2. राष्ट्रीय ्िपरायणता, प्रमज्तष्क घात, मािजसक मंिता और बहु जि:शक् तता्रस्त व्जत कल्याण न्यास जियम, 2000 में,-
(i) जियम 3 के प-जियम (2) जिनलिजलज त ्ारा प्रजत्पाजपत दकया िाएगा, अपा्त्,-

(2) न् यास अजिजियम क िारा 12 के तहत इसके पास पंिीकृत संगठिों में से बोड् क अिजि क समाजि से तीि माह पूि्
अजिजियम क िारा 3(4)( ) क आिश् यकता अिुसार बोड् के ि सि् यों के जलए िामांकि आमजं त्रत करते हुए
ररजतयां अजिसूजचत करेगा।
(ii) जियम 3 के प-जियम (2) के बाि जिनलिजलज त प्रजत्पाजपत दकया िाएगा, अपा्त्,-
2(क) न्यास अजिजियम क िारा 3(4)(घ) क अपेक्षािुसार तीि सि्यों के जलए परोपकारी दियाकलापों में लगे हुए
् यापार, िाजणज्य और ्ोगों के संगमों से भी िामांकि आमजं त्रत करेगा ।
2( ) न्यास अपेजक्षत अहत् ा, जि:शक्त ता सम्बन्िी जिययों में अपेजक्षत अिुभि, आिेििोंनिामांकिों क प्राजि के जलए
न्यूितम पैंतालीस दिि प्रिाि करिे के जिजियमों के अिीि यपा जिजहत पैंसठ िय् क ऊपरी आयुसीमा को जल्लज त करते हुए,
बोड् के सि्यों क ररजतयों को अजिसूजचत करेगा ।
2(ग) सजचि, दिव्ांगिि सशजतकरण जिभाग आिेििोंनिामांकिों के प्राि हो िािे पर, आिेििों क संिीक्षा करिे के
जलए बोड् के पििे सि्यों में से तीि पिाजिकाररयों क एक संिीक्षा सजमजत गरठत करेगा ।
2(घ) संिीक्षा सजमजत आिेिक ्ारा दिए गए जिकल्प के प्रिग् के आिार पर राज्यिार और क्षेत्रिार पात्र आिेिकों क
सूची त यार करेगा :
परंतु संिीक्षा सजमजत पात्र आिेिकों क सूची त यार करते समय, क्षेत्रों में काय्रत संगठिों को व्ापक प्रजतजिजित्ि
सुजिजश्चत करिे के जलए और यह भी सुजिजश्चत करिे के जलए दक िह आिेिक या िामजििजे शती व्ापक चयि क क मत पर
एकाजिकार िहीं अपिाते ह,ैं के सम्बन्ि में सम्यक् जिचार करेगा ।
2(ङ) न्यास बोड् ऐसे जििा्जचत सि्यों को, जिन्होंिे िए आिेिकों का माग् प्रश्त करिे के जलए एक पूण् अिजि के
जलए काय् दकया ह, सु्रसाही बिायेगा ।
(iii) जियम 3 के प-जियम (4) के ्पाि पर जिनलिजलज त र ा िाएगा, अपा्त् :-
(4) िहां पात्र आिेिकों क संख्या ररजतयों क संख्या से अजिक ह, िहां जििा्चि राष्ट्रीय न्यास जियम, 2000 के जियम (3) के
अिुसार दकया िाएगा ।
(iv) जियम 3 के प-जियम (5) के पश्चात्, जिनलिजलज त अन्तः्पाजपत दकया िाएगा, अपा्त् :-
(6) अजिजियम क िारा 3(4)(घ) के अिीि प्राि िामांकिों के मामलों में, बोड् दिव्ांगता सेक्टर में तीि िामजििजे शजतयों का,
िके अिुभि के आिार पर और कॉरपोरेट सामाजिक ्त रिाजयत्ि के अिुसरण में िके परोपकारी काय् को ध्याि में र ते हुए,
अिुमोिि करेगा ।
(7) जििा्चि से सम्बजन्ित जियय पर कोई जििाि पररणाम क घोयणा के तीस दिि के भीतर ठाया िा सकेगा और ऐसा
जििाि सजचि, सशत दिव्ांगिि सशजतकरण जिभाग सामाजिक न्याय और अजिकाररता मंत्रालय के समक्ष न्याय-जिण्यि के
जलए जिर्िष्ट् दकया िाएगा, स पर जिसका जिजिश्चय अजन्तम और आबद्धकर होगा ।
(8) ऐसा कोई व्जत, जिसे बोड् में एक बार िामजिर्िष्ट् दकया गया ह, पुिः िाम जिर्िष्ट् दकए िािे के हकिार िहीं होगा ।
(v) जियम 4 के शीय्क में “और सि्य” शब्िों को हटाया िाएगा ।
(vi) जियम 5 के प-जियम (2) म,ें ब ठक शब्ि के पश्चात्, “बोड् क ब ठक के प्रत्येक दिि के जलए पांच स रुपये क ब ठक फ स” शब्िों
के ्पाि पर “समय-समय पर न्यास ्ारा यपा अििाररत फ स” शब्ि र े िाएंगे ।
(vii) जियम 6 का प-जियम (3) हटाया िाएगा ।

NOTIFICATION
New Delhi, the 13th November, 2017
G.S.R. 1383(E).—The following draft of certain rules further to amend the National Trust for
Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities Rules, 2000,
which the Central Government, proposes to make, in exercise of the powers conferred by Section 34 of the
National Trust for Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation and Multiple
Disabilities Act, 1999 (44 of 1999), is hereby published for the information of all persons likely to be affected
thereby ; and notice is hereby given that the said draft rules shall be taken into consideration after the expiry
of a period of thirty days from the date on which the copies of the Official Gazette in which this notification is
published are made available to the public;

DRAFT RULES
1. (1) These rules may be called National Trust for Welfare of Persons with Autism, Cerebral Palsy,
Mental Retardation and Multiple Disabilities (Amendment) Rules, 2017.
(2) They shall come into force on the date of their final publication in the Official Gazette.
2. In the National Trust for Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation and
Multiple Disabilities Rules, 2000,—
(i) sub-rule (2) of rule 3 shall be substituted by the following, namely.—
(2) The Trust shall notify vacancies inviting nominations for nine members of the Board as
required by Section 3(4) (b) of the Act three months prior to the expiry of the term of the
Board from amongst the organizations registered with it under section 12 of the Act.
(ii) After sub-rule (2) of rule 3, the following shall be inserted, namely,—4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]
2(A) The Trust shall also invite nominations from associations of trade, commerce and
industry engaged in philanthropic activities for three members as required by Section 3(4)(d)
of the Act.
2(B) The Trust shall notify the vacancies of the Members of the Board highlighting the
requisite qualification, experience required in disability matters, upper age limit of 65 years as
prescribed under the regulations of the giving a minimum of 45 days for receipt of
applications/nominations.
2(C) On receipt of the applications/nominations the Secretary, Department of Empowerment
of Persons with Disabilities shall constitute a Scrutiny Committee of three officials from ex-
officio members of the Board to scrutinize the applications.
2(D) The Scrutiny Committee shall draw a list of eligible applicants State-wise and region-
wise based on the category opted by the applicant:
Provided that the Scrutiny Committee while drawing up the list of eligible applicants
shall give due consideration for ensuring wider representation to the organizations working in
the fields and also to ensure that the same applicant or nominee does not monopolise at the
cost of wider choice.
2(E) The Trust shall sensitize the elected member of the Board who have served for one
complete term to give way to new applicants.
(iii) For sub-rule (4) of rule 3, the following shall be substituted, namely.—
(4) where the number of eligible applicants is more than the number of vacancies, election
shall be held in accordance with Rule 3 of the NT Rules 2000.
(iv) After sub-rule (5) of rule 3, the following shall be inserted, namely.—
(6) In the case of nominations received under Section 3 (4) (d) of the Act, the Board shall
approve three nominees based on their experience in disability sector and taking into account
their philanthropic work in pursuance to corporate social responsibility.
(7) Any dispute on matter relating to election may be raised within 30 days of the declaration
of the result and such dispute shall be referred for adjudicationbefore the Secretary,
Department of Empowerment of Persons with Disabilities (Divyangjan), Ministry of Social
Justice, Government of India, whose decision thereon shall be final and binding.
(8) No person who has been nominated once to the Board shall be entitled to be re-nominated.
(v) In the title of rule 4, the words “and members” shall be deleted.
(vi) In sub-rule (2) of rule 5, after the word sitting, the words “fee of rupees five hundred for each
day of the meeting of the Board” shall be substituted by the words “fees as determined by the
Trust from time to time.”
(vii) Sub-rule (3) of rule 6 shall be deleted.
(viii) In sub-rule (1) of rule 10, after the word “Members”, the words “of the Board” shall be
inserted.
(ix) In sub-rule (1) of rule 16, for the words “Form A”, the words “format as prescribed by the
Trust from time to time” shall be substituted.
(x) In sub-rule (2) of rule 16, for the words “Form B”, the words “format as prescribed by the
Trust from time to time” shall be substituted.
(xi) In clause (a) of item (vi) of sub-rule (1) of rule 17, for the word “longer”, the word
“unreasonable” shall be substituted.II (i) 5
(xii) In clause (e) of item (vi) of sub-rule (1) of rule 17, for the word “long”, the word
“unreasonable” shall be substituted.
(xiii) In item (ix) of sub-rule (6) of rule 21, the words “to the society” shall be substituted
