(ख) घायल व् यजि को अस्ट् पताल म ें दाजखल करवान े के जलए संबंजधत दकसी प्रदिया को पूरा करने के जलए; या (ग) दकसी घायल व् यजि के उपचार का जचदक‍ सीय व् यय वहन करन े के जलए। बित े दक यदद नेक व् यजि न े स्ट् वेच्छ ा स े अपना नाम बताया ह ै और यदद वह ऐसा करन े की मंिा जाजहर करता ह,ै तो अस्ट् पताल अपन े आजधकाररक पत्र म ें ऐसे नेक व् यजि का नाम, पता, दघु गटना का समय, जतजथ, स्ट् थान और यह पुजष्ट करते हुए दक घायल व् यजि को उपयुगक् त व् यजि द्वारा लाया गया था, के रूप म ेंअजभस्ट् वीकृजत प्रदान करेगा। बिते दक इसके अजतररक्त एक नेक व् यजि, जो दघु गटना का प्र‍ यिदिशी ह ै और स्ट् वच्े छ ा स े चश् मदीद गवाह बनाना चाहता ह,ै तो वह जांच प्रदिया में सहायता के जलए अपने नाम और पत े के अलावा चश् मदीद गवाह बनने की मंिा भी प्रकट कर सकता ह।ै (5) प्र‍ यके अस्ट् पताल को प्रविे या सस्ट्ु पष्‍टट स्ट् थान पर हहदी, अंग्रेजी और स्ट् थानीय भार्ा म ें एक अजधकार-पत्र सावगजजनक करना होगा, जजसम ें इस अजधजनयम और इस जनयम के तहत नेक व् यजि के अजधकारों के बारे म ें बताया गया हो। जनयम 139बी- नके व्य जि की जाचं और पछू ताछ[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 3 (1) वतगमान म ेंलागू दकसी अन् य कानून म ें जनजहत दकसी असगं तता के बावजूद, यदद कोई व् यजि ऐसे मामले म ेंस्ट् वच्े छा स े प्र‍ यिदिशी बनने को सहमत ह,ै जजसम ें उसने एक नेक व् यजि की भूजमका अदा की ह,ै तो उसकी जांच पड़ताल इस जनयम के प्रावधानों के अनरूु प की जाएगी। (2) नेक व् यजि की पछू ताछ उनकी सुजवधानुसार समय और स्ट् थान, जैसे उनके आवास या काय ग के स्ट् थान, पर की जाएगी और तदनुसार जांच अजधकारी सादे कपडों म ें होंगे। बिते दक नेक व् यजि अपनी जाचं पड़ताल पुजलस थान े म ें करवाने का चयन कर सकता ह ैऔर ऐसे मामल े म,ें पूछताछ जबना दकसी अनुजचत जवलंब के समयबद्ध तरीके स ेऔर जहां तक संभव हो एक बार म ेंही परू ी की जाएगी। (3) यदद नेक व् यजि स्ट् वच्े छा स ेचश् मदीद गवाह बनना चाहता ह,ै तो उसे आपराजधक प्रदिया संजहता, 1973 की धारा 296 के अनुरूप उनका साक्ष्य िपथ-पत्र पर दने े की अनुमजत दी जाएगी। बिते दक पुजलस अजधकारी को यह सुजनजित करना होगा दक जहां तक संभव हो पूछताछ के दौरान एक ही बार म ें नेक व् यजि का पूरा बयान या िपथ-पत्र दजग दकया जाए। (4) मामले की पररजस्ट्थजतयों के अंतगगत यदद नेक व् यजि अनुजचत जवलंब, व् यय या असुजवधा के जबना उपजस्ट्थत नहीं हो सकता अथवा उसकी जांच पड़ताल उसकी सुजवधानुसार समय और स्ट् थान पर दकया जाना संभव नहीं होता ह,ै तो कोट ग ऑफ मजजस्ट् रेट आपराजधक प्रदिया संजहता,1973 की धारा 284 के तहत इसके अंतगगत दकए गए आवेदन पर जांच पड़ताल के जलए एक आयोग जनयुक्त कर सकती ह”ै । [फा. स.ं आरटी-16011/1/2015-आरएस] जप्रयांक भारती, संयुक् त सजचव रटप्प णी: मुख्य जनयम भारत के राजपत्र, असाधारण, भाग-II, खंड 3, उप-धारा (i) की अजधसूचना संख्या सा.का.जन. 590(अ), 2 जून, 1989 को प्रकाजित दकए गए थ े और जपछली बार संिोधन अजधसूचना संख् या........ ददनांदकत........द्वारा दकया गया था। MINISTRY OF ROAD TRANSPORT & HIGHWAYS NOTIFICATION New Delhi, the 26th February, 2020 G.S.R. 141(E).—The following draft of certain rules further to amend the Central Motor Vehicles Rules, 1989, which the Central Government proposes to make in exercise of the powers conferred by section 134A of the Motor Vehicles Act, 1988 (59 of 1988), is hereby published as required by sub-section (1) of section 212 of the said Act for information of all persons likely to be affected thereby; and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of thirty days from the date on which the copies of this notification as published in the Official Gazette, are made available to the public; The objections or suggestions which may be received from any person in respect of the said draft rules before the expiry of the aforesaid period will be considered by the Central Government,4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] Draft Rules 1. Short Title and commencement.-( I) These rules may be called the Central Motor Vehicles ( ...... Amendment) Rules, 2019. (2) They shall come into force on the date of their final publication in the Official Gazette. 2. In Central Motor Vehicle Rules, 1989 (hereafter referred as the said rules). I. After Rule 139, the following chapter to be included- "Chapter VIA- Examination and Questioning of Good Samaritan 139A-Rights of Good Samaritan:- (1) Any person who is a Good Samaritan, as per Section 134A of the Act, shall have the rights detailed under this chapter, and shall be treated respectfully without any discrimination on the grounds of religion, nationality, caste or sex. (2) A Good Samaritan who has informed the police of any accident involving a motor vehicle, or who has transported a victim of an accident involving a motor vehicle to the hospital, shall not be subjected to any further requirements by the police or the hospital, and shall be permitted to leave immediately. (3) No police officer, any other person, shall compel a Good Samaritan to disclose his/her name, identity, address or any such other personal details. Provided that the Good Samaritan may voluntarily choose to disclose his/her name, address, and name of the injured person (if known) to the police officer. Provided further that, if the Good Samaritan has voluntarily disclosed his/her name or personal details, the police officer shall not compel such person to become an eye witness in the case, and choice of becoming an eye-witness shall solely rest with the Good Samaritan. (4) Notwithstanding anything contained in any other law for the time being in force, a Good Samaritan who transports a victim of an accident involving a motor vehicle to the hospital shall not be forced to: (a) disclose any personal information, such as his/her name, telephone number and address, including for the purpose of the Medico-Legal Case Form; (b) fulfill any procedure related to the admission of an injured person or victim at the hospital; or (c) bear any medical expenses towards the treatment of an injured person or victim. Provided that in case the Good Samaritan has volunteered to provide the name, and if he/she so desires, the hospital shall provide an acknowledgement to such Good Samaritan, on official letter-pad, mentioning the name of the Good Samaritan, address, time, date, place of occurrence, and confirming that the injured person was brought by the said person. Provided further that a Good Samaritan who has witnessed the accident and volunteers to become an eye- witness may, in addition to his name and address, also indicate his willingness to become an eye-witness in order to facilitate the investigation process. (5) Every hospital shall publish a charter in Hindi, English and vernacular language, at the entrance or other conspicuous location, stating the rights of Good Samaritans under the Act and this rule. 139B- Examination and Questioning of Good Samaritans- (1) Notwithstanding anything to the contrary contained in any other law for the time being in force, if a person has voluntarily agreed to become a witness in the case in which he/she has acted as a Good Samaritan, he/she shall be examined in accordance with the provisions of this rule. (2) The examination of a Good Samaritan shall be conducted at a time and place of his/her convenience, such as his place of residence or business, and the investigating officer shall accordingly be dressed in plain clothes. Provided that the Good Samaritan may choose to have his examination done at the police station, and in such case, the examination shall be conducted in a time bound manner without causing undue delay, and as far as possible, completed in a single examination.[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 5 (3) In case the Good Samaritan has volunteered to become an eye-witness, he/she shall be permitted to give the evidence on affidavit in accordance with Section 296 of the Code of Criminal Procedure 1973. Provided that the police officer shall ensure that the complete statement or affidavit of the Good Samaritan shall as far as possible be recorded in a single examination. (4) In case the attendance of a Good Samaritan cannot be procured without delay, expense or inconvenience, which under the circumstances of the case would be unreasonable, or the examination is unable to take place at a time and place of his convenience, the Court of Magistrate may appoint a commission under Section 284 of the Code of Criminal Procedure, 1973 to conduct the examination, on an application made thereunder."
