2021 सा.का.जन. 57(अ).—केंद्रीय मोटर यान जनयम,1989 के कजतपय जनयमों के जनम्न जलजखत प्राूपप को, जिन्ह ें केंद्रीय सरकार, मोटर यान अजधजनयम, 1988 (1988 का 59) की धारा 27 द्वारा प्रित्त िजियों का प्रयोग करते हुए संिोधन करन े का प्रस्ट् ताव करती ह, उक्त अजधजनयम की धारा 212 की उप-धारा (1) द्वारा यथापेजित उनके द्वारा संभाव् य प्रस्ट् ताजवत सभी व् यजक्त यों की िानकारी के जलए प्रकाजित दकया िाता ह; और नोरटस दिया िाता ह दक उक्त प्राूपप जनयमों पर उस तारीख से िब इस अजधसूचना की प्रजतयां, भारत के रािपत्र में यथाप्रकाजित, आम िनता को उपलब्ध कराई िाती ह,ं से तीस दिन की अवजध की समाज‍ त के प‍ चातव जवचार दकया िाएगा इन प्राूपप जनयमों के बारे में आपजत्तयां या सुझाव, यदि कोई हो, तो संयुक्त सजचव (एमवीएल), सड़क पररवहन और रािमाग ग मंत्रालय, पररवहन भवन,1, संसि मागग, नई दिल्ल ी-110001 को भेिे िा सकेंगे अथवा comments-morth@gov.in पर ई-मेल दकए िा सकेंगे उक्त प्राूपप जनयमों के बारे में आपजत्तयां या सुझाव, िो दकसी व् यजक्त से इस प्रकार जवजनदिि‍ग ट अवजध की समाज‍ त के भीतर प्रा‍ त दकए िाते ह,ं पर केंद्रीय सरकार द्वारा जवचार दकया िाएगा प्राूपप जनयम 1. संजि‍त नाम एव ंप्रारंभ. - (1) इन जनयमों को केंद्रीय मोटर वाहन (…… संिोधन) जनयम, 2021 कहा िाएगा 2. वे आजधकाररक रािपत्र में अपने अंजतम प्रकािन की तारीख से लाग ूहोंगे 618 GI/2021 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 2. केंद्रीय मोटर वाहन जनयम,1989 में (बाि में उि जनयमों के ूपप में संिर्भगत), जनयम 11 म,ें उप-जनयम (1) म,ें खंड (डी) के बाि, जनम्नजलजखत खंड को अतं ःस्ट्थाजपत दकया िाएगा, अथागतव: - "(ई) ईंधन कुिल ड्राइववंग तकनीक का ज्ञान और उसकी समझ " 3. उि जनयमों म,ें जनयम 14 में, खंड (ई) के बाि, जनम्नजलजखत खंड को अतं ःस्ट्थाजपत दकया िाएगा, अथागत:व - "(एफ) जनयम 31 ई के अनुसार, प्रपत्र 5बी में मान्यता प्राप्त चालक प्रजििण केंद्र से प्रमाणपत्र, यदि कोई हो " 4. उि जनयमों म,ें जनयम 15 में, उप-जनयम (2) के बाि, जनम्नजलजखत परंतुक अतं ःस्ट्थाजपत दकया िाएगा, अथागत:व - "बिते दक फॉम ग5बी में प्रमाण पत्र धारक को ड्राइववंग टेस्ट्ट की आव‍यकता से छूट िी िाएगी" 5. जनयम 31A के बाि, उि जनयमों में, जनम्नजलजखत जनयम अतं ःस्ट्थाजपत दकए िाएंगे, अथागत:व - “प्रत्यायन प्राप्त ड्राइवर प्रजििण केंद्र 31बी. प्रत्यायन प्राप्त चालक प्रजििण केंद्र. - (1) कोई भी व्यजि राज्य पररवहन प्राजधकरण अथवा केंद्रीय मोटर वाहन जनयम,1989 के जनयम 126 में उल्लेजखत दकसी परीिण एिेंसी की जसफाररस पर केंद्र सरकार द्वारा अजधसूजचत दकसी प्राजधकृत एिेंसी द्वारा फॉमग 11ए म ें दिए गए प्रत्यायन के जबना मोटर वाहन चलान े का जििण िने े हते ु एक प्रत्यायन प्राप्त चालक प्रजििण केंद्र की स्ट्थापना या रखरखाव नहीं करेगा (2) उप-जनयम (1) के तहत प्रत्यायन की स्ट्वीकृजत या नवीकरण हते ु फॉमग 12ए या फॉम ग 13ए म,ें यथाजस्ट्थजत, राज्य पररवहन प्राजधकारी, िहां वह केंद्र जस्ट्थत ह, को आवेिन जनयम 32 म ेंजनदििष्टग उजचत िल्ु क के साथ दकया िाएगा स्ट्पष्टीकरण. - इस जनयम के प्रयोिनों के जलए "नाजमत प्राजधकारी" का अथग ह ऐसा अजधकारी िो राज्य पररवहन प्राजधकरण के पि स ेनीचे का अजधकारी नहीं हो या केंद्र सरकार द्वारा अजधसूजचत प्राजधकृत एिेंसी का नाजमत अजधकारी (३) नाजमत प्राजधकारी िब इस जनयम के तहत दकसी प्रत्यायन की स्ट्वीकृजत या नवीनीकरण के जलए एक आवेिन पर जवचार करेगा, तो जनम्नजलजखत बातों पर ध्यान िगे ा यथा : - I. आवेिक और उसके अधीन काम करने वाले कमगचारी अच्छे न जतक चररत्र के ह ंऔर ड्राइववगं जनििे िने े के जलए योग्य हं; II. आवेिक जनम्नजलजखत न्यूनतम बुजनयािी ढांचे और अन्य आव‍यकताओं को बनाए रखता ह, अथागत:व - क. पररसर िहां केंद्र का संचालन प्रस्ट्ताजवत ह, या तो आवेिक के स्ट्वाजमत्व में ह या उसके द्वारा पट्टे पर जलया गया ह या उसके नाम पर रखा गया ह , िो म िानी इलाकों म ें 2 एकड़ या पहाड़ी जिलों में 1 एकड़ िेत्र म ें फ ला ह, यथाजस्ट्थजत, और इसके पास ड्राइववंग प्रजििण प्रिान करने हते ु व्यवहृत वाहनों के जलए पयागप्त पार्किंग िेत्र के अजतररि पयागप्त बुजनयािी ढााँचा ह ख. यातायात जनयमों और जवजनयमों ,चालन प्रदक्रया, वाहन यंत्ररचना, सावगिजनक संबंध और प्राथजमक जचदकत्सा पर जसद्ांत किाए ं / पाठ आयोजित करने के जलए कं‍यूटर और मल्टीमीजडया प्रोिेक्टर ि से प्रजििण म ें मििगार सामग्री के साथ िो किाए;ं ग. वाहन के िोनों वगों (LMV और HMV) के जलए जसम्युलेटर घ. बायो-मेररक अटेंडेंस जसस्ट्टम सजहत ब्रॉडबंड कनेजक्टजवटी ङ. पंतरेबाजी, पार्किंग, ररवसग ड्राइववंग, ढलान पर ड्राइववंग आदि के जलए प्रजििुओं को अभ्यास प्रिान करने के जलए ड्राइववंग र क च. िो पजहया वाहनों को छोड़कर िोहरे जनयंत्रण के साथ प्रत्येक वगग का कम से कम एक वाहन छ. प्रििगन के साथ-साथ कायगिाला ि. बायोमेररक उपजस्ट्थजत प्रणाली, योग्य प्रजििक, ई-भुगतान, वास्ट्तजवक समय मूल्यांकन, ऑनलाइन मूल्यांकन प्रदक्रया और प्रत्येक श्रणे ी म ें पयागप्त स्ट्टाफ संसाधन (जििण कमगचारी, आईटी कमी, सफाई कमगचारी आदि) होन े चाजहए;[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 झ. भवन / पररसर प्रचजलत मानिडं ों के अनुसार होना चाजहए; ञ. प्रजििु और प्रजििकों के प्रजििण वाहनों का व ध बीमा; ट. अन्यान्य, ि सा दक आव‍यक हो सकता ह III. प्रजििण प्रिान करने हते ु उसके द्वारा जनयोजित आवेिक या कोई भी स्ट्टाफ जनम्नजलजखत योग्यता रखता हो, यथा: - क. 12वीं किा पास की न्यूनतम िि जणक योग्यता; ख. केंद्र या राज्य सरकार द्वारा स्ट्थाजपत दकसी संस्ट्थान या राज्य सरकार के तकनीकी जििा बोडग द्वारा मान्यता प्रित्त दकसी संस्ट्थान स े मोटर यांजत्रकी में एक कोसग म ें प्रवीणता परीिा प्रमाण पत्र या म केजनकल इंिीजनयररंग म ें कोई भी उच्चतर योग्यता के अलावा पांच साल का न्यनू तम ड्राइववंग अनुभव ग. अजधजनयम की अनुसूची और धारा 118 के तहत बनाए गए जनयमों में जनदििष्टग यातायात संकेतों का गहन ज्ञान; घ. वाहनों के जवजभन्न घटकों, पुिों के कायों को प्रिर्िगत करन े और समझाने की िमता; ङ. जसम्यूलेटर और ड्राइववंग के जवजभन्न तरीकों के उपयोग को प्रिर्िगत करने की िमता; च. अंग्रेिी या उस िेत्र की िेत्रीय भाषा का, जिसमें केंद्र या संस्ट्थान जस्ट्थत ह पयागप्त ज्ञान: बिते दक कोई भी व्यजि िो इन जनयमों के िुूप होने स ेठीक पहले पांच साल से कम नहीं की अवजध के जलए प्रजििक के ूपप म ेंसेवा कर चुका हो, उसे इस उप-खंड की आव‍यकताओं से छूट िी िाती ह (4) नाजमत प्राजधकारी, उप-जनयम (2) के तहत आवेिन प्राप्त होने पर और संतुष्ट होन े के बाि दक आवेिक न े उप-जनयम (3) की आव‍यकताओं का अनुपालन दकया ह, तो ऐसे आवेिन की प्राजप्त के 60 दिनों की अवजध के भीतर फॉमग 11ए म ें प्रत्यायन स्ट्वीकृत या नवीकृत कर सकती ह (5) प्रत्यायन के जलए कोई भी आवेिन नाजमत प्राजधकारी द्वारा तब तक अस्ट्वीकार नहीं दकया िाएगा िब तक दक आवेिक को सुनवाई का अवसर न दिया िाए और इस तरह के इनकार के कारण जलजखत ूपप स े लाइसेंवसंग प्राजधकारी द्वारा दिए गए हों 31ई. प्रत्यायन धारक द्वारा पालन दकए िानेवाली साधारण ित-ें जनयम 31B के तहत प्रिान दकए गए मान्यता का धारक:- बिते दक उि मान्यता की व धता जनधागररत मानिंडों को परू ा करने के अधीन होगी, िो जनदििष्टग प्राजधकारी या दकसी अन्य प्राजधकारी द्वारा प्रमाजणत दकया िाएगा, ि सा दक राज्य सरकार द्वारा वार्षगक आधार पर जनधागररत दकया िा सकता ह 31 डी डुज‍लकेट मान्यता िारी करना - (1) यदि दकसी भी समय जनयम ३१ बी के उप-जनयम (४) के तहत िी गई मान्यता खो िाती ह या नष्ट हो िाती ह, तो मान्यता के धारक को मान्यता प्राप्त प्राजधकारी को हुए नुकसान के बारे म ें सूजचत करना होगा डुज‍लकेट के जलए, उि प्राजधकरण को जलजखत ूपप में आवेिन करना होगा (2) जनयम 32 में जनदििष्टग उजचत िुल्क के साथ एक आवेिन प्राप्त होने पर, नाजमत प्राजधकारी स्ट्पष्ट ूपप से "डुज‍लकेट" के ूपप में जचजननत एक नकली मान्यता िारी करेगा (3) यदि एक डुज‍लकेट मान्यता के मुद्दे के बाि, मूल पाया िाता ह, तो उसे उसी जनदििष्टग प्राजधकारी के सामने आत्मसमपगण कर दिया िाएगा जिसके द्वारा उसे िारी दकया गया था 31 ई एक मान्यता धारक द्वारा िेखी िाने वाली सामान्य जस्ट्थजतयााँ - जनयम 31B के तहत िी गई प्रत्यायन की धारक, - I. फॉमग 14 में एक इलक्े रॉजनक रजिस्ट्टर और वषग के िौरान प्रवेजित छात्रों के नामों की एक वणगमाला सूची बनाए रखेगा; II. जनयम 31िे म ेंजनदििष्टग पाठ्यक्रम के अनुसार प्रजििण कोसग का संचालन करेगा; III. फॉमग 5बी में पाठ्यक्रम पूरा करने वाल ेप्रत्येक छात्र को प्रमाण-पत्र िारी करेगा;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] IV. प्रत्यायन िारी करने वाल ेनाजमत प्राजधकारी को इस अध्याय के प्रयोिनों के जलए समय-समय पर मागं ी गई सूचना प्रस्ट्तुत करेगा V. प्रत्यायन िारी करने वाल ेनाजमत प्राजधकारी के पूवग जलजखत अनुमोिन के जबना प्रत्यायन म ेंउजल्लजखत पररसर को स्ट्थानांतररत नहीं करेगा VI. प्रजििण हते ु व्यवहृत सभी मोटर वाहनों पर नाम, केंद्र का परू ा पता, और टेलीफोन नं. सुस्ट्पष्ट ूपप से मोटे अिरों म ेंप्रिर्ितग करेगा VII. फॉमग 15 में प्रत्येक प्रजिि ुद्वारा हर दिन जबताए गए ड्राइववंग घंटे की संख्या दिखात े हुए अलग से ररकॉडग बनाए रखेगा; VIII. अपन े कायागलय म ेंप्रमुख स्ट्थान पर जनम्नजलजखत का प्रििगन करेगा- a. नाजमत अजधकारी द्वारा केंद्र को िारी दकए गए प्रत्यायन की मलू प्रजत, और b. केंद्र द्वारा जनयिु प्रजििकों के नाम, पता, और मोबाईल नं; IX. केंद्र से प्रजििण प्राप्त करने हते ु आवेिन करने वाल े व्यजि को जनयमसंगत तरीके से उनके प्रत्यायन प्राप्त करन े की िमता के अन्यथा, उस े गुमराह करन े के जलए पररकजल्पत इस प्रकार स े कायग नहीं करेगा या इस अध्याय के प्रावधानों में गजतरोध उत्पन्न करने हते ु दकसी व्यजि स ेकृताकृत में सांठगांठ नहीं करेगा 31एफ. प्रत्याजयत चालक प्रजििण केंद्रों की लेखा-परीिा- (1) नाजमत प्राजधकारी जनयजमत लेखा-परीिा के माध्यम से केंद्र के कायों की तथा उनके द्वारा जनयमों के अनुपालन की जनगरानी करेगा लेखा परीिा का कायग नाजमत प्राजधकारी द्वारा इस हते ु प्राजधकृत दकसी अजधकारी द्वारा दकया िाएगा 2. केंद्र बारम्बार होन े वाली लखे ा परीिाओं के अध्यधीन होगा पहला ऑजडट केंद्र के संचालन के िूपु होन े के 3 महीन े के भीतर और दफर हर साल एक बार आयोजित दकया िाएगा केंद्र कोसग की समाजप्त की जतजथ से जपछले 5 वषग के िौरान दिए गए प्रजििण के प्रलेखन का रखरखाव करेगा ऐसी लेखा परीिाओं की लागत केंद्र द्वारा वाहन की िाएगी 3. जनधागररत लेखा परीिाओं के अलावा नाजमत प्राजधकारी द्वारा केंद्र में आकजस्ट्मक जनरीिण भी दकया िाएगा कायागलय समय के िौरान दकसी भी समय जनरीिण के समन्वय एवं इसे सिम बनाने हते ु केंद्र का प्रबंधन उत्तरिायी होगा 4. लेखा परीिा हते ु केंद्र जनम्नजलजखत कागिात का रखरखाव करेगा – i. इलेक्रॉजनक उपजस्ट्थजत रजिस्ट्टर ii. केंद्र को चलाने का प्रत्यायन-पत्र iii. िमीन के पट्टे या स्ट्वाजमतत्व का कागि; iv. प्रजििकों एवं प्रजििओंु की पात्रता योग्यता जसद् करन े संबंधी कागिात; v. प्रजििण वाहन स्ट्वाजमतत्व के कागिात; vi. प्रजििण प्रिान करने संबंधी कागिात 31िी. प्रत्यायन रद्द करन े या जनरस्ट्त करने के जलए नाजमत प्राजधकारी की िजि - प्रत्यायन धारण करन े वाले व्यजि को सुनवाई का अवसर प्रिान करन े के पश्चात, यदि प्रत्यायन स्ट्वीकृत करने वाल ेनाजमत प्राजधकारी को यह समाधान हो िाता ह दक वह- a. जनयम 31b के उप जनयम(3) म ेंजवजनदििष्टग आव‍यकताओं के अनुपालन में जवफल राहत ह; या b. प्रजििण म ेंप्रयिु वाहनों के अच्छी अवस्ट्था में रखरखाव में जवफल रहता ह; या c. प्रजििण प्रिान करन े में जनयम 31िे में जनदििष्टग पाठ्यक्रम का पालन करन े में जवफल रहता ह; या[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 i. 31ई जनयम के दकसी प्रावधान का उल्लघं न करता ह, तो वह जलजखत म ेंििग कारणों से, एक जवजनदििष्टग अवजध के जलए प्रत्यायन को जनलंजबत करते हुए; या ii. प्रत्यायन को जनरस्ट्त करते हुए आिेि िारी कर सकता ह- (2) िहां प्रत्यायन जनयम (1) के तहत जनरस्ट्त या जनलंजबत दकया गया ह, वहा ाँ प्रत्यायन प्रमाण पत्र धारक द्वारा यह नाजमत प्राजधकारी को सौंप दिया िाएगा 31एच जनयम31 बी, जनयम 31सी या जनयम 31िी के उप-जनयम (5) के तहत नाजमत प्राजधकारी द्वारा िारी दकसी आिेि से िजु खत कोई भी व्यजि ऐसे आिेि की प्राजप्त के 30 दिनों के भीतर, यदि प्रत्यायन का आवेिन राज्य पररवहन प्राजधकारी को दकया गया ह तो सजचव(पररवहन)/उस राज्य के पररवहन आयुि िहां केंद्र जस्ट्थत ह, को, और यदि प्रत्यायन का आवेिन केंद्र सरकार द्वारा अजधसूजचत प्राजधकृत एिेंसी को दकया गया हो तो यथाजस्ट्थजत केंद्र सरकार को अपील करेगा 31आई. अपील की प्रदक्रया- (1) उस आििे की प्रमाजणत प्रजत जिसके जवरुद् अपील दकया गया ह तथा जनयम 32 म ें जवजनदििष्टग िुल्क के साथ नाजमत प्राजधकारी के आिेि के जवरुद् आपजत्तयों के कारणों को उजल्लजखत करते हुए, जनयम 31एच के तहत अपील ज्ञापन के ूपप म ेंिो प्रजतयों म ेंवांजछत होगा (2) अपीलीय प्राजधकारी, पिों को सुनवाई का अवसर िने े के बाि और इस तरह की आग े की पछू ताछ के बाि, यदि कोई हो, ि सा दक आव‍यक हो, ऐसे अपील की प्राजप्त की जतजथ स े पंतालीस दिनों की अवजध के भीतर उजचत आिेि पाररत कर सकता ह 31ि.े मान्यताप्राप्त ड्राइववगं प्रजििण केंद्रों द्वारा मोटर वाहनों के ड्राइववगं म ें जनििे िेन े के जलए पाठ्यक्रम - (1) मोटर वाहन चलान े के जनिेि िेन े का पाठ्यक्रम जनम्नानुसार होगा: - क. लाइट मोटर वाहन ड्राइववगं सभी खंडों में पाठ्यक्रम की अवजध 4 सप्ताह की अवजध म ें29 घंटे ह इन्ह ें2 सेगमेंट, थ्योरी और प्र जक्टकल में जवभाजित दकया िाना ह थ्योरी - 8 घंटे थ्योरी जवषय घटं े ड्राइववंग थ्योरी 1 यातायात जििा 2 मूल वाहन तंत्र जसद्ांत डेमो 1 िनसंपकग और प्राथजमक उपचार 1 रोड जिष्टाचार और व्यवहार और रोड रेि 1 िघु गटनाओं और मामले के अध्ययन के कारण 1 ड्राइववंग ईंधन ििता 1 प्र जक्टकल - 21 ड्राइववंग आव‍यकताओं म ें जविेषज्ञता दिलान े वाले कोसग व कायगक्रम की व्यवस्ट्था करन े का जवकल्प भी चुन सकता ह, ि स े दक खतरनाक / िोजखम वाला सामान, फायर रक, एम्बुलेंस, ड्राइवर वाहन, जडलीवरी व न, जवस्ट्फोटक और वस्ट्प्रंकलर रक, फोकगजलफ्र्टस, सेंटर बस, प्रजििण कायगिालाएं आदि को ल े िाने वाले वाहन इन कायों के जलए अजतररि प्रजििण की आव‍यकता होती ह , जिसे इन पाठ्यक्रमों के माध्यम से संबोजधत दकया िा सकता ह (3) उपरोि पाठ्यक्रम राष्ट्रीय कौिल जवकास जनगम (एनएसडीसी)और मानकीकरण, परीिण और गुणवत्ता प्रमाणन (एसटीक्यूसी)के मागगििगन और आव‍यकताओं के अनुसार होना चाजहए (४) प्रजििुओं की उपजस्ट्थजत की जनगरानी कड़ाई से बायोमेररक प्रणाली के माध्यम से की िानी चाजहए प्रजििण के पश्चात पात्रता का मानिंड 85% होगा इस मानिंड को पूरा नहीं करने वाले को अंजतम मल्ू यांकन से अव‍य हटा दिया िाना चाजहए ड्राइववंग अभ्यास में उपजस्ट्थजत या जवफलता की कमी के जलए प्रजििण की अवजध आव‍यकता के अनुसार बढ़ाई िा सकती ह (5) जसद्ांत व प्रायोजगक का अंजतम मल्ू यांकन उत्तीण ग करन े के जलए न्यूनतम मानिडं 60% ह संस्ट्थान द्वारा आयोजित ड्राइववंग परीिा उत्तीणग करने वाले प्रजििुओं को मोटर वाहन जनरीिक को एलएमवी/एचएमवी ड्राइववंग लाइसेंस संस्ट्तुजत के जलए भेिा िाएगा (6) सभी थ्योरी पेपसग और मोटर वाहन इंस्ट्पेक्टर के टेस्ट्ट में पास होने [फा. स.ं आरटी-11036/137/2020-एमवीएल] अजमत वरिान, संयुि सजचव रट‍प ण: मूल जनयम भारत के रािपत्र असाधरण, भाग II, खंड 3, उप-खंड (i) में अजधसूचना संख् या का.आ. 590 (अ), दिनांदकत 2 िून, 1989 द्वारा प्रकाजित दकए गए थ े और बाि में अजधसूचना सं. सा.का.जन. ______(अ), दिनांदकत ______ द्वारा इसमें संिोधन दकया गया था MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 29th January, 2021 G.S.R. 57(E).—The following draft of certain rules further to amend the Central Motor Vehicles Rules, 1989, which the Central Government proposes to make in exercise of the powers conferred by section 27 of the Motor Vehicles Act, 1988 (59 of 1988), is hereby published as required by sub-section (1) of section 212 of the said Act for information of all persons likely to be affected thereby; and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of thirty days from the date on which the copies of this notification as published in the Official Gazette, are made available to the public; Objections and suggestions to these draft rules, if any, may be sent to the Joint Secretary (MVL), email: comments-morth@gov.in , Ministry of Road Transport and Highways, Transport Bhawan, Parliament Street, New Delhi-110 001. The objections or suggestions which may be received from any person in respect of the said draft rules before the expiry of the aforesaid period will be considered by the Central Government. Draft Rules 1. Short Title and commencement. - (1) These rules may be called the Central Motor Vehicles (……Amendment) Rules, 2021. (2) They shall come into force on the date of their final publication in the Official Gazette. 2. In Central Motor Vehicle Rules, 1989 (hereinafter referred to as the said rules), in rule 11, in sub-rule (1), after clause (d), the following clause shall be inserted, namely: - “(e) knowledge and understanding of fuel efficient driving technique;”. 3. In the said rules, in rule 14, after clause (e), the following clause shall be inserted, namely: -20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] “(f) Certificate from Accredited Driver Training Center in Form 5B as per rule 31E, if any.”. 4. In the said rules, in rule 15, after sub-rule (2), the following proviso shall be inserted, namely: - “Provided that the holder of certificate in Form 5B shall be exempted from requirement of driving test”. 5. In the said rules, after rule 31A, the following rules shall be inserted, namely: - “Accredited Driver Training Centers 31B. Accredited Driver Training Centers. — (1) No person shall establish or maintain an accredited driver training center for imparting instructions for driving motor vehicles without an accreditation in Form 11 A granted by the State Transport Authority or any authorised agency notified by the Central Government on recommendation of any testing agency referred in rule 126 of the Central Motor Vehicle Rules, 1989. (2) An application for the grant or renewal of an accreditation under sub-rule (1) shall be made in Form 12 A or Form 13 A, as the case may be, to the State Transport Authority of the State in which the center is situated and shall be accompanied by appropriate fee as specified in rule 32. Explanation.— For the purposes of this rule "designated authority" means an officer not below the rank of the State Transport Authority or designated official of authorised agency notified by the Central Government. (3) The designated authority shall, when considering an application for the grant or renewal of an accreditation under this rule, have regard to the following matters, namely: — I. the applicant and the staff working under him are of good moral character and are qualified to give driving instructions; II. the applicant maintains the following minimum infrastructure and other requirements, namely: — a. the premises where the center is proposed to be conducted is either owned by the applicant or is taken on lease by him or is hired in his name, spread over area of 2 acre in plains or 1 acre in hilly districts, as the case may be, and it has adequate infrastructure besides adequate parking area for the vehicles meant to be used for imparting instructions in driving; b. Two class-rooms with teaching aids like computers and Multimedia Projector for holding theory classes/ lessons on Traffic Rules and Regulations, Driving Procedures, Vehicle Mechanism, Public Relations and First Aid; c. Simulator(s) for both the classes of vehicles (LMV and HMV); d. Broadband connectivity including bio-metric attendance system; e. Driving track to provide practice to the trainees for maneuvering, parking, reverse driving, driving on slopes, etc. f. Minimum one vehicle of each class of vehicles with dual control except in case of two wheelers. g. Workshop along with exhibits; h. Should have biometric attendance system, qualified instructors, e-payment, real time evaluation, online evaluation process and adequate staff resources in each category (Teaching staff, IT personnel, cleaning staff etc.); i. building/ premises should be as per prevailing norms; j. Valid Insurance of the training vehicles for trainee and trainers; k. Any other, as may be required. III. The applicant or any member of the staff employed by him for imparting instructions possesses the following qualifications, namely: — a. a minimum educational qualification of a pass in the 12th standard; b. a minimum driving experience of five years in addition to a Proficiency Test Certificate in a course in motor mechanics or any other higher qualification in mechanical engineering from an institution established by the Central or a State Government or from an institution recognised by the Board of Technical Education of a State Government; c. thorough knowledge of traffic signs specified in the Schedule to the Act and the regulations made under section 118; d. ability to demonstrate and to explain the functions of different components, parts of the vehicles;[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 21 e. ability to demonstrate usage of simulators and different modes of driving; f. adequate knowledge of English or the regional language of the region in which the center or establishment is situated: Provided that any person who has served as an instructor for a period of not less than five years immediately before the commencement of these rules, is exempted from the requirements of this sub-clause. (4) The designated authority may, on receipt of an application under sub-rule (2) and after satisfying that the applicant has complied with the requirements of sub-rule (3), grant or renew an accreditation in Form 11A within a period of sixty days from receipt of such an application. (5) No application for accreditation shall be refused by the designated authority unless the applicant is given an opportunity of being heard and reasons for such refusal are given in writing by the licensing authority 31C. Duration of an accreditation and renewal thereof. — An accreditation granted in Form 11 A shall be in force for a period of five years and may be renewed on an application in Form 13 A made to the designated authority which granted the accreditation not less than sixty days before the date of its expiry: Provided that the validity of the said accreditation shall be subject to fulfilling the criteria as prescribed, which shall be certified by the designated authority or any other authority as, may be prescribed for the purpose by the State Government on an annual basis. 31D. Issue of duplicate accreditation. — (1) If at any time an accreditation granted under sub-rule (4) of rule 31B is lost or destroyed, the holder of the accreditation shall forthwith intimate the loss to the designated authority which granted the accreditation and shall apply in writing to the said authority, for a duplicate. (2) On receipt of an application along with the appropriate fee as specified in rule 32, the designated authority shall issue a duplicate accreditation clearly marked "Duplicate". (3) If after the issue of a duplicate accreditation, the original is found, the same shall be surrendered forthwith to the designated authority by which it was issued. 31E. General conditions to be observed by the holder of an accreditation. — The holder of an accreditation granted under rule 31B shall, — I. maintain an electronic register in Form 14 and an alphabetical list of the names of the students admitted during the year; II. conduct the training course according to the syllabus specified in rule 31J; III. issue to every student who has completed the course a certificate in Form 5B; IV. submit to the designated authority which granted the accreditation such information as may be called for by it from time to time for the purposes of this Chapter; V. not shift the center from the premises mentioned in the accreditation without the prior approval in writing of the designated authority, which granted the accreditation; VI. exhibit in a conspicuous manner on all the motor vehicles used for imparting instructions the name, full address of the center and the telephone number, in bold letters; VII. maintain a record separately for each trainee showing the number of driving hours spent every day in Form 15; VIII. display at a prominent place in its office the following: — a. the accreditation in original issued to the center by the designated authority, and b. the names, addresses and mobile number of instructors employed by the center; IX. not act in a manner calculated to mislead any person making an application to receive instructions from the center as to his ability to procure an accreditation for such person other than in accordance with these rules or to connive with any person in acts of commission or omission with a view to circumventing the provisions of this Chapter. 31F. Audit of Accredited Driver Training centers. — (1) The designated authority shall monitor the operation of the center and compliance to these rules through regular audits. The audits may be conducted by an officer authorised in this behalf by the designated authority. (2) The center shall be subjected to recurring Audits. The first audit will be conducted within 3 months of start of operations of the center and then once every year. The center needs to maintain the documentation of training provided for last 5 years from the date of completion of course. The cost of such audits will be borne by the center.22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (3) Apart from scheduled Audits, the center might also be subjected to surprise Audits by the designated authority. Management of the center shall be responsible for enabling and coordinating inspection at any point of time during office hours. (4) The center shall maintain the following documents ready for audit purpose: i. Electronic Attendance register; ii. Accreditation to run the center; iii. Land lease or ownership paper; iv. Document to prove eligibility qualification of trainees and instructions; v. Training Vehicles Ownership papers; vi. Training delivery documents. 31G. Power of the designated authority to suspend or revoke accreditation. — (1) If the designated authority which granted the accreditation is satisfied, after giving the holder of the accreditation an opportunity of being heard, that he has— a. failed to comply with the requirements specified in sub-rule (3) of rule 31B; or b. failed to maintain the vehicles in which instructions are being imparted in good condition; c. failed to adhere to the syllabus specified in rule 31J in imparting instruction; or d. violated any other provision of rule 31E, it may, for reasons to be recorded in writing, make an order, — i. suspending the accreditation for a specified period; or ii. revoking the accreditation (2) Where the accreditation is suspended or revoked under sub-rule (1), the accreditation certificate shall be surrendered to the designated authority by the holder thereof. 31H. Appeal.—Any person aggrieved by any order of the designated authority under sub-rule (5) of rule 31B, rule 31C or rule 31G may, within thirty days of the date of receipt of such order, appeal to Secretary (Transport)/Transport Commissioner of the State in which the center is situated if the application for accreditation is made to State Transport Authority and in case of application of accreditation made to authorised agency notified by the Central Government, to the central Government as the case may be. 31I. Procedure for appeal. — (1) An appeal under rule 31H shall be preferred in duplicate in the form of a memorandum, setting forth the grounds of objections to the order of the designated authority and shall be accompanied by a certified copy of the order appealed against and appropriate fee as specified in rule 32. (2) The appellate authority, after giving an opportunity to the parties to be heard and after such further enquiry, if any, as it may deem necessary, pass appropriate orders within a period of forty-five days from the date of receipt of such an appeal. 31J. Syllabus for imparting instructions in driving of motor vehicles by accredited Driving Training Centers. — (1) The syllabus for imparting instructions in driving of motor vehicles shall be as follows: — A. Refresher/ Orientation courses Refresher/ Orientation courses shall be of short duration of 2-3 days and may include the following topics:  Behavioural Practices & stress management  Defensive Driving Techniques  Traffic Rules and Regulations  Emergency handling techniques  Maintenance & fuel conservation  Pollution and environment  Case studies on accidents to analyze the cause of accident, who was at fault and how it could have been averted A practical skill test and theoretical behavioural analysis test to be conducted for such drivers to understand and analyze their improvement areas and give special focus on those areas during the course of training. Simulators may be used to train & assess such drivers in particular. (2) Apart from above mentioned courses, the center may also choose to provide courses and programs specializing in particular type of driving requirements like Vehicles carrying Dangerous/ Hazardous goods, Fire Trucks, Ambulance, Chauffeur Driver, Delivery Van, Explosive & Sprinkler Trucks, Forklifts, Center Bus, Training Workshops etc. These operations require additional training requirement which can be addressed through these courses. (3) The above courses should be in accordance with the National Skill Development Corporation (NSDC) and Standardization, Testing and Quality Certification (STQC) guidance and requirements. (4) The attendance of the trainees should be strictly monitored and recorded through biometric system. The criteria for eligibility post training shall be 85%. Anyone not completing this criterion must be debarred from final evaluation. For shortage of attendance or failure in Driving Practice the training period may be extended as per requirement. (5) The minimum criteria to pass the final evaluation of theory as well as practical is 60%. The trainees who passed the Driving Performance Test conducted by the Institute will be sent to Motor Vehicle Inspector's for LMV/ HMV Driving License Endorsement. (6) After passing in all Theory Papers and Motor Vehicle Inspector's Test, the Proficiency Test Certificate will be issued to the trainees. A copy of the passing certificate along with the necessary details of the trainees will also be sent to the concerned RTO for issuance of driving license.”. 6.
