जवजनर्िष्टा ह,ैं पाररजस्ट्थजतकी, पर्ाावरणीर् और िवै -जवजवधता की िजृ ष्ट स े पाररजस्ट्थजतकी संवेिी िोन के रूप म ें सुरजक्षत और संरजक्षत करना तथा उि पाररजस्ट्थजतकी संवेिी िोन में उद्योगों र्ा उद्योगों की श्रेजणर्ों के प्रचालन तथा प्रसंस्ट्करण को प्रजतजिद्ध करना आवश्र्क ह;ै अतः अब, केन्द्रीर् सरकार, पर्ाावरण (संरक्षण) जनर्मावली, 1986 के जनर्म 5 के उपजनर्म (3) के साथ परित पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) (जिसे इस अपधसूचना म ें इसके पश्चात् पर्ाावरण अजधजनर्म कहा गर्ा ह)ै की उपधारा (1)तथा धारा 3 की उपधारा (2) के खडं (v) और खंड (xiv) एवं उपधारा (3) के द्वारा प्रित्त िजिर्ों[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 का प्रर्ोग करत े हुए, मेघा्य राज्र् के दपिण गरो िहाड़ी पि्ा म ें बाघमारा पिचर प्ाांट अभयारण्य की सीमा के चारों ओर 0.2 म़ीटर से 857 म़ीटर तक जवस्ट्ताररत क्षेत्र को पाररजस्ट्थजतकी संवेिी िोन (जिसे इसमें इसके पश् चात ् पाररजस्ट्थजतकी संवेिी िोन कहा गर्ा ह)ै के रूप में अजधसूजचत करती ह,ै जिसका जववरण जनम्नानुसार ह,ै अथाात् :- 1. पाररजस्ट्थजतकी सवं िे ी िोन का जवस्ट्तार और सीमा- (1) पाररजस्ट्थजतकी संवेिी िोन का जवस्ट्तार बाघमारा पिचर प्ाांट अभयारण्य की स़ीमा के चारों ओर 0.2 मीटर से 857 म़ीटर तक पवथतृत ह ै और पाररजस्ट्थजतकी संवेिी िोन का क्षेत्रफल 0.2225 वग ा दकलोमीटर ह।ै राज्य सरकार द्वारा िाररपथिपतकी सांवेद़ी िोन का न्यूनतम पवथतार उपचत ठहराया गया िा कक ‘अभयारण्य बाघमारा शहर के केंद्र म ें पथित ह,ै यह मानव वास और बागवाऩी बागानों स े पघरा हुआ ह ै और अत:, यहाां अभयारण्य के चारों ओर िाररपथिपतकी सांवेद़ी िोन की थिािना के प्ए शायद ह़ी अन्य ित्रे ह।ै ’ (2) बाघमारा पिचर प्ाांट अभयारण्य और इसके पाररजस्ट्थजतकी संवेिी िोन की सीमा का जववरण अनलु ग्नक-I के रूप म ें संलग्न ह।ै (3) स़ीमा पववरण और अिाांश और देशाांतर के साि पाररजस्ट्थजतकी संवेिी िोन को स़ीमाांककत करत े हुए बाघमारा पिचर प्ाांट अभयारण्य के मानजचत्र अनलु ग्नक –IIक और अनलु ग्नक-IIख के रूप म ेंसंलग्न ह।ै (4) बाघमारा पिचर प्ाांट अभयारण्य और पाररजस्ट्थजतकी संवेिी िोन की स़ीमा के भू-जनिेिांकों की सूच़ी अनलु ग्नक –III की सारणी क और ख म ेंद़ी गई ह।ै (5) बाघमारा पिचर प्ाांट अभयारण्य के पाररजस्ट्थजतकी संवेिी िोन के अांतगगत कोई ग्राम नहीं ह।ै 2. पाररजस्ट्थजतकी संविे ी िोन के जलए आचं जलक महार्ोिना.–(1) राज्र् सरकार, द्वारा पाररजस्ट्थजतकी संवेिी िोन के प्रर्ोिन के जलए, रािपत्र म ें अंजतम अजधसूचना के प्रकािन की तारीख स े िो विा की अवजध के भीतर, स्ट्थानीर् व्यजिर्ों के परामिा से और इस अजधसूचना में दिए गए अनुबंधों का पालन करते हुए, राज्र् सरकार के सक्षम प्राजधकारी के अनुमोिनाथ ा एक आंचजलक महार्ोिना बनाई िार्ेगी। (2) राज्र् सरकार द्वारा पाररजस्ट्थजतकी संवेिी िोन के जलए आचंजलक महार्ोिना इस अजधसूचना में जवजनर्िष्ा ट रीजत स े तथा प्रासंजगक केंरीर् और राज्र् जवजधर्ों के अनुरूप तथा केंरीर् सरकार द्वारा िारी दििा जनििे ों, र्दि कोई हों, के अनुसार बनार्ी िाएगी। (3) आंचजलक महार्ोिना म ें पाररजस्ट्थजतकी और पर्ाावरण सबं ंधी सरोकारों को िाजमल करने के जलए इसे राज्र् सरकार के जनम्नजलजखत जवभागों के परामिा से बनार्ा िाएगा, अथाात:्- (i) पर्ाावरण; (ii) वन; (iii) िहरी जवकास; (iv) पर्ाटन; (v) नगरिाप्का; (vi) रािथव; (vii) कृजि; और (viii) मेघा्य राज्य प्रदिू ण पनयांत्रण बोडग। (4) िब तक इस अजधसूचना में जवजनर्िष्टा न हो, आंचजलक महार्ोिना में वतामान म ें अनमु ोदित भ-ू उपर्ोग, अवसंरचना और दक्रर्ाकलापों पर कोई प्रजतबंध नहीं लगार्ा िाएगा तथा आचंजलक महार्ोिना में सभी अवसंरचनाओं और दक्रर्ाकलापों में सुधार करके उन्द्ह ेअजधक िक्ष और पाररजस्ट्थजतकी-अनुकूल बनान ेकी व्यवस्ट्था की िाएगी।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (5) आंचजलक महार्ोिना म ें वनरजहत और अवक्रजमत क्षेत्रों के सुधार, जवद्यमान िल जनकार्ों के संरक्षण, िलग्रहण क्षेत्रों के प्रबंधन, िल-संभरों के प्रबंधन, भू-िल के प्रबंधन, मृिा और नमी के संरक्षण, स्ट्थानीर् िनता की आवश्र्कताओं तथा पाररजस्ट्थजतकी एव ं पर्ाावरण के ऐसे अन्द्र् पहलओंु की व्यवस्ट्था की िाएगी जिन पर ध्र्ान दिर्ा िाना आवश्र्क ह।ै (6) आंचजलक महार्ोिना में सभी जवद्यमान पूिा स्ट् थलों, ग्रामों एवं िहरी बजस्ट्तर्ों, वनों की श्रेजणर्ों एवं दकस्ट् मों, कृजि क्षेत्रों, ऊपिाऊ भूजम, उद्यानों एवं उद्यानों की तरह के हररत क्षेत्रों, बागवानी क्षेत्रों, बगीचों, झीलों और अन्द्र् िल जनकार्ों की सीमा का सहार्क मानजचत्र के साथ जनधाारण दकर्ा िाएगा और योिना म ें मौिूदा और प्रस्ट्ताजवत भ-ू उपर्ोग की जविेिताओं का ब्र्ौरा देते हुए मानपचत्रों को भी दशागया िाएगा। (7) आंचजलक महार्ोिना म ें पाररजस्ट्थजतकी संवेिी िोन म ें होने वाले जवकास का जवजनर्मन दकर्ा िाएगा और सारणी में र्थासूचीबद्ध पैराग्राफ 4 में प्रजतजिद्ध एव ं जवजनर्जमत दक्रर्ाकलापों का पालन दकर्ा िाएगा। इसमें स्ट् थानीर् िनता की आिीजवका की सुरक्षा के जलए पाररजस्ट्थजतकी-अनुकूल जवकास का भी सुजनश्चर् एवं संवधान दकर्ा िाएगा। (8) आंचजलक महार्ोिना, क्षेत्रीर् जवकास र्ोिना की सह-काजलक होगी । (9) अनुमोदित आंचजलक महार्ोिना, जनगरानी सजमजत के जलए एक संिभ ा िस्ट्तावेि होगी तादक वह इस अजधसूचना के उपबंधों के अनुसार जनगरानी के अपने कताव्यों का जनवाहन कर सके। 3. राज्र् सरकार द्वारा दकए िान े वाल े उपार्.- राज्र् सरकार इस अजधसूचना के उपबंधों को प्रभावी बनाने के जलए जनम्नजलजखत उपार् करेगी, अथाात्:- (1) भू-उपर्ोग.– (क) पाररजस्ट्थजतकी संवेिी िोन म ें वनों, बागवानी क्षेत्रों, कृजि क्षेत्रों, मनोरंिन के जलए जचजन्द्हत उद्यानों और खुल े स्ट्थानों का वृहि वाजणजज्र्क र्ा आवासीर् पररसरों र्ा औद्योजगक दक्रर्ाकलापों के जलए प्रर्ोग र्ा संपररवतान अनुमत नहीं दकर्ा िाएगा: परंत ु पाररजस्ट्थजतकी संवेिी िोन के भीतर ऊिर भाग (क), म ें जवजनर्िष्टा प्रर्ोिन से जभन्न प्रर्ोिन के जलए कृजि और अन्द्र् भूजम का संपररवतान, जनगरानी सजमजत की जसफाररि पर और सक्षम प्राजधकारी के पूवा अनमु ोिन स े क्षेत्रीर् नगर र्ोिना अजधजनर्म तथा र्था लाग ू केन्द्रीर् सरकार एव ं राज्र् सरकार के अन्द्र् जनर्मों एव ं जवजनर्मों के अधीन तथा इस अजधसूचना के उपबंधों के अनुसार स्ट्थानीर् जनवाजसर्ों की जनम्नजलजखत आवासीर् िरूरतों को पूरा करने के जलए अनुमत दकर्ा िाएगा िैसे:- (i) जवद्यमान सड़कों को चौड़ा करना, उन्द्ह ेंसुिढ़ृ करना और नई सड़कों का जनमााण करना; (ii) बुजनर्ािी ढांचों और नागररक सुजवधाओं का संजनमााण और नवीकरण; (iii) प्रििू ण उत्पन्न न करने वाल े लघ ुउद्योग; (iv) कुटीर उद्योग एवं ग्राम उद्योग; पाररजस्ट्थजतकी पर्ाटन में सहार्क सुजवधा भण्डार और स्ट्थानीर् सुजवधाए ं तथा गहृ वास; और (v) पैराग्राफ-4 में उजल्लजखत बढावा दिए गए दक्रर्ाकलापः परंत ु र्ह भी दक क्षेत्रीर् िहरी जनर्ोिन अजधजनर्म के अधीन सक्षम प्राजधकारी के पूवा अनमु ोिन के जबना तथा राज्र् सरकार के अन्द्र् जनर्मों एवं जवजनर्मों एवं संजवधान के अनुच्छेि 244 के उपबंधों तथा तत्समर् प्रवृत्त जवजध, जिसके अंतगता अनुसूजचत िनिाजत और अन्द्र् परंपरागत वन जनवासी (वन अजधकारों की मान्द्र्ता) अजधजनर्म, 2006 (2007 का 2) भी आता ह,ै का अनुपालन दकए जबना वाजणजज्र्क र्ा औद्योजगक जवकास दक्रर्ाकलापों के जलए िनिातीर् भूजम का प्रर्ोग अनुमत नहीं होगा: परंत ु र्ह भी दक पाररजस्ट् थजतकी संवेिी िोन के अतं गता आने वाली भूजम के अजभलेखों म ें हुई दकसी त्रुरट को, जनगरानी सजमजत के जवचार प्राि करन े के पश्चात,् राज्र् सरकार द्वारा प्रत्र्ेक मामल े म ें एक बार सुधारा िाएगा और उि त्रुरट को सुधारन े की सूचना केंरीर् सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् को िी िाएगी: परंत ु र्ह भी दक उपर्ुाि त्रुरट को सुधारन े म,ें इस उप-पैरा में र्था उपबंजधत के जसवार्, दकसी भी ििा म ें भू- उपर्ोग का पररवतान िाजमल नहीं होगा।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 (ख) अनप्रु र्क्तु र्ा अनुत् पािक कृजि क्षेत्रों म ें वनीकरण तथा पर्ावा ासों की बहाली के कायगक्ािों स े िुन: वऩीकरण के प्रर्ास दकए िाएंगे। (2) प्राकृजतक िल पनकाय.- सभी प्राकृजतक िलमागों के िलग्रहण क्षेत्रों की पहचान की िाएगी और आंचजलक महार्ोिना में उनके संरक्षण और बहाली की र्ोिना सज‍ मजलत की िाएगी और राज्र् सरकार द्वारा कदशा-पनदेश इस ऱीपत स े तैयार ककए िाएांगे दक उसमें ऐस े क्षेत्रों में या उसके िास जवकास दक्रर्ाकलापों को प्रजतजिद्ध और जनबंजधत दकर्ा िा सके िो ऐसे िेत्रों के प्ए हापनकारक हों। (3) पर्टा न एव ं पाररजस्ट्थजतकी पर्टा न.– (क) पाररजस्ट्थजतकी संवेिी िोन में सभी नए पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलाप र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार पाररजस्ट्थजतकी संवेिी िोन सांबांध़ी पर्ाटन महार्ोिना के अनुसार अनुमत होगा। (ख) पाररजस्ट्थजतकी पर्ाटन महार्ोिना राज्र् के पर्ाावरण और वन जवभाग के परामिा स े राज्य के पर्ाटन जवभाग द्वारा बनार्ी िाएगी। (ग) पर्ाटन महार्ोिना आंचजलक महार्ोिना का घटक होगी। (घ) पर्ाटन महार्ोिना पाररजस्ट्थजतकी संवेिी िोन की वहन क्षमता के अध्ययन के आधार पर तैर्ार की िार्ेगी। (ङ) पाररजस्ट्थजतकी पर्ाटन संबधं ी दक्रर्ाकलाप जन‍न ानुसार जवजनर्जमत दकए िाएंग,े अथाात:्- (i) सांरपित ित्रे की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, इनम ें िो भी अजधक जनकट हो, दकसी होटल र्ा ररिॉटा का नर्ा सजन्नमााण अनुमत नहीं दकर्ा िाएगाः परंत ु र्ह, पाररजस्ट्थजतकी पर्ाटन सुजवधाओं के जलए सांरपित ित्रे की सीमा स े एक दकलोमीटर की िरू ी स े परे पाररजस्ट्थजतकी संवेिी िोन की सीमा तक पूवा पररभाजित और अभीजहत क्षेत्रों में पर्टा न महार्ोिना के अनुसार, नए होटलों और ररिॉटा की स्ट्थापना अनुमत होगी; (ii) पाररजस्ट्थजतकी संवेिी िोन के अन्द्िर सभी नए पर्ाटन दक्रर्ाकलापों र्ा जवद्यमान पर्टा न दक्रर्ाकलापों का जवस्ट्तार, केन्द्रीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् द्वारा िारी दििाजनिेिों तथा पाररजस्ट्थजतकी पर्ाटन, पाररजस्ट्थजतकी-जिक्षा और पाररजस्ट्थजतकी-जवकास पर बल िेने वाल े राष्ट्रीर् व्याघ्र संरक्षण प्राजधकरण द्वारा िारी पाररजस्ट्थजतकी पर्ाटन संबंधी दििाजनिेिों (समर्-समर् पर र्था सिं ोजधत) के अनुसार होगा; (iii) आंचजलक महार्ोिना का अनुमोिन होने तक, पर्ाटन के जवकास और जवद्यमान पर्टा न दक्रर्ाकलापों के जवस्ट्तार को वास्ट्तजवक स्ट्थल-जवजिष्ट संवीक्षा तथा जनगरानी सजमजत की जसफाररि के आधार पर संबंजधत जवजनर्ामक प्राजधकरणों द्वारा अनुमत दकर्ा िाएगा और पाररजस्ट्थजतकी संवेिी िोन म ें दकसी नए होटल/ ररिॉट ा र्ा वाजणजज्र्क प्रजतष्ठान का संजन्नमााण अनुमत नहीं होगा । (4) प्राकृजतक जवरासत.– पाररजस्ट्थजतकी संवेिी िोन के अंतगता आने वाल े बहुमूल्र् प्राकृजतक जवरासत के सभी स्ट्थलों िैसे दक िीन पूल ररिवा क्षत्रे , िैल संरचना, िल प्रपात, झरन,े िरे, उपवन, गुफाए,ं स्ट्थल, वनपथ, रोहण माग,ा उत्प्रपात आदि की पहचान की िाएगी और उनकी सुरक्षा एव ं संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप म ें एक जवरासत संरक्षण र्ोिना बनार्ी िाएगी। (5) मानव जनर्मता जवरासत स्ट्थ ल.- पाररजस्ट्थजतकी संवेिी िोन म ें भवनों, संरचनाओं, कलाकृजत-क्षेत्रों तथा ऐजतहाजसक, स्ट्थापत्र् संबधी, सौंिर्ाात्मक और सांस्ट्कृजतक महत्व के क्षेत्रों की पहचान की िाएगी और उनके संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप में एक जवरासत संरक्षण र्ोिना बनार्ी िाएगी। (6) ध्व जन प्रििू ण.- पर्ाावरण अजधजनर्म के अधीन ध्वजन प्रििू ण (जवजनर्मन और जनर्त्रं ण) जनर्म, 2000 म ें जनर्त उपबंधों के अनुसार पाररजस्ट्थजतकी संवेिी िोन में ध्वजन प्रििू ण की रोकिाम और जनर्ंत्रण ककया िाएगा । (7) वार् ु प्रििू ण.- पाररजस्ट्थजतकी संवेिी िोन म,ें वार् ु प्रििू ण का जनवारण और जनर्ंत्रण, वार् ु (प्रििू ण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14) और उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार दकर्ा िाएगा ।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (8) बजहस्राव का पनथसरण.- पाररजस्ट्थजतकी संवेिी िोन में शोपधत बजहस्राव का जनस्ट्सरण, पर्ाावरण अजधजनर्म और उसके अधीन बनाए गए जनर्मों के अधीन आन े वाल े पर्ाावरणीर् प्रििू ण के जनस्ट्सरण के जलए साधारण मानकों र्ा राज्र् सरकार द्वारा जनर्त मानकों, िो भी अजधक किोर हो, के उपबंधों के अनुसार होगा। (9) िोस अपजिष्ट.- िोस अपजिष्ट का जनपटान एवं प्रबन्द्धन जनम्नानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी संवेिी िोन म ें िोस अपजिष्ट का जनपटान और प्रबंधन भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् की समर्-समर् पर र्था संिोजधत अजधसूचना सं. का.आ. 1357(अ), दिनांक 8 अप्रैल, 2016 के तहत प्रकाजित िोस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा; अकाबाजनक पिाथो का जनपटान पाररजस्ट्थजतकी संवेिी िोन स ेबाहर जचजन्द्हत दकए गए स्ट्थानों पर पर्ाावरण-अनुकूल रीजत से दकर्ा िाएगा; (ख) पाररजस्ट्थजतकी संवेिी िोन म ें मान्द्र् प्रौद्योजगदकर्ों का प्रर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप ठोस अपजिष्ट का सुरजक्षत और पर्ाावरण अनुकूल प्रबंधन (ईएसएम) अनुमत दकर्ा िार्ेगा। (10) िैव जचदकत्सा अिपशष्ट.- िैव जचदकत्सा अपजिष्ट का प्रबंधन जनम्नानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी संवेिी िोन म ें िैव जचदकत्सा अपजिष्ट का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की अजधसचू ना सं.सा.का.जन. 343 (अ), तारीख 28 माच,ा 2016 के तहत प्रकाजित िैव जचदकत्सा अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (ख) पाररजस्ट्थजतकी संवेिी िोन म ें मान्द्र् प्रौद्योजगदकर्ों का प्रर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनरूु प िैव पचककत्सा अपजिष्ट का सुरजक्षत और पर्ाावरण अनुकूल प्रबंधन अनुमत दकर्ा िार्ेगा। (11) प्लाजस्ट्टक अपजिष्ट का प्रबधं न.- पाररजस्ट्थजतकी संवेिी िोन में प्लाजस्ट्टक अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्-समर् पर र्था संिोजधत अजधसूचना सं.सा.का.जन 340(अ), तारीख 18 माचा, 2016 के तहत प्रकाजित प्लाजस्ट्टक अपजिष्ट प्रबंधन जनर्म, 2016 के उपबधं ो के अनुसार दकर्ा िाएगा। (12) जनमाणा और जवध्वसं अपजिष्ट का प्रबधं न.- पाररजस्ट्थजतकी संवेिी िोन में जनमााण और जवध्वंस अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्-समर् पर र्था संिोजधत अजधसूचना सं.सा.का.जन 317(अ), तारीख 29 माचा, 2016 के तहत प्रकाजित संजनमााण और जवध्वंस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (13) ई–अपजिष्ट.- पाररजस्ट्थजतकी संवेिी िोन में ई–अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् द्वारा प्रकाजित तथा समर्-समर् पर र्था संिोजधत ई–अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (14) वाहन-र्ातार्ात.- वाहन-र्ातार्ात को पर्ाावास-अनुकूल तरीके स े जवजनर्जमत दकर्ा िाएगा और इस संबंध म ें आंचजलक महार्ोिना में जवििे उपबंध िाजमल दकए िाएंग।े आंचजलक महार्ोिना के तैर्ार होने और राज्र् सरकार के सक्षम प्राजधकारी स े अनुमोदित होन े तक, जनगरानी सजमजत प्रासंजगक अजधजनर्मों और उनके तहत बनाए गए जनर्मों एव ं जवजनर्मों के अनुसार वाहन-र्ातार्ात के अनुपालन की जनगरानी करेगी। (15) वाहन िजनत प्रििू ण.- वाहन िजनत प्रििू ण की रोकथाम और जनर्ंत्रण लागू जवजधर्ों के अनुसार दकर्ा िाएगा और स्ट्वच्छतर ईंधन के उपर्ोग के जलए प्रर्ास दकए िाएगं े । (16) औद्योजगक ईकाइर्ा.ं- (क) रािित्र म ें इस अपधसूचना के प्रकाशन िर या उसके िश्चात पाररजस्ट्थजतकी संवेिी िोन के भीतर कोई नए प्रदिू णकाऱी उद्योगों की स्ट्थापना की अनुज्ञा नहीं िी िाएगी। (ख) केन्द्ऱीय प्रदिू ण पनयांत्रण बोडग द्वारा फरवऱी, 2016 द्वारा िाऱी समर्-समर् पर यिा संिोजधत मागगदशगक पसद्धान्तों म ें उद्योगों के वगीकरण के अनुसार, िब तक कक अपधसूचना म ें इस प्रकार पवपनर्दष्टग न हो, िाररपथिपतकी सांवेद़ी िोन के भ़ीतर केव् गैर-प्रदिू णकाऱी उद्योगों को अनुज्ञात ककया िाएगा और इसके अपतररक्त, गैर प्रदिू णकाऱी उद्योगों को बढ़ावा कदया िाएगा।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7 (17) पहाड़ी ढलानों का सरं क्षण.- पहाड़ी ढलानों का संरक्षण जनम्नानुसार दकर्ा िाएगा:- (क) आंचजलक महार्ोिना म ें पहाड़ी ढलानों के उन क्षेत्रों को ििाार्ा िाएगा जिनम ें दकसी भी संजनमााण की अनज्ञु ा नहीं होगी; (ख) जिन ढलानों र्ा जवद्यमान खड़ी पहाड़ी ढलानों म ें अत्र्जधक भ-ू क्षरण होता ह ै उनम ें दकसी भी संजनमााण की अनुज्ञा नहीं होगी । 4. पाररजस्ट्थजतकी संविे ी िोन म ें प्रजतजिद्ध र्ा जवजनर्जमत दकए िान े वाल े दक्रर्ाकलापों की सचू ी.- पाररजस्ट्थजतकी संवेिी िोन म ें सभी दक्रर्ाकलाप पर्ाावरण अजधजनर्म और उसके अधीन बने जनर्मों के उपबंधों जिसमें तटीर् जवजनर्मन िोन, 2011 एवं पर्ाावरणीर् प्रभाव आकलन अजधसूचना, 2006 िाजमल ह ै सजहत वन (संरक्षण) अजधजनर्म, 1980 (1980 का 69), भारतीर् वन अजधजनर्म, 1927 (1927 का 16), वन्द्र्िीव (संरक्षण) अजधजनर्म, 1972 (1972 का 53) तथा उनमें दकए गए संिोधनों के अनुसार िाजसत होंगे और नीच े िी गई सारणी म ें जवजनर्िष्टा रीजत स े जवजनर्जमत होंगे, अथाात:् - सारणी क्रम दक्रर्ाकलाप रटप्पणी स.ं (2) (3) (1) क. प्रजतजिद्ध दक्रर्ाकलाप 1. वा जणजज्र्क गौडाबमान जथरुमूलपाि बनाम भारत संघ के मामल े म ें माननीर् उच्चतम न्द्र्ार्ालर् के आदशे 4 अगस्ट्त, 2006 और 2012 की ररट र्ाजचका (जसजवल) स.ां 435 म ें गोवा फाउंडेिन बनाम भारत संघ के मामल े म ें तारीख 21 अप्रलै , 2014 के आिेि के अनुसरण म ेंहोगा । 2. प्रि िू ण (िल, वार्,ु मृिा, ध्वजन, पाररजस्ट्थजतकी संवेिी िोन म ें कोई नर्ा उद्योग लगाने और वतामान आदि) उत्पन्न करन े वाल े उद्योगों की प्रििू णकारी उद्योगों का जवस्ट्तार करने की अनमु जत नहीं होगीः स्ट्थापना । िरन्त ु यह कक केन्द्ऱीय प्रदिू ण पनयांत्रण बोडग द्वारा फरवऱी, 2016 म ें िाऱी समर्-समर् पर यिा संिोजधत मागगदशगक पसद्धान्तों म ें उद्योगों के वगीकरण के अनुसार, िब तक कक अपधसचू ना म ें ऐसा पवपनर्दष्टग न हों, िाररपथिपतकी सांवेद़ी िोन के भ़ीतर गैर-प्रदिू णकाऱी उद्योगों को अनुज्ञात ककया िाएगा और इसके अपतररक्त गैर-प्रदिू णकाऱी कुट़ीर उद्यागों को जमलों का जवस्ट्तार अनुमत नहीं होगा । 7. दकु ानदार द्वारा पोजलथीन बगै ों का प्रजतजिद्ध। उपर्ोग । 8. ईंट भट्टों की स्ट्थापना करना। प्रजतजिद्ध। 9. िल ावन लकड़ी का वाजणजज्र्क प्रजतजिद्ध। उपर्ोग। ख.जवजनर्जमत दक्रर्ाकलाप 10. हो टलों और ररसोटों की वाजणजज्र्क पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलापों हते ु लघ ु अस्ट्थार्ी संरचनाओं के जनमााण स्ट्थापना । के जसवार्, संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, इनम ें िो भी अजधक जनकट हो, नए वाजणजज्र्क होटलों और ररसोटो की स्ट्थापना अनुमत नहीं होगी: परंतु, संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर बाहर र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, इनमें िो भी अजधक जनकट हो, पर्ाटन महार्ोिना और लाग ू दििाजनिेिों के अनुसार सभी नए पर्ाटन दक्रर्ाकलाप करने र्ा जवद्यमान दक्रर्ाकलापों का जवस्ट्तार करने की अनुज्ञा होगी । 11. जन मााण दक्रर्ाकलाप । (क) संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक िो भी जनकट हो, दकसी भी प्रकार का नया वाजणजज्र्क जनमााण अनुमत नहीं दकर्ा िाएगा: परंतु स्ट्थ ानीर् लोगों को पैराग्राफ 3 के उप परै ाग्राफ (1) में सूचीबद्ध दक्रर्ाकलापों सजहत उनके उपर्ोग के जलए उनकी भूजम म ें स्ट्थानीर् पनवापसयों की आवासीर् आवश्र्कताओं को पूरा करन े जलए जनमााण करन े की अनुमपत भवन उपजवजधर्ों के अनुसार िी िाएगी। परन्द्तु ऐसे लघ ु उद्योगों िो प्रििू ण उत् पन्द् न नहीं करत े ह,ैं से संबंजधत जनमााण दक्रर्ाकलाप जवजनर्जमत दकए िाएंग े और लाग ू जनर्मों और जवजनर्मों, र्दि कोई हों, के अनुसार सक्षम प्राजधकारी की पूव ा अनुमपत स े ही न्द् र्नू तम पर रख ेिाएंग े । (ख) एक दकलोमीटर से आग े आंचजलक महार्ोिना के अनुसार जवजनर्जमत होंगे । 12. गैर प्रििू णकारी लघ ु िैमाने के फरवरी, 2016 म ें केन्द्रीर् प्रििू ण जनर्ंत्रण बोड ा द्वारा िारी, समर्-समर् उद्योग। पर यिा संिोजधत उद्योगों में वगीकरण के अनुसार गैर-प्रििू णकारी उद्योग और अपररसंकटमय, लघु और सेवा उद्योग, कृजि, पुष्प कृजि, बागवाऩी र्ा पाररजस्ट्थजतकी संवेिी िोन स े ििे ी सामग्री से उत्पािों को उत्पन्न करन े वाल े कृजि आधाररत उद्योग सक्षम प्राजधकारी द्वारा अनुज्ञात होंगे। 13. वृक्ष ों की कटाई । (क) राज्र् सरकार के सक्षम प्राजधकारी की पूवा अनुमपत के जबना वन भूजम र्ा सरकारी र्ा रािस्ट्व र्ा जनिी भूजम पर वृक्षों की कटाई नहीं होगी । (ख) वृक्षों की कटाई केंरीर् र्ा संबंजधत राज्र् के अजधजनर्म र्ा उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार जवजनर्जमत होगी ।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 9 14. वन उत्पािों और गैर काष्ठ वन उत्पािों लाग ूजवजधर्ों के अधीन जवजनर्जमत होगा । का संग्रहण । रा जत्र म ेंवाहन र्ातार्ात का संचलन । लाग ूजवजधर्ों के अधीन वाजणजज्र्क प्रर्ोिन के जलए जवजनर्जमत होगा । 21. स्ट्थ ानीर् िनता द्वारा अपनार्ी िा स्ट्थानीर् िनता के प्रर्ोग के जलए लागू जवजधर्ों के अधीन अनमु त होंगे। रही वतामान कृजि और बागवानी पद्धजतर्ों के साथ डेर्ररर्ां, िग्ु ध उत्पािन, िल कृजि और मत्स्ट्र् पालन। 22. फम ों, कारपोरेट और कंपजनर्ों द्वारा स्ट्थानीर् आवश्र्कताओं को परू ा करने के जलए लाग ू जवजधर्ों के अधीन बड़े पैमान े पर वाजणजज्र्क पिुधन जवजनर्जमत (अन्द्र्था प्रिान दकए गए) होंगे । संपिा और कुक्कुट फामों की स्ट्थापना। 23. प्रा कृजतक िल जनकार्ों र्ा भू क्षत्रे म ें िल जनकार्ों म ें published, as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry of a period of sixty days from the date on which copies of the Gazette containing this notification are made available e-mail address of the Ministry at esz-mef@nic.in Draft Notification WHEREAS, the Baghmara Pitcher Plant Sanctuary is situated in South Garo Hills district of Meghalaya and located within the Baghmara Town area covering an area of 0.027 square kilometres. The Sanctuary is named after the location of the Sanctuary and the Pitcher plant (Nepenthes khasiana) a rare insectivorous plant which is being protected and conserved in the Sanctuary. The area is declared as a Sanctuary in 1984 vides Govt. of Meghalaya Notification No. FOR 79/84/5 dated 24th May 1984. The[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 21 Sanctuary is lies within 25’11.00” N and 90.38.00 E” and is bounded by the Public Work Department (PWD) Road and weaving school compound for a distance of approximately 450 metres in the North, and in the Eastern side it is bounded by the Baghmara Police Station for approximately 135 metres. The Southern side is bounded by the Catholic Mission Compound for approximately 373 metres; AND WHEREAS, the flora and fauna of the Baghmara Pitcher Plant Sanctuary represent rich biological significance and the area is very rich in Pitcher Plant (Nepenthes khasiana) species which are of ecological and medicinal significance. Besides, pitcher plant, many endemic flora and fauna are found in the Sanctuary. In fact, the area has high level of endemism and the Pitcher Plant (Nepenthes khasiana) and Drosera spp, etc. are endemic species; major flora of the Sanctuary are nahar (Mesua ferrea), spike oak (Lithorcarpus elegans), siris tree (Albizia stipulata), artaki (Terminalia chebula), odal (Sterculia villosa), kum (Carrya arborea), dutkuri (Wrightia tomentosa), jarul (Lagerstroemia parviflora), varuna (Crateva nurvala), lakoocha (Artocarpus lacucha), wild jam (Syzygium spp), akhataru (Sapium baccatum), devil tree (Alstonia scholaris), paroli (Stereopermumchelenoides), bohera (Terminalia belarica), drooping fig (Ficus cunia), microcos (Microcos paniculata), java plum (Syzygium cumini), arani (Premna latifolia), large leaf rosemallow (Hibicus macrophyllus), macaranga (Macaranga tanarius), ficus spp. (Ficus benjamina), schizostachium spp. (Schizostachium dullooa), sal tree (Sorea robusta), toona (Toona ciliata), chaplasa (Artocarpus chaplasa), duabanga (Duabanga gradiflora), gia poma (Lanea grandis), amloki (Aphyllanthus emblica), dimiri tree (Ficus racemosa), cadam (Anthocephalus cadamba), oxi (Dilenia pentagyna), muga tree (Litsea polyenta), kimbal (Calicarpa arborea), rata (Amoora walichii), coromandel (Garcinia cowa), batgila (Oroxylum indicum), etc; AND WHEREAS, the Baghmara Pitcher Plant Sanctuary is also having species diversity from mammals viz. large brown flying squirrel (Petaurista phillipensis), hedge hog (Hemiechinus auritus), leopard cat (Felis begalensis), pangolin (Manis crassicaudata), slow loris (Nycticebus cauceang), Assamese macaque (Macaca assamensis), rhesus macaque (Macaca mulata), small Indian civet (Viverricula indica), Asiatic brush tailed porcupine (Atherurus macrourus ), common otter (Lutra lutra), Large Indian civet (Viverra zibetha), Malayan giant squirrel (Ratufa bicolour), etc; AND WHEREAS, the Baghmara Pitcher Plant Sanctuary is also a habitat for varieties of bird species as the India ring dove (Streptopelia clinensia), spotted dove (Streptopelia decaocto), common teal (Anas crecca), wood pecker (Picidae), pigeon duck (Anas penelop), Baer’s pochard (Aythya baeri), common kingfisher (Alcedo atthis), crested serpent eagle (Spilornis cheelad), hill myna (Gracula religiosa), red crested bulbul (Pycnonotus jocosus), greater racket tailed drongo (Dicrurus paradiseus), purple wood pigeon (Culumba puniceus), hoopoe (Upupa spp.), black crested bulbul (Pycnontus gularis), etc. while major reptiles available in the Sanctuary includes yellow monitor lizard (Varanus flavescenes), bengal monitor lizard (Varanus bengnalensis), water lizard (Varanus salvator), king cobra (Ophiphagus hanna), banded Krait (Bungarus fasciatus), green vipers (Trimeresurs gramineus), common krait (Bungarus caerulens), rat snake (Ptyas mucosa), common worm snake or blind snake (Typholops braminus), Diard’s blind snake (Typholops diadir), gecko (Gecko gecko), blind snake (Typholops braminus), etc; AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of Baghmara Pitcher Plant Sanctuary which are specified in paragraph 1 as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub-section (2) and (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from 0.2 metres to 857 metres around the boundary of Baghmara Pitcher Plant Sanctuary, in South Garo22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Hills in the State of Meghalaya as the Eco-sensitive Zone (hereafter in this notification referred to as the Eco-sensitive Zone) details of which are as under, namely: - 1. Extent and boundaries of the Eco-sensitive Zone. – (1) The Eco-sensitive Zone shall be to an extent of 0.2 metres to 857 metres around the boundary of Baghmara Pitcher Plant Sanctuary and the area of the Eco-sensitive Zone is 0.2225 square kilometres. The minimum extent of Eco-sensitive Zone was justified by the State Government that ‘the Sanctuary is located in the heart of Baghmara Town, it is surrounded by human habitations and horticultural plantations and therefore, there is hardly any area for establishment of Eco-sensitive Zone around the Sanctuary’. (2) The boundary description of Baghmara Pitcher Plant Sanctuary and its Eco-sensitive Zone is appended in Annexure-I. (3) The maps of the Baghmara Pitcher Plant Sanctuary demarcating the Eco-sensitive Zone along with boundary details and latitudes and longitudes are appended as Annexure-IIA and Annexure-IIB. (4) Lists of geo-coordinates of the boundary of Baghmara Pitcher Plant Sanctuary and the Eco-sensitive Zone are given in Table A and Table B of Annexure-III. (5) There is no village falling in the Eco-sensitive Zone of Baghmara Pitcher Plant Sanctuary. 2. Zonal Master Plan for Eco-sensitive Zone.-(1) The State Government shall, for the purposes of the Eco-sensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the competent authority of State. (2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan:- (i) Environment; (ii) Forest; (iii) Urban Development; (iv) Tourism; (v) Municipal; (vi) Revenue; (vii) Agriculture; and (viii) Meghalaya State Pollution Control Board. (4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 23 (6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features. (7) The Zonal Master Plan shall regulate development in the Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local communities’ livelihood. (8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan. (9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. 3. Measures to be taken by the State Government.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities: Provided that the conversion of agricultural and other lands, for the purposes other than that specified at part (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central Government or State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents and for activities such as:- (i) widening and strengthening of existing roads and construction of new roads; (ii) construction and renovation of infrastructure and civic amenities; (iii) small scale industries not causing pollution; (iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and (v) promoted activities given under paragraph 4: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the State Government and without compliance of the provisions of Article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph; (b) efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism or Eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco- sensitive Zone; (b) the Eco-Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with State Departments of Environment and Forests; (c) the Tourism Master Plan shall form a component of the Zonal Master Plan; (d) the Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco- sensitive Zone; (e) the activities of eco-tourism shall be regulated as under, namely:- (i) new construction of hotels and resorts shall not be allowed within one kilometre from the boundary of the protected area or upto the extent of the Eco-sensitive Zone whichever is nearer: Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan; (ii) all new tourism activities or expansion of existing tourism activities within the Eco- sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco- tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development; (iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-sensitive Zone area. (4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan. (5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan. (6) Noise pollution. - Prevention and control of noise pollution in the Eco-sensitive Zone shall be complied in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 under the Environment Act.[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 25 (7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be compiled in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder. (8) Discharge of effluents.- Discharge of treated effluent in the Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environment Act and the rules made thereunder or standards stipulated by State Government whichever is more stringent. (9) Solid wastes.- Disposal and Management of solid wastes shall be as under:- (a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone; (b) safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco- sensitive Zone. (10) Bio-Medical Waste.– Bio-Medical Waste Management shall be as under:- (a) the Bio-Medical Waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 343 (E), dated the 28th March, 2016; (b) safe and Environmentally Sound Management of Bio-Medical Wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco- sensitive Zone. (11) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time. (12) Construction and demolition waste management.- The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time. (13) E-waste.- The e - waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time. (14) Vehicular traffic.– The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (15) Vehicular pollution.- Prevention and control of vehicular pollution shall be incompliance with applicable laws and efforts shall be made for use of cleaner fuels.26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (16) Industrial units.– (a) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-sensitive Zone; (b) only non-polluting industries shall be allowed within Eco-sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, as amended from time to time, unless so specified in this notification, and in addition, the non-polluting cottage industries shall be promoted. (17) Protection of hill slopes.- The protection of hill slopes shall be as under:- (a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted; (b) construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted. 4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco- sensitive Zone shall be governed by the provisions of the Environment Act and the rules made there under including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE Sl. Construction activities. (a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the protected area or upto extent of the Eco-sensitive Zone, whichever is nearer: Provided that, local people shall be permitted to undertake construction in their land for their use including the activities mentioned in sub-paragraph (1) of paragraph 3 as per building bye-laws to meet the residential needs of the local residents: Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any. (b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan. 12. Small scale non polluting industries. Non polluting industries as per classification of industries issued by the Central Pollution Control Board in February, 2016 as amended from time to time, and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent authority.28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 13. Monitoring Committee for Monitoring the Eco-sensitive Zone Notification.- For effective monitoring of the provisions of this notification under sub-section (3) of section 3 of the Environment (Protection) Act, 1986, the Central Government hereby constitutes a Monitoring Committee, comprising of the following, namely:- Sl. Terms of reference. – (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification. (1) The tenure of the Monitoring committee shall be till further orders, provided that the non-official members of the Committee shall be nominated by the State Government from time to time. (2) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in30 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification. (3) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities. (4) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment Act, against any person who contravenes the provisions of this notification. (5) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (6) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden in the State as per proforma appended at Annexure IV. (7) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7. Additional measures.- The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification. 8. Orders of Supreme Court, etc.- The provisions of this notification shall be subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or the High Court or the National Green Tribunal.
