(1) इन िनयम(cid:24) का संि,< त नाम क(cid:2)(cid:3)ीय मोटरयान िनयम (.......संशोधन) िनयम 2016 ह ै। (2) ये राजप6 म(cid:2) उनके अंितम (cid:27)काशन क तारीख को (cid:27)वृ#त ह(cid:24)ग े । 2. केO (cid:3)ीय मोटर यान िनयम, 1989 (िजसे इसम(cid:2) इसके प=च ात् उ$त िनयम कहा गया ह)ै के िनयम 93 के उपिनयम (2) के खंड (iii) के प= चात् िन(cid:25)न िलिखत परंतुक अंत:(थ ािपत 3कया जाएगा, अथाDत्:-- ''परंतु [1 अ(cid:27)ैल, 2017 को या उसके प= चात्] ऑटोमोबाइल िविनमातD ाS !ारा मोटर यान(cid:24) को उनके कारखान(cid:24) से दशे म(cid:2) िभOन िभO न िवTय केO (cid:3)(cid:24) पर ले जाए जाने के िलए लगाए गए अUटकुलेटेड यान(cid:24) क दशा म(cid:2) 18.75 मीटर ।'' 1859 GI/2016 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 3.िनयम 93 के उपिनयम (2) के खडं (iv) के प=च ात् िन(cid:25)न िलिखत परंतुक अंत:(थ ािपत 3कए जाएंगे, अथाDत् :-- ''परंतु [1 अ(cid:27)ैल, 2017 को या उसके प=च ात]् ऑटोमोबाइल िविनमातD ाS !ारा मोटर यान(cid:24) को उनके कारखान(cid:24) से दशे म(cid:2) िभO न-िभO न िवTय केO(cid:3) (cid:24) पर ले जाए जाने के िलए लगाए गए Fक-Fेलर या टै$ट र Fैलर यान(cid:24) क दशा म(cid:2) 18:75 मीटर; परंतु यह और 3क [1 अ(cid:27)ैल, 2017 को या उसके प=च ात्] ऑटोमोबाइल िविनमातD ाS !ारा मोटर यान(cid:24) को उनके कारखान(cid:24) से दशे म(cid:2) िभO न-िभO न िवTय केO(cid:3) ो पर ले जाए जाने के िलए लगाए गए आUटकुलेटेड या Fक Fेलर या Fै$ट र Fेलर यान के कंटेनर क बॉडी पर कंटेनर म(cid:2) ले जाए जान े वाले मोटर यान(cid:24) का स#य ापन करने के िलए (ल ाइ\डग िनरी,ण िखड़क लगाइ जाएगी और (ल ाइ\डग िनरी,ण िखड़क क Oय नू तम लंबाई 400 िम.मी. और ऊंचाई 300 िम.मी होगी और कम से कम एक (ल ाइ\डग िनरी,ण िखड़क तीसरे यान के पास बीच म(cid:2) 3फट क जाएगी, (cid:27)मुख ( लाइ\डग िनरी,ण िखड़क आगे से 3 मी. से ‘य ादा नहa होगी; Fेलर क दशा म(cid:2) इस दरू ी को मापन े के िलए bाबार क लबं ाई को c यान म(cid:2) रखा जाएगा और दो समीप(थ (ल ाइ\डग िनरी,ण िखड़3कय(cid:24) के बीच क दरू ी 4 मी. से अिधक नहa होगी, ( लाइ\डग िनरी,ण िखड़क का ऊपरी िसरा, भिू म स े 1.8 मी. से अिधक नहa होगा ।'' 4. उ$ त िनयम(cid:24) के िनयम 118 के उपिनयम (1) के दसू रे परंतुक के प=च ात ् िन(cid:25)न िलिखत परंतुक अंत:( थािपत 3कया जाएगा, अथाDत् :-- परंतु यह भी 3क [1 अ(cid:27)ैल, 2017 से ही] ऑटोमोबाइल िविनमातD ा !ारा उनके कारखान(cid:24) से दशे म(cid:2) िभO न- िभOन िवTय केO (cid:3)(cid:24) पर मोटरयान ले जाने के िलए लगाए गए आUटकुलेटड, Fक-Fेलर या Fै$ट र Fेलर, उस समय तक जब तक त#( थ ानी भारतीय मानक 9 यरू ो िवEनदशे अिधसिू चत करे यान िविनमाDता !ारा, या तो िविनमाDण के (cid:27)Tम पर, या डीलरिशप (cid:27)Tम पर समय-समय पर यथासंशोिधत एआईएस 018/2001 मानक के अनुeप 60 3कलोमीटर क अिधकतम गित वाल े ( पीड गवDनर (गित सीिमत करने वाली यिु $त या गित सीिमत करन े वाला कायDकरण) से सि‘ज त होगा या उसम(cid:2) लगा होगा ।''। 5. िनयम 125 के उपिनयम (2) के तीसरे परंतकु के प=च ात ् िन(cid:25)न िलिखत परंतकु अंत:(थ ािपत 3कया जाएगा, अथाDत्:-- ''परंतु यह और 3क [1 अ(cid:27)ैल, 2017 से ही] ऑटोमोबाइल िवEनमाताS !ारा उनके कारखान े से दशे म (cid:2) िभOन -िभOन िवTय केO (cid:3)(cid:24) पर मोटर यान ल े जाए जाने के िलए आUटकुलेटड, Fक-Fेलर या Fै$ट र-Fेलर यान प=च िनगरानी सबं ंधी कैमरे मॉनीटरी युि$ त या प=च अवलोकन कैमरे स े सि‘ज त होगा ।''। [सं. आरटी-11028/29/2006-एमवीएल] अभय दामले, संयु$ त सिचव (cid:6)(cid:6)(cid:6)(cid:6)टटटट(cid:25)(cid:25)(cid:25)(cid:25)पप पप णणणण : मूल िनयम भारत के राजप6 म(cid:2) सा.का.िन. 590(अ), तारीख 2 जून, 1989 !ारा अिधसूिचत 3कए गए थे और सा.का.िन...... तारीख..........!ारा उनका अिOतम संशोधन 3कया गया । MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 18th April, 2016 G.S.R. 425(E).— The following draft of certain rules further to amend the Central Motor Vehicles Rules, 1989, which the Central Government proposes to make in exercise of the powers conferred by section 110 of Motor Vehicles Act, 1988 (59 of 1988), is hereby published as required by sub-section (1) of section 212 of the said Act for information of all persons likely to be affected thereby and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of thirty days from the date on which the copies of this notification as published in the Gazette of India, are made available to the Public;¹Hkkx IIµ[k.M 3 (i)º Hkkjr dk jkti=k % vlk/kj.k 3 Any objections or suggestions which may be received from any person with respect the said draft rules before the expiry of the aforesaid period will be considered by the Central Government; Objections and suggestions, if any, may be sent to the Joint Secretary (Transport), Ministry of Road Transport and Highways, Transport Bhavan, Parliament Street, New Delhi-110001. Draft Rules 1. (1) These rules may be called the Central Motor Vehicles (_____Amendment) Rules, 2016. (2) They shall come into force from the date of their final publication in the Official Gazette. 2. In the Central Motor Vehicles Rules, 1989 (hereinafter referred as the said rules), in rule 93, in sub-rule (2), after clause (iii), the following proviso shall be inserted, namely:— “Provided that, on and after the 1st April 2017, in case of articulated vehicles, engaged by automobile manufacturers to carry motor vehicles from their factories to different sale outlets in the country, 18.75 metres.” 3. In rule 93, in sub-rule (2), after clause (iv), the following provisos shall be inserted namely:— “Provided that, on and after the 1st April 2017, in case of Truck-Trailer or Tractor-Trailer vehicles engaged by automobile manufacturers to carry motor vehicles from their factories to different sale outlets in the country, 18.75 m.: Provided further that, on and after the 1st April 2017, articulated or Truck-Trailer or Tractor-Trailer vehicles engaged by automobile manufacturers to carry motor vehicle from their factories to different sale outlets in the country, shall be provided with a sliding inspection window on the container body, to allow verification of motor vehicles carried in the container and the sliding inspection window shall be minimum of 400 mm in length and 300 mm in height and at least one sliding inspection window shall be fitted to the middle third of the vehicle, the foremost sliding inspection window being not further than 3 m from the front; in the case of trailers account shall be taken of the length of the drawbar for the measurement of this distance and the distance between two adjacent sliding inspection windows shall not exceed 4 m. the height of the upper edge of the sliding inspection window shall not be more than 1.8 m from the ground.” 4. In the said rules, in rule 118, in sub-rule (1), after the second proviso, the following proviso shall be inserted, namely:- “Provided also that on and from 1st April 2017 in case of articulated, Truck-Trailer or Tractor-Trailer vehicles engaged by automobile manufacturers to carry motor vehicles from their factories to different sale outlets in the country, shall be equipped or fitted by the vehicle manufacturer, either in the manufacturing stage or at the dealership stage, with a speed governor (speed limiting device or speed limiting function) having maximum speed of 60 kilometers per hour conforming to the Standards AIS 018/2001, as amended from time to time, till such time as corresponding Bureau of Indian Standards specifications are notified.”. 5. In rule 125, in sub-rule (2), after the third proviso, the following proviso shall be inserted, namely:— “Provided also that on and from the 1st April 2017 in case of Articulated, Truck-Trailer or Tractor-Trailer vehicles engaged by automobile manufacturers to carry motor vehicle from their factories to different sale outlets in the country, shall be equipped with a rear surveillance camera-monitoring device or rear view camera.”.
