यहां पहले िनयम(cid:31) के ,प म(cid:10) संदNभ9त), िनयम 92 म (cid:10) , उप-िनयम (3) के िलए , िन*िलिखत (cid:27)ित%थािपत (cid:4)कया जाएगा , अथा9त्: - """" (3) (i) मोटर यान म(cid:10) (cid:27)यAु त सुरPा नाजुक पूजQ, घटक, या एस(cid:10)बली भारतीय मानक के %थ ान पर मानक के ह(cid:31)गे : - जब कभी भी (cid:4)कसी मोटर यान म(cid:10) (cid:27)युAत ् पूजQ, घटक, या एस(cid:10)बली इन िनयम(cid:31) म(cid:10) अिधसूिचत मानक(cid:31) %थ ान पर उन मानक(cid:31) के ह(cid:31)गे जैसे अंतरा9RS ीय मान (ईईसी/ ईसीई/आईईसी/आईएसओ/जेआईसी),ऐसे मामल(cid:31) म(cid:10) ऐसे के पूजU, घटक(cid:31) या एस(cid:10)बली क(cid:24) अनुपालना देश क(cid:24) एक (cid:27)ािधकृत (cid:27)माणन एज(cid:10)सी या ऐसे अंतरा9RS ीय या िवदेशी या िवदेशी राR Sीय मानक मूल देश क(cid:24) (cid:4)कसी (cid:27)Gय ाियत (cid:27)माणन एज(cid:10)सी (cid:26)ारा जारी (cid:4)कसी अनुपालना के (cid:27)माण प: (cid:26)ारा िनयम 126 के (cid:27)योजन के िलए %थ ािपत माने जाएंगे "। 3. उAत िनयम(cid:31) म,(cid:10) िनयम 126 म,(cid:10) (i) दसू रे उपबंध के िलए, िनMन िलिखत उपबंध (cid:27)ित%थ ािपत (cid:4)कए जाएगं ,े अथा9त: ् :- "परंतु यह (cid:4)क वाहन िनमात9 ाX के सबं ंध म(cid:10) सीधे या उनके अिधकृत (cid:27)ितिनिध के माYयम से पूरी तरह स े िनNम9त इकाइय(cid:31) (सीबीयू) या अZ 9 द%तक वाली (cid:4)कट (एसकेडी) क(cid:24) अिधकतम 2500 इकाइय(cid:31) म(cid:10) आयात करने के िलए, %टीय\रंग िनय:ं ण के मामले म(cid:10) दािहने हाथ %टीय\रंग िनय:ं ण अंतररा]ीय मानक (ईईसी/ईसीई/आईईसी/ आईएसओ/जेआईसी) के मोटर वाहन, ऐसे मामल(cid:31) म(cid:10) ऐसे भाग(cid:31), घटक(cid:31) या अस(cid:10)बली का अनुपालन (cid:27)ािधकृत (cid:27)माणन एज(cid:10)सी (cid:26)ारा जारी अनुपालन के (cid:27)माण प: (cid:26)ारा या ऐसे अंतररा]ीय या िवदशे ी या िवदशे ी रा]ीय मानक(cid:31) के िलए मूल दशे क(cid:24) माBयता (cid:27)ा6 (cid:27)माणन एज(cid:10)सी स े %थािपत (cid:4)कया जाएगा "। (ii) यथा संशोिधत दसू रे उपबधं के प1च ात्, िनMन िलिखत (cid:27)ावधान शािमल (cid:4)कए जाएगं ,े अथा9त: ् :- " परंतु यह भी (cid:4)क ‘ यि(cid:30)गत उपयोग के (cid:27)योजन के िलए भारत म(cid:10) आयाितत अBय दाए ं हाथ के %टीय\रंग िनय:ं ण मोटर के सबं ंध म (cid:10) पूरी तरह से िनNम9त इकाईय(cid:31) (सीबीयू), (cid:27)दश9न, परीPण, अनुसंधान, वaै ािनक काय 9के ,प म(cid:10), अंतराR9 Sीय मानक पूरी तरह से बनाया इकाइय(cid:31) (सीबीयू), अंतररा]ीय मानक (ईईसी/ईसीई/आईईसी/आईएसओ/जेआईसी) के (cid:27)माण प:, ऐसे मामल े म(cid:10) अनुपालना का इस अिधिनयम के (cid:27)ावधान(cid:31) और इन िनयम(cid:31) क(cid:24) अनुपालना मानी जाएगी और उसे िनयम 47 के अनसु ार (cid:27)%त तु क(cid:24) गयी उपल< ध सूचना के साथ पंजीकरण (cid:27)ािधकारी (cid:26)ारा पंजीकृत (cid:4)कए जाएंग े ;¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 3 परंतु यह भी (cid:4)क मोटर उbोग मानक (एआईएस), टाइप अनुमोदन (cid:27)(cid:4)cया 115/116, केB(cid:11) ीय मोटर यान िनयम, 1989 के तहत अिधसचू नाX, भारतीय मानक(cid:31) (आईएस) और अंतरा9RS ीय मानक(cid:24)करण सगं ठन (आईएसओ) मानक, म(cid:10) शुिZप:, संशोधन या पुनरीPण से िनपटने के िलए (cid:27)शासिनक (cid:27)(cid:4)cया जो केB(cid:11) ीय मोटर यान िनयम, 1989 के तहत अिधसूिचत ह,= समय समय पर यथा संशोिधत एआईएस – 000 :2013 के अनु,प ह(cid:31)गे। " [फा. सं. आरटी-11036/82/2017-एमवीएल ] अभय दामले, संयु(cid:30) सिचव ननननोोोोटटटट: मुmय िनयम भारत के राजप:, असाधारण, भाग II, खंड 3, उपखंड (i) म(cid:10) (cid:4)दनांक 2 जून 1989 क(cid:24) अिधसूचना सं. सा. का. िन. 590 (अ) के तहत (cid:27)कािशत (cid:4)कए गए थे और अंितम बार (cid:4)दनाकं ....... क(cid:24) अिधसूचना संm या .......के तहत संशोिधत (cid:4)कए गए थे। MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 6 June, 2018 G.S.R. 528(E).—The following draft of certain rules further to amend the Central Motor Vehicles Rules, 1989, which the Central Government proposes to make in exercise of the powers conferred by Section 110 of the Motor Vehicles Act, 1988 ( 59 of 1988) is hereby published as required by sub-section (1) of Section 212 of the said Act for information of all persons likely to be affected thereby and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of a period of 30 days from the date on which the copies of this notification as published in the Gazette of India, are made available to the public. The objections or suggestions which may be received from any person with respect to the said draft rules before the expiry of the period aforesaid will be considered by the Central Government; Objections and suggestions to these draft rules, if any, may be sent to the Joint Secretary (Transport),email : js- tpt@gov.in, Ministry of Road Transport and Highways, Transport Bhawan, Parliament Street, New Delhi-110 001. DRAFT RULES 1. (1) These rules may be called as the Central Motor Vehicles (……..Amendment) Rules, 2018 2. These rules shall come into force on the date of their final publication in the Official Gazette. 2. In the Central Motor Vehicles Rules, 1989 (herein after referred as the said rules), in rule 92, for sub-rule (3), the following shall be substituted, namely: - “(3) (i) Testing of safety critical parts, components and assembly of motor vehicle conforming to standards in lieu of Indian Standards: -4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] Whenever a part, component, or assembly is used in a motor vehicle complying with standards in lieu of those notified in these rules such as an international standard (EEC/ECE/IEC/ISO/JIC), in such cases the compliance of such parts, components or assembly shall be deemed to be established for the purpose of rule126 by a certificate of compliance issued by an authorised certifying agency or by an accredited certifying agency of the country of origin " for such international or foreign or foreign national standards. 3. In the said rules, in rule 126, (i) for the second proviso, the following proviso shall be substituted, namely: - “Provided further that in respect of vehicle manufacturers directly or through their authorised representative importing into India to the maximum of 2500 units of completely built units (CBU) or semi knocked down kits (SKD), the right hand steering control in case of steering control motor vehicles, of international standard (EEC/ECE/IEC/ISO/JIC), in such cases the compliance of such parts, components or assembly shall be deemed to be established by a certificate of compliance issued by an authorised certifying agency or by an accredited certifying agency of the country of origin for such international or foreign or foreign national standards ”. (ii) after second proviso as so amended, the following proviso shall be inserted, namely: - “ Provided further that in respect of right hand steering control motor vehicles so imported into India for the purpose of personal use, demonstration, testing, research, scientific work as completely built units (CBU), the certificate of international standard (EEC/ECE/IEC/ISO/JIC), in such cases the compliance shall be deemed to be established as the compliance to the provision of the act and these rules and that shall be registered by registering authority with available information furnished as per rule 47; Provided further that the Administrative Procedure to deal with Corrigendum, Amendments or Revisions to Automotive Industry Standards(AIS), Type Approval Procedures 115/116, Notifications under Central Motor Vehicles Rules 1989, Indian Standards (IS) and International Organization for Standardization (ISO) standards, which are notified under Central Motor Vehicles Rules 1989 shall be in accordance with AIS-000: 2013, as amended from time to time.”.
