L.-33004/99 सी.जी.-डी.एल.-अ.-12022020-216088 xxxGIDHxxx CG-DL-E-12022020-216088 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (i) PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 85] नई दिल्ली, मगं लवार, फरवरी 11, 2020/माघ 22, 1941 No. 85] NEW DELHI, TUESDAY, FEBRUARY 11, 2020/MAGHA 22, 1941 सड़क पररवहन और रािमाग गमत्रं ालय अजधसचू ना नई दिल्ली, 11 फरवरी, 2020 सा.का.जन. 103(अ).—केंद्रीय मोटर यान जनयम, 1989, जिनम ें केंद्र सरकार मोटर यान अजधजनयम, 1988 (1988 का 59) की धारा 110 के द्वारा प्रित्त िजियों का प्रयोग करते हुए संिोधन करन े का प्रस्ट्ताव करती ह,ै म ें और अजधक संिोधन करते हुए जनम्नजलजखत प्रारूप कजतपय जनयमों को इस अजधजनयम की धारा 212 की उप-धारा (1) के द्वारा यथावश्यक इसके द्वारा प्रभाजवत होने की संभावना वाले सभी व्यजियों की िानकारी के जलए एतिद्वारा प्रकाजित दकया िाता ह;ै और नोरटस दिया िाता ह ै दक प्रारूप जनयमों को उस तारीख स े तीस दिन की अवजध समाप्त होन े के बाि जवचाराथग स्ट्वीकार कर जलया िाएगा जिसको सरकारी रािपत्र म ें यथा प्रकाजित इस अजधसूचना की प्रजतयां िनता के जलए उपलब्ध करायी िाती ह;ैं इस प्रकार जवजनर्िष्टग अवजध समाप्त होने के पहले उक्त प्रारूप जनयमों के संबंध में दकसी भी व्यजि से प्राप्त होने वाली दकन् हीं ्पजत्तयों या सवोावों पर केंद्र सरकार द्वारा जवचार दकया िाएगा इन प्रारूप जनयमों के प्रजत ्पज‍ तयों एव ं सवोावों, यदि कोई हो, को संयवि सजचव (एमवीएल, टोल और ्ईटी), ईमेल: jspb-morth@gov.in, सड़क पररवहन और रािमाग ग मंत्रालय, पररवहन भवन, संसि माग,ग नई दिल्ली-110001 के पास भेिा िा सकता ह ै 832 GI/2020 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] प्रारूप जनयम 1. िीर्कग एव ं प्रारंभ – (1) इन जवजनयमों को केंद्रीय मोटर यान (..........संिोधन) जवजनयम, 2020 कहा िायेगा (2) बित,े अन् यथा इन जनयमों म ें जनजहत के अनवसार, य े जनयम सरकारी रािपत्र म ें उनके अंजतम प्रकािन की जतजथ स ेलाग ू होंगे 2. केंद्रीय मोटर यान जनयमावली, 1989 (इसके बाि उक्त जनयमों के रूप म ें उजल्ल जखत) म ें जनम्नजलजखत संिोधनों को एतद्द्वारा िारी दकया गया ह ै (i) जनयम 100 म,ें उप जनयमों 1, 2 और 3 (खंड 3क और 3ख सजहत) के जलए जनम्नजलजखत को अतं :स्ट्थाजपत दकया िाएगा, िो 1 अक् टूबर, 2021 स े प्रभावी होगा नामत: - “(1) ववंडस्ट्रीन का िीिा और कृजर् रैक्टर सजहत प्र‍ येक मोटर वाहन की जखड़दकयां, यदि केजबन साथ लगाया गया हो, जनमागण उपकरण वाहन, यदि केजबन साथ लगाया गया हो और कंबाइन हावेस्ट्टर सवरक्षा िीिा (सेफ्टी ग् लास) या चमकीले (ग्लेविगं ) पिाथ ग का होना चाजहए बिते दक एल 5 श्रेणी के वाहनों (तीन पजहया वाहनों) और हुड वाले तथा दकनारे स े ढ़के वाहनों के मामले म ें जखड़दकयां ऐरेजलक या प्लाजस्ट्टक की पारििी िीट की हो सकती ह ैं स्ट्पष्टीकरण - इस जनयम के प्रयोिनाथ,ग - (i) "सेफ्टी ग्ल ास या सेफ्टी ग्लवे ंग" का ता‍ पय ग ह ै ्ई एस 2553 (भाग 2) (संिोधन 1): 2019 के अनवरूप सामजियां (ii) वाहन के अि भाग म ें दकसी ववंडस्ट्रीन या जखड़की, जिसकी ्ंतररक सतह वाहन के अनविैर्धय ग अक्ष स े तीस जडिी स ेअजधक कोण पर हो, को सामन े की ओर अि भाग माना िाएगा (2) प्र‍येक मोटर वाहन के ववंडस्ट्रीन और जपछली जखड़की का सेफ्टी ग्लास या सेफ्टी ग्लेव ंग ऐसा होना चाजहए और उन् ह ें ऐसी जस्ट्थजत म ें रखा िाना चाजहए दक प्रकाि का िश्ृ य संचरण 70% स े कम न हो बगल की जखड़दकयों के जलए प्रयवक् त सेफ्टी ग्लास या सेफ्टी ग्लेव ंग ऐसा होना चाजहए और उन्ह ें ऐसी जस्ट्थजत म ें रखा िाना चाजहए दक प्रकाि का िश्ृ य संचरण 50% स े कम न हो और समय-समय पर यथा सिं ोजधत भारतीय मानक ्ईएस 2553 (भाग 2) (संिोधन 1): 2019 के अनरूव प होना चाजहए (3) बिते दक मोटर वाहनों के अि भाग की ववंडस्ट्रीन का सेफ्टी ग्लास या सफ्े टी ग्लेव ंग ्ई एस 2553 (भाग 2) (संिोधन 1): 2019 म ें जवजनर्िष्टग के अनरूव प होनी चाजहए ” (ii) जनयम 123 के जलए जनम्न जलजखत को अंत:स्ट्थाजपत दकया िाएगा, िो 01 अक् टूबर 2020 स े प्रभावी होगी, नामत:- "123. मोटरसाइदकल म ें सरव क्षा उपकरण-(1) दकसी भी मोटर साईदकल, जिसम ें पीछे के सवार के जलए चालक की सीट के बगल म ें या पीछे स्ट्थ ायी जनमागण के बगैर हाथ स ेपकड़ने के प्रावधान दकया िाना और एक फवट रेस्ट्ट बनाया िाना चाजहए और पीछे वाले पजहये के ्धे जहस्ट्स े को कवर करने वाला एक सवरक्षा‍मक उपकरण होना चाजहए, तादक पीछे बैठे व्यजि के कपड़ों को पजहए म ें उलोने स े रोका िा सके: बिते दक, पीछे के सवार द्वारा हाथ स े पकड़े िान े वाल े प्रावधान, समय-समय पर यथा सिं ोजधत ्ई एस: 14495-1998 जवजनिेिों द्वारा िाजसत होने चाजहए[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 बिते दक इसके अलावा फवट रेस्ट् ट के जलए भारतीय मानक ब्यूरो अजधजनयम, 2016 (2016 के 11) के तहत संबंजधत बी्ईएस जवजनिेिों को अजधसूजचत दकए िान े तक, समय समय पर यथा संिोजधत ए्ईएस 148: 2018 म ें जवजनर्िष्टग ्वश्यकताओं का अनवपालन दकया िाएगा (2) मोटरसाइदकल पर यदि हल्के विन वाला एक कंटेनर लगाया गया ह,ै तो जनम्नजलजखत ्वश्यकताओं को पूरा करना होगा: (i) कंटेनर का ्याम लंबाई म ें 550 जममी, चौड़ाई म ें 510 जममी और ऊंचाई म ें 500 जममी स े अजधक नहीं होना चाजहए; (ii) कंटेनर का भार, उसके ्लंबन और कंटेनर म ें ले िान े वाला भार सजहत, 30 दकलोिाम स े अजधक नहीं होना चाजहए; (iii) यदि ऐसे कंटेनर को पीछे सवार के स्ट् थान पर लगाया िाता ह,ै तो दकसी को भी पीछे सवार होने की अनवमजत नहीं िी िाएगी: बिते दक कंटेनर का भार, उसके ्लंबन और कंटेनर म ें ले िान े वाला भार सजहत, वाहन जनमागता द्वारा जवजनर्िष्टग स्ट्वीकाय ग सकल वाहन भार दकलो के भीतर होना चाजहए और जनयम 126 में उजललजखत िांच एिेंसी द्वारा अनवमोदित भी होना चाजहए; (3) मोटरसाइदकलों को भारतीय मानक ब्यरू ो अजधजनयम, 2016 (2016 के 11) के तहत सबं ंजधत बी्ईएस जवजनिेिों को अजधसूजचत दकए िाने तक, समय समय पर यथा संिोजधत ए्ईएस 146: 2018 म ें जवजनर्िष्टग स्ट्टैंड ्वश्यकताओं का अनवपालन करना होगा (4) मोटरसाइदकलों को भारतीय मानक ब्यूरो अजधजनयम, 2016 (2016 के 11) के तहत संबंजधत बी्ईएस जवजनिेिों को अजधसूजचत दकए िाने तक, समय समय पर यथा संिोजधत ए्ईएस 147: 2018 म ें जवजनर्िष्टग बाहर जनकलन े वाल े जहस्ट्स े की ्वश्यकताओं का अनवपालन करना होगा; " (iii) जनयम 123 म,ें द्वीतीय परंतवक म,ें मि स.ं (iv), जनम्नजलजखत के द्वारा अतं :स्ट्थाजपत दकया िाएगा, नामत:- “(iv) यदि ऐसे कंटेनर को पीछे के सवार के स्ट् थान के पीछे लगाया िाता ह ै तो पीछे सवार को बैठने की अनवमजत होगी बिते दक वाहन, उसके ्लंबन और कंटेनर म ें ले िान े वाला भार सजहत यात्री और कंटेनर का भार वाहन जनमागता द्वारा जवजनर्िष्टग स्ट्वीकाय ग सकल वाहन भार दकलो के भीतर होना चाजहए और जनयम 126 म ें उजल्लजखत िांच एिेंसी द्वारा अनवमोदित भी होना चाजहए; " (iv) जनयम 124क म,ें उप जनयम 5क म ें िब्ि नामत: "बित े िहां कभी" को "यांजत्रक यवग्मन" के पश् चात ् और "कृजर् रैक्टर के जलए" िब्ि स े पहले अंत:स्ट् थाजपत दकया िाएगा (v) जनयम 138, उप जनयम 4 (क), खंड(क) म ें प्रथम परंतवक के पश् चात ् जनम्न जलजखत परंतवक को अंत:स्ट्थ ाजपत दकया िाएगा, िो 01 अक् टूबर, 2020 स े प्रभावी होगा “बित,े इसके अजतररक्त एम 1 श्रेणी के वाहनों के मामले म,ें यदि ट्यूबलेस टायर लगाया िाता ह ै और एक मानक मि के रूप म ें टायर मरम्मत दकट उपलब् ध कराई िाती ह,ै तो ऐसे वाहनों को तयै ार या अस्ट्थायी उपयोग वाल े अजतररक्त पजहए प्रिान करने की ्वश्यकता नहीं होगी4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] स्ट्पष्टीकरण: इस जनयम के प्रयोिनाथ,ग टायर मरम्मत दकट का ता‍ पयग ्सानी से मरम् मत करने की दकट वाहन में रखी गई ह,ै जिसका टायर पंचर होन े की जस्ट्थजत म ें संपीज डत वायव के साथ पंचर वाल े स्ट्थ ान को सील करन े वाले जवजिष्ट पिाथग का उपयोग करके टायर का पंचर ठीक करने के जलए इस्ट् तेमाल दकया िाता ह ै (vi) जनयम 95 म,ें उप-जनयम 7 के पश् चात् जनम्नजलजखत उप-जनयम िोड़ा िाएगा, िो 1 अक्टूबर, 2020 स े प्रभावी होगा: - “(8) अजधसूचना की तारीख को और उसके छह महीने बाि या 1 अक्टूबर 2020 तक, िो भी पहले ्ता ह,ै जनर्मगत 3.5 टी और एन 1 तक के अजधकतम द्रव् यमान वाल े एम 1 श्रेजणयों के वाहनों, यदि टायर प्रेिर मॉजनटररंग जसस्ट्टम (टीपीएमएस) स े सवसजित ह,ै को भारतीय मानक ब्यूरो अजधजनयम, 2016 (2016 के 11) के तहत संबंजधत बी्ईएस जवजनिेि अजधसूजचत होन े तक, समय समय पर यथा संिोजधत ए्ईएस 154 का अनवपालन करना होगा” [स.ं ्रटी-11028/03/2019-एमवीएल] जप्रयांक भारती, संयवक् त सजचव रटप्प णी: मवख्य जनयम भारत के रािपत्र, असाधारण, भाग- II, खंड 3, उप-खण् ड (i) की अजधसचू ना संख्या सा.का.जन. 590(अ), 2 िून, 1989 को प्रकाजित दकए गए थ े और जपछली बार संिोधन अजधसूचना संख् या...... ..दिनांदकत........द्वारा दकया गया था MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 11th February, 2020 G.S.R. 103(E).—The following draft of certain rules further to amend the Central Motor Vehicles Rules, 1989, which the Central Government proposes to make in exercise of the powers conferred by Section 110 of the Motor Vehicles Act, 1988 ( 59 of 1988) is hereby published as required by sub-section (1) of Section 212 of the said Act for information of all persons likely to be affected thereby and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of a period of 30 days from the date on which the copies of this notification as published in the Gazette of India, are made available to the public. The objections or suggestions which may be received from any person with respect to the said draft rules before the expiry of the period aforesaid will be considered by the Central Government; Objections and suggestions to these draft rules, if any, may be sent to the Joint Secretary (MVL, Toll & IT), email: jspb-morth@gov.in, Ministry of Road Transport and Highways, Transport Bhawan, Parliament Street, New Delhi-110 001. DRAFT RULES 1. Short title and commencement.-(1) These rules may be called as the Central Motor Vehicles (………Amendment) Rules, 2020. (2) Save as otherwise provided in these rules, they shall come into force on the date of their final publication in the Official Gazette. 2. In the Central Motor Vehicles Rules, 1989 (herein after referred as the said rules) following amendments are hereby issued. (i) in rule 100, for sub rules 1, 2 and 3 (including clause 3A and 3B), following shall be substituted with effect from 1stOctober 2021 namely.-[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 “(1) The glass of windscreen and the windows of every motor vehicle including agriculture tractors if fitted with cabin, Construction Equipment Vehicle if fitted with cabin and Combine Harvester shall be of safety glass or glazing material. Provided that in the case of L5 category vehicles (three wheelers) and vehicles with hood and side covers, the windows may be of acrylic or plastic transparent sheet. Explanation - For the purpose of this rule, - (i) “Safety glass or safety glazing” means materials conforming to IS 2553 (Part 2) (Revision 1): 2019. (ii) Any windscreen or window at the front of the vehicle, the inner surface of which is at an angle more than thirty degrees to the longitudinal axis of the vehicle shall be deemed to face to the front. (2) The safety glass or safety glazing of the windscreen and rear window of every motor vehicle shall be such and shall be maintained in such a condition that the visual transmission of light is not less than 70%. The safety glass or safety glazing used for side windows are such and shall be maintained in such a condition that the visual transmission of light is not less than 50% and shall conform to Indian Standards IS 2553 (Part 2) (Revision 1): 2019 as amended from time to time. (3) Provided that the safety glass or safety glazing of the front windscreen of motor vehicles shall be as specified in IS 2553 (Part 2) (Revision 1):2019.” (ii) for rule 123 following shall be substituted with effect from 1stOctober 2020 namely.- “123. Safety devices in motorcycle.-(1). No motor cycle, shall which has provision for pillion rider shall be constructed without provision for a permanent hand grip on the side or behind the driver's seat and a foot rest and a protective device covering not less than half of the rear wheel so as to prevent the clothes of the person sitting on the pillion from being entangled in the wheel: Provided that, the pillion hand holds shall be governed by IS: 14495-1998 specifications, as may be amended from time to time. Provided further that the foot rests shall comply with the requirements specified in AIS 148:2018, as amended from time to time, till the corresponding BIS specifications are notified under the Bureau of Indian Standard Act, 2016 (11 of 2016). (2) A light weight container if fitted on a motorcycle provided it meets the following requirements : (i) the dimensions of the container shall not exceed 550 mm in length, 510 mm in width and 500 mm in height; (ii) Weight of the container including its mounting and the load carried in the container shall not exceed 30 kgs; (iii) if such container is fitted on the pillion rider space, then no pillion rider shall be allowed: Provided that the weight of container including its mounting and the load carried in the container, shall be within the permissible Gross Vehicle Weight in kg, specified by the vehicle manufacturer and also approved by the test agency referred to in rule 126; (3) Motorcycles shall comply with the stand requirements specified in AIS 146:2018, as amended from time to time, till the corresponding BIS specifications are notified under the Bureau of Indian Standard Act, 2016 (11 of 2016); (4) Motorcycles shall comply with external projections requirements specified in AIS 147:2018, as amended from time to time, till the corresponding BIS specifications are notified under the Bureau of Indian Standard Act, 2016 (11 of 2016);” (iii) in rule 123, in the second proviso, item No. (iv), shall be substituted by the following namely :- “(iv) if such container is fitted behind the pillion rider space then pillion rider shall be allowed to be seated.6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] Provided that the weight of the vehicle, passenger and the container including its mounting and the load carried in the container, shall be within the permissible Gross Vehicle Weight in kg, specified by the vehicle manufacturer and also approved by the test agency referred to in rule 126;” (iv) in sub rule 5A, in rule 124A,the words namely “where ever provided” shall be inserted after the words namely “the mechanical couplings” and before the words namely “for agriculture tractor” (v) in clause (a), sub rule 4(a), rule 138, after the first proviso following proviso shall be inserted with effect from 1stOctober 2020. “Provided further that in case of M1 category of vehicles, if fitted with tubeless tyres and supplied with tyre repair kit as a standard item, then such vehicles need not be provided with ready for use or temporary use spare wheel. Explanation: For the purposes of this rule, Tyre Repair kit means an easy to repair kit stored in the vehicle, which in the incident of tyre puncture is used to seal the punctured spot in the tyre tread using specific sealant poured into the tyre along with compressed air.” (vi) after sub rule 7, in rule 95, the following sub- rule shall be added, with effect from 1st October 2020 namely:- “(8) Vehicles of categories M1 up to maximum mass of 3.5 T and N1, manufactured on and after six months from the date of notification or 1st day October 2020, whichever comes earlier, if fitted with Tyre Pressure Monitoring System (TPMS), shall conform to AIS-154, as amended from time to time, till the corresponding BIS specifications are notified under Bureau of Indian Standards Act, 2016 (11 of 2016)” [No. RT-11028/03/2019-MVL] PRIYANK BHARTI.
