3. उक्त जनयमों म,ें जनयम 55 म,ें उप-जनयम (2) म,ें खंड 3 के पश्च ात जननलिजलजखत खंड को अंत:स्ट् थाजपत दकया जाएगा, अथागत:्- ‘‘(iv) नाजमती के पहचान का प्रमाण, यदद कोई हो’’; 4. उक्त जनयमों म,ें जनयम 56 म,ें उप-जनयम (2) म,ें खडं (ड.) के पश् चात जननलिजलजखत खडं को अंत:स्ट्थ ाजपत दकया जाएगा, अथागत:्- ‘‘(च) नाजमती के पहचान का प्रमाण, यदद कोई हो’’; 5. उक्त जनयमों म,ें जनयम 56 म,ें उप-जनयम (2) म,ें जननलिजलजखत उप-जनयम को अंत:स्ट् थाजपत दकया जाएगा, अथागत:्- ‘‘(3) इस जनयम म ें सज‍ नजहत दकसी बात के होत े हुए यह जनयम वैसे मामलों में लागू होगा जहां नाजमती को वाहन के पंजीकृत स्ट् वामी द्वारा जनर्ददष् ट दकया गया ह’ै’; बिते दक नाजमत अपने आवासीय राज्य अथवा व् यापार के स्ट्थ ान में दकसी पंजीकरण प्राजधकारी को पोटगल के मा‍ यम से सूजचत करेगा और अपन े नाम म ें नवीन पंजीकरण प्रमाणपत्र जनगतग करान े के जलए इलेक्र ॉजनक रूप स े आवेदन करेगा। 6. उक्त जनयमों म,ें जनयम 57 म,ें उप-जनयम (1) म,ें खडं (ड.) के पश् चात जननलिजलजखत खडं को अंत:स्ट्थ ाजपत दकया जाएगा, अथागत:्- ‘‘(च) नाजमती के पहचान का प्रमाण, यदद कोई हो’’; and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of thirty days from the date on which the copies of this notification as published in the Official Gazette, are made available to the public; Objections and suggestions to these draft rules, if any, may be sent to the Joint Secretary (MVL), email: director-morth@gov.in , Ministry of Road Transport and Highways, Transport Bhawan, Parliament Street, New Delhi-110 001. The objections or suggestions which may be received from any person in respect of the said draft rules before the expiry of the aforesaid period will be considered by the Central Government. Draft Rules 1. Short Title and commencement.—(1) These rules may be called the Central Motor Vehicles (……Amendment) Rules, 2020. (2) They shall come into force on the date of their final publication in the Official Gazette. 2. In Central Motor Vehicle Rules, 1989 (hereinafter referred to as the said rules) in rule 47, in sub-rule (1), after clause (l), the following clause shall be inserted, namely: - “ (m) proof of identity of nominee, if any”; 3. In the said rules, in rule 55, in sub-rule (2), after clause (iii), the following clause shall be inserted, namely: - “ (iv) proof of identity of nominee, if any”; 4. In the said rules, in rule 56, in sub-rule (2), after clause (e), the following clause shall be inserted, namely: - “(f) proof of identity of nominee, if any”; 5. In the said rules, in rule 56, after sub-rule (2), the following sub-rule shall be inserted, namely: - “(3) Notwithstanding anything contained in this rule shall apply in case where the nominee has been specified by the registered owner of the vehicle: Provided that the nominee shall inform any registering authority in the state of his residence or place of business through the portal and apply for a fresh certificate of registration in his/her name electronically. 6. In the said rules, in rule 57, in sub-rule (1), after clause (e), the following clause shall be inserted, namely: - “(f) proof of identity of nominee, if any”;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 7. In the said rules, in FORM 20, after serial number 9, the following shall be inserted, namely: - “9A. Name of the Nominee……………………………………… 9B. Relationship with the Nominee………………………… 8. In the said rules, in FORM 23A, in the marginal heading “Machine Readable Zone”, in the table, in serial number 2, after the words “ownership type”, the following shall be inserted, namely: - “Nominee Name Relationship with the nominee” 9. In the said rules, in FORM 24, in column 3, after the words “present address”, the following words shall be inserted, namely: - “Nominee name, relationship with the nominee” 10. In the said rules, in FORM 30, in Part II, after first paragraph, the following paragraph shall be inserted, namely: - “I/We hereby declare …………………………………………….. as the nominee for this vehicle who is my/our …………………………………………………………….” 11. In the said rules, in FORM 31, after serial number 5, the following shall be inserted, namely: - “6. Nominee Name………………………………………… 7. Relationship with the nominee………………………………………….” 12. In the said rules, in FORM 32, after first paragraph, the following paragraph shall be inserted, namely: - “I/We hereby declare …………………………………………….. as the nominee for this vehicle who is my/our …………………………………………………………….” Note 1: After the death of the registered owner of the vehicle, the ownership of vehicles shall be transferred to nominee.
