - Chairman and Members, etc., to be public servants The Chairman, Members and other officers and employees of the Appellate Tribunal shall be deemed to be public servants within the meaning of section 21 of the Indian Penal Code, 1860. Rule ____ - Protection of action taken in good faith No suit, prosecution or other legal proceedings shall lie against the Central Government or the Board or any officer of the Central Government or any member, officer or other employees of the Boardfor anything which is in good faith done or intended to be done under the Act or the rules or regulations made thereunder.
