L.-33004/99 सी.जी.-डी.एल.-अ.-06092021-229452 xxxGIDHxxx CG-DL-E-06092021-229452 xxxGIDExxx ऄसाधारण EXTRAORDINARY भाग II—खण् ड 3—ईप-खण्ड (i) PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 500] नइ ददल्ली, सोमवार, जसतम्ब र 6, 2021/भार 15, 1943 No. 500] NEW DELHI, MONDAY, SEPTEMBER 6, 2021/BHADRA 15, 1943 परे ोजलयम और प्राकृजतक गसै मत्रं ालय ऄजधसचू ना नइ ददल्ली, 2 जसतम्ब र, 2021 सा.का.जन. 614(ऄ).—पेरोजलयम ऄजधजनयम, 1934 (1934 का 30) की धारा 4 और धारा 29 की ईपधारा (2) और (3) द्वारा प्रदत्त िजियों का प्रयोग करते हुए, केन्द्र सरकार पेरोजलयम जनयमावली, 2002 में अगे संिोधन करने के जलए कजतपय जनयमों के जनम्नजलजखत मसौद े का प्रस्ट्ताव, ईि ऄजधजनयम की धारा 29 की ईपधारा (4) द्वारा यथापेजित ईससे प्रभाजवत होने वाले सभी व्यजियों को सूजचत करन े के जलए, एतदद्वारा प्रकाजित करती ह ै और एतदद्वारा नोटिस ददया जाता ह ैदक ईि मसौदा जनयमों को िाजमल करने वाले भारत के राजपत्र की प्रजतयां जनता को ईपलब्ध करवाए जान े की तारीख से पतैं ालीस ददनों की ऄवजध की समाजि पर या ईसके बाद, ईि मसौदे पर जवचार दकया जाएगा। ईपययुि ऄवजध के भीतर दकसी भी व्यजि स े प्राि होने वाली अपजत्तयों और सयझावों पर केन्द्र सरकार द्वारा जवचार दकया जाएगा। अपजत्तयां और सयझाव, यदद कोइ हो, को संययि सजचव (जवपणन), पेरोजलयम और प्राकृजतक गैस मंत्रालय, नइ ददल्ली-110107 को संबोजधत दकया जा सकता ह ैया आसे jsm.png@nic.in इमले पर भजे ा जा सकता ह:ै। मसौदा जनयम 1. आन जनयमों को पेरोजलयम (संिोधन) जनयम, 2021 कहा जाएगा। 2. पेरोजलयम जनयम, 2002 म,ें - (1) जनयम 2 म,ें ईप जनयम (1) म,ें - 4936 GI/2021 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (क) खडं (xiv), के बाद जनजम्नजलजखत खडं को ऄंत:स्ट्थाजपत दकया जाएगा। “(xivक) “भारी मिीनरी” से तात्पयु हवै ी ड्यूिी मिीनरी, जनमाुण कायु ऄथवा कृजि कायु ऄथवा जवियद्धत: राजमागु के ऄलावा जनमाणु काय ु करने के जलए जविेि रूप से रूपांदकत ऄथवा सड़क नेिवकु के ऄलावा पटरसर, कारखाना, पत्तन ऄथवा खान के भीतर ईपयोग हते य रूपांदकत और ऄपनाए गए ऐस े जलफ्टिग ईपस्ट्कर वाहन स े ह ै जो ऄपनी उजाु स े सावुजजनक सड़कों पर यात्रा के जलए सजित नहीं हो। (xivख) “भारी वाहन” से तात्पयु रबर िायडु या न्द्यूमेटिक िायडु या रबर पडै ेड या स्ट्िील ड्रम व्हील माईंिेड, स्ट्वचाजलत ऄथवा दकसी यांजत्रक रूप स े चाजलत वाहन या ईनका संयोजन से ह ै जजसे जवजभन्न िेत्र प्रचालनों के जलए ईपययि ईपकरणों के साथ काम करन े के जलए रूपांदकत दकया गया हो और/ऄथवा कृजि, जनमाुण, खनन, औद्योजगक ईपक्रम, फ्सचाइ और सामान्द्य जनमाुण के िेत्र में राजमागु के ऄलावा प्रचालनों के जलए रूपांदकत दकया गया हो और जो "ऑन ऄथवा ऑफ" ऄथवा "ऑन और ऑफ" राजमागु िमताओं के साथ संिोजधत और जवजनर्ममत और एक गरै -पटरवहन, गैर-वाजणजययक वाहन हो, जो सावुजजनक सड़क पर यात्रा करन े के जलए सयसजित हो और जो समय-समय पर यथा-संिोजधत मोिर वाहन ऄजधजनयम, 1988 में यथा-पटरभाजित ह;ै " (ख) खडं (xxvi) में िब्द “पेरोजलयम” के बाद िब्द “अइएसओ िैंक कंिेनर सजहत” ऄंत:स्ट्थाजपत दकया जाएगा; (ग) खडं (xxvii) के बाद जनम्नजलजखत खडं ऄंत:स्ट्थाजपत दकया जाएगा, नामत: :- (xxviiक) “अइएसओ िैंक कंिेनर” से तात्पयु एक ऐसे पेरोजलयम फ्रेि कंिेनर से ह ैजो अइएसओ िैंक कंिेनर ढांचे पर लगाया गया हो, जो जववस्ट्िर लॉक द्वारा सयरजित हो, तरल पेरोजलयम की ढयलाइ के जलए ईपयिय हो और जजसे पटरवहन के आन रूपों के बीच आंिरचेंज सजहत सड़क, रेल या समयर द्वारा पटरवहन के जलए गयरुत्वाकिुण ऄथवा दबाव जनवुहन द्वारा लोड या ऄनलोड दकया जा सकता हो और जो मयख्य जनयंत्रक द्वारा स्ट्वीकार दकए गए राष्ट्रीय या ऄंतराष्ट्रु ीय मानकों के ऄनयसार रूपांकन, जवजनदेिनों और परीिण के ऄनरूय प हो; (xxviiख) “अइएसओ िैंक कंिेनर फ्रेमवकु” से तात् पयु िैंक माईंिंि्‍स , एंड स्ट्रक्चर और सभी लोड वाले तत्व ह ैं जो कागो रखने के प्रयोजनों के जलए मौजदू नहीं हैं, जो िैंक कंिेनर को ईठाने, ईसकी हडैं फ्लग करन,े सयरजित करने और एक परू े िैंक कंिेनर के पटरवहन स े ईत्पन्न जस्ट्थर और गजतिील बलों को संचाटरत करते ह ैं और मयख्य जनयत्रं क द्वारा स्ट्वीकार दकए गए राष्ट्रीय या ऄंतरराष्ट्रीय मानकों के ऄनयसार जडजाआन, जवजनदेिों और जांच के ऄनयरूप ह;ैं ” (घ) खंड (xxxiii) के बाद जनम्न जलजखत खडं को ऄंत:स्ट् थाजपत दकया जाएगा:- “(xxxiiiक) “तृतीय पिकार जनरीिण एजेंसी” से तात् पयु मख्य य जनयंत्रक द्वारा मान्द्यता प्राि एक ऐसे पिे ेवर संगठन स े ह ै जो समय-समय पर यथा-संिोजधत खतरनाक रसायनों के जनमाुण, भंडारण और अयात जनयम, 1989 के तहत यथा- पटरभाजित बड़े दघय ुिना खतरों वाले (एमएएच) पटरसर का समय-समय पर जनरीिण और सयरिा जांच करता ह ैऔर जजसके पास सिम व्यजियों के जलए लागू यो्‍यता और ऄनयभव वाल ेव्यजि हों;” (2) जनयम 4 में ईप जनयम (3) के बाद जनम्न जलजखत को ऄतं :स्ट्थ ाजपत दकया जाएगा, नामत:; “(4) आन जनयमों में कयछ भी ऄनयसंधान और जवकास के जलए पेरोजलयम ययि कंिेनरों के अयात के जलए लागू नहीं होगा बिते आनकी पैककग समय-समय पर यथा-संिोजधत ऄंतराुष्ट्रीय वायय पटरवहन संघ (अइएिीए) के खतरनाक सामान जवजनयमनों के ऄनरूय प हो।"; (3) जनयम 8 म,ें ईप जनयम (1) म ें “आस प्रकार मरम् मत दकए जाने वाल”े िब् दों को “ऄथवा िीपीअइए” िब् दों स े प्रजतस्ट् थाजपत दकया जाएगा; (4) जनयम 13 म,ें - (क) ईप जनयम (1) म ें “मयख्य जवस्ट् फोिक जनयंत्रक के पि म ें दये , नागपरय म ें देय ऄथवा इ-भयगतान के माध् यम स े रा्‍र ीयकृत ऄथवा ऄनयसूजचत बैंक के रेखांदकत बैंक ड्राटि द्वारा,” िब् दों को “इ-भयगतान के माध् यम स े ऄथवा गैर कर प्राजत त पोिलु माध् यम स”े िब् दों स ेप्रजतस्ट्थ ाजपत दकया जाएगा; (ख) ईप जनयम (2) म ें “मयख्य जवस्ट् फोिक जनयंत्रक, जजसे भयगतान दकया जाना ह,ै के पि म ें दये रेखांदकत बैंक ड्राटि द्वारा। बैंक ड्राटि रा्‍र ीयकृत ऄथवा ऄनयसूजचत बैंक के नाम पर होगा और ईस स्ट् िेिन पर देय होगा जहां जनयंत्रक, जजन्द् ह ें भयगतान दकया जाना है, का कायाुलय जस्ट् थत ह”ै िब् दों को “इ-भयगतान के माध् यम से ऄथवा गैर कर प्राजतत पोिलु माध्य म स”े िब्द ों से प्रजतस्ट् थाजपत दकया जाएगा;[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 3 (5) जनयम 14 के बाद जनम्न जलजखत जनयम को ऄंत:स्ट् थाजपत दकया जाएगा, नामत: “14(क) अइएसओ िैंक कंिेनरों के अयात और पटरवहन पर प्रजतबधं - (1) कोइ भी व्यजि मख्य य जनयंत्रक की पूव ु ऄनयमजत के बगैर पेरोजलयम से भरे हुए ऄथवा भरे जाने के जलए दकसी भी अइएसओ िैंक कंिेनर का अयात नहीं करेगा। (2) ईप-जनयम (1) के तहत पूव ुऄनयमोदन प्राि करन े वाला कोइ भी व्यजि मयख्य जनयंत्रक को जनम्न जलजखत प्रस्ट्तयत करेगा- (क) फॉमु XV में जारी वैध लाआसेंस की एक प्रजत जो अइएसओ िैंक कंिेनर की संपणू ु सामग्री को समायोजजत करन े की पयाुि िमता के जलए हो; (ख) जवजनमाुता देि के सिम प्राजधकारी द्वारा जवजधवत रूप से पृष्ांदकत अइएसओ िैंक कंिेनर के जवजनमाुता के जनरीिण और जांच टरपोिें; (ग) जवजनमाुता देि के सिम प्राजधकारी द्वारा जारी हाआड्रोिेस्ट्ि प्रमाण पत्र और कंिेनर सयरिा प्रमाण पत्र (सीएससी) सजहत अवजधक जनरीिण और जांच की एक प्रजत; (घ) जवजनमाुता देि के सिम प्राजधकारी द्वारा जवजधवत रूप से पृष्ांदकत अइएसओ िैंक कंिेनर के रूपांकन जववरण, िैंक की जल िमता, आसकी दफिंिग और आसके जनमाुण म ें प्रययि सामग्री के जवजनदेिनों का जववरण दिाुने वाली रूपांकन ड्राआंग की दो प्रजतयां; (ड.) अइएसओ िैंक कंिेनर के प्रचालन के जलए अयात के पत् तन की सहमजत (च) मयख्य जनयंत्रक द्वारा जवजधवत ऄनयमोददत सड़क द्वारा पटरवहन के जलए ऄनयमोददत जवस्ट्तृत वाहन माईंिंिग ड्राआंग की तीन प्रजतया ं (छ) अयात के पत् तन से ऄंजतम ईपयोग के स्ट्थान तक अइएसओ िैंक कंिेनर के प्रचालन और पटरवहन के जलए सयरजित प्रचालन प्रदक्रया (ज) पहली ऄनयसूची के भाग ग में यथा-जवजनर्ददष्ट जांच िल्य क।"; (6) जनयम 19 म,ें- (क) ईप-जनयम (1) म,ें खंड (क) म ें "और" िब्द का लोप दकया जाएगा; (ख) ईप-जनयम (1) म,ें खंड (ख) के बाद जनम्नजलजखत खंड को ऄंत:स्ट् थाजपत दकया जाएगा, नामत: "(ग) अइएसओ िैंक कंिेनर में पेरोजलयम के अयात और पटरवहन के मामले में जनयम 14 (क) के तहत जारी अइएसओ िैंक कंिेनर मयख्य जनयंत्रक की रूपांकन ड्राआंग का ऄनयमोदन;"; (7) ऄध्याय 2 म,ें भाग 3 के बाद जनम्नजलजखत भाग ऄंत:स्ट्थ ाजपत दकया जाएगा नामत: "भाग IV" वाय यमाग ुद्वारा अयात 27(क) वाय य माग ु स े अयात पर प्रजतबधं : (1) केंर सरकार द्वारा समय-समय पर आस ईद्देश्य के जलए प्राजधकृत हवाइ ऄड्डों को छोड़कर वायय माग ुसे कोइ पेरोजलयम अयात नहीं दकया जाएगा। (2) ऄतं रराष्ट्रीय हवाइ पटरवहन प्राजधकरण के जनयमों या नागटरक ईड्डयन के महाजनदेिक द्वारा जजसकी ऄनयमजत नहीं ह,ै ऐसे दकसी भी पेरोजलयम ईत् पाद का अयात वायय माग ुसे नहीं दकया जाएगा। (3) कोइ भी व्यजि जो वायय मागु से पेरोजलयम का अयात करना चाहता है, ईसे नागटरक ईड्डयन महाजनदेिालय से लैंफ्डग परजमि प्राि करना होगा। (4) पेरोजलयम के अयात और भंडारण के जलए लाआसेंस रखन े वाला कोइ भी व्यजि या ईसका प्राजधकृत एजेंि पेरोजलयम को हवाइ ऄड्ड े पर लान े से पहल े हवाइ ऄड्ड े के प्रभारी ऄजधकारी और सीमा ियल्क अयिय को अयात दकए जान े वाल े पेरोजलयम ईत् पाद का परू ा जववरण देते हुए घोिणा करेगा। (5) अयातकता ु द्वारा अयाजतत पेरोजलयम की सीधी सयपयदगु ी लेन े और ईसे हवाइ ऄड्डे से यथािीघ्र हिाने की ईजचत व्यवस्ट्था की जाएगी।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 27(ख) वाय य माग ु स े परे ोजलयम का अयात करन े स े पहल े घोिणा करनी होगी और प्रमाण पत्र और लाआससें प्रस्ट्ततय होगा- वायय मागु से पेरोजलयम अयात करने के आच्छयक प्रत्येक व्यजि को सीमा ियल्क अययि जनम्न जलजखत प्रस्ट्तयत करना होगा: - (क) फॉमु I में एक घोिणा जो ईसके या ईसके एजेंि द्वारा हस्ट्तािटरत हो; (ख) ईसके या ईसके एजेंि द्वारा हस्ट्तािटरत फॉमु II में भंडारण स्ट् थल का प्रमाण पत्र; (ग) ऐसे पेरोजलयम के अयात और भंडारण के जलए रखे गए लाआसेंस की एक प्रमाजणत प्रजत; (घ) पेरोजलयम के वायय माग ुसे अयात दकए जान े के मामले म ेंनागटरक ईड्डयन महाजनदेिक स ेलैंफ्डग परजमि और; (ड.) वायय मागु स ेपेरोजलयम के पटरवहन के जलए संबंजधत टलाआि ऑपरेिर से एक ऄनमजत पत्र; बिते दक आस जनयम में कयछ भी ऄजधजनयम की धारा 7, 8 और 9 के तहत छूि प्राि पेरोजलयम के अयात पर लागू नहीं होगा: बिते यह भी दक ऄजधजनयम की धारा 7 के तहत छूि प्राि मात्रा में थोक में पेरोजलयम वग ु ग के अयात के जलए खंड (ग) के तहत लाआसेंस प्रस्ट्तयत करना अवश्यक नहीं होगा। 27(ग) परे ोजलयम की ऄनलोफ्डग के जलए सीमा िल्य क अयिय की ऄनमय जत - (1) सीमा िल्य क अयिय की ऄनयमजत के जबना कोइ भी पेरोजलयम ऄनलोड नहीं दकया जाएगा। (2) यदद सीमा िल्य क अययि, जनम्न जलजखत प्राि करने के बाद: - (क) पेरोजलयम संबंधी जांच ऄजधकारी की टरपोि;ु (ख) फॉमु II में प्रमाण पत्र, यदद जनयम 27 (ख) द्वारा ऄपेजित है; (ग) लाआसेंस, यदद जनयम 27 (ख) द्वारा ऄपेजित हो तथा ऐसी और पूछताछ, जजसे वह अवश्य क समझता ह,ै करने के बाद वह संतयष्ट हो दक पेरोजलयम का वैध रूप से अयात दकया जा सकता ह ै और आसके भंडारण केजलए ईपयिय स्ट् थान ह,ै वह आस े ईतारने की ऄनयमजत दगे ा; (घ) यदद जनयम 27 (ख) द्वारा ऄपेजित हो, नागटरक ईड्डयन महाजनदेिक से लैंफ्डग परजमि, (ड.) हवाइ माग ुसे पेरोजलयम के पटरवहन के जलए संबंजधत ईड़ान ऑपरेिर स ेऄनयमजत पत्र। (3) यदद सीमा ियल्क अययि आस बात से संतयष्ट ह ैं दक अयाजतत दकसी भी पेरोजलयम ईत् पाद का भारत में भंडारण करने का आरादा नहीं ह,ै ऄजपतय ऄनलोफ्डग के तरय ंत बाद भारत के बाहर दकसी भी स्ट्थान पर भेजा जाना है, तो वह जनयम 27 (ख) की ऄपेिाओं को छोड़ सकता ह ै और ऐसी ितों के ऄधीन जो वह जवजनर्ददष्ट कर सकता ह,ै ईसके द्वारा जलजखत अदेि परजमि द्वारा ऐसे पेरोजलयम ईत्प ाद को ईस स्ट्थान पर तत्काल भेजने के ईद्देश्य से ऄनलोड दकया जाना चाजहए। (4) आस जनयम म ें कयछ भी ऄस्ट् थायी तौर पर लागू दकसी ऄन्द्य कानून या जनयम के तहत पेरोजलयम को रोके रखन े की सीमा ियल्क अययि की िजि को प्रभाजवत नहीं करेगा"। (8) जनयम 32 म,ें- (क) िब्द "पोत" के बाद, िब्द "अइएसओ िैंक कंिेनर" ऄंत:स्ट्थ ”जपत दकया जाएगा; (ख) स्ट्पष्टीकरण म,ें "मयख्य जनयत्रं क" िब्दों के बाद िब्द "ऄथवा िीपीअइए" ऄंत:स्ट्थ ाजपत दकया जाएगा। (9) जनयम 70 म,ें ईप-जनयम (1) म,ें खंड (iii) के बाद जनम्नजलजखत खंड ऄंत:स्ट्थ ाजपत दकया जाएगा, नामत: - "बित े दक आस जनयम के खंड (ii) और (iii) में कयछ भी समय-समय पर सड़क पटरवहन प्राजधकरण द्वारा जवजनर्ददष्ट बीएस-IV या ईन्नत आंजन वाल ेवाहन पर लाग ूनहीं होगा;" (10) जनयम 75 म,ें- (क) ईप-जनयम (1) म,ें "लाआससें " िब्द के बाद, िब्द "या ऄनमय जत" ऄंत:स्ट् थाजपत दकया जाएगा; (ख) ईप-जनयम (2) के बाद, जनम्नजलजखत ईप-जनयम ऄंत:स्ट्थ ाजपत दकया जाएगा, नामत: - "(3) अइएसओ िैंक कंिेनर की प्रत्येक खेप के जलए सड़क माग ु से पटरवहन के जलए मयख्य जनयत्रं क/जनयंत्रक से ऄनयमजत प्राि की जाएगी। ऐसी ऄनयमजत जारी होने की तारीख से छह महीन ेके जलए वैध रहगे ी;[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 5 (4) (क) ईप-जनयम (3) के तहत अइएसओ िैंक कंिेनर के जलए ऄनयमजत की प्रात त करन े वाला व्यजि मयख्य जनयंत्रक/जनयंत्रक को जनम्नजलजखत प्रस्ट्तयत करेगा: - (i) फॉमु VII क में अवेदन, (ii) पहली ऄनयसूची के भाग ग में जवजनर्ददष्ट जांच ियल्क, (ख) मख्य य जनयंत्रक, ईप-जनयम (क) के तहत ऄपेजित दस्ट्तावेजों की प्राजि के बाद तथा ऐसी और पूछताछ, जजसे वह अवश्यक समझता ह,ै करने के बाद संतयष्ट होने पर दक वाहन आन जनयमों में जनधाुटरत ऄपेिाओं को पूरा करता ह,ै वह अवेदक को जवजधवत पष्ृ ांदकत ड्राआंग की एक प्रजत के साथ ऄनमय जत जारी करेगा; (11) जनयम 76 म,ें ईप-जनयम (3) म,ें िब्दों और ऄंकों “(1934 का 22)” के बाद, “और आन जनयमों के फॉम ु XIX के तहत लाआसेंस प्राि वाहनों द्वारा भारी वाहनों/मिीनरी/ऄचल ईपकरणों में साआि पर ईंधन भरना” िब्दों और ऄंकों को ऄंत:स्ट्थाजपत दकया जाएगा; (12) जनयम 77 म,ें “पयन: जांच की गइ” िब्दों के बाद, “एक सिम व्यजि या िीपीअइए द्वारा” िब्द ऄंत:स्ट्थाजपत दकए जाएंगे; (13) जनयम 85 म,ें - (क) ईप-जनयम (1) म,ें “सिम जजम्मेदार व्यजि” िब्दों को, “सिम व्यजि या िीपीअइए” िब्दों स े प्रजतस्ट्थाजपत दकया जाएगा; (ख) ईप-जनयम (4) के बाद, जनम्नजलजखत को ऄंत:स्ट्थ ाजपत दकया जाएगा, नामत: - “(5) अइएसओ िैंक कंिेनर फ्रेमवकु और/ ऄथवा अइएसओ िैंक कंिेनर की प्रत्येक मरम्मत के बाद फैजिकेिन कोड म ें जनधाुटरत तरीके से जांच की जाएगी। स्ट्पष्टीकरण: आस जनयम के प्रयोजन के जलए, यह स्ट्पष्ट दकया जाता ह ै दक िैंकों के जनरीिण, मरम्मत, पटरवतुन और पयनर्मनमाुण के संबंध म ेंयथा-लागू ओअइएसडी मानकों और/ऄथवा एपीअइ मानकों का पालन दकया जाएगा। (14) जनयम 89 म,ें ईप-जनयम (2) के बाद जनम्नजलजखत ईप-जनयम को ऄतं ःस्ट्थाजपत दकया जाएगा, नामत: - “(3) ईप-जनयम (2) के तहत ड्राआंग और ियल्क प्राि होने पर और ऐसी यथा-ऄपेजित ऄजतटरि जानकारी प्राि करन े के बाद मयख्य जनयंत्रक, यदद वह संतष्टय हो, तो प्रस्ट्ताजवत पाआपलाआन को ईपययि समझी जान े वाली ऐसी ितों के ऄधीन ऄनयमोददत करेगा” ; (15) जनयम 90 म,ें ईप-जनयम (1) म,ें िब्द “आस्ट्पात” के बाद “ऄथवा मयख्य जनयंत्रक द्वारा ऄनयमोददत कोइ ऄन्द्य ईपययि सामग्री” िब्द ों को ऄतं ःस्ट्थाजपत दकया जाएगा; (16) जनयम 93 म,ें ईप-जनयम (२) के बाद, जनम्नजलजखत ईप-जनयम को ऄतं ःस्ट्थाजपत दकया जाएगा, नामत:- “(2क) पाआपलाआन की हाआड्रोस्ट्िेटिक जांच एक सिम व्यजि या िीपीअइए द्वारा की जाएगी। (2ख) सिम व्यजि या िीपीअइए ईप-जनयम (1) के तहत यथा-ऄपेजित जांच करेगा और एक प्रमाण पत्र जारी करेगा; आस प्रकार जारी दकया गया प्रमाण पत्र मयख्य जनयंत्रक को प्रस्ट्तयत दकया जाएगा।” ; (17) जनयम 98 म,ें “कािने या दफर से वेफ्ल्डग करन े वाल”े िब्दों को, “या हॉि वकु” िब्दों स ेप्रजतस्ट् थाजपत दकया जाएगा; (18) जनयम 106 म,ें- (क) ईप जनयम (1) म,ें “60079-II” ऄंकों के बाद “अइएस/अइइसी 60079-26” िब्दों और ऄंकों को ऄंत:स्ट्थ ाजपत दकया जाएगा; (ख) ईप-जनयम (2), खंड (i) को जनम्नजलजखत खंड से प्रजतस्ट्थाजपत दकया जाएगा, नामत: - “(i) अइएस/अइइसी 60079-1, अइएस/अइइसी 60079-2, अइएस/अइइसी 60079-5, अइएस/अइइसी 60079- 6, अइएस/अइइसी 60079-7, अइएस/अइइसी 60079-11, अइएस/अइइसी 60079-18 और मयख्य जनयंत्रक द्वारा जलजखत रूप म ें ऄनयमोददत कोइ ऄन्द्य समकि मानक के ऄनरूय प टलेमप्रूफ ऄथवा प्रेिराआयड िाआप ऄथवा पाईडर भरा ऄथवा तले में डूबा हुअ ऄथवा बढी हुइ सयरिा या अतं टरक रूप से सयरजित या एनकैतसयलेिेड ईपकरण, ऄथवा”;6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (ग) ईपजनयम (3) म ेंखंड (i) को जनम्नजलजखत खंड से प्रजतस्ट् थाजपत दकया जाएगा, नामत:- “(i) अइएस/अइइसी 60079-15 और मयख्य जनयंत्रक द्वारा जलजखत रूप म ें ऄनयमोददत एक िाआप के ऄनरूय प गरै -स्ट्पार्ककग ईपकरण; ऄथवा”; (घ) ईप-जनयम (3) के बाद, जनम्नजलजखत ईप-जनयम को ऄतं :स्ट्थ ाजपत दकया जाएगा, नामत: - “(4) एक् स-आलैक्र ीकल ऄपरेचसु का चयन अइएस 16724:2018/अइइसी60079-14 ऄथवा अइइसी 60079-14 ऄथवा मयख्य जनयंत्रक द्वारा जलजखत रूप में स्ट्वीकृत दकसी ऄन्द्य समकि मानक में यथा-पटरभाजित ईपकरण सयरिा स्ट्तर (इपीएल) के ऄनयसार होगा।” ; (19) जनयम 107 म,ें ईपखंड (5) के बाद जनम्नजलजखत स्ट्पष्टीकरण ऄंत:स्ट्थ ाजपत जाएगा, नामत: - "स्ट्पष्टीकरण: आस जनयम के प्रयोजनों के जलए, यह स्ट्पष्ट दकया जाता ह ै दक दफक्स्ट्ड आलेजक्रक वायिंरग के संबंध में, यथा- लाग ूओअइएसडी मानकों का पालन दकया जाएगा” (20) जनयम 108 म,ें ईपखंड (5) के बाद जनम्नजलजखत स्ट्पष्टीकरण ऄंतःस्ट्थाजपत दकया जाएगा, नामत:- “स्ट्पष्टीकरण: आस जनयम के प्रयोजनों के जलए, यह स्ट्पष्ट दकया जाता ह ै दक ऄर्थथग और बॉफ्न्द्डग के संबंध में यथा-लाग ू ओअइएसडी मानकों का पालन दकया जाएगा।” (21) जनयम 114 म ेंिब्द "व्यजि” को “आलेजक्रकल/आंस्ट्ूमेंिेिन आंजीजनयर” िब्दों से प्रजतस्ट्थ ाजपत दकया जाएगा; (22) जनयम 117 म,ें ईप-जनयम (4) म,ें खंड (2) म,ें “ओअइएसडी मानक-117” िब्दों और ऄंकों के बाद “ऄथवा ओअइएसडी मानक-244” िब्द ों और ऄंकों को ऄंतःस्ट्थाजपत दकया जाएगा ; और “ओअइएसडी -117” िब्द और ऄंक के बाद “और ओअइएसडी -244” िब्द और ऄंक ऄंत:स्ट् थाजपत दकया जाएगा; (23) जनयम 118 के बाद, जनम्नजलजखत स्ट्पष्टीकरण ऄतं ःस्ट्थाजपत दकया जाएगा, नामत::- “स्ट्पष्टीकरण: यह स्ट्पष्ट दकया जाता ह ै दक सरय िा प्रजििण के संबंध में, यथा-लाग ू ओअइएसडी मानकों का पालन दकया जाएगा।” (24) जनयम 120 म,ें ईपखंड (5) के बाद जनम्नजलजखत स्ट्पष्टीकरण ऄंत:स्ट्थ ाजपत दकया जाएगा, नामत: - “स्ट्पष्टीकरण: आस जनयम के प्रयोजनों के जलए यह स्ट्पष्ट दकया जाता ह ै दक जल जनकासी के संबंध में यथा-लाग ू ओअइएसडी मानकों का पालन दकया जाएगा।” (25) जनयम 124 के ईप-जनयम (1) म ें“एपीअइ:650” िब्दों एवं ऄंक के बाद “या एपीअइ:620” िब्दों एवं ऄंक को ऄंतःस्ट्थाजपत दकया जाएगा; (26) जनयम 126 में, - (क) ईप-जनयम (1) में, “सिम व्यजि” िब्दों के बाद “या िीपीअइए” िब्दों को ऄतं ःस्ट्थाजपत दकया जाएगा; (ख) ईप-जनयम (3) में, “सिम व्यजि” िब्दों के बाद “या िीपीअइए” िब्दों को ऄतं ःस्ट्थाजपत दकया जाएगा; (27) जनयम 127 में ईप-खण्ड (3) के बाद जनम्नजलजखत स्ट्पष्टीकरण ऄंतःस्ट्थाजपत की जाएगी, नामतः, - “स्ट्पष्टीकरण: आस जनयम के प्रयोजनाथु यह स्ट्पष्ट दकया जाता ह ै दक यथाप्रयोयय ओअइएसडी मानकों का ऄनपय ालन दकया जाएगा।” (28) जनयम 130 में, - (क) ईप-जनयम (1) में, “सिम व्यजि” िब्दों के बाद “या िीपीअइए” िब्दों को ऄतं ःस्ट्थाजपत दकया जाएगा; (ख) ईप-जनयम (1क) के बाद, सयरिा सम्बन्द्धी प्रमाण पत्र के प्रारूप में, “सिम व्यजि” िब्दों के बाद “या िीपीअइए” िब्दों को ऄंतःस्ट्थाजपत दकया जाएगा; (ग) ईप-जनयम (2) के खण्ड (i) में – (i) “सिम व्यजि” िब्दों के बाद “या िीपीअइए” िब्दों को ऄंतःस्ट्थाजपत दकया जाएगा; (ii) खण्ड (ख) के बाद, जनम्नजलजखत खण्ड ऄंतःस्ट्थाजपत दकया जाएगा, नामतः, - "(ग) पाँच वि ु की ऄवजध के जलए मान्द्यता प्रदान की जाएगी और प्रदिुन टरपोिु एव ं मेजडकल काईंजसल ऑफ आंजडया द्वारा मान्द्यता-प्राि पंजीकृत जचदकत्सक द्वारा प्रदत्त जचदकत्सीय स्ट्वास्ट््य प्रमाण पत्र के अधार पर प्रत्येक तीन विु के जलए नवीनीकृत दकया जा सकेगा, जब तक सिम व्यजि या िीपीअइए 65 विु की अय य प्राि नहीं कर लेता ह।ै सिम व्यजि या िीपीअइए की मान्द्यता 65 विु की अय यप्राि करने पर जनरस्ट्त हो जाएगी।” (29) जनयम 143 में, (क) ईप-जनयम (2) के जलए, जनम्नजलजखत खण्ड प्रजतस्ट्थाजपत दकया जाएगा, नामतः, - "(2) यांजत्रक रूप से चाजलत वाहनों में सड़क माग ु से पेरोजलयम के थोक पटरवहन के जलए ऄनयज्ञजि देन े के जलए एक अवेदन प्रपत्र VII में होगा और वायययानों, भारी वाहनों/मिीनटरयों और यांजत्रक रूप से चाजलत वाहन द्वारा जस्ट्थर8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] ईपकरण यथा टरटयूलर के जलए ऑनसाआि ईंधन भरने के जलए पेरोजलयम श्रेणी क/ख के थोक पटरवहन के जलए प्रपत्र VIII होगा; बिते ऐसा अवेदन प्राि होन े के 30 ददनों के भीतर मख्य य जनयंत्रक द्वारा कोइ जनणुय नहीं लेन े पर ऄनयज्ञजि प्रदान दकया हुअ माना जाएगा।" (ख) ईप-जनयम (2) के बाद, जनम्नजलजखत खण्ड ऄंतःस्ट्थाजपत दकया जाएगा, नामतः, - "(3) पेरोजलयम के अयात और भंडारण के जलए ऄनयज्ञजि सम्बन्द्धी एक अवेदन प्रपत्र IX में होगा और कंिेनरों में यांजत्रक रूप से चाजलत वाहनों स ेजमट्टी का तेल (पेरोजलयम श्रणे ी ख) खाली करन े के जलए प्रपत्र X में होगा।" (30) जनयम 144 में, (क) ईप-जनयम (5) के जलए, जनम्नजलजखत खण्ड प्रजतस्ट्थाजपत दकया जाएगा, नामतः, - "(5) ईप-जनयम (1) के ऄंतगुत ऄनापजत्त प्रमाण पत्र (एनओसी) जनगुत करने के जलए जजला प्राजधकारी जाँच पूणु करेगा और जनम्नजलजखत के ऄनयसार एनओसी जनगुत करन े या ऄस्ट्वीकृत करने, जैसा भी मामला हो, की कारुवाइ करेगा :- (i) ऄनापजत्त प्रमाण पत्र जारी करने के जलए जाँच, ईप-जनयम (7) के ऄंतगतु जनधाटु रत प्रारूप के ऄनयसार जजला प्राजधकारी द्वारा ऐसे अवेदन की प्राजि से 60 ददनों की ऄवजध के भीतर पूण ु कर जलया जाएगा। आसके ऄलावा, स्ट्थल के अधार पर, जजला प्राजधकारी यह भी सयजनजश्चत करेगा दक ऐसी जाँच करने के जलए ईन ऄजधकाटरयों को संदर्मभत नहीं दकया जाएगा जो संबंजधत स्ट्थल के जलए सयसगं त नहीं ह।ै (ii) जजला प्राजधकारी और ईससे सबं ंजधत प्राजधकाटरयों के बीच सभी पत्राचारों की एक प्रजत अवेदक को भेजा जाएगा जैसा दक प्रारूप के खंड (1) के ऄंतगतु जवजनर्ददष्ट दकया गया ह;ै (iii) यदद जजला प्राजधकारी द्वारा जविेि प्राजधकरण/एजेंसी से ईि 60 ददनों की ऄवजध के भीतर कोइ प्रजतदक्रया प्राि नहीं होती ह,ै तो यह माना जाएगा दक ऐसे जविेि प्राजधकरण/एजेंसी को ईि अवेदन पर 'अपजत्त नहीं' ह;ै (iv) ईपययुि 60 ददनों की ऄवजध की समाजि के बाद या संबंजधत ऄजधकाटरयों से प्रजतदक्रया प्राि होने पर, जो भी पहल े हो, जैसादक ईप -जनयम (7) के ऄंतगतु ददए गए प्रारूप के खडं (1) के ऄधीन जजला प्राजधकारी एनओसी जनगुत करन े या ऄस्ट्वीकृत करन े की कारुवाइ , जैसा भी मामला हो , 30 ददनों की ऄवजध के भीतर पूरा करेगा; (ख) यातायात संबंधी भीड़भाड़ और यातायात पर प्रभाव के संबंध में पयजलस जवभाग की टितपजणयाँ; (ग) स्ट्थानीय िेत्र जवकास योजना के ऄनयरूप स्ट्थानीय िेत्र जवकास प्राजधकरण की टितपजणयाँ; (घ) सड़क सयरिा, सड़क संरेखण और सड़क तक पहुचँ सयजनजश्चत करने के संबंध में एनएचएअइ/पीडब्ल्यूडी या दकसी ऄन्द्य संबंजधत प्राजधकरण की टितपजणयाँ। ऄपनी सरकारी मयहर के साथ ऄनापजत्त प्रमाण पत्र जनगुत करने वाले जजला प्राजधकारी (ऐसे नगर जहाँ एक पयजलस अयिय , अययि या एक पयजलस ईपाययि और दकसी ऄन्द्य स्ट्थान के जलए जजला मजजस्ट्रेि) के हस्ट्तािर टितपण:- ऄनज्ञय जि प्राजधकारी ऄनयज्ञजि प्रदान करने पर जवचार करन े के जलए ऄनापजत्त प्रमाण-पत्र को ईसके जनगुत होन े की जतजथ से तीन वि ु की ऄवजध के भीतर स्ट्वीकार करेगा।" (31) जनयम 146 के ईप-जनयम (2) म ेंखण्ड (ii) को जनम्नजलजखत खण्ड द्वारा प्रजतस्ट्थाजपत दकया जाएगा, नामतः, - "(ii) प्रस्ट्ताजवत पटरवतुन की जाँच के जलए पहली ऄनयसूची के भाग ग म ेंजवजनर्ददष्ट िल्य क।" (32) जनयम 148 के ईप-जनयम (9) म,ें "सजहत" िब्द को "जसवाय" िब्द द्वारा प्रजतस्ट्थाजपत दकया जाएगा; (33) जनयम 156 के ईप-जनयम (3) के बाद, जनम्नजलजखत स्ट्पष्टीकरण ऄंतःस्ट्थाजपत दकया जाएगा, नामतः,- "स्ट्पष्टीकरण: आस खण्ड के प्रयोजनाथ ु यह स्ट्पष्ट दकया जाता ह ै दक ऄनयज्ञापन प्राजधकारी ईि अवेदन की प्राजि होने के 30 ददनों के भीतर जनणुय करेगा, ऐसा न करन े पर, ऄनयज्ञजि को आस प्रकार स्ट्थानांतटरत हुअ माना जाएगा।" (34) जनयम 157 म ें:- (क) ईप-जनयम (1) के परन्द्तयक के बाद, जनम्नजलजखत स्ट्पष्टीकरण ऄंतःस्ट्थाजपत दकया जाएगा, नामतः, - "स्ट्पष्टीकरण: - आस खण्ड के ऄंतगुत ऄनयज्ञजि ईि व्यजि जो ऐसा व्यवसाय चलान े वाल े ऄनयज्ञजिधारक के पास िेि ऄनयज्ञजि ऄवजध के जलए स्ट्वतः स्ट्थानांतटरत मानी जाएगा, बित ें आस तरह की घिना होन े 1 विु के भीतर ऐस े व्यजि द्वारा दकए गए अवेदन दकया गया हो जबदक ईि ऄनयज्ञजिधारक की मृत्यय हो गइ हो या वह ददवाजलया हो गया हो या मानजसक रूप स े ऄसमथु हो या ऄन्द्यथा ऄिम हो।" (ख) ईप-जनयम (2) और (3) का लोप दकया जाएगा।"; (35) जनयम 200 म,ें - (क) ईप-जनयम (1) म,ें खण्ड (क) म,ें "फैक्स" िब्द के बाद, "या इमेल या संचार के ऄन्द्य आलेक्रॉजनक तरीके" िब्द ऄंतःस्ट्थाजपत दकए जाएगं ;े (ख) ईप-जनयम (2) म,ें "संचार" िब्द के बाद, " बिते दक मयख्य जनयंत्रक या ईसके प्रजतजनजध द्वारा ऐसा दौरा ऐसी दघय ुिना की सूचना की जतजथ स ेसात ददनों की ऄवजध के भीतर दकया जाएगा"; In the Petroleum Rules, 2002,- (1) in rule 2, in sub-rule (1),- (a) after clause (xiv), the following clause shall be inserted, namely:- ―(xiva) ―Heavy machineries‖ means heavy-duty machineries, specially designed for executing construction or agricultural tasks or purely off-highway construction or lifting equipment vehicle designed and adopted for use within the premises, factory, port or mine other than road network, not equipped to travel on public roads on their own power; (xivb) ―Heavy vehicles‖ means rubber tyred or pneumatic tyred or rubber padded or steel drum wheel mounted, self-propelled or any mechanically propelled vehicles or combination thereof designed to work with suitable implements for various field operations and/or designed for off-highway operations in agricultural, construction, mining, industrial undertaking, irrigation and general construction, modified and manufactured with "on or off" or "on and off" highway capabilities and is a non-transport, non-commercial vehicle, or equipped to travel on public road and as defined in the Motor Vehicles Act, 1988 as amended from time to time;‖; (b) in clause (xxvi), after the word ―petroleum‖, the words ―including ISO Tank container‖ shall be inserted; (c) after clause (xxvii), the following clause shall be inserted, namely:- ―(xxviia) ―ISO Tank container‖ means a petroleum freight container, mounted on a ISO Tank container framework, secured by twister locks, suitable for carriage of liquid petroleum which may be loaded or unloaded by gravity or pressure discharge, for conveyance by road, rail or sea, including interchange between these forms of transport and conforms to design, specifications and testing, marking as per national or international standards accepted by the Chief Controller; (xxviib) ―ISO Tank container framework‖ means tank mountings, end structure and all load bearing elements not present for the purposes of containing cargo, which transmit static and dynamic forces arising out of lifting, handling, securement and transporting of the tank container as a whole and conforms to design, specifications and testing as per national or international standards accepted by the Chief Controller;‖; (d) after clause (xxxiii), the following clause shall be inserted, namely:- ―(xxxiiia) ―Third Party Inspection Agency (TPIA)‖ means a professional organisation recognized by Chief Controller to carry out periodical inspection and safety audit of major accident hazards (MAH) premises as[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 17 defined under the Manufacture, Storage and Import of hazardous Chemicals Rules, 1989 as amended from time to time and having persons with qualifications and experience as applicable to the competent persons;‖ (2) in rule 4, after the sub rule (3), the following shall be inserted namely; "(4) Nothing in these rules shall apply for import of containers containing petroleum for research and development purpose provided that the packing conforms to International Air Transport Association (IATA) Dangerous Goods Regulations as amended from time to time."; (3) in rule 8, in sub-rule (1), for the words ―to have been so repaired‖, the words ―or TPIA‖ shall be substituted; (4) in rule 13,- (a) in sub-rule (1), for the words ―by a crossed bank draft of a nationalised or scheduled bank drawn in favour of the Chief Controller of Explosives, payable at Nagpur or through e-payment‖, the words ―through e-payment or through Non Tax Receipt Portal‖ shall be substituted; (b) in sub-rule (2), for the words ―by a crossed bank draft drawn in favour of the Controller of Explosives to whom the payment is made. The bank draft shall be drawn on any nationalized or scheduled bank payable at the station where the office of the Controller to whom payment is to be made is located‖, the words ―through e-payment or through Non Tax Receipt Portal‖ shall be substituted; (5) after rule 14, the following rule shall be inserted, namely:- ―14(A). Restriction on import and transport of ISO tank containers- (1) No person shall import any ISO tank container filled or intended to be filled with petroleum without prior approval of from Chief Controller. (2) Any person seeking prior approval under sub-rule (1) shall submit to the Chief Controller- (a) a copy of valid licence issued in Form XV having adequate capacity to accommodate whole contents of the ISO tank container; (b) manufacturer‘s inspection and test reports of the ISO tank container duly endorsed by the competent authority of the country of origin; (c) a copy of periodic inspection and testing including hydrotest certificate and Container Safety Certificate (CSC) issued by competent authority of the country of origin; (d) two copies of design drawing showing the design details of the ISO tank container, water capacity of the tank, its fittings and particulars of specifications of the materials used in construction thereof duly endorsed by competent authority of the country of origin; (e) Consent from the Port of import for handling of ISO tank container (f) three copies of approved detailed vehicle mounting drawing for transportation by road duly approved by the Chief Controller (g) Safe operating procedure for handling and transportation of the ISO tank container from the port of import to the end use location (h) Scrutiny fees as specified in Part C of the First Schedule.‖; (6) in rule 19,- (a) in sub-rule (1), in clause (a), the word ―and‖ shall be omitted; (b) in sub-rule (1), after clause (b), the following clause shall be inserted, namely:- ―(c) Approval of design drawing of the ISO tank container Chief Controller issued under rule 14(A), in case of import and transport of petroleum in ISO tank container;‖; (7) In Chapter II, after Part III, the following Part shall be inserted namely;18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] ―PART IV IMPORTATION BY AIR 27(A) Restriction on import by air: (1) No petroleum shall be imported by air except at the airports authorized for this purpose by the Central Government from time to time. (2) Any petroleum not permitted by International Air Transport Authority regulations or by the Director General of Civil Aviation, shall not be imported by air. (3) Any person intending to import petroleum by air shall obtain landing permit from the Director General of Civil Aviation. (4) Any person holding a license for import and storage of petroleum or his authorized agent shall give declaration well in advance before bringing the petroleum into the airport to the Officer in charge of the airport and to the Commissioner of Customs giving full particulars of the petroleum intended to be imported. (5) Proper arrangements shall be made by the importer to take direct delivery of the imported petroleum and remove the same as expeditiously as possible from the airport. 27(B) Declaration and certificate to be furnished and licence to be produced before importing petroleum by air. - Every person desiring to import petroleum by air shall furnish to the Commissioner of Customs:- (a) a declaration in Form I signed by him or his agent; (b) a certificate of storage accommodation in Form II signed by him or his agent; (c) an authenticated copy of the licence held for the importation and storage of such petroleum; (d) a landing permit from the Director General of Civil Aviation in case, of petroleum is imported by air and; (e) a consent letter from respective flight operator for transportation of petroleum by air; Provided that nothing in this rule shall apply to the importation of petroleum exempted under sections 7, 8 and 9 of the Act: Provided further that the furnishing of licence under clause (c) shall not be necessary for the importation of petroleum class C, in bulk, in quantity exempted under section 7 of the Act. 27(C) Permission of the Commissioner of Customs to unload petroleum. – (1) No petroleum shall be unloaded except with the permission of the Commissioner of Customs. (2) If the Commissioner of customs, after receiving:- (a) the testing officer‘s report on the Petroleum; (b) the certificate in Form II, if required by rule 27(B); (c) the licence, if required by rule 27(B); and after making such further inquiries as he deems necessary, is satisfied that the petroleum can be lawfully imported and that there is suitable accommodation for it, he shall permit it to be unloaded; (d) landing permit from the Director General of Civil Aviation, if required by rule 27(B), (e) consent letter from respective flight operator for transportation of petroleum by air. (3) If the Commissioner of Customs is satisfied that any petroleum imported is not intended to be stored in India but is intended to be dispatched immediately after unloading to any place outside India, he may waive the requirements of rules 27(B) and by written order permit, subject to such conditions as he may specify, such petroleum to be unloaded for the purpose of immediate dispatch to that place. (4) Nothing in this rule shall affect the power of the Commissioner of Customs to detain petroleum under any other law or rule for the time being in force‖. (8) in rule 32,- (a) after the word ―vessel‖, the words ―, ISO tank container‖ shall be inserted; (b) In the Explanation, after the words ―Chief Controller‖ the words ―or TPIA‖ shall be inserted.[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 19 (9) in rule 70, in sub-rule (1), after clause (iii), the following clause shall be inserted, namely:- ―Provided that nothing in clause (ii) and (iii) of this rule shall apply to the vehicle with engines of type BS- IV or upgraded version as specified by Road Transport Authority from time to time;‖; (10) in rule 75,- (a) in sub-rule (1), after the word ―licence ‖, the words ―or permission‖ shall be inserted; (b) after sub-rule (2), the following sub-rule shall be inserted, namely:- ―(3) Permission shall be obtained from Chief Controller/ Controller for transportation by road for every consignment of the ISO tank container. Such permission shall remain valid for six months from the date of issue; (4) (a) Person desiring permission is for a ISO tank container under sub-rule (3) shall submit the following to the Chief Controller/ Controller:- (i) Application in form VII A, (ii) a scrutiny fee as specified in Part C of the First Schedule, (b) The Chief Controller, after receipt of the documents under sub-rule (a) and after making such further inquiries as he deems necessary, is satisfied that the vehicle meets with the requirements laid down in these rules, he shall issue a permission to the applicant with one copy of drawing duly endorsed.‖; (11) in rule 76, in sub-rule (3), after the words and figures ―(22 of 1934)‖, the words and figures ―and on site refuelling of heavy vehicles/machineries/stationary equipments by vehicles licensed under Form XIX of these rules‖ shall be inserted; (12) In rule 77, after the words ―re-tested―, the words ―by a competent person or TPIA‖ shall be inserted; (13) in rule 85, – (a) in sub–rule (1), for the words ―competent responsible person‖, the words ―competent person or TPIA‖ shall be substituted; (b) after sub-rule (4), the following shall be inserted, namely:- ―(5) The ISO tank container framework and/ or the ISO tank container shall be tested after each repair in the manner laid down in the code of fabrication. Explanation: For the purpose of this rule, it is clarified that with regard to inspection, repair, alteration & re-construction of tanks, the OISD Standards and/or API Standards, as applicable, shall be followed.‖ (14) in rule 89, after sub-rule (2), the following sub-rule shall be inserted, namely:- ―(3) On receipt of the drawings and fee under sub-rule (2) and after eliciting such additional information as may be required, the Chief Controller shall, if he is satisfied, approve the proposed pipeline subject to such conditions as deemed fit.‖; (15) in rule 90, in sub-rule (1), after the word ―steel‖, the words ―or any other suitable materials approved by the Chief Controller‖ shall be inserted; (16) in rule 93, after sub-rule (2), the following sub-rule shall be inserted, namely:- ―(2A) The hydrostatic testing of pipeline shall be carried out by a competent person or TPIA. (2B) The competent person or TPIA shall carry out the test as required under sub-rule (1) and issue a certificate; the certificate so issued shall be submitted to the Chief Controller.‖; (17) in rule 98, for the words ―involving cutting or re-welding‖, the words ―or hot work‖ shall be substituted; (18) in rule 106,- (a) in sub rule (1), after the figure ―60079-II‖, the words and figure ―IS/IEC 60079-26‖ shall be inserted; (b) in sub-rule (2), for clause (i), the following clause shall be substituted, namely:-20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] ―(i) a flameproof or pressurised type or powder filled or oil immersed or increased safety or intrinsically safe or encapsulated apparatus confirming to IS/IEC 60079-1, IS/IEC 60079-2, IS/IEC 60079-5, IS/IEC 60079- 6, IS/IEC 60079-7, IS/IEC 60079-11, IS/IEC 60079-18 and any other equivalent standard approved in writing by the Chief Controller, or‖; (c) in sub-rule (3) for clause (i), the following clause shall be substituted, namely:- ―(i) non-sparking apparatus conforming to IS/IEC 60079- 15 and of a type approved in writing by the Chief Controller; or‖; (d) after sub-rule (3), the following sub-rule shall be inserted, namely:- ―(4) The selection of Ex-Electrical Apparatus shall be as per equipment protection level (EPL) asdefined in IS 16724:2018/IEC60079-14 or IEC 60079-14 or any other equivalent standard accepted in writing by the Chief Controller.‖; (19) in rule 107, after sub-clause (5), the following Explanation shall be inserted, namely:- ―Explanation: For the purposes of this rule, it is clarified that with regard to the Fixed Electric wiring, the OISD Standards as applicable shall be followed.‖ (20) in rule 108, after sub-clause (5) following Explanation shall be inserted, namely:- ―Explanation: For the purposes of this rule, it is clarified that with regard to earthing and bonding, the OISD Standards as applicable shall be followed.‖ (21) in rule 114, for the word ― person‖, the words ―electrical / instrumentation engineer‖ shall be substituted; (22) in rule 117, in sub-rule (4), in clause (ii), after the words and figure ―OISD Standard-117‖, the words ―or OISD Standard - 244‖ shall be inserted; and after the word and figure ―OISD-117‖, the word and figure ―and OISD-244‖ shall be inserted; (23) after rule 118, the following Explanation shall be inserted, namely:- ―Explanation: It is clarified that with regard to the safety training, the OISD Standards as applicable shall be followed.‖ (24) in rule 120, after sub-clause (5), the following Explanation shall be inserted, namely:- ―Explanation: For the purposes of this rule, it is clarified that with regard to drainage, the OISD Standards as applicable shall be followed.‖ (25) in rule 124, in sub-rule(1), after the words and figure ―API:650‖, the words and figure ―or API:620‖ shall be inserted; (26) in rule 126,- (a) in sub-rule (1), after the words ―competent person‖, the words ―or TPIA‖ shall be inserted; (b) in sub-rule (3), after the words ―competent person‖, the words ―or TPIA‖ shall be inserted; (c) in sub –rule(4), for the Proforma of Certificate of Tank Testing, the following Proforma shall be substituted, namely:- ―Proforma of Certificate of Tank Testing [See Rule 126] Tank identification Diameter in Height or length Construction Type of tank Test date No. meter in meter standard[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 21 In respect of the above tanks, installed within the installation service station of ……………………………… (delete words not applicable) (full name of occupier of installation/service station as the case may be)…………………………………. at……… …… ……………… (Name of place, police Station, District State) covered by licence No. …………………………………. (d) after sub-rule (4), the following sub-rule shall be inserted, namely:- ―(5) Storage tanks or other receptacles for the storage of petroleum-in bulk, in a service station shall be tested by water pressure by a competent person or TPIA once in 7 years in addition to the tests carried out in sub-rule(1).‖; (27) in rule 127, after sub-clause (3), the following Explanation shall be inserted, namely:- ―Explanation: For the purposes of this rule, it is clarified that the OISD Standards as applicable shall be followed.‖ (28) in rule 130,- (a) in sub-rule (1), after the words ―competent person‖, the words ― or TPIA‖ shall be inserted; (b) after sub-rule (1b), in the Proforma Certificate of Safety, after the words ―competent person‖, the words ―or TPIA‖ shall be inserted; (c) in sub-rule (2), in clause(i):- (i) after the words ―competent person‖, the words ― or TPIA‖ shall be inserted; (ii) after clause (b), the following clause shall be inserted, namely:- ―(c) The recognition shall be granted for a period of five years and may be renewed for every three years based on the performance report and submission of the medical fitness certificate by a registered medical practioner recognized by Medical Council of India, till the competent person or TPIA attains the age of 65 years. The recognition of competent person or TPIA shall stand cancelled on attaining the age of 65 years.‖ (29) In rule 143,- (a) for sub-rule (2), the following clause shall be substituted, namely:- ―(2) An application for the grant of licence to transport petroleum in bulk by road in mechanically propelled vehicles shall be in Form VII and to transport petroleum Class A/B in bulk on land for onsite fuelling of aircrafts, heavy vehicles/ machineries and stationary equipments by a mechanically propelled vehicle viz. refueller shall be in Form VIII; provided that the license shall be deemed to have been granted if no decision is taken by the Chief Controller within 30 days of receipt of such an application‖. (b) after sub-rule (2), the following clause shall be inserted, namely:- ―(3) An Application for licence to import and store petroleum shall be in Form IX and to decant Kerosene (Petroleum Class B) from mechanically propelled vehicles in containers shall be in Form X.‖22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (30) In rule 144:- (a) for sub–rule(5), the following shall be substituted, namely :- ―(5) The District Authority shall complete the enquiry for issuing NO OBJECTION CERTIFICATE (NOC) under sub –rule (1) and shall complete the action for issue or refusal of the NOC, as the case may be, in accordance with the following: (i) The enquiry for issuing the NOC shall be completed in accordance with the Proforma as laid down under sub –rule (7) within a period of 60 days from the receipt of such application by the District Authority. Further, depending upon the site, the District Authority shall also ensure that the reference for making such enquiry is not sent to the authorities which are not relevant to the site concerned. (ii) A copy of all the correspondences between the District Authority and authorities pertinent thereto; as prescribed under clause (1) of the said Proforma shall also be marked to the applicant; (iii) If no response is received within the said period of 60 days from the particular authority/ agency by the District Authority, it shall be deemed that such particular authority / agency has ‗NO OBJECTION‘ to the said application; (iv) After the expiry of the aforesaid period of 60 days or upon receipt of the response from the authorities pertinent thereto as prescribed under clause (1) of the Proforma as laid down under sub –rule (7), whichever is earlier, the District Authority shall complete the action for issue or refusal of the NOC, as the case may be, within a period of 30 days; provided that the NOC by the District Authority shall be deemed to have been granted after the expiry of said period of 30 days if the District Authority has received the ‗NO OBJECTIONS‗ from the said authorities.‖ (b) after sub–rule (6), the following sub –rule shall be inserted, namely: ―(6a) There shall be no requirement of ―No Objection Certificate‖ from District Authority under sub –rule (1) for a licence in Form XIV forming a part of the CNG station licensed in Form ―G‖ under Gas Cylinder Rules , 2016 or LNG station licensed in Form ―LS-1C‖ under Static and Mobile Pressure Vessels ( U) Rules 2016.‖ (c) In sub-rule(7), for the Proforma No Objection Certificate, the following Proforma shall be substituted, namely:- ―Proforma No Objection Certificate [See rule 144] No……………. (1) The following particulars have been considered while issuing this no objection certificate, that- (a) comments from the revenue department on the issue whether the possession of the site by the applicant is lawful and there is an authorisation from land owner or lease holder for developing premises under these rules for storage of petroleum products; (b) comments from the police department regarding traffic density and impact on traffic; (c) comments from the local area development authority regarding conformity of proposal to the local area development planning;[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 23 (d) comments from the NHAI/ PWD or any other authority concerned regarding road safety, road alignment and road access conformity. Signature of the district authority issuing no objection certificate with his office seal (in towns having a Commissioner of Police, the Commissioner or a Deputy Commissioner of Police and for any other place the District Magistrate) Note.- The licensing authority shall accept the no objection certificate within a period of three years from the date of its issue for considering grant of licence.‖. (31) in rule 146, in sub-rule (2), for clause (ii), the following clause shall be substituted, namely:- ―(ii) a fee as specified in Part C of the FIRST SCHEDULE for scrutiny of the proposed alteration.‖ (32) in rule 148, in sub-rule (9), for the word ―including‖, the word ―except‖ shall be substituted; (33) in rule 156, after sub-rule (3), the following Explanation shall be inserted, namely:- ―Explanation: For the purpose of this clause, it is clarified that the licensing authority shall decide upon the said application within 30 days of receipt, failing which, the license shall be deemed to have been so transferred.‖ (34) in rule 157:- (a) after proviso to sub-rule (1), the following Explanation shall be inserted, namely:- ―Explanation:- Under this clause, the license shall be deemed to have been automatically transferred for the remaining license period to the said person carrying on the business of such licensee, subject to an application made by such person within 1 year of such event when the said licensee dies or becomes insolvent or mentally incapable or is otherwise disabled‖. Consent from the Port of import for handling of ISO tank container 7. approved detailed vehicle mounting drawing for transportation by road duly approved by the Chief Controller 8. Safe operating procedure for handling and transportation of the ISO tank container from the port of import to the end use location.‖; (e) In Form VIII; for the words and figures ―PART II‖, the words ―Part B‖ shall be substituted; and for the words ―recognized engineer‖, the words ―competent person or TPIA‖ shall be substituted. (f) in Form XIV,- (i) in condition 5, after the words " another tank ", the words and figures, " except with the previous sanction in writing of the licensing authority " shall be inserted; (h) in Form XIX, for item (b), the following item shall be substituted, namely:- ―(b) PETROLEUM CLASS B FOR ON SITE REFUELLING OF HEAVY VEHICLES/HEAVY MACHINERIES/STATIONARY EQUIPMENTS.‖; (i) for the Form XX, the following form shall be substituted, namely:-28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] ―FORM XX [See rules 2(v) and 130] A. Physically fit and mentally sound for carrying out tests and examination 3 Rule 93 1. Degree in chemical or Mechanical Minimum experience of 5 years in or Metallurgy engineering from a testing, fabrication or installation, recognized university or equivalent maintenance of petroleum or professional qualifications liquefied petroleum gases or Natural Gas pipelines.‖ 2. Physically fit and mentally sound for carrying out tests and examination. (38) in the Third Schedule:- (a) in Sl. No. 11, the words ―, but, fusible vents shall not be provided on tanks of capacity 25 Kilolitres and above‖ shall be omitted; (b) after Sl. No. 15 the following shall be inserted, namely:- ―16. Tank vehicle for ISO tank containers: (1) ISO Tank container for petroleum exceeding 1,000 litres in capacity, associated piping, fittings and the framework suitable for carriage of liquid petroleum shall conform to design, specifications and testing and marking as per national or international standards accepted by the Chief Controller. (2) ISO Tank container framework including the ISO tank mountings, end structure and all load bearing elements not present for the purposes of containing cargo, which transmit static and dynamic forces arising out of lifting, handling, securement and transporting of the ISO tank container as a whole and conforms to design, specifications and testing as per national or international standards accepted by the Chief Controller. (3) No compartment or baffle partition is necessary if the capacity of the ISO Tank container for transportation of petroleum is not exceeding 7.5 kiloliters (4) ISO Tank containers exceeding 7.5kilo liters capacity, shall be divided into compartments by baffle partitions and no compartment shall have net capacity exceeding 7.5 kiloliters.[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 29 (5) The maximum capacity shall be restricted corresponding to gross vehicle weight certified by RTO (6) The maximum capacity of such ISO tank container shall not exceed 26 kilo litres (7) The ISO tank container if filled above 20% but less than 80%, shall not be offered for carriage unless the shell is divided into 7.5 kilolitres capacity by baffle partition or surge plate.
