## Report on Central Motor Vehicles Amendment Rules, 2021 **1. Executive Summary:** This report analyzes a notification from the Ministry of Road Transport and Highways, Government of India, published on May 27, 2021, regarding proposed amendments to the Central Motor Vehicles Rules, 1989. The core purpose of this amendment, as evidenced by the text, is to exempt Battery Operated Vehicles (BOVs) from the payment of certain fees related to registration certificates and assignment of new registration marks. The key finding is that this amendment aims to incentivize the adoption of BOVs by reducing the financial burden associated with vehicle registration. **2. Introduction:** The purpose of this report is to provide a detailed overview of the proposed amendments to the Central Motor Vehicles Rules, 1989, as outlined in the notification dated May 27, 2021. This analysis is based solely on the information provided within the given policy text. **3. Policy Overview:** * **Amendment to:** Central Motor Vehicles Rules, 1989. * **Core Objective(s):** Based on the text, the primary objective is to reduce the financial burden associated with the registration of Battery Operated Vehicles (BOVs) by exempting them from specific fees. This is inferred from the amendment providing an exemption on fees mentioned in the "TABLE" in Rule 81. **4. Background and Rationale:** This amendment seeks to incentivize the adoption and use of Battery Operated Vehicles. By removing the financial burden of registration fees, the government likely intends to encourage the transition to electric mobility, potentially addressing environmental concerns and promoting sustainable transportation. The text suggests the exemption is specifically for fees associated with the issue or renewal of registration certificates and assignment of new registration marks. **5. Key Provisions / Changes:** This notification introduces an amendment to Rule 81 of the Central Motor Vehicles Rules, 1989. Specifically: * **Specific Part Changed:** Rule 81, after the first proviso. * **New Rule/Provision:** A new proviso is inserted stating "Provided further that, for the Battery Operated Vehicles as defined in rule 2u; the items given at Sl. no. 4 of the below mentioned TABLE shall be exempted from the payment of fees for the purpose of issue or renewal of registration certificate and assignment of new registration mark." * **Difference/Effect of Change:** This amendment introduces a fee exemption for Battery Operated Vehicles (BOVs), which are defined in Rule 2u, specifically regarding the fees mentioned in Item 4 of the "TABLE" mentioned in the rule for the issuance or renewal of registration and assignment of new registration marks. **6. Target Audience and Stakeholders:** The primary target audience and stakeholders directly affected by this amendment are: * Owners and prospective owners of Battery Operated Vehicles (BOVs). * Vehicle manufacturers and dealers specializing in BOVs. * Regional Transport Offices (RTOs) and other authorities responsible for vehicle registration. **7. Implementation Aspects (Inferred):** * **Responsible Agency/Bodies:** The Ministry of Road Transport and Highways is responsible for implementing this amendment. RTOs will likely be responsible for executing the fee exemptions during the registration process. * **Timelines/Procedures:** The rules will come into force on the date of their final publication in the Official Gazette. The public has 30 days from the date of the notification's publication to submit objections or suggestions regarding the draft rules to the Joint Secretary (MVL) at commentsmorthgov.in. * **Changes Implementation:** The change requires RTOs to identify BOVs as defined in Rule 2u and to apply the appropriate fee exemptions (detailed in Item 4 of the relevant table). **8. Expected Outcomes / Impact of Changes:** The intended outcome of these specific changes is likely to: * Increase the adoption rate of Battery Operated Vehicles by lowering the initial cost of vehicle ownership. * Support the growth of the electric vehicle market in India. * Potentially contribute to a reduction in air pollution and greenhouse gas emissions from the transportation sector. **9. Conclusion:** The proposed amendment to the Central Motor Vehicles Rules, 1989, represents a targeted effort to promote the adoption of Battery Operated Vehicles by providing a fee exemption related to vehicle registration. This measure is expected to reduce the financial burden on BOV owners and encourage a shift towards more sustainable transportation options. The success of this amendment will depend on its effective implementation by the relevant authorities and the public's response to the financial incentive.
