पर इ-मेल दकए जा सकेंगे 5753 GI/2020 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] प्राूपप जनयम 1. संजिप्त िीर्कग और प्रारंभ —(1) आन जनयमों को केंद्रीय मोटर यान (....... संिोधन) जनयम, 2020 कहा जा सकता ह, (2) आन जनयमों म ेंयथा जनजहत, ये जनयम सरकारी राजपत्र म ेंआनके ऄंजतम प्रकािन की तारीख स े लागू होंगे 2. केंद्रीय मोटर यान जनयम, 1989 के (आसके प‍ चात ्ईक्त जनयमों के ूपप म ें ईजल्लजखत), जनयम 81 म,ें ताजलका म,ें क्रम संख्या 15 के बाद जनम्नजलजखत ऄंत:स्ट् थाजपत दकया जाएगा, ऄथागत्: — “16. ववटेज मोटर वाहनों के जलए पजं ीकरण और पंजीकरण प्रमाण पत्र बीस हजार 81सी जारी करना 17. ववटेज मोटर वाहनों के जलए पुनः पंजीकरण / पंजीकरण प्रमाण पांच हजार 81सी पत्र का नवीनीकरण 3. ईि जनयमों म,ें जनयम 81 के प‍ चात् जनम्नजलजखत जनयम ऄन् त:स्ट् थाजपत दकए जाएंग:े - "ववटेज मोटर वाहनों के पंजीकरण के जलए जविेर् प्रावधान" 81ए. ववटेज मोटर वाहन राज्य / सघं राज्य ित्रे सजमजत (वीएमवीएससी) का गठन – (1) राज्य/संघ राज्य ित्रे सरकार राज्य स्ट्तरीय एक सजमजत का गठन करेगी, जजसे ववटेज मोटर वाहन राज्य सजमजत (वीएमवीएससी) कहा जाएगा, जजसम ें राज्य/संघ राज्य ित्रे के पररवहन अयिु /सजचव/प्रमखु सजचव /समकि स्ट्तर के एक ऄजधकारी,राज्य सरकार/सघं राज्य ित्रे प्रिासन द्वारा ऄजधकृत ऑटोमोबाआल एसोजसएिन का एक सदस्ट्य और राज्य/संघ राज्य ित्रे प्रिासन द्वारा ऄजधकृत कोइ ऄन्य व्यजि,यदद अव‍यक हो तो, िाजमल होंगे (2) ववटेज मोटर वाहन की स्ट् वीकृजत या ऄस्ट्वीकृजत के बारे म ें सभी जनणगयों को आस सजमजत द्वारा ऄंजतम ूपप ददया जाएगा सजमजत प्रपत्र 38बी के ऄनुसार जनरीिण का जडजजटल प्रमाण पत्र जारी करेगी योग्यता के प्रयोजनाथग दकसी वाहन को ईसके मूल स्ट् वूपप म ें रखा जाना चाजहए और ईसका ऄजधक ओवरहॉल नहीं दकया जाना चाजहए,जजसमें चेजसस या बॉडी िले और आंजन म ें कोइ भी संिोधन िाजमल ह यदद सजमजत के पास यह मानन े का कारण ह दक ववटेज वाहन के पंजीकरण के जलए अवेदन ऄनमु ोदन के जलए ईपयुि नहीं ह, तो वह धारक को ऄपनी सफाइ देने का ऄवसर देने के बाद, ऄस्ट्वीकृजत के कारणों का ईल्लेख करत े हुए अवेदन को ऄस्ट्वीकार कर सकती ह स्ट्पष्टीकरण: आन जनयमों के प्रयोजनाथ,ग "ववटेज मोटर वाहन" का ऄजभप्राय कोइ भी वाहन जजसे ववटेज वाहन श्रेणी के तहत वगीकृत दकया जा सकता ह, ज सा दक आस क्रम म ें एल1 और एल2 श्रेणी (दोपजहया) और एम1 श्रेणी चार पजहया के जलए पररभाजर्त दकया गया ह, जो पहली जबक्री के बाद पहली पंजीकरण की तारीख स े 50 वर्ग स े ऄजधक परु ाना ह, जजसमें आस ित ग के ऄधीन दक भारत म ें अयाजतत दकसी भी वाहन को आस तरह के वाहनों को ईनके मलू स्ट् वूपप म ें रखा जाना और कोइ भी ऄजधक ओवरहाल नहीं करन,े जजसम ें चेजसस या बॉडी िले , और/या आंजन म ें कोइ संिोधन िाजमल ह 81बी. ववटेज मोटर वाहन राज्य पजं ीकरण प्राजधकारी (वीएमवीएसअरए) की जनयजु ि — (1) राज्य/संघ राज्य ित्रे सरकार संयुि पररवहन अयिु की रैंक के उपर के ऄजधकाररयों म ें स े एक को राज्य पंजीकरण प्राजधकारी (नोडल या समन्वय ऄजधकारी) के ूपप म ें जनयुि करेगी, जो ववटेज मोटर वाहन के ूपप म ें वाहन के पजं ीकरण और वीएमवीएससी सजमजत के ऄनुमोदन के बाद, राष्ट्रीय रजजस्ट्टर म ें ईजचत प्रजवजष्ट करन े के प‍ चात ् ववटेज मोटर वाहन के ूपप म ें वाहन का पंजीकरण या पुन:पंजीकरण के जलए अवेदन प्रा‍ त करेंगे[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 3 81सी.अवदे न और ववटेज मोटर वाहन के ूपप म ें पजं ीकरण प्रमाण पत्र जारी करन े की प्रदक्रया— (1) केंद्रीय मोटर यान जनयम, 1989 के प्रपत्र 20 के ऄनुसार दकसी ववटेज वाहन के पंजीकरण/पनु ः पंजीकरण के जलए अवेदन दकया जाएगा पंजीकरण के प्रत्येक अवेदन के साथ होगा: (i) बीमा की एक पॉजलसी; (ii) जनयम 81 म ें जनर्ददष्टानुसार ईजचत िुल्क; (iii) अयाजतत ववटेज मोटर वाहनों के मामल े म ेंप्रवेि का जबल; (iv) भारत म ेंपहले स ेपंजीकृत वाहन के मामल े म ें परु ाना पंजीकरण प्रमाणपत्र; (v) जनयम 81ए के ऄनुसार जारी प्रपत्र 38बी के ऄनुसार जनरीिण का जडजजटल प्रमाण पत्र (2) राज्य पंजीकरण प्राजधकारी ऄपन े द्वारा पंजीकृत ववटेज मोटर वाहन के माजलक को ऐसे अवेदन की प्राजप्त स े साठ ददन की ऄवजध के भीतर केंद्रीय मोटर यान जनयम, 1989 के प्रपत्र 23ए के ऄनुसार पजं ीकरण प्रमाण पत्र जारी करेगा और आस तरह के प्रमाण पत्र और ईसम ें पररवतनग के जववरण को राष्ट्रीय रजजस्ट्टर म ें भी दजग करेगा बिते दक ववटेज मोटर वाहन के ूपप म ेंपंजीकृत होन े के बाद मोटर वाहन के पंजीकरण का पुराना प्रमाण पत्र, यदद कोइ हो, को रद्द कर ददया जाएगा और माजलक केवल ऐजतहाजसक ईद्दे‍यों के जलए पंजीकरण के ऐसे रद्द दकए गए प्रमाण पत्र को ऄपने पास रख सकता ह (3) पंजीकरण प्राजधकरण पूवगवती पंजीकरण ऄजभलेख और स्ट्व ाजमत् व ऄजभलेख का पूरा लेखाजोखा रखेगा वाहन पंजीकरण का राष्र ीय रजजस्ट् टर तदनुसार ऄ्यतजतत दकया जाएगा (4) दकसी ववटेज मोटर वाहन के पंजीकरण के प‍ चात दकसी समय, जनम्न जलजखत के सबंध म ेंपंजीकरण प्राजधकारी को अवेदन करन े की अव‍ यकता ह: (i) पंजीकरण का डु‍ लीकेट प्रमाणपत्र जारी करना: (ii) मोटर वाहन के स्ट् वाजमत् व के स्ट् थानातं रण का ररकाड गकरना; ऄथवा (iii) पता पररवतगन, ऐसे अवेदन मोटर यान ऄजधजनयम,1988 के ऄंतगगत बताए गए तरीके से दकया जाना चाजहए और केंद्रीय मोटर वाहन जनयमावली, 1989 के ऄतं गगत यथा-जनधागररत ऐसे िल्ु कों के साथ होन े चाजहए 81घ. ववटेज वाहनों पर पजं ीकरण जचह्नों के प्रदिनग का ूपप और तरीका — (1) ऄजधजनयम की धारा 41 के ऄंतगगत ऐस े वाहनों के नवीन पंजीकरण के जलए पंजीकरण प्राजधकरण को दकसी ववटेज मोटर वाहन पर प्रदिगन के जलए सौंपा जाएगा जजसमें एक पंजीकरण जचह्न के साथ ऄिर “XX VA YY ****”, िाजमल ह जबदक VA ववटेज के जलए अता ह, XX राज्य कोड बतलाता ह, YY एक दो ऄिरों की सीरीज होगा और “****” 0001 से 9999 का कोइ नंबर राज्य पंजीकरण प्राजधकारी द्वारा अबंरटत होगा (2) दकसी ववटेज मोटर वाहन को ददया गया पंजीकरण जचह्न वाहन के सामन े और पीछे स्ट् पष्ट और पठनीय ूपप म ें प्रद्ित दकया जाएगा जो केंद्रीय मोटर वाहन जनयमावली, 1989 के जनयम 50 और 51 में बताए गए जवजनर्ददजष्ट यों के समनुूपपी पंजीकरण ‍ लेट स े संबंजधत जवजनर्ददजष्ट यों और अकार म ें एक लाआसेंस ‍ लेट के ूपप म ें होगा और ववटेज मोटर वाहनों को जनयम 51 के ऄनुदेिों के ऄनुसार ईच् च सुरिा पंजीकरण ‍ लेट के अकार, फांट और लगान े के स्ट् थान के अदेि से कोइ छूट नहीं होगी 81ड. पजं ीकरण प्रमाणपत्र की वध ता – व धता प्रमाणपत्र 10 वर्ों के जलए मान् य होगी और ईसके प‍ चात तदनुसार नवीकरण दकया जाएगा 81च. जबक्रय और क्रय – ववटेज वाहन के ूपप में पंजीकृत वाहनों का जबक्रय और क्रय ऄनुमत ह बिते दक क्रेता और जवक्रेता ऄपन े संबंजधत राज्य ों के पररवहन प्राजधकरण को सूजचत करें और नए स्ट् वामी के नाम के ऄतं गगत पंजीकरण को ऄजभलेखबध4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] कराए यह क्रेता और जबक्रेता दोनों की संयुक् त जजम् मदारी होगी दक आस संबंध में सूचना क्रय/जवक्रय के 90 ददनों के भीतर प्राजधकरण को प्रस्ट् ततु कर दी जाए 81छ. ईपयोग पर प्रजतबधं – ववटेज मोटर वाहनों को दकसी वाजणजज्य क ईद्दे‍ य, चाह े कुछ भी हो, के जलए सड़क पर नहीं चलाया जाएगा और ववटेज मोटर वाहनों का ईपयोग जनम्न जलजखत के जलए दकया जाएगा: (i) दकसी प्रदिगन के ईद्दे‍ य के जलए प्रद्ित ऄथवा ईपयोग करना ; (ii) तकनीकी ऄनुसंधान के ईद्दे‍य ऄथवा दकसी ववटेज कार र ली में भाग लने ा; (iii) पुन: ईंधन भराने ऄथवा रखरखाव के ईद्दे‍ य; (iv) प्रदिगनी, ववटेज र जलयों, ऐसे प्रदिगन/कार र जलयों म ेंअना-जाना; 4. ईक्त जनयमों म,ें जनयम 92 के ईप-जनयम (2) में खडं (ग) के संबंध में जनम्न जलजखत को प्रजतस्ट् थाजपत दकया जाएगा, नामत: — “(ग) जो ववटेज मोटर वाहन के ूपप म ेंपंजीकृत ह” 5. ईक्त जनयमों म,ें प्रपत्र 38ए के प‍ चात, जनम्न प्रपत्र को ऄंत:स्ट्थ ाजपत दकया जाएगा, ऄथागत: — प्रपत्र 38बी [ जनयम 81ए देख]ें ववटेज मोटर वाहन जनरीिण प्रमाणपत्र द्वारा ववटेज मोटर वाहन राज्य /सघं राज्य -ित्रे सजमजत जनरीजित और सूजचत दकया गया दक (i) अवेदन म ेंददया गया जववरण सही ह; (ऄ.) के तहत संिोजधत दकए गए थे[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 5 MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 25th November, 2020 G.S.R. 734(E).—The following draft of certain rules further to amend the Central Motor Vehicles Rules, 1989, which the Central Government proposes to make in exercise of the powers conferred by Section 64 and Section 110 of the Motor Vehicles Act, 1988 ( 59 of 1988) is hereby published as required by sub-section (1) of Section 212 of the said Act for information of all persons likely to be affected thereby and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of a period of 30 days from the date on which the copies of this notification as published in the Gazette of India, are made available to the public. The objections or suggestions which may be received from any person with respect to the said draft rules before the expiry of the period aforesaid will be considered by the Central Government; Objections and suggestions to these draft rules, if any, may be sent to the Director (MVL),email : director- morth@gov.in, Ministry of Road Transport and Highways, Transport Bhawan, Parliament Street, New Delhi-110 001. DRAFT RULES 1. Short title and commencement.— (1) These rules may be called as the Central Motor Vehicles (..................Amendment) Rules, 2020; (2) Save as otherwise provided in these rules, they shall come into force on the date of their final publication in the Official Gazette. 2. In the Central Motor Vehicles Rules, 1989 (herein after referred as said rules), in rule 81, in the table, after serial no. 15, the following shall be inserted, namely:— ―16. Registration and Issue of certificate of registration for Vintage Twenty 81C Motor Vehicles Thousand 17. Re-registration/ Renewal of certificate of registration for Five 81C Vintage Motor Vehicles Thousand 3. In the said rules, after rule 81, the following rules shall be inserted, namely:-―Special Provision for registration of Vintage Motor Vehicles‖. 81A. Appointment of Vintage Motor Vehicles State/ Union Territory Committee(VMVSC)– (1) The State/Union Territory Government shall constitute a committee at State level which shall be called Vintage Motor Vehicles State Committee(VMVSC) comprising of one of the officers of State/Union Territory i.e. Transport Commissioners/Secretary /Principal Secretary/equivalent level, a member of Automobile Association authorized by the State Government /Union Territory Administration, and any other person authorized by State / Union Territory administration if required. (2) All decisions regarding approval or rejection of vintage motor vehicle shall be finalized by this committee. The committee shall issue a digital certificate of inspection as per Form 38B. For the purpose of qualification, a vehicle should be maintained in its original form and should not have undergone any substantial overhaul which includes any modification in chassis or body shell, and engine. If the committee has reason to believe that the application for registration of vintage vehicle is not fit for approval, it may, after giving the holder an opportunity of being heard, reject the application mentioning the reasons of rejection. Explanation: For the purpose of these rules, ―Vintage Motor Vehicle‖ means Any vehicle can be classified under vintage vehicle category as defined in this order forL1 & L2 category (two-wheeler) and M1 category four- wheeler, which are more than 50 years old from the date of 1st registration after first sale including any vehicle imported into India subject to condition that such vehicles should be maintained in its original form and should not have undergone any substantial overhaul which includes any modification in chassis or body shell, and/or engine.6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 81B. Appointment of Vintage Motor Vehicles State Registering Authority(VMVSRA)— (1) The State/Union Territory Government shall assign one of the officers not below the rank of Joint Transport Commissioner as State Registering Authority (nodal or coordinating officer) who shall, on receipt of the application for registration of vehicle as Vintage Motor Vehicle, and after approval of the VMVSC committee, register or re- register the vehicle, as a vintage motor vehicle after making due entry in the National Register. 81C. Procedure of application and issuance of Certificate of Registration as a Vintage Motor Vehicle — (1) An application for registration / re-registration of a vintage vehicle shall be made as per Form 20 of Central Motor Vehicles Rules, 1989. Every application for registration shall be accompanied by: (i) A policy of insurance; (ii) Appropriate fee as specified in rule 81; (iii) Bill of Entry in the case of imported vintage motor vehicles; (iv) Old Registration Certificate in case of already registered vehicle in India; (v) Digital Certificate of inspection as per Form 38B, issued as per rule 81A. (2) The State Registering Authority shall issue to the owner of a vintage motor vehicle registered by it, a certificate of registration as per Form 23A of Central Motor Vehicles Rules, 1989 within the period of sixty days from the receipt of such an application and shall also enter in the National register, the particulars of such certificate and changes thereof. Provided that the old certificate of registration of a motor vehicle after being registered as Vintage Motor Vehicle, if any, shall be cancelled and the owner may retain such cancelled certificate of registration for historical purposes only. (3) The Registering Authority shall maintain a complete record of previous registration and ownership record. The National register of vehicle registration shall be updated accordingly. (4) If at any time after the registration of a vintage motor vehicle, an application needs to be made to the registering authority regarding: (i) Issuance of a duplicate certificate of registration; (ii) Recording transfer of ownership of the motor vehicle; or (iii) Change of address; Such application shall be made in the manner provided under the Motor Vehicles Act, 1988 and be accompanied by such fees as prescribed under Central Motor Vehicles Rules, 1989. 81D. Form and manner of display of registration marks on vintage vehicles. —(1) For fresh registration of such vehicles, under Section 41 of the Act, the Registering Authority shall assign to a vintage motor vehicle for display thereon, a registration mark consisting of the letters ―XX VA YY ****‖, where VA stands for vintage, XX stands for State code, YY will be a two letter series and ―****‖ is a number from 0001 to 9999 allotted by State Registering Authority. (2) The registration mark assigned to a vintage motor vehicle shall be exhibited both at the front and at the rear of the vehicle clearly and legibly in the form of a license plate in the size and specifications related to registration plate shall conform to the specifications spelt out in rule 50 and 51 of the Central Motor Vehicle Rules, 1989 and there shall be no exemption to the vintage motor vehicles from High Security Registration Plate order as regards the size, font and place of affixation as instructions in Rule 51. 81E. Validity of the certificate of registration. — The certificate of registration shall be valid for a period of 10 years and shall be renewable accordingly thereafter. 81F. Sale and Purchase. —Sale or purchase of vehicles registered as the vintage Motor Vehicle is permissible provided the buyer and seller inform respective State Transport Authority and registration under the new owner’s[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 7 name to be recorded. It is the joint responsibility of both buyer and seller that information in this regard shall be submitted to the authority within 90 days of sale /purchase. 81G. Restriction on uses.—Vintage Motor Vehicles shall not be driven or plied on the roads for any commercial purposes whatsoever. Vintage Motor Vehicles shall be used for: (i) display or use for the purpose of a demonstration ; (ii) the purposes of technical research or taking part in a vintage car rally; (iii) the purposes of refueling and maintenance. (iv) exhibitions, vintage rallies, to and fro to such exhibition/car rally; 4. In the said rules, in rule 92, in sub-rule (2), for clause (c), the following shall be substituted, namely:— ―(c) which is registered as Vintage Motor Vehicle.‖ 5. In the said rules, after FORM 38A, the following form shall be inserted, namely: Form 38B [See rule 81A] CERTIFICATE OF INSPECTION OF A VINTAGE MOTOR VEHICLE By Vintage Motor Vehicles State/Union Territory Committee Inspected and reported that (i) the particulars contained in the application are true; (ii) vehicle is in its original form and has not undergone any substantial overhaul and no modification in chassis, body and/or engine has been made.
