L.-33004/99 xxxGIDHxxx सी.जी.-डी.एxलx.x-GअID.-E1x8xx0 32021-225972 CG-DL-E-18032021-225972 असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (i) PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 141] नई ददल्ली, मगं लवार, माच ग16, 2021/फाल्ग ना 25, 1942 No. 141] NEW DELHI, TUESDAY, MARCH 16, 2021/PHALGUNA 25, 1942 सड़क पररवहन और राजमाग गमत्रं ालय अजधसचू ना नई ददल्ली, 15 माच,ग 2021 190(अ).—मोटर यान (वाहन स्ट्र ैपिंग सपग साजवधा का पंजीकरण और कायग) जनयम, 2021, जजनमें केंद्र सरकार मोटर यान अजधजनयम, 1988 (1988 का 59) की धारा 59(4) के द्वारा प्रदत्त िजियों का प्रयोग करन े का प्रस्ट्ताव करती ह,ै के जनम्नजलजखत प्रारूप कजतपय जनयमों को इस अजधजनयम की धारा 212 की उप- धारा (1) के द्वारा यथावश्यक इसके द्वारा प्रभाजवत होन े की संभावना वाल े सभी व्यजियों की जानकारी के जलए एतदद्व् ारा प्रकाजित दकया जाता ह;ै और एतदद्व् ारा नोरटस ददया जाता ह ै दक प्रारूप जनयमों को उस तारीख स े तीस ददन की अवजध समाप्त होने के बाद जवचाराथग स्ट्वीकार कर जलया जाएगा जजसको सरकारी राजपत्र में यथा- प्रकाजित इस अजधसूचना की प्रजतयां जनता के जलए उपलब्ध करायी जाती ह;ैं इन प्रारूप जनयमों के बारे में आक्षेपों एवं सझा ावों, यदद कोई हो, को संयाि सजचव (पररवहन), comments-morth@gov.in, सड़क पररवहन और राजमाग ग मंत्रालय, 1 पररवहन भवन, संसद माग,ग नई ददल्ली-110001 कोभेजे जा सकेंगे। 1635 GI/2021 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] जवजनर्ददष्ट अवजध समाप्त होने के पहले उक् त प्रारूप जनयमों के संबंध में दकसी भी व्यजि स े प्राप्त होने वाली आपजत्तयों या साझावों पर केंद्र सरकार द्वारा जवचार दकया जाएगा। प्रारूप जनयम मोटर वाहन अजधजनयम, 1988 की धारा 59 (4) के तहत प्रदत्त िजियों का उपयोग करते हुए, केंद्र सरकार एतदद्व् ारा जनम्नजलजखत जनयम बनाती ह,ै जैसे: - सजं क्षप्त िीर्कग और प्रारंभ- (1) इन जनयमों को मोटर वाहन (वाहन स्ट्र ैपिंग सपग सजा वधा का पजं ीकरण और काय)ग जनयम, 2021 कहा जा सकता ह।ै (2) व े आजधकाररक राजपत्र में अपने अंजतम प्रकािन की तारीख स े लाग ू होंग े 2. अनप्रा योग ये प्रावधान पंजीकृत वाहन स्ट्रेपिंग सपग साजवधा (आरवीएसएफ) की स्ट्थापना, प्राजधकरण और पररचालन के जलए प्रदरयाओं को जनधागररत करेगा। ये सभी वाहनों और उनके अंजतम पंजीकृत माजलकों, ऑटोमोबाइल संग्रहण केंद्रों, ऑटोमोरटव जवखंडन, स्ट्रेपिंग सपग और ररसाइकपिंग सलग साजवधाओं एवं सभी प्रकार के ऑटोमोरटव अपजिष्ट उत्पादों के ररसाइकल करन े वालों पर लाग ू होगा। 3. पररभार्ाए ँ : - इन जनयमों म,ें जब तक दक संदभ ग से अन्यथा अपेजक्षत न हो - क. "अजधजनयम" का तात् पयग मोटर वाहन अजधजनयम, 1988 ह।ै ख. "पंजीकृत स्ट्रैपर" से अजभप्रेत ह ै दक कोई व्यजि, फम,ग संस्ट्थ ा, रस्ट्ट या ऐसी कंपनी जो कोई पंजीकृत वाहन स्ट्रैपिंग सपग साजवधा (यहा इसके बाद इसे "आरवीएसएफ" के रूप में जाना जाएगा) का माजलक हो और इस े संचाजलत करता हो। ग. "पंजीकृत वाहन स्ट्रेपिंग सपग साजवधा (आरवीएसएफ)" से अजभप्रेत ह ै दक दकसी स्ट्थ ापना जो ‘वाहन स्ट्र ेपिंग सपग के जलए एक पंजीकरण’ रखता ह,ै जजसे इस अध्याय के तहत जवखंडन और स्ट्र ैपिंग सपग कायग के जलए जारी दकया गया ह।ै घ. "सर्टटदफकेट ऑफ जडपॉजजट" से अजभप्रेत ह ै दक आगे के ररटमेंट के जलए पंजीकृत माजलक से पंजीकृत स्ट्र ेपर को वाहन के स्ट्व ाजमत्व के हस्ट्तांतरण को मान् यता प्रदान करन े के जलए आरवीएसएफ द्वारा जारी प्रमाण-पत्र। ङ. "वाहन स्ट्रैपिंग सपग प्रमाण पत्र" स े अजभप्रेत ह ै दक दकसी आरवीएसएफ के द्वारा जारी प्रमाण पत्र दकसी वाहन को अंजतम रूप से जनस्ट्त ारण को मान् यता प्रदान करना। च. "ऐंड ऑफ लाइफ - वाहन (ईएलवी)" का संदभग उन सभी वाहनों स े ह ैं जो अब वधै रूप स े पंजीकृत नहीं रह गए ह;ैं अथवा जजन् ह ें स्ट्वचाजलत दफटनेस केंद्रों के माध्यम से अयोग्य घोजर्त दकया गया; अथवा जजनका पंजीकरण इस अजधजनयम के अध्याय IV के अंतगगत अथवा दकसी न् याजयक आदिे के कारण; अथवा जवजध सम् मत पंजीकृत वाहन माजलक द्वारा दकसी भी पररजस्ट्थजत आग, क्षजत, प्राकृजतक[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 3 आपदा, दगं ों या दघा गटना इत्य ादद के कारण खराब वाहन के रूप में स्ट्व-घोजर्त दकया गया हो, के अंतगगत रद्द दकया गया हो; छ. "अंजतम जनस्ट्त ारण" का संदभ ग वाहन का इस प्रकार प्रिोधन करना ह ै जजससे दक वाहन अब इस रूप में उपयोग करने में सक्षम न हो, जजसके जलए सीपीसीबी ददिाजनदिे ों के अनसा ार चेजसस का कट आउट और इसके इंजन का जनपटान कासाक्ष्य रखना ह।ै ज. " पंजीकरण प्राजधकरण" से अजभप्रेत ह ै दक आयाि (पररवहन) या इस उद्दश्े य के जलए राज्य / केन्द्र िाजसत प्रदिे सरकार द्वारा नाजमत कोई अन्य अजधकारी। झ. "ररसाइकपिंग सलग" से अजभप्रेत ह ै दक मूल उद्दश्े य के जलए या अन्य उद्दश्े यों के जलए अपजिष्ट पदाथों की उत्पादन प्रदरया म ें पानसरं मण लेदकन ऊजाग की वसूली को छोड़कर। ञ. "ऐंड ऑफ लाइफ के पंजीकृत माजलक" से अजभप्रेत ह:ै - i. वह व्यजि जजसके नाम पर वाहन औपचाररक रूप स े नेिनल रजजस्ट्टर फॉर व्हीकल्स (वाहन) या राज्य / राज्य पररवहन जवभाग के ररकॉड ग में पंजीकृत ह;ै या ii. दस्ट्तावेजी साक्ष्य द्वारा समर्थथत ऐसे व्यजि के अजधकृत प्रजतजनजध; या iii. कोई व्यजि जजस े सीएमवीआर के जनयम 57 के अनसा ार दकसी सावगजजनक नीलामी म ें वाहन का स्ट्वाजमत्व जमल गया हो; iv. कोई व् यजक्त जजस े सीएमवीआर के जनयम 56 के अनारूप वाहन जवरासत में जमला हो; या v. दकसी मोटर वाहन के संबंध में, जो उस अनाबंध के तहत वाहन के कब्जे वाल े व्यजि को दकराए पर लेन,े समझौते, या पट्टे के समझौते या हाइपोथीकेिन के समझौते का जवर्य ह;ै ट. "जनयम" से अजभप्रेत ह ै दक केंद्रीय मोटर वाहन जनयम (सीएमवीआर) और राज्य जवजिष्ट मोटर वाहन जवजनयमन (राज्य एमवीआर)। ठ. "स्ट्रैपिंग सपग" से अजभप्रेत ह,ै 'ईएलवी' की प्राजप्त और ररकॉड ग से पूरी प्रदरया जजसमें जडपॉल् यूटिटग, जनस्ट्त ारण, सामग्री का अलगाव, गैर-पान: प्रयोज्य भागों का सारजक्षत जनपटान और मोटर वाहन के पंजीकृत माजलक को 'वाहन स्ट्रैपिंग सपग का प्रमाण पत्र' जारी करना िाजमल ह।ै ड. "स्ट्रैपिंग सपग याड"ग से अजभप्रेत ह,ै आरएसएफ के पररसर के भीतर जनधागररत स्ट्थ ान, जहां जवखंजडत वाहन भागों को ररसाइकपिंग सलग सजहत आगे के साधार के जलए संसाजधत दकया जाता ह।ै ढ. "प्रिोधन" से अजभप्रेत ह,ै ऐंड ऑफ व् हीकल लाइफ के बाद दकसी भी गजतजवजध को आरडब्ल्यूएफ के संग्रहण केंद्र म ें जडपॉल् यूिन, जनस्ट्त ारण, जसयटिरग, कतगन, काटे हुए रद्दी के जनस्ट्त ारण के जलए तैयारी ररकवरी अथवा जनस्ट्त ारण के जलए तैयार करना और या ऐंड ऑफ लाइफ व् हीकल के और इसके घटकों की ररकवरी के जलए कोई अन्य कायग दकया गया हो; ण. "वाहन" से अजभप्रेत कोई मोटर वाहन जैसा दक इसे अजधजनयम में पररभाजर्त दकया गया हो;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 4. आरवीएसएफ की िजिया ं और दाजयत्व (1) आरवीएसएफ को पासवड ग संरजक्षत प्रयोक्त ा आईडी के साथ वाहन पंजीकरण के वाहन डटे ाबेस तक कनेजक्टजवटी और पहुचं प्रदान की जाएगी और वाहन के स्ट्रैपिंग सपग और सर्टटदफकेट ऑफ जडपॉजजट और सर्टटदफकेट ऑफ स्ट्कैपिंग सपग जारी करने स े संबंजधत उपयाि प्रजवजष्टयां करने के जलए सीधे या उनके संग्रहण केंद्रों के माध् यम से अजधकृत दकया जाएगा। (2) आरवीएसएफ के पास वाहन डटे ाबेस तक सरा जक्षत पहुचँ के जलए आईटी जसस्ट्टम हते ा आवश्यक साइबर सारक्षा प्रमाणपत्र होना चाजहए। (3) आरवीएसएफ को स्ट्थानीय पाजलस के साथ एनसीआरबी द्वारा रखे गए चाराए वाहनों के डटे ाबेस के साथ स्ट्रैपिंग सपग के जलए उत्पाददत वाहनों के ररकॉड ग को सत्याजपत करन े के जलए आवश्यक कनेजक्टजवटी प्रदान की जाएगी। वाहन को स्ट्रैप करने से पहले आरवीएसएफ की ओर से इस तरह का सत्यापन करना अजनवायग होगा। (4) आरवीएसएफ वाहन माजलक को सौंपने वाल े व्यजियों का सत्यापन करने के जलए वाहन माजलक या उसके प्राजधकृत प्रजतजनजध के प्रामाजणक होना जनधागररत करन े और 6 महीने की न्यूनतम अवजध के जलए ररकॉड ग की एक प्रजत बनाए रखने का काय ग करेगा। 5. आरवीएसएफ के जलए पात्रता की ित ें राज्य सरकार / केंद्र िाजसत प्रदिे सरकार खंड 6 के तहत आवेदन करने वाल े दकसी भी आरवीएसएफ को प्राजधकरण प्रदान करत े समय नीचे दी गई पात्रता मानदडं ों को ध्यान में रखेगी : क. आरवीएसएफ दकसी भी कानूनी इकाई द्वारा स्ट्वाजमत्व और सचं ाजलत दकया जा सकता ह,ै यह लाग ू कानूनों के अनसा ार स्ट्थाजपत एक व्यजि, फम,ग संस्ट्थ ा या रस्ट्ट हो। ख. इकाई में जनम्नजलजखत दस्ट्तावेज होने चाजहए: - (i) जनगमन का प्रमाण पत्र (ii) वैध जीएसटी पंजीकरण (iii) वैध पैन ग. इसके अजतररि, इकाई: - (i) ने राज् य अथवा संघ राज् य सरकार जहां आरवीएसएफ स्ट्थ ाजपत करने का इरादा हो, के सक्षम प्राजधकारी स े इसकी स्ट् थापना के जलए सहमजत हते ा अनामोदन जलया हो अथवा इसके जलए आवेदन दकया हो। (ii) केंद्रीय प्रदर्ू ण जनयंत्रण बोड ग के ददिा जनदिे ों के अनासार संग्रहण और जनस्ट्त ारण केंद्रों के जलए न्यूनतम तकनीकी आवश्यकता को पूरा करती हो।[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 5 (iii) के पास एक सारजक्षत और पयागवरणीय रूप से जजम्मेदार तरीके से जडपॉल् यूिन और जनस्ट्त ारण गजतजवजधयों को करने के जलए सक्षम जनिजि और उपयाि उपकरण होना चाजहए। (iv) पररचालन िारू होने के 12 महीनों के भीतर आईएसओ 9001 (गाणवत्ता प्रबंधन प्रणाली) / आईएसओ 14001 (पयागवरण प्रमाणीकरण) / आईएसओ 45001 (व्यावसाजयक स्ट्वास्ट््य और सरा क्षा) के आवश्यक गाणवत्ता प्रमाणपत्र प्राप्त करने का कायग करेगा। (v) के पास होना चाजहए अथवा इसे प्राप्त करने के जलए अंडरटेिंकग प्रदान करना,राज्य प्रदर्ू ण जनयंत्रण बोड ग से इसे चलाने के जलए सहमजत, जो कायग करने के िारूआत से छह महीने की अवजध के भीतर का हो। (vi) को सभी अनाप्रयोज् य ्रमम कानूनों और यथा अनाप्रयोज् य अन् य सभी अजधजनयमों / जनयमों के प्रावधानों का पालन करन े के जलए अनापालन करना चाजहए। (vii) राज्य / संघ राज् य क्षेत्र के ऑरेंज ्रमेणी के औद्योजगक क्षेत्र में भूजम के पयागप्त उपयोग योग्य क्षेत्रफल की उपलब्धता, स्ट्वाजमत्वया बेचने के समझौते या न्यूनतम तीन वर्ग की अवजध के जलए पट्टे के जररए का प्रमाण प्रदान करेगी। (viii) के पास खंड 4 (2) के अनासार आवश्यक साइबर सारक्षा प्रमाणपत्र होना चाजहए। (ix) अनामोददत प्लांट लेआउट और जबपिंग सल्डग प्लान प्रदान करना चाजहए। 6. आरवीएसएफ के जलए पंजीकरण प्रदरया (1) आवेदक जनधागररत फाम ग 1, या दकसी अन्य रूप में जैसा दक राज् य अथवा केंद्र िाजसत प्रदिे सरकार के मान् यताप्राप्त पंजीकरण प्राजधकारी द्वारा जनधागररत दकया गया हो और जो उस राज् य अथवा केंद्र िाजसत प्रदिे की सरकार को संबोजधत हो, जहां आरवीएसएफ स्ट्थ ाजपत दकया जाना ह,ै के साथ: (i) स्ट्थ ाजपत दकए जाने वाल े प्रस्ट्त ाजवत प्रत् येक आरवीएसएफ के जलए 1,00,000 / - रुपये (एक लाख केवल) की प्रोसेपिंग ससग फी, अथवा ऐसी फी जो इस उद्दश्े य के जलए राज् य अथवा केंद्र िाजसत प्रदिे सरकार द्वारा जनधागररत दकया गया हो। (ii) स्ट्थ ाजपत दकए जाने वाले प्रस्ट्त ाजवत प्रत् येक आरवीएसएफ के जलए 10,00,000 / - (दस लाख रुपये) की बैंक गारंटी के रूप म ें एक बयाना राजि जोराज्य अथवा केंद्र िाजसत प्रदिे सरकार द्वारा यथा अजधसूजचत अजधकृत पंजीकरण प्राजधकारी अथवा अजधकृत अजधकारी के पक्ष में हो और एक अवजध के जलए ब् याज रजहत प्रजतभूजत जमा, जो प्रारंजभक प्राजधकार की अवजध, प्ल स 90 ददन के वैधता के साथ सह-समाप्य हो। (2) पंजीकरण की स्ट्व ीकृजत के जलए सभी आवेदन पंजीकरण प्राजधकरण द्वारा आवेदन की तारीख स े 60 ददनों की अवजध के भीतर जनपटाए जाने ह।ैं (3) आवेदक, जजसे स्ट्वीकार कर जलया जाता ह,ै को फॉम-ग 1ए, अथवा ऐसा अन् य फॉम ग जो इस उद्दश्े य के जलए राज् य अथवा केंद्र िाजसत प्रदिे सरकार द्वारा जनधागररत दकया गया है, के रूप में पंजीकरण प्रमाणपत्र जारी दकया जाएगा।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (4) उन आवेदनकताओंग जजनके आवदने रद्द कर ददए जात े हैं, उन् ह ें उनका बयाना राजि / बैंक गारंटी वाजपस कर ददया जाएगा, हालांदक, प्रोसेपिंग ससग फी वाजपस नहीं दकया जाएगा। (5) राज् य अथवा केंद्र िाजसत प्रदिे सरकार स्ट्थ ाजयत् व, पयागप्त क्षमता और पयागवरण संरक्षण साजनजित करन े के जलए साजवधा के जलए अजतररि पात्रता आवश्यकताओं को अजधसूजचत कर सकते ह।ैं (6) भारत सरकार पिंग ससगल पिंग सवडो क्लीयरेंस जजस पर आवेदक सभी आवश्यक दस्ट्तावेजों और पंजीकरण के जलए आवश्यक िाल्क के साथ आवेदन करेगा,के जलए एक पोटगल का जवकास करेगी। राज् य या केंद्र िाजसत प्रदिे सरकार जवजभन् न एजेपिंग ससयों (्रमम, प्रदर्ू ण इत्य ादद) से आंतररक अनामोदन सजहत 60 ददनों के भीतर जनधागररत समय में प्रस्ट्त ाव को पास करेगी, ऐसे प्रस्ट्त ावों को प्रस्ट्त ात करन े के बाद ही प्रस्ट्त ाव को अनामोददत समझा जाएगा। ऐसे पोटगल को इन जनयमों की अजधसूचना की तारीख से 6 माह के भीतर संचाजलत दकया जाएगा। (7) खंड 6 में संदर्थभत पोटगल के संचालन के पश्च ात सभी उत् तरवतती अनामोदनों इत्य ादद को पोटगल के माध् यम से मंजूरी दी जानी चाजहए और आरवीएसएफ की जाचं और लेखा परीक्षा संबंधी ररपोटें पोटगल पर उपलब् ध कराई जानी चाजहए। ऐसे आरवीएसएफ की स्ट्थ ापना/संचालन के जलए राज् य प्रदर्ू ण जनयंत्रण बोड,ग ्रमम जवभाग और यथा-आवश् यक दकसी अन् य जवभाग द्वारा आवश् यक अनामोदन केवल इसी पोटगल के माध् यम से उपलब् ध कराए जाने चाजहए। (8) राज्य या केंद्र िाजसत प्रदिे सरकार पोटगल के काम-काज और ऐसे पोटगलों के अनामोदन की मंजरू ी के संदभग में नागररक चाटगर भी प्रकाजित करेंगे। यह प्रदरया पारदिती तथा सचा ारु होनी चाजहए और सभी अजधसूचनाए,ं ददिा-जनदिे , प्रपत्र इत्य ादद खंड 6 में स्ट्थ ाजपत पोटगल पर उपलब् ध कराए जाते ह ैं और आवेदन इलैक् रॉजनक माध् यम से दकए जाते ह ैं तथा इनका जनपटान भी जनधागररत समय में दकया जाता ह।ै 7. पजं ीकरण की वधै ता और नवीनीकरण (1) खण्ड 6 के तहत जारी दकया गया पंजीकरण 10 वर्ों की प्रारंजभक अवजध के जलए वैध होगा, जजसका एक बार 10 वर्ों के जलए और नवीनीकरण दकया जाएगा, जो इस ित ग के अधीन होगा दक पंजीकृत स्ट्रेपर इन प्रावधानों या खंड 14 में यथा-जवजनर्ददष्ट लागू कानून और अजधजनयम का दोर्ी नहीं ह।ै (2) नवीनीकरण के जलए आवेदन प्रपत्र-1 में या राज्य अथवा संघ राज् य क्षेत्र सरकार द्वारा जवजनर्दद्‍ ट दकए जाने वाले दकसी अन्य प्रारूप में दकया जाएगा। आवेदन के साथ राज्य या संघ राज् य क्षेत्र सरकार द्वारा इस उद्दश्े य के जलए जवजनर्ददष्ट नवीनीकरण िाल्क और प्रजतभूजत जमा दकया जाएगा। (3) पंजीकरण का नवीनीकरण प्रपत्र-1क के अनासार जारी दकया जाएगा। (4) इस जनयम के तहत जारी पंजीकरण हस्ट्तातं रणीय नहीं होगा। 8. वाहनों की स्ट्रैपिंग सपग के जलए मानदडं जनम्नजलजखत वाहनों को पंजीकृत स्ट्रेपर को स्ट्रैप करने के जलए पेि दकया जा सकता ह:ै[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 7 (i) जजन वाहनों न े सीएमवीआर, 1989 के जनयम 52 के अनसा ार पंजीकरण प्रमाणपत्र का नवीनीकरण नहीं दकया ह।ै (ii) जजन वाहनों को मोटर यान अजधजनयम, 1988 की धारा 62 के अनासार दफटनसे प्रमाणपत्र नहीं ददया गया ह।ै (iii) वाहन जो आग, दगं ा, प्राकृजतक आपदा, दघा गटना या दकसी आपदा के कारण क्षजतग्रस्ट्त हो गए ह,ैं जजसके बाद पंजीकृत स्ट्वामी स्ट्वयं उसे स्ट्रैप के रूप में प्रमाजणत करता ह।ै (iv) वाहन जो सरकार के केंद्रीय / राज्य संगठनों द्वारा अप्रचजलत या अजधिेर् या आर्थथक मरम्मत स े परे घोजर्त दकए गए ह ैं और स्ट्रैपिंग सपग के जलए पेि दकए गए ह।ैं (v) आरवीएसएफ सजहत दकसी भी एजसें ी द्वारा स्ट्रैपिंग सपग के जलए नीलामी में खरीद े गए वाहन। (vi) वाहन माजलक द्वारा स्ट्व-प्रमाजणत वाहन जो अपनी उपयोजगता व्यि करता ह ै अथवा जविेर् रूप स े खनन, राजमागग, जबजली, खेतों आदद में पररयोजनाओं के जलए आवेदन दकया गया हो। (vii) वाहन ओईएम द्वारा प्रमाजणत जवजनमागण अस्ट्वीकायग और परीक्षण वाहन। (viii) दकसी भी प्रवतगन एजेंसी द्वारा नीलाम दकए गए, जब्त दकए गए और छोड़ ददए गए वाहन। 9. जनरीक्षण का अजधकार (1) इस अध्याय म ें प्रावधानों के अनापालन को साजनजित करने के जलए पंजीकरण प्राजधकारी या राज्य अथवा संघ राज् य क्षेत्र सरकार के नाजमत अजधकारी द्वारा जनरीक्षण के जलए पंजीकृत स्ट्रेपर को आरवीएसएफ में वाहनों के लेनदने और स्ट्रैप जनरेिन के बारे में ररकॉड ग और अजधकृत ररसाइकलसग से इसका जजम्मेदार जनपटान और आरवीएसएफ पररसर में सभी मिीनरी, उपकरण और तत्रं तैयार रखना चाजहए। (2) वास्ट्तजवक जनरीक्षण और साइट का दौरा केवल तभी करना चाजहए: - (i) जब उपयाि प्राजधकारी द्वारा गैर अनापालना की ररपोटग अथवा पंजीकृत स्ट्रेपर के संबंध में पंजीकरण प्राजधकारी द्वारा जन जिकायत प्राप्त की गई ह।ै (ii) इस तरह की जिकायत को पंजीकृत स्ट्रेपर को 3 कायग ददवसों के भीतर जलजखत जवाब दाजखल करने के जलए भेज ददया गया ह।ै (iii) प्रजतदरया की जांच की गई ह ै और पंजीकृत स्ट्कैपर को तीन कायग ददवसों के भीतर और स्ट्पष्टीकरण प्रदान करने का अवसर प्रदान दकया गया ह।ै (iv) पंजीकरण प्राजधकारी की राय में प्रदान की गई प्रजतदरया और स्ट्पष्टीकरण अपयागप्त ह,ैं और साइट का एक जनरीक्षण आवश् यक ह।ै (v) इस तरह के साइट के दौरे को पंजीकरण प्राजधकारी या राज्य अथवा संघ राज् य क्षेत्र सरकार द्वारा नाजमत अजधकारी द्वारा याथोजचत अजधकृत दकया जाना चाजहए। (3) जनरीक्षण दल की ररपोटग को पंजीकरण प्राजधकारी अथवा नाजमत अजधकारी को आगे की प्रदरया के जलए प्रस्ट्तात दकया जाएगा और इसकी एक प्रजत पंजीकृत स्ट्रैपर को माहयै ा करायी जाएगी। (4) पंजीकृत स्ट्रेपर को अपना पक्ष रखने का अवसर प्रदान करने के बाद पंजीकरण प्राजधकारी साजवधा की प्राजधकृजत को रद्द करने या जनलंजबत करने का मौजखक आदिे पाररत कर सकता ह।ै8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] बिते दक सीपीसीबी के ददिाजनदिे ों के संबंध म ें दखे े गए उल्लंघनों को आवश्यक कारगवाई के जलए संबंजधत प्रदर्ू ण जनयंत्रण बोड ग को सूजचत दकया जाएगा। इस अवजध के दौरान पंजीकरण जनलंजबत रहगे ा, जबदक दकसी अन्य प्राजधकारी द्वारा साजवधा के जलए अपेजक्षत लाइसेंस / एनओसी / प्राजधकृजतयों को काननू के तहत वापस ल े जलया गया ह ै या जनलंजबत कर ददया गया ह।ै 10. स्ट्रैपिंग सपग प्रदरया (1) पंजीकृत स्ट्रैपर द्वारा जब्त दकये गए वाहन/छोड़ ददए गए वाहनों को छोड़कर सभी ईएलवी के संबंध में नीचे उजल्लजखत प्रदरया का पालन वाहनों की स्ट्रैपिंग सपग की जाएगी। (2) पंजीकृत माजलक या प्राजधकृत प्रजतजनजध वाहन को प्रपत्र-2 के अनसा ार आवेदन की दो मूल प्रजतयों के साथ पंजीकृत स्ट्रेपर या अजधकृत वाहन जमा/जनरूपण संग्रहण केंद्र को सौंपेंगे। (3) यदद वाहन का वैध पंजीकरण नहीं ह,ै तो पंजीकृत स्ट्रेपर या उसके जनर्ददष्ट केंद्र वाहन डटे ाबेस के अनासार पंजीकृत माजलक की पहचान का जमलान वाहन सौंपने वाल े व् यजि के साथ करेंगे और वाहन प्राप्त करेंगे तथा वाहन डटे ाबेस से जाड े जडजजटल प्ल ेटफॉम ग के माध् यम से रसीद जारी करेंगे। (4) प्रवतगन एजेंसी द्वारा जब्त दकये गए वाहनों को राज्य या संघ राज् य क्षेत्र सरकार द्वारा यथोजचत जवजनर्दद्‍ ट प्रदरया के अनासार पंजीकृत स्ट्रैपर को सौंपा जाएगा। (5) दकसी वाहन की स्ट्र ैपिंग सपग से पहले आरवीएसएफ की ओर से वाहन स्ट्रैपिंग सपग के जलए प्रस्ट्त ात दकए गए वाहनों के ररकॉड ग का सत् यापन एनसीआरबी के साथ ही स्ट्थानीय पाजलस द्वारा जब् त चोरी दकए वाहनों के डटे ाबेस के साथ करना अजनवाय ग होगा। (6) पंजीकृत स्ट्रेपर को माजलक या प्राजधकृत प्रजतजनजध स े प्रपत्र -2 के साथ जनम्नजलजखत लाग ू मूल दस्ट्तावेजों की आवश्यकता होगी: i. पंजीकरण का मूल प्रमाण पत्र। ii. पंजीकृत माजलक स े प्राजधकृजत। iii. उत्तराजधकार के मामले में, उत्तराजधकारी के दकसी भी प्रमाण के साथ पंजीकृत माजलक का मृत्य ा प्रमाण पत्र। iv. नीलामी करने के जलए अजधकृत व्यजि द्वारा यथोजचत हस्ट्त ाक्षररत अपने पक्ष में दकसी सावगजजनक नीलामी में वाहन की जबरी की पाजष्ट करने वाला प्रमाण पत्र या आदिे । v. माजलक/प्रजतजनजध से वचन लेना जो यह दिागता ह ै दक वाहन का कोई लंजबत आपराजधक ररकॉड ग या माकदमा नहीं ह।ै (7) यह सत्याजपत दकया जाना चाजहए दक अजधजनयम की धारा 51 की उप-धारा (2) के तहत आवश्यक मोटर वाहन के पंजीकरण प्रमाण पत्र में दकराया-खरीद, पट्टे या उपप्राधीयन समझौते का जवजधवत जनवगहन दकया गया ह।ै (8) पंजीकृत स्ट्रैपर द्वारा माजलक अथवा अजधकृत प्रजतजनजध के माध्यम से जनम्नजलजखत दस्ट्तावेजों की स्ट्व- प्रमाजणत प्रजतयां स्ट्वीकार की जायेगी। i. माजलक के पैन काड ग की प्रजत।[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 9 ii. माजलक के बैंक खात े का रॉस चेक। iii. प्राजधकृत प्रजतजनजध (यदद लाग ू हो) पहचान प्रमाण जैसे पासपोटग, मतदाता काड,ग आधार काड,ग ड्राइपिंग सवग लाइसेंस, राज्य/केंद्र सरकार संगठनों द्वारा जारी फोटो पहचान पत्र। iv. माजलक के पते का प्रमाण जैसे जबजली का जबल, पानी का जबल, लैंड लाइन टेलीफोन का जबल, पाइप् ड कािंकग गैस का जबल आदद। v. माजलक या पंजीकृत स्ट्रैपर को ईएलवी सौंपन े वाल े प्राजधकृत प्रजतजनजध की जडजजटल फोटो या प्रपत्र-2 में यथोजचत जचपकाया गया माजलक/प्रजतजनजध का फोटो और माजलक/प्रजतजनजध द्वारा प्रजत हस्ट्ताक्षररत। (9) पंजीकृत स्ट्रैपर जवजधवत् प्राप्त दकया गया दसू रा प्रपत्र-2 माजलक या उसके प्राजधकृत प्रजतजनजध को दगे ा और वाहन के स्ट्वाजमत्व के हस्ट्तातं रण के सबूत के रूप म ें जमा प्रमाणपत्र जारी करेगा। (10) दकसी राज्य में स्ट्थाजपत आरवीएसएफ दकसी भी पंजीकृत प्राजधकरण के अजधकार क्षेत्र में दकसी भी राज्य / संघ राज्य क्षेत्रों में पंजीकृत वाहनों को स्ट्वीकार और स्ट्रैप कर सकता ह।ै पूरी प्रदरया वाहन के साथ सचा ारू रूप से जाड़ी होगी और अजखल भारत के आधार पर दकसी भी वाहन पंजीकरण प्राजधकरण के अवस्ट्थान के जनरपेक्ष होगी। (11) ‘जमा प्रमाणपत्र’ माजलक के जलए एक नया वाहन खरीदने के जलए समय-समय पर लागू दकए गए प्रोत्साहन और लाभ प्राप्त करने के जलए आवश्यक और पयागप्त दस्ट्तावेज होगा। (12) ‘जमा प्रमाणपत्र’ व्यापार करने योग्य होगा और इसका एक बार उपयोग दकए जाने के बाद एजेंसी द्वारा उि प्रमाण पत्र धारक को लाभ प्रदान करते हुए इस े “जनरस्ट्त ” कर ददया जाएगा। इस संबंध में प्रजवजष्टयों का जमलान आरवीएसएफद्वारा वाहनपोटगल पर भी दकया जाएगा। (13) पंजीकृत स्ट्रेपर वाहन के जलए सहमत राजि का जडजजटल तरीके से या आदाता खाता चेक से भागतान करेगा और ररकॉड ग के जलए माजलक या प्राजधकृत प्रजतजनजध से उसकी एक रसीद प्राप्त करेगा। (14) खंड 11 के अनासार ‘वाहन स्ट्रेपिंग सपग प्रमाणपत्र’ के जारी होने की तारीख से छह महीने की अवजध तक चेजसस नंबर के कटे हुए टाकड़ े की सारजक्षत-अजभरक्षा की जजम्मेदारी पंजीकृत स्ट्रेपर की होगी। (15) पंजीकृत स्ट्रेपर को ररकॉड ग और जनरीक्षण के दौरान जांच के जलए पंजीकरण अजधकारी या आरवीएसएफ के नाजमत अजधकारी द्वारा प्रमाजणत सभी दस्ट्तावेजों की वास्ट्तजवक और कम्प्यूटरीकृत स्ट्कैन की गई प्रजत को समय समय पर यथा संिोजधत कंपनी अजधजनयम, 2013 द्वारा यथावश्य क अवजध तक अपन े पास रखना होगा। (16) पंजीकृत स्ट्रैपर साजनजित करेगा दक स्ट्र ैप दकए गए वाहन के खतरनाक पारजों को हटाने/रीसाइकल या जनपटान मौजूदा ददिाजनदिे ों के अनासार दकया गया हो। (17) ईंधन, तेल, एटं ीफ्रीज, और अन्य गैसों, तरल पदाथग आदद जनकालने और उन् ह ें प्रमाजणत मानक कंटेनरों म ें एकत्र न दकया जाए तब तक वाहनों को स्ट्रैप नहीं दकया जाएगा। (18) स्ट्रैप दकए गए वाहनों पर एक वार्थर्क ररपोटग प्रपत्र -3 में या राज्य अथवा संघ राज् य क्षेत्र के पररवहन जवभाग द्वारा जनर्दद्‍ टानासार प्रस्ट्तात की जायेगी। 11. वाहन स्ट्रैपिंग सपग का प्रमाण पत्र10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (1) पंजीकृत स्ट्रैपर, आवश्यक उपचार पूरा करने के बाद, नेिनल रजजस्ट्टर, वाहनडटे ाबेस को अपडटे करन े और अजभलेखों का अद्यतन करने के जलए सक्षम प्राजधकारी राज्य या संघ राज्यक्षेत्र सरकार को सूजचत करने के जलए फॉम-ग 4 में चेजसस के कट आउट की एक जडजजटल तस्ट्वीर सजहत एक जडजजटल 'वाहन स्ट्रैपिंग सपग प्रमाण पत्र' जारी करेगा। (2) केंद्र सरकार द्वारा स्ट्रैप्ड वाहनों का एक अलग ररकॉड ग वाहन डटे ाबेस में रखा जाएगा। (3) स्ट्रैप दकए गए वाहन स े प्राप्त, एक ईएलवी के दकसी भी भाग का पान: उपयोग / पानर्थवरय, जजसमें ईंजन या कोई भी पानर्थनर्थमत भाग िाजमल ह,ै समय-समय पर लाग ू नीजत / ददिाजनदिे ों / मानकों के अनसा ार होगी । 12. सीसीटीवी कैमरों की स्ट्थापना (1) पंजीकृत स्ट्रेपर ग्राहक और वाहन स्ट्वागत क्षेत्र में, स्ट्रैपिंग सपग याड ग में सीसीटीवी कैमरे स्ट्थाजपत करेगा। तीन कैलेंडर महीनों की अवजध के जलए पंजीकृत स्ट्रेपर के आईटी जसस्ट्टम में स्ट्रैपिंग सपग के ररकॉड ग को रखा जाना चाजहए । (2) साजवधा में लगाए गए सीसीटीवी कैमरों की पहुचं राज्य या संघ राज्य क्षेत्र द्वारा जनधारग रत प्राजधकृत एजेंजसयों को प्रदान की जा सकती ह।ै 13. स्ट्रैपिंग सपग याड ग (1) स्ट्रैप के बड़ े आकार और बहुत अजधक मात्रा को दखे ते हुए, वाहनों की आवाजाही के साथ-साथ वाहनों/ प्राप्त उत्पादों और प्राप्त पानयोग्य सामग्री के जलए भंडारण के जलए पयागप्त जगह वाले बड़ े क्षेत्र में जनराकरण साजवधा स्ट्थाजपत की जानी चाजहए। (2) जवदकरण को मापने के जलए साजवधा के साथ-साथ ईएलवी, व्हाईट वस्ट्ताओं और अन्य स्ट्रैप को संभालन,े प्रदर्ू ण रजहत करन े और जडसमेंटल करने के जलए एक पयागप्त दरवाजा लगे हुए क्षेत्र के मानदडं ों को पूरा करना चाजहए जैसा दक स्ट्रैप के आयात के जलए पालन दकया जाता ह।ै आरवीएसएफ को मानवीय हस्ट्तक्षेप को कम करने और सारजक्षत कायग स्ट्थल बनाने के जलए सामग्री संभालने वाली मिीनों स े जनपटने की आवश्यकता होगी। (3) यह साजनजित करने के जलए दक सारजक्षत संचालन प्रथाओं का पालन दकया जाता ह,ै संग्रहण केंद्रों से व्यवसाजयक स्ट्वास्ट््य और सारक्षा मानकों, आईएसओ 45001 (ओएचएसएएस) का पालन करने की उम्मीद की जाती ह।ै सभी सग्रं हण केंद्र सक्षम और प्रजिजक्षत जनिजि को उपयोगी जीवन रजहत, माल और अन्य स्ट्रैप की प्रदरया में लगाएगा। (4) संग्रहण केंद्रों में िा्‍क क्षेत्र (जल भराव स े माि), सारजक्षत काय ग स्ट्थलों के रखरखाव और प्रदर्ू ण को जनयंत्रण में रखन े के जलए अन्य सभी आवश्यक उपाय के जलए डामर / ठोस फि,ग डामर / कंरीट सड़कों, इन-हाऊस रखरखाव के जलए पयागप्त कायगिाला साजवधाओं, अजि सारक्षा प्रणाली आदद की तरह अभेद्य सतह होनी चाजहए ।[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 11 (5) संग्रहण केंद्रों को प्रदर्ू ण समाप्त करन े वाली प्रणाली, खासकर िून्य जडस्ट्चाजग प्रणाली के साथ, सासजित दकया जाएगा और जडसमेंटपिंग सलग कायग उपयोगी जीवन रजहत वाहनों, माल और अन्य स्ट्रैप के अंत का प्रसंस्ट्करण सबसे अच्छी उपलब्ध तकनीक का उपयोग करके दकया जाएगा। (6) संग्रहण केंद्र इस तरह के संचालन के जलए संबद्ध स्ट्वास्ट््य तथा सारक्षा कानून / जवजनयमन और एमओईएफएडं सीसी, सीपीसीबी और खतरनाक और अन्य अपजिष्ट पदाथग (प्रबंधन और सीमा पार आवागमन) जनयम, 2016 द्वारा जनधागररत पयागवरणीय मानदडं ों का अनापालन करेगा। (7) स्ट्रैपिंग सपग याड ग में जनम् नजलजखत होना चाजहए- क. अपजिष्ट वाहनों की पार्ककग के जलए उपयाि जनधागररत स्ट्थान। ये क्षेत्र गैर-पारगम्य कंरीट के होते ह ैं और पयागप्त जल जनकासी की साजवधा के साथ इपॉक्स ी कोटेड लोलोटिरग वाल े होत े ह।ैं कोई अपजिष्ट या संभाजवत अपजिष्ट वाहन सड़कों पर या सावगजजनक स्ट्थानों पर पाकग नहीं दकया जाना ह,ै यहां तक दक जमा करने के जलए आवेदनों के प्रदरया के दौरान भी और केवल आरवीएसएफ के पररसर के भीतर ही समायोजजत दकया जाना ह।ै ख. ईंधन, तरल पदाथ,ग गैसों और तरल पदाथों की जनकासी के दौरान प्रदर्ू कों के िून्य ररसाव को साजनजित करने के जलए प्रमाजणत प्रदर्ू ण समाप्त करन े वाले उपकरण, सारजक्षत न्यूरलाइजेिन / एयरबैग को हटाने, प्री- टेंिनर आदद के जलए प्रमाजणत ड-े ररपिंग सस्ट्कग उपकरण, पररभाजर्त गजतजवजधयों (जैसे डी-ररपिंग सस्ट्कग, प्रदर्ू ण समाप्त करने वाली, जवघटन, ्रमेपिंग सडग, िीयटिरग, बेपिंग सलग आदद) के जलए उपयाि जवघटन करने वाल े उपकरण, अलग-थलग स्ट्रैप के भंडारण के जलए नाजमत क्षेत्र, ऑटोमोरटव खतरनाक कचरे जैसे दक टायर, बैटरी, ईंधन, तेल, तरल पदाथग और गैसों के अस्ट्थायी भंडारण के जलए स्ट्पष्ट रूप से जनर्ददष्ट स्ट्थान, उपयाि सारक्षा और व्यावसाजयक स्ट्वास्ट््य उपकरण, पाजों, स्ट्रैप और अपजिष्ट उत्पादों के सारजक्षत पररवहन के जलए सामग्री संभालने वाल े उपकरण। ग. उपयाि औद्योजगक ग्रेड प्रकाि और वेंरटलेिन प्रणाली, ध्वजन प्रदर्ू ण मानदडं और उपयाि अपजिष्ट उपचार संयंत्रों या जल पानचरग ण संयंत्रों के अनरूा प। (8) इन स्ट्रैपिंग सपग याडों को अपने केंद्रों / इकाइयों को पररचालन िारू होन े के 12 महीनों के भीतर गाणवत्ता मानकों अथागत आईएसओ 9001 (गाणवत्ता प्रबंधन प्रणाली), आईएसओ 14001 (पयागवरण प्रबंधन प्रणाली) और आईएसओ 45001 (व्यावसाजयक स्ट्वास्ट््य और सारक्षा) के नवीनतम संस्ट्करणों के साथ मान्यता दने ी चाजहए। (9) यदद आरएसएफ में खतरनाक कचरे (जैसे ई-कचरा, सीसा एजसड बैटरी, जलजथयम आयन घटक, या दला गभ पृ्वी धाताओं की बरामदगी, आदद) के पानचगरण के जलए या स्ट्रैप सामग्री के पानचगरण के जलए, जो इसके दायरे से बाहर ह,ै पयागप्त क्षमता / प्रावधान नहीं ह ैं , तो ऐसी सामजग्रयों को अजधकृत ररसाइकलस ग / एजेंजसयों को बेचा जाना ह,ै जजनके पास पयागप्त क्षमता और लाइसेंस ह।ै लेन-दने का एक ररकॉड ग स्ट्पष्ट रूप से ऑफ-लोडडे वॉल्यूम और अजधकृत ररसाइक्लर / एजेंसी के नाम, प्राजधकरण संख्या,12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] पैन, जीएसटी और अन्य व्यावसाजयक जववरण बताते हुए रखा जाएगा। इस तरह के ररकॉड ग समय-समय पर लेखापरीक्षा के अधीन होंगे। 14. लाग ू अजधजनयम / जनयम भारत में प्रवर्थतत काननू ों के अलावा, जनम्नजलजखत अजधजनयमों/जनयमों के प्रावधान इन जनयमों के जलए लागू ह:ैं - i. मोटर वाहन अजधजनयम, 1988 ii. केंद्रीय मोटर वाहन जनयम, 1989 iii. जवजभन्न राज्य और यूटी मोटर वाहन जनयम, 1993 iv. समय-समय पर संिोजधत खतरनाक अपजिष्ट (प्रबंधन, हडैं पिंग सलग और सीमा पार आवागमन) जनयम, 2008 v. ओजोन घटान े वाले पदाथग (जवजनयमन और जनयंत्रण) जनयम, 2000 vi. 2016 में संिोजधत बैटरी (प्रबंधन और हडैं पिंग सलग) जनयम, 2011 vii. 2016 में यथा-संिोजधत प्लाजस्ट्टक अपजिष्ट (प्रबंधन और हडैं पिंग सलग) जनयम, 2011 viii. ई-वेस्ट्ट (प्रबंधन और हडैं पिंग सलग) जनयम 2016 15. लखे ापरीक्षा और प्रमाणन (1) इस अध्याय के अनापालन के जलए आरवीएसएफ का सक्षम अजधकारी द्वारा लेखा परीक्षा दकया जाएगा। (2) सक्षम प्राजधकारी की ओर स,े सीएमवीआर के जनयम 126 या सामग्री पानचगरण उद्योग संघ (एमआरएआई) या भारतीय ऑटोमोरटव अनासंधान सघं (एआरएआई) या भारतीय ऑटोमोबाइल जवजनमागता सोसायटी (जसयाम), समय-समय परसड़क पररवहन और राजमागग मंत्रालय द्वारा संिोजधत इस तरह की सचू ी के तहत एजेंजसयों में से कोई भी जनम्नजलजखत काय ग कर सकती ह ै क. जनयामक और अनापालन लेखा परीक्षा, और ख. आरवीएसएफ द्वारा वार्थर्क जववरण में भरे हुए मास लोलो विव्य की लेखा परीक्षा जैसा दक राज्य या केंद्र िाजसत प्रदिे सरकार द्वारा अजधसजू चत हो (3) लेखा परीक्षा ररपोटग एक जवत्तीय वर्ग या उसके दकसी भाग के जलए सालाना ऑजडट एजेंसी द्वारा वाहन पोटगल पर अपलोड दकया जाएगा और उस जवत्त वर्ग के 31 मई (जवत्तीय वर्ग के पूरा होने के दो महीने के भीतर) तक जमाकर ददया जाएगा। (4) ऑजडट ररपोटग पंजीकृत स्ट्रैपर द्वारा प्राप्त उनके प्रदिगन और व्यावसाजयक स्ट्वास्ट््य और सारक्षा अनापालन, जवजनयामक, व्यापार, पयागवरण और ्रमम मानकों और संबंजधत रीसाइपिंग सक्लग दरों, मास लोलो की जानकारी के आधार पर आरवीएसएफ का ग्रेड और मूल्यांकन करेगी।[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 13 (5) लेखा परीक्षा में ररपोटग दकए गए गैर अनापालन की रटप्पजणयों को ऑजडट ररपोटग के जारी होने के दो महीने के भीतर पंजीकृत द्वारा हल कर जलया जाना चाजहए जजसे सक्षम प्राजधकारी के जववेक पर अजधकतम एक महीन े तक बढाया जा सकता ह।ै (6) प्रमाणन को उनकी Short Title and commencement- (1) These rules may be called the Motor Vehicles (Registration and Functions of Vehicle Scrapping Facility) Rules, 2021. (2) They shall come into force on the date of their final publication in the Official Gazette 2. Application These provisions shall lay down the procedure for establishment of Registered Vehicle Scrapping Facility (RVSF). These will apply to all vehicles and their last registered owners, Automobile collection centres, Automotive Dismantling, Scrapping and Recycling Facilities and recyclers of all types of automotive waste products. 3. Definitions: - In these rules, unless the context otherwise requires- a. “Act” means the Motor Vehicles Act, 1988. b. “Registered Scrapper” means a person, firm, society, trust or company owning and operating a Registered Vehicle Scrapping Facility (hereinafter referred to as “RVSF”). c. “Registered Vehicle Scrapping Facility (RVSF)” means any establishment which holds a „Registration for Vehicle Scrapping‟ issued under this Chapter for carrying out dismantling and scrapping operations. d. “Certificate of Deposit” means the certificate issued by the RVSF to recognize the transfer of ownership of the vehicle from the registered owner to the Registered Scrapper for further treatment. e. “Certificate of Vehicle Scrapping” means the certificate issued by an RVSF to recognize the final disposal of a vehicle. f. “End of Life - Vehicles (ELV)” refers to all vehicles which are no longer validly registered; or declared unfit through Automated Fitness Centres; or their registrations have been cancelled under Chapter IV of the Act; or due to an order of a Court of Law; or are self-declared by the legitimate registered owner as a waste vehicle due to any circumstances that may arise from fire, damage, natural disaster, riots or accident etc. g. “Final Disposal” refers to the treatment of the vehicle so that the vehicle is no longer capable of being used as such, the evidence for which is the cut out of the Chassis and the disposal of its engine in accordance with CPCB Guidelines. h. “Registration Authority” means the Commissioner (Transport) or any other Officer designated by the Government of the State/UT for this purpose. i. “Recycling” means the reprocessing in a production process of the waste materials for the original purpose or for other purposes but excluding energy recovery. j. “Registered owner of an End of Life Vehicle” means: - i. the person in whose name the vehicle is formally registered in the National Register for Vehicles (VAHAN) or on the records of the State/UT transport department; or ii. the authorised representative of such person supported by documentary evidence; or iii. person who has gained ownership of the vehicle in a public auction in accordance with Rule 57 of the CMVR; iv. Person who has inherited the vehicle in accordance with Rule 56 of the CMVR; or v. In relation to a motor vehicle which is the subject of a hire-purchase, agreement, or an agreement of lease or an agreement of hypothecation, the person in possession of the vehicle under that agreement; k. “Rules” means the Central Motor Vehicle Rules (CMVR) and State specific Motor Vehicle Regulation (State MVR). l. “Scrapping” means the entire process from receipt and record of the „ELV‟ including depolluting, dismantling, segregation of material, safe disposal of non-reusable parts, and issuance of „Certificate of Vehicle Scrapping‟ to the registered owner of a motor vehicle. m. “Scrapping yard” means the designated location within the premises of the RVSF where dismantled vehicle parts are processed for further treatment including recycling. n. “Treatment” means any activity after the end of life vehicle has been handed over to a collection centre of an RVSF for depollution, dismantling, shearing, shredding, recovery or preparation for disposal of the shredder26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] wastes, and any other operation carried out for the recovery and/or disposal of the end of life vehicle and its components; o. “Vehicle” means a motor vehicle as defined in the Act; 4. Powers and obligations of RVSF The RVSF shall be provided connectivity and access to the VAHAN database of vehicle registration with password protected user ID and shall be authorized to make suitable entries regarding scrapping of the vehicle and issuance of Certificate of Deposit and Certificate of Scrapping, either directly or through their collection centre. (1) The RVSF must have necessary cyber security certifications for the IT Systems for safe access to the VAHAN database. (2) The RVSF shall be provided the necessary connectivity to verify the records of the vehicles produced for scrapping with the database of the stolen vehicles, held by NCRB as well with the local Police. It would be obligatory on the part of the RVSF to carry out such verification before scrapping a vehicle. (3) The RVSF shall undertake verification of the persons handing over the vehicle for scrapping to determine the bona fide of the vehicle owner or his authorized representative and retain a copy of the same for record for a minimum period of 6 months. 5. Conditions of Eligibility for RVSF The State Government/ Union Territory Governments shall take into account the eligibility criteria specified below when granting authorization to any RVSF making an application under clause 6: a. The RVSF may be owned and operated by any legal entity, be it a person, firm, society or trust established in accordance with the applicable laws. b. The entity must possess the following documents: - (i) Certificate of Incorporation (ii) Valid GST registration (iii) Valid PAN c. Additionally, the entity: - (i) Should have applied for or be in possession of an approval for consent to establish from the competent authority of the State or Union Territory Government in which the RVSF is intended to be located. (ii) Shall undertake to meet the minimum technical requirement for collection and dismantling centres as per Central Pollution Control Board Guidelines. (iii) Should have competent manpower and appropriate equipment to carry out the depollution and dismantling activities in a safe and environmentally responsible manner. (iv) Shall undertake to obtain the required quality certifications of ISO 9001(quality management system)/ISO 14001(environmental certification)/ISO 45001 (occupational health and safety) within 12 months of commencement of operations. (v) Should possess, or provide an undertaking to obtain, a consent to operate from State Pollution Control Board, within a period of six months from commencement of operations (vi) Should Undertake to abide by the Provisions of all applicable Labour codes and all other Acts/Rules as applicable. (vii) Shall provide evidence of availability of an adequate useable area of land in the Orange category industrial zone of the State/UT by way of ownership or agreement to sell or agreement for lease of a minimum period of three years. (viii) Should be in possession of necessary cyber security certifications as per clause 4 (2). (ix) Should provide approved plant layout and the building plan. 6. Registration Procedure for RVSF (1) An applicant may make an application in the prescribed Form-1, or any other form as may be prescribed by the designated Registration Authority of the State or Union Territory Government, addressed to the[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 27 „Registration Authority‟ of the concerned State or Union Territory Government where the RVSF is intended to be located along with: (i) A Processing Fee of Rs. 1,00,000/- (Rupees One Lakh only) for each RVSF proposed to be established, or such fee as may be prescribed by the State or Union Territory Government for this purpose. (ii) An Earnest Money Deposit by way of a bank guarantee of Rs. 10,00,000/- (Rupees Ten Lakhs) each RVSF proposed to be established, in favour of the designated Registration Authority or designated officer as notified by the State or Union Territory Government as a non-interest-bearing Security deposit for a period, co-terminus with the validity of the initial authorization period, plus 90 days. (2) All applications for grant of registration are to be disposed of by the Registration Authority within a period of 60 days from the date of application. (3) Applicants that are accepted are to be issued a Registration Certificate in Form-1A, or such other form as prescribed by the State or Union Territory Government for this purpose. (4) Applicants whose applications are rejected shall be refunded their Earnest Money/Bank Guarantee, however, the processing fee will not be refunded. (5) The State or Union Territory Government may notify additional eligibility requirements for the facility to ensure sustainability, adequate capacity and environment protection. (6) The Government of India will develop a portal for Single Window Clearance on which the applicant will apply with all necessary documents and required fee for registration. States or Union Territory Government would clear the proposal in time bound manner within 60 days including the internal approval from various State agencies (Labour, Pollution etc.) after submitting such application else the proposal would be deemed approved. Such portal shall be operationalized within 6-months from the date of notification of these rules. (7) After the operationalization of the portal referred to in clause 6, all subsequent approvals etc. should be granted through the portal and reports regarding the inspection and audit of RVSF should be made available on the portal. The necessary approvals by the State Pollution Control Board, Labour Department and any other department deemed necessary for the establishing/operation of such RVSF must be provided through that portal only. (8) The State or Union Territory Government must also publish a Citizen‟s Charter with respect to the functioning of the portal and grant of approvals on such portal. The process should be made transparent and seamless and all the notifications, guidelines, forms, etc. are made available on the portal established in clause 6, and the applications are electronically made and disposed-off in time-bound manner. 7. Validity and renewal of Registration (1) The Registration issued under Clause 6 shall be valid for an initial period of 10 years, which shall be renewable for another 10 years at a time, subject to the condition that the Registered Scrapper has not been in default of these provisions or applicable Laws and Acts as specified in Clause 14. (2) Application for renewal shall be in Form-1, or in any other form as may be prescribed by the State or Union Territory Government. The application shall carry such renewal fee and security deposit as may be specified by the State or Union Territory Government for this purpose. (3) The renewal of registration shall be issued as per Form-1A. (4) The registration issued under this rule shall not be transferable. 8. Criteria for Scrapping of Vehicles The following vehicles may be offered for scrapping to the Registered Scrapper: (i) Vehicles which have not renewed their Certificate of Registration in accordance with Rule 52 of the CMVR, 1989. (ii) Vehicles which have not been granted a certificate of fitness in accordance with Section 62 of the Motor Vehicles Act, 1988. (iii) Vehicles which have been damaged due to fire, riot, natural disaster, accident or any calamity, following which the registered owner self certifies the same as scrap. (iv) Vehicles that have been declared obsolete or surplus or beyond economic repair by the Central/State Organizations of the government and have been offered for scrapping.28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (v) Vehicles bought by any agency including RVSF in an auction for scrapping the vehicles. (vi) Vehicles which have outlived their utility or application particularly for projects in mining, highways, power, farms etc. as may be self-certified by the owner. (vii) Manufacturing rejects and test vehicles as may be certified by the Vehicle OEM. (viii) Auctioned, impounded and abandoned vehicles by any Enforcement Agency. 9. Right to Inspection (1) In order to ensure compliance of the provisions in this Chapter, the Registered Scrapper should keep in the RVSF, the records regarding the transaction of vehicles and scrap generation and its responsible disposal to authorized recyclers, and all the machinery, equipment and apparatus in the RVSF premises, ready for inspection by the Registration Authority or Designated Officer of the State or Union Territory Government. (2) Physical Inspection and Site visits should only be carried out: - i. When a report of non-compliance by the appropriate authority or a public complaint has been received by the Registration Authority in respect of the Registered Scrapper. ii. Such complaint has been forwarded to the Registered Scrapper to file a written response within 3 working days. iii. The response has been scrutinized and an opportunity has been provided to the Registered Scrapper to provide further clarifications within three working days. iv. The response and clarifications provided are inadequate in the opinion of the Registration Authority, and a site inspection is warranted. v. Such site visit should be duly authorized by the Registration Authority or the Designated Officer in the State or Union Territory Government. (3) The Report of the Inspection Team is to be submitted to the Registration Authority or Designated Officer for further processing and a copy of the same provided to the Registered Scrapper. (4) The Registration Authority may after providing an opportunity to the Registered Scrapper of being heard, pass a speaking order to cancel or suspend the authorization for the facility. Provided that the violations noticed in respect of Guidelines of CPCB shall be reported to the concerned Pollution Control Board for necessary action. The registration would remain suspended during the period while the requisite licences/NOC/Authorizations for the facility have been withdrawn or suspended by any other authority under the law. 10. Scrapping Procedure (1) The scrapping of vehicles shall be carried out by a Registered Scrapper by following the procedure outlined as mentioned below in respect of all ELVs, except impounded/ abandoned vehicles. (2) The registered owner or the authorized representative shall hand over the vehicle together with an Application as per Form-2 in two originals to the Registered Scrapper or the designated collection centre for deposit/treatment of the vehicle. (3) If the vehicle does not have a valid registration, then the Registered Scrapper or its designated centre, shall match the identity of the registered owner as per the VAHAN database with the person handing over the vehicle and receive the vehicle and issue a receipt through digital platform linked to VAHAN database. (4) Vehicles impounded by an Enforcement Agency shall be handed over to the Registered Scrapper as per procedure duly prescribed by the State or Union Territory Government. (5) It would be obligatory on the part of the RVSF to verify the records of the vehicles produced for scrapping with the database of the stolen vehicles, held by NCRB as well with the local Police, before scrapping a vehicle. (6) The Registered Scrapper shall require, along the Form-2, the following applicable original documents from the owner or the authorized representative: i. Original Certificate of Registration. ii. In case of inheritance, the death certificate of the registered owner accompanied with any proof of succession. iv. Certificate or order confirming the sale of the vehicle in a public auction in his favour duly signed by the person authorized to conduct the auction. v. An undertaking from the owner/representative, indicating that vehicle has no pending criminal record or litigation. (7) It shall be verified that the hire-purchase, lease or hypothecation agreement in the certificate of registration of a motor vehicle required under sub-section (2) of section 51 of the Act has been duly discharged. (8) The Registered Scrapper shall accept self-certified copies from the owner or through authorized representative of the following documents: - i. Copy of the PAN Card of the owner, ii. Crossed cheque of the bank account of the owner. iii. Identity Proof of the authorized representative (if applicable) such as Passport, Voter Card, Aadhar Card, Driving Licence, Photo Identity card issued by the State/Central Government Organizations. iv. Address Proof of the owner such as Electricity Bill, Water Bill, Land Line Telephone Bill, piped cooking gas bill etc. v. Digital photograph of the owner or authorized representative physically handing over the ELV to the Registered Scrapper, or a photograph of the owner/representative duly pasted in Form-2 and countersigned by the owner/representative. (9) The Registered Scrapper will return the second Form-2, duly receipted, to the owner or his authorized representative and issue the Certificate of Deposit as evidence of transfer of ownership of the vehicle. (10) The RVSF established in a State can accept and scrap the vehicles registered in any of the State/UTs under the jurisdiction of any Registering authority. The whole process shall be smooth linked with VAHAN and on PAN India basis irrespective of the location of any vehicle registering authority. (11) The „Certificate of Deposit‟ will be a necessary and sufficient document for the owner to avail incentives and benefits for purchase of a new vehicle as may be promulgated from time to time. (12) The Certificate of Deposit will be tradeable and once utilized will be stamped as “Cancelled” by the agency providing the benefits to the holder of the said certificate. Matching entries in this regard shall also be made by the RVSF on VAHAN Portal. (13) The Registered Scrapper shall digitally remit or pay by an account payee cheque, the agreed consideration for the vehicle and obtain a receipt for the same from the owner or his authorized representative for record. (14) Safe-custody of cut piece of the Chassis Number for a period of six months from the date of issue of „Certificate of Vehicle Scrapping‟ as per Clause 11 will be the responsibility of the Registered Scrapper. (15) The Registered Scrapper shall maintain a physical and computerized scanned copy of all documents, digitally certified by the Registration Officer or Designated Officer of the RVSF for record and examination during inspection, for a period as required by the Companies Act, 2013, as amended from time to time. (16) The Registered Scrapper shall ensure that removal / re-cycle or disposal of hazardous parts of the scrapped vehicle is done as per extant guidelines. (17) Vehicles will not be scrapped until the fuel, oil, antifreeze, and other gases, fluids etc. are drained and collected in certified standard containers. (18) A yearly report on vehicles scrapped shall be furnished in Form-3 or as prescribed by the Transport Department of the State or Union Territory Government. 11. Certificate of Vehicle Scrapping (1) The Registered Scrapper, after completing the necessary treatment, will issue a Digital „Certificate of Vehicle Scrapping‟, including a digital photograph of the cut out of the Chassis, in Form-4 to update the National Register, VAHAN Database and inform the competent authority of the State or Union Territory Government for updating of records. (2) A separate record of the scrapped vehicles would be maintained on the VAHAN database by the Central Government.30 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (3) The reuse/resale of any of the parts of an ELV including engines or any refurbished part, obtained from the scrapped vehicle shall be in accordance with the policy/guidelines/standards issued from time to time as applicable. 12. Installation of CCTV Cameras (1) The Registered Scrapper shall install CCTV cameras at the scrapping yard, in the customer and vehicle reception area. The record of scrapping should be saved in the Registered Scrapper‟s IT system for a period of three calendar months. (2) The access to the CCTV cameras installed in the facility may be provided to the authorized agencies as may be decided by the State or Union Territory Government. 13. Scrapping Yard (1) In view of the large size and voluminous nature of the scraps to be handled, the dismantling facility should be set up in a large area having adequate space for vehicular movement, as well as storage for the Vehicles/products received and recyclable material recovered. (2) It should fulfil the criteria of an adequate gated area to handle, depollute and dismantle ELVs, white goods and other scraps along with facility for measuring radiation as is followed for import of scrap. RVSF shall require material handling machines to minimize human intervention and create safe work places. (3) To ensure that safe operating practices are followed, collection centres are expected to follow Occupational Health and Safety Standards, ISO 45001 (OHSAS). All collection centres shall engage competent and trained manpower to process the End of Life vehicles, goods and other scraps. (4) The collection centres should have dry areas (free from water logging), impermeable surfaces like asphalt/concrete flooring, asphalt/concrete roads, adequate workshop facilities for in-house maintenance, fire protection systems etc. to maintain safe work places and all other required measures for keeping pollution under control. (5) The collection centres shall be equipped with a depollution system, preferably with zero discharge system, and dismantling work shall be done by making use of best available technology for processing the end of life vehicles, goods and other scraps. (6) The collection centres shall comply with relevant health and safety legislation/regulation and environmental norms as laid down by MoEF&CC, CPCB/SPCB for such operations and Hazardous & Other Wastes (Management & Transboundary Movement) Rules, 2016. (7) The Scrapping yard should have- a. Suitable earmarked area for parking of waste vehicles on non-permeable concrete or epoxy coated flooring with adequate drainage facility. No waste or potentially waste vehicle is to be parked on roads or public spaces even during processing of applications for deposit and to be accommodated within the premises of the RVSF only. b. Certified de-polluting equipment to ensure zero leakage of pollutants during draining of fuels/fluids/gases and liquids, Certified de-risking equipment for safe neutralization/removal of airbags, pre- tensioner etc., appropriate dismantling equipment for the activities defined (such as de-risking, de- polluting, dismantling, shredding, shearing, bailing etc.), designated areas for storing the segregated scrap, adequate space for storage and handling of segregated spares, designated space for temporary storage of automotive hazardous waste such as tyres, batteries, fuel, oils, liquids and gases, Suitable safety and occupational health equipment, material handling equipment for the safe transportation of spares, scrape etc. c. Appropriate Industrial grade lighting and ventilation systems, conformity to noise pollution norms and appropriate effluent treatment plants or water recycling plants. (8) These Scrapping yards should preferably accredit their centres/units with the latest version of quality standards viz. ISO 9001 (Quality management system), ISO14001 (Environmental Management System) and ISO 45001 (Occupational health and safety) within 12 months of commencement of operations. (9) In case the RVSF do not have adequate capability/provisions for responsible recycling of hazardous waste (like e-waste, lead acid batteries, lithium ion components, or for recovery of rare earth metals, etc.), or for recycling of scrap material which is outside its scope, then such materials are to be sold to duly authorized recyclers/agencies, who have adequate capability and licence. A record of the transactions shall be[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 31 maintained, clearly stating the volumes off-loaded and the name, authorization number, PAN, GST and other commercial details of the authorized recycler/agency. Such records shall be subjected to periodical audit. 14. Applicable Act /Rules In addition to the laws in force in India, the provisions of the following Act/ Rules are applicable to these rules: - i. The Motor Vehicle Act, 1988. ii. The Central Motor Vehicles Rules, 1989. iii. Various State and UT Motor Vehicles Rules, 1993 iv. The Hazardous Waste (Management, Handling and Transboundary movement) Rules, 2008 as amended from time to time. v. The Ozone Depleting Substances (Regulation and Control) Rules, 2000. vi. The Batteries (Management and handling) Rules, 2011 as amended in 2016. vii. The Plastic Waste (Management and Handling) Rules, 2011 as amended in 2016. viii. The e-waste (Management and Handling) Rules 2016. 15. Audits and Certifications (1) The RVSF will be audited by the competent authority for compliance with this Chapter. (2) On behalf of the competent authority, any of the agencies specified under Rule 126 of the CMVR or the Material Recycling Industry Associations (MRAI) or the Automotive Research Association of India (ARAI) or Society of Indian Automobile Manufacturers (SIAM), such list as modified by MoRTH from time to time, may undertake a. Regulatory and Compliance Audit, and b. Audit of the Mass Flow Statement filed in the Annual Returns by the RVSF as may be notified by the State or Union Territory Government. (3) The Audit Report shall be uploaded on the VAHAN portal by the Audit agency annually for a financial year or part thereof and shall be submitted by 31st May (within two months of completion of financial year) of that financial year. (4) The Audit Report shall also grade and evaluate the RVSF in terms of their performance and adherence to occupational health and safety compliances, regulatory, business, environment and labour standards and the respective recycling rates basis, the mass flow information, achieved by the Registered Scrapper. (5) Observations of non-compliance as reported in the Audit Report should be resolved by the Registered Scrapper within two months of issue of the Audit Report which may be extended by a maximum of one- month days at the discretion of the competent authority. (6) Certifications are to be revalidated at least 3 months before their expiry. 16. Appeal (1) Any person aggrieved by an order of the Registration Authority of the State or Union Territory Government for forfeiture of security or issuance of cancellation of the registration, may within thirty days of the date of receipt of such order appeal to the designated authority of the State or Union Territory Government or the Commissioner/Secretary (Transport). (2) The appeal shall be preferred in a plain application format, or, as may be prescribed by the Designated Authority of the State or Union Territory Government, setting forth the grounds of objections to the order of the Registration Authority and shall be accompanied by a certified copy of the order appealed against and fee of Rs 10,000/- (Rupees Ten Thousand only).
